Health Care Regulations</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="926580" lims:id="926580" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2022-03-28" lims:fid="926581" lims:id="926581"><Label>2</Label><Text>In these Regulations,</Text><Definition lims:inforce-start-date="2018-04-01" lims:fid="926582" lims:id="926582" generate-in-text="no"><Text><DefinedTermEn>adult residential care</DefinedTermEn> means a service provided in a health care facility to meet a type I health need; (<DefinedTermFr>soins institutionnels pour adultes</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926583" lims:id="926583" generate-in-text="no"><Text><DefinedTermEn>Canada service veteran</DefinedTermEn> means a veteran who</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926584" lims:id="926584"><Label>(a)</Label><Text>served</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926585" lims:id="926585"><Label>(i)</Label><Text>on full-time active service, other than service in a theatre of actual war as that expression is defined in subsection 37(8) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>, as a member of the naval, army or air forces of Canada or of similar forces raised in Newfoundland, for a minimum of 365 days during any of the following periods, namely,</Text><Clause lims:inforce-start-date="2018-04-01" lims:fid="926586" lims:id="926586"><Label>(A)</Label><Text>the period beginning on August 4, 1914 and ending on August 31, 1921, and</Text></Clause><Clause lims:inforce-start-date="2018-04-01" lims:fid="926587" lims:id="926587"><Label>(B)</Label><Text>the period beginning on September 1, 1939 and ending on August 15, 1945, or</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926588" lims:id="926588"><Label>(ii)</Label><Text>as a Canadian merchant mariner of World War I or World War II, as described in section 21.1 of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, other than as a merchant navy veteran of World War I or World War II within the meaning of subsection 37(7.3) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>, for a minimum of 365 days during any of the following periods, namely,</Text><Clause lims:inforce-start-date="2018-04-01" lims:fid="926589" lims:id="926589"><Label>(A)</Label><Text>the period beginning on August 4, 1914 and ending on August 31, 1921, and</Text></Clause><Clause lims:inforce-start-date="2018-04-01" lims:fid="926590" lims:id="926590"><Label>(B)</Label><Text>the period beginning on September 1, 1939 and ending on August 15, 1945,</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926591" lims:id="926591"><Label>(b)</Label><Text>is 65 years of age or more, and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926592" lims:id="926592"><Label>(c)</Label><Text>would qualify as a recipient under the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal> but for the fact</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926593" lims:id="926593"><Label>(i)</Label><Text>that the veteran does not meet the requirements of subsection 37(3) or (5) of that Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926594" lims:id="926594"><Label>(ii)</Label><Text>that</Text><Clause lims:inforce-start-date="2018-04-01" lims:fid="926595" lims:id="926595"><Label>(A)</Label><Text>the veteran or the veteran’s spouse or common-law partner is in receipt of payments made under the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal> or under similar legislation of another country, and</Text></Clause><Clause lims:inforce-start-date="2018-04-01" lims:fid="926596" lims:id="926596"><Label>(B)</Label><Text>the veteran does not meet the requirements of subsection 37(3) or (5) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>; (<DefinedTermFr>ancien combattant ayant servi au Canada</DefinedTermFr>)</Text></Clause></Subparagraph></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926597" lims:id="926597" generate-in-text="no"><Text><DefinedTermEn>chronic care</DefinedTermEn> means a service provided in a health care facility to meet a type III health need; (<DefinedTermFr>soins prolongés</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926598" lims:id="926598" generate-in-text="no"><Text><DefinedTermEn>civilian</DefinedTermEn> has the same meaning as in subsection 56(1) of the <XRefExternal reference-type="act" link="C-31">Civilian War-related Benefits Act</XRefExternal>; (<DefinedTermFr>civil</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926599" lims:id="926599" generate-in-text="no"><Text><DefinedTermEn>civilian pensioner</DefinedTermEn> means a person who is entitled to a pension under</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926600" lims:id="926600"><Label>(a)</Label><Text>Parts I to III or VI to X of the <XRefExternal reference-type="act" link="C-31">Civilian War-related Benefits Act</XRefExternal>, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926601" lims:id="926601"><Label>(b)</Label><Text>the <XRefExternal reference-type="regulation">Civilian Government Employees (War) Compensation Order</XRefExternal>; (<DefinedTermFr>pensionné civil</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926602" lims:id="926602" generate-in-text="no"><Text><DefinedTermEn>client</DefinedTermEn> means a</Text><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926603" lims:id="1342829"><Label>(a)</Label><Text>veteran pensioner, income-qualified veteran, overseas service veteran or veteran to whom paragraphs (a) and (b) of the definition <DefinitionRef>Canada service veteran</DefinitionRef> apply,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926604" lims:id="926604"><Label>(b)</Label><Text>civilian pensioner, income-qualified civilian or civilian,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926605" lims:id="926605"><Label>(c)</Label><Text>Newfoundland Special Award pensioner,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926606" lims:id="926606"><Label>(d)</Label><Text>military service pensioner,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926607" lims:id="926607"><Label>(e)</Label><Text>Red Cross pensioner,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926608" lims:id="926608"><Label>(f)</Label><Text>flying accident pensioner,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926609" lims:id="926609"><Label>(g)</Label><Text>special duty service pensioner,</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926610" lims:id="1342832"><Label>(h)</Label><Text>prisoner of war entitled to basic compensation under subsection 71.2(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926611" lims:id="1342833"><Label>(i)</Label><Text>veteran described in paragraph (h) of the definition <DefinedTermEn>veteran</DefinedTermEn>,</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="926612" lims:id="1121939"><Label>(j)</Label><Text>former member or reserve force member who is entitled to a disability award or entitled to pain and suffering compensation, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926613" lims:id="926613"><Label>(k)</Label><Text>former member or reserve force member who has received a detention benefit under Part 3 of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>; (<DefinedTermFr>client</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926614" lims:id="926614" generate-in-text="no"><Text><DefinedTermEn>common-law partner</DefinedTermEn>, in relation to an individual, means a person who is cohabiting with the individual at the relevant time in a conjugal relationship, having so cohabited for a period of at least one year. For greater certainty,</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926615" lims:id="926615"><Label>(a)</Label><Text>in the case of an individual’s death, the <DefinedTermEn>relevant time</DefinedTermEn> means the time of that death, and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926616" lims:id="926616"><Label>(b)</Label><Text>common-law partners cease to be common-law partners when they cease to cohabit except if it is by reason only of the placement of one of the partners in a health care facility; (<DefinedTermFr>conjoint de fait</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926617" lims:id="926617" generate-in-text="no"><Text><DefinedTermEn>community facility</DefinedTermEn> means a health care facility in Canada that is approved by the Minister and provides accommodation and meals and adult residential care, intermediate care or chronic care; (<DefinedTermFr>établissement communautaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926618" lims:id="926618" generate-in-text="no"><Text><DefinedTermEn>contract bed</DefinedTermEn> means a bed that is set aside in a community facility pursuant to a contractual arrangement entered into by the Minister for the adult residential care, intermediate care or chronic care of certain veterans; (<DefinedTermFr>lit réservé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926619" lims:id="926619" generate-in-text="no"><Text><DefinedTermEn>departmental facility</DefinedTermEn><Repealed>[Repealed, SOR/2016-31, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926620" lims:id="1342828"><Text><DefinedTermEn>dual service veteran</DefinedTermEn><Repealed>[Repealed, SOR/2022-69, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="926621" lims:id="1121909"><Text><DefinedTermEn>entitled to a disability award</DefinedTermEn> means, in respect of a member or former member, that the member or former member</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121910" lims:id="1121910"><Label>(a)</Label><Text>has received a <DefinitionRef>disability award</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="1121911" lims:id="1342830"><Label>(b)</Label><Text>has not received a <DefinitionRef>disability award</DefinitionRef> as defined in subsection 2(1) of that Act because one of the conditions set out in section 53 of that Act as it read immediately before April 1, 2019 had not been met as of that day, unless a decision regarding the application for pain and suffering compensation referred to in subsection 174(1) of the <XRefExternal reference-type="act" link="B-9.8592">Budget Implementation Act, 2018, No. 1</XRefExternal> has been made, or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121912" lims:id="1121912"><Label>(c)</Label><Text>but for subsection 54(1) of that Act as it read immediately before April 1, 2019, would have received a <DefinitionRef>disability award</DefinitionRef> as defined in subsection 2(1) of that Act; (<DefinedTermFr>droit à une indemnité the member or former member is entitled to a disability award or entitled to pain and suffering compensation is attributable to or was incurred during <DefinitionRef>special duty service</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>; (<DefinedTermFr>droit à une indemnité d’invalidité ou à une indemnité pour douleur et souffrance en raison du service spécial</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926626" lims:id="926626" generate-in-text="no"><Text><DefinedTermEn>entitled to a pension</DefinedTermEn> means, in respect of a person, that the person receives a pension, has received a final payment of a pension or has been declared eligible for a pension; (<DefinedTermFr>droit à une pension</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121923" lims:id="1121923"><Text><DefinedTermEn>entitled to pain and suffering compensation</DefinedTermEn> means, in respect of a member or former member, that the member or former member</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121924" lims:id="1121924"><Label>(a)</Label><Text>has received pain and suffering compensation under subsection 45(1) or 47(1) of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121925" lims:id="1121925"><Label>(b)</Label><Text>is referred to in subsection 45(1) of that Act but whose extent of disability has not yet been assessed, or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121926" lims:id="1121926"><Label>(c)</Label><Text>but for subsection 56.4(1) of that Act, would have received pain and suffering compensation under subsection 45(1) or 47(1) of that Act; (<DefinedTermFr>droit à une indemnité pour douleur et not include</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926629" lims:id="926629"><Label>(a)</Label><Text>periods of absence without leave or leave of absence without pay,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926630" lims:id="926630"><Label>(b)</Label><Text>periods in respect of which pay is forfeited, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926631" lims:id="926631"><Label>(c)</Label><Text>time served in prison or other detention; (<DefinedTermFr>service actif à temps plein</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926632" lims:id="926632" generate-in-text="no"><Text><DefinedTermEn>health</DefinedTermEn> means a state of physical, mental and social well-being; (<DefinedTermFr>santé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926633" lims:id="926633" generate-in-text="no"><Text><DefinedTermEn>health professional</DefinedTermEn> means a physician, dentist, nurse or other health care practitioner approved by the Minister; (<DefinedTermFr>professionnel de la santé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926634" lims:id="926634" generate-in-text="no"><Text><DefinedTermEn>income-qualified civilian</DefinedTermEn> means a civilian who is in receipt of an allowance under subsection 57(1) of the <XRefExternal reference-type="act" link="C-31">Civilian War-related Benefits Act</XRefExternal> or in respect of whom a determination has been made that the civilian would be eligible for such an allowance if the civilian or their spouse or common-law partner were not in receipt of, or eligible to receive, payments under the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal> or similar legislation of another country; (<DefinedTermFr>civil au revenu admissible</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926635" lims:id="926635" generate-in-text="no"><Text><DefinedTermEn>income-qualified overseas service civilian</DefinedTermEn> means an overseas service civilian who is an income-qualified civilian; (<DefinedTermFr>civil au revenu admissible ayant servi outre-mer</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926636" lims:id="926636" generate-in-text="no"><Text><DefinedTermEn>income-qualified veteran</DefinedTermEn> means a veteran referred to in any of paragraphs (a) to (g) of the definition <DefinedTermEn>veteran</DefinedTermEn> who is in receipt of an allowance under the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal> or in respect of whom a determination has been made that the veteran would be eligible for such an allowance if the veteran or their spouse or common-law partner were not in receipt of, or eligible to receive, payments under the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal> or similar legislation of another country; (<DefinedTermFr>ancien combattant au revenu admissible</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926637" lims:id="926637" generate-in-text="no"><Text><DefinedTermEn>intermediate care</DefinedTermEn> means a service provided in a health care facility lims:fid="926639" lims:id="926639" generate-in-text="no"><Text><DefinedTermEn>military service pensioner</DefinedTermEn> means a former member or reserve force member who is entitled to a pension under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> for a disability related to military service that was not</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926640" lims:id="926640"><Label>(a)</Label><Text>active service in World War I or World War