(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955567" lims:id="955567" generate-in-text="no"><Text><DefinedTermEn>band</DefinedTermEn><Repealed>[Repealed, SOR/93-333, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955568" lims:id="955568" generate-in-text="no"><Text><DefinedTermEn>Convention Area</DefinedTermEn> has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="regulation" link="SOR-86-21">Atlantic Fishery Regulations, 1985</XRefExternal>; (<DefinedTermFr>zone de la Convention</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955569" lims:id="955569" generate-in-text="no"><Text><DefinedTermEn>Department</DefinedTermEn> means the Department of Fisheries and Oceans; (<DefinedTermFr>ministère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955570" lims:id="955570" generate-in-text="no"><Text><DefinedTermEn>document</DefinedTermEn> means a licence, fisher’s registration card or vessel registration card that grants a legal privilege to engage in fishing or any other activity related to fishing and fisheries; (<DefinedTermFr>document</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955571" lims:id="955571" generate-in-text="no"><Text><DefinedTermEn>fisher’s registration card</DefinedTermEn> means a fisher’s registration card issued under any of the Regulations listed in subsection 3(4); (<DefinedTermFr>carte d’enregistrement de pêcheur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955572" lims:id="955572" generate-in-text="no"><Text><DefinedTermEn>fish landing station</DefinedTermEn> means any place, premises, vessel or vehicle used to receive fish landed, whether directly or indirectly, from a fishing vessel; (<DefinedTermFr>poste de débarquement du poisson</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955573" lims:id="955573" generate-in-text="no"><Text><DefinedTermEn>licence</DefinedTermEn> means any type, kind or category of licence issued under any of the Regulations listed in subsection 3(4) or under these Regulations; (<DefinedTermFr>permis</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955574" lims:id="955574" generate-in-text="no"><Text><DefinedTermEn>licence number</DefinedTermEn> means the number assigned to a licence by the Department at the time the licence is issued; (<DefinedTermFr>numéro de permis</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955575" lims:id="955575" generate-in-text="no"><Text><DefinedTermEn>observer</DefinedTermEn> means a person who is designated under section 39 or 39.1; (<DefinedTermFr>observateur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2020-11-30" lims:enacted-date="2020-11-30" lims:fid="1276743" lims:id="1276743"><Text><DefinedTermEn>provincial or territorial fisher’s certificate</DefinedTermEn> means a certificate of accreditation or registration, however described and regardless of format, that is issued to a commercial fisher through a program of accreditation or registration established under provincial or territorial legislation; (<DefinedTermFr>certificat provincial ou territorial de pêcheur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955576" lims:id="955576" generate-in-text="no"><Text><DefinedTermEn>Regional Director-General</DefinedTermEn> means a Regional Director-General or an Associate Regional Director-General of the Department; (<DefinedTermFr>directeur général régional</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955577" lims:id="955577" generate-in-text="no"><Text><DefinedTermEn>registered vessel</DefinedTermEn> means a fishing vessel registered with the Department under any of the Regulations listed in subsection 3(4); (<DefinedTermFr>bateau enregistré</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955578" lims:id="955578" generate-in-text="no"><Text><DefinedTermEn>Regulatory Area</DefinedTermEn> means that part of the Convention Area that lies beyond the areas in which any country exercises fisheries jurisdiction; (<DefinedTermFr>zone de réglementation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955579" lims:id="955579" generate-in-text="no"><Text><DefinedTermEn>vessel registration card</DefinedTermEn> means a vessel registration card or vessel registration certificate issued under any of the Regulations listed in subsection 3(4); (<DefinedTermFr>carte d’enregistrement de bateau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955580" lims:id="955580" generate-in-text="no"><Text><DefinedTermEn>vessel registration number</DefinedTermEn> means the number assigned to a vessel by the Department at the time the vessel is registered as a fishing vessel under any of the Regulations listed in subsection 3(4). lims:id="955583" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2018-05-30" lims:lastAmendedDate="2025-03-01" lims:fid="955584" lims:id="955584"><Label>3</Label><Subsection lims:inforce-start-date="2018-05-30" lims:fid="955585" lims:id="955585"><Label>(1)</Label><Text>Subject to subsection (2), Parts I to VIII apply in respect of</Text><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="955586" lims:id="955586"><Label>(a)</Label><Text>fishing and related activities in Canadian fisheries waters off the Atlantic, Pacific and Arctic coasts;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="955587" lims:id="955587"><Label>(b)</Label><Text>fishing and related activities in the provinces of Nova Scotia, New Brunswick, British Columbia, Prince Edward Island and Newfoundland and Labrador and in the Yukon Territory and Northwest Territories; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="955588" lims:id="955588"><Label>(c)</Label><Text>fishing and related activities carried out in waters other than Canadian fisheries waters from vessels subject to the jurisdiction of Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-05-30" lims:fid="955589" lims:id="955589"><Label>(2)</Label><Text>Parts I to VIII do not apply in respect of fishing and related activities in respect of which the <XRefExternal reference-type="regulation" link="SOR-90-214">Quebec Fishery Regulations, 1990</XRefExternal> apply.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-30" lims:fid="955590" lims:id="955590"><Label>(3)</Label><Text>Parts IX and X apply in respect of Canada and Canadian fisheries waters.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-30" lims:fid="955591" lims:id="955591"><Label>(4)</Label><Text>Where there is an inconsistency between these Regulations and any of the following Regulations, the following Regulations shall prevail:</Text><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="955592" lims:id="955592"><Label>(a)</Label><Text>the <XRefExternal reference-type="regulation" link="SOR-86-21">Atlantic Fishery Regulations, 1985</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="955593" lims:id="955593"><Label>(b)</Label><Text>the <XRefExternal reference-type="regulation" link="SOR-96-137">British Columbia Sport Fishing Regulations, 1996</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-05-30" lims:fid="955594" lims:id="955594"><Label>(c)</Label><Text>the <XRefExternal reference-type="regulation" link="C.R.C.,_c._815">Foreign Vessel Fishing lims:id="955605"><Label>(5)</Label><Text>Sections 18 to 21, 23 and 26 to 29 do not apply with respect to fishing and related activities carried out under the authority of a licence issued under the <XRefExternal reference-type="regulation" link="SOR-93-332">Aboriginal Communal Fishing Licences Regulations</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-30" lims:fid="955606" lims:id="955606"><Label>(6)</Label><Text>Sections 18 to 21, 23, 26 and 29 do not apply in respect of Inuit domestic fishing, being the exercise by a person of the right to harvest any species or stock of fish for food, social and ceremonial purposes in accordance with the Agreement defined in section 2 of the <XRefExternal reference-type="act" link="L-4.3">Labrador Inuit Land that occurs earlier in a calendar year than the month in which the period begins, that period begins in one calendar year and ends in the next calendar year.</Text></Paragraph></Section><Section lims:id="955615"><Label>(1)</Label><Text>Subject to subsection (2), a reference to time in a provision of any of the Regulations listed in subsection 3(4) or a notice given under section 7 is a reference to local time in effect in the province or portion thereof that is closest to the waters in respect of which the provision or the notice applies unless, in the case of a notice, it is otherwise stated in the notice.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955616" lims:id="955616"><Label>(2)</Label><Text>Where notice is given under section 7 in respect of any close time set out in the <XRefExternal reference-type="regulation" link="C.R.C.,_c._815">Foreign Vessel Fishing Regulations</XRefExternal>, that time is a reference to Greenwich time.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955617" lims:id="955617" level="2"><TitleText>Variation Orders</TitleText></Heading><Section lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:lastAmendedDate="2023-06-23" lims:fid="955618" lims:id="1413529"><Label>6</Label><Subsection lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:fid="1413530" lims:id="1413530"><Label>(1)</Label><Text>If a close time, fishing quota, limit on the size or weight of fish or fishing gear or equipment is fixed in respect of an area under any of the Regulations listed in subsection 3(4), the Regional Director-General may, by order, vary that close time, quota, limit, gear or equipment in respect of that area or any portion of that area.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:fid="1413531" lims:id="1413531"><Label>(2)</Label><Text>If a close time, fishing quota or fishing gear or equipment for herring or salmon fishing is fixed in respect of an area under the <XRefExternal reference-type="regulation" link="SOR-93-54">Pacific Fishery Regulations, 1993</XRefExternal>, a fishery officer may, by order, vary that close time, quota, gear or equipment in respect of that area or any portion of that area.