lims:fid="464734" lims:id="464734"><Text><DefinedTermEn>Commissioner</DefinedTermEn> means the Commissioner of the Force; (<DefinedTermFr>commissaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-01" lims:fid="464735" lims:id="464735"><Text><DefinedTermEn>designated program</DefinedTermEn> means a provincial or municipal program that is set out in the schedule; (<DefinedTermFr>programme désigné</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-01" lims:fid="464736" lims:id="464736"><Text><DefinedTermEn>designated program protectee</DefinedTermEn> means a person who is receiving protection under a designated program; (<DefinedTermFr>bénéficiaire d’un programme lims:inforce-start-date="2014-11-01" lims:fid="464739" lims:id="464739"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Public Safety and Emergency Preparedness; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-01" lims:fid="464740" lims:id="464740"><Text><DefinedTermEn>Program</DefinedTermEn> means the Witness Protection Program established by section 4; (<DefinedTermFr>programme</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-01" lims:fid="464741" lims:id="464741"><Text><DefinedTermEn>protected person</DefinedTermEn> means a current or former protectee or a current or former designated program protectee; (<DefinedTermFr>personne protégée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-01" lims:fid="464742" lims:id="464742"><Text><DefinedTermEn>protectee</DefinedTermEn> means a person who is receiving protection under the lims:id="464743"><Text><DefinedTermEn>protection</DefinedTermEn> may include relocation, accommodation and change of identity as well as counselling and financial support for those or any other purposes in order to ensure the security of a person or to facilitate the person’s re-establishment or becoming self-sufficient; (<DefinedTermFr>protection</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-01" lims:fid="464744" lims:id="464744"><Text><DefinedTermEn>protection agreement</DefinedTermEn> means an agreement referred to in paragraph 6(1)(c) that applies in respect of a protectee; (<DefinedTermFr>accord de protection</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-01" lims:fid="464745" lims:id="464745"><Text><DefinedTermEn>provincial official</DefinedTermEn> means, with respect to a designated program, the official designated under subsection 10.1(2) or (3); (<DefinedTermFr>fonctionnaire provincial</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-01" lims:fid="464746" lims:id="464746"><Text><DefinedTermEn>substantial harm</DefinedTermEn> means any injury, whether physical or psychological, that interferes in a substantial way with a person’s health or well-being; (<DefinedTermFr>préjudice sérieux</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2014-11-01" lims:fid="464747" lims:id="464747"><Text><DefinedTermEn>witness</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464748" lims:id="464748"><Label>(a)</Label><Text>a person who has given or has agreed to give information or evidence, or participates or has agreed to participate in a matter, relating to an inquiry or the investigation or prosecution of an offence and who may require protection because of risk to the security of the person arising in relation to the inquiry, investigation or prosecution,</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464749" lims:id="464749"><Label>(b)</Label><Text>a person who has assisted or has agreed to assist a federal security, defence or safety organization and who may require protection because of a risk to his or her security arising in relation to the assistance, or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464750" lims:id="464750"><Label>(c)</Label><Text>a person who, because of their relationship to or association with a person referred to in paragraph (a) or (b), may also require protection for the reasons 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2014-11-01" lims:fid="464758" lims:id="464758" level="1"><TitleText>Purpose of Act</TitleText></Heading><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="464759" lims:id="464759"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464760" lims:id="464760">Protection of persons</MarginalNote><Label>3</Label><Text>The purpose of this Act is to promote law enforcement, national security, national defence and public safety by facilitating the protection of persons</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464761" lims:id="464761"><Label>(a)</Label><Text>who are involved directly or indirectly in providing assistance in law enforcement matters in relation to</Text><Subparagraph lims:inforce-start-date="2014-11-01" lims:fid="464762" lims:id="464762"><Label>(i)</Label><Text>activities conducted by the Force, other than activities arising under an arrangement entered into under section 20 of the <XRefExternal reference-type="act" link="R-10">Royal Canadian Mounted Police Act</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-11-01" lims:fid="464763" lims:id="464763"><Label>(ii)</Label><Text>activities conducted by any law enforcement agency or international criminal court or tribunal in respect of which an agreement or arrangement has been entered into under section 14;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464764" lims:id="464764"><Label>(b)</Label><Text>who are involved directly or indirectly in providing assistance to a federal security, defence or safety organization; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464765" lims:id="464765"><Label>(c)</Label><Text>who have been admitted to a designated 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2014-11-01" lims:fid="464768" lims:id="464768" level="1"><TitleText>Witness Protection Program</TitleText></Heading><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="464769" lims:id="464769"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464770" lims:id="464770">Establishment</MarginalNote><Label>4</Label><Text>A program to facilitate the protection of witnesses is hereby established called the Witness Protection Program to be administered by the Commissioner.