W-5, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="466775" lims:id="466775" level="1"><TitleText>Construction</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="466776" lims:id="466776"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466777" lims:id="466777">Construction</MarginalNote><Label>1.01</Label><Text>The provisions of this Act shall be liberally construed and interpreted to the end that the recognized obligation of the people and Government of Canada to those who have served their country so well and to their dependants may be fulfilled.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:fid="466779" lims:id="466779">R.S., 1985, c. 20 (3rd Supp.), s. 29</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="466780" lims:id="466780" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2015-02-26" lims:lastAmendedDate="2015-02-26" lims:fid="466781" lims:id="466781"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="466782" lims:id="466782">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2015-02-26" lims:fid="466783" lims:id="466783"><Label>(1)</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2015-02-26" lims:fid="466784" lims:id="466784"><Text><DefinedTermEn>adjudication</DefinedTermEn> means any decision, determination, refusal or award made under this Act pertaining to an allowance; (<DefinedTermFr>décision</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466785" lims:id="466785"><Text><DefinedTermEn>allowance</DefinedTermEn> means an allowance payable under this Act; (<DefinedTermFr>allocation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466786" lims:id="466786"><Text><DefinedTermEn>base calendar year</DefinedTermEn> means the calendar year ending next before the current payment period; (<DefinedTermFr>année civile de base</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466787" lims:id="466787"><Text><DefinedTermEn>blind</DefinedTermEn> has the meaning prescribed by regulations made under paragraph 25(q); (<DefinedTermFr>aveugle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466788" lims:id="466788"><Text><DefinedTermEn>Board</DefinedTermEn> means the Veterans Review and Appeal Board established by section 4 of the <XRefExternal reference-type="act" link="V-1.6">Veterans Review and Appeal Board Act</XRefExternal>; (<DefinedTermFr>Tribunal</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466789" lims:id="466789"><Text><DefinedTermEn>child</DefinedTermEn> means a child of</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466790" lims:id="466790"><Label>(a)</Label><Text>a veteran,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466791" lims:id="466791"><Label>(b)</Label><Text>a veteran’s survivor who, having been a recipient, marries and</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466792" lims:id="466792"><Label>(i)</Label><Text>whose spouse of that marriage dies, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466793" lims:id="466793"><Label>(ii)</Label><Text>whose marriage ends in dissolution or legal separation, or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466794" lims:id="466794"><Label>(c)</Label><Text>a veteran’s survivor who, having been a recipient, acquires a common-law partner and</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466795" lims:id="466795"><Label>(i)</Label><Text>whose common-law partner dies, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466796" lims:id="466796"><Label>(ii)</Label><Text>who ceases to cohabit with that common-law partner,</Text></Subparagraph></Paragraph><ContinuedDefinition lims:inforce-start-date="2015-02-26" lims:fid="466797" lims:id="466797"><Text>and includes an adopted child or a foster child of a veteran, and a child, adopted child or foster child of a veteran’s spouse or common-law partner; (<DefinedTermFr>enfant</DefinedTermFr>)</Text></ContinuedDefinition></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466798" lims:id="466798"><Text><DefinedTermEn>common-law partner</DefinedTermEn>, in relation to an individual, means a person who is cohabiting with the individual at the relevant time in a conjugal relationship, having so cohabited for a period of at least one year. For greater certainty,</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466799" lims:id="466799"><Label>(a)</Label><Text>in the case of an individual’s death, the <DefinedTermEn>relevant time</DefinedTermEn> means the time of that death; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466800" lims:id="466800"><Label>(b)</Label><Text>common-law partners cease to be common-law partners when they cease to cohabit; (<DefinedTermFr>conjoint de fait</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466801" lims:id="466801"><Text><DefinedTermEn>Consumer Price Index</DefinedTermEn>, in relation to any adjustment quarter, means the average of the Consumer Price Index for Canada, as published by Statistics Canada under the authority of the <XRefExternal reference-type="act" link="S-19">Statistics Act</XRefExternal>, for each month in that adjustment quarter; (<DefinedTermFr>indice des prix à la consommation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466802" lims:id="466802"><Text><DefinedTermEn>current fiscal year</DefinedTermEn><Repealed>[Repealed, 1998, c. 21, s. 121]</Repealed></Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466803" lims:id="466803"><Text><DefinedTermEn>current payment period</DefinedTermEn>, in relation to a month, means the payment period that includes the month; (<DefinedTermFr>période de paiement en cours</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466804" lims:id="466804"><Text><DefinedTermEn>Department</DefinedTermEn> means the Department of Veterans Affairs; (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466805" lims:id="466805"><Text><DefinedTermEn>dependent child</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466806" lims:id="466806"><Label>(a)</Label><Text>a child who has no spouse or common-law partner and is</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466807" lims:id="466807"><Label>(i)</Label><Text>under the age of eighteen years,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466808" lims:id="466808"><Label>(ii)</Label><Text>under the age of twenty-five years and following and making satisfactory progress in a course of instruction approved by the Minister,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466809" lims:id="466809"><Label>(iii)</Label><Text>under the age of twenty-one years and prevented by physical or mental incapacity from earning a livelihood, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466810" lims:id="466810"><Label>(iv)</Label><Text>over the age of twenty-one years and prevented by physical or mental incapacity from earning a livelihood, where the incapacity occurred before the child attained the age of twenty-one years, or after the age of twenty-one years and before the age of twenty-five years while following and making satisfactory progress in a course of instruction approved by the Minister, or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466811" lims:id="466811"><Label>(b)</Label><Text>a child referred to in subparagraph (a)(i), (ii), (iii) first day of November next before that first day of April,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466814" lims:id="466814"><Label>(b)</Label><Text>if the payment quarter commences on the first day of July, the period of three months commencing on the first day of February next before that first day of July,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466815" lims:id="466815"><Label>(c)</Label><Text>if the payment quarter commences on the first day of October, the period of three months commencing on the first day of May next before that first day of October, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466816" lims:id="466816"><Label>(d)</Label><Text>if the payment quarter commences on the first day of January, the period of three months commencing on the first day of August next before that first day of January; (<DefinedTermFr>premier trimestre de the military operations undertaken by the United Nations to restore peace in the Republic of Korea during the period from June 25, 1950 to July 27, 1953, inclusive; (<DefinedTermFr>guerre de Corée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466818" lims:id="466818"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Veterans