(<DefinedTermFr>demandeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-03-27" lims:fid="1001003" lims:id="1001003" generate-in-text="no"><Text><DefinedTermEn>beer</DefinedTermEn> means beer or malt liquor as defined in section 4 of the <XRefExternal reference-type="act" link="E-14">Excise Act</XRefExternal>; SOR/2003-241, s. 1; SOR/2015-70, s. 1</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2022-06-23" lims:enacted-date="2022-06-23" lims:fid="1367926" lims:id="1367926" lims:enactId="1356571">2022, c. 10, s. 106</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001020" lims:id="1001020" level="1"><Label>PART I</Label><TitleText>Licensing of Bonded Warehouses</TitleText></Heading><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001021" lims:id="1001021" level="2"><TitleText>Issuance of Licence</TitleText></Heading><Section lims:inforce-start-date="2015-03-27" lims:lastAmendedDate="2024-10-21" lims:fid="1001022" lims:id="1001022"><Label>3</Label><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001023" lims:id="1001023"><Label>(1)</Label><Text>Subject to subsection (4), the Minister of Public Safety and Emergency Preparedness may issue a licence to any person who</Text><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001024" lims:id="1001024"><Label>(a)</Label><Text>makes an application in accordance with subsection (2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001025" lims:id="1001025"><Label>(b)</Label><Text>provides such security as may be required under subsection 91(4) of the <XRefExternal reference-type="act" link="C-54.011">Customs Tariff</XRefExternal> and in accordance with section 4.</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001026" lims:id="1001026"><Label>(c)</Label><Text><Repealed>[Repealed, SOR/2015-70, s. 2]</Repealed></Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="1001027" lims:id="1492714"><Label>(2)</Label><Text>An application for a licence must be submitted to the Minister in the prescribed form, together with a detailed plan of the proposed bonded warehouse.</Text></Subsection><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001028" lims:id="1001028"><Label>(3)</Label><Text>The plan referred to in subsection (2) must indicate</Text><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001029" lims:id="1001029"><Label>(a)</Label><Text>whether the place proposed to be operated as a bonded warehouse exists or is to be constructed;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001030" lims:id="1001030"><Label>(b)</Label><Text>the type of construction of the place, whether or not it already exists; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001031" lims:id="1001031"><Label>(c)</Label><Text>the area, within the place, that is to be used for the storage of goods.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001032" lims:id="1001032"><Label>(4)</Label><Text>The Minister of Public Safety and Emergency Preparedness shall not issue a licence to an applicant unless</Text><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001033" lims:id="1001033"><Label>(a)</Label><Text>the applicant is of good character;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001034" lims:id="1001034"><Label>(b)</Label><Text>the site of the proposed bonded warehouse is within an area served by a customs office;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001035" lims:id="1001035"><Label>(c)</Label><Text>the applicant has sufficient financial resources</Text><Subparagraph lims:inforce-start-date="2015-03-27" lims:fid="1001036" lims:id="1001036"><Label>(i)</Label><Text>to meet the requirements set out in sections 11 and 12, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-03-27" lims:fid="1001037" lims:id="1001037"><Label>(ii)</Label><Text>to lease or purchase the place proposed to be operated as a bonded warehouse;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001038" lims:id="1001038"><Label>(d)</Label><Text>the applicant will provide conditions suitable for the safekeeping of goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001039" lims:id="1001039"><Label>(e)</Label><Text>the Canada Border Services Agency is able to provide customs services with respect to the proposed bonded warehouse.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001040" lims:id="1001040"><Label>(5)</Label><Text>The terms and conditions under which a licence may be issued include the extent to which and circumstances in which, in accordance with section 20, goods may be manipulated, unpacked, packed, altered or combined with other goods while in bonded warehouses.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-03-27" lims:fid="1001042" lims:id="1001042">SOR/99-106, s. 2; SOR/2001-197, s. 9</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="1492717" lims:id="1492717" lims:enactId="1447813">SOR/2024-41, s. 67</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2015-03-27" lims:lastAmendedDate="2015-03-27" lims:fid="1001056" lims:id="1001056"><Label>5</Label><Text><Repealed>[Repealed, SOR/2015-70, s. 3]</Repealed></Text></Section><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001057" lims:id="1001057" level="2"><TitleText>Amendment of Licence</TitleText></Heading><Section lims:inforce-start-date="2015-03-27" lims:lastAmendedDate="2015-03-27" lims:fid="1001058" lims:id="1001058"><Label>6</Label><Text>The Minister of Public Safety and Emergency Preparedness may amend a licence only where the name of the licensee has been changed legally.