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:fid="1413532" lims:id="1413532"><Label>(3)</Label><Text>If a close time, fishing quota, limit on the size or weight of fish or fishing gear or equipment is fixed in respect of an area of non-tidal waters for any species of fish other than salmon under the <XRefExternal reference-type="regulation" link="SOR-96-137">British Columbia Sport Fishing Regulations, 1996</XRefExternal>, the director responsible for fisheries management in the ministry responsible for fisheries in the Government of British Columbia may, by order, vary that close time, quota, limit, gear or equipment in respect of that area or any portion of that area.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:fid="1413533" lims:id="1413533"><Label>(4)</Label><Text>If a close time, fishing quota, limit on the size or weight of fish or fishing gear or equipment is fixed in respect of an area of non-tidal waters for any species of fish other than salmon under the <XRefExternal reference-type="regulation" link="C.R.C.,_c._854">Yukon Territory Fishery Regulations</XRefExternal>, the Director of the Fish and Wildlife Branch of the Department of Environment for the Yukon Territory may, by order, vary that close time, quota, limit, gear or equipment in respect of that area or any portion of that area.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:fid="1413534" lims:id="1413534"><Label>(5)</Label><Text>If a close time, fishing quota, limit on the size or weight of fish or fishing gear or equipment is fixed in respect of an area of the province of New Brunswick under the <XRefExternal reference-type="regulation" link="SOR-93-55">Maritime Provinces Fishery Regulations</XRefExternal>, the director responsible for fisheries management in the ministry responsible for fisheries in the Government of New Brunswick may, by order, vary that close time, quota, limit, gear or equipment in respect of that area or any portion of that area for any species of fish listed in Appendix A of the Canada–New Brunswick Memorandum of Understanding on Recreational Fisheries, dated June 18, 2001, as amended from time to time.</Text></Subsection><Subsection lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:fid="1413535" lims:id="1413535"><Label>(6)</Label><Text>If a close time, fishing quota, limit on the size or weight of fish or fishing gear or equipment is fixed in respect of an area of the province of Nova Scotia under the <XRefExternal reference-type="regulation" link="SOR-93-55">Maritime Provinces Fishery Regulations</XRefExternal>, the director responsible for fisheries management in the ministry responsible for fisheries in the Government of Nova Scotia may, by order, vary that close time, quota, limit, gear or equipment in respect of that area or any portion of that area for any species of fish listed in Appendix A to the Canada–Nova Scotia Memorandum of Understanding on Recreational Fisheries, dated September 17, 2003, as amended from time to time.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-02-10" lims:fid="955628" lims:id="955628"><Label>(1)</Label><Text>Subject to subsection (3), where a variation order is made under section 6, notice of the variation shall be given to the persons affected or likely to be affected by the variation by one or more of the following methods:</Text><Paragraph lims:inforce-start-date="2011-02-10" lims:fid="955629" lims:id="955629"><Label>(a)</Label><Text>broadcasting the notice over a commercial or marine radio station, a radio station operated by the Department or a radio station located on a vessel under lims:inforce-start-date="2011-02-10" lims:fid="955631" lims:id="955631"><Label>(c)</Label><Text>posting the notice in the area or in the vicinity of the area affected by the variation;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-02-10" lims:fid="955632" lims:id="955632"><Label>(d)</Label><Text>transmitting the notice by electronic means to those persons;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-02-10" lims:fid="955633" lims:id="955633"><Label>(d.1)</Label><Text>posting the notice on the web site of the Department or of the province;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-02-10" lims:fid="955634" lims:id="955634"><Label>(e)</Label><Text>having a fishery officer or fishery guardian give oral notice thereof to those persons; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-02-10" lims:fid="955635" lims:id="955635"><Label>(f)</Label><Text>publishing the notice in the next issue of a sport fishing publication, published periodically by the applicable province or by the Department.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-02-10" lims:fid="955636" to that included in the application as may reasonably be regarded as relevant; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955648" lims:id="955648"><Label>(b)</Label><Text>a statutory declaration verifying the information given in the application or verifying the information submitted under paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955649" lims:id="955649"><Label>(2)</Label><Text>An application from a corporation for a document shall be signed by an officer of the corporation.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955650" lims:id="955650" level="2"><TitleText>Signing of Documents</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955651" lims:id="955651"><Label>9</Label><Text>Where it is indicated in a document that it is not valid unless signed, the holder of the document shall, on receipt of the document, immediately sign it in ink in the space provided.</Text></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955652" lims:id="955652" level="2"><TitleText>Expiration of Documents</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955653" lims:id="955653"><Label>10</Label><Text>Unless otherwise specified in a document, a document expires</Text><Paragraph Licences, Registration Cards and Certificates</TitleText></Heading><Section lims:inforce-start-date="2020-11-30" lims:enacted-date="2020-11-30" lims:lastAmendedDate="2020-11-30" lims:fid="955657" lims:id="1276745"><Label>11</Label><Text>Every holder of a licence, a fisher’s registration card or a provincial or territorial fisher’s certificate shall carry it at all times while engaged in any activity to which it relates and shall produce it on the demand of a fishery officer or fishery guardian.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2020-11-30" has been issued shall have the vessel registration card and the licence authorizing the use of the vessel on board the vessel whenever the vessel is engaged as a fishing vessel and shall produce them on the demand of a fishery officer or fishery guardian.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955659" lims:id="955659"><Label>13</Label><Text><Repealed>[Repealed, SOR/93-333, s. 3]</Repealed></Text></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955660" lims:id="955660" level="2"><TitleText>Amending Documents</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955661" lims:id="955661"><Label>14</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955662" lims:id="955662"><Label>(1)</Label><Text>Notwithstanding paragraph 15(1)(a), a fishery officer who is employed by the Department or any employee of the Department engaged in the issuance of documents may, on the request of the holder of a document,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955663" lims:id="955663"><Label>(a)</Label><Text>amend the document and sign and date the amendment; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955664" lims:id="955664"><Label>(b)</Label><Text>cancel the document and issue a replacement document.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955665" lims:id="955665"><Label>(2)</Label><Text>Where a document contains an error or was issued in error, a fishery officer or an employee referred to in subsection (1) may request the holder of the document to surrender it.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955666" lims:id="955666"><Label>(3)</Label><Text>Where the holder of a document receives a request referred to in subsection (2), that person shall immediately comply with the request.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955667" lims:id="955667" level="2"><TitleText>Alteration and Use of Documents</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955668" lims:id="955668"><Label>15</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955669" lims:id="955669"><Label>(1)</Label><Text>No person shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955670" lims:id="955670"><Label>(a)</Label><Text>alter or deface any document;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955671" lims:id="955671"><Label>(b)</Label><Text>use or produce any document that has been altered or defaced; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955672" lims:id="955672"><Label>(c)</Label><Text>use or produce any document issued to another person under the pretence of being the holder thereof.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955673" lims:id="955673"><Label>(2)</Label><Text>No holder of a fisher’s registration card shall permit another person to use that registration card.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955674" lims:id="955674"><Label>(3)</Label><Text>Where a licence specifies the person or persons who may fish under the licence, the holder of that licence shall not permit any person other than the person or persons so specified to use that licence.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955675" lims:id="955675" level="2"><TitleText>Transfer of Documents and Rights and Privileges</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955676" lims:id="955676"><Label>16</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955677" lims:id="955677"><Label>(1)</Label><Text>A document is the property of the Crown and is not transferable.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955678" lims:id="955678"><Label>(2)</Label><Text>The issuance of a document of any type to any person does not imply or confer any future right or privilege for that person to be issued a document of the same type or any other type.