Affairs; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466819" lims:id="466819"><Text><DefinedTermEn>orphan</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466820" lims:id="466820"><Label>(a)</Label><Text>a child who is bereft by death of his or her parents,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466821" lims:id="466821"><Label>(b)</Label><Text>a child who is bereft by death of one parent and whose surviving parent has, in the opinion of the Minister, abandoned or deserted the child, or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466822" lims:id="466822"><Label>(c)</Label><Text>a child of</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466823" lims:id="466823"><Label>(i)</Label><Text>divorced or separated parents, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="466824" lims:id="466824"><Label>(ii)</Label><Text>parents who are neither spouses nor common-law partners of each other</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2015-02-26" lims:fid="466825" lims:id="466825"><Text>who is bereft by death of a parent who, at the time of death, was receiving an additional allowance in respect of that child or would have been eligible to receive an additional allowance in respect of that child but for the level of that parent’s income, lims:id="466852"><Text><DefinedTermEn>survivor</DefinedTermEn>, in relation to an individual, means</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466853" lims:id="466853"><Label>(a)</Label><Text>a surviving spouse or surviving common-law partner of that individual who is not a veteran and who has not remarried or married, as the case may be, or acquired a subsequent common-law partner,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466854" lims:id="466854"><Label>(b)</Label><Text>a surviving spouse or surviving common-law partner of that individual who is not a veteran, who has remarried or married, as the case may be, and whose spouse of that marriage dies or whose marriage ends in dissolution or legal separation, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466855" lims:id="466855"><Label>(c)</Label><Text>a surviving spouse or surviving common-law partner of that individual who is not a veteran, who has acquired a subsequent common-law partner and whose subsequent common-law partner dies or who ceases to cohabit with that common-law partner; (<DefinedTermFr>survivant</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="466856" lims:id="466856"><Text><DefinedTermEn>veteran</DefinedTermEn> means any former member of the North West Field Force and any of the following persons, more particularly described in section 37, 317]</Repealed></Text></Definition></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="466866" lims:id="466866"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="466867" lims:id="466867">Surviving spouse of allied veteran</MarginalNote><Label>(2)</Label><Text>For the purposes of this Act, the definition <DefinitionRef>survivor</DefinitionRef> in subsection (1) includes a person who has resided in Canada for a total period of at least 10 years and who was the spouse or common-law partner of an individual at the time of the individual’s death and the individual</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466868" lims:id="466868"><Label>(a)</Label><Text>died after October 13, 2008;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466869" lims:id="466869"><Label>(b)</Label><Text>was, at the time of death, a resident in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="466870" lims:id="466870"><Label>(c)</Label><Text>was, at the time of death, an individual described in subsection 37(4.1) or (4.2), even if they had not resided in Canada for a total period of at least 10 years, but only if the total of the time they resided in Canada prior to their death and the time that has elapsed since their death is at least 10 lims:id="466872">Survivor — limitation</MarginalNote><Label>(3)</Label><Text>For the purposes of the definition <DefinitionRef>survivor</DefinitionRef> in subsection (1), a spouse or common-law partner is the survivor of an allied veteran referred to in paragraph 37(4)(d.1) or subsection 37(4.1) or (4.2) only if that allied veteran died after October 13, and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="466898" lims:id="466898"><Label>(c)</Label><Text>determine the monthly allowance payable to the veteran, survivor or orphan by subtracting from the applicable monthly allowance ceiling determined under paragraph (b) the current monthly benefits, if any,</Text><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="466899" lims:id="466899"><Label>(i)</Label><Text>payable under the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal> or, if no such benefits are payable, such benefits as are deemed to be payable pursuant to regulations made under paragraph 25(p), to or in respect of the veteran and the veteran’s spouse or common-law partner, if any, or the survivor or orphan, as the case may be, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="466900" lims:id="466900"><Label>(ii)</Label><Text>payable under section 34 of the <XRefExternal reference-type="act" link="V-1.6">Veterans Review and Appeal Board Act</XRefExternal>, any enactment prescribed by regulations made under section 25, or any similar or equivalent laws of the country in whose forces the veteran served.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="466901" lims:id="466901"><MarginalNote lims:inforce-start-date="2013-10-01" lims:fid="466902" lims:id="466902">Payment where recipient absent from Canada</MarginalNote><Label>(4)</Label><Text>Notwithstanding subsection (1), the allowance payable under this section to a veteran, survivor or orphan may be paid to that veteran, survivor or orphan who absents himself or herself from Canada after July 31, 1960 if, on the day that he or she leaves Canada, he or she</Text><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="466903" lims:id="466903"><Label>(a)</Label><Text>is a recipient of an allowance under this section or section 5; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="466904" lims:id="466904"><Label>(b)</Label><Text>had been resident in Canada for the twelve months immediately preceding that day.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="466905" lims:id="466905"><MarginalNote lims:inforce-start-date="2013-10-01" lims:fid="466906" lims:id="466906">Payment to survivors and orphans resident outside Canada</MarginalNote><Label>(5)</Label><Text>Notwithstanding anything in this section, the allowance payable under this section to a survivor or orphan may be paid to</Text><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="466907" lims:id="466907"><Label>(a)</Label><Text>the survivor of a recipient if that survivor resides outside Canada and was living with, maintaining or being maintained by that recipient at the time of the recipient’s death; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="466908" lims:id="466908"><Label>(b)</Label><Text>an orphan of a recipient if that orphan resides outside Canada and if that recipient, at the time of death,</Text><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="466909" lims:id="466909"><Label>(i)</Label><Text>was receiving an additional allowance in respect of the child, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="466910" lims:id="466910"><Label>(ii)</Label><Text>would have been eligible to receive an additional allowance in respect of the child but for the level of the recipient’s income.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="466911" lims:id="466911"><MarginalNote lims:inforce-start-date="2013-10-01" lims:fid="466912" lims:id="466912">Exception — allied veterans</MarginalNote><Label>(5.1)</Label><Text>Subsections (4) and (5) do not apply to an allied veteran referred to in paragraph 37(4)(d.1) or subsection 37(4.1) or (4.2) or to the survivor or orphan of that veteran.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="466913" lims:id="466913"><MarginalNote lims:inforce-start-date="2013-10-01" lims:fid="466914" lims:id="466914">Veteran couples</MarginalNote><Label>(6)</Label><Text>Where spouses residing together, or common-law partners, are both veterans, each may be paid the allowance that would be payable under this section if each veteran were a veteran without a spouse or common-law partner.