generate-in-text="no"><Text><DefinedTermEn>charitable proceeds from Superstar Bingo</DefinedTermEn> means payments made by the Ontario Lottery Corporation to the Provincial Bingo Charitable Activities Association where the payments are equal to a percentage of the proceeds from the operation of the bingo game known as Superstar Bingo conducted by the Corporation and the Association receives the payments as agent for other non-profit organizations or charities. (<DefinedTermFr>produit du bingo Superstar</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933707" lims:id="933707" generate-in-text="no"><Text><DefinedTermEn>consideration</DefinedTermEn>, in respect of a supply of a service (other than a service referred to in subsection (2)) made to a provincial gaming authority by a distributor of the authority, does not include a reimbursement. (<DefinedTermFr>contrepartie</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933708" lims:id="933708" generate-in-text="no"><Text><DefinedTermEn>distributor</DefinedTermEn> has the meaning assigned by subsection 188.1(1) of the Act. (<DefinedTermFr>distributeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933709" lims:id="933709" generate-in-text="no"><Text><DefinedTermEn>face value</DefinedTermEn> of a right to play or participate in a game of chance that is evidenced by a ticket, card or other printed device, or of such a device, means the amount shown on the device as its price inclusive of tax under Part IX of the Act. (<DefinedTermFr>valeur nominale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933710" lims:id="933710" generate-in-text="no"><Text><DefinedTermEn>gaming activity</DefinedTermEn> of a provincial gaming authority means a commercial activity of the authority except to the extent to which the activity involves the making of non-gaming supplies by the authority and includes anything done by the authority in connection with the acquisition, establishment, disposition or termination of the commercial activity. (<DefinedTermFr>activité de jeu</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933711" lims:id="933711" generate-in-text="no"><Text><DefinedTermEn>imputed input tax credit</DefinedTermEn>, in respect of property or a service for a reporting period of a provincial gaming authority, means the amount that would be the input tax credit in respect of the property or service for the period if the amount in respect of the property or service that the authority is required under any of subparagraphs (d)(i) to (iii) of the description of A<Sub>1</Sub> in subsection 7(7) to include in determining the imputed tax payable by the authority for the period were tax that became payable by the authority during the period in respect of that property or service. (<DefinedTermFr>crédit de taxe sur les intrants imputé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933712" lims:id="933712" generate-in-text="no"><Text><DefinedTermEn>instant win game</DefinedTermEn> means a game of chance the right to play or participate in which is evidenced by a ticket, card or other printed device that contains sufficient information to ascertain, without reference to any other information, whether a holder of the device is entitled to receive a prize or winnings. (<DefinedTermFr>loterie instantanée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933713" lims:id="933713" generate-in-text="no"><Text><DefinedTermEn>instant win ticket</DefinedTermEn> means a ticket, card or other printed device that is or is evidence of a right to play or participate in an instant win game. (<DefinedTermFr>billet de loterie instantanée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933714" lims:id="933714" generate-in-text="no"><Text><DefinedTermEn>lease interval</DefinedTermEn>, in respect of a supply by way of lease of property, means a period to which a payment forming part of the consideration for the supply is attributable and that is all or part of the period during which possession or use of the property is provided under the agreement for the supply. (<DefinedTermFr>période de location</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933715" lims:id="933715" generate-in-text="no"><Text><DefinedTermEn>manufacturing</DefinedTermEn>, in respect of property, includes the production, processing or packaging of the property. (<DefinedTermFr>fabrication</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933716" lims:id="933716" generate-in-text="no"><Text><DefinedTermEn>non-gaming activity</DefinedTermEn> of a provincial gaming authority means a commercial activity of the authority except to the extent to which the activity is a gaming activity of the authority. (<DefinedTermFr>activité non liée au jeu</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933717" lims:id="933717" generate-in-text="no"><Text><DefinedTermEn>non-gaming reimbursement</DefinedTermEn> means a reimbursement paid or payable by a provincial gaming authority that is in respect of an expense incurred by a distributor of the authority and that is part of the cost to the authority of making non-gaming supplies. (<DefinedTermFr>montant de remboursement non lié au jeu</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933718" lims:id="933718" generate-in-text="no"><Text><DefinedTermEn>non-gaming supply</DefinedTermEn> means a supply other than</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933719" lims:id="933719"><Label>(a)</Label><Text>a supply of a service of accepting a bet on a game of chance, race or other event or occurrence;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933720" lims:id="933720"><Label>(b)</Label><Text>a supply of a right to play or participate in a game of chance, or a ticket, card or other printed device that is evidence of such a right, made to a distributor of a provincial gaming authority;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933721" lims:id="933721"><Label>(c)</Label><Text>a supply referred to in paragraph 188.1(4)(b) of the Act that, but for that paragraph, would be a supply by a provincial gaming authority to a distributor of the authority;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933722" lims:id="933722"><Label>(d)</Label><Text>a supply of a prize in kind; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933723" lims:id="933723"><Label>(e)</Label><Text>a promotional supply. (<DefinedTermFr>fourniture non liée au jeu</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933724" lims:id="933724" generate-in-text="no"><Text><DefinedTermEn>non-taxable reimbursement</DefinedTermEn> means a reimbursement paid or payable to a distributor of a provincial gaming authority in respect of an expense incurred by the distributor in connection with supplying a casino operating service to the authority, where the expense is</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933725" lims:id="933725"><Label>(a)</Label><Text>consideration (other than interest) for a supply made to the distributor (other than a supply that would be deemed under subsection 188.1(4) of the Act not to be a supply if it were made to the authority instead of to the distributor) that is</Text><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="933726" lims:id="933726"><Label>(i)</Label><Text>an exempt supply of personal property or a service,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="933727" lims:id="933727"><Label>(ii)</Label><Text>a zero-rated supply, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="933728" lims:id="933728"><Label>(iii)</Label><Text>a taxable supply all or part of the consideration for which is, due to the application of section 166 of the Act, not included in calculating the tax payable in respect of the supply; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933729" lims:id="933729"><Label>(b)</Label><Text>property tax payable by the