format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada is committed to protecting and promoting the French language, recognizing that French is in a minority situation in Canada and North America due to the predominant use of English;</Text></Provision><Provision lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403183" lims:id="1403183" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas the Government of Canada recognizes the diversity of the provincial and territorial language regimes that contribute to the advancement of the equality of status and use of English and French in Canadian society;</Text></Provision><Provision lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403184" lims:id="1403184" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas consumers in Quebec or a region with a strong francophone presence should have the right to communicate in French with and obtain available services in French from federally regulated private businesses that carry on business in Quebec or the region;</Text></Provision><Provision lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403185" lims:id="1403185" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And whereas employees of federally regulated private businesses who work in Quebec or a region with a strong francophone presence should have the right to work in title</MarginalNote><Label>1</Label><Text>This Act may be cited as the <XRefExternal reference-type="act" link="U-3.5">Use of French in Federally Regulated Private Businesses Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403192" lims:id="1403192" level="1"><TitleText>Interpretation</TitleText></Heading><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403193" lims:id="1403193"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403194" lims:id="1403194">Definitions</MarginalNote><Label>2</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403195" lims:id="1403195"><Label>(1)</Label><Text>The following definitions apply in this Act.</Text><Definition in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403196" lims:id="1403196"><Text><DefinedTermEn>Board</DefinedTermEn> means the Canada Industrial Relations Board established by section 9 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>. (<DefinedTermFr>Conseil</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403197" lims:id="1403197"><Text><DefinedTermEn>Commissioner</DefinedTermEn> means the Commissioner of Official Languages for Canada appointed under section 49 of the <XRefExternal reference-type="act" link="O-3.01">Official Languages Act</XRefExternal>. (<DefinedTermFr>commissaire</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403198" lims:id="1403198"><Text><DefinedTermEn>federally regulated private business</DefinedTermEn> means a person that employs employees on or in connection with a <DefinitionRef>federal work, undertaking or business</DefinitionRef> as defined in section 2 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> but does not include</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403199" lims:id="1403199"><Label>(a)</Label><Text>a person that employs fewer employees than the number of employees specified in the regulations;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403200" lims:id="1403200"><Label>(b)</Label><Text>a corporation that is incorporated to perform functions on behalf of the Government of Canada;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403201" lims:id="1403201"><Label>(c)</Label><Text>a corporation that is subject to the <XRefExternal reference-type="act" link="O-3.01">Official Languages Act</XRefExternal> under another Act of Parliament; or</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403202" lims:id="1403202"><Label>(d)</Label><Text>a council, government, corporation or other entity that is authorized to act on behalf of an Indigenous group, community or people that holds rights recognized and affirmed by section 35 of the <XRefExternal reference-type="act" link="const">Constitution Act, 1982</XRefExternal>. (<DefinedTermFr>entreprise privée de compétence fédérale</DefinedTermFr>)</Text></Paragraph></Definition><Definition in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403203" lims:id="1403203"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Canadian Heritage. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403204" lims:id="1403204"><Text><DefinedTermEn>parties</DefinedTermEn>, in relation to a complaint made to the Commissioner, means the complainant, the federally regulated private business that is the subject of the complaint and any other person added as a party to the complaint. (<DefinedTermFr>parties</DefinedTermFr>)</Text></Definition></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403205" lims:id="1403205"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403206" lims:id="1403206">Board</MarginalNote><Label>(2)</Label><Text>For the purposes of this Act, the Board is considered to be composed only of the members described in paragraphs 9(2)(a), (b), (e) and (f) of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403207" lims:id="1403207"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403208" lims:id="1403208">Language rights</MarginalNote><Label>3</Label><Text>For the purposes of this Act, language rights</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403209" lims:id="1403209"><Label>(a)</Label><Text>are to be given a large, liberal and purposive interpretation; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403210" lims:id="1403210"><Label>(b)</Label><Text>are to be interpreted in light of their remedial character.</Text></Paragraph></Section><Heading lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403211" lims:id="1403211" level="1"><TitleText>Purpose</TitleText></Heading><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403212" lims:id="1403212"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403213" lims:id="1403213">Purpose</MarginalNote><Label>4</Label><Text>The purpose of this Act is to foster and protect the use of French in federally regulated private businesses in Quebec.</Text></Section><Heading lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403214" lims:id="1403214" level="1"><TitleText>Non-application</TitleText></Heading><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403215" lims:id="1403215"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403216" lims:id="1403216">Broadcasting</MarginalNote><Label>5</Label><Text>This Act does not apply in relation to a federally regulated private business in respect of activities or workplaces related to the broadcasting sector.