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="466915" lims:id="466915"><MarginalNote lims:inforce-start-date="2013-10-01" lims:fid="466916" lims:id="466916">Veteran couples</MarginalNote><Label>(6.1)</Label><Text>Where one of the veterans referred to in subsection (6) is not entitled to any allowance under that subsection, each may be paid the allowance that would be payable under this section if each veteran</Text><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="466917" lims:id="466917"><Label>(a)</Label><Text>were a veteran without a spouse or common-law partner; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="466918" lims:id="466918"><Label>(b)</Label><Text>had one half of the aggregate of the income and benefits of both veterans.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="466919" lims:id="466919"><MarginalNote lims:inforce-start-date="2013-10-01" lims:fid="466920" lims:id="466920">Dependent child allowance exception</MarginalNote><Label>(7)</Label><Text>Notwithstanding subsection (6), either veteran referred to in that subsection is entitled to an allowance in respect of a dependent child of either or both of the veterans.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="466921" lims:id="466921"><MarginalNote lims:inforce-start-date="2013-10-01" lims:fid="466922" lims:id="466922">If couple not residing together</MarginalNote><Label>(8)</Label><Text>If the Minister is satisfied that an applicant and their spouse or common-law partner, or a recipient and their spouse or common-law partner, are not residing together as a result of one or both of them having to reside in a treatment or care facility or as a result of any other circumstances that are prescribed by regulations made under section 25, the Minister may direct that the applicant and spouse or common-law partner, or the recipient and spouse or common-law partner, as the case may be, be treated in the same manner as if they were persons referred to in subsection (6) and each person had one half of the aggregate of the income and benefits of both persons, and in that case, if the Minister deems it appropriate, the Minister shall apportion the allowances payable to them having regard to the circumstances of each of them and any dependent children involved.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-01" lims:fid="466924" lims:id="466924">R.S., 1985, c. lims:inforce-start-date="2003-01-01" lims:fid="466927" lims:id="466927">Death of veteran</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466928" lims:id="466928"><Label>(1)</Label><Text>On the death of a veteran who, at the time of their death or at any time within the last twelve months of their life, was a recipient of an allowance under section 4, the Minister may, in the Minister’s discretion and within twelve months from the date of the death, award a monthly allowance to the veteran’s survivor.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466929" lims:id="466929"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466930" lims:id="466930">Amount of allowance</MarginalNote><Label>(1.1)</Label><Text>The monthly allowance payable to a survivor under this section shall be computed in the same manner as a monthly allowance under section 4, except that the applicable monthly income factor referred to in paragraph 4(3)(a) in respect of the survivor shall be a monthly income factor specified in column II of the schedule opposite paragraph 2(a), (b) or (c) of the schedule, whichever is applicable, as if the survivor were a veteran described in paragraph 2(a) of the schedule.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466931" lims:id="466931"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466932" lims:id="466932">Inclusion of amount for dependent child</MarginalNote><Label>(1.2)</Label><Text>A monthly allowance payable to a survivor under this section shall, where the veteran who died left one or more dependent children, include an amount in respect of the child or children computed in accordance with the income factor specified in column II of the schedule opposite paragraph 2(d) of the schedule.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466933" lims:id="466933"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466934" lims:id="466934">Death of spouse or common-law partner</MarginalNote><Label>(2)</Label><Text>On the death of a spouse or common-law partner in respect of whom a veteran was, at the time of the death or at any time within the twelve months immediately preceding the death, a recipient of an allowance under section 4, the Minister may, in the Minister’s discretion and within twelve months from the date of the death, award to that veteran a monthly allowance payable in the same manner and to the same extent as if the veteran were a survivor referred to in subsections (1) to (1.2).</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466935" lims:id="466935"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466936" lims:id="466936">Death of child</MarginalNote><Label>(3)</Label><Text>On the death of a child in respect of whom a veteran or the survivor of a veteran was, at the time of the death or at any time within the twelve months immediately preceding the death, the recipient of an allowance under section 4, the Minister may, in the Minister’s discretion and within twelve months from the date of the death, award to that veteran or survivor a monthly allowance payable in the same manner and to the same extent as if the veteran or survivor were a survivor referred to in subsections (1) to (1.2).</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466937" lims:id="466937"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466938" lims:id="466938">Limitation on allowance payable</MarginalNote><Label>(4)</Label><Text>Notwithstanding anything in this Act, no allowance under this section is payable on the death of a veteran or of a spouse, common-law partner or child of a veteran in respect of any period more than twelve months after the month in which death occurs, and no other allowance is payable under this Act to a person to whom any allowance under this section has been awarded, during any period in respect of which the allowance so awarded is payable to that person.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466939" lims:id="466939"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466940" lims:id="466940">Applications pending at time of death</MarginalNote><Label>(5)</Label><Text>Where, at any time after March 31, 1955, a veteran dies and, at the time of death,</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="466941" lims:id="466941"><Label>(a)</Label><Text>the veteran was eligible for an allowance under section 4, and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="466942" lims:id="466942"><Label>(b)</Label><Text>an application for that allowance made by the veteran and received by the Minister was pending,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2003-01-01" lims:fid="466943" lims:id="466943"><Text>the veteran shall, if the Minister so directs, be deemed, for the purposes of subsection (1), to have been a recipient of that allowance at the time of death.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466944" lims:id="466944"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466945" lims:id="466945">Saving</MarginalNote><Label>(6)</Label><Text>Notwithstanding the time limitation of twelve months within which the Minister may make an award under subsection (1), (2) or (3), the Minister may make an award under any of those subsections after the expiration of those twelve months where, as determined by the Minister, the failure to make an award within those twelve months was caused by administrative oversight.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:id="466955"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466956" lims:id="466956">Continuation of allowance</MarginalNote><Label>6.2</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466957" lims:id="466957"><Label>(1)</Label><Text>Subject to this Act, an allowance payable under section 4 or awarded under section 5, on or before February 27, 1995, to or in respect of a person who is an allied veteran within the meaning of paragraph 37(4)(b) or an allied dual service veteran within the meaning of paragraph 37(6)(b), as those paragraphs read immediately before that day, shall continue to be paid during the lifetime of the recipient and shall cease with the payment for the month in which the recipient dies.