lims:id="460955"><Label>(1)</Label><Text>In this Act,</Text><Definition lims:inforce-start-date="2002-12-31" lims:fid="460956" lims:id="460956"><Text><DefinedTermEn>client</DefinedTermEn> means a person from whom a discounter acquires a right to a refund of tax to which that person is entitled; (<DefinedTermFr>client</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="460957" lims:id="460957"><Text><DefinedTermEn>discounter</DefinedTermEn> means a person who acquires, for a consideration, a right to a refund of tax from a person entitled thereto; (<DefinedTermFr>escompteur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="460958" lims:id="460958"><Text><DefinedTermEn>minimum consideration</DefinedTermEn>, in relation to a refund of tax, means an amount equal to</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460959" lims:id="460959"><Label>(a)</Label><Text>where the refund of tax is equal to or less than three hundred dollars, eighty-five per cent of the refund of tax, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460960" lims:id="460960"><Label>(b)</Label><Text>where the refund of tax is greater than three hundred dollars, two hundred and fifty-five dollars plus ninety-five per cent of the amount by which the refund of tax is greater than three hundred dollars; (<DefinedTermFr>contrepartie minimale</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="460961" lims:id="460961"><Text><DefinedTermEn>Minister</DefinedTermEn> means the form, the information to be given on a form or the manner of filing a form, authorized by the Minister, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460964" lims:id="460964"><Label>(b)</Label><Text>in any other case, prescribed by regulation; (<DefinitionEnOnly>Version anglaise seulement</DefinitionEnOnly>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="460965" lims:id="460965"><Text><DefinedTermEn>refund of tax</DefinedTermEn> means the amount of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460966" lims:id="460966"><Label>(a)</Label><Text>an overpayment of tax paid or deemed to have been paid under the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> or collected pursuant to an agreement entered into under section 7 of the <XRefExternal reference-type="act" link="F-8">Federal-Provincial Fiscal Arrangements Act</XRefExternal>, or of tax deemed to have been paid under an Act of the legislature of a province that imposes a tax on income that is collected by the Minister of National Revenue pursuant to such an agreement,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460967" lims:id="460967"><Label>(b)</Label><Text>a payment to an individual by virtue of an agreement referred to in paragraph (a) that is other than a refund of an overpayment of tax paid or collected,</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460968" lims:id="460968"><Label>(c)</Label><Text>an overpayment of premiums paid under the <XRefExternal reference-type="act" link="E-5.6">Employment Insurance Act</XRefExternal>, or</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460969" lims:id="460969"><Label>(d)</Label><Text>an overpayment of contributions paid under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal>,</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2002-12-31" lims:fid="460970" lims:id="460970"><Text>and any interest paid on any of those overpayments or payments; (<DefinedTermFr>remboursement d’impôt</DefinedTermFr>)</Text></ContinuedDefinition></Definition><Definition lims:inforce-start-date="2002-12-31" lims:fid="460971" lims:id="460971"><Text><DefinedTermEn>return of income</DefinedTermEn> means a return of income pursuant to subsection 150(1) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>. (<DefinedTermFr>déclaration du revenu</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="460972" lims:id="460972"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="460973" lims:id="460973">Where person acquires right to a refund</MarginalNote><Label>(2)</Label><Text>For the purposes of this Act, a person acquires a right to a refund of tax where that person, as between himself and another person, acquires a right to a refund of tax or to an amount equal to the amount of a refund of tax, notwithstanding that, by virtue of section 67 of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal> or any provision of any other Act of Parliament or of the legislature of a province, the refund of tax is not assignable.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="460974" lims:id="460974"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="460975" lims:id="460975">Enforcement of right to refund</MarginalNote><Label>(3)</Label><Text>A right to a refund of tax acquired by a discounter from a client is enforceable only between the client and the discounter and nothing in this Act shall be construed as creating any liability between the discounter and Her lims:inforce-start-date="2002-12-31" lims:fid="460979" lims:id="460979">Payment to discounter</MarginalNote><Label>2.1</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="460980" lims:id="460980"><Label>(1)</Label><Text>Where a discounter has acquired a client’s right to a refund of tax, the Minister of National Revenue may pay the amount of the refund to the discounter.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="460981" lims:id="460981"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="460982" lims:id="460982">Effect of payment to discounter</MarginalNote><Label>(2)</Label><Text>A payment of a client’s refund of tax made by the Minister of National Revenue under subsection (1) to a discounter shall be deemed to have been made to the client as a refund of tax at the time the payment was made to the discounter.