(<DefinedTermFr>président</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="943906" lims:id="943906">SOR/98-534, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="943907" lims:id="943907" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943908" lims:id="943908"><Label>3</Label><Text>These Rules apply in respect of public inquiries held pursuant to subsection 26(3), 33(1) or 250(3) of the Act.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="943909" lims:id="943909" level="1"><TitleText>Notice of the Inquiry</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943910" lims:id="943910"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943911" lims:id="943911"><Label>(1)</Label><Text>Where the Superintendent is satisfied that it is necessary and in the public interest that an inquiry be held into an objection, the Superintendent shall, at least 14 days before the inquiry,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943912" lims:id="943912"><Label>(a)</Label><Text>publish a notice of the inquiry in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> and in a newspaper in general circulation at or near the place where the head office of the company is to be situated; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943913" lims:id="943913"><Label>(b)</Label><Text>serve the parties with a notice of the inquiry, a copy of the objection and an invitation to attend the inquiry.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943914" lims:id="943914"><Label>(2)</Label><Text>The notice referred to in subsection (1) shall set out</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943915" lims:id="943915"><Label>(a)</Label><Text>the date, time and place of the inquiry;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943916" lims:id="943916"><Label>(b)</Label><Text>the purpose of the inquiry and the substance of the objection;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943917" lims:id="943917"><Label>(c)</Label><Text>the name of the presiding officer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943918" lims:id="943918"><Label>(d)</Label><Text>such other information as the Superintendent considers appropriate.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="943919" lims:id="943919" level="1"><TitleText>Withdrawal of Application or Objection</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943920" lims:id="943920"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943921" lims:id="943921"><Label>(1)</Label><Text>The Superintendent shall cancel an inquiry where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943922" lims:id="943922"><Label>(a)</Label><Text>the application is withdrawn; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943923" lims:id="943923"><Label>(b)</Label><Text>the objection is withdrawn or, if there is more than one objection, all of the objections are withdrawn.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943924" lims:id="943924"><Label>(2)</Label><Text>Where an inquiry is cancelled, the Superintendent shall serve the parties with, and publish in accordance with paragraph 4(1)(a), a notice of the cancellation.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="943925" lims:id="943925" level="1"><TitleText>Service of Documents</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943926" lims:id="943926"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943927" lims:id="943927"><Label>(1)</Label><Text>A document required to be served under these Rules shall be served on a person by</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943928" lims:id="943928"><Label>(a)</Label><Text>delivering the document to the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943929" lims:id="943929"><Label>(b)</Label><Text>posting the document by registered or certified mail</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="943930" lims:id="943930"><Label>(i)</Label><Text>to the person’s address for service; or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="943931" lims:id="943931"><Label>(ii)</Label><Text>where a person has no address for service at the time of service, the usual or last known address of the person; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943932" lims:id="943932"><Label>(c)</Label><Text>such other method as the presiding officer may specify.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943933" lims:id="943933"><Label>(2)</Label><Text>The address for service of documents is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943934" lims:id="943934"><Label>(a)</Label><Text><Repealed>[Repealed, SOR/98-534, s. 4]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943935" lims:id="943935"><Label>(b)</Label><Text>in the case of an applicant, the address set out in the application; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943936" lims:id="943936"><Label>(c)</Label><Text>in the case of an objector, the address set out in the objection.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="943938" lims:id="943938">SOR/98-534, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="943939" lims:id="943939" level="1"><TitleText>General Conduct of the Inquiry</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943940" lims:id="943940"><Label>7</Label><Text>The Superintendent may appoint a person to preside as presiding officer over an inquiry.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943941" lims:id="943941"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943942" lims:id="943942"><Label>(1)</Label><Text>A party may, in respect of an objection, present written submissions and make oral submissions to the presiding officer at an inquiry.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943943" lims:id="943943"><Label>(2)</Label><Text>A party may attend an inquiry in person or be represented by legal counsel.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943944" lims:id="943944"><Label>(3)</Label><Text>A presiding officer may allow a party to call witnesses.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943945" lims:id="943945"><Label>(4)</Label><Text>At an inquiry, the objector shall make any submissions in support of the objection first, after which the applicant may make submissions in response.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943946" lims:id="943946"><Label>9</Label><Text>A presiding officer may</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943947" lims:id="943947"><Label>(a)</Label><Text>receive any information that is relevant to the inquiry; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="943948" lims:id="943948"><Label>(b)</Label><Text>refuse to receive any information that is not relevant to the inquiry.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="943949" lims:id="943949" level="1"><TitleText>Public Access</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943950" lims:id="943950"><Label>10</Label><Text>Every inquiry shall be open to attendance by the public.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943951" lims:id="943951"><Label>11</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943952" lims:id="943952"><Label>(1)</Label><Text>A person may examine and obtain a copy of the objection and any document submitted in support of, or in opposition to, the objection during the period beginning on the day of publication of the notice of the inquiry in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> and ending on the day that the Minister issues, or renders a decision not to issue, the letters patent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="943953" lims:id="943953"><Label>(2)</Label><Text>An examination or a request for a copy referred to in subsection (1) shall be made at the Office of the Superintendent of Financial Institutions in Ottawa or, during the conduct of the inquiry, at the place where the inquiry is held.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="943954" lims:id="943954" level="1"><TitleText>Report</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="943955" lims:id="943955"><Label>12</Label><Text>The Superintendent shall send a copy of the report of the findings of an inquiry to the parties immediately after the Minister makes the report available to the public pursuant to subsection 26(4) of the Act.</Text></Section></Body></Regulation>