distributor. (<DefinedTermFr>montant de remboursement non taxable</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933730" lims:id="933730" generate-in-text="no"><Text><DefinedTermEn>period cost</DefinedTermEn> for a particular period, in respect of a supply to a provincial gaming authority of tangible personal property or real property made by way of lease, means the total of</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933731" lims:id="933731"><Label>(a)</Label><Text>the total of all amounts each of which is the portion of the capital cost of the property to the supplier that is reasonably allocated to a lease interval for which a payment forming part of the consideration for the supply becomes due in the particular period or is paid in the particular period without having become due;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933732" lims:id="933732"><Label>(b)</Label><Text>the total of all amounts each of which is an amount not included in paragraph (a) that is a cost to the supplier that is reasonably attributable to the making of the supply for a lease interval referred to in that paragraph other than, in the case of a supply to which section 16 applies, the portion, if any, of that cost that is deducted from the value of the consideration for the supply in determining under that section the amount deemed to be the tax payable in respect of the supply;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933733" lims:id="933733"><Label>(c)</Label><Text>any capital loss on the disposition of the property by the supplier that is recovered from the authority during the particular period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933734" lims:id="933734"><Label>(d)</Label><Text>an amount that, at any time in the particular period, the supplier recognizes in the supplier’s books of account as an unrecoverable loss, being the amount by which the unamortized capital cost of the property exceeds its fair market value at that time. (<DefinedTermFr>coût imputable</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933735" lims:id="933735" generate-in-text="no"><Text><DefinedTermEn>prize in kind</DefinedTermEn> means property or a service that is given as a prize or winnings in a game of chance. (<DefinedTermFr>prix en nature</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933736" lims:id="933736" generate-in-text="no"><Text><DefinedTermEn>promotional supply</DefinedTermEn>, by a provincial gaming authority, means</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933737" lims:id="933737"><Label>(a)</Label><Text>a supply of property (other than a supply by way of sale of capital property of the authority) made by the authority for no consideration or for nominal consideration; or</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933738" lims:id="933738"><Label>(b)</Label><Text>a supply by way of sale of</Text><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="933739" lims:id="933739"><Label>(i)</Label><Text>a service, or intangible personal property, that was purchased by the authority, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="933740" lims:id="933740"><Label>(ii)</Label><Text>tangible personal property (other than capital property of the authority),</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2011-03-03" lims:fid="933741" lims:id="933741"><Text>made by the authority for consideration that is less than the basic cost to the authority of the property or service. (<DefinedTermFr>fourniture de promotion</DefinedTermFr>)</Text></ContinuedParagraph></Paragraph></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933742" lims:id="933742" generate-in-text="no"><Text><DefinedTermEn>property tax</DefinedTermEn> means a tax imposed by a municipality or other local authority on real property or in respect of the ownership, occupation or use of real property. (<DefinedTermFr>impôt foncier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933743" lims:id="933743" generate-in-text="no"><Text><DefinedTermEn>provincial gaming authority</DefinedTermEn> means a registrant that is prescribed by section 3, other than paragraph 3(g) or (m). (<DefinedTermFr>administration provinciale de jeux et paris</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933744" lims:id="933744" generate-in-text="no"><Text><DefinedTermEn>reimbursement</DefinedTermEn> means an amount of consideration (as defined in subsection 123(1) of the Act) that</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933745" lims:id="933745"><Label>(a)</Label><Text>is paid or payable by a provincial gaming authority to a distributor of the authority as an allowance or reimbursement in respect of an expense incurred or to be incurred by the distributor otherwise than as an agent of the authority; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933746" lims:id="933746"><Label>(b)</Label><Text>is invoiced or charged to the authority separately from amounts that are not in respect of specific expenses incurred or to be incurred by the distributor. (<DefinedTermFr>montant de remboursement</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2011-03-03" lims:fid="933747" lims:id="933747" generate-in-text="no"><Text><DefinedTermEn>right</DefinedTermEn> of a provincial gaming authority has the meaning assigned by subsection 188.1(1) of the Act. (<DefinedTermFr>droit</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2011-03-03" lims:fid="933748" lims:id="933748"><MarginalNote lims:inforce-start-date="2011-03-03" lims:fid="933749" lims:id="933749">Basic cost</MarginalNote><Label>(2)</Label><Text>For the purposes of this Part, the basic cost to a provincial gaming authority of personal property or a service is equal to</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933750" lims:id="933750"><Label>(a)</Label><Text>in the case of food or a beverage prepared by the authority, the total of all consideration paid or payable by the authority to purchase the food or beverage and the ingredients used in its preparation, to the extent that the consideration is a cost to the authority of the prepared food or beverage;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933751" lims:id="933751"><Label>(b)</Label><Text>in the case of particular tangible personal property (other than food or a beverage) manufactured in whole or in part by or for the authority, the total of all consideration paid or payable by the authority to purchase the following property and services to the extent that the consideration is a cost to the authority of the particular property:</Text><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="933752" lims:id="933752"><Label>(i)</Label><Text>tangible personal property incorporated into or forming a constituent or component part of the particular property,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="933753" lims:id="933753"><Label>(ii)</Label><Text>tangible personal property consumed or expended directly in the process of manufacturing the particular property, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="933754" lims:id="933754"><Label>(iii)</Label><Text>services of manufacturing the particular property in whole or in part;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933755" lims:id="933755"><Label>(c)</Label><Text>in the case of tangible personal property that is purchased by the authority and is not further manufactured by or for the authority, the consideration paid or payable by the authority to purchase the property; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933756" lims:id="933756"><Label>(d)</Label><Text>in the case of intangible personal property or a service, the consideration paid or payable by the authority to purchase the property or service.