(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="954855" lims:id="954855" generate-in-text="no"><Text><DefinedTermEn>counsel</DefinedTermEn> means a person who represents a party in any proceeding before the Adjudication Division; (<DefinedTermFr>conseil</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="954856" lims:id="954856" generate-in-text="no"><Text><DefinedTermEn>director</DefinedTermEn> means a director of the Adjudication Division; (<DefinedTermFr>directeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="954857" lims:id="954857" generate-in-text="no"><Text><DefinedTermEn>held</DefinedTermEn> means, in respect of an inquiry, held, reopened, resumed or continued; (<DefinedTermFr>mener</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="954858" lims:id="954858" generate-in-text="no"><Text><DefinedTermEn>notice to appear</DefinedTermEn> means a notice to appear referred to in rule 9; (<DefinedTermFr>avis de convocation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="954859" lims:id="954859" generate-in-text="no"><Text><DefinedTermEn>party</DefinedTermEn> means the person concerned or the Minister; (<DefinedTermFr>partie</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="954860" lims:id="954860" generate-in-text="no"><Text><DefinedTermEn>person concerned</DefinedTermEn> means a person who is the subject of an inquiry or a person referred to in subrule 28(1); (<DefinedTermFr>intéressé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="954861" lims:id="954861" generate-in-text="no"><Text><DefinedTermEn>registrar</DefinedTermEn> means a person designated pursuant to rule 4; (<DefinedTermFr>greffier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="954862" lims:id="954862" generate-in-text="no"><Text><DefinedTermEn>registry</DefinedTermEn> means an office established by the Board pursuant to rule 3. (<DefinedTermFr>greffe</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954863" lims:id="954863" level="1"><TitleText>Registry and Registrar</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954864" lims:id="954864"><Label>3</Label><Text>The Board shall establish one or more offices for the activities of the Adjudication Division, each of which is to be known as a registry.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954865" lims:id="954865"><Label>4</Label><Text>The Board shall designate a person to be registrar at each registry.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954866" lims:id="954866" level="1"><TitleText>Request for Inquiry</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954867" lims:id="954867"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954868" lims:id="954868"><Label>(1)</Label><Text>Where an inquiry is caused to be held pursuant to the Act, the senior immigration officer shall forward to the Adjudication Division a request for inquiry that contains the following information:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954869" lims:id="954869"><Label>(a)</Label><Text>the name, sex, date of birth, civil status and citizenship of the person concerned;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954870" lims:id="954870"><Label>(b)</Label><Text>the address and telephone number in Canada of the person concerned;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954871" lims:id="954871"><Label>(c)</Label><Text>any report and direction that relate to the person concerned;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954872" lims:id="954872"><Label>(d)</Label><Text>a statement as to whether the person concerned claims to be a Convention refugee;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954873" lims:id="954873"><Label>(e)</Label><Text>a statement as to whether the person concerned is detained and if so, the place of detention;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954874" lims:id="954874"><Label>(f)</Label><Text>where any members of the family who are dependent on the person concerned and who are in Canada are included for the purposes of subsection 33(1) of the Act, the name, sex, date of birth, civil status, citizenship, address and telephone number of those dependent family members;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954875" lims:id="954875"><Label>(g)</Label><Text>the official language chosen by the person concerned for communication with the Adjudication Division;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954876" lims:id="954876"><Label>(h)</Label><Text>where applicable, the language or dialect of the interpreter required by the person concerned for any proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954877" lims:id="954877"><Label>(i)</Label><Text>the Canada Employment and Immigration Commission Client I.D. Number relating to the person concerned;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954878" lims:id="954878"><Label>(j)</Label><Text>where applicable, the names of the family members of the person concerned who have been referred to the Adjudication Division for an inquiry and the file number of the Canada Employment and Immigration Commission relating to those family members;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954879" lims:id="954879"><Label>(k)</Label><Text>the date on which the senior immigration officer forwards the request for inquiry; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954880" lims:id="954880"><Label>(l)</Label><Text>the name of the senior immigration officer.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954881" lims:id="954881"><Label>(2)</Label><Text>The senior immigration officer shall forward the information referred to in subrule (1) to the registry designated by the Adjudication Division.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954882" lims:id="954882" level="1"><TitleText>Joinder</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954883" lims:id="954883"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954884" lims:id="954884"><Label>(1)</Label><Text>The Adjudication Division may order that two or more inquiries be held jointly where the Adjudication Division believes that no injustice is thereby likely to be caused to any party.