II,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926641" Act</XRefExternal>, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926642" lims:id="926642"><Label>(c)</Label><Text>special duty service, as defined in subsection 3(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>; (<DefinedTermFr>pensionné du service militaire</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926643" lims:id="926643" generate-in-text="no"><Text><DefinedTermEn>Newfoundland Special Award pensioner</DefinedTermEn> means a person who was not entitled to a pension in accordance with the terms of the union of Canada and Newfoundland but was recognized by the Canadian government as entitled to the continuation of an award paid before that union in respect of a disability incurred during service in World War I or World War II; (<DefinedTermFr>pensionné titulaire d’une attribution spéciale (Terre-Neuve)</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926644" lims:id="926644" generate-in-text="no"><Text><DefinedTermEn>overseas service civilian</DefinedTermEn> means a civilian described in paragraph (e), (f), (g), (h) or (i) of the definition <DefinedTermEn>civilian</DefinedTermEn> in subsection 56(1) of the <XRefExternal reference-type="act" link="C-31">Civilian War-related Benefits Act</XRefExternal>; (<DefinedTermFr>civil ayant servi outre-mer</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926645" lims:id="926645" generate-in-text="no"><Text><DefinedTermEn>overseas service veteran</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926646" lims:id="926646"><Label>(a)</Label><Text>in respect of Parts I and III, a veteran referred to in any of paragraphs (a) to (g) of the definition <DefinitionRef>veteran</DefinitionRef> who, before April 1, 1946, served during World War I or World War II,</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926647" lims:id="926647"><Label>(i)</Label><Text>in a theatre of actual war, as that expression is defined in subsection 37(8) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926648" lims:id="926648"><Label>(ii)</Label><Text>as a merchant navy veteran of World War I or World War II within the meaning of subsection 37(7.3) of that Act,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926649" lims:id="926649"><Label>(b)</Label><Text>in respect of Part II, a veteran referred to in any of paragraphs (a) to (g) of the definition <DefinitionRef>veteran</DefinitionRef> who served during World War I or World War II as defined in subsection 37(10) of that Act</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926650" lims:id="926650"><Label>(i)</Label><Text>in a theatre of actual war, as that expression is defined in subsection 37(8) of that Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926651" lims:id="926651"><Label>(ii)</Label><Text>as a merchant navy veteran of World War I or World War II within the meaning of subsection 37(7.3) of that Act,</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926652" lims:id="926652"><Label>(c)</Label><Text>a veteran who</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926653" lims:id="926653"><Label>(i)</Label><Text>was on service in a theatre of operations, as that expression is defined in section 2 of the <XRefExternal reference-type="act" link="V-1.3">Veterans Benefit Act</XRefExternal>, as a member of the Canadian Forces, including the special force, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926654" lims:id="926654"><Label>(ii)</Label><Text>served as a Canadian merchant navy veteran of the Korean War, within the meaning of subsection 37(7.4) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>, or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926655" lims:id="926655"><Label>(d)</Label><Text>an allied veteran described in paragraphs 37(4)(c.1) and (d.1) or subsection 37(4.2) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>; (<DefinedTermFr>ancien combattant ayant servi outre-mer</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926656" lims:id="926656" generate-in-text="no"><Text><DefinedTermEn>pension</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926657" lims:id="926657"><Label>(a)</Label><Text>a pension that is awarded under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, other than a pension that is awarded under subsection 22(2) of that Act,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926658" lims:id="926658"><Label>(b)</Label><Text>a pension that is awarded under any of Parts I to III or VI to X of the <XRefExternal reference-type="act" link="C-31">Civilian War-related Benefits Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926659" lims:id="926659"><Label>(c)</Label><Text>a pension to which a Red Cross pensioner is entitled,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926660" lims:id="926660"><Label>(d)</Label><Text>compensation that is payable under the <XRefExternal reference-type="regulation" link="C.R.C.,_c._10">Flying Accidents Compensation Regulations</XRefExternal>, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926661" lims:id="926661"><Label>(e)</Label><Text>a pension that is awarded under the <XRefExternal reference-type="regulation">Civilian Government Employees (War) Compensation Order</XRefExternal>,</Text></Paragraph><ContinuedDefinition lims:inforce-start-date="2018-04-01" lims:fid="926662" indemnisé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926664" lims:id="926664" generate-in-text="no"><Text><DefinedTermEn>Red Cross pensioner</DefinedTermEn> means a Red Cross worker who is entitled to a pension pursuant to the Memorandum of Agreement between Her Majesty The Queen and The Canadian Red Cross Society made on October 17, 1952; (<DefinedTermFr>pensionné de la Croix-Rouge</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926665" lims:id="926665" generate-in-text="no"><Text><DefinedTermEn>reserve force member</DefinedTermEn> means a member </Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926666" lims:id="926666"><Label>(a)</Label><Text>of the Supplementary Reserve Force,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926667" lims:id="926667"><Label>(b)</Label><Text>on a period of Class A Reserve Service, as described in article 9.06 of the <XRefExternal reference-type="regulation">Queen’s Regulations and Orders for the Canadian Forces</XRefExternal>, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926668" lims:id="926668"><Label>(c)</Label><Text>on a period of 180 days or less of Class B Reserve Service, as described in article 9.07 of the <XRefExternal reference-type="regulation">Queen’s Regulations and Orders for the Canadian Forces</XRefExternal>; (<DefinedTermFr>membre de la Act</XRefExternal>, is equal to or greater than 78%; (<DefinedTermFr>déficience grave</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926670" lims:id="926670" generate-in-text="no"><Text><DefinedTermEn>special duty area pensioner</DefinedTermEn><Repealed>[Repealed, SOR/2003-362, s. 1]</Repealed></Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926671" lims:id="926671" generate-in-text="no"><Text><DefinedTermEn>special duty service pensioner</DefinedTermEn> means a former member or reserve force member who is entitled to a pension under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> for a disability attributable to or incurred during special duty service, as defined in subsection 3(1) of that Act; (<DefinedTermFr>pensionné du service spécial</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926672" lims:id="926672" generate-in-text="no"><Text><DefinedTermEn>spouse</DefinedTermEn>, in relation to an individual, means a person who is legally married to the individual and who</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926673" lims:id="926673"><Label>(a)</Label><Text>resides with the individual or in a health care facility, or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926674" lims:id="926674"><Label>(b)</Label><Text>maintains or is being maintained by the individual; (<DefinedTermFr>époux</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926675" lims:id="926675" generate-in-text="no"><Text><DefinedTermEn>supplementary benefits</DefinedTermEn> means the benefits referred to in section 6; (<DefinedTermFr>avantages supplémentaires</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926676" lims:id="926676" generate-in-text="no"><Text><DefinedTermEn>treatment benefits</DefinedTermEn> means the benefits referred to in section 4; (<DefinedTermFr>avantages médicaux</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926677" lims:id="926677" generate-in-text="no"><Text><DefinedTermEn>type I health need</DefinedTermEn> means the need of a person for personal care and supervision on a continuing basis, where the person is ambulant or independently mobile but has decreased physical or mental faculties; (<DefinedTermFr>besoins de santé de type I</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926678" lims:id="926678" generate-in-text="no"><Text><DefinedTermEn>type II health need</DefinedTermEn> means the need of a person for personal care on a continuing basis under the supervision of a health professional, where the person has a functional disability, has reached the apparent limit of recovery and has little need for diagnostic or therapeutic services; (<DefinedTermFr>besoins de santé de type II</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926679" lims:id="926679" generate-in-text="no"><Text><DefinedTermEn>type III health need</DefinedTermEn> means the need of a person for personal care and for diagnostic, nursing and therapeutic services provided by a health professional on a continuing basis, where the person is chronically ill or has a functional disability and the acute phase of the illness or disability has ended, whether or not the status of the illness or disability is unstable; (<DefinedTermFr>besoins de santé de type III</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926680" lims:id="926680" generate-in-text="no"><Text><DefinedTermEn>veteran</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926681" lims:id="926681"><Label>(a)</Label><Text>a person who was on active service during World War I or World War II as a member of the naval, army or air forces of Canada or of similar forces raised in Newfoundland,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926682" lims:id="926682"><Label>(b)</Label><Text>a person who was on service in a theatre of operations, as that expression is defined in section 2 of the <XRefExternal reference-type="act" link="V-1.3">Veterans Benefit Act</XRefExternal>, as a member of the Canadian Forces, including the special force,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926683" lims:id="926683"><Label>(b.1)</Label><Text>a person who was on active service during the Korean War as a member of the special force, as defined in subsection 3(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926684" lims:id="926684"><Label>(c)</Label><Text>a special operator who is deemed to be a veteran pursuant to section 3 of the <XRefExternal reference-type="act">Special Operators War Service Benefits Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926685" lims:id="926685"><Label>(d)</Label><Text>a supervisor who is deemed to be a veteran pursuant to section 3 of the <XRefExternal reference-type="act">Supervisors War Service Benefits Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926686" lims:id="926686"><Label>(e)</Label><Text>an allied veteran described in subsection 37(4), (4.1) or (4.2) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926687" lims:id="926687"><Label>(e.1)</Label><Text>a person referred to in paragraph 64(1)(a) or (b), lims:id="926694"><Label>(C)</Label><Text>adult residential care, intermediate care or chronic care pursuant to paragraph 21(1)(c) or subsection 21(2), or</Text></Clause><Clause lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926695" lims:id="1342831"><Label>(D)</Label><Text>the cost of chronic care in a community facility pursuant to paragraph 22.1(1)(b), or</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926696" lims:id="926696"><Label>(h)</Label><Text>a former member of His Majesty’s forces, or of any of the forces, other than resistance groups, of any of His Majesty’s allies or powers associated with His Majesty in World War I or World War II, who</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926697" lims:id="926697"><Label>(i)</Label><Text>served during either of those wars during the period set out in paragraph 37(10)(b) or (c), as the case may be, of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926698" lims:id="926698"><Label>(ii)</Label><Text>has resided in Canada for a total period of at least 10 years,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926699" lims:id="926699"><Label>(iii)</Label><Text>does not meet the Canadian domicile requirements of subsection 37(4) of that Act, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926700" lims:id="926700"><Label>(iv)</Label><Text>served in a theatre of actual war as defined in subsection 37(8) of that Act, receives a pension for an injury or disease incurred or aggravated during service in any such force during either of those wars or accepted a commuted pension; (<DefinedTermFr>ancien combattant</DefinedTermFr>)</Text></Subparagraph></Paragraph></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="926701" lims:id="926701" generate-in-text="no"><Text><DefinedTermEn>war-related pensioned condition</DefinedTermEn> means a pensioned condition that is related to</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926704" lims:id="926704"><Label>(a)</Label><Text>active service in the military during World War I or World War II,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926705" lims:id="926705"><Label>(b)</Label><Text>service in a theatre of operations as that expression is defined in section 2 of the <XRefExternal reference-type="act" link="V-1.3">Veterans Benefit Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926706" lims:id="926706"><Label>(c)</Label><Text>special duty service, as defined in subsection 3(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>,</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926707" lims:id="926720"><Label>(d)</Label><Text>a flying accident pensioner.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926721" lims:id="926721"><Label>(2)</Label><Text>A Newfoundland Special Award pensioner is eligible to receive treatment benefits in Canada or elsewhere in respect of the disability for which they receive the award.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926722" lims:id="926722"><Label>(3)</Label><Text lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1119527" lims:id="1121941">The following clients are eligible to receive treatment benefits in Canada or elsewhere in respect of a pensioned condition or a disability for which they are entitled to a disability award or entitled to pain and suffering compensation to the extent that those benefits are not available to them as a member or former member of the Canadian Forces:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926723" lims:id="926723"><Label>(a)</Label><Text>a special duty service pensioner;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926724" lims:id="926724"><Label>(b)</Label><Text>a military service pensioner; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926725" lims:id="926725"><Label>(c)</Label><Text>a former member or a reserve force member.