or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462398" lims:id="462398"><Label>(d)</Label><Text>the 31st day of October 1953,</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2002-12-31" lims:fid="462399" lims:id="462399"><Text>whichever is the earliest; (<DefinedTermFr>service sur un théâtre d’opérations</DefinedTermFr>)</Text></ContinuedDefinition></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="462400" lims:id="462400"><Text><DefinedTermEn>special force</DefinedTermEn> means the Royal Canadian Navy Special Force, Canadian Army Special Force and the Royal Canadian Air Force Special Force, as constituted from time to time by the Minister of National Defence; (<DefinedTermFr>contingent spécial</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="462401" lims:id="462401"><Text><DefinedTermEn>unit</DefinedTermEn> means a unit or other element of the Canadian Forces organized by or under the authority of the Minister of National Defence. (<DefinedTermFr>unité</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="462403" lims:id="462403">R.S., 1970, c. V-2, s. 2; 2000, c. 34, s. 93(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="462404" lims:id="462404" level="1"><TitleText>War Service Grants Act</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="462405" lims:id="462405"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462406" lims:id="462406">Application</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462407" lims:id="462407"><Label>(1)</Label><Text>The <XRefExternal reference-type="act" link="W-2.5">War Service Grants Act</XRefExternal> applies to members of the Canadian Forces described in paragraphs (2)(a), (b) and (c) as specified in this section.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462408" lims:id="462408"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462409" lims:id="462409"><DefinitionRef>Member of the forces</DefinitionRef></MarginalNote><Label>(2)</Label><Text>The expressions <DefinedTermEn>member</DefinedTermEn> and <DefinedTermEn>member of the forces</DefinedTermEn>, as defined in section 2 of the said Act, include</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462410" lims:id="462410"><Label>(a)</Label><Text>every person who was enrolled for the purpose of serving in the special force and who has been on service in a theatre of operations;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462411" lims:id="462411"><Label>(b)</Label><Text>every officer or non-commissioned member of the reserve forces who has been on service in a theatre of operations on the strength of the special force; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462412" lims:id="462412"><Label>(c)</Label><Text>every member of the regular forces who has been on service in a theatre of operations on the strength of the special force.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462413" lims:id="462413"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462414" lims:id="462414"><DefinitionRef>Discharge</DefinitionRef></MarginalNote><Label>(3)</Label><Text>The expression <DefinedTermEn>discharge</DefinedTermEn>, as defined in section 2 of the said Act, means, in the case of a person described in paragraph (2)(a) of this section, honourable termination of his service in the special force otherwise than by reason of engagement in the regular forces, and in the case of a person described in paragraph (2)(b) or (c) of this section means,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462415" lims:id="462415"><Label>(a)</Label><Text>honourable termination of his service in or with the regular forces, including, in the case of an officer or non-commissioned member of the reserve forces, return to reserve status; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462416" lims:id="462416"><Label>(b)</Label><Text>in any case where his service in or with the regular forces has not been terminated,</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="462417" lims:id="462417"><Label>(i)</Label><Text>if his service in a theatre of operations has been honourably terminated and immediate leave has been granted to him, the reporting by him to a unit on the expiration of such leave,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="462418" lims:id="462418"><Label>(ii)</Label><Text>if his service in a theatre of operations has been honourably terminated without immediate leave having been granted to him, the commencement by him, pursuant to orders, of further duty in a unit other than a unit of the special force, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="462419" lims:id="462419"><Label>(iii)</Label><Text>if he has been evacuated on medical grounds from a theatre of operations for the purpose of further medical treatment, his admission to a hospital in Canada.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462420" lims:id="462420"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462421" lims:id="462421"><DefinitionRef>Pay and allowances</DefinitionRef></MarginalNote><Label>(4)</Label><Text>The expression <DefinedTermEn>pay and allowances</DefinedTermEn>, as defined in section 2 of the said Act, means the following pay and allowances prescribed by the regulations under section 35 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>:</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462422" lims:id="462422"><Label>(a)</Label><Text>pay of rank, including group pay and progressive pay;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462423" lims:id="462423"><Label>(b)</Label><Text>if marriage allowance is being paid, marriage allowance and separated family’s allowance at the rates applicable to an officer or non-commissioned member in receipt of subsistence allowance and not occupying married quarters; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462424" lims:id="462424"><Label>(c)</Label><Text>subsistence allowance, whether or not it is being paid to the officer or non-commissioned member concerned, at the rates applicable in Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462425" lims:id="462425"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462426" lims:id="462426"><DefinitionRef>Service</DefinitionRef></MarginalNote><Label>(5)</Label><Text>The expression <DefinedTermEn>service</DefinedTermEn>, as defined in section 2 of the said Act, means time served in the Canadian Forces.