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954885" lims:id="954885"><Label>(2)</Label><Text>Subject to subsection (3), inquiries in respect of the legal or <Language xml:lang="la">de facto</Language> spouse, dependant children, father, mother, brothers or sisters of the person concerned shall be held jointly.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954886" lims:id="954886"><Label>(3)</Label><Text>On application by a party, or on the adjudicator’s own motion at the time of the inquiry, the adjudicator may order that inquiries be held separately, where the adjudicator believes that holding hearings jointly is likely to cause an injustice to any party.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954887" lims:id="954887" level="1"><TitleText>Change of Venue</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954888" lims:id="954888"><Label>7</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954889" lims:id="954889"><Label>(1)</Label><Text>A party may apply in accordance with rule 19 to the Adjudication Division to have a conference or hearing held at a place other than that which has been set.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954890" lims:id="954890"><Label>(2)</Label><Text>An application made under subrule (1) shall be accompanied by a statement of facts to support the application.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954891" lims:id="954891"><Label>(3)</Label><Text>The Adjudication Division shall grant the application made under subrule (1) if it is satisfied that doing so will not adversely affect the proper operation of the Adjudication Division, will provide for a full and proper hearing and will dispose of the inquiry expeditiously.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954892" lims:id="954892"><Label>(4)</Label><Text>Where an application made under subrule (1) is granted, the file relating to the inquiry shall be transferred to the registry of the place where the conference or hearing is to be held.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954893" lims:id="954893" level="1"><TitleText>Postponement and Adjournment</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954894" lims:id="954894"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954895" lims:id="954895"><Label>(1)</Label><Text>Before the commencement of a hearing, a party may apply in accordance with rule 19 to the Adjudication Division to have the hearing postponed.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954896" lims:id="954896"><Label>(2)</Label><Text>Before the resumption of a hearing, a party may apply in accordance with rule 19 to the Adjudication Division to have the hearing adjourned.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954897" lims:id="954897"><Label>(3)</Label><Text>A party whose application for a postponement or adjournment was denied may reapply orally at the commencement or resumption of the hearing.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954898" lims:id="954898"><Label>(4)</Label><Text>The Adjudication Division, in determining whether a hearing shall be postponed or adjourned, may take into consideration, where applicable,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954899" lims:id="954899"><Label>(a)</Label><Text>whether the postponement or adjournment would unreasonably impede the proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954900" lims:id="954900"><Label>(b)</Label><Text>the efforts made by the parties to proceed expeditiously;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954901" lims:id="954901"><Label>(c)</Label><Text>the nature and complexity of the issues relevant to the proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954902" lims:id="954902"><Label>(d)</Label><Text>the nature of the evidence to be presented, and the likelihood of causing an injustice to any party by proceeding in the absence of that evidence;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954903" lims:id="954903"><Label>(e)</Label><Text>counsel’s knowledge of, and experience with, similar proceedings;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954904" lims:id="954904"><Label>(f)</Label><Text>the amount of time already afforded the parties for preparation of the case;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954905" lims:id="954905"><Label>(g)</Label><Text>the efforts made by the parties to be present at the hearing;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954906" lims:id="954906"><Label>(h)</Label><Text>the efforts made by the parties to make an application for a postponement or adjournment of the hearing at the earliest opportunity;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954907" lims:id="954907"><Label>(i)</Label><Text>the number of, and reasons for, any previous postponements or adjournments;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954908" lims:id="954908"><Label>(j)</Label><Text>whether the hearing was set peremptorily; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954909" lims:id="954909"><Label>(k)</Label><Text>any other relevant facts.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954910" lims:id="954910" level="1"><TitleText>Notice to Appear</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954911" lims:id="954911"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954912" lims:id="954912"><Label>(1)</Label><Text>Where the Adjudication Division directs a party to appear before it at a conference or hearing, the Adjudication Division shall, in a notice to appear, set out</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954913" lims:id="954913"><Label>(a)</Label><Text>the date, time and place set for the conference or hearing;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954914" lims:id="954914"><Label>(b)</Label><Text>the name and address in Canada of the person concerned;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954915" lims:id="954915"><Label>(c)</Label><Text>the Canada Employment and Immigration Commission Client I.D. Number relating to the person concerned;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954916" lims:id="954916"><Label>(d)</Label><Text>the names and addresses of the family members of the person concerned referred to in paragraph 5(1)(f);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954917" lims:id="954917"><Label>(e)</Label><Text>the purpose of the conference or hearing;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954918" lims:id="954918"><Label>(f)</Label><Text>the right of the person concerned and of any person referred to in paragraph (d) to be represented by counsel at their own expense;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954919" lims:id="954919"><Label>(g)</Label><Text>the requirement that the person concerned inform the Adjudication Division forthwith, in writing, of any change of address of the person concerned or of counsel of the person concerned; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954920" lims:id="954920"><Label>(h)</Label><Text>that the person concerned could be arrested for failing to appear at the date, time and place set for the conference or hearing.