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926726" lims:id="926726"><Label>(4)</Label><Text>The following clients are eligible to receive treatment benefits in Canada, for any health condition, to the extent that those benefits are not available to them as a member or former member of the Canadian Forces nor available as an insured service under a provincial health care system:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926727" lims:id="926727"><Label>(a)</Label><Text>a veteran pensioner or a civilian pensioner if the extent of their disability in respect of the aggregate of all of their disability assessments under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> and the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal> is equal to or greater than 48%;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926728" lims:id="926728"><Label>(b)</Label><Text>a client referred to in subsection (1) or (2) who is seriously disabled; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="926729" lims:id="1122050"><Label>(c)</Label><Text>a special duty service pensioner or a former member or reserve force member who is entitled to a disability award or pain and suffering compensation in respect of special duty service, if they are eligible to receive any of the veterans independence program services referred to in paragraphs 19(a), (b) and (e).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926730" lims:id="926730"><Label>(5)</Label><Text>The following clients are eligible to receive treatment benefits in Canada, for any health condition, to the extent that those benefits are not available as an insured service under a provincial health care system:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926731" lims:id="926731"><Label>(a)</Label><Text>an income-qualified veteran;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926732" lims:id="926732"><Label>(b)</Label><Text>an income-qualified civilian;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926733" lims:id="926733"><Label>(c)</Label><Text>a client who is in receipt of adult residential care, intermediate care or chronic care in a contract bed;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926734" lims:id="926734"><Label>(d)</Label><Text>a client who is in receipt of the cost to them of intermediate care or chronic care under section 21.1 or 21.2;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926735" lims:id="926735"><Label>(e)</Label><Text>a Canada service veteran who is in receipt of chronic care in a community facility under subsection 22(2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926736" lims:id="926736"><Label>(f)</Label><Text>a client who is in receipt of chronic care in a community facility under section 22.1.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926737" lims:id="926737"><Label>(6)</Label><Text>The following clients are eligible to receive treatment benefits in Canada, for any health condition, to the extent that those benefits are not available as an insured service under a provincial health care system:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926738" lims:id="926738"><Label>(a)</Label><Text>if they are eligible under section 15, 17 or 17.1 to receive any of the veterans independence program services referred to in paragraphs 19(a), (b) and (e) or are in receipt of those services under section 18:</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926739" lims:id="926739"><Label>(i)</Label><Text>a veteran pensioner,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926740" lims:id="1342835"><Label>(ii)</Label><Text>an overseas service veteran, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926741" lims:id="1342836"><Label>(iii)</Label><Text><Repealed>[Repealed, SOR/2022-69, s. 2]</Repealed></Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926742" lims:id="926742"><Label>(iv)</Label><Text>an overseas service civilian; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926743" lims:id="926743"><Label>(b)</Label><Text>if they are eligible to receive any of the veterans independence program services referred to in paragraphs 19(a), (b) and (e):</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926744" lims:id="926744"><Label>(i)</Label><Text>a civilian pensioner,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926745" lims:id="926745"><Label>(ii)</Label><Text>a prisoner of war who is entitled to basic compensation under subsection 71.2(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926746" lims:id="926746"><Label>(iii)</Label><Text>a Canada service veteran, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926747" lims:id="926747"><Label>(iv)</Label><Text>a former member or a reserve force member who has received a detention benefit under Part 3 of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926748" lims:id="926748"><Label>(7)</Label><Text>If a client is hospitalized and they assert that hospitalization is required in respect of their pensioned condition, treatment benefits in respect of that hospitalization, in Canada or elsewhere, are deemed to be required in respect of the pensioned condition, for the period during which there is uncertainty as to whether the primary condition in respect of which the treatment benefits are required is the client’s pensioned benefits consist of the following:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926752" lims:id="926752"><Label>(a)</Label><Text>any medical, surgical or dental examination or treatment provided by a health professional;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926753" lims:id="926753"><Label>(b)</Label><Text>the provision of any surgical or prosthetic device or any aid approved by the Minister, the maintenance of the device or aid and any home adaptation that is necessary to accommodate or facilitate its use;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926754" lims:id="926754"><Label>(c)</Label><Text>preventive health care approved by the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926755" lims:id="926755"><Label>(d)</Label><Text>pharmaceuticals prescribed by a physician, dentist or other person authorized to prescribe pharmaceuticals under the laws in force in the province or the country where the pharmaceuticals are provided.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="926757" lims:id="926757">SOR/2001-157, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="926758" lims:id="926758"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926759" lims:id="926759"><Label>(1)</Label><Text>Where treatment benefits are provided in Canada, the rate at which the treatment benefits and any administrative costs related thereto are payable is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926760" lims:id="926760"><Label>(a)</Label><Text>where the treatment benefits are fully insured health services of the province in which they are provided, the rate established by the province for those services and costs;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926761" lims:id="926761"><Label>(b)</Label><Text>where the treatment benefits are not fully insured health services of the province in which they are provided and, in respect of that province, an association of health professionals has adopted a fee schedule for treatment benefits and costs, the rate that is approved by the Minister and that is based on that fee schedule; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926762" lims:id="926762"><Label>(c)</Label><Text>in any other case, the rate normally paid for those treatment benefits and costs in the community in which the treatment benefits are provided.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926763" lims:id="926763"><Label>(2)</Label><Text>Where treatment benefits are provided in a country other than Canada, the rate at which the treatment benefits and any administrative costs related thereto are payable is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926764" lims:id="926764"><Label>(a)</Label><Text>the rate established for former members of the armed forces of that country for those treatment benefits and costs; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926765" lims:id="926765"><Label>(b)</Label><Text>where no rate referred to in paragraph (a) is established, the lesser of the rate that would be payable to the client under subsection (1) if the client were resident in Ottawa, Ontario and the actual rate paid by the client for the treatment benefits and costs.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="926766" lims:id="926766" level="2"><TitleText>Supplementary Benefits</TitleText></Heading><Section lims:inforce-start-date="2012-03-15" lims:lastAmendedDate="2022-03-28" lims:fid="926767" lims:id="926767"><Label>6</Label><Text lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="1342619" lims:id="1342838">A client who receives treatment benefits referred to in paragraph 4(a) or (b) under section 3 and a client referred to in paragraph 3(3)(a) or any of subsections 3(4) to (7) who receives those benefits as an insured service under a provincial health care system are eligible to receive supplementary benefits as follows:</Text><Paragraph lims:inforce-start-date="2012-03-15" lims:fid="926768" lims:id="926768"><Label>(a)</Label><Text>the costs of travel incurred by the client who travels to receive those treatment benefits;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-15" lims:fid="926769" lims:id="926769"><Label>(b)</Label><Text>where the client’s health needs are such that the client needs to be accompanied by an escort on travel referred to in paragraph (a), the costs of travel incurred by that escort; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-15" lims:fid="926770" lims:id="926770"><Label>(c)</Label><Text>the remuneration of an escort referred to in paragraph (b), where that escort is not the spouse or common-law partner or a dependant of the client or any other member of the client’s household.</Text></Paragraph><Paragraph lims:inforce-start-date="2012-03-15" lims:fid="926771" lims:inforce-start-date="2006-03-22" lims:fid="926775" lims:id="926775"><Label>(1)</Label><Text>Subject to subsections (2), (2.1), (2.2) and (3), the costs of travel referred to in paragraphs 6(a) and (b) are payable in respect of a client who receives treatment benefits in Canada in respect of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926776" lims:id="926776"><Label>(a)</Label><Text>transportation by the most convenient and economical means of transportation appropriate to the condition of the client</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926777" lims:id="926777"><Label>(i)</Label><Text>where the client is resident in Canada, between the client’s residence and the appropriate treatment centre nearest to that residence, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926778" lims:id="926778"><Label>(ii)</Label><Text>where the client is resident in a country other than Canada, between the client’s point of entry into Canada and the appropriate treatment centre nearest to that point;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926779" lims:id="926779"><Label>(b)</Label><Text>transportation between the treatment centre and the accommodations referred to in paragraph (d);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926780" lims:id="926780"><Label>(c)</Label><Text>meals; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926781" lims:id="926781"><Label>(d)</Label><Text>standard commercial sleeping accommodations that are conveniently located in respect of the treatment centre, or private accommodations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926782" lims:id="926782"><Label>(2)</Label><Text>Where the means of transportation referred to in subparagraph (1)(a)(i) or (ii) is a taxi, $5.00 shall, subject to subsection 34(2), be deducted from the costs of travel for each trip.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926783" lims:id="926783"><Label>(2.1)</Label><Text>Where the means of transportation referred to in subparagraph (1)(a)(i) or (ii) is a private automobile other than a taxi, whether belonging to the client or otherwise, the costs of travel</Text><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926784" lims:id="1342840"><Label>(a)</Label><Text>are payable at the rate established for employees of the public service of Canada in Appendix B of the <XRefExternal reference-type="other">Travel Directive</XRefExternal> of the National Joint Council, as amended from time to time, plus two cents per kilometre; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926785" lims:id="926785"><Label>(b)</Label><Text>include the cost of parking while the client is at the treatment centre.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926786" lims:id="1342841"><Label>(2.2)</Label><Text>The costs of travel referred to in subsections (1) and (2) are payable at the same rates, less any minimum rates that apply, as those established for employees of the public service of Canada in Appendices C and D of the <XRefExternal reference-type="other">Travel Directive</XRefExternal> of the National Joint Council, as amended from time to time.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926789" lims:id="926789"><Label>(3)</Label><Text>The costs of travel referred to in paragraphs 6(a) and (b) are payable, in respect of a client who receives treatment benefits in a country other than Canada and who is a resident of that country or who is in that country for a purpose other than seeking treatment, at the same rate and subject to the same conditions as the rate and conditions that are established for former members of the armed forces of that country for similar costs of travel or, where no such rate is established, at the rate that would be payable under subsection (1) if the client were resident in Canada.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="926791" lims:id="926791">SOR/95-440, s. lims:inforce-start-date="2006-03-22" lims:fid="926794" lims:id="926794"><Label>(a)</Label><Text>where the treatment benefits are provided in Canada, at a daily rate computed by dividing by 30 the sum of the basic pension and the additional pension for a spouse or common-law partner that are payable for a class 1 pension under Schedule I to the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, as adjusted in accordance with Part V of that Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926795" lims:id="926795"><Label>(b)</Label><Text>where the treatment benefits are provided in a country other than Canada, at the same rate and subject to the same conditions as the rate and conditions that are established for former members of the armed forces of that country for such escorts or, where no such rate is established, at the rate referred to in paragraph (a).