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955679" lims:id="955679" level="2"><TitleText>Change of Name or Address and Replacement of Documents</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955680" lims:id="955680"><Label>17</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955681" lims:id="955681"><Label>(1)</Label><Text>Where a person is the holder of a document and has a change of name or address, or the document is lost, stolen or destroyed or becomes illegible, that person shall notify the Minister in writing within 15 days after the occurrence of the event and the Minister may issue a replacement document showing any applicable changes.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955682" lims:id="955682"><Label>(2)</Label><Text>On receipt of a replacement document, the holder shall immediately return to the Department the document being replaced if it is still in the holder’s possession.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955683" lims:id="955683"><Label>(3)</Label><Text>A holder of a replacement document who recovers the document that was replaced shall immediately return it to the Department.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955684" lims:id="955684" level="2"><TitleText>Transfer of Ownership or Loss of Vessel</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955685" lims:id="955685"><Label>18</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955686" lims:id="955686"><Label>(1)</Label><Text>Where there is a transfer of ownership of a registered vessel or a loss, destruction, dismantling or other removal of a registered vessel from use as a fishing vessel, the person in whose name the vessel is registered shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955687" lims:id="955687"><Label>(a)</Label><Text>notify the Minister in writing of the event within 15 days after the occurrence of the event; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955688" lims:id="955688"><Label>(b)</Label><Text>where the person is still in possession of the vessel registration card or any licence issued in respect of the vessel, return the document to the Minister with the notification required under paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955689" lims:id="955689"><Label>(2)</Label><Text>A notification of transfer of ownership given under paragraph (1)(a) shall include the name and address of the new owner.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955690" lims:id="955690"><Label>19</Label><Text>Where there is a transfer of ownership of a registered vessel and the vessel is not registered in the name of the new owner,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955691" lims:id="955691"><Label>(a)</Label><Text>no person shall use that vessel as a fishing vessel; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955692" lims:id="955692"><Label>(b)</Label><Text>the new owner of that vessel shall not permit another person to use the vessel as a fishing vessel.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955693" lims:id="955693"><Label>20</Label><Text>Where a transfer of ownership of a registered vessel is to take place and it is not intended that the vessel will be used in any activity that requires the vessel to be registered, the person in whose name the vessel is registered shall, prior to the transfer, remove the vessel registration number that is painted on or affixed to the vessel in accordance with section 26.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955694" lims:id="955694"><Label>21</Label><Text>Where there is a change in the registered ownership of shares of a corporation that holds a licence that results in a different person being the registered owner of the largest number of shares of the corporation or that results in any one person being the registered owner of more than 50 per cent of the shares of that corporation, the corporation shall notify the Minister in writing of the change within 15 days after the date of the change.</Text></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955695" lims:id="955695" level="2"><TitleText>Conditions of Licences</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955696" lims:id="955696"><Label>22</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955697" lims:id="955697"><Label>(1)</Label><Text>For the proper management and control of fisheries and the conservation and protection of fish, the Minister may specify in a licence any condition that is not inconsistent with these Regulations or any of the Regulations listed in subsection 3(4) and in particular, but not restricting the generality of the foregoing, may specify conditions respecting any of the following matters:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955698" lims:id="955698"><Label>(a)</Label><Text>the species of fish and quantities thereof that are permitted to be taken or transported;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955699" lims:id="955699"><Label>(b)</Label><Text>the age, sex, stage of development or size of fish that are permitted to be taken or transported;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955700" lims:id="955700"><Label>(c)</Label><Text>the waters in which fishing is permitted to be carried out;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955701" lims:id="955701"><Label>(d)</Label><Text>the location from which and to which fish is permitted to be transported;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955702" lims:id="955702"><Label>(e)</Label><Text>the vessel from which and to which fish is permitted to be transhipped;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955703" lims:id="955703"><Label>(f)</Label><Text>the period during which fishing or transporting fish is permitted to be carried out;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955704" lims:id="955704"><Label>(g)</Label><Text>the vessel that is permitted to be used and the persons who are permitted to operate it;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955705" lims:id="955705"><Label>(h)</Label><Text>the type, size and quantity of fishing gear and equipment that is permitted to be used and the manner in which it is permitted to be used;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955706" lims:id="955706"><Label>(i)</Label><Text>the specific location at which fishing gear is permitted to be set;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955707" lims:id="955707"><Label>(j)</Label><Text>the distance to be maintained between fishing gear;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955708" lims:id="955708"><Label>(k)</Label><Text>information that the holder of the licence shall report to the Department prior to commencement of a fishing trip with respect to where and when fishing will be carried out, including the method by which, the times at which and the person to whom the report is to be made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955709" lims:id="955709"><Label>(l)</Label><Text>information that the master of the vessel shall report to the Department from sea, including the method by which, the times at which and the person to whom the report is to be made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955710" lims:id="955710"><Label>(m)</Label><Text>the location and times at which landing of fish from the vessel is permitted;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955711" lims:id="955711"><Label>(n)</Label><Text>verification by an observer of the weight and species of any fish caught and retained;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955712" lims:id="955712"><Label>(o)</Label><Text>the method permitted for landing of fish from the vessel and the method by which the weight of the fish is to be determined;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955713" lims:id="955713"><Label>(p)</Label><Text>records that the master of the vessel shall keep of any fishing activity carried out under the licence or of the sale or transporting of fish caught under the licence, including the manner and form in which the records are to be kept, the times at which and the person to whom the records are to be produced and the period for which the records are to be retained;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955714" lims:id="955714"><Label>(q)</Label><Text>the type, size and colour of containers to hold or transport fish and the marking of such containers for identification of the source of the fish;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955715" lims:id="955715"><Label>(r)</Label><Text>the marking or tagging of fish for identification of the source of the fish;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955716" lims:id="955716"><Label>(s)</Label><Text>the segregation of fish by species on board the vessel;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955717" lims:id="955717"><Label>(t)</Label><Text>the time within which findings and data obtained as a result of fishing for an experimental or scientific purpose are to be forwarded to the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955718" lims:id="955718"><Label>(u)</Label><Text>the manner in which fish caught for an educational or public display purpose are to be held and transported;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955719" lims:id="955719"><Label>(v)</Label><Text>the species and quantities of fish that may be released or transferred under a licence issued under Part VIII;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955720" lims:id="955720"><Label>(w)</Label><Text>the period during which the release or transfer of fish is to be carried out under a licence issued under Part VIII;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955721" lims:id="955721"><Label>(x)</Label><Text>the waters or fish rearing facility into which the fish are to be released or transferred under a licence issued under Part VIII;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955722" lims:id="955722"><Label>(y)</Label><Text>the waters or fish rearing facility from which the fish are to be taken under a licence issued under Part VIII;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955723" lims:id="955723"><Label>(z)</Label><Text>the method and manner of transporting the fish to be released or transferred under a licence issued under Part VIII; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955724" lims:id="955724"><Label>(z.1)</Label><Text>the method of disposing of any water, container or other material used in the transporting of fish under a licence issued under Part VIII.