</Text></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403217" lims:id="1403217"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403218" lims:id="1403218"><XRefExternal reference-type="other">Charter of the French language</XRefExternal></MarginalNote><Label>6</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403219" lims:id="1403219"><Label>(1)</Label><Text>In relation to communications with or services provided to consumers in Quebec or in relation to workplaces in Quebec, Quebec’s <XRefExternal reference-type="other">Charter of the French language</XRefExternal> applies instead of this Act to a federally regulated private business if the federally regulated private business chooses to be subject to Quebec’s <XRefExternal reference-type="other">Charter of the French language</XRefExternal>.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403220" lims:id="1403220"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403221" lims:id="1403221">Notice</MarginalNote><Label>(2)</Label><Text>A federally regulated private business must, in accordance with the regulations, give notice of the day on which it will become or cease to be subject to Quebec’s <XRefExternal reference-type="other">Charter of the French language</XRefExternal>.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403222" lims:id="1403222"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403223" lims:id="1403223">Agreement with Quebec</MarginalNote><Label>(3)</Label><Text>The Minister may, on behalf of the Government of Canada and with the approval of the Governor in Council, enter into an agreement with the Government of Quebec for the purpose of giving effect to subsection (1).</Text></Subsection></Section><Heading lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403224" lims:id="1403224" level="1"><TitleText>Rights and Duties</TitleText></Heading><Heading lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403225" lims:id="1403225" level="2"><TitleText>Communications with and Services to Consumers</TitleText></Heading><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403226" lims:id="1403226"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403227" lims:id="1403227">Communications and services in French</MarginalNote><Label>7</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403228" lims:id="1403228"><Label>(1)</Label><Text>Consumers in Quebec have the right to communicate in French with and obtain available services in French from a federally regulated private business that carries on business in Quebec.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403229" lims:id="1403229"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403230" lims:id="1403230">Duty</MarginalNote><Label>(2)</Label><Text>The federally regulated private business has the duty to ensure that consumers are able to exercise the rights set out in subsection (1).</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403231" lims:id="1403231"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403232" lims:id="1403232">For greater certainty</MarginalNote><Label>(3)</Label><Text>For greater certainty, the rights set out in subsection (1) do not preclude consumers from communicating with or obtaining services from the federally regulated private business in English or a language other than French if they wish to do so and the federally regulated private business is able to communicate or provide services in that language.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403233" lims:id="1403233"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403234" lims:id="1403234">Scope of duty</MarginalNote><Label>8</Label><Text>The duty in respect of communications and services in French under section <XRefInternal>7</XRefInternal> applies in respect of oral and written communications and in respect of any documents or activities that relate to those communications or services.</Text></Section><Heading lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403235" lims:id="1403235" level="2"><TitleText>Language of Work</TitleText></Heading><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403236" lims:id="1403236"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403237" lims:id="1403237">Language rights at work</MarginalNote><Label>9</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403238" lims:id="1403238"><Label>(1)</Label><Text in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403553" lims:id="1403553">Employees of a federally regulated private business who occupy or are assigned to positions in a workplace in Quebec have the right to</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403239" lims:id="1403239"><Label>(a)</Label><Text>carry out their work and be supervised in French;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403240" lims:id="1403240"><Label>(b)</Label><Text>receive all communications and documents from the federally regulated private business, including employment application forms, offers of employment, transfer or promotion, individual employment contracts, documents related to the conditions of employment, training documents produced for employees, notices of termination of employment, collective agreements and their schedules and grievances, in French; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403241" lims:id="1403241"><Label>(c)</Label><Text>use regularly and widely used work instruments and computer systems in French.</Text></Paragraph></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403242" lims:id="1403242"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403243" lims:id="1403243">Continuation of right — former employees</MarginalNote><Label>(1.1)</Label><Text>An employee’s right set out in paragraph (1)(b) to receive communications and documents from a federally regulated private business in French continues after the employee ceases to be employed by the business.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403244" lims:id="1403244"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403245" lims:id="1403245">Duty</MarginalNote><Label>(2)</Label><Text>The federally regulated private business has the duty to ensure that employees are able to exercise the rights set out in subsection (1) and that persons who were employees are able to exercise the right continued under subsection (1.1).