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926796" lims:id="926796"><Label>(2)</Label><Text><Repealed>[Repealed, SOR/95-440, s. eligible to receive a treatment allowance in respect of a period of acute care for a pensioned condition provided in a hospital or on an out-patient basis:</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="926801" lims:id="926801"><Label>(a)</Label><Text>veteran pensioners;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="926802" lims:id="926802"><Label>(b)</Label><Text>civilian pensioners;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="926803" lims:id="926803"><Label>(c)</Label><Text>military service pensioners or members who are entitled to a pension under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> for a disability related to military service that was not</Text><Subparagraph lims:inforce-start-date="2013-01-01" lims:fid="926804" lims:id="926804"><Label>(i)</Label><Text>active service in World War I or World War II,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-01-01" lims:fid="926805" lims:id="926805"><Label>(ii)</Label><Text>service in a theatre of operations, as that expression is defined in section 2 of the <XRefExternal reference-type="act" link="V-1.3">Veterans Benefit Act</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-01-01" lims:fid="926806" lims:id="926806"><Label>(iii)</Label><Text>special duty service, as defined in subsection 3(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="926807" lims:id="926807"><Label>(d)</Label><Text>Red Cross pensioners;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="926808" lims:id="926808"><Label>(e)</Label><Text>flying accident pensioners; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="926809" lims:id="926809"><Label>(f)</Label><Text>special duty service pensioners or members who are entitled to a pension under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> for a disability attributable to or incurred during special duty service, as defined in subsection 3(1) of that lims:inforce-start-date="2006-03-22" lims:fid="926813" lims:id="926813"><Label>(1)</Label><Text>A treatment allowance is payable at a rate that is equal to the difference between the monthly pension paid to the client, including any additional pension paid for a spouse or common-law partner or dependant of the client, and the amount that the client would receive were the client in receipt of a class 1 pension under Schedule I to the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926814" medical examination in order to establish that person’s entitlement to any benefit, service or care, the person is eligible to receive</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926822" lims:id="926822"><Label>(a)</Label><Text>reimbursement of the cost of the examination incurred by the person; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" requests that a person undergo a medical examination, the person is eligible to receive</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926826" lims:id="926826"><Label>(a)</Label><Text>reimbursement of the cost of the examination incurred by the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926827" lims:id="926827"><Label>(b)</Label><Text>reimbursement of the costs of travel incurred by the person in respect of the examination, in accordance with section 7; and</Text></Paragraph><Paragraph lims:id="926829"><Label>(3)</Label><Text>Subsections (1) and (2) do not apply in respect of a medical examination required under the <XRefExternal reference-type="act" link="C-16.8">Veterans receive treatment benefits and supplementary benefits for a period that is equal to the shorter of one year and the total period of service of the client:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926831" lims:id="926831"><Label>(a)</Label><Text>veteran pensioners, special duty service pensioners and military service pensioners, if they take a course of training under the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1581">Pensioners Training Regulations</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926832" lims:id="926832"><Label>(b)</Label><Text>veteran pensioners whose war-related pensioned condition is blindness, if they take a course of lims:id="1342966"><Label>14</Label><Text>The following definitions apply in sections 14.1 to 14.5.</Text><Definition lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342967" lims:id="1342967"><Text><DefinedTermEn>Canadian Forces</DefinedTermEn> means the armed forces referred to in section 14 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> and includes any predecessor naval, army or air forces of Canada or Newfoundland. (<DefinedTermFr>Forces canadiennes</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342969" lims:id="1342969"><Label>(a)</Label><Text>a pension awarded under section 21 of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> on account of a disability; or</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342970" lims:id="1342970"><Label>(b)</Label><Text>pain and suffering compensation paid under subsection 45(1) of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>. (<DefinedTermFr>prestations d’invalidité</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342971" lims:id="1342971"><Text><DefinedTermEn>mental health benefits</DefinedTermEn> means the benefits referred to in section 14.2. (<DefinedTermFr>avantages pour la santé mentale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342972" lims:id="1342972"><Text><DefinedTermEn>mental health client</DefinedTermEn> means a person who meets the requirements of section 14.1. (<DefinedTermFr>client en santé mentale</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342974" lims:id="1342974" lims:enactId="1342506">SOR/2022-69, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:lastAmendedDate="2022-04-01" lims:fid="1342975" lims:id="1342975"><Label>14.1</Label><Subsection lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342976" lims:id="1342976"><Label>(1)</Label><Text>A former member of the Canadian Forces or a reserve force member is eligible to receive mental health benefits in Canada or elsewhere in respect of any mental health condition for which they submit an application for disability benefits to the extent that those benefits are not available to them as a former member of the Canadian Forces or a reserve force member nor available as an insured service under a provincial health care system.</Text></Subsection><Subsection lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342977" lims:id="1342977"><Label>(2)</Label><Text>For the purposes of subsection (1), a mental health condition means one or more of the following psychiatric conditions:</Text><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342978" lims:id="1342978"><Label>(a)</Label><Text>an anxiety disorder;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342979" lims:id="1342979"><Label>(b)</Label><Text>a depressive disorder;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342980" lims:id="1342980"><Label>(c)</Label><Text>a trauma- and stressor-related disorder.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342982" lims:id="1342982" lims:enactId="1342506">SOR/2022-69, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:lastAmendedDate="2022-04-01" lims:fid="1342983" lims:id="1342983"><Label>14.2</Label><Text>Mental health benefits consist of the following:</Text><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342984" lims:id="1342984"><Label>(a)</Label><Text>any examination or treatment provided by a psychologist, mental health counsellor or therapist, social worker or other professional approved by the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342985" lims:id="1342985"><Label>(b)</Label><Text>pharmaceuticals prescribed by a physician or other person authorized to prescribe pharmaceuticals under the laws in force in the province or the country where the pharmaceuticals are provided.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342987" lims:id="1342987" lims:enactId="1342506">SOR/2022-69, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:lastAmendedDate="2022-04-01" lims:fid="1342988" lims:id="1342988"><Label>14.3</Label><Subsection lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342989" lims:id="1342989"><Label>(1)</Label><Text>Where mental health benefits are provided in Canada, the rate at which the mental health benefits and any related administrative costs are payable is</Text><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342990" lims:id="1342990"><Label>(a)</Label><Text>where the mental health benefits are fully insured health services of the province in which they are provided, the rate established by the province for those services and costs;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342991" lims:id="1342991"><Label>(b)</Label><Text>where the mental health benefits are not fully insured health services of the province in which they are provided and, in respect of that province, an association of health professionals has adopted a fee schedule for treatment benefits and costs, the rate that is approved by the Minister and that is based on that fee schedule; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342992" lims:id="1342992"><Label>(c)</Label><Text>in any other case, the rate normally paid for those mental health benefits and costs in the community in which the mental health benefits are provided.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342993" lims:id="1342993"><Label>(2)</Label><Text>Where mental health benefits are provided in a country other than Canada, the mental health client is eligible to receive reimbursement of the actual and reasonable expenses and any related administrative costs incurred by the mental health client, up to a maximum amount approved by the Minister.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342995" lims:id="1342995" lims:lastAmendedDate="2022-04-01" lims:fid="1342996" lims:id="1342996"><Label>14.4</Label><Subsection lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342997" lims:id="1342997"><Label>(1)</Label><Text>A mental health client becomes eligible to receive mental health benefits</Text><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342998" lims:id="1342998"><Label>(a)</Label><Text>on April 1, 2022, if their application for disability benefits is received by the Minister before that date and the Minister has not yet made a decision respecting the application; or</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1342999" lims:id="1342999"><Label>(b)</Label><Text>on the day on which the Minister receives their application for disability benefits, if their application is received on or after April 1, 2022.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1343000" lims:id="1343000"><Label>(2)</Label><Text>Despite subsection (1), if a person who does not meet the requirements of section 14.1 submits an application for disability benefits, they become eligible to receive mental health benefits beginning on the day on which they become a mental health client.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1343002" lims:id="1343002" lims:enactId="1342506">SOR/2022-69, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:lastAmendedDate="2022-04-01" lims:fid="1343003" lims:id="1343003"><Label>14.5</Label><Text>Despite section 31, a mental health client ceases to be eligible to receive mental health benefits</Text><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1343004" lims:id="1343004"><Label>(a)</Label><Text>if the Minister makes a favourable decision respecting their application for disability benefits, on the day on which the decision is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1343005" lims:id="1343005"><Label>(b)</Label><Text>if the Minister makes an unfavourable decision respecting their application for disability benefits, two years after the applicable day determined under section 14.4 or, if the Minister makes the decision after that day, on the day on which the decision is made; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1343006" lims:id="1343006"><Label>(c)</Label><Text>if the Minister decides that their application for disability benefits has been withdrawn, two years after the applicable day determined under section 14.4 or, if the Minister makes the decision after that day, on the day on which the decision is made.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2022-04-01" lims:enacted-date="2022-03-28" lims:fid="1343008" lims:id="1343008" II</Label><TitleText>Veterans Independence Program</TitleText></Heading><Heading lims:inforce-start-date="2016-04-01" lims:fid="926837" lims:id="926837" level="2"><TitleText>Eligibility</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2022-03-28" lims:fid="926838" lims:id="926838"><Label>15</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926839" lims:id="926839"><Label>(1)</Label><Text>Subject to subsections (1.1) and (1.11), veteran pensioners, civilian pensioners and special duty service pensioners are eligible to receive the veterans independence program services referred to in paragraphs 19(a), (b) and (d) or, where it is not reasonably practicable for those services to be provided at their principal residence, the care referred to in paragraph 19(e), to the extent that those services or that care is not available to them as an insured service under a provincial health care system, if</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926840" lims:id="926840"><Label>(a)</Label><Text>they are resident in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926841" lims:id="926841"><Label>(b)</Label><Text>an assessment indicates that</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926842" lims:id="926842"><Label>(i)</Label><Text>their war-related pensioned condition impairs their ability to remain self-sufficient at their principal residence without those services, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926843" lims:id="926843"><Label>(ii)</Label><Text>the provision of those services would assist them to remain self-sufficient at their principal residence or the provision of that care is necessary for health reasons.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926844" lims:id="926844"><Label>(1.1)</Label><Text>Seriously disabled veteran pensioners and seriously disabled civilian pensioners are not required to meet the requirement set out in subparagraph (1)(b)(i).</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926845" lims:id="926845"><Label>(1.11)</Label><Text>Veteran pensioners and civilian pensioners, whose extent of disability, in respect of the aggregate of all of their disability assessments under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> and the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal>, is equal to or greater than 48% are not required to meet the requirement set out in subparagraph (1)(b)(i).</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926846" lims:id="926846"><Label>(1.2)</Label><Text lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1119528" lims:id="1121942">Military service pensioners and former members or reserve force members who are entitled to a disability award or entitled to pain and suffering compensation are eligible to receive the veterans independence program services referred to in paragraphs 19(a), (b) and (d) or, if it is not reasonably practicable for those services to be provided at their principal residence, the care referred to in paragraph 19(e), to the extent that those services or that care is not available to them as a member or former member of the Canadian Forces nor available as an insured service under a provincial health care system, if</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926847" lims:id="926847"><Label>(a)</Label><Text>they are resident in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926848" lims:id="926848"><Label>(b)</Label><Text>an assessment indicates that</Text><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="926849" lims:id="1121965"><Label>(i)</Label><Text>their pensioned condition or the disability for which they are entitled to a disability award or entitled to pain and suffering compensation, as the case may be, impairs their ability to remain self-sufficient at their principal residence without those services, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="926850" lims:id="926850"><Label>(ii)</Label><Text>the provision of those services would assist them to remain self-sufficient at their principal residence or the provision of that care is necessary for health reasons.