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462427" lims:id="462427"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462428" lims:id="462428">Subsections 3(1) and (2)</MarginalNote><Label>(6)</Label><Text>For the purposes of this section, subsections 3(1) and (2) of the said Act are deemed to read as follows:</Text><ReadAsText lims:inforce-start-date="2002-12-31" lims:fid="462429" lims:id="462429"><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="462430" lims:id="462430"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462431" lims:id="462431">Gratuity payable to member of the forces</MarginalNote><Label>“3</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462432" lims:id="462432"><Label>(1)</Label><Text>Subject to this Act, every member of the forces is, upon discharge, entitled to be paid a war service gratuity at the rate of fifty cents a day for each day of paid service in a theatre of operations.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462433" lims:id="462433"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462434" lims:id="462434">Supplemental gratuity</MarginalNote><Label>(2)</Label><Text>In addition to the amount mentioned in subsection (1), every member of the forces is, upon discharge, entitled to be paid for each period of one hundred and eighty-three days of paid service in a theatre of operations, and proportionately for any less period, an amount equal to seven days pay and allowances at the rate payable to or in respect of such member at the termination of his last such period of service preceding discharge.”</Text></Subsection></Section></ReadAsText></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462435" lims:id="462435"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462436" lims:id="462436">Subsection 5(1)</MarginalNote><Label>(7)</Label><Text>For the purposes of this section, subsection 5(1) of the said Act is deemed to read as follows:</Text><ReadAsText lims:inforce-start-date="2002-12-31" lims:fid="462437" lims:id="462437"><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="462438" lims:id="462438"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462439" lims:id="462439">Payment of gratuity in case of death of member</MarginalNote><Label>“5</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462440" lims:id="462440"><Label>(1)</Label><Text>Where a member of the forces dies while on service or after discharge but before he has been paid his gratuity in full, payment of the gratuity or the unpaid balance thereof shall be made to</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462441" lims:id="462441"><Label>(a)</Label><Text>any person to or on behalf of whom marriage allowance was payable immediately prior to such member’s death or discharge;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462442" lims:id="462442"><Label>(b)</Label><Text>any person who, in the opinion of the Minister, was eligible to be paid such marriage allowance immediately prior to such member’s death or discharge;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462443" lims:id="462443"><Label>(c)</Label><Text>any person on whose behalf, in the opinion of the Minister, marriage allowance would have been payable immediately prior to such member’s death or discharge, had not such person been a member of the forces; or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462444" lims:id="462444"><Label>(d)</Label><Text>any person who, in the opinion of the Minister, was wholly or substantially dependent upon such member at the time of such member’s death;</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="462445" lims:id="462445"><Text>and where there is no person to whom payment may be made under paragraph (a), (b), (c) or (d), the gratuity shall form part of the deceased member’s service estate or, at the option of the Minister, shall be paid to such person as the Minister directs.”</Text></ContinuedSectionSubsection></Subsection></Section></ReadAsText></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="462447" lims:id="462447">R.S., 1970, c. V-2, s. 3; 1985, c. 26, s. 66</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="462448" lims:id="462448"><Label>4</Label><Text><Repealed>[Repealed, 1993, c. 34, s. 133]</Repealed></Text></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="462449" lims:id="462449"><Label>5</Label><Text><Repealed>[Repealed, 2000, c. 34, s. 56]</Repealed></Text></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="462450" lims:id="462450" level="1"><TitleText>Veterans’ Land Act</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="462451" lims:id="462451"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462452" lims:id="462452">Application</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462453" lims:id="462453"><Label>(1)</Label><Text>The <XRefExternal reference-type="act" link="V-1.5">Veterans’ Land Act</XRefExternal> applies to members of the Canadian Forces included under subsection (2) in the expression <DefinitionRef>veteran</DefinitionRef> therein referred to.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462454" lims:id="462454"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462455" lims:id="462455"><DefinitionRef>Veteran</DefinitionRef></MarginalNote><Label>(2)</Label><Text>The expression <DefinedTermEn>veteran</DefinedTermEn>, as defined in subsection 2(1) of the said Act, includes every person described in paragraphs 4(2)(a), (b), (c) and (d) of this Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462456" lims:id="462456"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462457" lims:id="462457">Persons qualified to participate</MarginalNote><Label>(3)</Label><Text>Where any contract has been entered into under section 11 or 26 of the said Act, or any grant has been made under section 45 or 46 of the said Act, with or to any person described in paragraph 4(2)(a), (b), (c) or (d) of this Act in respect of his service during the war declared by His Majesty on the 10th day of September 1939, and the contract or the agreement relating to the grant is rescinded or otherwise terminated prior to his discharge referred to in subsection 4(2) of this Act and,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462458" lims:id="462458"><Label>(a)</Label><Text>in the case of the contract, prior to the expiration of the ten-year period referred to in subsection 11(5) of the said Act, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462459" lims:id="462459"><Label>(b)</Label><Text>in the case of the agreement relating to the grant, prior to the expiration of the period after which, under the agreement, he is not required to repay the grant,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="462460" lims:id="462460"><Text>such person is qualified to participate in the benefits of the said Act if he pays to The Director, The Veterans’ Land Act, the amount of any loss sustained by the Crown by reason of such contract or grant, as determined by the Minister.