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-03-03" lims:fid="933757" lims:id="933757"><MarginalNote lims:inforce-start-date="2011-03-03" lims:fid="933758" lims:id="933758">Exclusion from <DefinedTermEn>promotional supply</DefinedTermEn></MarginalNote><Label>(2.1)</Label><Text>Despite the definition <DefinedTermEn>promotional supply</DefinedTermEn> in subsection (1), a supply of a particular property or service made by a provincial gaming authority is not included in that definition if the authority would, in the absence of this subsection, be entitled to include, in determining a total for A<Sub>2</Sub> in subsection 7(7), or a total for B in section 8, all or a portion of an input tax credit in respect of</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933759" lims:id="933759"><Label>(a)</Label><Text>the particular property or service;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933760" lims:id="933760"><Label>(b)</Label><Text>a service of manufacturing the particular property; or</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933761" lims:id="933761"><Label>(c)</Label><Text>other tangible personal property acquired, imported or brought into a participating province by the authority for use as an ingredient in preparing the particular property or for the purpose of being incorporated into, forming a constituent or component part of, or being consumed or expended directly in the process of manufacturing, the particular property.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-03-03" lims:fid="933762" lims:id="933762"><MarginalNote lims:inforce-start-date="2011-03-03" lims:fid="933763" lims:id="933763">Reduction in consideration</MarginalNote><Label>(2.2)</Label><Text>For the purpose of the definition <DefinedTermEn>promotional supply</DefinedTermEn> in subsection (1), if, in making a supply of property or a service, a provincial gaming authority</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933764" lims:id="933764"><Label>(a)</Label><Text>accepts from the recipient of the supply a coupon, a voucher, a receipt, a ticket, a device that, without regard to section 181.2 of the Act, is a gift certificate or any other device that may be exchanged for the property or service or that entitles the recipient to a reduction of, or a discount on, the price of the property or service (the amount of the reduction or discount is in this subsection referred to as the “coupon value”), or</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933765" lims:id="933765"><Label>(b)</Label><Text>applies, as a discount on, or credit against, the price of the property or service, an amount (in this subsection referred to as the “credit value”) that has been credited in favour of the recipient by the authority,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2011-03-03" lims:fid="933766" lims:id="933766"><Text>the consideration for the supply is deemed to be equal to the amount that would, without regard to section 181 of the Act, be the consideration for the supply less the coupon value or credit value, as the case may be.</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2011-03-03" lims:fid="933767" lims:id="933767"><MarginalNote lims:inforce-start-date="2011-03-03" lims:fid="933768" lims:id="933768">Exception</MarginalNote><Label>(2.3)</Label><Text>Subsection (2.2) does not apply in respect of a supply of property or a service by a provincial gaming authority if</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933769" lims:id="933769"><Label>(a)</Label><Text>subsection 181(2) of the Act applies in respect of the supply;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933770" lims:id="933770"><Label>(b)</Label><Text>the consideration for the supply is reduced in circumstances in which subsection 232(2) of the Act applies; or</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="933771" lims:id="933771"><Label>(c)</Label><Text>the property or service is given in exchange, or the reduction, discount or credit is provided, in lieu of refunding or reducing all or part of the consideration for a non-gaming supply by the authority of another property or service.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-03-03" lims:fid="933772" lims:id="933772"><MarginalNote lims:inforce-start-date="2011-03-03" lims:fid="933773" lims:id="933773">Accepting and making a bet</MarginalNote><Label>(3)</Label><Text>For the purposes of this Part, the sale of a right to play or participate in a game of chance conducted by a provincial gaming authority to a person other than a distributor of the authority is deemed to be a supply of a service of accepting a bet on the game in an amount equal to the selling price of the right, and the purchase of the right is deemed to be the betting of that amount on the game.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-03-03" lims:id="933846"><Label>(b)</Label><Text>an amount of tax that the authority is deemed to have collected during the period under subsection 206(5) of the Act,</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933847" lims:id="933847"><Label>(b.1)</Label><Text>an amount (other than an amount described in subparagraph (d)(ii)) of tax in respect of a supply deemed under subsection 143(1) of the Act to have been made outside Canada (other than a supply described in subsection 178.8(2) of the Act) that would have become payable by the authority during the particular period if the supply had been made in Canada by a registrant,</Text></FormulaParagraph><FormulaParagraph lims:id="933853"><Label>(ii)</Label><Text>a reimbursement of the cost to the distributor of a right to play or participate in a game of chance given away free of charge by the distributor,</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933854" lims:id="933854"><Label>(iii)</Label><Text>a reimbursement of salaries, wages or other remuneration paid or payable by the distributor to an employee of the distributor to the extent that that remuneration is a cost to the distributor of supplying a casino operating service to the authority, or</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933855" lims:id="933855"><Label>(iv)</Label><Text>a reimbursement of an expense incurred by the distributor in the course of supplying a service referred to in subparagraph 188.1(4)(a)(iii) of the Act, and</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:id="933857"><Label>(i)</Label><Text>if the reimbursement is in respect of a supply made by the distributor to the authority in a participating province, the total of the rate set out in subsection 165(1) of the Act and the tax rate for that province, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933858" lims:id="933858"><Label>(ii)</Label><Text>in any other case, the rate set out in subsection 165(1) of the Act, and</Text></FormulaParagraph></FormulaDefinition></FormulaGroup></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933859" lims:id="933859"><Label>(d)</Label><Text>twice the value of all amounts each of which is</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933860" lims:id="933860"><Label>(i)</Label><Text>an amount that, but for subsection 156(2) or 167(1.1) of the Act, would have become payable by the authority during the particular period as tax under Division II of Part IX of the Act in respect of a supply made to the authority,</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933861" lims:id="933861"><Label>(ii)</Label><Text>an amount that would have become payable by the authority during the particular period as tax under Division IV or IV.1 of Part IX of the Act if the authority’s gaming activities were not commercial activities,</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933862" lims:id="933862"><Label>(iii)</Label><Text>the amount by which</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933863" lims:id="933863"><Label>(A)</Label><Text>the total of all amounts each of which is tax that would have become