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466958" lims:id="466958"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466959" lims:id="466959">Continuation of right to allowance</MarginalNote><Label>(2)</Label><Text>Subject to this Act but notwithstanding subsections 4(4) and (5), a survivor or orphan of an allied veteran or an allied dual service veteran to whom payment of an allowance was continued by subsection (1) may, on or after February 27, 1995, apply for and be paid an allowance under section 4 or be awarded an allowance under section 5, and any allowance so paid or awarded shall continue to be paid during the lifetime of the recipient and shall cease with the payment for the month in which the recipient dies.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466960" lims:id="466960"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466961" lims:id="466961">When no allowance payable</MarginalNote><Label>(3)</Label><Text>No allowance under section 4 or 5 shall be paid to or in respect of a person referred to in subsection (1) or (2) for any month after February, 1996 in which the person resides outside Canada.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466962" lims:id="466962"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466963" lims:id="466963">Residency requirement</MarginalNote><Label>(4)</Label><Text>In determining the rate of an allowance referred to in subsection (1) or (2) after February 29, 1996, a person is maintained by another, dependent on another or a dependent child of another only if the person is resident in Canada.</Text></Subsection><Subsection lims:id="466965">Exceptions</MarginalNote><Label>(5)</Label><Text>Notwithstanding subsections (3) and (4), a person to whom subsection (1) or (2) applies who</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="466966" lims:id="466966"><Label>(a)</Label><Text>at any time during the period beginning on March 1, 1995 and ending on December 19, 1995, was in receipt of, or had a right to receive, an allowance referred to in subsection (1) while residing outside Canada, or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="466967" lims:id="466967"><Label>(b)</Label><Text>was the spouse, common-law partner or child of an allied veteran or an allied dual service veteran referred to in subsection (1) who, at any time during the period beginning on March 1, 1995 and ending on December 19, 1995, was in receipt of, or had a right to receive, an allowance referred to in subsection (1) while residing outside Canada</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2003-01-01" lims:fid="466968" lims:id="466968"><Text>shall, subject to this Act, be paid their allowance, during their lifetime, for any month beginning after February 1996 in which the person resides outside Canada and ending with such month as the Minister may fix by reference-type="act" link="C-44.6">Corrections and Conditional Release Act</XRefExternal>, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2003-01-01" lims:fid="466982" lims:id="466982"><Label>(iv)</Label><Text>the <XRefExternal reference-type="act" link="R-10.6">Royal Canadian Mounted Police Pension Continuation Act</XRefExternal>, chapter R-10 of the Revised Statutes of Canada, 1970;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="466983" lims:id="466983"><Label>(b)</Label><Text>there shall not be included in income of the person for the year</Text><Subparagraph lims:inforce-start-date="2003-01-01" lims:fid="466984" lims:id="466984"><Label>(i)</Label><Text>casual earnings in the year being net income from employment, self-employment or rental of property the aggregate of which from those sources does not exceed, in respect of the person, the person and the person’s spouse or common-law partner or the person and the person’s spouse or common-law partner who is a veteran, as the case may be, such applicable maximum amount as is prescribed by regulations made under section 25 in respect of a person without a spouse or common-law partner, a person with a spouse or common-law partner and a person with a spouse or common-law partner who is a veteran,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2003-01-01" lims:fid="466985" lims:id="466985"><Label>(ii)</Label><Text>net interest income in the year from any source the aggregate of which does not exceed, in respect of the person or the person and the person’s spouse or common-law partner, as the case may be, such applicable maximum amount as is prescribed by regulations made under section 25 in respect of a person without a spouse or common-law partner and a person with a spouse or common-law partner,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2003-01-01" lims:fid="466986" lims:id="466986"><Label>(iii)</Label><Text>any amount paid under any law that provides compensation to workers injured in the course of their employment as an attendance allowance in respect of the person or the person’s spouse or common-law partner, if any, or the person’s survivor or orphan, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2003-01-01" lims:fid="466987" lims:id="466987"><Label>(iv)</Label><Text>any amount paid to the person or the person’s spouse or common-law partner, if any, or the person’s survivor or orphan by reason of a decoration for gallantry;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="466988" lims:id="466988"><Label>(c)</Label><Text>business losses and capital losses shall be taken into account in the year in which those losses occurred;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="466989" lims:id="466989"><Label>(d)</Label><Text>dividend income shall be taken into account on the basis of the actual amount of the dividend; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="466990" lims:id="466990"><Label>(e)</Label><Text>paragraph (d) of the definition <DefinitionRef>income</DefinitionRef> in section 2 of the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal> does not apply.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="466991" lims:id="466991"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="466992" lims:id="466992">If change to other Acts</MarginalNote><Label>(2)</Label><Text>Despite subsection (1), if it appears to the Governor in Council that any amendment to the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> or the regulations made under that Act, or to the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal>, would result in a significant change in the amount of any allowance payable in respect of any class of persons under this Act, the Governor in Council may make orders to alleviate the effect of the change by deeming, for the purposes of this Act, revenue specified in the orders, or a part of that revenue, to be or not to be, as the case may require, income of a person referred W-3, s. 11; 2000, c. 12, s. 330(F), c. 34, s. 90(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="467041" lims:id="467041"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467042" lims:id="467042">Allowance only to dependent child</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467043" lims:id="467043"><Label>(1)</Label><Text>Except where an allowance is payable to a person other than by virtue of that person being a child, no allowance shall be paid to or in respect of a child unless the child is a dependent child.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467044" lims:id="467044"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467045" lims:id="467045">Discontinuance of child allowance</MarginalNote><Label>(2)</Label><Text>Payment of an allowance to or in respect of a dependent child shall be suspended where the child is being wholly maintained at the expense of a provincial or municipal institution or by any branch or agency of the Government of Canada, other than the Department.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467046" lims:id="467046"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467047" lims:id="467047">Commencement or discontinuance of allowance for dependent child</MarginalNote><Label>(3)</Label><Text>An allowance to or in respect of a dependent child who in any month becomes or ceases to be eligible for an allowance shall be paid as if the dependent child was eligible for the allowance for the whole month and not just a part thereof.