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-11-01" lims:fid="464772" lims:id="464772">1996, c. 15, s. 4; 2013, c. 29, s. 20(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="464773" lims:id="464773"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="464774" lims:id="464774">Admission to Program</MarginalNote><Label>5</Label><Text>Subject to this Act, the Commissioner may determine whether a witness should be admitted to the Program and the type of protection to be provided to any protectee in the Program.</Text></Section><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="464775" lims:id="464775"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464776" lims:id="464776">Admission to Program</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464777" lims:id="464777"><Label>(1)</Label><Text>A witness shall not be admitted to the Program unless</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464778" lims:id="464778"><Label>(a)</Label><Text>a recommendation for the admission has been made by a law enforcement agency, a federal security, defence or safety organization or an international criminal court or tribunal;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464779" lims:id="464779"><Label>(b)</Label><Text>the Commissioner has been provided by the witness with such information, in accordance with any regulations made for the purpose, concerning the personal history of the witness as will enable the Commissioner to consider the factors referred to in section 7 in respect of the witness; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464780" lims:id="464780"><Label>(c)</Label><Text>an agreement has been entered into by or on behalf of the witness with the Commissioner setting out the obligations of both parties.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464781" lims:id="464781"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464782" lims:id="464782">Emergency situations</MarginalNote><Label>(2)</Label><Text>Despite subsection (1), the Commissioner may, in a case of emergency, and for a period of not more than 90 days, provide protection to a person who has not entered into a protection agreement. The Commissioner may, if the emergency persists, provide protection for one additional period of not more than 90 days.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="464785" lims:id="464785"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464786" lims:id="464786">Factors to be considered</MarginalNote><Label>7</Label><Text>The Commissioner shall consider the following factors in determining whether a witness should be admitted to the Program:</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464787" lims:id="464787"><Label>(a)</Label><Text>the nature of the risk to the security of the witness;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464788" lims:id="464788"><Label>(b)</Label><Text>the danger to the community if the witness is admitted to the Program;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464789" lims:id="464789"><Label>(c)</Label><Text>the nature of the inquiry, investigation or prosecution involving the witness — or the nature of the assistance given or agreed to be given by the witness to a federal security, defence or safety organization — and the importance of the witness in the matter;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464790" lims:id="464790"><Label>(d)</Label><Text>the value of the witness’s participation or of the information, evidence or assistance given or agreed to be given by the witness;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464791" lims:id="464791"><Label>(e)</Label><Text>the likelihood of the witness being able to adjust to the Program, having regard to the witness’s maturity, judgment and other personal characteristics and the family relationships of the witness;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464792" lims:id="464792"><Label>(f)</Label><Text>the cost of maintaining the witness in the Program;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464793" lims:id="464793"><Label>(g)</Label><Text>alternate methods of protecting the witness without admitting the witness to the Program; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464794" lims:id="464794"><Label>(h)</Label><Text>such other factors as the Commissioner deems 20(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="464797" lims:id="464797"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464798" lims:id="464798">Deemed terms of protection agreement</MarginalNote><Label>8</Label><Text>A protection agreement is deemed to include an obligation</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464799" lims:id="464799"><Label>(a)</Label><Text>on the part of the Commissioner, to take such reasonable steps as are necessary to provide the protection referred to in the agreement to the protectee; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464800" lims:id="464800"><Label>(b)</Label><Text>on the part of the protectee,</Text><Subparagraph lims:inforce-start-date="2014-11-01" lims:fid="464801" lims:id="464801"><Label>(i)</Label><Text>to give the information or evidence or participate as required in relation to the inquiry, investigation or prosecution — or to give to the federal security, defence or safety organization the assistance — in respect of which protection is provided under the agreement,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-11-01" lims:fid="464802" lims:id="464802"><Label>(ii)</Label><Text>to meet all financial obligations incurred by the protectee at law that are not by the terms of the agreement payable by the Commissioner,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-11-01" lims:fid="464803" lims:id="464803"><Label>(iii)</Label><Text>to meet all legal obligations incurred by the protectee, including any obligations regarding the custody and maintenance of children,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-11-01" lims:fid="464804" lims:id="464804"><Label>(iv)</Label><Text>to refrain from activities that constitute an offence against an Act of Parliament or that might compromise the security of the protectee, another protectee or the Program, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-11-01" lims:fid="464805" lims:id="464805"><Label>(v)</Label><Text>to accept and give effect to reasonable requests and directions made by the Commissioner in relation to the protection provided to the protectee and the obligations of the protectee.