</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403246" lims:id="1403246"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403247" lims:id="1403247">Duty — offer to fill a position</MarginalNote><Label>(2.1)</Label><Text>When a federally regulated private business that has workplaces in Quebec publishes in a language other than French an advertisement to fill a position — including through recruitment, hiring, transfer or promotion — that is assigned to one of those workplaces, the business must also publish the advertisement in French and ensure the simultaneous publication of both linguistic versions by means that are of the same nature and that reach a target public of a proportionally comparable size.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403248" lims:id="1403248"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403249" lims:id="1403249">Communication in a language other than French</MarginalNote><Label>(3)</Label><Text>For greater certainty, the right set out in paragraph (1)(b) does not preclude communications and documents from also being in English or another language other than French but, in the case of widely distributed communications and any documents, the use of French must be at least equivalent to the use of the language other than French.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403250" lims:id="1403250"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403251" lims:id="1403251">Individual employment contracts — contracts of adhesion</MarginalNote><Label>(4)</Label><Text>The right set out in paragraph (1)(b) does not preclude the federally regulated private business from entering into an individual employment contract that is a contract of adhesion with an employee exclusively in English or another language other than French, if the business and employee so agree and the business has already provided the contract to the employee in French.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403252" lims:id="1403252"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403253" lims:id="1403253">Individual employment contracts — other</MarginalNote><Label>(5)</Label><Text>The right set out in paragraph (1)(b) does not preclude the federally regulated private business from entering into an individual employment contract — other than a contract of adhesion — with an employee exclusively in English or another language other than French, if the business and employee so agree.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403254" lims:id="1403254"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403255" lims:id="1403255">Communications and documents</MarginalNote><Label>(6)</Label><Text>The right set out in paragraph (1)(b) does not preclude the federally regulated private business from providing to an employee communications and documents exclusively in English or another language other than French, if the business and employee so agree, even after the employee ceases to be employed by the business.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403256" lims:id="1403256"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403257" lims:id="1403257">Duty — arbitral awards</MarginalNote><Label>9.1</Label><Text>A federally regulated private business that has workplaces in Quebec has the duty to ensure that an arbitral award that results from the arbitration of a grievance or dispute regarding the negotiation, renewal or review of a collective agreement respecting employees of the business who occupy or are assigned to positions in one of those workplaces</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403258" lims:id="1403258"><Label>(a)</Label><Text>is issued in French or, if it is issued in English or another language other than French, is translated into French without delay at the expense of the business and provided to the parties to the arbitration in both linguistic versions at the same time; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403259" lims:id="1403259"><Label>(b)</Label><Text>is translated into English or another language other than French as soon as feasible and at the expense of the business, if it was issued exclusively in French and a party to the arbitration requests a translation into the language other than French.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403260" lims:id="1403260"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403261" lims:id="1403261">Rights of trade unions</MarginalNote><Label>9.2</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403262" lims:id="1403262"><Label>(1)</Label><Text>A trade union that represents employees of a federally regulated private business who occupy or are assigned to positions in a workplace in Quebec has the right to receive communications and documents from the federally regulated private business in French.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403263" lims:id="1403263"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403264" lims:id="1403264">Duty</MarginalNote><Label>(2)</Label><Text>The federally regulated private business has the duty to ensure that a trade union is able to exercise the right set out in subsection (1).</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403265" lims:id="1403265"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403266" lims:id="1403266">Communication in a language other than French</MarginalNote><Label>(3)</Label><Text>For greater certainty, the right set out in subsection (1) does not preclude communications and documents from also being in English or another language other than French but, in the case of widely distributed communications and any documents, the use of French must be at least equivalent to the use of the language other than French.