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954921" lims:id="954921"><Label>(2)</Label><Text>The Adjudication Division shall serve the parties and any person referred to in paragraph (1)(d) with the notice to appear and a copy of any report and direction that relate to the person concerned who is subject of the inquiry.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954922" lims:id="954922" level="1"><TitleText>Official Languages</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954923" lims:id="954923"><Label>10</Label><Text>At least 15 days before the date set for a conference or hearing, as the case may be, the person concerned shall notify the Adjudication Division, in writing, of the official language in which the person concerned chooses the conference or hearing to be conducted.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954924" lims:id="954924" level="1"><TitleText>Interpreter</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954925" lims:id="954925"><Label>11</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954926" lims:id="954926"><Label>(1)</Label><Text>The Adjudication Division shall provide an interpreter to assist a party or a party’s witness where the party advises the Adjudication Division, in writing, at least 15 days before the date set for a conference or hearing, as the case may be, that the party or witness does not understand or speak the language in which the conference or hearing is to be conducted, or is hearing impaired.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954927" lims:id="954927"><Label>(2)</Label><Text>The interpreter shall take an oath or make a solemn affirmation to interpret accurately any statements made, and to translate accurately any documents that the Adjudication Division may require to be translated, in the course of the conference or hearing.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954928" lims:id="954928" level="1"><TitleText>Conferences</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954929" lims:id="954929"><Label>12</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954930" lims:id="954930"><Label>(1)</Label><Text>The Adjudication Division may direct the parties, by a notice to appear, to attend a conference, that is to be held before or during a hearing, on any matter related to the inquiry, in order to provide for a full and proper hearing and to dispose of the inquiry expeditiously.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954931" lims:id="954931"><Label>(2)</Label><Text>At the conference the participants shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954932" lims:id="954932"><Label>(a)</Label><Text>exchange the names and addresses of witnesses that they intend to call, copies of any document that they intend to produce and of any statement of the facts, information and opinions of which they are in possession and that they intend to produce as evidence at the hearing; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954933" lims:id="954933"><Label>(b)</Label><Text>attempt to agree on means of simplifying the hearing and, as far as possible, define any pertinent issues, agree upon certain facts and receive documents.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954934" lims:id="954934"><Label>(3)</Label><Text>An agreement concluded at a conference shall be in writing and signed by the participants or given orally at the hearing and shall govern the hearing to the extent that the Adjudication Division considers appropriate in order to provide for a full and proper hearing and to dispose of the inquiry expeditiously.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954935" lims:id="954935"><Label>(4)</Label><Text>Forthwith after a conference, the adjudicator shall forward to the registry any written agreement concluded and a true copy of any documents that have been received during the conference.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954936" lims:id="954936" level="1"><TitleText>Disclosure</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954937" lims:id="954937"><Label>13</Label><Text>A party who intends to call an expert witness at a hearing shall, at least 20 days before the date set for the hearing, serve on the other party a report signed by the expert witness, setting out the name, address and qualifications of the expert witness and a brief summary of the substance of the proposed testimony of the expert witness.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954938" lims:id="954938" level="1"><TitleText>Applications for Confidentiality</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954939" lims:id="954939"><Label>14</Label><Text>An application referred to in subsection 29(2) or 103(10) of the Act shall be made to the Adjudication Division by motion in accordance with subrules 20(2) to (7).</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954940" lims:id="954940" level="1"><TitleText>Witnesses</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954941" lims:id="954941"><Label>15</Label><Text>A party who calls a witness shall pay the witness the applicable fees and allowances set out in the <XRefExternal reference-type="regulation">Federal Court Rules</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954942" lims:id="954942"><Label>16</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954943" lims:id="954943"><Label>(1)</Label><Text>The Adjudication Division may, at the request of a party or of its own motion, exclude witnesses from a hearing until they are called to testify.