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:fid="467049" lims:id="467049">R.S., c. W-3, s. 13; 2013, c. 33, s. 158</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2003-01-01" lims:fid="467054" lims:id="467054" level="1"><TitleText>Suspension of Allowance</TitleText></Heading><Section lims:inforce-start-date="2003-01-01" lims:lastAmendedDate="2003-01-01" lims:fid="467055" lims:id="467055"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467056" lims:id="467056">Absence from Canada</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467057" lims:id="467057"><Label>(1)</Label><Text>Where a recipient of an allowance under section 4 absents themself from Canada, payment of the allowance shall, subject to subsection (4) of that section, be suspended immediately following the payment for the month in which the recipient so absents themself, but may be resumed when the recipient returns to Canada.</Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467058" lims:id="467058"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467059" lims:id="467059">On imprisonment of recipient</MarginalNote><Label>(2)</Label><Text>Where, on or after July 17, 1980, a recipient of an allowance is convicted of an offence and sentenced to a term of imprisonment, the payment of the allowance shall be suspended from the first day of the seventh month of that imprisonment until the release from imprisonment except that the payment thereof may be continued where the Minister is of the opinion that,</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467060" lims:id="467060"><Label>(a)</Label><Text>where a spouse, common-law partner or child of the recipient is entitled to be supported by the recipient at the time of the recipient’s conviction, the spouse, common-law partner or child continues to be entitled to that support; or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467061" lims:id="467061"><Label>(b)</Label><Text>the continuation of the payment of the allowance would assist the recipient in his or her rehabilitation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467062" lims:id="467062"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467063" lims:id="467063">On imprisonment of applicant</MarginalNote><Label>(3)</Label><Text>Where an applicant for an allowance who is serving a term of imprisonment is eligible for an allowance, an allowance may be awarded to the applicant and may be paid during that imprisonment where the Minister is of the opinion that</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467064" lims:id="467064"><Label>(a)</Label><Text>a spouse, common-law partner or child of the applicant is entitled to be supported by the applicant at the time of the applicant’s conviction and the spouse, common-law partner or child continues to be entitled to that support; or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467065" lims:id="467065"><Label>(b)</Label><Text>the payment of the allowance would assist the applicant in his or her rehabilitation.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:fid="467067" lims:id="467067">R.S., 1985, c. or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467100" lims:id="467100"><Label>(b)</Label><Text>if an allowance payment was paid to a person in respect of that period that was in excess of the amount of the allowance payment to which the person was entitled, the amount of that excess.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467101" lims:id="467101"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467102" lims:id="467102">Recovery of overpayments</MarginalNote><Label>(1.01)</Label><Text>If, through any cause, an overpayment is paid to a person, the overpayment is a debt due to Her Majesty by that person or by that person’s estate or succession, and</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467103" lims:id="467103"><Label>(a)</Label><Text>may be recovered by deduction from any future payments made pursuant to this Act to that person or to that person’s estate or succession;</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467104" lims:id="467104"><Label>(b)</Label><Text>may be recovered in accordance with section 155 of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467105" lims:id="467105"><Label>(c)</Label><Text>may be recovered in any court of competent jurisdiction.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467106" lims:id="467106"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467107" lims:id="467107">Excessive payments and underpayments</MarginalNote><Label>(1.1)</Label><Text>Where an allowance has been paid in respect of any payment period and it is subsequently determined that the income of the recipient and, if applicable, the recipient’s spouse or common-law partner, for the base calendar year calculated as required by this Act, in this subsection referred to as the “actual income”, is not the same as the income of the recipient, in this subsection referred to as the “shown income”, calculated as required by this Act on the basis of a statement required or permitted by section 8.1 to be made or filed by the recipient, the following adjustment shall be made:</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467108" lims:id="467108"><Label>(a)</Label><Text>if the actual income exceeds the shown income, any amount by which the allowance paid to the recipient for months in that payment period exceeds the allowance that would have been paid to the recipient for those months if the shown income had been equal to the actual income shall be considered an overpayment; or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467109" lims:id="467109"><Label>(b)</Label><Text>if the shown income exceeds the actual income, there shall be paid to the recipient any amount by which the allowance that would have been paid to the recipient for months in that payment period if the actual income had been equal to the shown income, exceeds the allowance paid to the recipient for those months.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467110" lims:id="467110"><Label>(1.2)</Label><Text><Repealed>[Repealed, 2000, c. 34, s. 75]</Repealed></Text></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467111" lims:id="467111"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467112" lims:id="467112">Remission of overpayments</MarginalNote><Label>(2)</Label><Text>If a person has received or obtained an overpayment and the Minister is satisfied that</Text><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467113" lims:id="467113"><Label>(a)</Label><Text>the overpayment cannot be recovered within the reasonably foreseeable future,</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467114" lims:id="467114"><Label>(b)</Label><Text>the administrative costs of recovering the overpayment are likely to equal or exceed the amount to be recovered,</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467115" lims:id="467115"><Label>(c)</Label><Text>repayment of the overpayment would cause undue hardship to the person, or</Text></Paragraph><Paragraph lims:inforce-start-date="2003-01-01" lims:fid="467116" lims:id="467116"><Label>(d)</Label><Text>the overpayment is the result of an administrative error, delay or oversight on the part of a public servant,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2003-01-01" lims:fid="467117" lims:id="467117"><Text>the Minister may, unless that person has been convicted of an offence under the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> in connection with the receiving or obtaining of the overpayment, remit all or any portion of the overpayment.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2003-01-01" lims:fid="467118" lims:id="467118"><MarginalNote lims:inforce-start-date="2003-01-01" lims:fid="467119" lims:id="467119">Recovery from survivor or orphan</MarginalNote><Label>(3)</Label><Text>Where a survivor or orphan of a deceased veteran retains any amount of the veteran’s allowance paid after the last day of the month in which the veteran died, that amount may be deducted from any allowance granted to the survivor or orphan.