payable by the authority during the particular period under Division II of Part IX of the Act in respect of a supply (other than a supply referred to in subparagraph (iv) or (v)) made to the authority that is a taxable supply of property or a service for consideration less than fair market value, or an exempt supply by way of lease of tangible personal property or real property, if the supply had been a taxable supply made for consideration equal to fair market value,</Text></FormulaParagraph><ContinuedFormulaParagraph><Text>exceeds</Text></ContinuedFormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933864" lims:id="933864"><Label>(B)</Label><Text>the total amount of tax under that Division that became payable by the authority during the particular period in respect of supplies included in clause (A),</Text></FormulaParagraph></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933865" lims:id="933865"><Label>(iv)</Label><Text>the amount of tax that would have become payable by the authority during the particular period under Division II of Part IX of the Act in respect of an exempt supply of real property made to the authority by way of lease by a wholly-owned subsidiary of the authority that had acquired the property for consideration equal to fair market value if the supply had been a taxable supply and if the amount of consideration for the supply that had become due in the period or was paid in the period without having become due were equal to the greater of the period cost of the supply for the period and the total of any amounts of consideration for the supply, as otherwise determined for the purposes of Part IX of the Act, that became due in the period or were paid in the period without having become due, or</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933866" lims:id="933866"><Label>(v)</Label><Text>the amount, if any, by which</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933867" lims:id="933867"><Label>(A)</Label><Text>the amount of tax that would have become payable by the authority during the particular period under Division II of Part IX of the Act in respect of a taxable supply of property made to the authority by way of lease by a wholly-owned subsidiary of the authority that had acquired the property for consideration equal to fair market value if consideration for the supply, equal to the period cost of the supply for the period, became due in the period and if that were the only consideration for the supply that became due in the period or was paid in the period without having become due,</Text></FormulaParagraph><ContinuedFormulaParagraph><Text>exceeds</Text></ContinuedFormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933868" lims:id="933868"><Label>(B)</Label><Text>the total amount of tax under that Division that became payable by the authority during the particular period in respect of the supply, and</Text></FormulaParagraph></FormulaParagraph></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933869" lims:id="933869"><FormulaTerm>A<Sub>2</Sub></FormulaTerm><Text>is the total of all amounts each of which is determined by the formula</Text><FormulaGroup lims:inforce-start-date="2017-02-28" lims:fid="933870" lims:id="933870"><Formula lims:inforce-start-date="2017-02-28" lims:fid="933871" lims:id="933871"><FormulaText>A<Sub>5</Sub> × A<Sub>6</Sub></FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933872" lims:id="933872"><FormulaTerm>A<Sub>5</Sub></FormulaTerm><Text>is</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933873" lims:id="933873"><Label>(a)</Label><Text>an input tax credit of the authority for the particular period that is in respect of an amount included under paragraph (a), or</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933874" lims:id="933874"><Label>(b)</Label><Text>twice the value of an imputed input tax credit of the authority for the particular period that is in respect of an amount included under any of subparagraphs (d)(i) to (iii), of the description of A<Sub>1</Sub> in determining the total for A<Sub>1</Sub> for the particular period, and</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933875" lims:id="933875"><FormulaTerm>A<Sub>6</Sub></FormulaTerm><Text>is the extent (expressed as a percentage) to which the authority is, subject to section 9, entitled to include the input tax credit or imputed input tax credit, as the case may be, in determining this total for the particular period;</Text></FormulaDefinition></FormulaGroup></FormulaDefinition></FormulaGroup></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933876" lims:id="933876"><FormulaTerm>B</FormulaTerm><Text>is the total of all amounts each of which is an amount of tax that would have become payable by the authority during the particular period in respect of consideration for a supply of a casino operating service made to the authority by a distributor of the authority if subsection 188.1(4) of the Act did not apply to the supply and the consideration lims:fid="933883" lims:id="933883"><FormulaTerm>B<Sub>4</Sub></FormulaTerm><Text>is a particular amount of salaries, wages or other remuneration (other than an amount described in the description of B<Sub>6</Sub>) paid or payable by the distributor, or by a person (in this description and in the description of B<Sub>6</Sub> referred to as the “distributor’s subsidiary”) that is a wholly-owned subsidiary of the distributor, to an employee of the distributor or of the distributor’s subsidiary, and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933884" lims:id="933884"><FormulaTerm>B<Sub>5</Sub></FormulaTerm><Text>is the extent (expressed as a percentage) to which the particular amount is</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933885" lims:id="933885"><Label>(i)</Label><Text>a cost to the distributor of supplying the casino operating service to the authority, or</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933886" lims:id="933886"><Label>(ii)</Label><Text>a cost to the authority of the management, administration and carrying on of the day-to-day operations of the authority’s gaming activities that are connected with a casino of the authority, and</Text></FormulaParagraph></FormulaDefinition></FormulaGroup></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933887" lims:id="933887"><FormulaTerm>B<Sub>3</Sub></FormulaTerm><Text>is the total of all amounts each of which is determined by the formula</Text><FormulaGroup lims:inforce-start-date="2017-02-28" lims:fid="933888" lims:id="933888"><Formula lims:inforce-start-date="2017-02-28" lims:fid="933889" lims:id="933889"><FormulaText>B<Sub>6</Sub> × B<Sub>7</Sub></FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933890" lims:id="933890"><FormulaTerm>B<Sub>6</Sub></FormulaTerm><Text>is a particular amount that is paid by, or is in respect of a supply of property or a service made by, the distributor or the distributor’s subsidiary to an employee of the distributor or of the distributor’s subsidiary or to a person related to such an employee, and that the employee is required under section 6 of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> to include in computing the employee’s income for a taxation year of the employee, and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933891" lims:id="933891"><FormulaTerm>B<Sub>7</Sub></FormulaTerm><Text>is the extent (expressed as a percentage) to which the particular amount is</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933892" lims:id="933892"><Label>(i)</Label><Text>a cost to the distributor of supplying the casino operating service to the authority, or</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933893" lims:id="933893"><Label>(ii)</Label><Text>a cost to the authority of the management, administration and carrying on of the day-to-day operations of the authority’s gaming