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462461" lims:id="462461"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462462" lims:id="462462">Persons not qualified to receive additional benefits</MarginalNote><Label>(4)</Label><Text>Except as provided in subsection (3), no person described in paragraph 4(2)(a), (b), (c) or (d) of this Act who has entered into a contract with the Director under section 11 or 26 of the said Act or has received any grant under section 45 or 46 of the said Act is qualified to receive any additional benefits under that Act by virtue of this section.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="462464" lims:id="462464">R.S., 1970, c. V-2, s. 6; 1980-81-82-83, c. 78, s. 13</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2002-12-31" lims:fid="462465" lims:id="462465" level="1"><TitleText>Veterans Insurance Act</TitleText></Heading><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="462466" lims:id="462466"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462467" lims:id="462467">Application</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462468" lims:id="462468"><Label>(1)</Label><Text>The <XRefExternal reference-type="act" link="V-1.4">Veterans Insurance Act</XRefExternal> applies to members of the Canadian Forces described in paragraphs (2)(a), (b), (c) and (d), and their dependants, as specified in this section.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462469" lims:id="462469"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462470" lims:id="462470"><DefinitionRef>Veteran</DefinitionRef></MarginalNote><Label>(2)</Label><Text>The expression <DefinedTermEn>veteran</DefinedTermEn>, as defined in subsection 2(1) of the said Act, includes</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462471" lims:id="462471"><Label>(a)</Label><Text>every person who was enrolled for the purpose of serving in the special force, who has been on service in a theatre of operations and who has been discharged from such force;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462472" lims:id="462472"><Label>(b)</Label><Text>every officer or non-commissioned member of the reserve forces who has been on service in a theatre of operations on the strength of the special force, and whose service with the regular forces has been terminated;</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462473" lims:id="462473"><Label>(c)</Label><Text>every member of the regular forces who has been on service in a theatre of operations on the strength of the special force and who has been discharged from the regular forces; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="462474" lims:id="462474"><Label>(d)</Label><Text>every person described in paragraph 4(2)(d) of this Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462475" lims:id="462475"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462476" lims:id="462476"><DefinitionRef>Discharge from service</DefinitionRef></MarginalNote><Label>(3)</Label><Text>The expression <DefinedTermEn>discharge from service</DefinedTermEn>, as defined in subsection 2(1) of the said Act, means, in the case of a person described in paragraph (2)(b) of this section, termination of his service with the regular forces.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462477" lims:id="462477"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462478" lims:id="462478">Subparagraph 3(1)(b)(iii)</MarginalNote><Label>(4)</Label><Text>For the purposes of this section, subparagraph 3(1)(b)(iii) of the said Act is deemed to read as follows:</Text><ReadAsText lims:inforce-start-date="2002-12-31" lims:fid="462479" lims:id="462479"><SectionPiece lims:inforce-start-date="2002-12-31" lims:fid="462480" lims:id="462480"><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="462481" lims:id="462481"><Label>“(iii)</Label><Text>a person who is a member of the regular forces and has been on service in a theatre of operations on the strength of the special force,”.</Text></Subparagraph></SectionPiece></ReadAsText></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462482" lims:id="462482"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462483" lims:id="462483">Minister may enter into contract with widow</MarginalNote><Label>(5)</Label><Text>Where any person described in paragraph (2)(a), (b), (c) or (d) of this section or subsection (4) of this section who is eligible for insurance under the <XRefExternal reference-type="act" link="V-1.4">Veterans Insurance Act</XRefExternal> by virtue of this section dies without having obtained any contract of insurance thereunder, the Minister may enter into a contract of insurance under that Act with the widow of such person at any time prior to the expiration of the period during which such person, had he lived, would have been eligible for a contract of insurance under that Act.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462484" lims:id="462484"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462485" lims:id="462485">Idem</MarginalNote><Label>(6)</Label><Text>Where any person who served in a theatre of operations on the strength of the special force has died prior to the 26th day of June 1954 and prior to the termination of his service with the special force or the regular forces, the Minister may enter into a contract of insurance under the <XRefExternal reference-type="act" link="V-1.4">Veterans Insurance Act</XRefExternal> with the widow of such person as though that person had died on or after that date and as though he had been discharged from the said force or forces or his service therewith had been terminated immediately prior to his death.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="462486" lims:id="462486"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="462487" lims:id="462487">Time limit</MarginalNote><Label>(7)</Label><Text>No contract of insurance may be entered into by the Minister under the said Act with any person described in paragraph (2)(a), (b), (c) or (d) of this section or subsection (4) of this section after the 31st day of October 1958.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="462489" lims:id="462489">R.S., 1970, c.