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403267" lims:id="1403267"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403268" lims:id="1403268">Fostering use of French</MarginalNote><Label>10</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403269" lims:id="1403269"><Label>(1)</Label><Text in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403554" lims:id="1403554">A federally regulated private business that has workplaces in Quebec must take measures to foster the use of French in those workplaces. Those measures must include</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403270" lims:id="1403270"><Label>(a)</Label><Text>informing employees that it is subject to this Act;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403271" lims:id="1403271"><Label>(b)</Label><Text>informing employees who occupy or are assigned to positions in those workplaces of their language of work rights and available remedies; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403272" lims:id="1403272"><Label>(c)</Label><Text>establishing a committee to support the management group that is responsible for the general direction of the federally regulated private business in the fostering of French and its use within the federally regulated private business.</Text></Paragraph></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403273" lims:id="1403273"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403274" lims:id="1403274">Generalizing use of French</MarginalNote><Label>(1.1)</Label><Text in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403555" lims:id="1403555">A committee established under paragraph (1)(c) by a federally regulated private business that has workplaces in Quebec must develop programs intended to generalize the use of French at all levels of the business in those workplaces, through the following:</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403275" lims:id="1403275"><Label>(a)</Label><Text>all members of the management group and employees having a good knowledge of French;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403276" lims:id="1403276"><Label>(b)</Label><Text>an increase, if necessary, in the number of persons who have a good knowledge of French in order to ensure that it is used generally;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403277" lims:id="1403277"><Label>(c)</Label><Text>the use of French as the language of work and of internal communications;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403278" lims:id="1403278"><Label>(d)</Label><Text>the use of French in the working documents, work instruments and computer systems used in the business;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403279" lims:id="1403279"><Label>(e)</Label><Text>the use of French terminology;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403280" lims:id="1403280"><Label>(f)</Label><Text>the use of French in information technologies; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403281" lims:id="1403281"><Label>(g)</Label><Text>any other means that the committee considers appropriate.</Text></Paragraph></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403282" lims:id="1403282"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403283" lims:id="1403283">Employee needs</MarginalNote><Label>(2)</Label><Text>In developing the measures referred to in subsection (1), the federally regulated private business must consider the needs of employees who are close to retirement, have many years of service or have conditions that could impede the learning of French.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403284" lims:id="1403284"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403285" lims:id="1403285">Communication in a language other than French</MarginalNote><Label>(3)</Label><Text>For greater certainty, programs referred to in subsection (1.1) do not preclude communications and documents from also being in English or another language other than French but, in the case of widely distributed communications and any documents, the use of French must be at least equivalent to the use of the language other than French.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403286" lims:id="1403286"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403287" lims:id="1403287">Adverse treatment</MarginalNote><Label>11</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403288" lims:id="1403288"><Label>(1)</Label><Text in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403556" lims:id="1403556">A federally regulated private business that has workplaces in Quebec must not treat adversely an employee who occupies or is assigned to a position in one of those workplaces for any of the following reasons:</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403289" lims:id="1403289"><Label>(a)</Label><Text>the employee speaks only French;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403290" lims:id="1403290"><Label>(b)</Label><Text>the employee does not have a sufficient knowledge of a language other than French;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403291" lims:id="1403291"><Label>(c)</Label><Text>the employee claims the possibility of expressing themselves in French;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403292" lims:id="1403292"><Label>(d)</Label><Text>the employee has exercised a right under this Act or made a complaint to the Commissioner;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403293" lims:id="1403293"><Label>(e)</Label><Text>the business is seeking to deter the employee from exercising such a right or making such a complaint;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403294" lims:id="1403294"><Label>(f)</Label><Text>the employee has taken part in meetings of, or carried out tasks for, a committee established under paragraph 10(1)(c) or a subcommittee created by such a committee;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403295" lims:id="1403295"><Label>(g)</Label><Text>the employee has, in good faith, communicated information to the Commissioner in relation to a complaint made under section 18 or participated in an investigation conducted as a result of such a communication; or</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403296" lims:id="1403296"><Label>(h)</Label><Text>the business is seeking to induce the employee to endorse a document prepared by a committee established under paragraph 10(1)(c) or to dissuade the employee from doing so.</Text></Paragraph></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403297" lims:id="1403297"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403298" lims:id="1403298">Acquired rights in Quebec</MarginalNote><Label>(2)</Label><Text>A federally regulated private business that has workplaces in Quebec must not treat adversely an employee who occupies or is assigned to a position in one of those workplaces on or before the day on which this subsection comes into force for the sole reason that the employee does not have a sufficient knowledge of French.