activities that are connected with a casino of the authority;</Text></FormulaParagraph></FormulaDefinition></FormulaGroup></FormulaDefinition></FormulaGroup></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933894" lims:id="933894"><FormulaTerm>C</FormulaTerm><Text>is the total of all amounts each of which is an amount determined by the formula</Text><FormulaGroup lims:inforce-start-date="2017-02-28" lims:fid="933895" lims:id="933895"><Formula lims:inforce-start-date="2017-02-28" lims:fid="933896" lims:id="933896"><FormulaText>C<Sub>1</Sub> × C<Sub>2</Sub></FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933897" lims:id="933897"><FormulaTerm>C<Sub>1</Sub></FormulaTerm><Text>is the total of all amounts each of which is an amount that, in the absence of subsection 188.1(4) of the Act, would be consideration (other than charitable proceeds from Superstar Bingo) for a supply (other than a supply of a casino operating service) by a distributor of the authority to the authority or would be a reimbursement paid or payable by the authority to a distributor of the authority (other than a reimbursement that is a non-gaming reimbursement, a non-taxable reimbursement, a reimbursement of the cost to the distributor of a right to play or participate in a game of chance given away free of charge by the distributor or a reimbursement of salaries, wages or other remuneration paid or payable by the distributor to an employee of the distributor to the extent that that remuneration is a cost to the distributor of supplying a casino operating service to the authority), where</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933898" lims:id="933898"><Label>(a)</Label><Text>if the amount represents a commission in respect of the sale, by the distributor on behalf of the authority, of a right to play or participate in a game of chance (other than an instant win game), it became ascertainable in the particular period whether a prize or winnings were payable in respect of the right, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933899" lims:id="933899"><Label>(b)</Label><Text>in any other case, the amount became due to the distributor during the particular period or was paid to the distributor during the particular period without having become due, and</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933900" lims:id="933900"><FormulaTerm>C<Sub>2</Sub></FormulaTerm><Text>is</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933901" lims:id="933901"><Label>(a)</Label><Text>if the particular supply by the distributor to the authority relates to the making of supplies of rights of the authority in a participating province, the total of the rate set out in subsection 165(1) of the Act and the tax rate for that province, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933902" lims:id="933902"><Label>(b)</Label><Text>in any other case, the rate set out in subsection 165(1) of the Act;</Text></FormulaParagraph></FormulaDefinition></FormulaGroup></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933903" lims:id="933905"><FormulaText>(D<Sub>1</Sub> - D<Sub>2</Sub>) × D<Sub>3</Sub></FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933906" lims:id="933906"><FormulaTerm>D<Sub>1</Sub></FormulaTerm><Text>is the amount by which</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933907" lims:id="933907"><Label>(a)</Label><Text>the total face value of all rights of the authority evidenced by tickets, cards or other printed devices that were acquired by the distributor from the authority for the purpose of supply on the distributor’s own behalf otherwise than as prizes in kind and</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933908" lims:id="933908"><Label>(i)</Label><Text>in the case of instant win tickets, the consideration for the supplies of which by the authority to the distributor became due during the particular period or was paid during the particular period without having become due, or</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933909" lims:id="933909"><Label>(ii)</Label><Text>in any other case, in respect of which it became ascertainable in the particular period whether amounts were payable as prizes or winnings</Text></FormulaParagraph></FormulaParagraph><ContinuedFormulaParagraph><Text>exceeds</Text></ContinuedFormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933910" lims:id="933910"><Label>(b)</Label><Text>the total amount paid or payable for the supplies referred to in paragraph (a) made by the authority to the distributor,</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933911" lims:id="933911"><FormulaTerm>D<Sub>2</Sub></FormulaTerm><Text>is the amount by which</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933912" lims:id="933912"><Label>(a)</Label><Text>the total face value of all rights of the authority evidenced by tickets, cards or other printed devices that were supplied to the distributor by the authority, the face value of which is included in determining the value for D<Sub>1</Sub> for the particular period or a preceding reporting period of the authority and that are returned by the distributor to the authority during the particular period</Text></FormulaParagraph><ContinuedFormulaParagraph><Text>exceeds</Text></ContinuedFormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933913" lims:id="933913"><Label>(b)</Label><Text>the total amount paid or payable for the supplies referred to in paragraph (a) made by the authority to the distributor, and</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933914" lims:id="933914"><FormulaTerm>D<Sub>3</Sub></FormulaTerm><Text>is</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933915" lims:id="933915"><Label>(a)</Label><Text>if the distributor acquired the devices for the purpose of supplying them in a participating province, the total of the rate set out in subsection 165(1) of the Act and the tax rate for that province, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933916" lims:id="933916"><Label>(b)</Label><Text>in any other case, the rate set out in subsection 165(1) of the Act; and</Text></FormulaParagraph></FormulaDefinition></FormulaGroup></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933917" lims:id="933917"><FormulaTerm>E</FormulaTerm><Text>is</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933918" lims:id="933918"><Label>(a)</Label><Text>if the particular period includes the last day of February in a calendar year, the total of all amounts, if any, each of which is determined by the formula</Text><FormulaGroup lims:inforce-start-date="2017-02-28" lims:fid="933919" lims:id="933919"><Formula lims:inforce-start-date="2017-02-28" lims:fid="933920" lims:id="933920"><FormulaText>E<Sub>1</Sub> × (100% - E<Sub>2</Sub>) × E<Sub>3</Sub></FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933921" lims:id="933921"><FormulaTerm>E<Sub>1</Sub></FormulaTerm><Text>is an amount (in this paragraph referred to as the “benefit amount”)</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933922" lims:id="933922"><Label>(i)</Label><Text>that</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933923" lims:id="933923"><Label>(A)</Label><Text>was paid by the authority, or</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933924" lims:id="933924"><Label>(B)</Label><Text>is in respect of a supply of property or a service (other than property or a service in respect of which the authority was not entitled to claim an input tax credit because of subsection 170(1) of the Act) made by the authority to an individual who was an employee of the authority during the previous calendar year or to a person related to the individual, and</Text></FormulaParagraph></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933925" lims:id="933925"><Label>(ii)</Label><Text>that the individual is required under section 6 