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-03-27" lims:fid="1001060" lims:id="1001060">SOR/2015-70, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001061" lims:id="1001061" level="2"><TitleText>Cancellation or Suspension of Licences</TitleText></Heading><Section lims:inforce-start-date="2015-03-27" lims:lastAmendedDate="2015-03-27" lims:fid="1001062" lims:id="1001062"><Label>7</Label><Text>The Minister of Public Safety and Emergency Preparedness may cancel a licence where the licensee</Text><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001063" lims:id="1001063"><Label>(a)</Label><Text>no longer owns or leases the place that is licensed as a bonded warehouse;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001064" lims:id="1001064"><Label>(b)</Label><Text>makes a request in writing to that Minister that the licence be cancelled; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001065" lims:id="1001065"><Label>(c)</Label><Text>is bankrupt.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-03-27" lims:fid="1001067" lims:id="1001067">SOR/2015-70, ss. 4(E), 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2015-03-27" lims:lastAmendedDate="2015-03-27" lims:fid="1001068" lims:id="1001068"><Label>8</Label><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001069" lims:id="1001069"><Label>(1)</Label><Text>Subject to section 9, the Minister of Public Safety and Emergency Preparedness may suspend or cancel a licence where the licensee</Text><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001070" lims:id="1001070"><Label>(a)</Label><Text>is the subject of a receivership in respect of the licensee’s debts;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001071" lims:id="1001071"><Label>(b)</Label><Text>fails to comply with any Act of Parliament, or any regulation made pursuant to an Act of Parliament, that prohibits, controls or regulates the importation or exportation of goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001072" lims:id="1001072"><Label>(c)</Label><Text>has, in the course of operating the bonded warehouse, acted dishonestly in business dealings with customs brokers, importers, carriers, Her Majesty or servants of Her Majesty;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001073" lims:id="1001073"><Label>(d)</Label><Text>has not met any of the requirements set out in sections 11 and 12; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001074" lims:id="1001074"><Label>(e)</Label><Text>has been incompetent in the operation of the bonded warehouse.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001075" lims:id="1001075"><Label>(2)</Label><Text>Subject to section 9, the Minister of Public Safety and Emergency Preparedness may cancel a licence where</Text><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001076" lims:id="1001076"><Label>(a)</Label><Text>the volume of goods being received in the bonded warehouse is no longer sufficient to warrant the continued operation of the bonded warehouse;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001077" lims:id="1001077"><Label>(b)</Label><Text>there is no longer a need for a bonded warehouse in the area in which the bonded warehouse is located;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001078" lims:id="1001078"><Label>(c)</Label><Text>the Canada Border Services Agency is no longer able to provide customs services with respect to the bonded warehouse;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001079" lims:id="1001079"><Label>(d)</Label><Text>the licensee manipulates, unpacks, packs, alters or combines the goods with other goods while in the bonded warehouse other than in accordance with the terms and conditions set out in the licence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-03-27" lims:fid="1001080" lims:id="1001080"><Label>(e)</Label><Text>the licensee contravenes section 20.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001081" lims:id="1001081"><Label>(3)</Label><Text>Where a licence is suspended, an officer may lock and seal the bonded warehouse and keep it locked and sealed during the period of suspension.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-03-27" lims:fid="1001083" lims:id="1001083">SOR/2002-130, s. 2; SOR/2003-241, s. 3; err.(E), Vol. 138, No. 6; SOR/2007-181, s. 3; SOR/2015-70, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2015-03-27" lims:lastAmendedDate="2015-03-27" lims:fid="1001084" lims:id="1001084"><Label>9</Label><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001085" lims:id="1001085"><Label>(1)</Label><Text>The Minister of Public Safety and Emergency Preparedness shall, immediately after suspending a licence, give the licensee a notice that confirms the suspension and that provides all relevant information concerning the grounds for the suspension.</Text></Subsection><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001086" lims:id="1001086"><Label>(2)</Label><Text>The licensee may, within 90 days after the day on which the licence is suspended, make representations to the Minister of Public Safety and Emergency Preparedness regarding why the licence should be reinstated.</Text></Subsection><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001087" lims:id="1001087"><Label>(3)</Label><Text>The Minister of Public Safety and Emergency Preparedness shall, before cancelling a licence under section 8, give the licensee 90 days’ notice of the proposed cancellation and provide the licensee with all relevant information concerning the grounds for the proposed cancellation.</Text></Subsection><Subsection lims:inforce-start-date="2015-03-27" lims:fid="1001088" lims:id="1001088"><Label>(4)</Label><Text>The licensee may, within 90 days after the day on which the notice referred to in subsection (3) is given, make representations to the Minister of Public Safety and Emergency Preparedness regarding why the licence should not be cancelled.