(<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889101" lims:id="889101" generate-in-text="no"><Text><DefinedTermEn>applicant</DefinedTermEn> means a person who applies for a licence; (<DefinedTermFr>demandeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889102" lims:id="889102" generate-in-text="no"><Text><DefinedTermEn>carrier</DefinedTermEn> means a person who, pursuant to the <XRefExternal reference-type="regulation" link="SOR-86-1064">Transportation of Goods Regulations</XRefExternal>, is authorized to transport goods or to cause goods to be transported; (<DefinedTermFr>transitaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="889103" lims:id="889103" generate-in-text="no"><Text><DefinedTermEn>chief officer of customs</DefinedTermEn>, with respect to a sufferance warehouse or a proposed sufferance warehouse, means the manager of the customs office or customs offices that serve the area in which the sufferance warehouse is located or is proposed to be located; (<DefinedTermFr>contenant spécial</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889115" lims:id="889115">SOR/96-152, s. 1; SOR/2005-211, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889116" lims:id="889116" level="1"><Label>PART I</Label><TitleText>Licensing of Sufferance Warehouses</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="889117" lims:id="889117" level="2"><TitleText>Issuance of Licence</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-10-21" lims:fid="889118" lims:id="889118"><Label>3</Label><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="889119" lims:id="1492697"><Label>(1)</Label><Text>For the purposes of section 24 of the Act and subject to subsection (3), the Minister may issue a licence to any person who makes an application for a licence in accordance with subsection (2) and gives the security required under section 4.</Text></Subsection><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="889120" lims:id="1492698"><Label>(2)</Label><Text>An application for a licence must be submitted to the Minister in the prescribed form, together with a detailed plan of the proposed sufferance warehouse.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889121" lims:id="889121"><Label>(2.1)</Label><Text>The plan referred to in subsection (2) must indicate</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889122" lims:id="889122"><Label>(a)</Label><Text>whether the place proposed to be operated as a sufferance warehouse exists or is to be constructed;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889123" lims:id="889123"><Label>(b)</Label><Text>the type of construction of the place, whether or not it already exists; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889124" lims:id="889124"><Label>(c)</Label><Text>the area, within the place, that is to be used for the storage of goods.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889125" lims:id="889125"><Label>(3)</Label><Text>The Minister shall not issue a licence to an applicant unless</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889126" lims:id="889126"><Label>(a)</Label><Text>the applicant is of good character;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889127" lims:id="889127"><Label>(b)</Label><Text><Repealed>[Repealed, SOR/95-177, s. 1]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889128" lims:id="889128"><Label>(c)</Label><Text>the applicant has sufficient financial resources to enable him to provide the facilities, equipment, personnel and services required under sections 11 to 13 and to lease or purchase the proposed sufferance warehouse;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889129" lims:id="889129"><Label>(d)</Label><Text>the volume and nature of business in the area in which the applicant proposes to operate a sufferance warehouse is such that a sufferance warehouse is needed to serve the importers in that area;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889130" lims:id="889130"><Label>(e)</Label><Text>the site of the proposed sufferance warehouse is within a reasonable distance from major transportation routes and a customs office;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889131" lims:id="889131"><Label>(f)</Label><Text>the proposed sufferance warehouse contains adequate space for the storage of imported goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889132" lims:id="889132"><Label>(g)</Label><Text>the structure of the proposed sufferance warehouse will be suitable for the operation of a sufferance warehouse; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889133" lims:id="889133"><Label>(h)</Label><Text>the Agency is able to provide customs services with respect to the proposed sufferance warehouse.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889134" lims:id="889134"><Label>(4)</Label><Text><Repealed>[Repealed, SOR/95-177, s. 1]</Repealed></Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889136" lims:id="889136">SOR/88-85, s. 1(F); SOR/95-177, s. 1; SOR/96-38, s. 1; SOR/2005-211, s. 6</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="1492699" lims:id="1492699" lims:enactId="1447745">SOR/2024-41, s. 37</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889137" lims:id="889137" level="2"><TitleText>Security</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-10-21" lims:fid="889138" lims:id="889138"><Label>4</Label><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="889139" lims:id="1492700"><Label>(1)</Label><Text>An applicant must, before a licence is issued to the applicant, give security in accordance with the requirements of the <XRefExternal reference-type="regulation" link="SOR-2024-42">Financial Security (Electronic Means) Regulations</XRefExternal> and in an amount determined by the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889140" lims:id="889140"><Label>(2)</Label><Text>The Minister may at any time require a licensee to increase the amount of security given under subsection (1) to an amount sufficient to ensure the payment of any duties payable in respect of goods stored in the sufferance warehouse.