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2003-01-01" lims:fid="467121" lims:id="467121">R.S., 1985, c. lims:inforce-start-date="2015-02-26" lims:fid="467294" lims:id="467294"><Label>(a)</Label><Text>any of His Majesty’s forces,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467295" lims:id="467295"><Label>(b)</Label><Text>any of the forces, other than resistance groups, of any of His Majesty’s allies,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467296" lims:id="467296"><Label>(c)</Label><Text>any of the forces, other than resistance groups, of any power associated with His Majesty in World War disability under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> in respect of service during World War I or World War II as those wars are defined in that Act,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467302" lims:id="467302"><Label>(f)</Label><Text>has accepted a commuted pension in respect of service described in paragraph (e),</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467303" lims:id="467303"><Label>(g)</Label><Text>is, after death, declared to have been eligible for, or awarded, a pension described in paragraph (e), or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467304" lims:id="467304"><Label>(h)</Label><Text>served in the United Kingdom during World War I.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="467305" lims:id="467305"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="467306" lims:id="467306">Allied veteran — World War II</MarginalNote><Label>(4.1)</Label><Text>An allied veteran is also any former member of any of His Majesty’s forces, or of any of the forces, other than resistance groups, of any of His Majesty’s allies in World War II, who served during that war, who resided in Canada for a total period of at least 10 years beginning on or after August 15, 1945, who has been honourably discharged or has been permitted honourably to resign or retire from one of those forces and who</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467307" lims:id="467307"><Label>(a)</Label><Text>served in a theatre of actual war during that war;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467308" lims:id="467308"><Label>(b)</Label><Text>is in receipt of a pension for an injury or disease incurred or aggravated during service in any such force during that war or is declared to have been eligible for, or awarded, such a pension subsequent to their death; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467309" lims:id="467309"><Label>(c)</Label><Text>has accepted a commuted pension.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="467310" lims:id="467310"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="467311" lims:id="467311">Allied veteran — Korean War</MarginalNote><Label>(4.2)</Label><Text>An allied veteran is also any former member of any of the forces that took part in the Korean War and who served during that war, who resided in Canada for a total period of at least 10 years beginning on or after July 27, 1953, who has been honourably discharged or has been permitted honourably to resign or retire from one of those forces and who served in a theatre of operations during that war.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="467312" lims:id="467312"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="467313" lims:id="467313">Canadian dual service veteran</MarginalNote><Label>(5)</Label><Text>A Canadian dual service veteran is a person who</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467314" lims:id="467314"><Label>(a)</Label><Text>served during World War I and World War II as a member of His Majesty’s Canadian forces;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467315" lims:id="467315"><Label>(b)</Label><Text>was enlisted or obligated to serve in those forces without territorial limitation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467316" lims:id="467316"><Label>(c)</Label><Text>has been honourably discharged or has been permitted honourably to resign or retire from those forces.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="467317" lims:id="467317"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="467318" lims:id="467318">Allied dual service veteran</MarginalNote><Label>(6)</Label><Text>An allied dual service veteran is</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467319" lims:id="467319"><Label>(a)</Label><Text>a person who</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467320" lims:id="467320"><Label>(i)</Label><Text>served during World War I as a member of His Majesty’s forces,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467321" lims:id="467321"><Label>(ii)</Label><Text>was domiciled in Canada when he or she became a member of those forces,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467322" lims:id="467322"><Label>(iii)</Label><Text>was a member of His Majesty’s Canadian forces during World War II, enlisted or obligated to serve without territorial limitation, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467323" lims:id="467323"><Label>(iv)</Label><Text>has been honourably discharged or has been permitted honourably to resign or retire from those forces.</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467324" lims:id="467324"><Label>(b)</Label><Text><Repealed>[Repealed, lims:fid="467326" lims:id="467326">Canadian Forces veteran</MarginalNote><Label>(7)</Label><Text>A Canadian Forces veteran is a person who,</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467327" lims:id="467327"><Label>(a)</Label><Text>as a member of the forces referred to in section 14 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, left Canada or the United States, including Alaska, at any time prior to July 27, 1953 to participate in military operations undertaken by the United Nations to restore peace in the Republic of Korea; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467328" lims:id="467328"><Label>(b)</Label><Text>is in receipt of a pension under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, or is declared to have been eligible for, or awarded, a pension under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> after the member’s death, having become eligible for that pension by virtue of</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467329" lims:id="467329"><Label>(i)</Label><Text>service as a member of the special force, as that force is defined in subsection 3(1) of that Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467330" lims:id="467330"><Label>(ii)</Label><Text>service in the Korean War, as that service is defined in subsection 3(1) of that Act.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="467331" lims:id="467331"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="467332" lims:id="467332">Definitions</MarginalNote><Label>(7.1)</Label><Text>The definitions in this subsection apply in this section.</Text><Definition lims:inforce-start-date="2015-02-26" lims:fid="467333" lims:id="467333"><Text><DefinedTermEn>allied ship</DefinedTermEn> means a ship other than a Canadian ship or a ship serving the enemy, and includes a ship that belonged to a government of an enemy-occupied country, or to a person resident in an enemy-occupied country, and that was placed under Canadian or allied control. (<DefinedTermFr>navire allié</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="467334" lims:id="467334"><Text><DefinedTermEn>Canadian manning pool</DefinedTermEn> means a manning pool of the Canadian merchant navy established under Order in Council P.C. 14/3550 of May 19, 1941. (<DefinedTermFr>dépôt d’équipages canadien</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="467335" lims:id="467335"><Text><DefinedTermEn>Canadian ship</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467336" lims:id="467336"><Label>(a)</Label><Text>a ship registered or licensed in Canada or Newfoundland, except</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467337" lims:id="467337"><Label>(i)</Label><Text>a ship chartered by bareboat charter to a charterer resident outside Canada or Newfoundland, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467338" lims:id="467338"><Label>(ii)</Label><Text>a ship taken over and operated by any allied country; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467339" lims:id="467339"><Label>(b)</Label><Text>a ship, wherever registered or licensed, having a crew engaged under the laws of Canada or Newfoundland and</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467340" lims:id="467340"><Label>(i)</Label><Text>chartered by bareboat charter to a charterer resident in Canada or Newfoundland, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467341" lims:id="467341"><Label>(ii)</Label><Text>taken over and operated by, under the control of, or on behalf of the Canadian Shipping