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954944" lims:id="954944"><Label>(2)</Label><Text>No person may communicate to a witness who has been excluded pursuant to subrule (1) any evidence or testimony that is given during the course of a hearing until after the witness has testified.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954945" lims:id="954945"><Label>17</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954946" lims:id="954946"><Label>(1)</Label><Text>A party who makes an application to summon a witness shall do so in writing and shall file it at the registry.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954947" lims:id="954947"><Label>(2)</Label><Text>Where a person fails to comply with a summons, the party who applied for the issuance of the summons may make an application in writing, accompanied by an affidavit setting out the facts on which the application is based, to the Adjudication Division for a warrant and shall file the application at the registry.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954948" lims:id="954948"><Label>(3)</Label><Text>An application made under to subrule (2) shall contain information to establish that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954949" lims:id="954949"><Label>(a)</Label><Text>the person named in the summons was served with the summons and was paid or offered a reasonable amount of attendance money but failed to comply with the requirements of the summons; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954950" lims:id="954950"><Label>(b)</Label><Text>the appearance of the person named in the summons is necessary to ensure a full and proper hearing.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954951" lims:id="954951"><Label>(4)</Label><Text>A warrant issued on an application made under subrule (2) that directs a peace officer to cause the person named therein to be apprehended anywhere in Canada shall indicate the measures to be taken by the peace officer in respect of the detention or release of the person.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954952" lims:id="954952"><Label>(5)</Label><Text>The measures referred to in subrule (4) may include</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954953" lims:id="954953"><Label>(a)</Label><Text>detaining the person in custody and forthwith bringing the person before the Adjudication Division; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954954" lims:id="954954"><Label>(b)</Label><Text>releasing the person on a recognizance, with or without sureties, conditional on the person’s appearance at the date, time and place specified, to give or produce evidence at a hearing before the Adjudication Division.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954955" lims:id="954955" level="1"><TitleText>Person Concerned in Custody</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954956" lims:id="954956"><Label>18</Label><Text>Where a person concerned is detained, the Adjudication Division may order the person who detains the person concerned to bring the latter in custody to a conference or hearing held in respect of the person concerned.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954957" lims:id="954957" level="1"><TitleText>Applications</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954958" lims:id="954958"><Label>19</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954959" lims:id="954959"><Label>(1)</Label><Text>Subject to subrule (2), every application that is provided for in these Rules, except an application referred to in rules 14 and 17 and subrule 21(3), shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954960" lims:id="954960"><Label>(a)</Label><Text>made by a party in writing;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954961" lims:id="954961"><Label>(b)</Label><Text>filed at the registry; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954962" lims:id="954962"><Label>(c)</Label><Text>served on the other party.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954963" lims:id="954963"><Label>(2)</Label><Text>A party may make an application that is provided for in these Rules orally at a hearing where the adjudicator is satisfied that no injustice is likely to be caused to any party thereby.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954964" lims:id="954964"><Label>(3)</Label><Text>The Adjudication Division may determine an application when it is satisfied that all parties have been given a reasonable opportunity to make representations.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954965" lims:id="954965" level="1"><TitleText>Motions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954966" lims:id="954966"><Label>20</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954967" lims:id="954967"><Label>(1)</Label><Text>Every application that is not provided for in these Rules shall be made by a party to the Adjudication Division by motion, unless, where the application is made during a hearing, the adjudicator decides that, in the interests of justice, the application should be dealt with in some other manner.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954968" lims:id="954968"><Label>(2)</Label><Text>The motion shall consist of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954969" lims:id="954969"><Label>(a)</Label><Text>a notice specifying the grounds on which the motion is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954970" lims:id="954970"><Label>(b)</Label><Text>an affidavit setting out the facts on which the motion is based; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954971" lims:id="954971"><Label>(c)</Label><Text>a concise statement of the law and of the arguments that are relied on by the applicant.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954972" lims:id="954972"><Label>(3)</Label><Text>The motion shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954973" lims:id="954973"><Label>(a)</Label><Text>served on the other party to the proceeding; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954974" lims:id="954974"><Label>(b)</Label><Text>filed in duplicate, together with proof of service thereof, at the registry within five days after the date of service.