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403299" lims:id="1403299"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403300" lims:id="1403300">Language other than French</MarginalNote><Label>(3)</Label><Text>Requiring an employee to have a knowledge of a language other than French does not constitute adverse treatment for the purposes of subsection (1) if the federally regulated private business is able to demonstrate that a knowledge of that language is objectively required by reason of the nature of the work to be performed by the employee and the business sets out the reasons that justify the requirement in any advertisement to fill a position that requires such knowledge.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403301" lims:id="1403301"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403302" lims:id="1403302">Language other than French — minimum conditions</MarginalNote><Label>(4)</Label><Text in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403557" lims:id="1403557">For the purposes of subsection (3), in order to demonstrate that a knowledge of a language other than French is objectively required by reason of the nature of the work to be performed by the employee, a federally regulated private business must, before requiring such knowledge, at a minimum,</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403303" lims:id="1403303"><Label>(a)</Label><Text>assess the actual language needs associated with the work to be performed;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403304" lims:id="1403304"><Label>(b)</Label><Text>verify that the language knowledge already required of other employees is not sufficient for the performance of that work; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403305" lims:id="1403305"><Label>(c)</Label><Text>restrict the number of positions involving work whose performance requires knowledge of a language other than French.</Text></Paragraph></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403306" lims:id="1403306"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403307" lims:id="1403307">Interpretation</MarginalNote><Label>(5)</Label><Text>Subsection (4) is not to be interpreted as imposing an unreasonable reorganization of a federally regulated private business’s affairs.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403308" lims:id="1403308"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403309" lims:id="1403309">Prevention of adverse treatment</MarginalNote><Label>(6)</Label><Text>A federally regulated private business that has workplaces in Quebec must take all reasonable measures to prevent, in the work environment, the adverse treatment of an employee referred to in subsection (1) for any of the reasons referred to in that subsection or of an employee referred to in subsection (2) for the reason referred to in that subsection.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403310" lims:id="1403310"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403311" lims:id="1403311">Cessation of adverse treatment</MarginalNote><Label>(7)</Label><Text>If a federally regulated private business that has workplaces in Quebec is made aware of the adverse treatment, in the work environment, of an employee referred to in subsection (1) for any of the reasons referred to in that subsection or of an employee referred to in subsection (2) for the reason referred to in that subsection, it must take all reasonable measures to make the adverse treatment cease.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403312" lims:id="1403312"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403313" lims:id="1403313">Definition of <DefinitionRef>adverse treatment</DefinitionRef></MarginalNote><Label>(8)</Label><Text>For the purposes of this section, <DefinedTermEn>adverse treatment</DefinedTermEn> includes dismissing, laying off, demoting, transferring or suspending an employee, harassing them or taking reprisals against them or disciplining or imposing any other penalty on them.</Text></Subsection></Section><Heading lims:id="1403316">Role</MarginalNote><Label>12</Label><Text>The Minister is responsible for the administration of this Act.</Text></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403317" lims:id="1403317"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403318" lims:id="1403318">Promotion of rights</MarginalNote><Label>13</Label><Text>The Minister is responsible for promoting the rights set out in subsections <XRefInternal>7</XRefInternal>(1) and <XRefInternal>9</XRefInternal>(1) and for providing assistance, education and information to federally regulated private businesses in relation to those rights.</Text></Section><Heading lims:inforce-start-date="2023-06-20" lims:enacted-date="2023-06-20" lims:fid="1403319" lims:id="1403319" level="1"><TitleText>Commissioner’s Duty</TitleText></Heading><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403320" lims:id="1403320"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403321" lims:id="1403321">Duty</MarginalNote><Label>14</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403322" lims:id="1403322"><Label>(1)</Label><Text>It is the Commissioner’s duty to take all actions and measures within the Commissioner’s authority with a view to ensuring recognition of the rights and respect for the duties under this Act concerning the use of French in communications with and services to consumers and as a language of work in relation to federally regulated private businesses, and the fostering by those businesses of the use of French in their workplaces as required by this Act.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403323" lims:id="1403323"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403324" lims:id="1403324">Investigations</MarginalNote><Label>(2)</Label><Text>It is Commissioner’s duty, for the purpose set out in subsection (1), to</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403325" lims:id="1403325"><Label>(a)</Label><Text>conduct and carry out investigations either as a result of a complaint made to the Commissioner or, in the case of a right or duty under section <XRefInternal>7</XRefInternal>, on the Commissioner’s own initiative; person believes that a federally regulated private business has failed to comply with that subsection in respect of the position.