lims:id="979833"><Label>2</Label><Text>In these Regulations,</Text><Definition lims:inforce-start-date="2018-04-26" lims:fid="979834" lims:id="979834" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>; (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-26" lims:fid="979835" lims:id="979835" generate-in-text="no"><Text><DefinedTermEn>average bank rate</DefinedTermEn> means the weighted arithmetic average of the bank rates that are established during the month before the month in respect of which interest is being calculated; (<DefinedTermFr>taux d’escompte moyen</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-26" lims:fid="979836" lims:id="979836" generate-in-text="no"><Text><DefinedTermEn>bank rate</DefinedTermEn> means the rate of interest established periodically by the Bank of Canada as the minimum rate at which the Bank of Canada makes short term advances to members of the Canadian Payments Association; (<DefinedTermFr>taux d’escompte</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-26" lims:fid="979837" lims:id="979837" generate-in-text="no"><Text><DefinedTermEn>concessionary loan</DefinedTermEn> means a loan bearing no interest or a rate of interest that is three or more percentage points below the average cost of borrowing of the Government of Canada on the day the loan agreement is entered into; (<DefinedTermFr>prêt assorti de conditions privilégiées</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-26" lims:fid="979838" lims:id="979838" generate-in-text="no"><Text><DefinedTermEn>demand for payment</DefinedTermEn> means a demand for payment in writing and includes an invoice, bill, statement and assessment; (<DefinedTermFr>demande de paiement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-26" lims:fid="979839" lims:id="979839" generate-in-text="no"><Text><DefinedTermEn>due date</DefinedTermEn> means, in relation to an amount owing to Her Majesty</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979840" lims:id="979840"><Label>(a)</Label><Text>for the provision of goods or services or the use of facilities,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979841" lims:id="979841"><Label>(i)</Label><Text>the due date specified in a demand for payment for, or included in the terms and conditions of, the provision of the goods or services or the use of the facilities, as the case may be, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979842" lims:id="979842"><Label>(ii)</Label><Text>where no date has been specified or included as indicated in subparagraph (i), the day that is 30 days after the day on which a demand for payment is issued,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979843" lims:id="979843"><Label>(b)</Label><Text>with respect to a repayable contribution,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979844" lims:id="979844"><Label>(i)</Label><Text>every day on which a scheduled repayment is to be made in accordance with the terms and conditions of the contribution, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979845" lims:id="979845"><Label>(ii)</Label><Text>where no repayment schedule for the contribution has been specified, the day that is 30 days after the day on which a demand for payment is issued,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979846" lims:id="979846"><Label>(c)</Label><Text>with respect to the recovery of an overpayment or erroneous payment,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979847" lims:id="979847"><Label>(i)</Label><Text>every day on which a scheduled repayment is to be made, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979848" lims:id="979848"><Label>(ii)</Label><Text>where no repayment schedule has been arranged, the day that is 30 days after the day on which a demand for payment is issued,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979849" lims:id="979849"><Label>(d)</Label><Text>with respect to a licence, lease, loan, including a hypothecary loan, or a mortgage, every day on which a payment is to be made in accordance with the licence, lease, loan or mortgage agreement,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979850" lims:id="979850"><Label>(e)</Label><Text>with respect to an accountable advance, the day on which repayment of any balance owing to Her Majesty is to be made in accordance with the <XRefExternal reference-type="regulation" link="SOR-86-438">Accountable Advances Regulations</XRefExternal>, and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979851" lims:id="979851"><Label>(f)</Label><Text>for any other reason,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979852" lims:id="979852"><Label>(i)</Label><Text>any day on which payment is to be made in accordance with the applicable Act of Parliament, regulation, order, contract or arrangement, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979853" lims:id="979853"><Label>(ii)</Label><Text>where a day referred to in subparagraph (i) cannot be determined, the day that is 30 days after the day on which a demand for payment is issued; (<DefinedTermFr>date the laws of a foreign state or political subdivision of that state, that holds deposits and honours cheques and other payment instructions on behalf of its clients and includes a bank, a trust company and a cooperative credit society; (<DefinedTermFr>institution financière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-26" lims:fid="979855" lims:id="979855" generate-in-text="no"><Text><DefinedTermEn>in writing</DefinedTermEn> includes in any electronic form that is capable of being reproduced in intelligible, written form within a reasonable time; (<DefinedTermFr>par écrit</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-26" lims:fid="979856" lims:id="979856" generate-in-text="no"><Text><DefinedTermEn>pre-authorized debit</DefinedTermEn> means a debit to a debtor’s credit card account or other account with a financial institution that is initiated by the creditor, in accordance with a prior authorization given by the debtor to the creditor. (<DefinedTermFr>prélèvement automatique</DefinedTermFr>) lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979860" lims:id="979860"><Label>3</Label><Text>These Regulations do not apply to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979861" lims:id="979861"><Label>(a)</Label><Text>amounts owed to a Crown corporation; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979862" lims:id="979862"><Label>(b)</Label><Text>amounts owing by a department.