of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> to include in computing the individual’s income for that previous calendar year,</Text></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933926" lims:id="933926"><FormulaTerm>E<Sub>2</Sub></FormulaTerm><Text>is the extent (expressed as a percentage) to which the benefit amount is a cost to the authority of making non-gaming supplies other than the supply referred to in clause (i)(B) of the description of E<Sub>1</Sub>, and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2017-02-28" lims:fid="933927" lims:id="933927"><FormulaTerm>E<Sub>3</Sub></FormulaTerm><Text>is</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933928" lims:id="933928"><Label>(i)</Label><Text>where the benefit amount is required under paragraph 6(1)(k) or (l) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> to be included in computing the individual’s income,</Text><FormulaParagraph lims:inforce-start-date="2017-02-28" lims:fid="933929" lims:id="933929"><Label>(A)</Label><Text>if the last establishment of the authority at which the individual ordinarily worked or to which the individual ordinarily reported in the previous calendar year in relation to the individual’s office or employment with the authority is located in</Text><FormulaParagraph lims:inforce-start-date="2026-02-28" lims:enacted-date="2025-03-06" lims:fid="933930" lims:id="1557424"><Label>(I)</Label><Text>Ontario, the percentage referred to in paragraph 2(a) of the <XRefExternal reference-type="regulation" link="SOR-99-176">Automobile Operating Expense Benefit (GST/HST) Regulations</XRefExternal>,</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2026-02-28" lims:enacted-date="2025-03-06" lims:fid="933931" lims:id="1557425"><Label>(II)</Label><Text>Nova Scotia, the percentage referred to in paragraph 2(a.1) of the <XRefExternal reference-type="regulation" link="SOR-99-176">Automobile Operating Expense authority, in making promotional supplies or in making supplies of financial services that relate to gaming activities of the authority;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933975" lims:id="933975"><Label>(b)</Label><Text>was acquired or imported, or brought into a participating province, by the authority for the purpose of making a supply of the property or service that is a promotional supply;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933976" lims:id="933976"><Label>(c)</Label><Text>is tangible personal property that was acquired or imported, or brought into a participating province, by the authority for use as an ingredient in preparing food or beverages the supply of which by the authority is a promotional supply;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933977" lims:id="933977"><Label>(d)</Label><Text>is tangible personal property that was acquired or imported, or brought into a participating province, by the authority for the purpose of being incorporated into or forming a constituent or component part of, or being consumed or expended directly in the process of manufacturing, particular tangible personal property (other than food or beverages) that the authority manufactures or engages another person to manufacture for the purpose of making a supply of the particular property that is a promotional supply; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933978" lims:id="933978"><Label>(e)</Label><Text>is a service that is the manufacturing for the authority of tangible personal property (other than food or beverages) and that the authority acquires for the purpose of making a supply of the property that is a promotional supply.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-09-20" lims:fid="933979" lims:id="933979"><MarginalNote lims:inforce-start-date="2012-09-20" lims:fid="933980" lims:id="933980">Use of capital property</MarginalNote><Label>(2)</Label><Text>For the purposes of applying section 193 of the Act and the provisions of Subdivision d of Division II of Part IX of the Act in determining the net tax of a provincial gaming authority, the following rules apply:</Text><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933981" lims:id="933981"><Label>(a)</Label><Text>subsections 141(1) to (4), 193(2), 199(2) to (4) and 200(2) and (3) of the Act do not apply to the authority;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933982" lims:id="933982"><Label>(b)</Label><Text>subsection 193(1) of the Act applies, with such modifications as the circumstances require, to all property (other than a passenger vehicle) acquired or imported by the authority for use as capital property of the authority as if the authority were not a public sector body and, in the case of personal property, the property acquired or imported by the authority for that use were real property;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933983" lims:id="933983"><Label>(c)</Label><Text>subsections 206(2) to (5) of the Act apply, with such modifications as the circumstances require, to personal property acquired or imported by the authority for use as capital property of the authority, and to improvements to personal property that is capital property of the authority, as if the personal property were real property and the references in those subsections to “acquired” were references to “acquired or imported”;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933984" lims:id="933984"><Label>(d)</Label><Text>where the authority acquires or imports property for use as capital property of the authority in commercial activities of the authority, the authority is deemed to have acquired or imported the property for use in the authority’s commercial activities only to the extent to which the property was acquired or imported for use in the authority’s non-gaming activities; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933985" lims:id="933985"><Label>(e)</Label><Text>where the authority uses property as capital property of the authority in commercial activities of the authority, that use is deemed to be use in the authority’s commercial activities only to the extent to which the property is used in the authority’s non-gaming activities.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-09-20" lims:fid="933986" lims:id="933986"><MarginalNote lims:inforce-start-date="2012-09-20" lims:fid="933987" lims:id="933987">Double counting</MarginalNote><Label>(3)</Label><Text>An amount shall not be included in determining a total for A in subsection 7(1) or section 8 for a reporting period of a provincial gaming authority to the extent that that amount was included in that total for a preceding reporting period of the authority.</Text></Subsection><Subsection lims:inforce-start-date="2012-09-20" lims:fid="933988" lims:id="933988"><MarginalNote lims:inforce-start-date="2012-09-20" lims:fid="933989" lims:id="933989">Restriction</MarginalNote><Label>(4)</Label><Text>An amount shall not be included in determining a total for B in section 8 for a particular reporting period of a provincial gaming authority to the extent that that amount was claimed or included in that total in determining the net tax for a preceding reporting period of the authority unless</Text><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933990" lims:id="933990"><Label>(a)</Label><Text>the authority was not entitled to claim the amount in determining the net tax for that preceding period only because the authority did not satisfy the requirements of subsection 169(4) of the Act in respect of the amount before the return for that preceding period was filed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-09-20" lims:fid="933991" lims:id="933991"><Label>(b)</Label><Text>where the authority is claiming the amount in a return for the particular reporting period and the Minister has not disallowed the amount as an input tax credit in assessing the net tax of the authority for that preceding reporting period,</Text><Subparagraph lims:inforce-start-date="2012-09-20" lims:fid="933992" lims:id="933992"><Label>(i)</Label><Text>the authority reports in writing to the Minister, at or before the time the return for the particular reporting period is filed, that the authority made an error in claiming that amount in determining the net tax of the authority for that preceding period, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-09-20" lims:fid="933993" lims:id="933993"><Label>(ii)</Label><Text>where the authority does not report the error to the Minister at least three months before the end of the period after which an assessment of the net tax of the authority for that preceding period cannot, because of subsection 298(1) of the Act, be made, the authority pays, at or before the time the return for the particular reporting period is filed, the amount and any applicable penalty and interest to the Receiver General.