</Text></Subsection><Subsection in-force="no" in good faith in the exercise or purported exercise of any power, or in the performance or purported performance of any duty or function, conferred on them under this lims:id="1403427">External adjudicator — remuneration and expenses</MarginalNote><Label>(9)</Label><Text>An external adjudicator must be paid the remuneration and the fees that may be fixed by the Chairperson and is entitled to be paid reasonable travel and living expenses incurred by them in the course of their duties while absent from their ordinary place of residence.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403428" lims:id="1403428"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403429" lims:id="1403429">Dealing with complaint</MarginalNote><Label>23</Label><Text>In dealing with any complaint under this Act, the Board</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403430" lims:id="1403430"><Label>(a)</Label><Text>is to proceed as informally and expeditiously as the circumstances and considerations of fairness permit; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403431" lims:id="1403431"><Label>(b)</Label><Text>is not bound by legal or technical rules of evidence.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403432" lims:id="1403432"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403433" lims:id="1403433">Powers of Board</MarginalNote><Label>24</Label><Text>The Board has, in relation to a complaint referred to it by the Commissioner, the power</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403434" lims:id="1403434"><Label>(a)</Label><Text>to summon and enforce the attendance of witnesses and compel them to give oral or written evidence on oath and to produce the documents and things that the Board considers necessary, in the same manner and to the same extent as a superior court of record;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403435" lims:id="1403435"><Label>(b)</Label><Text>to administer oaths;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403436" lims:id="1403436"><Label>(c)</Label><Text>to receive, and base a decision on, any evidence adduced that the Board believes to be credible;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403437" lims:id="1403437"><Label>(d)</Label><Text>to compel any person to provide information or produce documents and things that may be relevant to a matter before the Board, after providing the parties with the opportunity to make representations;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403438" lims:id="1403438"><Label>(e)</Label><Text>subject to any limitations prescribed by regulation of the Governor in Council, to enter any premises of a federally regulated private business that is the subject of a complaint and to inspect and view anything found in the premises that may be relevant to the complaint and require any person to answer any question that may be relevant to the complaint;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403439" lims:id="1403439"><Label>(f)</Label><Text>to abridge or extend the time for doing any act, filing any document or presenting any evidence;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403440" lims:id="1403440"><Label>(g)</Label><Text>if the parties agree, to assist the parties in resolving any issues in dispute by any means that the Board considers appropriate, without prejudice to the Board’s power to determine issues that have not been settled;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403441" lims:id="1403441"><Label>(h)</Label><Text>to authorize any person to do anything that the Board may do under paragraphs (a) to (g) and to report to the Board on it;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403442" lims:id="1403442"><Label>(i)</Label><Text>to adjourn or postpone any proceeding from time to time;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403443" lims:id="1403443"><Label>(j)</Label><Text>to defer deciding any matter, if the Board considers that the matter could be resolved by an alternate method of resolution;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403444" lims:id="1403444"><Label>(k)</Label><Text>to amend or permit the amendment of any document filed in connection with the complaint;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403445" lims:id="1403445"><Label>(l)</Label><Text>to add a party at any stage;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403446" lims:id="1403446"><Label>(m)</Label><Text>to permit an interested person to intervene at any stage;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403447" lims:id="1403447"><Label>(n)</Label><Text>to merge complaints that relate to the same situation or subject matter;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403448" lims:id="1403448"><Label>(o)</Label><Text>to decide any matter that may arise in connection with the complaint;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403449" lims:id="1403449"><Label>(p)</Label><Text>to take notice of facts that may be judicially noticed;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403450" lims:id="1403450"><Label>(q)</Label><Text>to take notice of other generally recognized facts and any information that is within the Board’s specialized knowledge, after notifying the parties and any intervenor of its intention to do so and providing them with an opportunity to make representations; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403451" lims:id="1403451"><Label>(r)</Label><Text>to review, rescind, amend, alter or vary any order or decision made by the Board and to rehear any matter before making a decision with respect to it.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403452" lims:id="1403452"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403453" lims:id="1403453">Consultation</MarginalNote><Label>25</Label><Text>A member of the Board or an external adjudicator may, in respect of any complaint referred to the Board, consult with any member of the Board or with any employee of the Administrative Tribunals Support Service of Canada.