</Text></Paragraph></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="979863" lims:id="979863" level="1"><Label>PART I</Label><TitleText>Interest</TitleText></Heading><Heading lims:inforce-start-date="2018-04-26" lims:fid="979864" lims:id="979864" level="2"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979865" lims:id="979865"><Label>4</Label><Text>This Part does not apply to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979866" lims:id="979866"><Label>(a)</Label><Text>capital market transactions and, except as provided in section 7, interest-bearing loans, including hypothecary loans, or mortgages;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979867" lims:id="979867"><Label>(b)</Label><Text>amounts owing to Her Majesty pursuant to the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>, or any Act of Parliament that imposes a tax or duty; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979868" lims:id="979868"><Label>(c)</Label><Text>amounts referred to in any other Act of Parliament or regulation, or any order, contract or arrangement, that provides for the charging of interest on those amounts.</Text></Paragraph></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="979869" lims:id="979869" level="2"><TitleText>Rate of Interest</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="979870" lims:id="979870"><Label>5</Label><Subsection lims:inforce-start-date="2018-04-26" lims:fid="979871" lims:id="979871"><Label>(1)</Label><Text>For the purpose of subsection 155.1(1) of the Act and subject to sections 6 to 8, in all cases where an amount is owing to Her Majesty, interest calculated and compounded monthly at the average bank rate plus 3% is payable on that amount and accrues during the period beginning on the due date and ending on the day before the day on which payment is received by Her Majesty or an authorized agent of Her Majesty.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="979872" lims:id="979872"><Label>(2)</Label><Text>If a partial payment is made, the period for which interest is payable in respect of the amount paid ends on the day before the day on which the partial payment is received by Her Majesty or an authorized agent of Her Majesty.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="979874" lims:id="979874">SOR/99-30, s. 2; SOR/2018-89, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="979875" lims:id="979875" level="2"><TitleText>Overpayments and Erroneous Payments</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="979876" lims:id="979876"><Label>6</Label><Subsection lims:inforce-start-date="2018-04-26" lims:fid="979877" lims:id="979877"><Label>(1)</Label><Text>If a person has received an overpayment or erroneous payment, interest is payable by the person on any amount that is not repaid by its due date and accrues as specified in section 5, during the period beginning on the due date and ending on the day before the day on which repayment is received by Her Majesty or an authorized agent of Her Majesty.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="979878" lims:id="979878"><Label>(2)</Label><Text>If a person has received an overpayment or erroneous payment as a result of fraud, falsification of documents, wilful misrepresentation or any other offence committed by that person or by any other person acting on behalf of that person, unless provided otherwise by an order of a court, interest is payable by that person on the amount owing on account of the overpayment or erroneous payment and accrues as specified in section 5, during the period beginning on the day on which the overpayment or erroneous payment is made and ending on the day before the day on which repayment is received by Her Majesty or an authorized agent of Her Majesty.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="979879" lims:id="979879"><Label>(3)</Label><Text>Nothing in subsection (1) shall prevent a deputy head from entering into an arrangement with a person that calls for repayment to be made in instalments and interest to accrue and be paid on the total amount outstanding.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="979881" lims:id="979881">SOR/99-30, s. 3; SOR/2018-89, ss. 4, 7</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="979882" lims:id="979882" level="2"><TitleText>Concessionary Loans</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="979883" lims:id="979883"><Label>7</Label><Subsection lims:inforce-start-date="2018-04-26" lims:fid="979884" lims:id="979884"><Label>(1)</Label><Text>Subject to subsection (2), in the case of a late or missed payment on a concessionary loan, interest is payable on the amount of the late or missed payment and accrues during the period beginning on the due date and ending on the day before the day on which payment is received by Her Majesty or an authorized agent of Her Majesty, at a rate equal to the difference between the rate set out in section 5 and the concessionary rate set out in the loan agreement.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="979885" lims:id="979885"><Label>(2)</Label><Text>Subsection (1) does not apply to</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979886" lims:id="979886"><Label>(a)</Label><Text>concessionary loans that are made to sovereign states and to which a multilateral debt relief agreement or undertaking to which Canada is a party applies; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979887" lims:id="979887"><Label>(b)</Label><Text>concessionary loans that are made to international organizations or sovereign states for the purpose of developmental assistance.