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-09-20" lims:fid="933994" lims:id="933994"><MarginalNote lims:inforce-start-date="2012-09-20" lims:fid="933995" lims:id="933995">Amounts refunded or remitted</MarginalNote><Label>(5)</Label><Text>An amount shall not be included in determining a total for B in section 8 for a reporting period of a provincial gaming authority to the extent that, before the end of the period, the amount was rebated, refunded or remitted to the authority under any Act of Parliament.</Text></Subsection><Subsection lims:inforce-start-date="2012-09-20" lims:fid="933996" lims:id="933996"><MarginalNote lims:inforce-start-date="2012-09-20" lims:fid="933997" lims:id="933997">Application</MarginalNote><Label>(6)</Label><Text>Sections 231 to 236.01 of the Act do not apply for the purpose of determining the net tax of a provincial gaming authority except as otherwise provided in this Part.</Text></Subsection><Subsection proceeds from the game that are paid, at any time, to the authority, for the purpose of paragraph (a.1) of the description of A<Sub>1</Sub> in subsection 7(7), the imputed tax payable by the authority in respect of those expenses for the reporting period of the authority that includes that time is the amount determined by the formula</Text><FormulaGroup lims:inforce-start-date="2011-03-03" Corporation, (in this section referred to as the “reporting authority”) is a distributor of another provincial gaming authority in relation to a game of chance conducted by or on behalf of the other authority,</Text><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="934058" lims:id="934058"><Label>(a)</Label><Text>in applying subsection 7(7) and sections 8 and 9 of these Regulations and Part IX of the Act in determining the imputed tax payable on gaming expenses and the input tax credits of the reporting authority and of the other authority, any amount paid or payable by the reporting authority on behalf of the other authority in respect of the acquisition or importation, or bringing into a participating province, of property or a service for consumption, use or supply in relation to the conduct of the game is to be taken into account as if</Text><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="934059" lims:id="934059"><Label>(i)</Label><Text>the game were conducted by the reporting authority as part of the gaming activities of the reporting authority and not of the other authority,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="934060" lims:id="934060"><Label>(ii)</Label><Text>the property or service were acquired or imported, or brought into the participating province, and the amount were paid or payable, by the reporting authority on its own account and not by the other authority,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="934061" lims:id="934061"><Label>(iii)</Label><Text>the rights to play or participate in the game were rights of the reporting authority and not of the other authority, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-03-03" lims:fid="934062" lims:id="934062"><Label>(iv)</Label><Text>persons, other than the reporting authority, acting as distributors of the other authority in relation to the game were distributors of the reporting authority, and not of the other authority, in relation to the game;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="934063" lims:id="934063"><Label>(b)</Label><Text>no amount that would, but for subsection 188.1(4) of the Act, be consideration for a supply by the reporting authority to the other authority in relation to the game is to be included in the total for C<Sub>1</Sub> in subsection 7(7); and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-03-03" lims:fid="934064" lims:id="934064"><Label>(c)</Label><Text>no amount of a reimbursement paid or payable by the other authority to the reporting authority in respect of an expense incurred or to be incurred by the reporting authority that is attributable to the game is to be included in the amount determined for A<Sub>3</Sub> or C<Sub>1</Sub> in subsection                     — SOR/98-440, s. 7</TitleText></Heading><Section><Label>7</Label><Subsection><Label>(1)</Label><Text>Sections 1 and 3, paragraphs 3(g), (h) and (m) of the Regulations, as enacted by subsection 4(2), section 5 and subsection 6(1) are deemed to have come into force on December 31, 1990, except that</Text><Paragraph><Label>(a)</Label><Text>in relation to games of chance any right to play or participate in which was supplied for consideration that became due or was paid before 1997, section 4 of the Regulations, as enacted by section 5, shall be read as follows:</Text><ReadAsText><Section><Label>4</Label><Text>A game of chance conducted by a person referred to in section 3 is a prescribed game of chance for the purposes of section 5.1 of Part VI of Schedule V to the Act.</Text></Section></ReadAsText></Paragraph><ContinuedSectionSubsection><Text>and</Text></ContinuedSectionSubsection><Paragraph><Label>(b)</Label><Text>subsection 9(1) of the Regulations, as enacted by subsection 6(1), shall be read without reference to “or an imputed input tax credit” for the purpose of determining the net tax of a provincial gaming authority for reporting periods beginning before January 30, 1998.</Text></Paragraph></Subsection><Subsection><Label>(2)</Label><Text>Section 2 and subsections 6(3) to (6), (8), (10), (11) and (16) are deemed to have come into force on April 1, 1997.</Text></Subsection><Subsection><Label>(3)</Label><Text>Subsection 4(1) is deemed to have come into force on July 27, 1993.</Text></Subsection><Subsection><Label>(4)</Label><Text>Paragraph 3(i) of the Regulations, as enacted by subsection 4(2), is deemed to have come into force on July 1, 1993.</Text></Subsection><Subsection><Label>(5)</Label><Text>Paragraph 3(j) of the Regulations, as enacted by subsection 4(2), is deemed to have come into force on June 2, 1994.</Text></Subsection><Subsection><Label>(6)</Label><Text>Paragraph 3(k) of the Regulations, as enacted by subsection 4(2), is deemed to have come into force on December 2, 1993.</Text></Subsection><Subsection><Label>(7)</Label><Text>Paragraph 3(l) of the Regulations, as enacted by subsection 4(2), is deemed to have come into force on February 15, 1995.</Text></Subsection><Subsection><Label>(8)</Label><Text>Subsection 4(3) is deemed to have come into force on July 15, 1996.