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955725" lims:id="955725"><Label>(2)</Label><Text>The Minister may, for the purposes of the conservation and protection of fish, amend the conditions of a licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955726" lims:id="955726"><Label>(3)</Label><Text>A notice of any amendment referred to in subsection (2) shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955727" lims:id="955727"><Label>(a)</Label><Text>sent to the licence holder by registered mail; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955728" lims:id="955728"><Label>(b)</Label><Text>personally delivered to the licence holder by a fishery officer.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955729" lims:id="955729"><Label>(4)</Label><Text>An amendment referred to in subsection (2) is effective from the time the licence holder receives the notice referred to in subsection (3).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955730" lims:id="955730"><Label>(5)</Label><Text>A notice referred to in subsection (3) forms part of the licence to which it relates and the licence holder shall, on receipt of such a notice, attach the notice to the licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955731" lims:id="955731"><Label>(6)</Label><Text>Compliance with the Act and the regulations made under the Act is a condition of every licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955732" lims:id="955732"><Label>(7)</Label><Text>No person carrying out any activity under the authority of a licence shall contravene or fail to comply with any condition of the licence.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="955734" lims:id="955734">SOR/93-333, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955735" lims:id="955735"><Label>23</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955736" lims:id="955736"><Label>(1)</Label><Text>This section does not apply in respect of a licence issued for the purpose of recreational or sport fishing.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955737" lims:id="955737"><Label>(2)</Label><Text>Where the holder of a licence or the operator named in a licence is unable to engage in the activity authorized by the licence or use the vessel specified in the licence because of circumstances beyond the control of the holder or operator, a fishery officer who is employed by the Department or any employee of the Department engaged in the issuance of licences may, on the request of the holder or the holder’s agent, authorize in writing</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955738" lims:id="955738"><Label>(a)</Label><Text>another person to carry out the activity under the licence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955739" lims:id="955739"><Label>(b)</Label><Text>the use of another vessel under the licence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955740" lims:id="955740"><Label>(3)</Label><Text>Where an authorization is given under subsection (2), the authorization forms part of the licence and the person given the authorization shall attach it to the licence.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955741" lims:id="955741" level="2"><TitleText>Suspension or Cancellation of Licences</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955742" lims:id="955742"><Label>24</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955743" lims:id="955743"><Label>(1)</Label><Text>Where considering suspending or cancelling a lease or licence under section 9 of the Act, the Minister shall notify the holder thereof in writing by</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955744" lims:id="955744"><Label>(a)</Label><Text>sending a notice by registered mail to the holder; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955745" lims:id="955745"><Label>(b)</Label><Text>having a fishery officer personally deliver a notice to the holder or, if the holder cannot conveniently be found, leave a notice for the holder at the holder’s last known place of abode with any person who resides therein who appears to be at least 16 years of age.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955746" lims:id="955746"><Label>(2)</Label><Text>A notice referred to in subsection (1) shall set out the reasons for the suspension or cancellation being considered and the period of suspension or the effective date of cancellation, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955747" lims:id="955747"><Label>(3)</Label><Text>Where the holder of a lease or licence receives a notice referred to in subsection (1), the holder may, in writing and within 30 days after receiving the notice, make representations to the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955748" lims:id="955748"><Label>(4)</Label><Text>Where the Minister receives representations pursuant to subsection (3), the Minister shall, within a reasonable time, review the matter and, in writing, inform the holder referred to in subsection (3) of the decision.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955749" lims:id="955749"><Label>25</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955750" lims:id="955750"><Label>(1)</Label><Text>Where a licence is suspended or cancelled under section 9 or 79.1 of the Act, the holder of the licence shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955751" lims:id="955751"><Label>(a)</Label><Text>immediately surrender the licence to a fishery officer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955752" lims:id="955752"><Label>(b)</Label><Text>immediately remove from the water all fishing gear operated under the licence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955753" lims:id="955753"><Label>(2)</Label><Text>No person whose licence is suspended under section 9 or 79.1 of the Act shall, during the period of suspension,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955754" lims:id="955754"><Label>(a)</Label><Text>engage in fishing for any species of fish for which fishing was authorized by the licence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955755" lims:id="955755"><Label>(b)</Label><Text>be on board a vessel engaged in fishing for any species of fish for which fishing was authorized by the licence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955756" lims:id="955756"><Label>(3)</Label><Text>No person whose licence is cancelled under section 9 or 79.1 of the Act shall, during the remaining period for which the licence was issued,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955757" lims:id="955757"><Label>(a)</Label><Text>engage in fishing for any species of fish for which fishing was authorized by the licence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955758" lims:id="955758"><Label>(b)</Label><Text>be on board a vessel engaged in fishing for any species of fish for which fishing was authorized by the licence.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955759" lims:id="955759" level="1"><Label>PART III</Label><TitleText>Identification of Fishing Vessels and Fishing Gear</TitleText></Heading><Heading lims:inforce-start-date="2015-05-29" lims:fid="955760" lims:id="955760" level="2"><TitleText>Identification of Fishing Vessels</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955761" lims:id="955761"><Label>26</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955762" lims:id="955762"><Label>(1)</Label><Text>No person shall operate or cause to be operated a registered vessel</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955763" lims:id="955763"><Label>(a)</Label><Text>on which the vessel registration number is not painted or securely affixed by some other means; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955764" lims:id="955764"><Label>(b)</Label><Text>that displays a vessel registration number that does not meet the requirements set out in subsection (2).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955765" lims:id="955765"><Label>(2)</Label><Text>A vessel registration number shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955766" lims:id="955766"><Label>(a)</Label><Text>legible and unobstructed when viewed from an aircraft in flight, from another vessel or from shore;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955767" lims:id="955767"><Label>(b)</Label><Text>in solid Arabic numerals without ornamentation;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955768" lims:id="955768"><Label>(c)</Label><Text>white on a black background or black on a white background;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955769" lims:id="955769"><Label>(d)</Label><Text>aligned horizontally;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955770" lims:id="955770"><Label>(e)</Label><Text>of dimensions in accordance with the table to this subsection and subsections (4) and (5); and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955771" lims:id="955771"><Label>(f)</Label><Text>located on the vessel in accordance with subsection characteristics.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955779" lims:id="955779"><Label>(3)</Label><Text>For the purpose of subsections (4) and (5), “h” is the height of the numerals forming the vessel registration number.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955780" lims:id="955780"><Label>(4)</Label><Text>The numerals forming the vessel registration number shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955781" lims:id="955781"><Label>(a)</Label><Text>have a stroke width of h/6; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955782" lims:id="955782"><Label>(b)</Label><Text>be spaced apart not less than h/6 and not more than h/4.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955783" lims:id="955783"><Label>(5)</Label><Text>The background shall extend to provide a border of not less than h/6 around the vessel registration number.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955784" lims:id="955784"><Label>(6)</Label><Text>The vessel registration number shall be located as high as is practicable on both sides of the vessel.