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="979889" lims:id="979889">SOR/99-30, s. 4; SOR/2018-89, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="979890" lims:id="979890" level="2"><TitleText>Exceptions for Small Amounts, Errors and Breakdowns</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="979891" lims:id="979891"><Label>8</Label><Text>Notwithstanding any other provision of this Part,</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979892" lims:id="979892"><Label>(a)</Label><Text>no interest is payable to the extent that the interest accrued as a result of</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979893" lims:id="979893"><Label>(i)</Label><Text>any error made or delay caused by Her Majesty, or an authorized agent of Her Majesty, in processing a payment or establishing an amount payable, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="979894" lims:id="979894"><Label>(ii)</Label><Text>a breakdown or other failure in the system or communication links customarily used by the Government of Canada to process payments; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979895" lims:id="979895"><Label>(b)</Label><Text>no interest is payable on an outstanding amount due for a period in respect of a program or service if the total amount payable for the period, including accrued interest, is less than the minimum amount for which a demand for payment would normally be issued, as established by the deputy head responsible for the program or service and published for the purpose of this paragraph on a Government of Canada website.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="979897" lims:id="979897">SOR/2018-89, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="979898" lims:id="979898" level="2"><TitleText>Waiver</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2020-07-06" lims:fid="979899" lims:id="979899"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979900" lims:id="979900"><Label>(1)</Label><Text>The appropriate Minister of a department or any public officer authorized in writing by that Minister may waive or reduce interest provided for by this Part where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979901" lims:id="979901"><Label>(a)</Label><Text>the administrative costs of assessing, billing and collecting the interest would exceed the amount of interest owing;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979902" lims:id="979902"><Label>(b)</Label><Text>the interest is in respect of an amount in dispute that has been settled in whole, or in part, in favour of the debtor;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="979903" lims:id="1257111"><Label>(c)</Label><Text>an overpayment or erroneous payment of salary, wages or recurring benefits or allowances is to be recovered from a subsequent payment of salary, wages or recurring benefits or allowances, as the case may be, except in the circumstances described in subsection 6(2);</Text></Paragraph><Paragraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="979904" lims:id="1257112"><Label>(d)</Label><Text>the interest is payable under subsection 6(2) and a fine or penalty that takes into account interest on the overpayment or erroneous payment has been imposed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257113" lims:id="1257113"><Label>(e)</Label><Text>the interest is payable for a period during which there exists an urgent and critical situation of a temporary nature that</Text><Subparagraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257114" lims:id="1257114"><Label>(i)</Label><Text>is so serious as to be a national or provincial emergency,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257115" lims:id="1257115"><Label>(ii)</Label><Text>causes substantial financial hardship,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257116" lims:id="1257116"><Label>(iii)</Label><Text>is caused by an actual or imminent fire, flood, drought, storm, earthquake or other natural phenomenon, a disease in human beings, animals or plants, an accident, pollution or an act of sabotage or terrorism, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257117" lims:id="1257117"><Label>(iv)</Label><Text>results, or may result, in danger to the lives, health or safety of individuals, danger to property, social disruption or a breakdown in the flow of essential goods, services or resources.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979905" lims:id="979905"><Label>(2)</Label><Text>Subject to subsection (3), the appropriate Minister of a department or any public officer authorized in writing by that Minister may waive or reduce interest provided for by this Part where the debtor was prevented from making a payment by circumstances beyond the debtor’s control, including</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979906" lims:id="979906"><Label>(a)</Label><Text>death or incapacity of the debtor or of the person who is directly responsible for making the payment on behalf of the debtor;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979907" lims:id="979907"><Label>(b)</Label><Text>a postal disruption that can reasonably be considered to have delayed the payment or made it impossible, where no alternative means of making payment that would not cause undue inconvenience to the debtor are available; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979908" lims:id="979908"><Label>(c)</Label><Text>a delay in the processing of a pre-authorized debit that is caused by a breakdown or other failure in the external systems or communication links customarily used to process such debits.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979909" lims:id="979909"><Label>(3)</Label><Text>When contemplating a waiver or reduction of interest under subsection (2), the appropriate Minister or the public officer shall take into consideration</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979910" lims:id="979910"><Label>(a)</Label><Text>the case presented by the debtor;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979911" lims:id="979911"><Label>(b)</Label><Text>the debtor’s payment history and history of voluntary compliance; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979912" lims:id="979912"><Label>(c)</Label><Text>the debtor’s diligence in conducting the debtor’s affairs in relation to the debt.