(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019269" lims:id="1019269" generate-in-text="no"><Text><DefinedTermEn>agency firearm</DefinedTermEn> means a firearm that is in the possession of a public service agency for use by its public agents. (<DefinedTermFr>arme à feu d’agence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019270" lims:id="1019270" generate-in-text="no"><Text><DefinedTermEn>agency identification number</DefinedTermEn><Repealed>[Repealed, SOR/2004-265, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019271" lims:id="1019271" generate-in-text="no"><Text><DefinedTermEn>class</DefinedTermEn> means one of the following classes of firearms, namely, prohibited firearms, restricted firearms and non-restricted firearms. (<DefinedTermFr>classe</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019272" lims:id="1019272" generate-in-text="no"><Text><DefinedTermEn>controlled item</DefinedTermEn> means a prohibited device, a prohibited weapon, a restricted weapon or prohibited ammunition. (<DefinedTermFr>article contrôlé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019273" lims:id="1019273" generate-in-text="no"><Text><DefinedTermEn>firearm identification number</DefinedTermEn> means a number assigned to a firearm under paragraph 7(1)(b). (<DefinedTermFr>numéro d’enregistrement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019274" lims:id="1019274" generate-in-text="no"><Text><DefinedTermEn>non-restricted firearm</DefinedTermEn> means a firearm that is neither a prohibited firearm nor a restricted firearm. (<DefinedTermFr>arme à feu sans restrictions</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019275" lims:id="1019275" generate-in-text="no"><Text><DefinedTermEn>protected firearm</DefinedTermEn> means a firearm that is in the possession of a public service agency and that is not an agency firearm. (<DefinedTermFr>arme à feu protégée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019276" lims:id="1019276" generate-in-text="no"><Text><DefinedTermEn>public agent</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019277" lims:id="1019277"><Label>(a)</Label><Text>any of the following persons in the course of their duties or for the purposes of their employment:</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1019278" lims:id="1019278"><Label>(i)</Label><Text>peace officers,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1019279" lims:id="1019279"><Label>(ii)</Label><Text>persons training to become police officers or peace officers under the control and supervision of a police force or a police academy or similar institution designated by the federal Minister or the lieutenant governor in council of a province,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1019280" lims:id="1019280"><Label>(iii)</Label><Text>persons or members of a class of persons employed in the public service of Canada or by the government of a province or municipality who are prescribed to be public officers by the <XRefExternal reference-type="regulation" link="SOR-98-466">Regulations Prescribing Public Officers</XRefExternal>, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1019281" lims:id="1019281"><Label>(iv)</Label><Text>chief firearms officers and firearms officers, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019282" lims:id="1019282"><Label>(b)</Label><Text>an individual acting on behalf of, and under the authority of, a police force or a department of the Government of Canada or of a province. (<DefinedTermFr>agent public</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019283" lims:id="1019283" generate-in-text="no"><Text><DefinedTermEn>public agency identification number</DefinedTermEn> means the number assigned to a public service agency or unit under paragraph 7(1)(a). (<DefinedTermFr>numéro d’identification</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019284" lims:id="1019284" generate-in-text="no"><Text><DefinedTermEn>public service agency</DefinedTermEn> means a police force, a department or agency of the public service of Canada or of a province or municipality, a police academy or other public agency that employs or otherwise has under its authority public agents. (<DefinedTermFr>agence de services publics</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019285" lims:id="1019285" generate-in-text="no"><Text><DefinedTermEn>sticker</DefinedTermEn> means a self-adhesive label issued by the Registrar under subsection 7(2). (<DefinedTermFr>étiquette</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1019286" lims:id="1019286" generate-in-text="no"><Text><DefinedTermEn>unit</DefinedTermEn> means any part of a public service agency. (<DefinedTermFr>subdivision</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019288" lims:id="1019288">SOR/2004-265, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019289" lims:id="1019289" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019290" lims:id="1019290"><Label>2</Label><Text>These Regulations apply to:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019291" lims:id="1019291"><Label>(a)</Label><Text>public service agencies; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019292" lims:id="1019292"><Label>(b)</Label><Text>public agents.