Board or a Canadian naval authority. (<DefinedTermFr>navire canadien</DefinedTermFr>)</Text></Subparagraph></Paragraph></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="467342" lims:id="467342"><Text><DefinedTermEn>distressed mariner</DefinedTermEn> means a person who was in distress in a place outside Canada or Newfoundland, having been shipwrecked, discharged or left behind from a ship on which the person was engaged, and who received or was entitled to receive relief under</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467343" lims:id="467343"><Label>(a)</Label><Text>the <XRefExternal reference-type="regulation">Distressed Seamen Regulations</XRefExternal>, made by Order in Council P.C. 609 of March 23, 1937, as those regulations read at the relevant time; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467344" lims:id="467344"><Label>(b)</Label><Text>Order in Council P.C. 8592 of November 9, 1943. (<DefinedTermFr>en détresse</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="467345" lims:id="467345"><Text><DefinedTermEn>foreign voyage</DefinedTermEn> means a voyage from or to any place outside the area of a home-trade voyage. (<DefinedTermFr>voyage de long cours</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="467346" lims:id="467346"><Text><DefinedTermEn>home-trade voyage</DefinedTermEn> means a voyage between places in Canada, Newfoundland, the United States or Saint Pierre and Miquelon, in the course of which the ship did not go south of 36° North latitude or through the Bering Strait. (<DefinedTermFr>voyage de cabotage</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="467347" lims:id="467347"><Text><DefinedTermEn>territorial waters of Canada</DefinedTermEn> means all waters within three nautical miles of any of the coasts, bays, creeks or harbours of Canada and Newfoundland, not included within the limits specified and described in the first article of the convention between His Majesty King George III and the United States, signed at London on October 20, 1818, and includes all waters that, pursuant to Order in Council P.C. 3139 of December 18, 1937, were delimited as Canadian territorial waters, but does not include</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467348" lims:id="467348"><Label>(a)</Label><Text>the waters of the St. Lawrence River seaward from a line drawn due south across that river from the mouth of the Saguenay River; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467349" lims:id="467349"><Label>(b)</Label><Text>the waters of the Strait of Juan de Fuca westward beyond 124° 30′ West longitude. (<DefinedTermFr>eaux territoriales du Canada</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2015-02-26" lims:fid="467350" lims:id="467350"><Text><DefinedTermEn>war risk bonus</DefinedTermEn> means the pay supplement that was paid to ships’ crews serving in dangerous waters</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467351" lims:id="467351"><Label>(a)</Label><Text>by shipowners or shipping companies under the authority of decisions, findings or directions of the National War Labour Board pursuant to</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467352" lims:id="467352"><Label>(i)</Label><Text>the <XRefExternal reference-type="regulation">Wartime Wages and Cost of Living Bonus Order</XRefExternal>, Order in Council P.C. 8253 of October 24, 1941,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467353" lims:id="467353"><Label>(ii)</Label><Text>the <XRefExternal reference-type="regulation">Wartime Wages Control Order</XRefExternal>, Order in Council P.C. 5963 of July 10, 1942, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467354" lims:id="467354"><Label>(iii)</Label><Text>the <XRefExternal reference-type="regulation">Wartime Wages Control Order, 1943</XRefExternal>, Order in Council P.C. 9384 of December 9, 1943,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2015-02-26" lims:fid="467355" lims:id="467355"><Text>as those respective orders read at the relevant time; or</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467356" lims:id="467356"><Label>(b)</Label><Text>by the Government of Canada pursuant to Order in Council P.C. 122/7359 of August 19, 1942, as it read at the relevant time. (<DefinedTermFr>indemnité pour risques de guerre</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="467357" lims:id="467357"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="467358" lims:id="467358">Applicable rules</MarginalNote><Label>(7.2)</Label><Text>The following rules apply for the purposes of this section:</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467359" lims:id="467359"><Label>(a)</Label><Text>the status of a vessel and of the members of its crew, and the class of voyage in which a vessel was engaged, shall be determined according to the <XRefExternal reference-type="act">Canada Shipping Act, 1934</XRefExternal> and the regulations made thereunder, as that Act and those regulations read at the relevant time;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467360" lims:id="467360"><Label>(b)</Label><Text>the official records verifying the authenticity of any ship, other than a ship registered in Canada or Newfoundland, shall be those used under international practice or under the laws of the country of registration;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467361" lims:id="467361"><Label>(c)</Label><Text>a ship does not qualify as a Canadian ship or an allied ship if, at the relevant time,</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467362" lims:id="467362"><Label>(i)</Label><Text>it was neither registered nor licensed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467363" lims:id="467363"><Label>(ii)</Label><Text>it was a pleasure yacht not engaged in trade, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467364" lims:id="467364"><Label>(iii)</Label><Text>it was engaged in the fishing industry;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467365" lims:id="467365"><Label>(d)</Label><Text>where official records of a person’s service as a merchant navy veteran of World War I or World War II or as a Canadian merchant navy veteran of the Korean War are not available, the Minister may accept a statutory declaration or like statement from anyone if</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467366" lims:id="467366"><Label>(i)</Label><Text>information about the existence of any registered or licensed ship on which it is claimed that the person served is corroborated by official records,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467367" lims:id="467367"><Label>(ii)</Label><Text>no information in the declaration or statement is contradicted by other evidence, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467368" lims:id="467368"><Label>(iii)</Label><Text>after taking into consideration such corroboration as may be available, the Minister is satisfied, on the balance of probabilities, that the information in the declaration or statement is true,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2015-02-26" lims:fid="467369" lims:id="467369"><Text>but this paragraph does not apply in relation to subparagraph (7.3)(a)(i) with respect to the availability of war risk bonus;</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467370" lims:id="467370"><Label>(e)</Label><Text>a person’s domicile shall be understood as meaning the person’s domicile at the commencement of the service, activity or status referred to in paragraph (7.3)(d); and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467371" lims:id="467371"><Label>(f)</Label><Text>the Minister may presume death in every case where, according to the evidence available as to the circumstances surrounding the disappearance of the person whose death is in question or the loss of the ship on which the person was serving, the Minister is satisfied beyond a reasonable doubt that the death has in fact occurred.