(<DefinedTermFr>accident</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886965" lims:id="886965" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="S-9">Canada Shipping Act</XRefExternal>; (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886966" lims:id="886966" generate-in-text="no"><Text><DefinedTermEn>Canadian radio ship reporting station</DefinedTermEn> means a Canadian Coast Guard radio station or a Canadian Vessel Traffic Service Centre of the Department of Transport, a Canadian marine radio station operated by the St. Lawrence Seaway Authority or a Canadian harbour radio station; (<DefinedTermFr>station de radiocommunications maritime canadienne</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886967" lims:id="886967" generate-in-text="no"><Text><DefinedTermEn>dangerous occurrence</DefinedTermEn> includes an event involving</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886968" lims:id="886968"><Label>(a)</Label><Text>the breakage or malfunction of any rigging, structure or machinery on a ship or belonging to a ship that could have caused serious injury or loss of life, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886969" lims:id="886969"><Label>(b)</Label><Text>a situation which could have resulted in a casualty or accident; (<DefinedTermFr>événement dangereux</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="886970" lims:id="886970" generate-in-text="no"><Text><DefinedTermEn>shipping casualty</DefinedTermEn> means a shipping casualty described in section 541 of the Act. (<DefinedTermFr>sinistre maritime</DefinedTermFr>)</Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="886972" lims:id="886972">SOR/85-1088, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="886973" lims:id="886973" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="886974" lims:id="886974"><Label>3</Label><Text>These Regulations apply to all ships in Canadian waters and to all Canadian ships in any waters.</Text></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="886975" lims:id="886975" level="1"><TitleText>Preliminary Report</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="886976" lims:id="886976"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="886977" lims:id="886977"><Label>(1)</Label><Text>Where a ship, or a vessel being towed by a ship, is involved in a shipping casualty, an accident or a dangerous occurrence, the master, any certificated officer, operator, member of the crew, pilot or person responsible for the ship, or the vessel being towed, shall report the incident without delay in accordance with subsections (2) and (3).</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="886978" lims:id="886978"><Label>(2)</Label><Text>Subject to subsection (3), the report referred to in subsection (1) shall be made without delay</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886979" lims:id="886979"><Label>(a)</Label><Text>by radio communication to a Canadian radio ship reporting station, where the shipping casualty, accident or dangerous occurrence takes place in Canadian waters or on a voyage to or from a Canadian port or alongside a port facility in a Canadian port; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886980" lims:id="886980"><Label>(b)</Label><Text>where the shipping casualty, accident or dangerous occurrence takes place outside the range of a Canadian radio ship reporting station, to</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="886981" lims:id="886981"><Label>(i)</Label><Text>any other radio ship reporting station,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="886982" lims:id="886982"><Label>(ii)</Label><Text>a chief officer of customs or the superintendent of a mercantile marine office, if the location is in a Commonwealth country other than Canada, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="886983" lims:id="886983"><Label>(iii)</Label><Text>a Canadian consular officer, if the location is a place other than a place referred to in subparagraph (ii).</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="886984" lims:id="886984"><Label>(3)</Label><Text>Where the report referred to in subsection (1) cannot be communicated by radio from a ship while it is in a Canadian port, the shipping casualty, accident or dangerous occurrence shall be reported by telephone to the local Canadian radio ship reporting station, or to the Canadian Coast Guard Operations Centre of the Department of Transport in Ottawa.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="886985" lims:id="886985"><Label>(4)</Label><Text>The report referred to in subsection (1) shall indicate</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886986" lims:id="886986"><Label>(a)</Label><Text>the identity of the ship from which the report is being made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886987" lims:id="886987"><Label>(b)</Label><Text>the nature of the incident;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886988" lims:id="886988"><Label>(c)</Label><Text>the identity of the ship or ships involved in the incident;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886989" lims:id="886989"><Label>(d)</Label><Text>the date, time and location of the incident;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886990" lims:id="886990"><Label>(e)</Label><Text>the number of persons killed, missing or injured as a result of the incident;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886991" lims:id="886991"><Label>(f)</Label><Text>whether a pilot is on board the ship or ships involved in the incident; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="886992" lims:id="886992"><Label>(g)</Label><Text>whether the incident has caused or is likely to cause</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="886993" lims:id="886993"><Label>(i)</Label><Text>an obstruction to navigation or any other serious hazard, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="886994" lims:id="886994"><Label>(ii)</Label><Text>pollution of any lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="886998" lims:id="886998"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="886999" lims:id="886999"><Label>(1)</Label><Text>Where a ship is involved in a shipping casualty, an accident or a dangerous occurrence, the master, any certificated officer, operator, member of the crew or person responsible for the ship shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="887000" lims:id="887000"><Label>(a)</Label><Text>within 24 hours of the occurrence of the incident or as soon as possible thereafter, make a written report on the incident, including a statement as to its probable cause; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="887001" lims:id="887001"><Label>(b)</Label><Text>forward the report by air mail without delay to the Chief, Marine Casualty Investigations, Department of Transport, Ottawa.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="887002" lims:id="887002"><Label>(2)</Label><Text>The report referred to in subsection (1) shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="887003" lims:id="887003"><Label>(a)</Label><Text>be made on the form set out in the schedule; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="887004" lims:id="887004"><Label>(b)</Label><Text>where possible, be completed</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="887005" lims:id="887005"><Label>(i)</Label><Text>in Canada, in the presence of a chief officer of customs, a Department of Transport marine casualty investigations officer, a Canadian Coast Guard ship safety officer or any other Department of Transport Coast Guard officer, or, where none of these persons is available, a Royal Canadian Mounted Police officer.</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="887006" lims:id="887006"><Label>(ii)</Label><Text>in another Commonwealth country, in the presence of a chief officer of customs or the superintendent of a mercantile marine office, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="887007" lims:id="887007"><Label>(iii)</Label><Text>in a country other than a country