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019293" lims:id="1019293" level="1"><TitleText>Storage of Firearms</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019294" lims:id="1019294"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019295" lims:id="1019295"><Label>(1)</Label><Text>A public agent who is assigned an agency firearm or a controlled item shall, when the firearm or item is not in use,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019296" lims:id="1019296"><Label>(a)</Label><Text>ensure that it is stored in a container, receptacle, vault, safe or room, controlled by a public service agency, that is kept securely locked and is constructed so that it cannot readily be broken open or into; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019297" lims:id="1019297"><Label>(b)</Label><Text>store it in a dwelling house if authorized by the public service agency under whose authority the agent acts.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019298" lims:id="1019298"><Label>(2)</Label><Text>A public agent who stores an agency firearm in a dwelling house shall store the firearm</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019299" lims:id="1019299"><Label>(a)</Label><Text>in accordance with the <XRefExternal reference-type="regulation" link="SOR-98-209">Storage, Display, Transportation and Handling of Firearms by Individuals Regulations</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019300" lims:id="1019300"><Label>(b)</Label><Text>in accordance with instructions given to the agent under subsection (4).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019301" lims:id="1019301"><Label>(3)</Label><Text>A public agent who stores a controlled item in a dwelling house shall store the item</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019302" lims:id="1019302"><Label>(a)</Label><Text>in a container or receptacle that is kept securely locked and that is constructed so that it cannot readily be broken open or into; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019303" lims:id="1019303"><Label>(b)</Label><Text>in accordance with instructions given to the agent under subsection (4).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019304" lims:id="1019304"><Label>(4)</Label><Text>A public service agency may give written instructions respecting the safe storage of its agency firearms and controlled items in a dwelling house.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019306" lims:id="1019306">SOR/2004-265, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019307" lims:id="1019307"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019308" lims:id="1019308"><Label>(1)</Label><Text>Every public service agency shall ensure that its agency firearms and controlled items that have been assigned to a public agent are stored in accordance with subsections 3(1) to (3) when the firearms or items are not in use.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019309" lims:id="1019309"><Label>(2)</Label><Text>Every public service agency shall ensure that its agency firearms and controlled items that have not been assigned to a public agent and its protected firearms are stored in a container, receptacle, vault, safe or room, controlled by the agency, that is kept securely locked and is constructed so that it cannot readily be broken open or into.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019311" lims:id="1019311">SOR/2004-265, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019312" lims:id="1019312" level="1"><TitleText>Training</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019313" lims:id="1019313"><Label>5</Label><Text>Every public service agency shall ensure that each public agent whom it employs, or otherwise has under its authority, and who stores, handles, transports, possesses or uses firearms in the course of his or her duties receives training appropriate to his or her particular duties before storing, handling, transporting, possessing or using them.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019315" lims:id="1019315">SOR/2004-265, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019316" lims:id="1019316" level="1"><TitleText>Public Agency Identification Number</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019317" lims:id="1019317"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019318" lims:id="1019318"><Label>(1)</Label><Text>Every public service agency shall ensure that one or more applications for public agency identification numbers have been made to the Registrar so that the agency, including all of its units, will be covered by one or more of those numbers.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019319" lims:id="1019319"><Label>(2)</Label><Text>An application shall include the name, address, telephone number and, if applicable, facsimile number and electronic mail address of the public service agency or unit making the application.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019321" lims:id="1019321">SOR/2004-265, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019322" lims:id="1019322" level="1"><TitleText>Duties of the Registrar</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019323" lims:id="1019323"><Label>7</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019324" lims:id="1019324"><Label>(1)</Label><Text>The Registrar shall assign:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019325" lims:id="1019325"><Label>(a)</Label><Text>a public agency identification number to any public service agency or unit that applies for one under section 6 or reports that it has possession of a firearm; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019326" lims:id="1019326"><Label>(b)</Label><Text>a firearm identification number to an agency firearm or a protected firearm reported under subsection 8(1), 8.1(1), 9(1) or 10(1) or (1.1) in respect of which a firearm identification number has not already been assigned.