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955785" lims:id="955785"><Label>(7)</Label><Text>Subject to subsection (8), no person shall operate or cause to be operated a fishing vessel that displays, on the exterior of the vessel, any number other than the vessel registration number.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955786" lims:id="955786"><Label>(8)</Label><Text>Subsection (7) does not apply with respect to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955787" lims:id="955787"><Label>(a)</Label><Text>a foreign fishing vessel operating under a licence issued under the <XRefExternal reference-type="regulation" link="C.R.C.,_c._413">Coastal Fisheries Protection Regulations</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955788" lims:id="955788"><Label>(b)</Label><Text>a vessel displaying a licence number in accordance with the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1487">Small Vessel lims:inforce-start-date="2013-03-08" lims:fid="955795" lims:id="955795"><Label>(b)</Label><Text>in any other case, the name of the person who owns the gear.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955796" lims:id="955796"><Label>(2)</Label><Text>The vessel registration number or name referred to in subsection (1) shall be painted on or otherwise securely affixed to a tag, float or buoy attached to the gear and be legible and readily visible at all times without the necessity of raising the gear from the water or, where the water is ice covered, without the necessity of removing any snow or ice.</Text></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955797" lims:id="955797"><Label>(3)</Label><Text>The numerals in a vessel registration number referred to in paragraph (1)(a) shall be solid block Arabic numerals</Text><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955798" lims:id="955798"><Label>(a)</Label><Text>without ornamentation;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955799" lims:id="955799"><Label>(b)</Label><Text>not less than 75 mm in height; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955800" lims:id="955800"><Label>(c)</Label><Text>in a colour that contrasts with their background.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955801" lims:id="955801"><Label>(4)</Label><Text>The letters forming a name referred to in paragraph (1)(b) shall be solid block capital letters in Roman characters</Text><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955802" lims:id="955802"><Label>(a)</Label><Text>without ornamentation;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955803" lims:id="955803"><Label>(b)</Label><Text>not less than 75 mm in height; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955804" lims:id="955804"><Label>(c)</Label><Text>in a colour that contrasts with their background.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955805" lims:id="955805"><Label>(5)</Label><Text>The tag, float or buoy referred to in subsection (2) shall have displayed on it only one vessel registration number or one name, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955806" lims:id="955806"><Label>(6)</Label><Text lims:inforce-start-date="2023-06-23" lims:enacted-date="2023-06-23" lims:fid="1412550" lims:id="1413537">Except as otherwise provided as a condition of a licence, a tag, float or buoy referred to in subsection (2) shall</Text><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955807" lims:id="955807"><Label>(a)</Label><Text>where the waters are tidal waters and one end of the fishing gear is fastened to the shore, be affixed to the end of the gear farthest from the shore; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955808" lims:id="955808"><Label>(b)</Label><Text>in any other case, be affixed to each end of the gear.</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955809" level="1"><Label>PART IV</Label><TitleText>General</TitleText></Heading><Heading lims:inforce-start-date="2015-05-29" lims:fid="955817" lims:id="955817" level="2"><TitleText>Obstruction of Mesh</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955818" lims:id="955818"><Label>30</Label><Text>Subject to section 31, where a person is fishing for a species of fish with fishing gear for which any of the Regulations listed in subsection 3(4) prescribe a minimum mesh size, that person shall not use any device by means of which openings that are smaller in size than the mesh size prescribed for that species are created in any part of the gear.</Text></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955819" lims:id="955819" level="2"><TitleText>Chafing Gear</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955820" lims:id="955820"><Label>31</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955821" lims:id="955821"><Label>(1)</Label><Text>For the purposes of this section, <DefinedTermEn>cod-end</DefinedTermEn> means a bag-like extension that is attached to the after end of the belly of a trawl net and is used to retain the catch.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955822" lims:id="955822"><Label>(2)</Label><Text>For the purpose of preventing wear and tear to a trawl net, a person may attach</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955823" lims:id="955823"><Label>(a)</Label><Text>to the underside of the cod-end of the trawl net, any hides, canvas, netting or other similar material; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955824" lims:id="955824"><Label>(b)</Label><Text>to the topside of the cod-end, a topside chafer described in Schedule I.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955825" lims:id="955825"><Label>(3)</Label><Text>No person shall use on an otter trawl any topside chafer other than one that meets the description of one of the topside chafers described in Schedule I.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955826" lims:id="955826" level="2"><TitleText>Trans-shipment of Fish</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955827" lims:id="955827"><Label>32</Label><Text>No person shall trans-ship any fish from a Canadian fishing vessel to a foreign fishing vessel unless that foreign fishing vessel is licensed under the <XRefExternal reference-type="regulation" link="C.R.C.,_c._413">Coastal Fisheries Protection Regulations</XRefExternal> to take on board the fish.</Text></Section><Heading lims:id="955830"><Label>(1)</Label><Text>Subsection (2) applies where a person catches a fish</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955831" lims:id="955831"><Label>(a)</Label><Text>at a time or place at which the person is prohibited from fishing for that fish;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955832" lims:id="955832"><Label>(b)</Label><Text>by a method or with fishing gear that the person is prohibited from using to fish for that fish; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955833" lims:id="955833"><Label>(c)</Label><Text>the possession or retention of which is prohibited.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955834" lims:id="955834"><Label>(2)</Label><Text>Except where the retention of an incidental catch is expressly authorized by any of the Regulations listed in subsection 3(4), every person who catches a fish incidentally shall forthwith return it</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955835" lims:id="955835"><Label>(a)</Label><Text>to the place from which it was taken; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955836" lims:id="955836"><Label>(b)</Label><Text>where it is alive, in a manner that causes it the least harm.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955837" lims:id="955837" level="2"><TitleText>Dumping and Wasting of Fish</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955838" lims:id="955838"><Label>34</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955839" lims:id="955839"><Label>(1)</Label><Text>This section does not apply in respect of marine mammals.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955840" lims:id="955840"><Label>(2)</Label><Text>No person who is fishing under the authority of a licence issued for the purpose of commercial fishing shall dump from a vessel any fish that has been caught in accordance with the Act and the regulations made thereunder.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955841" lims:id="955841"><Label>(3)</Label><Text>No person who is food fishing for personal use or fishing for recreational or sport purposes shall waste any fish that is suitable for human consumption.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955842" lims:id="955842" level="2"><TitleText>Sale of Fish</TitleText></Heading><Section lims:inforce-start-date="2018-05-30" lims:lastAmendedDate="2018-05-30" lims:fid="955843" lims:id="955843"><Label>35</Label><Subsection lims:inforce-start-date="2018-05-30" lims:fid="955844" lims:id="955844"><Label>(1)</Label><Text>This section does not apply in respect of fish cultivated in an aquaculture facility or in respect of marine mammals.