</Text></Subsection><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="889141" lims:id="1492701"><Label>(3)</Label><Text><Repealed>[Repealed, SOR/2024-41, s. 38]</Repealed></Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889152" lims:id="889152">SOR/91-274, Part III; SOR/95-177, s. 2; SOR/96-38, s. 2; SOR/2001-197, s. 5</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="1492702" lims:id="1492702" lims:enactId="1447747">SOR/2024-41, s. 38</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:lastAmendedDate="2024-10-21" lims:fid="889154" lims:id="1492703"><Label>5</Label><Text><Repealed>[Repealed, SOR/2024-41, s. 39]</Repealed></Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889163" lims:id="889163" level="2"><TitleText>Amendment of Licence</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889164" lims:id="889164"><Label>6</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889165" lims:id="889165"><Label>(1)</Label><Text>The Minister may amend a licence only for the following purposes:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889166" lims:id="889166"><Label>(a)</Label><Text>subject to subsection (2),</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889167" lims:id="889167"><Label>(i)</Label><Text>to change a restriction specified in the licence regarding the classes of goods that may be received in the sufferance warehouse in respect of which the licence was issued, or to specify such a restriction, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889168" lims:id="889168"><Label>(ii)</Label><Text>to change the circumstances specified in the licence in which goods may be received in the sufferance warehouse, or to specify such circumstances; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889169" lims:id="889169"><Label>(b)</Label><Text>to change the name of the licensee, where the name of the licensee is changed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889170" lims:id="889170"><Label>(2)</Label><Text>The Minister may amend a licence for the purposes set out in subparagraph (1)(a)(i) or (ii) only where he gives to the licensee 90 days notice of the proposed amendment.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889171" lims:id="889171" level="2"><TitleText>Cancellation or Suspension of Licence</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889172" lims:id="889172"><Label>7</Label><Text>The Minister may cancel a licence where the licensee</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889173" lims:id="889173"><Label>(a)</Label><Text>no longer owns or leases the place that is licensed as a sufferance warehouse;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889174" lims:id="889174"><Label>(b)</Label><Text>requests the Minister in writing to cancel the licence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889175" lims:id="889175"><Label>(c)</Label><Text>is bankrupt.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889176" lims:id="889176"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889177" lims:id="889177"><Label>(1)</Label><Text>Subject to section 9, the Minister may suspend or cancel a licence where the licensee</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889178" lims:id="889178"><Label>(a)</Label><Text>is the subject of a receivership in respect of his debts;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889179" lims:id="889179"><Label>(b)</Label><Text>fails to comply with any Act of Parliament, or any regulation made pursuant thereto, that prohibits, controls or regulates the importation or exportation of goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889180" lims:id="889180"><Label>(c)</Label><Text><Repealed>[Repealed, SOR/95-177, s. 4]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889181" lims:id="889181"><Label>(d)</Label><Text>has, in the course of his operation of the sufferance warehouse, acted dishonestly in his business dealings with customs brokers, importers, carriers, Her Majesty or servants of Her Majesty; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889182" lims:id="889182"><Label>(e)</Label><Text>has been incompetent in the operation of the sufferance warehouse.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889183" lims:id="889183"><Label>(2)</Label><Text>Subject to section 9, the Minister may cancel a licence where</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889184" lims:id="889184"><Label>(a)</Label><Text>the volume of goods being received in the sufferance warehouse is no longer sufficient to warrant the continued operation;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889185" lims:id="889185"><Label>(b)</Label><Text>there is no longer a need for a sufferance warehouse in the area in which the sufferance warehouse is located; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889186" lims:id="889186"><Label>(c)</Label><Text>the Agency is no longer able to provide customs services with respect to the sufferance warehouse.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889188" lims:id="889188">SOR/95-177, s. 4; SOR/2005-211, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889189" lims:id="889189"><Label>9</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889190" lims:id="889190"><Label>(1)</Label><Text>The Minister shall, immediately after suspending a licence, give to the licensee a notice confirming the suspension and providing all relevant information concerning the grounds on which the Minister has suspended the licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889191" lims:id="889191"><Label>(2)</Label><Text>The licensee may, within 90 days after the day on which the licence is suspended, make representations to the Minister regarding why the licence should be reinstated.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889192" lims:id="889192"><Label>(3)</Label><Text>The Minister shall, before cancelling a licence under section 8, give the licensee 90 days notice of the proposed cancellation and provide the licensee with all relevant information concerning the grounds on which the Minister proposes to cancel the licence.