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019327" lims:id="1019327"><Label>(2)</Label><Text>In the case of a protected firearm that does not bear either a serial number sufficient to distinguish it from other firearms or a firearm identification number, the Registrar shall issue a sticker that bears the firearm identification number assigned to the firearm.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019329" lims:id="1019329">SOR/2004-265, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019330" lims:id="1019330" level="1"><TitleText>Change of Name or Address</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019331" lims:id="1019331"><Label>7.1</Label><Text>Every public service agency and unit that has been assigned a public agency identification number shall advise the Registrar of a change of its name or address within 30 days after the change.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019333" lims:id="1019333">SOR/2004-265, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019334" lims:id="1019334" level="1"><TitleText>Initial Firearm Inventory</TitleText></Heading><Section lims:inforce-start-date="2006-10-26" lims:lastAmendedDate="2006-10-26" lims:fid="1019335" lims:id="1019335"><Label>8</Label><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019336" lims:id="1019336"><Label>(1)</Label><Text>Every public service agency shall ensure that on or before October 31, 2009 the Registrar is provided with one or more reports that set out the inventory of all agency firearms and protected firearms in the agency’s possession on October 31, 2008.</Text></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019337" lims:id="1019337"><Label>(1.1)</Label><Text>For the purposes of subsection (1), inventory does not include protected firearms in the public service agency’s possession on October 31, 2008 that the agency intends to dispose of on or before October 31, 2009.</Text></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019338" lims:id="1019338"><Label>(1.2)</Label><Text>A report shall include the name and the public agency identification number of the public service agency or unit making the report.</Text></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019339" lims:id="1019339"><Label>(2)</Label><Text>For each agency firearm set out in a report referred to in subsection (1), the public service agency or unit making the report shall include the following information:</Text><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019340" lims:id="1019340"><Label>(a)</Label><Text>serial number, if any;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019341" lims:id="1019341"><Label>(b)</Label><Text>make;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019342" lims:id="1019342"><Label>(c)</Label><Text>the name of the manufacturer if different from the make;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019343" lims:id="1019343"><Label>(d)</Label><Text>model, if known;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019344" lims:id="1019344"><Label>(e)</Label><Text>type;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019345" lims:id="1019345"><Label>(f)</Label><Text>action;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019346" lims:id="1019346"><Label>(g)</Label><Text>calibre or gauge;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019347" lims:id="1019347"><Label>(h)</Label><Text>the barrel length if it is shorter than 470 mm; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019348" lims:id="1019348"><Label>(i)</Label><Text>the quantity of ammunition that the cartridge magazine can contain.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019349" lims:id="1019349"><Label>(3)</Label><Text>For each protected firearm set out in a report referred to in subsection (1), the public service agency or unit making the report shall include the following information:</Text><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019350" lims:id="1019350"><Label>(a)</Label><Text>the serial number, if any;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019351" lims:id="1019351"><Label>(b)</Label><Text>the type;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019352" lims:id="1019352"><Label>(c)</Label><Text>whether the barrel length is shorter than 470 mm; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019353" lims:id="1019353"><Label>(d)</Label><Text>the case reference or file reference respecting the firearm, if applicable.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019354" lims:id="1019354"><Label>(4)</Label><Text><Repealed>[Repealed, SOR/2004-265, s. 5]</Repealed></Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-10-26" lims:fid="1019356" lims:id="1019356">SOR/98-468, s. 2; SOR/99-109, s. 2; SOR/2001-9, s. 2; SOR/2002-443, s. 1; SOR/2003-401, s. 1; SOR/2004-265, s. 7; SOR/2005-240, s. 3; SOR/2006-258, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019372" lims:id="1019372" level="1"><TitleText>Coming into Possession — Protected Firearms</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019374" lims:id="1019374">SOR/2004-265, s. 8</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2006-10-26" lims:lastAmendedDate="2006-10-26" lims:fid="1019375" lims:id="1019375"><Label>10</Label><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019376" lims:id="1019376"><Label>(1)</Label><Text>Every public service agency shall ensure that a report of each firearm that comes into its possession after October 31, 2008 and that it keeps as a protected firearm is provided to the Registrar, subject to subsection (1.1), within 30 days after the coming into possession.