</Text></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403454" lims:id="1403454"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403455" lims:id="1403455">Regulations of Board</MarginalNote><Label>26</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403456" lims:id="1403456"><Label>(1)</Label><Text>The Board may make regulations respecting its powers, duties and functions under this Act, including regulations respecting</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403457" lims:id="1403457"><Label>(a)</Label><Text>rules of procedure for proceedings;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403458" lims:id="1403458"><Label>(b)</Label><Text>the use of means of telecommunication that permit simultaneous communication;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403459" lims:id="1403459"><Label>(c)</Label><Text>the forms to be used in connection with a complaint;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403460" lims:id="1403460"><Label>(d)</Label><Text>the time within which and the circumstances under which the Board may exercise its powers under this Act;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403461" lims:id="1403461"><Label>(e)</Label><Text>the form in which and the period during which evidence may be presented to the Board;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403462" lims:id="1403462"><Label>(f)</Label><Text>the time within which and the parties or persons to whom notices and other documents must be sent and the circumstances in which the notices or documents are deemed to have been given or received by the Board or any party or person; lims:enacted-date="2023-06-20" lims:fid="1403472" lims:id="1403472"><Label>(d)</Label><Text>the complaint has been settled in writing between the complainant and the federally regulated private business;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403473" lims:id="1403473"><Label>(e)</Label><Text>there are other means available to the complainant to resolve the subject matter of the complaint that the Board considers should be pursued;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403474" lims:id="1403474"><Label>(f)</Label><Text>the subject matter of the complaint has been adequately dealt with through recourse obtained before a court, tribunal, arbitrator or adjudicator; or</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403475" lims:id="1403475"><Label>(g)</Label><Text>if the complainant is subject to a collective agreement, the collective agreement covers the subject matter of the complaint and provides a third party dispute resolution process.</Text></Paragraph></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403476" lims:id="1403476"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403477" lims:id="1403477">Notice of rejection</MarginalNote><Label>(2)</Label><Text>If the Board rejects a complaint, it must notify the parties in writing, with reasons.</Text></Subsection></Section><Section in-force="no" lims:id="1403480"><Label>(a)</Label><Text>permit the complainant to return to the duties of their employment;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403481" lims:id="1403481"><Label>(b)</Label><Text>reinstate the complainant;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403482" lims:id="1403482"><Label>(c)</Label><Text>pay to the complainant compensation not exceeding the sum that, in the Board’s opinion, is equivalent to the remuneration that would, but for the failure to comply, have been paid to the complainant;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403483" lims:id="1403483"><Label>(d)</Label><Text>pay to the complainant compensation not exceeding the sum that, in the Board’s opinion, is equivalent to any financial or other penalty imposed on the complainant by the federally regulated private business; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403484" lims:id="1403484"><Label>(e)</Label><Text>do any other thing that the Board considers equitable for the federally regulated private business to do to remedy or counteract any consequence of the failure to comply.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403485" lims:id="1403485"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403486" lims:id="1403486">Copy of decision</MarginalNote><Label>29</Label><Text>The Board is to provide all parties, as well as the Commissioner, with a copy of its decision on whether a complaint is well-founded and of any related order made under section <XRefInternal>28</XRefInternal>, with reasons.</Text></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403487" lims:id="1403487"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403488" lims:id="1403488">Enforcement of orders</MarginalNote><Label>30</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403489" lims:id="1403489"><Label>(1)</Label><Text>Any person affected by an order of the Board made under section <XRefInternal>28</XRefInternal>, or the Commissioner on the request of such a person, may file a certified copy of the order, exclusive of reasons, in the Federal Court after the later of 14 days after the day on which the order is made and 14 days after a day that may be provided for in the order.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403490" lims:id="1403490"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403491" lims:id="1403491">Registration</MarginalNote><Label>(2)</Label><Text>Once filed, the order must be registered in the Federal Court and, when registered, has the same force and effect, and all proceedings may be taken in respect of it, as if the order were a judgment obtained in that Court.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403492" lims:id="1403492"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403493" lims:id="1403493">No civil remedy affected</MarginalNote><Label>31</Label><Text>No civil remedy of an employee against an employer is suspended or affected by this Act.