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-30" lims:fid="955845" lims:id="955845"><Label>(2)</Label><Text>Subject to subsection (3), no person shall buy, sell, trade, barter or offer to buy, sell, trade or barter any fish unless it was caught and retained under the authority of a licence issued for the purpose of commercial fishing, a licence issued under Part VII, a licence issued under the <XRefExternal reference-type="regulation" link="SOR-93-332">Aboriginal Communal Fishing Licences Regulations</XRefExternal> in which the Minister has authorized the sale of fish or an Excess Salmon to Spawning Requirement Licence issued under the <XRefExternal reference-type="regulation" link="SOR-93-54">Pacific Fishery Regulations, 1993</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2018-05-30" lims:fid="955846" lims:id="955846"><Label>(3)</Label><Text>Subsection (2) does not apply if the buying, selling, trading or bartering is carried out in accordance with the terms of the Agreement defined in section 2 of the <XRefExternal reference-type="act" link="W-6.7">Western Arctic (Inuvialuit) Claims Settlement Act</XRefExternal>, the Agreement defined in section 2 of the <XRefExternal reference-type="act" link="J-0.3">James Bay and Northern Quebec Native Claims Settlement Act</XRefExternal> or the Agreement defined in section 2 of the <XRefExternal reference-type="act" link="L-4.3">Labrador Inuit Land Claims Agreement Act</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-05-30" lims:fid="955848" lims:id="955848">SOR/93-333, s. 5; SOR/2010-270, and Measure Fish</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955850" lims:id="955850"><Label>36</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955851" lims:id="955851"><Label>(1)</Label><Text>No person shall possess fish that were caught by any person while fishing for recreational or sport purposes and that have been skinned, cut, packed or otherwise dealt with in such a manner that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955852" lims:id="955852"><Label>(a)</Label><Text>the species cannot be readily determined;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955853" lims:id="955853"><Label>(b)</Label><Text>the number of fish cannot be readily determined;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955854" lims:id="955854"><Label>(c)</Label><Text>where weight is used to determine catch limits, the weight of the fish cannot be readily determined; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955855" lims:id="955855"><Label>(d)</Label><Text>where size limits are applicable, the size of the fish cannot be readily determined.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955856" lims:id="955856"><Label>(2)</Label><Text>No person who catches and retains a fish under the authority of a licence issued for the purpose of commercial fishing shall have the fish in possession if the fish is skinned, cut, packed or otherwise dealt with in such a manner that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955857" lims:id="955857"><Label>(a)</Label><Text>the species cannot be readily identified;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955858" lims:id="955858"><Label>(b)</Label><Text>the number of fish cannot be readily determined;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955859" lims:id="955859"><Label>(c)</Label><Text>the weight of the fish cannot be readily determined; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955860" lims:id="955860"><Label>(d)</Label><Text>where size limits are applicable, the size of the fish cannot be readily determined.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955861" lims:id="955861" level="2"><TitleText>Fishing in or Near Government Facilities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955862" lims:id="955862"><Label>37</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955863" lims:id="955863"><Label>(1)</Label><Text>Unless authorized under the Act, these Regulations or any of the Regulations listed in subsection 3(4), no person shall fish in or remove fish from a fish hatchery, fish rearing establishment, fish holding facility or fish collection facility operated by the Department.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955864" lims:id="955864"><Label>(2)</Label><Text>Subject to subsection (3), no person shall fish within a 100 m radius of any facility operated by or on behalf of the Department, the Province of Nova Scotia, New Brunswick, British Columbia, Prince Edward Island or Newfoundland and Labrador, the Yukon Territory or the Northwest Territories for the purpose of the counting, passage or rearing of fish.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955865" lims:id="955865"><Label>(3)</Label><Text>A fishery officer may determine, taking into account the configuration of the waters, the amount of water flow and any other relevant circumstances, that the distance set out in subsection (2) is longer than required to protect fish, and may shorten the distance by placing a sign or signs, as may be appropriate, to delimit the shorter distance.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955866" lims:id="955866"><Label>(4)</Label><Text>Where a sign has been placed under subsection (3), no person shall fish between that sign and any facility referred to in subsection (2).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="955868" lims:id="955868">SOR/2003-369, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955869" lims:id="955869" level="2"><TitleText>Authorization to Place Nets in Waters for Cleaning</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955870" lims:id="955870"><Label>38</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955871" lims:id="955871"><Label>(1)</Label><Text>Notwithstanding section 25 of the Act, a fishery officer may, in writing, authorize a person to place a net in waters closed to fishing with that net for the purposes of cleaning the net.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955872" lims:id="955872"><Label>(2)</Label><Text>An authorization given under subsection (1) shall specify the location at which the net may be placed, the manner in which the net may be placed and the period of time for which the authorization is valid.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955873" lims:id="955873" level="1"><Label>PART V</Label><TitleText>Observers</TitleText></Heading><Heading lims:inforce-start-date="2015-05-29" lims:fid="955874" lims:id="955874" level="2"><TitleText>Designation and Duties</TitleText></Heading><Section lims:inforce-start-date="2013-03-08" lims:lastAmendedDate="2020-11-30" lims:fid="955875" lims:id="955875"><Label>39</Label><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955876" lims:id="955876"><Label>(1)</Label><Text>The Regional Director-General may designate as an observer any individual who is qualified and trained to perform any of the duties described in subsection (2) and who</Text><Paragraph lims:inforce-start-date="2020-11-30" lims:enacted-date="2020-11-30" lims:fid="955877" lims:id="1276750"><Label>(a)</Label><Text>does not hold a fisher’s registration card or a provincial or territorial fisher’s certificate;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955878" lims:id="955878"><Label>(b)</Label><Text>does not purchase fish for the purpose of resale; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955879" lims:id="955879"><Label>(c)</Label><Text>is not an owner, operator, manager or employee of an enterprise that catches, cultures, processes or transports fish.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955880" lims:id="955880"><Label>(2)</Label><Text>The Regional Director-General shall assign to an observer designated under subsection (1) one or more of the following duties:</Text><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955881" lims:id="955881"><Label>(a)</Label><Text>the monitoring of fishing activities, the examination and measurement of fishing gear, the recording of scientific data and observations and the taking of samples;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955882" lims:id="955882"><Label>(b)</Label><Text>the monitoring of the landing of fish and the verification of the weight and species of fish caught and retained; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955883" lims:id="955883"><Label>(c)</Label><Text>conducting biological examination and sampling of fish.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955884" lims:id="955884"><Label>(2.1)</Label><Text>An observer designated under subsection (1) shall transmit in a timely manner to the Department or to a corporation designated under subsection 39.1(1), as the case may be, the information collected and compiled in the course of their duties under subsection 39(2).</Text></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955885" lims:id="955885"><Label>(3)</Label><Text>An observer who is assigned the duties set out in paragraph (2)(a) shall perform those duties while on board a fishing vessel or in an aquaculture facility.</Text></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955886" lims:id="955886"><Label>(4)</Label><Text>An observer who is assigned the duties set out in paragraph (2)(b) shall perform those duties while at a fish landing station or in an aquaculture facility.</Text></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955887" lims:id="955887"><Label>(5)</Label><Text>An observer who is assigned the duties set out in paragraph (2)(c) shall perform those duties while on board a fishing vessel, at a fish landing station or in an aquaculture facility.</Text></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955888" lims:id="955888"><Label>(6)</Label><Text>The Regional Director-General may revoke the designation of an observer designated under subsection (1) if the observer</Text><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955889" lims:id="955889"><Label>(a)</Label><Text>no longer complies with the criteria set out in that subsection;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955890" lims:id="955890"><Label>(b)</Label><Text>performs his or her duties in respect of a fisher with whom the observer is not dealing at arm’s length;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955891" lims:id="955891"><Label>(c)</Label><Text>falsifies any information transmitted in the course of his or her duties or fails to perform those duties; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955892" lims:id="955892"><Label>(d)</Label><Text>fails to perform his or her duties in a competent and professional manner.