(<DefinedTermFr>organisme cinématographique gouvernemental canadien</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1029029" lims:id="1029029" generate-in-text="no"><Text><DefinedTermEn>Canadian program</DefinedTermEn> means a Canadian program as defined in subsection 2(1) of the <XRefExternal reference-type="regulation" link="SOR-90-105">Pay Television Regulations, 1990</XRefExternal>, in section 2 of the <XRefExternal reference-type="regulation" link="SOR-90-106">Specialty Services Regulations, 1990</XRefExternal>, and in section 2 of the <XRefExternal reference-type="regulation" link="SOR-87-49">Television Broadcasting Regulations, 1987</XRefExternal>. (<DefinedTermFr>émission canadienne</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1029030" lims:id="1029030" level="1"><TitleText>Prescribed Cinematographic Works</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1029031" lims:id="1029031"><Label>2</Label><Text>The following are prescribed cinematographic works for the purposes of section 17 of the <XRefExternal reference-type="act" link="C-42">Copyright Act</XRefExternal>, namely, a cinematographic work in which a performer’s performance has been embodied as a result of an agreement entered into by the performer on or after April 22, 1999:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1029032" lims:id="1029032"><Label>(a)</Label><Text>in respect of which the Minister of Canadian Heritage has issued a Canadian film or video production certificate under the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1029033" lims:id="1029033"><Label>(b)</Label><Text>that is recognized as a Canadian program by the Canadian Radio-television and Telecommunications Commission; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1029034" lims:id="1029034"><Label>(c)</Label><Text>that has received production funding from Telefilm Canada, or other Canadian government film agency.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1029036" lims:id="1029036">2002. c. 17, s. 15</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1029037" lims:id="1029037" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1029038" lims:id="1029038"><Label>3</Label><Text>These Regulations come into force on April 22, 1999.</Text></Section></Body></Regulation>