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="460983" lims:id="460983"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="460984" lims:id="460984">Deemed trust</MarginalNote><Label>(3)</Label><Text>The amount by which the amount of a refund paid under subsection (1) exceeds the total of</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460985" lims:id="460985"><Label>(a)</Label><Text>that portion of the refund that constitutes interest, and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460986" lims:id="460986"><Label>(b)</Label><Text>the amount estimated to be the client’s refund of tax at the time the right to the refund was acquired</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="460987" lims:id="460987"><Text>shall, if it exceeds ten dollars, be deemed to be held in trust for the client by the discounter until such time as it is paid to the client or to the Receiver General.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="460988" lims:id="460988"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="460989" lims:id="460989">Where bankruptcy, etc., of discounter</MarginalNote><Label>(4)</Label><Text>In the event of any liquidation, assignment or bankruptcy of a discounter, the amount deemed by subsection (3) to be held in trust shall be deemed to be separate from and form no part of the estate in liquidation, assignment or bankruptcy, whether or not that amount has in fact been kept separate and apart from the discounter’s own moneys or from the assets of the estate.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="460991" lims:id="460991">1993, c. 24, s. 149</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="460992" lims:id="460992"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="460993" lims:id="460993">Limitation of discount</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="460994" lims:id="460994"><Label>(1)</Label><Text>Any discounter who acquires a right to a refund of tax from a client for a consideration that is less than the minimum consideration in relation to the refund of tax is guilty of an offence.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="460995" lims:id="460995"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="460996" lims:id="460996">Determination of consideration</MarginalNote><Label>(2)</Label><Text>For the purposes of determining the consideration paid or provided by a discounter for the acquisition of a right to a refund of tax from a client, the discount charged by the discounter includes the amount of any fee or charge levied or made by the discounter, or by any person not acting at arm’s length (within the meaning of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>) with the discounter, for the service of preparing the client’s return of income or for any other service directly related to the discounting transaction.</Text></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="460997" lims:id="460997"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="460998" lims:id="460998">Defence</MarginalNote><Label>(3)</Label><Text>Subsection (1) does not apply where the refund of tax exceeds the amount estimated to be the refund of tax at the time the right to the refund was acquired if</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="460999" lims:id="460999"><Label>(a)</Label><Text>the consideration paid for the right at that time was equal to or greater than the minimum consideration calculated as if the amount estimated to be the refund of tax were the refund of tax; and</Text></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="461000" lims:id="461000"><Label>(b)</Label><Text>where the refund of tax, calculated for the purposes of this paragraph without reference to any interest on the overpayment or payment making up the refund, exceeds by ten dollars or more the amount estimated to be the refund of tax, the discounter, forthwith after receipt of the refund, pays or makes every reasonable effort to pay to the client the full amount of the excess and, in the event that the excess is not so paid within thirty days thereafter, forthwith remits the excess, together with a true copy of the notice referred to in paragraph 5(b), to the Receiver General to be held on account of any future tax liability of the client or to be paid to the client on application by the client to the Minister of National Revenue.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="461002" lims:id="461002">R.S., 1985, c. T-3, s. 3; R.S., 1985, c. 53 (1st Supp.), s. 2; 1999, c. 31, s. 245(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2023-06-22" lims:fid="461003" lims:id="461003"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="461004" lims:id="461004">Payment and disclosure</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2002-12-31" lims:fid="461005" lims:id="461005"><Label>(1)</Label><Text>Any discounter who does not, at or before the time a right to a refund of tax is acquired from a client,</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="461006" lims:id="461006"><Label>(a)</Label><Text>pay by cash or by a cheque or other bill of exchange drawn on a financial institution in Canada that is payable on demand and negotiable in Canada at the time it is given the amount by which</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="461007" lims:id="461007"><Label>(i)</Label><Text>the full amount of the minimum consideration for the right based on the estimated refund of