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889193" lims:id="889193"><Label>(4)</Label><Text>The licensee may, within 90 days after the day on which the notice referred to in subsection (3) is given, make representations to the Minister regarding why the licence should not be cancelled.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889195" lims:id="889195">SOR/95-177, s. 5; SOR/96-152, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889196" lims:id="889196" level="2"><TitleText>Reinstatement of Licence</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889197" lims:id="889197"><Label>10</Label><Text>The Minister may reinstate a suspended licence where the Minister is satisfied that the cause for the suspension no longer exists.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889198" lims:id="889198" level="1"><Label>PART II</Label><TitleText>Operation of Sufferance Warehouses</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="889199" lims:id="889199" level="2"><TitleText>Facilities, Equipment and Personnel</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889201" lims:id="889201">SOR/96-38, s. 3</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889202" lims:id="889202"><Label>11</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889203" lims:id="889203"><Label>(1)</Label><Text>Every licensee shall provide, at the sufferance warehouse in respect of which his licence was issued</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889204" lims:id="889204"><Label>(a)</Label><Text>washroom facilities and offices for the use of officers, and the heat, light and cleaning services necessary for those facilities and offices, where so requested by the chief officer of customs;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889205" lims:id="889205"><Label>(b)</Label><Text>adequate space for the examination of imported goods by officers;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889206" lims:id="889206"><Label>(c)</Label><Text>the personnel and equipment necessary to ensure that the goods to be examined by an officer are made available to the officer for examination;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889207" lims:id="889207"><Label>(d)</Label><Text>a detention compound or parking area for the storage of imported goods that are held in a conveyance, where so requested by the chief officer of customs; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889208" lims:id="889208"><Label>(e)</Label><Text>facilities, equipment and personnel sufficient to control access to the sufferance warehouse and provide secure storage of the goods stored in it, including</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889209" lims:id="889209"><Label>(i)</Label><Text>doors and other building components of sturdy construction,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889210" lims:id="889210"><Label>(ii)</Label><Text>secure locks on doors and windows,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889211" lims:id="889211"><Label>(iii)</Label><Text>signs that indicate the security requirements applicable to the premises, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="889212" lims:id="889212"><Label>(iv)</Label><Text>where the sufferance warehouse will be used for the storage of designated goods, such additional facilities and equipment as may be required to ensure the secure storage of those goods.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889213" lims:id="889213"><Label>(2)</Label><Text>Where a sufferance warehouse is restricted by the terms and conditions of its licence to the receipt of goods arriving by motor vehicles used for commercial purposes, the licensee may lease space to any carrier who has requested space for his exclusive use in the operation of a separate sufferance warehouse.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889215" lims:id="889215">SOR/95-177, s. 6; SOR/96-38, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889216" lims:id="889216" level="2"><TitleText>Operation and Maintenance Standards</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889217" lims:id="889217"><Label>12</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889218" lims:id="889218"><Label>(1)</Label><Text>Every licensee shall ensure that the goods received in the sufferance warehouse are stored safely and securely in the area designated for that purpose in the plan referred to in subsection 3(2).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889219" lims:id="889219"><Label>(2)</Label><Text>No person, other than the licensee, an employee of the licensee or an employee of a carrier engaged in the delivery of goods to or the removal of goods from the sufferance warehouse, shall enter any place in it where goods are stored, without the written authorization or the attendance of an officer.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889220" lims:id="889220"><Label>(3)</Label><Text>Every licensee shall have in place</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889221" lims:id="889221"><Label>(a)</Label><Text>procedures to maintain the security of, and restrict access to, the sufferance warehouse; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="889222" lims:id="889222"><Label>(b)</Label><Text>procedures to ensure that personnel working in the sufferance warehouse are aware of and follow the procedures referred to in paragraph (a).</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889224" lims:id="889224">SOR/96-38, s. 5; SOR/2005-211, s. 2(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889225" lims:id="889225"><Label>13</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889226" lims:id="889226"><Label>(1)</Label><Text>Every licensee shall make a schedule of the charges payable for the services offered by the licensee and shall make the schedule available for examination by any person who requests to see it.