</Text></Subsection><Subsection><Label>(9)</Label><Text>Subsections 6(2), (7), (9) and (15) are deemed to have come into force on January 30, 1998 and apply for the purpose of determining the net tax of provincial gaming authorities for reporting periods beginning on or after that day, except that, for the purposes of determining the net tax of provincial gaming authorities for reporting periods beginning before the day these Regulations are published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal>, clause (d)(iii)(A) of the description of A<Sub>1</Sub> in subsection 7(7) of the Regulations, as enacted by subsection 6(7), shall be read as follows:</Text><ReadAsText><SectionPiece><Clause><Label>(A)</Label><Text>the total of all amounts each of which is tax that would have become payable by the authority during the particular period under Division II of Part IX of the Act in respect of an exempt supply of real property made to the authority by way of lease, or a taxable supply of real property made to the authority by way of lease at less than fair market value, if the supply were a taxable supply made at fair market value, or, if section 16 applies to the supply, at the amount determined by the formula in that section,</Text></Clause></SectionPiece></ReadAsText></Subsection><Subsection><Label>(10)</Label><Text>Subsection 6(12) applies to the 1996 and subsequent taxation years.</Text></Subsection><Subsection><Label>(11)</Label><Text>Subsection 6(13) applies to the 1996 taxation year.</Text></Subsection><Subsection><Label>(12)</Label><Text>Subsection 6(14) applies to the 1997 and subsequent taxation years except that, in applying the description of E<Sub>3</Sub> in subsection 7(7) of the Regulations, as enacted by subsection 6(14), to the 1997 taxation year, the reference in clause (i)(A) of that description to “11%” shall be read as a reference to “9.5%” and the reference in subparagraph (ii) of that description to “the tax rate for the participating province” shall be read as a reference to “6%”.</Text></Subsection></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
                    — SOR/2011-56, s. 39</TitleText></Heading><Section><Label>39</Label><Text>For the purposes of Part IX of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal>, if a provincial gaming authority is, or would be in the absence of subsection 261(3) of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal>, entitled to a rebate under subsection 261(1) of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> of the difference between the amount that was paid by the authority, before the day on which these Regulations are published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal>, as imputed tax payable under subsection 7(7) of the <XRefExternal reference-type="regulation" link="SOR-91-28">Games of Chance (GST/HST) Regulations</XRefExternal> on gaming expenses for a reporting period of the authority ending after June 30, 2006 and before January 1, 2008 and the amount of the imputed tax payable by the authority on gaming expenses for that reporting period that is computed under subsection 7(7) of the <XRefExternal reference-type="regulation" link="SOR-91-28">Games of Chance (GST/HST) Regulations</XRefExternal>, as amended by subsections 12(11), (17), (19), (22) and (25), the authority may, despite subsection 261(3) of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal>, file an application, on or before the day that is one year after the day on which these Regulations are published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal>, for a rebate under subsection 261(1) of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> of the portion of that difference that is solely attributable to the enactments under those subsections.</Text></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>

                    — SOR/2025-77, s. 12</TitleText></Heading><Section><Label>12</Label><Text>Section <XRefInternal>1</XRefInternal> applies</Text><Paragraph><Label>(a)</Label><Text>to any supply made after March 2025;</Text></Paragraph><Paragraph><Label>(b)</Label><Text>for the purposes of calculating tax in respect of any supply (other than a supply by way of sale of real property) made before April 2025, but only in respect of the portion of the tax that becomes payable after March 2025 without having been paid before April 2025 or that is paid after March 2025 without having become payable;</Text></Paragraph><Paragraph><Label>(c)</Label><Text>to any supply (other than a supply deemed under Part IX of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> to have been made) by way of sale of real property made before April 2025 if ownership and possession of the property are transferred to the recipient of the supply after March 2025;</Text></Paragraph><Paragraph><Label>(d)</Label><Text>to goods imported into Canada after March 2025;</Text></Paragraph><Paragraph><Label>(e)</Label><Text>to goods imported into Canada before April 2025 that are, after March 2025, accounted for under subsection 32(1), paragraph 32(2)(a) or subsection 32(5) of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal> or released in the circumstances set out in paragraph 32(2)(b) of that Act;</Text></Paragraph><Paragraph><Label>(f)</Label><Text>to property brought into Nova Scotia or the Nova Scotia offshore area after March 2025;</Text></Paragraph><Paragraph><Label>(g)</Label><Text>to property that is brought into Nova Scotia or the Nova Scotia offshore area before April 2025 by a carrier if the property is delivered in Nova Scotia or in the Nova Scotia offshore area to a consignee after March 2025;</Text></Paragraph><Paragraph><Label>(h)</Label><Text>for the purpose of determining the tax rate for Nova Scotia in determining the amount for that province that, under subsection 225.2(2) of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal>, is required to be added to, or may be deducted from, the net tax for a reporting period of a financial institution that ends after March 2025;</Text></Paragraph><Paragraph><Label>(i)</Label><Text>for the purposes of determining the value of E<Sub>4</Sub> in subsection 7(7) of the <XRefExternal reference-type="regulation" link="SOR-91-28">Games of Chance (GST/HST) Regulations</XRefExternal> for any reporting period that ends on or after February 28, 2026, except that in respect of a reporting period that includes February 28, 2026, clause (A) of that E<Sub>4</Sub> is to be read as follows:</Text><ReadAsText><SectionPiece><Clause><Label>(A)</Label><Text>if the benefit amount is required to be included under paragraph 6(1)(a) or (e) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> and the last establishment at which the individual ordinarily worked, or to which the individual ordinarily reported, in the previous calendar year in relation to the individual’s office or employment with the authority is located in a participating province,</Text><Subclause><Label>(I)</Label><Text>if the participating province is Nova Scotia, 13.25%, and</Text></Subclause><Subclause><Label>(II)</Label><Text>in any other case, the total of 4% and the tax rate for the participating province, and</Text></Subclause></Clause></SectionPiece></ReadAsText></Paragraph><Paragraph><Label>(j)</Label><Text>for the purposes of determining or calculating any of the following if none of paragraphs (a) to (i) applies:</Text><Subparagraph><Label>(i)</Label><Text>tax in respect of Nova Scotia or the Nova Scotia offshore area after March 2025,</Text></Subparagraph><Subparagraph><Label>(ii)</Label><Text>tax that is not payable in respect of Nova Scotia or the Nova Scotia offshore area, but that would have been payable after March 2025 in the absence of certain circumstances described in Part IX of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal>, or</Text></Subparagraph><Subparagraph><Label>(iii)</Label><Text>an amount or number, at any time after March 2025, by or in accordance with an algebraic formula that makes reference to the tax rate for a participating province if the amount or number is to be determined or calculated in respect of Nova Scotia or the Nova Scotia offshore area.</Text></Subparagraph></Paragraph></Section></RelatedOrNotInForce><RelatedOrNotInForce><Heading level="5" style="nifrp"><TitleText>