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="467372" lims:id="467372"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="467373" lims:id="467373">Merchant navy veteran of World War I or World War II</MarginalNote><Label>(7.3)</Label><Text>A merchant navy veteran of World War I or World War II is</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467374" lims:id="467374"><Label>(a)</Label><Text>any person who, during World War I or World War II, served on board a Canadian ship while it was making</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467375" lims:id="467375"><Label>(i)</Label><Text>a voyage for which war risk bonus was available, as verified by articles of agreement or other official documentation,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467376" lims:id="467376"><Label>(ii)</Label><Text>a foreign voyage,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467377" lims:id="467377"><Label>(iii)</Label><Text>a home-trade voyage any part of which went outside the territorial waters of Canada and the territorial waters of all other countries and was</Text><Clause lims:inforce-start-date="2015-02-26" lims:fid="467378" lims:id="467378"><Label>(A)</Label><Text>between a place in Canada and a place in the United States, in either direction,</Text></Clause><Clause lims:inforce-start-date="2015-02-26" lims:fid="467379" lims:id="467379"><Label>(B)</Label><Text>between a place in one province and a place in another province,</Text></Clause><Clause lims:inforce-start-date="2015-02-26" lims:fid="467380" lims:id="467380"><Label>(C)</Label><Text>between a place in Newfoundland or Saint Pierre and Miquelon and a place outside Newfoundland and Saint Pierre and Miquelon, in either which</Text><Clause lims:inforce-start-date="2015-02-26" lims:fid="467383" lims:id="467383"><Label>(A)</Label><Text>the ship served on, or another Canadian or allied ship in the vicinity of the ship served on, was attacked by the enemy, or</Text></Clause><Clause lims:inforce-start-date="2015-02-26" lims:fid="467384" lims:id="467384"><Label>(B)</Label><Text>the ship served on was attacked or damaged</Text><Subclause lims:inforce-start-date="2015-02-26" lims:fid="467385" lims:id="467385"><Label>(I)</Label><Text>by friendly forces engaging in action or counteraction against the enemy, or</Text></Subclause><Subclause lims:inforce-start-date="2015-02-26" lims:fid="467386" lims:id="467386"><Label>(II)</Label><Text>as a result of marine hazards due to the or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467398" lims:id="467398"><Label>(e)</Label><Text>any person who</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467399" lims:id="467399"><Label>(i)</Label><Text>is in receipt of a pension,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467400" lims:id="467400"><Label>(ii)</Label><Text>has accepted a commuted pension, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467401" lims:id="467401"><Label>(iii)</Label><Text>is declared to have been eligible for, or is awarded, a pension subsequent to the person’s death</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2015-02-26" lims:fid="467402" lims:id="467402"><Text>for an injury or disease incurred or aggravated during service as a Canadian merchant mariner of World War I or Canadian merchant mariner of World War II within the meaning of section 21.1 of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>.</Text></ContinuedParagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-26" lims:fid="467403" lims:id="467403"><MarginalNote lims:inforce-start-date="2015-02-26" lims:fid="467404" lims:id="467404">Canadian merchant navy veteran of the Korean War</MarginalNote><Label>(7.4)</Label><Text>A Canadian merchant navy veteran of the Korean War is</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467405" lims:id="467405"><Label>(a)</Label><Text>any person who, at any time during the period from June 25, 1950 to July 27, 1953, served on board a Canadian ship in any of the waters, including gulfs, bays and inlets, lying between</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467406" lims:id="467406"><Label>(i)</Label><Text>the coasts of Siberia, Korea and China</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2015-02-26" lims:fid="467407" lims:id="467407"><Text>and</Text></ContinuedParagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467408" lims:id="467408"><Label>(ii)</Label><Text>a line beginning at a point on the coast of Siberia at longitude 135° East; thence south to a point at latitude 38° 30′ North and longitude 135° East; thence southwesterly to a point at latitude 30° North and longitude 124° East; thence south to Shokoto Sho; thence westerly to Shichisei Seki; and thence westerly to a point on the coast of China at latitude 23° North; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467409" lims:id="467409"><Label>(b)</Label><Text>any person who</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467410" lims:id="467410"><Label>(i)</Label><Text>is in receipt of a pension,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467411" lims:id="467411"><Label>(ii)</Label><Text>has accepted a commuted pension, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467412" actual war</DefinitionRef></MarginalNote><Label>(8)</Label><Text>For the purposes of this section, <DefinedTermEn>theatre of actual war</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467416" lims:id="467416"><Label>(a)</Label><Text><Repealed>[Repealed, 2015, c. 3, s. 168]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467417" lims:id="467417"><Label>(b)</Label><Text>in the case of World War I,</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467418" lims:id="467418"><Label>(i)</Label><Text>as applied to the army or air forces, the zone of the allied armies of the continents of Europe, Asia or Africa, or wherever the veteran has sustained injury or contracted disease directly by a hostile act of the enemy, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467419" lims:id="467419"><Label>(ii)</Label><Text>as applied to the naval forces or the merchant navy, the high seas or wherever contact has been made with hostile forces of the enemy, or wherever the veteran has sustained injury or contracted disease directly by a hostile act of the enemy; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-26" lims:fid="467420" lims:id="467420"><Label>(c)</Label><Text>in the case of World War II,</Text><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467421" lims:id="467421"><Label>(i)</Label><Text>with respect to a former member of His Majesty’s Canadian forces or a merchant navy veteran of World War II, any place where the person has been on service involving duties performed outside the Western Hemisphere, including</Text><Clause lims:inforce-start-date="2015-02-26" lims:fid="467422" lims:id="467422"><Label>(A)</Label><Text>service involving duties performed outside Canada, Newfoundland, the United States, Saint Pierre and Miquelon and the territorial waters thereof in aircraft, and</Text></Clause><Clause lims:inforce-start-date="2015-02-26" lims:fid="467423" lims:id="467423"><Label>(B)</Label><Text>service anywhere in a ship or other vessel, which service is classed as “sea time” for the purpose of advancement of naval ratings, or which would be so classed were the ship or other vessel in the service of the naval forces of Canada, and</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-26" lims:fid="467424" lims:id="467424"><Label>(ii)</Label><Text>with respect to a former member of His Majesty’s forces other than His Majesty’s Canadian forces, or of any of the forces of His Majesty’s Allies or powers associated with His Majesty in World War II, such places, zones or areas as the pension</DefinedTermEn></MarginalNote><Label>(9)</Label><Text>For the purposes of this section, <DefinedTermEn>commuted pension</DefinedTermEn> means a final payment under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> in lieu of annual pension in respect of a disability rated at five per cent or more of total disability, or a similar or analogous final           — 2013, c. 33, s. 159</TitleText></Heading><Section><MarginalNote>Retroactive pension</MarginalNote><Label>159</Label><Text>If, on the day on which this Division comes into force, a person is or has been in receipt of war veterans allowance referred to in subsection 32(2) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> as it read immediately before that day and, on or after that day, is awarded a retroactive pension or a retroactive increase of pension under that Act, then any pension payments made under that Act in respect of a month the whole of which is before that day are subject to that subsection 32(2) and to section 13 of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal> as they read immediately before that day.</Text></Section></RelatedOrNotInForce></BillPiece></Schedule></Statute>