</Text></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019377" lims:id="1019377"><Label>(1.1)</Label><Text>If the Canada Border Services Agency comes into the possession of a firearm other than through abandonment, seizure or forfeiture and the firearm remains in the possession of the Agency for more than 90 days, the Agency shall ensure that the report is made without delay after the 90 days.</Text></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019378" lims:id="1019378"><Label>(2)</Label><Text>The report shall include the following information:</Text><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019379" lims:id="1019379"><Label>(a)</Label><Text>the name and public agency identification number of the public service agency or unit making the report;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019380" lims:id="1019380"><Label>(b)</Label><Text>with respect to the firearm, its firearm identification number or, if there is none, the information referred to in paragraphs 8(2)(a) to (i);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019381" lims:id="1019381"><Label>(c)</Label><Text>whether the firearm was found, detained, seized, surrendered in an amnesty or otherwise surrendered;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019382" lims:id="1019382"><Label>(d)</Label><Text>the case reference or file reference respecting the firearm, if applicable; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019383" lims:id="1019383"><Label>(e)</Label><Text>if applicable, a statement that the firearm was imported by the public service agency or unit.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019384" lims:id="1019384"><Label>(3)</Label><Text>This section does not apply in respect of</Text><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019385" lims:id="1019385"><Label>(a)</Label><Text>a firearm that has been in the possession of the public service agency for less than 72 hours; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019403" lims:id="1019403"><Label>(b)</Label><Text>with respect to the firearm, its firearm identification number or, if there is none, the information referred to in paragraphs 8(2)(a) to (i).</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019405" lims:id="1019405">SOR/2004-265, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019406" lims:id="1019406" level="1"><TitleText>Modification to Agency Firearms</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019407" lims:id="1019407"><Label>12</Label><Text>Every public service agency shall ensure that the Registrar is advised of any modification to one of its agency firearms that changes the class of the firearm within 30 days after the modification is made.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019409" lims:id="1019409">SOR/2004-265, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019410" lims:id="1019410" level="1"><TitleText>Transactions Involving Firearms</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019411" lims:id="1019411"><Label>12.1</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019412" lims:id="1019412"><Label>(1)</Label><Text>Subject to subsections (2) and (3), a public service agency may only sell, barter, give, lend or rent a firearm to another public service agency.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019413" lims:id="1019413"><Label>(2)</Label><Text>A public service agency may give or lend a firearm to a department, an agency or a police force of a foreign government, national or otherwise, for purposes of evidence in judicial proceedings.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019414" lims:id="1019414"><Label>(3)</Label><Text>A public service agency may return an agency firearm to the business that supplied it if the firearm is defective.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019415" lims:id="1019415"><Label>(4)</Label><Text>For greater certainty, nothing in this section prevents a public service agency from returning a protected firearm to a person who is entitled to it.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019417" lims:id="1019417">SOR/2004-265, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019418" lims:id="1019418"><Label>13</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019419" lims:id="1019419"><Label>(1)</Label><Text>A public service agency that sells, barters, gives, lends or rents a firearm or returns a firearm under subsection 12.1(3) shall ensure that a report on the transaction is provided to the Registrar</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019420" lims:id="1019420"><Label>(a)</Label><Text>in the case of a firearm that is sold, bartered, given or returned, without delay; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019421" lims:id="1019421"><Label>(b)</Label><Text>in the case of a firearm that is loaned or rented,</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1019422" lims:id="1019422"><Label>(i)</Label><Text>if the firearm is intended to be lent or rented for more than 180 days, without delay, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1019423" lims:id="1019423"><Label>(ii)</Label><Text>if the firearm is not intended to be lent or rented for more than 180 days but the period that the firearm is lent or rented lasts longer than 180 days, without delay after the 180 days.