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="464808" lims:id="464808"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464809" lims:id="464809">Request for termination of protection</MarginalNote><Label>8.1</Label><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464810" lims:id="464810"><Label>(1)</Label><Text>A protectee may request that the Commissioner terminate the protection provided to the protectee.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464811" lims:id="464811"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464812" lims:id="464812">Termination</MarginalNote><Label>(2)</Label><Text>The Commissioner shall meet in person with the protectee to discuss their request and shall terminate the protection provided to them if, either at the meeting or afterwards, they confirm their request in the form and manner that the Commissioner considers appropriate in the circumstances.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464813" lims:id="464813"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464814" lims:id="464814">Effective day</MarginalNote><Label>(3)</Label><Text>The termination takes effect on the day on which the request is confirmed or on a later day that the protectee may specify.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-11-01" lims:fid="464816" lims:id="464816">2013, c. 29, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="464817" lims:id="464817"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464818" lims:id="464818">Termination of protection</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464819" lims:id="464819"><Label>(1)</Label><Text>The Commissioner may terminate the protection provided to a protectee if the Commissioner has evidence that there has been</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464820" lims:id="464820"><Label>(a)</Label><Text>a material misrepresentation or a failure to disclose information relevant to the admission of the protectee to the Program; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464821" lims:id="464821"><Label>(b)</Label><Text>a deliberate and material contravention of the obligations of the protectee under the protection agreement.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464822" lims:id="464822"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464823" lims:id="464823">Notification of proposed termination</MarginalNote><Label>(2)</Label><Text>The Commissioner shall, before terminating the protection provided to a protectee, take reasonable steps to notify the protectee and allow the protectee to make representations concerning the matter.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2014-11-01" lims:fid="464825" lims:id="464825">1996, c. 15, s. 9; 2013, c. 29, s. 20(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2014-11-01" lims:lastAmendedDate="2014-11-01" lims:fid="464826" lims:id="464826"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464827" lims:id="464827">Reasons for certain decisions</MarginalNote><Label>10</Label><Text>Where a decision is taken</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464828" lims:id="464828"><Label>(a)</Label><Text>to refuse to admit a witness to the Program, the Commissioner shall provide the body that recommended the admission or, in the case of a witness recommended by the Force, the witness, with written reasons to enable the body or witness to understand the basis for the decision; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464829" lims:id="464829"><Label>(b)</Label><Text>to terminate protection without the consent of a protectee, the person in criminal proceedings;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464890" lims:id="464890"><Label>(d)</Label><Text>the Commissioner has reasonable grounds to believe that the disclosure is essential for the purposes of national security or national defence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464891" lims:id="464891"><Label>(e)</Label><Text>the disclosure is made in accordance with an agreement or arrangement entered into under subsection 14.1(1).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464892" lims:id="464892"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464893" lims:id="464893">Designated program protectee</MarginalNote><Label>(3)</Label><Text>The Commissioner is only permitted to make a disclosure under paragraph (2)(c) that relates to a current or former designated program protectee if, in the Commissioner’s opinion, the urgency of the situation requires the disclosure or if the appropriate provincial official consents to investigation of an offence, could compromise national security, national defence or public safety or could result in substantial harm to any protected person or to any person providing protection or provincial official of a disclosure under paragraph (2)(a) or (b) that relates to a current or former designated program protectee before the disclosure is made.</Text></Subsection><Subsection designated program protectee has previously made such a disclosure or acted in a manner that results in such a disclosure;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464915" lims:id="464915"><Label>(c)</Label><Text>the provincial official has reasonable grounds to believe that the disclosure is essential for the purposes of the administration of justice, including</Text><Subparagraph lims:inforce-start-date="2014-11-01" lims:fid="464916" lims:id="464916"><Label>(i)</Label><Text>investigating a serious offence if there is reason to believe that the current or former designated program protectee can provide material information or evidence in relation to, or has been involved in the commission of, the offence,</Text></Subparagraph><Subparagraph request</MarginalNote><Label>(3)</Label><Text>A person may, for the purpose of providing protection to a designated program protectee, disclose that information to the extent that is necessary to give effect to a provincial official’s request that is made for that purpose.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464942" lims:id="464942"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464943" lims:id="464943">Court — confidentiality</MarginalNote><Label>(4)</Label><Text>Once a disclosure described in subsection 11(1) is made to a court, the court shall take any measures that it considers necessary to ensure that the information remains confidential.