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-03-27" lims:fid="1001090" lims:id="1001090">SOR/2015-70, ss. 5, 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001091" lims:id="1001091" level="2"><TitleText>Reinstatement of Licences</TitleText></Heading><Section lims:inforce-start-date="2015-03-27" lims:lastAmendedDate="2015-03-27" lims:fid="1001092" lims:id="1001092"><Label>10</Label><Text>The Minister of Public Safety and Emergency Preparedness may reinstate a suspended licence where the cause for the suspension no longer exists.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-03-27" lims:fid="1001094" lims:id="1001094">SOR/2015-70, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001095" lims:id="1001095" level="1"><Label>PART II</Label><TitleText>Operation of Bonded Warehouses</TitleText></Heading><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001096" lims:id="1001096" level="2"><TitleText>Facilities, Equipment and Personnel</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1001097" lims:id="1001097"><Label>11</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1001098" lims:id="1001098"><Label>(1)</Label><Text>Every licensee shall provide at the bonded warehouse in respect of which the licence was issued</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001099" lims:id="1001099"><Label>(a)</Label><Text>such facilities, equipment and personnel as are sufficient to control access to the bonded warehouse premises and provide secure storage of the goods in it, including</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001100" lims:id="1001100"><Label>(i)</Label><Text>doors and other building components of sturdy construction,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001101" lims:id="1001101"><Label>(ii)</Label><Text>secure locks on doors and windows,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001102" lims:id="1001102"><Label>(iii)</Label><Text>signs that indicate the security requirements applicable to the premises, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001103" lims:id="1001103"><Label>(iv)</Label><Text>where the bonded warehouse will be used for the storage of designated goods, such additional facilities and equipment as may be required to ensure the secure storage of those goods;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001104" lims:id="1001104"><Label>(b)</Label><Text>adequate space for the examination of goods by officers;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001105" lims:id="1001105"><Label>(c)</Label><Text>the personnel and equipment necessary to ensure that the goods to be examined by an officer are made available to the officer for examination; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001106" lims:id="1001106"><Label>(d)</Label><Text>the personnel necessary to furnish information, for audit purposes, to an officer with respect to the bonded warehouse operations and inventory system.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1001107" lims:id="1001107"><Label>(2)</Label><Text>Where a bonded warehouse forms only part of a building, the licensee shall, if so requested by the chief officer of customs, keep the bonded warehouse separate from the remainder of the building by a partition or other structure.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001108" lims:id="1001108" level="2"><TitleText>Operation and Maintenance Standards</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1001109" lims:id="1001109"><Label>12</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1001110" lims:id="1001110"><Label>(1)</Label><Text>Every licensee shall ensure that the goods received in the bonded warehouse are</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001111" lims:id="1001111"><Label>(a)</Label><Text>stored safely and securely in the area designated for that purpose in the plan referred to in subsection 3(2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001112" lims:id="1001112"><Label>(b)</Label><Text>identified in such a manner so as to enable an officer to locate the goods and check them against the appropriate documentation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1001113" lims:id="1001113"><Label>(2)</Label><Text>No person, other than the licensee, an employee of the licensee or an employee of a carrier engaged in the delivery of goods to or the removal of goods from the bonded warehouse, shall enter any place in it where goods are stored, without the written authorization or the attendance of an officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1001114" lims:id="1001114"><Label>(3)</Label><Text>Every licensee of a bonded warehouse shall have in place</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001115" lims:id="1001115"><Label>(a)</Label><Text>procedures to maintain the security of, and restrict access to, the bonded warehouse; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001116" lims:id="1001116"><Label>(b)</Label><Text>procedures to ensure that personnel working in the bonded warehouse are aware of and follow the procedures referred to in paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="1001117" lims:id="1001117"><Label>(4)</Label><Text>A bonded warehouse may be locked and sealed by an officer where the chief officer of customs requests that the bonded warehouse be locked and sealed, for the purpose of verifying the goods received or the warehouse documentation.