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019424" lims:id="1019424"><Label>(2)</Label><Text>A public service agency that lends or rents a firearm that is required to be reported under paragraph (1)(b) shall ensure that a report of the return of the firearm is provided to the Registrar without delay.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019425" lims:id="1019425"><Label>(3)</Label><Text>A report under subsection (1) or (2) shall include the following information:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019426" lims:id="1019426"><Label>(a)</Label><Text>the names of the parties to the transaction and their public agency identification numbers, if any; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019427" lims:id="1019427"><Label>(b)</Label><Text>with respect to the firearm, its firearm identification number or, if there is none, the information referred to in paragraphs 8(2)(a) to (i).</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019429" lims:id="1019429">SOR/2004-265, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019430" lims:id="1019430"><Label>14</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019431" lims:id="1019431"><Label>(1)</Label><Text>A public service agency that returns a protected firearm to the person entitled to it shall ensure that a report on the transaction is provided to the Registrar without delay.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019432" lims:id="1019432"><Label>(2)</Label><Text>The report shall include the following information:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019433" lims:id="1019433"><Label>(a)</Label><Text>the name and public agency identification number of the public service agency or unit making the report;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019434" lims:id="1019434"><Label>(b)</Label><Text>with respect to the firearm, its firearm identification number or, if there is none, the information referred to in paragraphs 8(2)(a) to (i);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019435" lims:id="1019435"><Label>(c)</Label><Text>the number of the registration certificate for the firearm, if any; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1019436" lims:id="1019436"><Label>(d)</Label><Text>the licence number of the person entitled to the firearm or, if that person is a non-resident who does not hold a licence, the name of the person.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019438" lims:id="1019438">SOR/2004-265, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1019439" lims:id="1019439" level="1"><TitleText>Disposal of Firearms</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1019440" lims:id="1019440"><Label>15</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019441" lims:id="1019441"><Label>(1)</Label><Text>Before a public service agency disposes of a firearm, the agency shall offer the firearm to the chief firearms officer of the province in which the firearm is stored or to the Commissioner of the Royal Canadian Mounted Police, for destruction or for any scientific, research or educational purpose, or for preservation as a historical firearm.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1019442" lims:id="1019442"><Label>(2)</Label><Text>If the offer referred to in subsection (1) is refused, the public service agency may only dispose of the firearm by having it destroyed.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1019444" lims:id="1019444">SOR/2004-265, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-10-26" lims:lastAmendedDate="2006-10-26" lims:fid="1019445" lims:id="1019445"><Label>16</Label><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019446" lims:id="1019446"><Label>(1)</Label><Text>Every public service agency shall ensure that a report of each firearm that it disposes of is provided to the Registrar within 30 days after the disposal.</Text></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019447" lims:id="1019447"><Label>(2)</Label><Text>The report shall include the following information:</Text><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019448" lims:id="1019448"><Label>(a)</Label><Text>the name and public agency identification number of the public service agency or unit making the report;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019449" lims:id="1019449"><Label>(b)</Label><Text>with respect to the firearm, its firearm identification number or, if there is none, the information referred to in paragraphs 8(2)(a) to (i); and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-10-26" lims:fid="1019450" lims:id="1019450"><Label>(c)</Label><Text>the date, place and method of destruction.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-10-26" lims:fid="1019451" lims:id="1019451"><Label>(3)</Label><Text>Subsection (1) does not apply in respect of a protected firearm that is in the possession of a public service agency on October 31, 2008 and that the agency disposes of on or before October 31, 2009.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-10-26" lims:fid="1019453" lims:id="1019453">SOR/2004-265, s. 11;