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257119" lims:id="1257119">SOR/2020-164, s. for Dishonoured Instruments</TitleText></Heading><Heading lims:inforce-start-date="2018-04-26" lims:fid="979914" lims:id="979914" level="2"><TitleText>Charges</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979915" lims:id="979915"><Label>10</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979916" lims:id="979916"><Label>(1)</Label><Text>Where an instrument tendered in payment or settlement of an amount due to Her Majesty is, for any reason, dishonoured, an administrative charge of $15 is payable by the debtor to Her Majesty.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979917" lims:id="979917"><Label>(2)</Label><Text>Where a payment is made by Her Majesty to a financial institution in order to reimburse that institution for an amount initially credited to the Receiver General on the basis of a dishonoured instrument, an administrative charge of $10 is payable by the debtor to Her Majesty, in addition to the charge referred to in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979918" lims:id="979918"><Label>(3)</Label><Text>Where a financial institution charges an amount to Her Majesty for monitoring the account of a debtor who has tendered a dishonoured instrument and for subsequently certifying or clearing that dishonoured instrument, an administrative charge in that amount is payable by the debtor to Her Majesty, in addition to the charge referred to in subsection (1).</Text></Subsection></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="979919" lims:id="979919" level="2"><TitleText>Exception for Errors and Breakdowns</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="979920" lims:id="979920"><Label>11</Label><Text>Notwithstanding section 10, no administrative charge becomes payable as a result of</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979921" lims:id="979921"><Label>(a)</Label><Text>any error made or delay caused by Her Majesty, or an authorized agent of Her Majesty, in processing a payment or an instrument used to make a payment; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="979922" lims:id="979922"><Label>(b)</Label><Text>a breakdown or other failure in the system or communication links customarily used by the Government of Canada to process payments or 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="979925" lims:id="979925" level="2"><TitleText>Waiver</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2020-07-06" lims:fid="979926" lims:id="979926"><Label>12</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979927" lims:id="979927"><Label>(1)</Label><Text>The appropriate Minister of a department or any public officer authorized in writing by that Minister may waive an administrative charge where the administrative costs of assessing, billing and collecting the administrative charge would exceed the amount of the administrative charge.</Text></Subsection><Subsection lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257120" lims:id="1257120"><Label>(1.1)</Label><Text>The appropriate Minister of a department or any public officer authorized in writing by that Minister may waive or reduce an administrative charge if the administrative charge is payable for a period during which there exists an urgent and critical situation of a temporary nature that</Text><Paragraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257121" lims:id="1257121"><Label>(a)</Label><Text>is so serious as to be a national or provincial emergency;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257122" lims:id="1257122"><Label>(b)</Label><Text>causes substantial financial hardship;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257123" lims:id="1257123"><Label>(c)</Label><Text>is caused by an actual or imminent fire, flood, drought, storm, earthquake or other natural phenomenon, a disease in human beings, animals or plants, an accident, pollution or an act of sabotage or terrorism; and</Text></Paragraph><Paragraph lims:inforce-start-date="2020-07-06" lims:enacted-date="2020-07-06" lims:fid="1257124" lims:id="1257124"><Label>(d)</Label><Text>results, or may result, in danger to the lives, health or safety of individuals, danger to property, social disruption or a breakdown in the flow of essential goods, services or resources.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979928" lims:id="979928"><Label>(2)</Label><Text>Subject to subsection (3), the appropriate Minister of a department or any public officer authorized in writing by that Minister may waive or reduce an administrative charge where circumstances beyond the debtor’s control, including an error made by the financial institution or other institution on which the instrument tendered in payment by the debtor is drawn, resulted in the instrument being dishonoured.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="979929" lims:id="979929"><Label>(3)</Label><Text>When contemplating a waiver or reduction of an administrative charge under subsection (2), the appropriate Minister or the public officer shall take into consideration</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979930" lims:id="979930"><Label>(a)</Label><Text>the case presented by the debtor; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="979931" lims:id="979931"><Label>(b)</Label><Text>the debtor’s diligence in taking action to remedy the III</Label><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979933" lims:id="979933"><Label>13</Label><Text>Administrative charges payable to Her Majesty under Part II are in addition to any interest payable to Her Majesty under Part I or any other Act of Parliament or regulation, or any order, contract or arrangement.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="979934" lims:id="979934"><Label>14</Label><Text>Where an instrument is tendered in payment, in whole or in part, of an amount owing to Her Majesty, including any interest payable under Part I, and that instrument is subsequently dishonoured, the interest continues to accrue without taking into account the purported payment.</Text></Section></Body></Regulation>