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889227" lims:id="889227"><Label>(2)</Label><Text>Any facilities, services, personnel and equipment provided by a licensee to an officer under any of paragraphs 11(1)(a) to (c) shall be provided free of charge.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889229" lims:id="889229">SOR/95-177, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889230" lims:id="889230" level="2"><TitleText>Receipt and Refusal of Goods</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889232" lims:id="889232">SOR/95-519, s. 4</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2015-05-06" lims:lastAmendedDate="2015-05-06" lims:fid="889233" lims:id="889233"><Label>14</Label><Subsection lims:inforce-start-date="2015-05-06" lims:fid="889234" lims:id="889234"><Label>(1)</Label><Text>Every licensee shall acknowledge the receipt of goods in the sufferance warehouse by electronic means.</Text></Subsection><Subsection lims:inforce-start-date="2015-05-06" lims:fid="889235" lims:id="889235"><Label>(2)</Label><Text>However, if the goods were transported to Canada by or on behalf of a courier and will be released under subsection 32(4) of the Act before the accounting required under subsection 32(1) of the Act and the payment of duties, the licensee shall acknowledge the receipt of the goods in the sufferance warehouse by</Text><Paragraph lims:inforce-start-date="2015-05-06" lims:fid="889236" lims:id="889236"><Label>(a)</Label><Text>endorsing the bill of lading, waybill or similar document presented by the carrier;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-06" lims:fid="889237" lims:id="889237"><Label>(b)</Label><Text>endorsing the customs document on which the goods were reported under the <XRefExternal reference-type="regulation" link="SOR-86-873">Reporting of Imported Goods Regulations</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-05-06" lims:fid="889238" lims:id="889238"><Label>(c)</Label><Text>issuing a transfer document to the carrier.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-05-06" lims:fid="889239" lims:id="889239"><Label>(3)</Label><Text>For the purposes of subsection (2), <DefinedTermEn>courier</DefinedTermEn> has the same meaning as in section 2 of the <XRefExternal reference-type="regulation" link="SOR-95-418">Persons Authorized to Account for Casual Goods Regulations</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-05-06" lims:fid="889241" lims:id="889241">SOR/2015-90, s. 21</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889242" lims:id="889242"><Label>14.1</Label><Text>A licensee may refuse goods that are brought to the sufferance warehouse for safe-keeping when the storage of the goods is requested by or on behalf of a person who has an unpaid account for storage fees at the sufferance warehouse.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889244" lims:id="889244">SOR/95-519, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="889245" lims:id="889245"><Label>14.2</Label><Text><Repealed>[Repealed, SOR/2005-211, s. 3]</Repealed></Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="889246" lims:id="889246" level="2"><TitleText>Time Limits</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2024-10-21" lims:fid="889247" lims:id="889247"><Label>15</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889248" lims:id="889248"><Label>(1)</Label><Text>Subject to subsections (2) to (4.1), if goods in a sufferance warehouse have not been removed from the sufferance warehouse within 40 days after the day on which the goods were reported under section 12 of the Act, the goods may, at the end of that limitation period, be deposited in a place of safe-keeping as provided for in subsection 37(1) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889249" lims:id="889249"><Label>(2)</Label><Text>Where perishable goods in a sufferance warehouse have not been removed therefrom within four days after the day on which they were reported under section 12 of the Act, the goods may be deposited in a place of safe-keeping as provided for in subsection 37(1) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2024-10-21" lims:enacted-date="2024-03-01" lims:fid="889250" lims:id="1492705"><Label>(3)</Label><Text>If goods in a sufferance warehouse are <DefinitionRef>nuclear substances</DefinitionRef> as defined in section 2 of the <XRefExternal reference-type="act" link="N-28.3">Nuclear Safety and Control Act</XRefExternal> or <DefinitionRef>prescribed equipment</DefinitionRef> as defined in section 1 of the <XRefExternal reference-type="regulation" link="SOR-2000-202">General Nuclear Safety and Control Regulations</XRefExternal> and have not been removed from that warehouse within 14 days after the day on which the goods are reported under section 12 of the Act, the goods may be deposited in a place of safe-keeping as provided for in subsection 37(1) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2022-10-01" lims:enacted-date="2022-06-23" lims:fid="889251" lims:id="1376982"><Label>(4)</Label><Text>For the purposes of subsection 39.1(1) of the Act, firearms, prohibited ammunition, prohibited devices, prohibited or restricted weapons, tobacco products and vaping products are goods of a prescribed class that are forfeit if they are not removed from a sufferance warehouse within 14 days after the day on which they were reported under section 12 of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889252" lims:id="889252"><Label>(4.1)</Label><Text>For the purposes of subsection 39.1(1) of the Act, spirits are goods of a prescribed class that are forfeit if they are not removed from a sufferance warehouse within 21 days after the day on which they were reported under section 12 of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="889253" lims:id="889253"><Label>(5)</Label><Text>Every licensee shall provide the Agency with a list of all goods not removed from the sufferance warehouse within the time limit prescribed in subsection (1), (2), (3), (4) or (4.1), as the case may be, on the first business day following the end of that period.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="889255" lims:id="889255">SOR/95-519, s. 4;
