(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1005379" lims:id="1005379" generate-in-text="no"><Text><DefinedTermEn>appropriate police officer</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005380" lims:id="1005380"><Label>(a)</Label><Text>in the case of the RCMP, the Assistant Commissioner of the RCMP in charge of drug enforcement; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005381" lims:id="1005381"><Label>(b)</Label><Text>in the case of any other police force, the member of the police force who is the most senior officer responsible for operations. (<DefinedTermFr>agent de police compétent</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="1005382" lims:id="1005382" generate-in-text="no"><Text><DefinedTermEn>chief</DefinedTermEn> means, in respect of a police force other than the RCMP, the senior police officer in charge of the police force. SOR/2005-72, ss. 13, 17(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="1005548" lims:id="1005548" level="1"><TitleText>Detention of Forfeited Substances</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1005549" lims:id="1005549"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005550" lims:id="1005550">Forfeited substances</MarginalNote><Label>21</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005551" lims:id="1005551"><Label>(1)</Label><Text>The chief or appropriate officer shall, as soon as practicable but not later than 60 days after a forfeited controlled substance or precursor is no longer required for the proceeding in respect of which it was seized, where the controlled substance or precursor is required for the purposes of conducting investigations under the Act or any other Act of Parliament, inform the Minister in writing of that requirement.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005552" lims:id="1005552"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005553" lims:id="1005553">Secure location</MarginalNote><Label>(2)</Label><Text>Every controlled substance or precursor referred to in subsection (1) shall be kept in a secure location while not being used for the purposes of conducting investigations under the Act or any other Act of Parliament.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005554" lims:id="1005554"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005555" lims:id="1005555">Transfer</MarginalNote><Label>(3)</Label><Text>The chief or appropriate police officer of a police force is exempt from the application of section 5 of the Act if that person transfers any controlled substance or precursor referred to in subsection (1) to the chief or appropriate police officer of another police force and if the chief or appropriate police officer of that other police force requests the transfer for the purposes of a particular investigation.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005556" lims:id="1005556"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005557" lims:id="1005557">Inform Minister</MarginalNote><Label>(4)</Label><Text>Where a transfer is conducted pursuant to subsection (3), the chief or appropriate police officer who</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005558" lims:id="1005558"><Label>(a)</Label><Text>makes the transfer shall inform the Minister of the transfer, as soon as practicable after the request for the transfer has been received; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005559" lims:id="1005559"><Label>(b)</Label><Text>receives the controlled substance or precursor shall inform the Minister of its receipt, as soon as practicable after the receipt.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005560" lims:id="1005560"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005561" lims:id="1005561">Directions</MarginalNote><Label>(5)</Label><Text>If a controlled substance or precursor referred to in subsection (1) is no longer required for the purposes of conducting investigations under the Act or any other Act of Parliament, the chief or appropriate police officer shall seek the directions of the Minister and dispose of or otherwise deal with the controlled substance or precursor in accordance with the Minister's directions.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005562" lims:id="1005562"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005563" lims:id="1005563">Substances not required</MarginalNote><Label>(6)</Label><Text>If a forfeited controlled substance or precursor is no longer required for the proceeding in respect of which it was seized and is not required for the purposes of conducting investigations under the Act or any other Act of Parliament, the chief or appropriate police officer shall, as soon as practicable,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005564" lims:id="1005564"><Label>(a)</Label><Text>in writing seek directions from the Minister respecting the disposal of or otherwise dealing with the controlled substance or precursor, unless the Minister has previously given such directions; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005574" lims:id="1005574"><Label>(c)</Label><Text>a forfeited controlled substance or precursor referred to in section 21.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005575" lims:id="1005575"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005576" lims:id="1005576">Copy of report</MarginalNote><Label>(2)</Label><Text>The chief or appropriate police officer of a police force other than the RCMP shall also send a copy of the report referred to in subsection (1) to the provincial minister responsible for the police force.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005577" lims:id="1005577"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005578" lims:id="1005578">Contents of report</MarginalNote><Label>(3)</Label><Text>The report shall indicate the name and total quantity of each controlled substance or precursor and the quantity, in respect of each controlled substance or precursor, that was forfeited, imported, exported, produced or destroyed, as applicable.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005579" lims:id="1005579"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005580" lims:id="1005580">Additional report</MarginalNote><Label>(4)</Label><Text>The chief or appropriate police officer of a police force shall also submit, on request, a report in written or electronic format to the Minister respecting the controlled substances or precursors referred to in subsection (1) as required for the following purposes:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005581" lims:id="1005581"><Label>(a)</Label><Text>to ensure the protection of the public against potential public health risks caused by the potential misuse or diversion of those substances;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005582" lims:id="1005582"><Label>(b)</Label><Text>to collect data required for studies and research;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005583" lims:id="1005583"><Label>(c)</Label><Text>to meet international obligations of the Government of Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005584" lims:id="1005584"><Label>(d)</Label><Text>for compliance with these Regulations.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-07-15" lims:enacted-date="2022-07-15" lims:fid="1372902" lims:id="1372902" lims:enactId="1371858">SOR/2022-174, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2022-07-15" lims:fid="1005585" lims:id="1005585"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005586" lims:id="1005586">Report of substances no longer in possession</MarginalNote><Label>23</Label><Subsection lims:inforce-start-date="2022-07-15" lims:enacted-date="2022-07-15" lims:fid="1005587" lims:id="1372903"><Label>(1)</Label><Text>The chief or appropriate police officer shall submit a report in written or electronic format to the Minister of Public Safety and Emergency Preparedness and the Minister containing the information required by subsection (3), respecting every controlled substance or precursor referred to in subsection 21(1) that is lost, stolen or otherwise no longer in the possession of the police force, as soon as practicable after the substance is lost, stolen or no longer in the possession of the police force.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005588" lims:id="1005588"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005589" lims:id="1005589">Copy of report</MarginalNote><Label>(2)</Label><Text>The chief or appropriate police officer of a police force other than the RCMP shall also send a copy of the report referred to in subsection (1) to the provincial minister responsible for the police force.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1005590" lims:id="1005590"><MarginalNote lims:inforce-start-date="2006-03-22" lims:fid="1005591" lims:id="1005591">Contents of report</MarginalNote><Label>(3)</Label><Text>The report shall include the following information:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005592" lims:id="1005592"><Label>(a)</Label><Text>the name and quantity of each controlled substance or precursor;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1005593" lims:id="1005593"><Label>(b)</Label><Text>the date of forfeiture, importation or exportation of each controlled substance or precursor, or the production of each controlled substance, as applicable;