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926851" lims:id="926851"><Label>(2)</Label><Text>Subject to section 33.1, income-qualified veterans who are 65 years of age or more, income-qualified overseas service civilians who are 65 years of age or more and Canada service veterans are eligible to receive the veterans independence program services referred to in paragraphs 19(a) to (d) or, where it is not reasonably practicable for those services to be provided at their principal residence, the care referred to in paragraph 19(e), to the extent that those services or that care is not available to them as an insured service under a provincial health care system, if</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926852" lims:id="926852"><Label>(a)</Label><Text>they are resident in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926853" lims:id="926853"><Label>(b)</Label><Text>an assessment indicates that the provision of those services would assist them to remain self-sufficient at their principal residence or the provision of that care is necessary for health reasons.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926854" lims:id="926854"><Label>(3)</Label><Text>Subject to section 33.1, prisoners of war who are entitled to basic compensation under subsection 71.2(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> and former members and reserve force members who have received a detention benefit under Part 3 of the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal> are eligible to receive the veterans independence program services referred to in paragraphs 19(a), (b) and (d) or, if it is not reasonably practicable for those services to be provided at their principal residence, the care referred to in paragraph 19(e), to the extent that those services or that care is not available as an insured service under a provincial health care system, if</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926855" lims:id="926855"><Label>(a)</Label><Text>they are totally disabled, whether by reason of military service or not;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926856" lims:id="926856"><Label>(b)</Label><Text>they are resident in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926857" lims:id="926857"><Label>(c)</Label><Text>an assessment indicates that the provision of those services would assist them to remain in their principal residence or that the provision of that care is necessary for health reasons.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926858" lims:id="926858"><Label>(4)</Label><Text>Subject to section 33.1, overseas service veterans eligible for intermediate care or chronic care in a contract bed under subsection 21(1) are also eligible to receive the veterans independence program services referred to in paragraphs 19(a), (b) and (d), to the extent that those services are not available to them as an insured service under a provincial health care system, if</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926859" lims:id="926859"><Label>(a)</Label><Text>they have applied to the Minister for admission to a contract bed, and are not admitted because there is no vacancy in a contract bed within a reasonable distance of the community in which they normally reside;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926860" lims:id="926860"><Label>(b)</Label><Text>they are resident in Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926861" lims:id="926861"><Label>(c)</Label><Text>an assessment indicates that the provision of those services would assist them to remain self-sufficient at their principal Services</TitleText></Heading><Section lims:inforce-start-date="2010-01-01" lims:lastAmendedDate="2010-01-01" lims:fid="926865" lims:id="926865"><Label>16</Label><Subsection lims:inforce-start-date="2010-01-01" lims:fid="926866" lims:id="926866"><Label>(1)</Label><Text>Subject to subsection (2), the primary caregiver of a client is entitled to any of the services referred to in subparagraphs 19(a)(iii) and (v) that the client was receiving under the <XRefExternal reference-type="act" link="V-1">Department of Veterans Affairs Act</XRefExternal> at the time the client died or began residing in a health care facility if</Text><Paragraph lims:inforce-start-date="2010-01-01" lims:fid="926867" lims:id="926867"><Label>(a)</Label><Text>the primary caregiver is assessed within one year after the earlier of client's death and the client's admission into the health care facility, or presents evidence relating to their health condition during that period on the basis of which an assessment can be made;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-01-01" lims:fid="926868" lims:id="926868"><Label>(b)</Label><Text>the assessment and all subsequent assessments indicate that the provision of the services is necessary for health reasons and to assist the primary caregiver to remain self-sufficient at their principal residence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-01-01" lims:fid="926869" lims:id="926869"><Label>(c)</Label><Text>the primary caregiver is resident in Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-01-01" lims:fid="926870" lims:id="926870"><Label>(1.1)</Label><Text>Despite subsection (1), the primary caregiver of a client who died or began residing in a health care facility during the period beginning on October 14, 2008 and ending on December 31, 2009 is entitled to the services in accordance with subsection (1) that the client would have been entitled to receive if paragraph (d) of the definition <DefinedTermEn>overseas service veteran</DefinedTermEn> and paragraph (e) of the definition <DefinedTermEn>veteran</DefinedTermEn> in section 2 had come into force on October 14, 2008 provided that</Text><Paragraph lims:inforce-start-date="2010-01-01" lims:fid="926871" lims:id="926871"><Label>(a)</Label><Text>the client is an allied veteran described in paragraphs 37(4)(c.1) and (d.1) or subsection 37(4.1) or (4.2) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2010-01-01" lims:fid="926872" lims:id="926872"><Label>(b)</Label><Text>the client is not an allied veteran described in paragraph (g) of the definition <DefinedTermEn>veteran</DefinedTermEn> in section 2; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-01-01" lims:fid="926873" lims:id="926873"><Label>(c)</Label><Text>the primary caregiver applies to the Minister for the services no later than December 31, 2010.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2010-01-01" lims:fid="926874" lims:id="926874"><Label>(2)</Label><Text>The primary caregiver is entitled to the services to the extent that they are not available to the primary caregiver as an insured service under a provincial health care system or a private insurance policy.</Text></Subsection><Subsection lims:inforce-start-date="2010-01-01" lims:fid="926875" lims:id="926875"><Label>(3)</Label><Text>In this section, <DefinedTermEn>primary caregiver</DefinedTermEn>, in relation to a client, means the adult person who, immediately before the client died or was admitted into a health care facility,</Text><Paragraph lims:inforce-start-date="2010-01-01" lims:fid="926876" lims:id="926876"><Label>(a)</Label><Text>was primarily responsible, without remuneration, for ensuring that care was provided to the client; and</Text></Paragraph><Paragraph lims:inforce-start-date="2010-01-01" lims:fid="926877" lims:id="926877"><Label>(b)</Label><Text>for a continuous period of at least one year, resided in the principal residence of the client and maintained the client or was maintained by the client.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2010-01-01" lims:fid="926879" lims:id="926879">SOR/2001-326, s. 3; SOR/2003-231, s. 1; lims:fid="926880" lims:id="926880"><Label>16.1</Label><Subsection lims:inforce-start-date="2008-02-26" lims:fid="926881" lims:id="926881"><Label>(1)</Label><Text>The survivor of a person — who was an income-qualified civilian, an income-qualified veteran, a veteran pensioner or a civilian pensioner and who, at the time of their death, was not in receipt of the services referred to in subparagraphs 19(a)(iii) and (v) — is eligible to receive those services if</Text><Paragraph lims:inforce-start-date="2008-02-26" lims:fid="926882" lims:id="926882"><Label>(a)</Label><Text>an assessment and all subsequent assessments indicate that the provision of the services is necessary for reasons related to the health of the survivor and to assist the survivor to remain self-sufficient at their principal residence;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-02-26" lims:fid="926883" lims:id="926883"><Label>(b)</Label><Text>the survivor is in receipt of the guaranteed income supplement under the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal> or an amount is deductible in respect of the survivor under section 118.3 of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal> in computing an individual’s tax payable under Part I of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-02-26" lims:fid="926884" lims:id="926884"><Label>(c)</Label><Text>the services are not available as an insured service under a provincial health care system or a private insurance policy;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-02-26" lims:fid="926885" lims:id="926885"><Label>(d)</Label><Text>the survivor is not eligible to receive any services under section 16; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-02-26" lims:fid="926886" lims:id="926886"><Label>(e)</Label><Text>the survivor is resident in Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-02-26" lims:fid="926887" lims:id="926887"><Label>(2)</Label><Text>In this section, <DefinedTermEn>survivor</DefinedTermEn> means, in relation to the person, the adult individual who, immediately before the person died or, if the person died in a health care facility, immediately before the person was admitted into the health care facility,</Text><Paragraph lims:inforce-start-date="2008-02-26" lims:fid="926888" lims:id="926888"><Label>(a)</Label><Text>was primarily responsible, without remuneration, for ensuring that care was provided to the person; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-02-26" lims:fid="926889" lims:id="926889"><Label>(b)</Label><Text>for a continuous period of at least one year, resided in the principal residence of the person and maintained the person or was maintained by the person.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2008-02-26" lims:fid="926891" lims:id="926891">SOR/2008-41, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="926892" lims:id="926892"><Label>17</Label><Text>Subject to section 33.1, income-qualified veterans who are under 65 years of age are eligible to receive the veterans independence program services referred to in paragraphs 19(a) to (d) or, where it is not reasonably practicable for those services to be provided at their principal residence, the care referred to in paragraph 19(e), to the extent that those services or that care is not available to them as an insured service under a provincial health care system, if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926893" lims:id="926893"><Label>(a)</Label><Text>they are resident in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926894" lims:id="926894"><Label>(b)</Label><Text>as of August 31, 1990, they were the subject of an assessment based on current data that indicated that</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926895" lims:id="926895"><Label>(i)</Label><Text>the provision of those services would assist them to remain self-sufficient at their principal residence, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926896" lims:id="926896"><Label>(ii)</Label><Text>the provision of that care was appropriate in the circumstances; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926897" lims:id="926897"><Label>(c)</Label><Text>they continue after August 31, 1990, without interruption</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926898" lims:id="926898"><Label>(i)</Label><Text>to qualify as income-qualified veterans, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926899" lims:id="926899"><Label>(ii)</Label><Text>to be the subject of an assessment that indicates that the provision of those services would assist them to remain self-sufficient at their principal residence or that the provision of that care is appropriate in the circumstances.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="926901" lims:id="926901">SOR/98-386, s. 7; SOR/2001-326, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="926902" lims:id="926902"><Label>17.1</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926903" lims:id="926903"><Label>(1)</Label><Text>A client described in section 15, 17 or 18 who, on June 30, 1993, is in receipt of adult residential care in a community facility other than in a contract bed, may continue to receive that care for as long as</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926904" lims:id="926904"><Label>(a)</Label><Text>the provision of those services is uninterrupted; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926905" lims:id="926905"><Label>(b)</Label><Text>the client meets the requirements set out in that section.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926906" lims:id="926906"><Label>(2)</Label><Text>A client described in section 15, 17 or 18 whose request for the care referred to in subsection (1) is approved on or after June 30, 1993, may receive that care if the request is submitted before that day.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926907" lims:id="926907"><Label>(3)</Label><Text>Clients referred to in subsections (1) and (2) are subject to the provisions of sections 29 and Needs</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2022-03-28" lims:fid="926911" lims:id="926911"><Label>18</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926912" lims:id="926912"><Label>(1)</Label><Text>Subject to subsections (2) and (3) and sections 20 and 33.1, the following clients are eligible to receive the veterans independence program services referred to in paragraphs 19(a) to (d) or, where it is not reasonably practicable for those services to be provided at their principal residence, the care referred to in paragraph 19(e), to the extent that those services or that care is not available to them as an insured service under a provincial health care system:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926913" lims:id="926913"><Label>(a)</Label><Text>veteran pensioners;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926914" lims:id="926914"><Label>(b)</Label><Text>overseas service veterans;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926915" lims:id="1342844"><Label>(c)</Label><Text><Repealed>[Repealed, SOR/2022-69, s. 7]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926916" lims:id="926916"><Label>(d)</Label><Text>overseas service civilians; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926917" lims:id="926917"><Label>(e)</Label><Text>veterans to whom paragraphs (a) and (b) of the definition “Canada service veteran” in section 2 apply.