KENNETH MOORE</SignatureName><SignatureTitle justification="right"><Emphasis style="italic">Chief Justice of the Court of Queen’s Bench of Alberta</Emphasis></SignatureTitle></SignatureBlock></Provision></Order><Body lims:inforce-start-date="2006-03-22" lims:fid="916476" lims:id="916476"><Heading lims:inforce-start-date="2006-03-22" lims:fid="916477" lims:id="916477" level="1"><TitleText>Short Title</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916478" lims:id="916478"><Label>1</Label><Text>These Rules may be cited as the <XRefExternal reference-type="regulation" link="SOR-88-599">Alberta Rules of Practice Respecting Reduction in the Number of Years of Imprisonment Without Eligibility for Parole</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="916479" lims:id="916479" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916480" lims:id="916480"><Label>2</Label><Text>In these Rules,</Text><Definition lims:inforce-start-date="2006-03-22" lims:fid="916481" lims:id="916481" generate-in-text="no"><Text><DefinedTermEn>applicant</DefinedTermEn> means a person who makes an application and includes, according to the context, counsel acting for that person; (<DefinedTermFr>demandeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="916482" lims:id="916482" generate-in-text="no"><Text><DefinedTermEn>application</DefinedTermEn> means an application made by an applicant pursuant to subsection 672(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>; (<DefinedTermFr>demande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="916483" lims:id="916483" generate-in-text="no"><Text><DefinedTermEn>Attorney General</DefinedTermEn> means the Attorney General of Alberta and includes counsel acting for the Attorney General; (<DefinedTermFr>procureur général</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="916484" lims:id="916484" generate-in-text="no"><Text><DefinedTermEn>Chief Justice</DefinedTermEn> means the Chief Justice of the Court of Queen’s Bench of Alberta; (<DefinedTermFr>juge en chef</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="916485" lims:id="916485" generate-in-text="no"><Text><DefinedTermEn>clerk</DefinedTermEn> means, in respect of an application, the clerk of the Court of Queen’s Bench of Alberta for the judicial district in which the sentence that is the subject of the application was imposed; (<DefinedTermFr>greffier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="916486" lims:id="916486" generate-in-text="no"><Text><DefinedTermEn>judge</DefinedTermEn> means the judge of the Court of Queen’s Bench of Alberta designated by the Chief Justice to empanel a jury pursuant to subsection 672(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> in respect of an application. (<DefinedTermFr>juge</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="916487" lims:id="916487" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916488" lims:id="916488"><Label>3</Label><Text>An application shall be in writing and shall contain</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916489" lims:id="916489"><Label>(a)</Label><Text>the applicant’s given names, surname and any other names the applicant may have used and the applicant’s date of birth;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916490" lims:id="916490"><Label>(b)</Label><Text>the name and place of the institution in which the applicant is detained;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916491" lims:id="916491"><Label>(c)</Label><Text>the offence that is the subject of the application, the date of conviction and the sentence imposed;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916492" lims:id="916492"><Label>(d)</Label><Text>the length of time the applicant has been imprisoned for the offence that is the subject of the application;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916493" lims:id="916493"><Label>(e)</Label><Text>the grounds to be relied on in support of the application;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916494" lims:id="916494"><Label>(f)</Label><Text>a statement of the relief sought;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916495" lims:id="916495"><Label>(g)</Label><Text>the applicant’s address for service; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916496" lims:id="916496"><Label>(h)</Label><Text>an outline of any evidence that the applicant intends to present at the hearing of the application.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916497" lims:id="916497"><Label>4</Label><Text>An application shall be filed with the clerk.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916498" lims:id="916498"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="916499" lims:id="916499"><Label>(1)</Label><Text>An applicant shall cause the applicant’s application to be served on</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916500" lims:id="916500"><Label>(a)</Label><Text>the Attorney General;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916501" lims:id="916501"><Label>(b)</Label><Text>the Solicitor General of Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916502" lims:id="916502"><Label>(c)</Label><Text>the officer in charge of the institution in which the applicant is detained.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="916503" lims:id="916503"><Label>(2)</Label><Text>Service of an application may be effected by registered mail, in which case it shall be deemed to have been effected on the tenth day after the day on which it was mailed.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="916504" lims:id="916504"><Label>(3)</Label><Text>Proof of service of an application may be established by filing with the clerk an affidavit of the person who effected the service or by any other means satisfactory to the clerk.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="916505" lims:id="916505"><Label>(4)</Label><Text>The Solicitor General of Canada and the officer in charge of the institution in which an applicant is detained shall not be parties to the application.