</Text></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403494" lims:id="1403494"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403495" lims:id="1403495">Regulations</MarginalNote><Label>32</Label><Text>The Governor in Council may make regulations for the purposes of lims:enacted-date="2023-06-20" lims:fid="1403498" lims:id="1403498">Regulations</MarginalNote><Label>33</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403499" lims:id="1403499"><Label>(1)</Label><Text>Subject to section <XRefInternal>32</XRefInternal>, the Governor in Council may, on the Minister’s recommendation, make regulations for the purposes of this Act, including regulations</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403500" lims:id="1403500"><Label>(a)</Label><Text>specifying, for the purposes of paragraph (a) of the definition <DefinitionRef>federally regulated private business</DefinitionRef> in section <XRefInternal>2</XRefInternal>(1), a number of employees;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403501" lims:id="1403501"><Label>(b)</Label><Text>defining “close to retirement”, “conditions that could impede the learning of French”, “consumer”, “employee”, “many years of service”, “treat adversely” and any other term or expression that is used in any of sections <XRefInternal>5</XRefInternal> to <XRefInternal>13</XRefInternal> but not defined in section <XRefInternal>2</XRefInternal>;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403502" lims:id="1403502"><Label>(c)</Label><Text>respecting the notices referred to in subsection <XRefInternal>6</XRefInternal>(2);</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403503" lims:id="1403503"><Label>(d)</Label><Text>respecting the establishment and operation of a committee referred to in paragraph <XRefInternal>10</XRefInternal>(1)(c);</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403504" lims:id="1403504"><Label>(e)</Label><Text>prescribing circumstances for the purposes of paragraph <XRefInternal>18</XRefInternal>(3)(b);</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403505" lims:id="1403505"><Label>(f)</Label><Text>exempting, with or without conditions, federally regulated private businesses from the application of any provision of this Act or its regulations in respect of activities or workplaces that are related to a specified sector of activity; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403506" lims:id="1403506"><Label>(g)</Label><Text>exempting, with or without conditions, federally regulated private businesses from the application of any provision of this Act or its regulations for any reason, including reasons related to intellectual property rights, international standards or the conduct of interprovincial or international business.</Text></Paragraph></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403507" lims:id="1403507"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403508" lims:id="1403508">Different numbers</MarginalNote><Label>(2)</Label><Text>A regulation made under paragraph (1)(a) may specify a different number of employees for federally regulated private businesses that have workplaces in Quebec and for federally regulated private businesses that do not have workplaces in Quebec but carry on business in Quebec.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403509" lims:id="1403509"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403510" lims:id="1403510">Factors</MarginalNote><Label>(3)</Label><Text>In making a regulation under subsection (1), the Governor in Council may take into account any factor that the Governor in Council considers appropriate, including</Text><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403511" lims:id="1403511"><Label>(a)</Label><Text>the volume of communications or services provided by federally regulated private businesses;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403512" lims:id="1403512"><Label>(b)</Label><Text>the type of services, documents, computer systems or work instruments required by the employees of federally regulated private businesses; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403513" lims:id="1403513"><Label>(c)</Label><Text>the mandates of and the nature of the activities carried out by federally regulated private businesses.</Text></Paragraph></Subsection></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403514" lims:id="1403514"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403515" lims:id="1403515">Consultations</MarginalNote><Label>34</Label><Text>The Minister must, at a time and in a manner appropriate to the circumstances, seek the views of members of the public as an integral part of the two official language communities of Canada and of organizations representative of employees or employers of federally regulated private businesses on proposed regulations to be made under sections <XRefInternal>32</XRefInternal> or <XRefInternal>33</XRefInternal>.</Text></Section><Section in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403516" lims:id="1403516"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403517" lims:id="1403517">Tabling of draft of proposed regulation</MarginalNote><Label>35</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403518" lims:id="1403518"><Label>(1)</Label><Text>If the Governor in Council proposes to make a regulation under section <XRefInternal>33</XRefInternal>, the Minister must lay a draft of the proposed regulation before the House of Commons at least 30 days before a copy of the regulation is published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> under section <XRefInternal>36</XRefInternal>.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403519" lims:id="1403519"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403520" lims:id="1403520">Calculation of 30-day period</MarginalNote><Label>(2)</Label><Text>In calculating the 30-day period referred to in subsection (1), only the days on which the House of Commons sits must be lims:fid="1403522" lims:id="1403522">Publication of proposed regulation</MarginalNote><Label>36</Label><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403523" lims:id="1403523"><Label>(1)</Label><Text>A copy of each regulation that the Governor in Council proposes to make under section <XRefInternal>33</XRefInternal> must be published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> at least 30 days before its proposed effective date, and a reasonable opportunity must be afforded to interested persons to make representations to the Minister with respect to the proposed regulation.</Text></Subsection><Subsection in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403524" lims:id="1403524"><MarginalNote in-force="no" lims:enacted-date="2023-06-20" lims:fid="1403525" lims:id="1403525">Exception</MarginalNote><Label>(2)</Label><Text>No proposed regulation need be published under subsection (1) if it Commissioner and the Minister made under this Act, are to be reviewed on a permanent basis by any committee of the Senate, of the House of Commons or of both Houses of Parliament that may be derogates from any powers, privileges or immunities of members of the Senate or the House of Commons in respect of their personal offices and staff or of judges of any Court.</Text></Section><Section