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926918" lims:id="926918"><Label>(2)</Label><Text>Payments shall be made in respect of services or care provided under subsection (1) to or in respect of a client referred to in that subsection for any period of 12 months commencing on October 1 of any year, or for any lesser period within those 12 months, if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926919" lims:id="926919"><Label>(a)</Label><Text>the client is resident in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926920" lims:id="926920"><Label>(b)</Label><Text>the client has exceptional health care needs that require services or care referred to in paragraphs 19(a) to (e);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926921" lims:id="926921"><Label>(c)</Label><Text>a determination in respect of that period has been made under section 31.2 that the client’s income is insufficient to enable the client to pay for those services or that care; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926922" lims:id="926922"><Label>(d)</Label><Text>an assessment indicates that the provision of those services would assist the client to remain self-sufficient at the client’s principal residence or the provision of that care is necessary for health reasons.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="926923" lims:id="926923"><Label>(3)</Label><Text>The following amounts are not payable under this section:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926924" lims:id="926924"><Label>(a)</Label><Text>the amount by which the client’s monthly income as computed under section 31.2 exceeds the income factor applicable to the client under that section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926925" lims:id="926925"><Label>(b)</Label><Text>that part of the amount payable for intermediate care under these Regulations, calculated monthly, that is equal to the maximum monthly amount that the client is required to pay for the cost of accommodation and meals, as determined under section 33.1.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="926929" lims:id="926929"><Label>19</Label><Text>The veterans independence program consists of the following services:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926930" lims:id="926930"><Label>(a)</Label><Text>home care that is provided to or on behalf of a client at the client’s principal residence, namely,</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926931" lims:id="926931"><Label>(i)</Label><Text>health and support services by a health professional, such as nursing care, therapy and personal care,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926932" lims:id="926932"><Label>(ii)</Label><Text>personal care services by a person other than a health professional,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926933" lims:id="926933"><Label>(iii)</Label><Text>housekeeping services, namely, those tasks or domestic chores to assist with daily living, which services normally include only routine housekeeping unless the health and safety of the client is at risk,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926934" lims:id="926934"><Label>(iv)</Label><Text>access to nutrition services, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926935" lims:id="926935"><Label>(v)</Label><Text>maintenance of the grounds necessary to permit independent living at the principal residence, such as the mowing of lawns and the removal of ice, snow and leaves from the walkways, driveways and eavestroughs, providing:</Text><Clause lims:inforce-start-date="2006-03-22" lims:fid="926936" lims:id="926936"><Label>(A)</Label><Text>the maintenance is the responsibility of the client and would normally be performed by the client were the client’s ability to do so not impaired as a result of the health condition the assessment of which indicated the client’s eligibility for the service, and</Text></Clause><Clause lims:inforce-start-date="2006-03-22" lims:fid="926937" lims:id="926937"><Label>(B)</Label><Text>there are no relatives of the client living at the residence who are capable of performing such maintenance;</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926938" lims:id="926938"><Label>(b)</Label><Text>ambulatory health care, namely, health services such as health assessments, diagnostic services and social and recreational services that are provided by a health professional, and transportation between the client’s residence and the health centre or other similar facility where the health services are provided;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926939" lims:id="926939"><Label>(c)</Label><Text>transportation to foster independence and to enable a client to participate in social activities, if an assessment referred to in paragraph 15(2)(b), subparagraph 17(c)(ii) or paragraph 18(2)(d) indicates that</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926940" lims:id="926940"><Label>(i)</Label><Text>the client requires home care or ambulatory health care, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="926941" lims:id="926941"><Label>(ii)</Label><Text>social isolation is harmful to the client’s health;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926942" lims:id="926942"><Label>(d)</Label><Text>home adaptations to a client’s principal residence to enable the client to carry out the activities of daily living; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="926943" lims:id="926943"><Label>(e)</Label><Text>intermediate care in a community facility, other than in a contract bed.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="926945" lims:id="926945">SOR/93-309, s. 2; SOR/2003-362, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="926946" lims:id="926946" level="2"><TitleText>Costs</TitleText></Heading><Section lims:inforce-start-date="2008-02-26" lims:lastAmendedDate="2022-03-28" lims:fid="926947" lims:id="926947"><Label>20</Label><Subsection lims:inforce-start-date="2008-02-26" lims:fid="926948" lims:id="926948"><Label>(1)</Label><Text>Subject to subsection (1.1) and section 34, the maximum rates at which the costs of veterans independence program services are payable are the following:</Text><Paragraph lims:inforce-start-date="2008-02-26" lims:fid="926949" lims:id="926949"><Label>(a)</Label><Text lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="1342620" lims:id="1342846">for home care, $11,842.40 per client per year, which amount includes</Text><Subparagraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926950" lims:id="1342847"><Label>(i)</Label><Text>a maximum amount of $1,652.41 per year for maintenance of the grounds of the client’s principal residence, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-02-26" lims:fid="926951" lims:id="926951"><Label>(ii)</Label><Text>where the client is in receipt of an attendance allowance under subsection 38(1) of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, an amount for personal care services referred to in subparagraph 19(a)(ii) that is in respect of not more than one week in any year plus 52 days in that year;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926952" lims:id="1342848"><Label>(b)</Label><Text>for ambulatory health care, $1,377.02 per client per year;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926953" lims:id="1342849"><Label>(c)</Label><Text>for transportation, $1,652.41 per client per year;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926954" lims:id="1342850"><Label>(d)</Label><Text>for home adaptations, $6,775.43 per client per principal residence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926955" lims:id="1342851"><Label>(e)</Label><Text>for intermediate care, $165.91 per client per day.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="926956" lims:id="1342852"><Label>(1.1)</Label><Text>Subject to section 34, the maximum rate at which the costs of veterans independence services referred to in section 16.1 are payable is $3,198.80 per year, which amount includes the adjusted maximum amount referred to in subparagraph 20(1)(a)(i) per year for maintenance of the grounds of the client’s principal residence.</Text></Subsection><Subsection lims:inforce-start-date="2008-02-26" lims:fid="926957" lims:id="926957"><Label>(2)</Label><Text>The rates referred to in subsections (1) and (1.1) shall be adjusted in the same manner and on the same day as pensions are adjusted under Part V of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2008-02-26" lims:fid="926958" lims:id="926958"><Label>(3) to (5)</Label><Text><Repealed>[Repealed, SOR/98-386, s. section 33.1, a client who on August 31, 1990 was in receipt of adult residential care, intermediate care or chronic care in a departmental facility, as that term is defined in the regulations as they read on September 1, 1990, or in a contract bed is eligible to receive care in a contract bed after August 31, 1990 for as long as the client continues, without interruption, to need adult residential care, intermediate care or chronic care.</Text></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="926973" lims:id="926973"><Label>(3)</Label><Text>Subsection (2) does not apply to a client who is discharged from a departmental facility, as that term is defined in the regulations as they read on September 1, 1990, pursuant to section 26, as it read immediately before the coming into force of this subsection, or whose discharge from a contract bed is recommended pursuant to that section.</Text></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="926974" lims:id="926974"><Label>(4)</Label><Text>Subject to section 33.1, veterans described in paragraph (h) of the definition <DefinedTermEn>veteran</DefinedTermEn> in section 2 are eligible to receive intermediate care or chronic care in a contract bed if an assessment indicates that their health care needs have increased and that they require specialized care that cannot adequately be provided in a community facility other than in a contract bed.</Text></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="926975" lims:id="926975"><Label>(5)</Label><Text>Despite subsection (1), an income-qualified veteran or an overseas service veteran, who is an allied veteran described in paragraphs 37(4)(c.1) and (d.1) or subsection 37(4.1) or (4.2) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal> and who is not an allied veteran described in paragraph (g) of the definition <DefinedTermEn>veteran</DefinedTermEn> in after this section comes into force, are eligible to receive the cost to them of that care to the extent that it is not available to them as an insured service under a provincial health care insured service under a provincial health care system if they have applied to the Minister for admission to a contract bed and are not admitted because there is no vacancy in a contract bed within a lims:id="926986"><Label>22</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926987" lims:id="926987"><Label>(1)</Label><Text>Veteran pensioners, civilian pensioners and special duty service pensioners are eligible to receive, in respect of a war-related pensioned condition, the cost to them of chronic care</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926988" lims:id="926988"><Label>(a)</Label><Text>received in Canada in a community facility, other than in a contract bed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926989" lims:id="926989"><Label>(b)</Label><Text>received in a health care facility outside Canada that is of a standard equivalent to the care that would have been provided under paragraph (a), provided that the cost of such care does not exceed the usual cost of chronic care in the jurisdiction in which the care is received.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926990" lims:id="926990"><Label>(1.1)</Label><Text>Seriously disabled veteran pensioners and seriously disabled civilian pensioners are eligible to receive the cost to them of chronic care received in Canada in a community facility, other than in a contract bed, to the extent that the chronic care is not available to them as an insured service under a provincial health care system.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926991" lims:id="926991"><Label>(1.11)</Label><Text>Subject to section 33.1, a veteran pensioner or a civilian pensioner, in respect of whom the aggregate of all of their disability assessments under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> and the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal> is equal to or greater than 48%, is eligible to receive the cost to them of chronic care received in Canada in a community facility, other than in a contract bed, to the extent that the chronic care is not available as an insured service under a provincial health care system.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926992" lims:id="926992"><Label>(1.2)</Label><Text lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1119529" lims:id="1121985">Military service pensioners, former members and reserve force members are eligible to receive, in respect of a pensioned condition or a disability for which they are entitled to a disability award or entitled to pain and suffering compensation, the cost to them of chronic care</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926993" lims:id="926993"><Label>(a)</Label><Text>received in Canada in a community facility, other than in a contract bed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="926994" lims:id="926994"><Label>(b)</Label><Text>received in a health care facility outside Canada that is of a standard equivalent to the care that would have been provided under paragraph (a), provided that the cost of such care does not exceed the usual cost of chronic care in the jurisdiction in which the care is received.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="926995" lims:id="926995"><Label>(2)</Label><Text>Subject to section 33.1, income-qualified veterans, Canada service veterans and income-qualified civilians are eligible to receive the cost to them of chronic care received in Canada in a community facility, other than in a contract bed, to the extent 33.1, the following clients are eligible to receive chronic care in a community facility, other than in a contract bed, to the extent that the chronic care is not available to them as an insured service under a provincial health care system:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927001" lims:id="927001"><Label>(a)</Label><Text>veteran pensioners;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927002" lims:id="927002"><Label>(b)</Label><Text>overseas service veterans;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="927003" lims:id="1342860"><Label>(c)</Label><Text><Repealed>[Repealed, SOR/2022-69, s. 11]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927004" lims:id="927004"><Label>(d)</Label><Text>civilians; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927005" lims:id="927005"><Label>(e)</Label><Text>veterans to whom paragraphs (a) and (b) of the definition “Canada service veteran” in section 2 apply.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927006" lims:id="927006"><Label>(2)</Label><Text>Payments shall be made in respect of the care provided under subsection (1) to or in respect of a client referred to in that subsection for the period of 12 months commencing on October 1 of any year, or for any lesser period within those 12 months, if a determination in respect of that period has been made under section 31.2 that the client’s income is insufficient to enable the client to pay for that care.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927007" lims:id="927007"><Label>(3)</Label><Text>The following amounts are not payable under this section:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927008" lims:id="927008"><Label>(a)</Label><Text>the amount by which the client’s monthly income as computed under section 31.2 exceeds the income factor applicable to the client under that section; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927009" lims:id="927009"><Label>(b)</Label><Text>that part of the amount payable for chronic care under these Regulations, calculated monthly, that is equal to the maximum monthly amount that the client is required to pay for the cost of accommodation and meals, as lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="927014" lims:id="1342862"><Label>(1)</Label><Text>Subject to section 34, the maximum rate at which the cost of chronic care in a community facility other than in a contract bed is payable is $278.39 per client per day, as adjusted in accordance with subsection (2).