(<DefinedTermFr>Protocole</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="964607" lims:id="964607" generate-in-text="no"><Text><DefinedTermEn>Vienna Convention</DefinedTermEn> means the Vienna Convention on Diplomatic Relations set out in Schedule I to the <XRefExternal reference-type="act" link="F-29.4">Foreign Missions and International Organizations Act</XRefExternal>. (<DefinedTermFr>Convention de Vienne</DefinedTermFr>) </Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="964609" lims:id="964609">SOR/2003-110, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="964610" lims:id="964610" level="1"><TitleText>Privileges and Immunities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="964611" lims:id="964611"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="964612" lims:id="964612"><Label>(1)</Label><Text>The Organization shall have in Canada the legal capacities of a body corporate and, to the extent specified in Articles 2 to 6 of the Protocol, the privileges and immunities set out in Articles II and III of the Convention.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="964613" lims:id="964613"><Label>(2)</Label><Text>Staff members of the Organization shall have in Canada, to the extent specified in Article 7 of the Protocol, the privileges and immunities set out in Section 18 of Article V of the Convention.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="964614" lims:id="964614"><Label>(3)</Label><Text>In addition to the privileges and immunities provided to staff members under subsection (2), the Director General of the Organization shall have in Canada the following privileges and immunities comparable to the privileges and immunities accorded in Canada to diplomatic representatives under the Vienna Convention:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="964615" lims:id="964615"><Label>(a)</Label><Text>immunity from arrest or detention;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="964616" lims:id="964616"><Label>(b)</Label><Text>immunity from civil and administrative jurisdiction and execution, comparable to those accorded under the Vienna Convention to diplomatic agents, except in the case of damage caused by a motor vehicle or other means of transport belonging to or driven by the Director General; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="964617" lims:id="964617"><Label>(c)</Label><Text>full immunity from criminal jurisdiction, except in the case of a traffic offence caused by a motor vehicle or other means of transport belonging to or driven by the Director General, subject to paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="964618" lims:id="964618"><Label>(4)</Label><Text>Representatives of foreign states that are parties to the Protocol shall have in Canada, to the extent specified in Article 9 of the Protocol, the privileges and immunities set out in Article IV of the Convention.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="964619" lims:id="964619"><Label>(5)</Label><Text>Experts appointed to carry out a specific task for or on behalf of the Organization and at its expense shall have in Canada, to the extent specified in Article 11 of the Protocol, the privileges and immunities set out in Article VI of the Convention.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="964621" lims:id="964621">SOR/2003-110, s. 7</HistoricalNoteSubItem></HistoricalNote></Section></Body></Regulation>