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-03-08" lims:fid="955894" lims:id="955894">SOR/98-481, lims:fid="955895" lims:id="955895"><Label>39.1</Label><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955896" lims:id="955896"><Label>(1)</Label><Text>The Regional Director-General may designate as an observer any corporation that has submitted</Text><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955897" lims:id="955897"><Label>(a)</Label><Text>a description of a program that is capable of accurately collecting and compiling information obtained by individual observers in the course of their duties under subsection 39(2) and that includes</Text><Subparagraph lims:inforce-start-date="2013-03-08" lims:fid="955898" lims:id="955898"><Label>(i)</Label><Text>a business plan for the corporation that describes the organization of the corporation, its human resources and its plan of operations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-03-08" lims:fid="955899" lims:id="955899"><Label>(ii)</Label><Text>a plan for the training and independent examination of individuals who will be designated as observers to perform the duties described in subsection 39(2), and for the supervision of those observers, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-03-08" lims:fid="955900" lims:id="955900"><Label>(iii)</Label><Text>a quality control system for ensuring the integrity of the information collected and compiled that identifies a person responsible for the system and his or her duties, and that describes the operation of the system, the manner in which records are kept, the control points, the verification procedures and the process for correcting deficiencies in the system;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955901" lims:id="955901"><Label>(b)</Label><Text>a statement that discloses all conflicts of interest that the corporation or any of its directors, officers or employees, or any shareholder having a significant interest in the corporation may have with the fishing industry, and that explains how those conflicts are to be resolved; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955902" lims:id="955902"><Label>(c)</Label><Text>evidence of the corporation’s financial viability, or a performance bond guaranteeing three months of operation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955903" lims:id="955903"><Label>(2)</Label><Text>An observer designated under subsection (1) has the following duties:</Text><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955904" lims:id="955904"><Label>(a)</Label><Text>to comply with the program submitted under paragraph (1)(a);</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955905" lims:id="955905"><Label>(b)</Label><Text>to transmit to the Department, in a timely manner, the information collected and compiled as part of the program;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955906" lims:id="955906"><Label>(c)</Label><Text>to disclose all conflicts of interest that arise after the observer’s designation and explain how they are to be resolved; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955907" lims:id="955907"><Label>(d)</Label><Text>to resolve any conflicts of interest disclosed under paragraph (c) or paragraph (1)(b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-03-08" lims:fid="955908" lims:id="955908"><Label>(3)</Label><Text>The Regional Director-General may revoke the designation of an observer designated under subsection (1) if the observer</Text><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955909" lims:id="955909"><Label>(a)</Label><Text>falsifies any information transmitted in the course of its duties or fails to perform those duties; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-03-08" lims:fid="955910" lims:id="955910"><Label>(b)</Label><Text>fails to maintain the performance bond submitted under paragraph (1)(c).</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-03-08" lims:fid="955912" lims:id="955912">SOR/98-481, s. 4; lims:inforce-start-date="2006-03-22" lims:fid="955925" lims:id="955925"><Label>(1)</Label><Text>The Regional Director-General shall provide each observer with a certificate that certifies the observer’s designation as such and specifies the duties that have been assigned to the observer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955926" lims:id="955926"><Label>(2)</Label><Text>An observer shall, on entering any place to perform the observer’s duties, on request, show the certificate of designation to the person in charge of the place.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955927" lims:id="955927" level="1"><Label>PART VI</Label><TitleText>Assisting Persons Engaged in the Enforcement or Administration of the Act</TitleText></Heading><Heading lims:inforce-start-date="2015-05-29" lims:fid="955928" lims:id="955928" level="2"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955929" lims:id="955929"><Label>41</Label><Text>In this Part,</Text><Definition lims:inforce-start-date="2006-03-22" lims:fid="955930" lims:id="955930" generate-in-text="no"><Text><DefinedTermEn>fisheries patrol-boat pennant</DefinedTermEn> means a pennant in the shape set out in Part I of Schedule II and the colours set out in Parts I and II of Schedule II, the crest of which has the details set out in Part II of Schedule II; (<DefinedTermFr>fanion de patrouilleur des pêches</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955931" lims:id="955931" generate-in-text="no"><Text><DefinedTermEn>inspection pennant</DefinedTermEn> means a pennant in the shape, size and colours set out in Schedule III; (<DefinedTermFr>fanion d’inspection</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="955932" lims:id="955932" generate-in-text="no"><Text><DefinedTermEn>inspector</DefinedTermEn> means a person named by a contracting party set out in Schedule IV to carry out inspections in the Regulatory Area in accordance with the scheme of joint international enforcement established pursuant to Article XVIII of the <XRefExternal reference-type="other">Convention of Future Multilateral Cooperation in the Northwest Atlantic Fisheries</XRefExternal> that was ratified by Canada on November 30, 1978 and came into force on January 1, 1979, and who is in possession of an identification card issued by that contracting pennant on a vessel identifies that vessel as a vessel with an inspector on board.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955941" lims:id="955941" level="2"><TitleText>Signalling</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955942" lims:id="955942"><Label>43</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955943" lims:id="955943"><Label>(1)</Label><Text>Where a fishery officer or fishery guardian sends the Signal L, the Signal SQ 1 or the Signal SQ 3 to a vessel by any of the methods set out in subsection (2), the master of the vessel shall immediately comply with the direction of that signal.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955944" lims:id="955944"><Label>(2)</Label><Text>The following methods of signalling may be used to send signals to vessels:</Text><Paragraph lims:fid="955948" lims:id="955948"><Label>(d)</Label><Text>Morse signalling using hand-flags or arms;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955949" lims:id="955949"><Label>(e)</Label><Text>voice with or without using loud hailer;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955950" lims:id="955950"><Label>(f)</Label><Text>radiotelegraphy; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955951" lims:id="955951"><Label>(g)</Label><Text>radiotelephony.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955952" lims:id="955952"><Label>(3)</Label><Text>Where any signal referred to in subsection (1) has been sent to a vessel, no person on board that vessel shall dump or throw anything overboard from that vessel until the fishery officer or fishery guardian who sent the signal indicates to the master of the vessel that the vessel may proceed.</Text></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955953" lims:id="955953" level="2"><TitleText>Assisting Fishery Officer and Fishery Guardian</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955954" lims:id="955954"><Label>44</Label><Text>The master of a fishing vessel shall provide all reasonable assistance to a fishery officer or fishery guardian, including</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955955" lims:id="955955"><Label>(a)</Label><Text>making the fishing gear used on or from the vessel available for inspection and for that purpose hauling in such gear and thawing the nets, where necessary;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955956" lims:id="955956"><Label>(b)</Label><Text>permitting the taking of photographs of the fisheries operations, including fishing gear and equipment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955957" lims:id="955957"><Label>(c)</Label><Text>where the fishery officer or fishery guardian is on board for more than four consecutive hours, providing food and accommodation equivalent to that provided to officers of the vessel.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955958" lims:id="955958" level="2"><TitleText>Assisting Inspector</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955959" lims:id="955959"><Label>45</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955960" lims:id="955960"><Label>(1)</Label><Text>Where an inspector sends the Signal L or the Signal SQ 3 by any of the methods set out in subsection 43(2) to a fishing vessel operating in the Regulatory Area, the master of the vessel shall immediately comply with the direction of that signal.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955961" lims:id="955961"><Label>(2)</Label><Text>The master of a fishing vessel operating in the Regulatory Area shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955962" lims:id="955962"><Label>(a)</Label><Text>at the request of an inspector, permit the inspector to board the vessel; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955963" lims:id="955963"><Label>(b)</Label><Text>provide the inspector with all reasonable assistance necessary to enable the inspector to carry out an inspection of the fishing operations, including</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="955964" lims:id="955964"><Label>(i)</Label><Text>making the fishing gear used on or from the vessel available for inspection and for that purpose hauling in such gear and thawing the nets, where necessary,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="955965" lims:id="955965"><Label>(ii)</Label><Text>permitting the taking of photographs of the fisheries operations, including fishing gear and equipment, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="955966" lims:id="955966"><Label>(iii)</Label><Text>where the inspector is on board for more than four consecutive hours, providing food and accommodation equivalent to that provided to officers of the vessel.