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001118" lims:id="1001118" level="2"><TitleText>Restrictions on Goods</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1001119" lims:id="1001119"><Label>13</Label><Text>No licensee shall receive in or transfer from a bonded warehouse in a province intoxicating liquor unless the licensee has obtained written approval to receive or transfer the intoxicating liquor from the board, commission or agency authorized by the laws of that province to sell or authorize the sale of intoxicating liquor in that province.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2022-10-01" lims:fid="1001120" lims:id="1001120"><Label>14</Label><Text>No licensee shall receive the following domestic products into a bonded warehouse:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001121" lims:id="1001121"><Label>(a)</Label><Text>cigars;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001122" lims:id="1001122"><Label>(b)</Label><Text>packaged raw leaf tobacco;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001123" lims:id="1001123"><Label>(c)</Label><Text>manufactured tobacco that is not stamped;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001124" lims:id="1001124"><Label>(d)</Label><Text>non-duty paid packaged or bulk spirits;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-10-01" lims:enacted-date="2022-06-23" lims:fid="1001125" lims:id="1376998"><Label>(e)</Label><Text>non-duty paid packaged or bulk wine;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-10-01" lims:enacted-date="2022-06-23" lims:fid="1001126" lims:id="1376999"><Label>(f)</Label><Text>non-duty paid specially denatured alcohol; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001135" lims:id="1001135"><Label>(c)</Label><Text>specially denatured alcohol.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1001137" lims:id="1001137">SOR/2003-241, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2022-10-01" lims:enacted-date="2022-06-23" lims:lastAmendedDate="2022-10-01" lims:fid="1377001" lims:id="1377001"><Label>16.1</Label><Text>No licensee shall receive into or remove from a bonded warehouse imported vaping products unless they are to be removed from the warehouse for sale to a foreign diplomat in Canada or export from Canada.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-10-01" lims:enacted-date="2022-06-23" lims:fid="1377003" lims:id="1377003" lims:enactId="1356575">2022, c. 10, s. 108</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001138" lims:id="1001138" level="2"><TitleText>Receipt of Goods</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1001139" lims:id="1001139"><Label>17</Label><Text>Every licensee shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001140" lims:id="1001140"><Label>(a)</Label><Text>acknowledge receipt of imported goods into the bonded warehouse in respect of which their licence was issued by endorsing</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001141" lims:id="1001141"><Label>(i)</Label><Text>the transportation document presented to the licensee by the carrier, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001142" lims:id="1001142"><Label>(ii)</Label><Text>the form that is referred to in subsection 19(2) of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal> and is presented to the licensee by the importer or owner of the goods; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001164" lims:id="1001164"><Label>(i)</Label><Text>any of the following that do not materially alter the characteristics of the goods:</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001165" lims:id="1001165"><Label>(i)</Label><Text>cleaning,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001166" lims:id="1001166"><Label>(ii)</Label><Text>complying with any applicable law of Canada or of a province,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001167" lims:id="1001167"><Label>(iii)</Label><Text>diluting,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001168" lims:id="1001168"><Label>(iv)</Label><Text>normal maintenance and servicing,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001169" lims:id="1001169"><Label>(v)</Label><Text>preserving,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001170" lims:id="1001170"><Label>(vi)</Label><Text>separating defective goods from prime quality goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001171" lims:id="1001171"><Label>(vii)</Label><Text>sorting or grading, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="1001172" lims:id="1001172"><Label>(viii)</Label><Text>trimming, filing, slitting or cutting.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="1001174" lims:id="1001174">SOR/2002-130, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-03-27" lims:fid="1001175" lims:id="1001175" level="2"><TitleText>Transfer and Removal of Goods</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1001176" lims:id="1001176"><Label>21</Label><Text>Where there is a transfer of ownership of goods stored in a bonded warehouse, the importer or owner of the goods shall submit a transfer document in the prescribed form to an officer at the customs office where the goods were described under subsection 19(2) of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="1001177" lims:id="1001177"><Label>22</Label><Text>Where the importer or owner of goods stored in a bonded warehouse wants the goods removed from the bonded warehouse in smaller units than those described under subsection 19(2) of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal>, the importer or owner shall submit to the chief officer of customs</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="1001178" lims:id="1001178"><Label>(a)</Label><Text>where the goods are to be released, an amended accounting in the prescribed form;