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916506" lims:id="916506"><Label>6</Label><Text>Where a clerk receives proof of service of an application in accordance with section 5, the clerk shall deliver the application and the proof of service of the application to the Chief Justice who shall forward the application and the proof of service of the application to the judge.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916507" lims:id="916507"><Label>7</Label><Text>On receipt of an application, the judge may, on the judge’s own initiative or on the request of the Attorney General, dismiss the application where the judge determines that subsection 672(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> does not apply to the applicant.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916508" lims:id="916508"><Label>8</Label><Text>In respect of an application, the judge shall make all necessary arrangements with the applicant and the Attorney General for the conduct of the hearing, including the fixing of the date for the empanelling of a jury and the hearing of the application.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="916509" lims:id="916509" level="1"><TitleText>Orders</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916510" lims:id="916510"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="916511" lims:id="916511"><Label>(1)</Label><Text>In addition to any other order that a judge may make, the judge may make an order</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916512" lims:id="916512"><Label>(a)</Label><Text>requiring the Attorney General to file a general outline of the evidence that the Attorney General intends to present at the hearing of an application;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916513" lims:id="916513"><Label>(b)</Label><Text>permitting the proof of facts by affidavit; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916514" lims:id="916514"><Label>(c)</Label><Text>requiring that an applicant be brought before the court.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="916515" lims:id="916515"><Label>(2)</Label><Text>Where a judge makes an order pursuant to paragraph (1)(b), the judge may, on application, require the attendance of the deponent at or prior to the hearing of the application for the purpose of cross-examination on the affidavit.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="916516" lims:id="916516"><Label>(3)</Label><Text>Where a judge makes an order pursuant to paragraph (1)(c), section 460 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> applies with such modifications as the circumstances require.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="916517" lims:id="916517" level="1"><TitleText>Hearing of Applications</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916518" lims:id="916518"><Label>10</Label><Text>A jury referred to in subsection 672(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> shall be empanelled in accordance with Part XVII of that Code with such modifications as the circumstances require.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916519" lims:id="916519"><Label>11</Label><Text>No person other than the applicant and the Attorney General may present evidence at the hearing of an application.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916520" lims:id="916520"><Label>12</Label><Text>At the hearing of an application, the applicant shall present evidence first and may, if the judge so permits, present rebuttal evidence after the evidence of the Attorney General is presented.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916521" lims:id="916521"><Label>13</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="916522" lims:id="916522"><Label>(1)</Label><Text>A duly certified transcript of the proceedings at the trial and sentencing of the applicant shall be admissible in evidence at the hearing of an application.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="916523" lims:id="916523"><Label>(2)</Label><Text>At the hearing of an application, the judge shall rule on the admissibility of any evidence.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916524" lims:id="916524"><Label>14</Label><Text>Where, at any time before or after the commencement of the hearing of an application, the judge determines that subsection 672(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> does not apply to the applicant, the judge shall dismiss the application and discharge the jury.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916525" lims:id="916525"><Label>15</Label><Text>After the evidence is presented at the hearing of an application, the applicant, followed by the Attorney General, shall address the jury.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916526" lims:id="916526"><Label>16</Label><Text>The judge, at the hearing of an application, shall address the jury after the address to the jury, if any, by the applicant and the Attorney General.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="916527" lims:id="916527" level="1"><TitleText>Orders and Directions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="916528" lims:id="916528"><Label>17</Label><Text>A judge may make any orders or give any directions that the judge considers necessary for the due hearing and disposition of an application, including, without restricting the generality of the foregoing, orders or directions with respect to</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916529" lims:id="916529"><Label>(a)</Label><Text>the extension or the abridgement of a time period;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916530" lims:id="916530"><Label>(b)</Label><Text>the sufficiency of an application or any affidavit relating to an application;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916531" lims:id="916531"><Label>(c)</Label><Text>the service and the proof of service of any document in relation to an application; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="916532" lims:id="916532"><Label>(d)</Label><Text>the adjournment of the hearing of an application.</Text></Paragraph></Section></Body></Regulation>