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954975" lims:id="954975"><Label>(4)</Label><Text>Evidence in support of a motion shall be introduced by affidavit, unless the Adjudication Division decides that, in the interests of justice, the evidence should be introduced in some other manner.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954976" lims:id="954976"><Label>(5)</Label><Text>The other party may, within seven days after being served with a motion, file at the registry a reply stating concisely the law and arguments relied on by the party, accompanied by an affidavit setting out the facts on which the reply is based.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954977" lims:id="954977"><Label>(6)</Label><Text>The applicant may, within seven days after being served with a reply, file a response thereto at the registry.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954978" lims:id="954978"><Label>(7)</Label><Text>A copy of the reply and affidavit filed pursuant to subrule (5) and of the response filed pursuant to subrule (6) shall be served on the other party within seven days after the date of service of the motion or reply, as the case may be.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954979" lims:id="954979"><Label>(8)</Label><Text>The Adjudication Division, on being satisfied that no injustice is likely to be caused, may dispose of a motion without a hearing.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954980" lims:id="954980" level="1"><TitleText>Decisions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954981" lims:id="954981"><Label>21</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954982" lims:id="954982"><Label>(1)</Label><Text>Where, at the conclusion of an inquiry, the adjudicator decides to make a removal order or conditional removal order against a person concerned, the adjudicator shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954983" lims:id="954983"><Label>(a)</Label><Text>date and sign the order and decision that sets out the basis on which the order was made; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954984" lims:id="954984"><Label>(b)</Label><Text>where the person concerned does not have grounds to appeal the decision to the Appeal Division pursuant to section 70 of the Act, inform the person and the person’s counsel by a notice in writing of the person’s right to file an application for leave to commence an application under section 18.1 of the <XRefExternal reference-type="act" link="F-7">Federal Courts Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954985" lims:id="954985"><Label>(2)</Label><Text>A copy of the documents referred to in paragraphs (1)(a) and (b) shall be</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954986" lims:id="954986"><Label>(a)</Label><Text>where the parties or their counsel, or both, are present when the Adjudicator makes the order, given forthwith to the parties or their counsel or both, as the case may be; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954987" lims:id="954987"><Label>(b)</Label><Text>where the parties or their counsel, or both, are absent when the adjudicator makes the order, served on the parties or their counsel or both, as the case may be.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954988" lims:id="954988"><Label>(3)</Label><Text>The adjudicator shall, upon a request in writing of a party that is filed within 10 days after the conclusion of an inquiry, provide written reasons for the adjudicator’s decision.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="954990" lims:id="954990">2002, c. 8, s. 182</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="954991" lims:id="954991" level="1"><TitleText>Service and Filing</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="954992" lims:id="954992"><Label>22</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954993" lims:id="954993"><Label>(1)</Label><Text>Subject to subrule (5), service of any document in the course of any proceeding under these Rules shall be effected by personal service, by prepaid regular mail, by any mail service whereby the sender is provided with an acknowledgement of receipt, or by the telephone transmission of a facsimile of the document in accordance with subrule (3).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954994" lims:id="954994"><Label>(2)</Label><Text>A copy of any document served on a party pursuant to subrule (1) shall also be served on that party’s counsel, if any.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="954995" lims:id="954995"><Label>(3)</Label><Text>A document that is served by telephone transmission of a facsimile shall include a cover page setting out</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954996" lims:id="954996"><Label>(a)</Label><Text>the sender’s name, address and telephone number;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954997" lims:id="954997"><Label>(b)</Label><Text>the name of the addressee;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954998" lims:id="954998"><Label>(c)</Label><Text>the total number of pages transmitted, including the cover page;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="954999" lims:id="954999"><Label>(d)</Label><Text>the telephone number from which the document is transmitted; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955000" lims:id="955000"><Label>(e)</Label><Text>the name and telephone number of a person to contact in the event of transmission problems.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955001" lims:id="955001"><Label>(4)</Label><Text>Service by prepaid regular mail shall be considered to be effected on the date that is seven days after the date of mailing.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955002" lims:id="955002"><Label>(5)</Label><Text>Where service cannot be effected in accordance with subrule (1), the Chairperson may direct that service be effected by such means as will, to the extent possible, provide a party with the document and as will not likely cause injustice to any party.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955003" lims:id="955003"><Label>(6)</Label><Text>After service of a document has been effected by a party, the party shall file proof of service thereof at the registry.