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927015" lims:id="927015"><Label>(2)</Label><Text>The rate referred to in subsection (1) shall be adjusted in the same manner and on the same day as pensions are adjusted under Part V of the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:id="927021"><Label>(1)</Label><Text>Priority of admission to a contract bed shall be based on health need and, if the health needs of any clients are similar, admission shall be given to the clients in accordance with the following order of priority:</Text><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927022" lims:id="927022"><Label>(a)</Label><Text>first, to veteran pensioners who need care for a war-related pensioned condition;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927023" lims:id="927023"><Label>(b)</Label><Text>second, to veteran pensioners who are seriously disabled and to income-qualified veterans;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="927024" lims:id="1342864"><Label>(c)</Label><Text>third, to overseas service veterans; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927025" lims:id="927025"><Label>(d)</Label><Text>fourth, to veterans described in paragraph (h) of the definition “veteran” in section 2.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927026" lims:id="927026"><Label>(2)</Label><Text>Priority of receipt of benefits or care under section 21.1, 22 or 22.1 in respect of the same community facility shall be based on health need and, where the health needs of any clients are similar, priority shall be given in the following order:</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="927027" lims:id="1121995"><Label>(a)</Label><Text>first, to veteran pensioners, civilian pensioners, special duty service pensioners and military service pensioners who need care for a pensioned condition and former members and reserve force members who need care for a condition in respect of which they are entitled to a disability award or entitled to pain and suffering compensation;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927028" lims:id="927028"><Label>(b)</Label><Text>second, to veteran pensioners who are seriously disabled, to civilian pensioners who are seriously disabled, to veteran pensioners, to income-qualified veterans, to income-qualified civilians and to Canada service veterans;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="927029" lims:id="1342865"><Label>(c)</Label><Text>third, to overseas service lims:id="927043"><Label>28</Label><Text lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1119530" lims:id="1122066">A veteran pensioner, a civilian pensioner, a special duty service pensioner and a former member or reserve force member who has a disability for which they are entitled to a disability award or pain and suffering compensation in respect of special duty service is eligible to receive, in accordance with section 7, the costs of transportation in Canada of an escort if</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="927044" lims:id="927044"><Label>(a)</Label><Text>the escort accompanies the pensioner or member on an annual vacation or on other travel approved by the Minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="927045" lims:id="927045"><Label>(b)</Label><Text>the means of transportation is other than by automobile; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="927046" lims:id="927046"><Label>(c)</Label><Text>their pensioned condition or disability, as the case may be, is total blindness or one that otherwise lims:fid="927049" lims:id="927049"><Label>29</Label><Text>A client is eligible to receive in accordance with section 7, but subject to paragraph 34(2)(c), the costs of transportation in Canada incurred by them when they are transferred for medical reasons from one health care facility to another if they are eligible to receive care in a contract bed or are eligible to receive any part of the cost of intermediate care under Part II or chronic care under Part III.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-04-01" lims:fid="927051" lims:id="927051">SOR/93-309, s. 4; SOR/95-440, s. 9; SOR/98-386, s. 14(F); SOR/2016-31, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2013-01-01" lims:lastAmendedDate="2022-03-28" lims:fid="927052" lims:id="927052"><Label>30</Label><Text>When the following clients are critically ill and the client’s attending physician is of the opinion that a visit by their spouse or common-law partner, another family member or another person designated by the client would be beneficial to the health of the client, the spouse or common-law partner, other family member or other person is eligible to receive, in accordance with section 7, the costs of transportation in Canada incurred to visit the client:</Text><Paragraph lims:inforce-start-date="2013-01-01" lims:fid="927053" lims:id="927053"><Label>(a)</Label><Text>a client who is in receipt of intermediate care or chronic care under Part II or III; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="927054" lims:id="1342867"><Label>(b)</Label><Text>if in receipt of acute care in a hospital, a veteran pensioner, a civilian pensioner, a Newfoundland Special Award pensioner, a Red Cross pensioner, a flying accident pensioner, an income-qualified veteran, an income-qualified civilian, a Canada service veteran, a special duty service pensioner, a military service pensioner and a former member or reserve force member who is entitled to a disability award or entitled to pain and suffering compensation.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-01-01" lims:fid="927056" lims:id="927056">SOR/95-440, s. 9; SOR/2001-326, s. 10; level="2"><TitleText>Continuation of Benefits, Services and Care</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="927058" lims:id="927058"><Label>31</Label><Text>Where a client who is in receipt of any benefit, service or care under these Regulations ceases to be eligible for it, the benefit, service or care shall be continued for a reasonable period in order to allow the client to make alternate arrangements.</Text></Section><Section lims:inforce-start-date="2016-04-01" lims:lastAmendedDate="2022-03-28" lims:fid="927059" lims:id="927059"><Label>31.1</Label><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927060" lims:id="927060"><Label>(1)</Label><Text>Despite any other provision of these Regulations, an income-qualified veteran, income-qualified civilian or Canada service veteran who is in receipt of any benefit, service, care, premium or fee under paragraphs 3(3)(a) or (c) or 3(4)(c), subsection 15(2), section 17 or 17.1, subsection 21(1) or 22(2) or section 27 is eligible to receive that benefit, service, care, premium or fee for life, regardless of any change in the income of the veteran or civilian or their spouse or common-law partner, in the veteran’s or civilian’s income factor or in the class of recipient to which the veteran or civilian belongs, provided that the veteran or civilian continues to meet the requirements set out in the provision under which that benefit, service, care, premium or fee is received.</Text></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927061" lims:id="927061"><Label>(2)</Label><Text>Subject to subsection (3) but despite any other provision of these Regulations, a veteran or a civilian not referred to in subsection (1) who, at the time this section comes into force, is in receipt of any benefit, service, care, premium or fee referred to in that subsection is eligible to continue to receive that benefit, service, care, premium or fee for life, regardless of any change in the income of the veteran or civilian or their spouse or common-law partner, in the veteran’s or civilian’s income factor or in the class of recipient to which the veteran or civilian belongs, provided that the veteran or civilian otherwise continues to meet the requirements set out in the provision under which that benefit, service, care, premium or fee is received.</Text></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927062" lims:id="927062"><Label>(3)</Label><Text>Subsection (2) does not apply if the veteran or civilian</Text><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927063" lims:id="927063"><Label>(a)</Label><Text>is in receipt of the benefit, service, care, premium or fee solely in respect of a pensioned condition;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927064" lims:id="927064"><Label>(b)</Label><Text>is in receipt of the benefit, service, care, premium or fee solely as a result of being eligible to receive, in respect of a pensioned condition, another benefit, service, care, premium or fee under these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927065" lims:id="927065"><Label>(c)</Label><Text>is in receipt of the benefit, service, care, premium or fee as a result of a determination of insufficient income in accordance with paragraph 18(2)(c) or subsection 22.1(2); or</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="927066" lims:id="1342869"><Label>(d)</Label><Text>is in receipt of adult residential care, intermediate care or chronic care in a contract bed under paragraph 21(1)(a) or (c).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927067" lims:id="927067"><Label>(4)</Label><Text>A veteran or civilian who, under subsection (1) or (2), receives any benefit, service, care, premium or fee set out in a provision referred to in subsection (1) is deemed, for the purposes of any other provision in these Regulations, to receive it under the provision referred to in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927068" lims:id="927068"><Label>(5)</Label><Text>For the purposes of subsections (1) and (2), “income factor” and “class of recipient”, in relation to a veteran or civilian, means the income factor and class of recipient set out in the schedule to the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal> that are applicable to that person, or that would be applicable to that person if the person were a recipient under that Act.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-04-01" lims:fid="927070" lims:id="927070">SOR/2001-326, s. 11; SOR/2012-289, s. 11; SOR/2016-31, s. 10</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="1342870" lims:id="1342870" lims:enactId="1342534">SOR/2022-69, s. 15</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="927071" lims:id="927071" level="2"><TitleText>Determination of When Income Insufficient</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="927072" lims:id="927072"><Label>31.2</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927073" lims:id="927073"><Label>(1)</Label><Text>For the purposes of paragraph 18(2)(c) and subsection 22.1(2), a client’s income is considered to be insufficient in respect of the period of 12 months commencing on October 1 of any year or in respect of any lesser period within those 12 months if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927074" lims:id="927074"><Label>(a)</Label><Text>the amount by which</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="927075" lims:id="927075"><Label>(i)</Label><Text>the client’s monthly income, computed in accordance with subsection 33.1(5), for the month of July preceding those 12 months</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2006-03-22" lims:fid="927076" lims:id="927076"><Text>exceeds</Text></ContinuedParagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="927077" lims:id="927077"><Label>(ii)</Label><Text>the monthly cost of the services or care provided, or to be provided, under section 18 or 22.1,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2006-03-22" lims:fid="927078" lims:id="927078"><Text>is less than</Text></ContinuedParagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927079" lims:id="927079"><Label>(b)</Label><Text>the income factor applicable to the client under subsection (2) or (3) in respect of that month.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927080" lims:id="927080"><Label>(2)</Label><Text>Subject to subsection (3), the income factor applicable to a client for the purpose of paragraph (1)(b) is the income factor set out in column II of the schedule to the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal> that applies to the client for the month of July referred to in subparagraph (1)(a)(i), or that would apply if the client were a recipient under that Act during that month.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927081" lims:id="927081"><Label>(3)</Label><Text>Where subsection 4(6), (6.1) or (8) of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal> applies to a client, the income factor applicable to the client for the purpose of paragraph (1)(b) is the sum of the income factors set out in column II of the schedule to that Act that apply to the client and to the client’s spouse or common-law partner, for the month of July referred to in subparagraph (1)(a)(i), or that would apply if the client and the client’s spouse or common-law partner were recipients under that Act during that month.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="927083" lims:id="927083">SOR/2001-326, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="927084" lims:id="927084" level="2"><TitleText>Referrals</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="927085" lims:id="927085"><Label>32</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927086" lims:id="927086"><Label>(1)</Label><Text>Subject to subsection (2), where a person who is a member of the Canadian Forces is discharged and is hospitalized for a disability at the time of the discharge, the person is eligible to receive treatment benefits and supplementary benefits for the lesser of one year immediately following the discharge and a period that is equal to the person’s service in the Forces, if the Minister of National Defence requests that the benefits be extended to the person and agrees to reimburse the cost of the benefits to the Department of Veterans Affairs.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927087" lims:id="927087"><Label>(2)</Label><Text>Where benefits are extended in accordance with subsection (1), the costs of travel shall include travel from the hospital to the person’s selected place of residence if the costs of travel were payable by the Minister of National Defence at the time of the discharge.</Text></Subsection></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="927088" lims:id="927088" level="2"><TitleText>Costs recoverable from Third Parties</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="927089" lims:id="927089"><Label>33</Label><Text>The portion of the cost of any benefit, service or care mentioned herein that is recoverable from a third party is not payable under these Regulations.