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955967" lims:id="955967"><Label>(2.1)</Label><Text>Where an inspector sends the Signal SQ 3 to a fishing vessel, no person on board that vessel shall retrieve any gear from the water for the period of 30 minutes after the signal is sent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955968" lims:id="955968"><Label>(3)</Label><Text>Where, during an inspection in the Regulatory Area, an inspector finds any fishing gear or equipment the use or possession of which is contrary to the Act, the <XRefExternal reference-type="regulation" link="SOR-86-21">Atlantic Fishery Regulations, 1985</XRefExternal> or these Regulations, the inspector may place a mark or seal on that fishing gear or equipment in a manner that will preserve the identity of the gear or equipment.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955969" lims:id="955969"><Label>(4)</Label><Text>No person other than a fishery officer shall remove a mark or seal placed on any fishing gear or equipment in accordance with subsection (3).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955970" lims:id="955970"><Label>(5)</Label><Text>Where a mark or seal has been placed on any fishing gear or equipment in accordance with subsection (3), no person shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955971" lims:id="955971"><Label>(a)</Label><Text>alter or tamper with that mark or seal; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955972" lims:id="955972"><Label>(b)</Label><Text>use, destroy or dispose of that fishing gear or equipment unless the mark or seal has been removed by a fishery officer.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="955974" Observers</TitleText></Heading><Heading lims:inforce-start-date="2015-05-29" lims:fid="955976" lims:id="955976" level="3"><TitleText>Monitoring Fishing Activities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955977" lims:id="955977"><Label>46</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955978" lims:id="955978"><Label>(1)</Label><Text>This section does not apply in respect of a foreign fishing vessel.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955979" lims:id="955979"><Label>(2)</Label><Text>The owner or master of a fishing vessel shall, at the request of the Regional Director-General,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955980" lims:id="955980"><Label>(a)</Label><Text>permit an observer who is assigned the duties set out in paragraph 39(2)(a) to go on board that vessel to perform those duties and to remain on board for the period of time specified in the request; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955981" lims:id="955981"><Label>(b)</Label><Text>arrange for the embarkation or disembarkation of the observer at such time and place as is specified in the request.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955982" lims:id="955982"><Label>(3)</Label><Text>The master of a fishing vessel shall provide all reasonable assistance to an observer who is assigned the duties set out in paragraph 39(2)(a), including</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955983" lims:id="955983"><Label>(a)</Label><Text>providing a suitable work area, including a table and adequate lighting;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955984" lims:id="955984"><Label>(b)</Label><Text>providing, at the request of the observer, information relating to any matter mentioned in subsection 61(2) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955985" lims:id="955985"><Label>(c)</Label><Text>providing, at the request of the observer, the position of the vessel in latitude and longitude;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955986" lims:id="955986"><Label>(d)</Label><Text>facilitating the sending and receiving of messages by means of the communications equipment on board the vessel;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955987" lims:id="955987"><Label>(e)</Label><Text>giving access to all areas of the vessel involved in fishing, processing and storage operations;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955988" lims:id="955988"><Label>(f)</Label><Text>permitting the taking of samples free of charge;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955989" lims:id="955989"><Label>(g)</Label><Text>providing suitable storage facilities for samples;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955990" lims:id="955990"><Label>(h)</Label><Text>assisting, at the request of the observer, in the examination and measurement of fishing gear on board the vessel;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955991" lims:id="955991"><Label>(i)</Label><Text>permitting the taking of photographs of the fisheries operations, including fishing gear and equipment;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955992" lims:id="955992"><Label>(j)</Label><Text>permitting the removal from the vessel of samples, records, photographs or film taken or made on board the vessel; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955993" lims:id="955993"><Label>(k)</Label><Text>where the observer is on board for more than four consecutive hours, providing food and accommodation equivalent to that provided to officers of the vessel.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2015-05-29" lims:fid="955994" lims:id="955994" level="3"><TitleText>Monitoring Landing and Conducting Biological Examinations</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-05-29" lims:fid="955996" lims:id="955996">SOR/98-481, s. 5</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955997" the request of an observer who is assigned the duties set out in paragraph 39(2)(b) or (c), provide the observer with access to the fish landing station; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="956004" lims:id="956004"><Label>(b)</Label><Text>provide the observer with such assistance as is reasonably necessary to enable the observer to perform those duties, including</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="956005" lims:id="956005"><Label>(i)</Label><Text>making the fish at the fish landing station readily accessible to the observer,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="956006" lims:id="956006"><Label>(ii)</Label><Text>providing the observer with a suitable work area, including a table and adequate lighting, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="956007" lims:id="956007"><Label>(iii)</Label><Text>permitting lims:id="956095"><Label>(b)</Label><Text>in the case where the fishing or trans-shipping of fish is to be carried out in waters that are subject to the jurisdiction of another state, the fishing or trans-shipping of fish by that vessel is authorized by a competent authority of that state.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="956096" lims:id="956096"><Label>(2)</Label><Text>Subject to subsection (3), the fee for a licence referred to in subsection (1) is $500.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="956097" lims:id="956097"><Label>(3)</Label><Text>There is no fee for a licence referred to in subsection (1) that is issued in respect of waters subject to the jurisdiction of lims:fid="1342591" lims:id="1342591"><Label>(a)</Label><Text>the stock status and stock trends;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342592" lims:id="1342592"><Label>(b)</Label><Text>the probable causes for the stock’s decline;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342593" lims:id="1342593"><Label>(c)</Label><Text>measurable objectives aimed at rebuilding the stock, including a target for rebuilding the stock;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342594" lims:id="1342594"><Label>(d)</Label><Text>the timelines for achieving the objectives;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342595" lims:id="1342595"><Label>(e)</Label><Text>the management measures aimed at achieving the objectives;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342596" lims:id="1342596"><Label>(f)</Label><Text>a method to track progress towards achieving the objectives; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342597" lims:id="1342597"><Label>(g)</Label><Text>a schedule for a periodic review of the plan in order to assess progress towards achieving the objectives and to determine whether an adjustment to the plan is needed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342598" lims:id="1342598"><Label>(2)</Label><Text>The plan shall be developed within 24 months after the day on which the Minister first had knowledge that the major fish stock had declined to or below its limit reference point.</Text></Subsection><Subsection lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342599" lims:id="1342599"><Label>(3)</Label><Text>The Minister may extend the time period to the extent necessary for completing the plan, by a period not exceeding 12 months.</Text></Subsection><Subsection lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342600" lims:id="1342600"><Label>(4)</Label><Text>If the Minister extends the time period, the Minister shall publish the reasons for doing so on the Internet site of the Department.</Text></Subsection><Subsection lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342601" lims:id="1342601"><Label>(5)</Label><Text>If fishing of the major fish stock while the plan is being developed is permitted by the Minister, the Minister shall ensure that the level of fishing of the stock during that time is consistent with the rebuilding of the stock above the limit reference point.</Text></Subsection><Subsection lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342602" lims:id="1342602"><Label>(6)</Label><Text>Despite paragraph 1(d), if the Minister determines that it is not feasible to establish a timeline for achieving the target for rebuilding the major fish stock, the plan shall include, instead of such a timeline, the reasons why it is not feasible to do so.</Text></Subsection><Subsection lims:inforce-start-date="2022-04-04" lims:enacted-date="2022-04-04" lims:fid="1342603" lims:id="1342603"><Label>(7)</Label><Text>The Minister shall publish the plan to rebuild a major fish stock and the results of any periodic review of the plan on the Internet site of the