tax</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2002-12-31" lims:fid="461008" lims:id="461008"><Text>exceeds the total of</Text></ContinuedParagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="461009" lims:id="461009"><Label>(ii)</Label><Text>any tax imposed under Part IX of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> that the discounter is required to collect from the client in respect of a taxable supply deemed under section 158 of that Act to have been made by the discounter to the client, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="461010" lims:id="461010"><Label>(iii)</Label><Text>any tax imposed under <XRefExternal reference-type="act">An Act respecting the Quebec sales tax and amending various fiscal legislation</XRefExternal>, being Chapter 67 of the Statutes of Quebec, 1991, that the discounter is required to collect from the client in respect of a taxable supply deemed under section 39 of that Act to have been made by the discounter to the client,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="461011" lims:id="461011"><Label>(b)</Label><Text>provide the client with</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="461012" lims:id="461012"><Label>(i)</Label><Text>a statement in prescribed form describing the discounting transaction, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="461013" lims:id="461013"><Label>(ii)</Label><Text>if the client has so requested, a true copy of the client’s return of income and any related information return, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="461014" lims:id="461014"><Label>(c)</Label><Text>obtain from the client an address of record for the purposes of section 5,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="461015" lims:id="461015"><Text>is guilty of an offence.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2002-12-31" lims:fid="461016" lims:id="461016"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="461017" lims:id="461017">Failure to file disclosure statement</MarginalNote><Label>(2)</Label><Text>Any discounter who, having acquired from a client a right to a refund of tax, files a client’s return of income on the client’s behalf without</Text><Paragraph lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="461018" lims:id="1417461"><Label>(a)</Label><Text>including with the return of income, other than a return of income deemed by subsection 150.1(3) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> to have been filed for the purposes of section 150 of that Act, a true copy of the statement referred to in subparagraph (1)(b)(i) as provided to the client, and</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-22" lims:enacted-date="2023-06-22" lims:fid="461019" lims:id="1417462"><Label>(b)</Label><Text>providing to such person and within such period of time as the Minister may specify a true copy of the statement referred to in subparagraph (1)(b)(i) as provided to the client,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="461020" lims:id="461020"><Text>is guilty of an offence.</Text></ContinuedSectionSubsection></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="461022" lims:id="461022">R.S., 1985, c. T-3, s. 5; R.S., 1985, c. 53 (1st Supp.), s. 2; 1993, c. 34, s. 118(F); 1998, c. 19, s. 301(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2002-12-31" lims:lastAmendedDate="2002-12-31" lims:fid="461030" lims:id="461030"><MarginalNote lims:inforce-start-date="2002-12-31" lims:fid="461031" lims:id="461031">Failure to maintain records or provide access</MarginalNote><Label>6</Label><Text>Any discounter who, having acquired from a client a right to a refund of tax, at any time fails during the three year period immediately following the acquisition of that right</Text><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="461032" lims:id="461032"><Label>(a)</Label><Text>to maintain at the discounter’s principal place of business in Canada, or at such other place or places in Canada as are designated by the Minister, a true copy of</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="461033" lims:id="461033"><Label>(i)</Label><Text>every document provided by the discounter under this Act to the client, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="461034" lims:id="461034"><Label>(ii)</Label><Text>every other document made by the discounter or received by the discounter in the course of the discounter’s business and dealing with the discounting transaction, or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2002-12-31" lims:fid="461035" lims:id="461035"><Label>(b)</Label><Text>to provide</Text><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="461036" lims:id="461036"><Label>(i)</Label><Text>a peace officer, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2002-12-31" lims:fid="461037" lims:id="461037"><Label>(ii)</Label><Text>a person designated for the purposes of this section by the Minister or the Minister of the Crown in right of the province where the copies are maintained who is responsible for the administration of matters related to consumer affairs,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2002-12-31" lims:fid="461038" lims:id="461038"><Text>reasonable access to such copies for the purposes of examination and making copies thereof,</Text></ContinuedParagraph></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2002-12-31" lims:fid="461039" lims:id="461039"><Text>is guilty of an offence.</Text></ContinuedSectionSubsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2002-12-31" lims:fid="461041" lims:id="461041">R.S., 1985, c.