</Text></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="927090" lims:id="927090" level="2"><TitleText>Accommodation and Meals</TitleText></Heading><Section lims:inforce-start-date="2016-04-01" lims:lastAmendedDate="2022-03-28" lims:fid="927091" lims:id="927091"><Label>33.1</Label><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927092" lims:id="927092"><Label>(1)</Label><Text>A client, except a client referred to in subsection (2), is required to pay for the cost of accommodation and meals, up to a maximum monthly amount determined under this section, while the client is in receipt of adult residential care, intermediate care or chronic care in</Text><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927093" lims:id="927093"><Label>(a)</Label><Text><Repealed>[Repealed, SOR/2016-31, s. 11]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927094" lims:id="927094"><Label>(b)</Label><Text>a contract bed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927095" lims:id="927095"><Label>(c)</Label><Text>a community facility in which the cost of care is payable, in whole or in part, under these Regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927096" lims:id="927096"><Label>(2)</Label><Text>The following clients are not required to pay for the cost of accommodation and meals while in receipt of adult residential care, intermediate care or chronic care:</Text><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927097" lims:id="927097"><Label>(a)</Label><Text>clients who are in receipt of the care for a pensioned condition;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927098" lims:id="927098"><Label>(b)</Label><Text>veteran pensioners who are seriously disabled and civilian pensioners who are seriously disabled; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="927099" lims:id="1122022"><Label>(c)</Label><Text>a former member or reserve force member who is in receipt of the care for the disability for which they are entitled to a disability award or entitled to pain and suffering compensation.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927100" lims:id="927100"><Label>(3)</Label><Text>The maximum amount under subsection (1) for a month is the lesser of the following amounts:</Text><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927101" lims:id="927101"><Label>(a)</Label><Text>the maximum monthly accommodation and meal charge for that month, as calculated under subsection (4); and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927102" lims:id="927102"><Label>(b)</Label><Text>the amount, if any, remaining to the client after deducting from the client’s monthly income, as calculated under subsection (5), the client’s personal and family exemption amount, as calculated under subsection (6).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927103" lims:id="927103"><Label>(4)</Label><Text lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="1342621" lims:id="1342871">The maximum monthly accommodation and meal charge for any of the 12 months after September 30 of a year is the lesser of the following amounts:</Text><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927104" lims:id="927104"><Label>(a)</Label><Text>the lowest monthly user charge for accommodation and meals permitted by a province, under section 19 of the <XRefExternal reference-type="act" link="C-6">Canada Health Act</XRefExternal>, on July 1 of the same year; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927105" lims:id="927105"><Label>(b)</Label><Text>the maximum monthly accommodation and meal charge that applied immediately prior to October 1 of the same year, multiplied by the ratio that</Text><Subparagraph lims:inforce-start-date="2016-04-01" lims:fid="927106" lims:id="927106"><Label>(i)</Label><Text>the income factor specified in paragraph 2(a) of the schedule to the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal> that is effective on July 1 of the same year</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2016-04-01" lims:fid="927107" lims:id="927107"><Text>bears to</Text></ContinuedParagraph><Subparagraph lims:inforce-start-date="2016-04-01" lims:fid="927108" lims:id="927108"><Label>(ii)</Label><Text>the same income factor that was effective on July 1 of the preceding year.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927109" lims:id="927109"><Label>(5)</Label><Text>The client’s income for a month is the total of all amounts that are subtracted from the income factor in computing the client’s allowance payable for that month under subsection 4(3), (6), (6.1) or (8), as the case may be, of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>, or that would be so subtracted if the client were a recipient under that Act.</Text></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927110" lims:id="927110"><Label>(6)</Label><Text>The client’s personal and family exemption amount for any of the 12 months following September 30 of a year is the sum of the following amounts:</Text><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927111" lims:id="927111"><Label>(a)</Label><Text>the amount for personal comforts, which is equal to the amount for personal comforts that applies on September 30 of the same year, multiplied by the ratio referred to in paragraph (4)(b);</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927112" lims:id="927112"><Label>(b)</Label><Text>where the client has a spouse or common-law partner, an amount equal to the income factor set out in paragraph 2(a) of the schedule to the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal> that is effective on July 1 of the same year;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927113" lims:id="927113"><Label>(c)</Label><Text>where the client has a spouse or common-law partner and one or more dependent children within the meaning of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>, an amount for each such child equal to the income factor set out in item 4 of the schedule to that Act that is effective on July 1 of the same year; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927114" lims:id="927114"><Label>(d)</Label><Text>where the client does not have a spouse or common-law partner but has one or more dependent children within the meaning of the <XRefExternal reference-type="act" link="W-3">War Veterans Allowance Act</XRefExternal>,</Text><Subparagraph lims:inforce-start-date="2016-04-01" lims:fid="927115" lims:id="927115"><Label>(i)</Label><Text>an amount equal to the income factor set out in paragraph 3(a) of the schedule to that Act that is effective on July 1 of the same year, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-04-01" lims:fid="927116" lims:id="927116"><Label>(ii)</Label><Text>for each such child in addition to one, an amount equal to the income factor set out in item 4 of the schedule to that Act that is effective on July 1 of the same year.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-04-01" lims:fid="927117" lims:id="927117"><Label>(7)</Label><Text>The cost of accommodation and meals shall be paid by a client referred to in subsection (1) as follows:</Text><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927118" lims:id="927118"><Label>(a)</Label><Text>the client pays the cost directly to the community facility; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-04-01" lims:fid="927119" lims:id="927119"><Label>(b)</Label><Text>the cost is recovered by the Minister if the cost has been paid to the community facility by the Minister, in accordance with an arrangement with that facility.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="927120" lims:id="1342873"><Label>(8)</Label><Text>For the period beginning on October 1, 2021 and ending on September 30, 2022,</Text><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="1342874" lims:id="1342874"><Label>(a)</Label><Text>the maximum monthly accommodation and meal charge is $1,091.43 per month; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="1342875" lims:id="1342875"><Label>(b)</Label><Text>the amount for personal comforts is $263.62 per month.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-04-01" lims:fid="927124" 22</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2022-03-28" lims:enacted-date="2022-03-28" lims:fid="1342872" lims:id="1342872" lims:enactId="1342536">SOR/2022-69, s. 16</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="927125" lims:id="927125" level="2"><TitleText>Exceeding Rates</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="927126" lims:id="927126"><Label>34</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927127" lims:id="927127"><Label>(1)</Label><Text>The Minister shall authorize the payment of costs at a rate that is higher than a rate set out in section 20 or 23 if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927128" lims:id="927128"><Label>(a)</Label><Text>the higher rate is necessary in order to provide an appropriate standard of service or care;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927129" lims:id="927129"><Label>(b)</Label><Text>the higher rate is, in the opinion of the Minister, necessary on humanitarian grounds;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927130" lims:id="927130"><Label>(c)</Label><Text>no bed is available for less than the higher rate in any health care facility that is within a reasonable distance of the community in which the client is normally resident;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927131" lims:id="927131"><Label>(d)</Label><Text>the client is not accepted for the care the client requires by any health care facility that is within a reasonable distance of the community in which the client is normally resident and the rate at the nearest health care facility that will accept the client is higher than the rate set out in that section for that care; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927132" lims:id="927132"><Label>(e)</Label><Text>an agreement between the Minister and the health care facility or the province in which the health care facility is situated provides for a higher rate.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="927133" lims:id="927133"><Label>(2)</Label><Text>The Minister may authorize that no deduction under subsection 7(2) be made</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927134" lims:id="927134"><Label>(a)</Label><Text>if the client’s mobility or cognition is severely impaired;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927135" lims:id="927135"><Label>(b)</Label><Text>if the deduction would seriously impede the client’s ability to access treatment benefits; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927136" lims:id="927136"><Label>(c)</Label><Text>in the case of a transfer referred to in section 29.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-04-01" lims:fid="927139" lims:id="927139" level="2"><TitleText>Limitation on Reimbursements and Payments</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="927140" lims:id="927140"><Label>34.1</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="927141" lims:id="927141"><Label>(1)</Label><Text>Where a person incurs an expenditure to meet a health need, no reimbursement or payment shall be made under these Regulations to or in respect of the person except in accordance with this section.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="927142" lims:id="927142"><Label>(2)</Label><Text>Subject to subsections (4) to (6), reimbursement or payment shall be made if the person was eligible to receive benefits, services or care under these Regulations for that health need at the time that the expenditure was incurred.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="927143" lims:id="927143"><Label>(3)</Label><Text>Subject to subsections (4) to (6), reimbursement or payment shall be made if the person, within 90 days after incurring the expenditure, applies for a pension and</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="927144" lims:id="927144"><Label>(a)</Label><Text>the person is awarded the pension for the condition in respect of which the expenditure was incurred and would have been eligible to receive benefits, services or care in respect of that condition if the person had been entitled to the pension at the time the expenditure was incurred;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="927145" lims:id="927145"><Label>(b)</Label><Text>the person is awarded the pension and as a result qualifies as a seriously disabled veteran or seriously disabled civilian; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="927146" lims:id="927146"><Label>(c)</Label><Text>the person is awarded the pension and, as a result, qualifies as a veteran pensioner or civilian pensioner, if the aggregate of all of their disability assessments under the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal> and the <XRefExternal reference-type="act" link="C-16.8">Veterans Well-being Act</XRefExternal> is equal to or greater than 48%.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="927147" lims:id="927147"><Label>(4)</Label><Text>A claim for reimbursement or payment must be made by or on behalf of the person within 18 months of the day on which the expenditure was incurred.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="927148" lims:id="927148"><Label>(5)</Label><Text>Proof of the expenditure must be provided by the person or on the person’s behalf.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="927149" lims:id="927149"><Label>(6)</Label><Text>Subject to subsection 34(1), no reimbursement or payment shall exceed the maximum amount payable under these Regulations at the time the expenditure was incurred.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="927150" lims:id="927150"><Label>(7)</Label><Text>This section does not apply to a claim in respect of the services referred to in subparagraph 19(a)(iii) or (v). or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="927157" lims:id="927157"><Label>(c)</Label><Text>to the client and the third party jointly.</Text></Paragraph></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="927158" lims:id="927158" level="2"><TitleText>Notice of Decisions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="927159" lims:id="927159"><Label>35.1</Label><Text>The Minister shall notify a client or the client’s representative of any decision relating to the award, increase, decrease, suspension or cancellation of any benefit under these Regulations concerning or affecting the client.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="927161" lims:id="927161">SOR/98-386, s. 17</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-04-01" lims:fid="927162" lims:id="927162" level="2"><TitleText>Review of Decisions</TitleText></Heading><Section lims:inforce-start-date="2009-07-30" lims:lastAmendedDate="2009-07-30" lims:fid="927163" lims:id="927163"><Label>36</Label><Subsection lims:inforce-start-date="2009-07-30" lims:fid="927164" lims:id="927164"><Label>(1)</Label><Text>A person who is dissatisfied with any decision made under these Regulations may, within 60 days after receiving notice of the decision or, where circumstances beyond the control of the person necessitate a longer period, within that longer period, apply in writing to the Minister for a review of that decision by an official of the Department of Veterans Affairs other than the official who made the original decision.</Text></Subsection><Subsection lims:inforce-start-date="2009-07-30" lims:fid="927165" lims:id="927165"><Label>(2)</Label><Text>Where a person is dissatisfied with the results of a review referred to in subsection (1), the person may, within 60 days after receiving notice of the decision on the review unless circumstances beyond the control of the applicant necessitate a longer period, apply in writing to the Minister for a final decision to be rendered by an official of the Department of Veterans Affairs other than the official who made the original decision or who reviewed it.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-07-30" lims:fid="927167" lims:id="927167">SOR/98-386, s. 18;