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464944" lims:id="464944"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464945" lims:id="464945">Exception — court</MarginalNote><Label>(5)</Label><Text>A court may make a disclosure described in subsection 11(1) for the purpose of preventing a miscarriage of justice, but in doing so it shall disclose only the information that it considers necessary for that purpose and official shall consider the following factors in determining whether to make a disclosure under section 11.2 or 11.3, as the case may be, except for a disclosure under paragraph 11.2(2)(e) or 11.3(2)(d):</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464950" lims:id="464950"><Label>(a)</Label><Text>the reasons for the disclosure;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464951" lims:id="464951"><Label>(b)</Label><Text>the danger or adverse consequences of the disclosure in relation to a person and the integrity of the Program or of a designated program, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464952" lims:id="464952"><Label>(c)</Label><Text>the likelihood that the information will be used solely for the purpose for which the disclosure is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464953" lims:id="464979">Ministerial arrangements</MarginalNote><Label>(2)</Label><Text>The Minister may enter into a reciprocal arrangement with the government of a foreign jurisdiction to enable a witness who is involved in activities of a law enforcement agency in that jurisdiction to be admitted to the Program, but no such person may be admitted to Canada pursuant to any such arrangement without the consent of the Minister of Citizenship and Immigration nor admitted to the Program without the consent of the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464980" lims:id="464980"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464981" lims:id="464981">Arrangements</MarginalNote><Label>(3)</Label><Text>The Minister may enter into an arrangement with an international criminal court or tribunal to enable a witness who is involved in activities of that court or tribunal to be admitted to the Program, but no such person may be lims:id="464988">Agreement or arrangement — provincial official</MarginalNote><Label>(2)</Label><Text>A provincial official may enter into an agreement or arrangement with a provincial department, agency or service of the same province as that official regarding disclosures — that are described in paragraph 11(1)(a) and that relate to a current or former designated program protectee — to each other or to another department, agency or service of the same province or any federal department, agency or service.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464989" lims:id="464989"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464990" lims:id="464990">Factors to be considered</MarginalNote><Label>(3)</Label><Text>The Commissioner or a provincial official shall consider the factors set out in paragraphs 12(a) to (e) in determining whether to enter into an agreement or arrangement and in establishing its terms.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464991" lims:id="464991"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464992" lims:id="464992">Mandatory terms</MarginalNote><Label>(4)</Label><Text>An agreement or arrangement shall include the following terms:</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464993" lims:id="464993"><Label>(a)</Label><Text>a party is not permitted to make a disclosure unless it is for a purpose that is essential for the administration of justice or public safety and that is specified in the agreement or arrangement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="464994" lims:id="464994"><Label>(b)</Label><Text>the parties shall take whatever steps are necessary, including any steps specified in the agreement or arrangement, to protect information that is disclosed from being disclosed beyond what is strictly necessary in the circumstances.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="464995" lims:id="464995"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="464996" lims:id="464996">Multiple departments, agencies or services</MarginalNote><Label>(5)</Label><Text>More than one department, agency or service may be party to a single agreement or may delegate to any member of the Force any of his or her powers, duties and functions under this Act, except the power to delegate under this section and the power to</Text><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="465003" lims:id="465003"><Label>(a)</Label><Text>determine whether to disclose information under any of paragraphs 11.2(2)(b) to (d) and subsection 11.2(4);</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="465004" lims:id="465004"><Label>(b)</Label><Text>enter into an agreement or arrangement under subsection 14.1(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="465005" lims:id="465005"><Label>(c)</Label><Text>designate an Assistant Commissioner to be responsible for the Program; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-01" lims:fid="465006" lims:id="465006"><Label>(d)</Label><Text>determine whether to admit a witness to the Program, to change the identity of a protectee and to terminate the protection provided to a protectee.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-01" lims:fid="465007" lims:id="465007"><MarginalNote lims:inforce-start-date="2014-11-01" lims:fid="465008" lims:id="465008">Assistant Commissioner</MarginalNote><Label>(2)</Label><Text>The Commissioner may designate an Assistant Commissioner to be responsible for the Program and, despite paragraph (1)(d), may delegate the powers set out in that paragraph to that Assistant lims:id="465021">Tabling</MarginalNote><Label>(2)</Label><Text>The Minister shall cause a copy of the report to be laid before each House of Parliament on any of the first fifteen days on which that force entered into by or on behalf of the Commissioner to provide protection to a person or entered into on behalf of the Government of Canada relating to the protection of persons is, to the extent that it is consistent with this Act, deemed to have been entered into under the relevant provisions of this Act and shall be governed by this Act.</Text></Section><Section