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955004" lims:id="955004"><Label>23</Label><Text>The person concerned and any family members of the person concerned referred to in paragraph 5(1)(f) shall notify the Adjudication Division forthwith in writing of their addresses and the name and address for service of their counsel, and any changes thereto.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955005" lims:id="955005"><Label>24</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955006" lims:id="955006"><Label>(1)</Label><Text>A document shall be filed at the registry by serving it on an employee of the registry at which the file relating to the inquiry or the application referred to in subrule 29(1) is held.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955007" lims:id="955007"><Label>(2)</Label><Text>The filing of a telephone transmission of a facsimile shall be considered to be effected on the date on which it is received by the registrar, as stamped on the facsimile.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955008" lims:id="955008"><Label>(3)</Label><Text>All documents submitted in the course of any proceeding under these Rules in a language other than English or French shall be accompanied by a translation in English or French that is certified to be correct, unless the Adjudication Division decides that a translation is not necessary to provide for a full and proper hearing.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="955009" lims:id="955009" level="1"><TitleText>Time Limits</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955010" lims:id="955010"><Label>25</Label><Text>The Adjudication Division may, on application by a party made in accordance with rule 19 either before or after a time limit set out in these Rules has expired, shorten or extend the time limit, in order to provide for a full and proper hearing.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="955011" lims:id="955011" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955012" lims:id="955012"><Label>26</Label><Text>These Rules are not exhaustive and, where any matter that is not provided for in these Rules arises in the course of any proceeding, the Adjudication Division may take whatever measures are necessary to provide for a full and proper hearing and to dispose of the matter expeditiously.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955013" lims:id="955013"><Label>27</Label><Text>Where a party does not comply with a requirement of these Rules, the Adjudication Division, on application made by the party in accordance with rule 19, may permit the party to remedy the non-compliance or may waive the requirement, where it is satisfied that no injustice is thereby likely to be caused to any party or the proceeding will not be unreasonably impeded.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="955014" lims:id="955014" level="1"><TitleText>Review of Reasons for Detention</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955015" lims:id="955015"><Label>28</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955016" lims:id="955016"><Label>(1)</Label><Text>Where, pursuant to subsection 103(6) of the Act, a person concerned must be brought before an adjudicator for a review of the reasons for the continued detention of the person concerned, a senior immigration officer shall forward to the Adjudication Division forthwith the following information:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955017" lims:id="955017"><Label>(a)</Label><Text>the date and time before which the hearing to review the reasons for the continued detention must be held;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955018" lims:id="955018"><Label>(b)</Label><Text>the name and place of detention of the person concerned;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955019" lims:id="955019"><Label>(c)</Label><Text>the Canada Employment and Immigration Commission Client I.D. Number relating to the person concerned;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955020" lims:id="955020"><Label>(d)</Label><Text>the official language chosen by the person concerned for the hearing for the purposes of rule 10;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955021" lims:id="955021"><Label>(e)</Label><Text>where applicable, the language or dialect of the interpreter required by the person concerned for the purposes of rule 11;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955022" lims:id="955022"><Label>(f)</Label><Text>the name, address for service and telephone number of the counsel of the person concerned, if any;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955023" lims:id="955023"><Label>(g)</Label><Text>the date and time at which the person concerned was detained;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955024" lims:id="955024"><Label>(h)</Label><Text>the purpose of the detention; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="955025" lims:id="955025"><Label>(i)</Label><Text>whether the review is being held after 48 hours, seven days or 30 days of detention.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955026" lims:id="955026"><Label>(2)</Label><Text>The senior immigration officer shall forward the information referred to in subrule (1) to the registry designated by the Adjudication Division.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955027" lims:id="955027"><Label>29</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955028" lims:id="955028"><Label>(1)</Label><Text>Where a person concerned referred to in subrule 28(1) wishes to be brought before an adjudicator for a review of the reasons for detention pursuant to subsection 103(6) of the Act, the person concerned shall so apply to the Adjudication Division in accordance with rule 19.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="955029" lims:id="955029"><Label>(2)</Label><Text>The application referred to in subrule (1) shall be accompanied by information referred to in paragraphs 28(1)(d) and (e) and a statement that sets out the reasons in support of the application.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="955030" lims:id="955030"><Label>30</Label><Text>Rule 7 and the time limits referred to in rules 10 and 11 do not apply in respect of the review of the reasons for detention referred to in rules 28 or 29.</Text></Section></Body></Regulation>
