(<DefinedTermFr>production</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="884920" lims:id="884920" generate-in-text="no"><Text><DefinedTermEn>start-up period of production</DefinedTermEn> means the period that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884921" lims:id="884921"><Label>(a)</Label><Text>begins on the date that</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884922" lims:id="884922"><Label>(i)</Label><Text>new production facilities are first used for commercial production, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884923" lims:id="884923"><Label>(ii)</Label><Text>production first commences for commercial purposes of a product that is new, or substantially different from products previously produced by the producer, and that requires production equipment or technology that is new or substantially different from production equipment or technology previously used by the producer, and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884924" lims:id="884924"><Label>(b)</Label><Text>ends on the date that the level of production is no longer limited to a significant degree owing to technical difficulties related to the use of new production facilities or the production of a new or substantially different product. period during which subsections 56(1.02), 58(1.2) and 59(3.3) and section 77.038 of the Act are in force, except in respect of a definitive decision that was made before the coming into force of Export Price</TitleText></Heading><Heading lims:inforce-start-date="2018-04-26" lims:fid="884932" lims:id="884932" level="2"><TitleText>NORMAL VALUE ADJUSTMENTS</TitleText></Heading><Heading lims:inforce-start-date="2018-04-26" lims:fid="884933" lims:id="884933" level="3"><TitleText>Quantitative Adjustments</TitleText></Heading><Section lims:inforce-start-date="2015-02-06" lims:lastAmendedDate="2015-02-06" lims:fid="884934" lims:id="884934"><Label>3</Label><Text>For the purposes of sections 15, 19 and 20 of the Act, the price of like goods shall be adjusted to reflect the quantity discount generally granted in connection with a sale of like goods in the same or substantially the same quantities as the quantities of the goods sold to the importer in the quantity discount referred to in section 3 cannot be ascertained, the price of like goods shall be adjusted by</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884938" lims:id="884938"><Label>(a)</Label><Text>adding thereto the amount that would reflect the costs that would be incurred by the exporter, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884939" lims:id="884939"><Label>(b)</Label><Text>deducting therefrom the amount that would reflect the savings that would accrue to the exporter,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="884940" lims:id="884940"><Text>if the like goods were sold by the exporter in the same or substantially the same quantities as the quantities of goods sold to the importer in Canada.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="884941" lims:id="884941" level="3"><TitleText>Qualitative Differences</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="884942" lims:id="884942"><Label>5</Label><Text>For the purposes of sections 15, 19 and 20 of the Act, where the goods sold to the importer in Canada and the like goods differ</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884943" lims:id="884943"><Label>(a)</Label><Text>in their quality, structure, design or material,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884944" lims:id="884944"><Label>(b)</Label><Text>in their warranty against defect or guarantee of performance,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884945" lims:id="884945"><Label>(c)</Label><Text>in the time permitted from their date of order to the date of their scheduled shipment, or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884946" lims:id="884946"><Label>(d)</Label><Text>in their conditions of sale, other than the conditions referred to in paragraphs (b) or (c) or any conditions that result in any adjustment being made pursuant to any other section of these Regulations,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="884947" lims:id="884947"><Text>and that difference would be reflected in a difference between the price of the like goods and the price at which goods that are identical in all respects, including conditions of sale, to the goods sold to the importer in Canada would be sold in the country of export, the price of the like goods shall be adjusted</Text></ContinuedSectionSubsection><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884948" lims:id="884948"><Label>(e)</Label><Text>where the price of the like goods is greater than the price of the identical goods, by deducting therefrom the estimated difference between those prices; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884949" lims:id="884949"><Label>(f)</Label><Text>where the price of the like goods is less than the price of the identical goods, by adding thereto the estimated difference between those prices.</Text></Paragraph></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="884950" lims:id="884950" level="3"><TitleText>Discounts</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="884951" lims:id="884951"><Label>6</Label><Text>For the purposes of sections 15, 19 and 20 of the Act, where any rebate, deferred discount or discount for cash is generally granted in relation to the sale of like goods in the country of export, the price of the like goods shall be adjusted by deducting therefrom the amount of any such generally granted rebate or discount for which the sale of the goods to the importer in Canada would qualify if that sale occurred in the country of export.</Text></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="884952" lims:id="884952" level="3"><TitleText>Delivery Costs</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="884953" lims:id="884953"><Label>7</Label><Text>For the purposes of sections 15 and 19 and subparagraph 20(1)(c)(i) of the Act, where like goods are sold at a delivered price, the price of the like goods shall be adjusted by deducting therefrom the cost of their delivery.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="884955" lims:id="884955">SOR/92-236, s. 1; SOR/2000-138, s. 11</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="884956" lims:id="884956"><Label>8</Label><Text>For the purposes of sections 15 and 19 and subparagraph 20(1)(c)(i) of the Act, where like goods are generally sold at a common delivered price when delivered to any destination within a zone that, under the ordinary commercial practice of the vendor of the like goods, is considered to be a common transportation zone, the price of the like goods shall be adjusted by deducting therefrom an amount that reflects the average cost incurred by the vendor in delivering the like goods to destinations 11</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="884959" lims:id="884959" level="3"><TitleText>Substitution of Trade Level</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="884960" lims:id="884960"><Label>9</Label><Text>For the purposes of sections 15 and 19 and subparagraph 20(1)(c)(i) of the Act, where purchasers of like goods who are at the trade level nearest and subsequent to that of the importer in Canada have been substituted for purchasers who are at the same or substantially the same trade level as that of the importer, the price of the like goods shall be adjusted by deducting therefrom</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884961" lims:id="884961"><Label>(a)</Label><Text>the amount of any costs, charges or expenses incurred by the vendor of the like goods in selling to purchasers who are at the trade level nearest and subsequent to that of the importer that result from activities that would not be performed if the like goods were sold to purchasers who are at the same or substantially the same trade level as that of the importer; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884962" lims:id="884962"><Label>(b)</Label><Text>in the absence of information relating to the costs, charges and expenses mentioned in paragraph (a), an amount not exceeding the discount that is generally granted on the sale of like goods by other vendors in the country of export to purchasers who are at the same or substantially the same trade level as the importer.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:fid="884965" lims:id="884965" level="3"><TitleText>Taxes and Duties</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="884966" lims:id="884966"><Label>10</Label><Text>For the purposes of sections 15, 19 and 20 of the Act, where any taxes or duties that are borne by like goods or any materials or components forming a part thereof are not borne by the goods sold to the importer in Canada, the price of the like goods shall be adjusted by deducting therefrom the amount of those taxes or duties.</Text></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="884967" lims:id="884967" level="3"><TitleText>Cost of Production and Other Costs</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2019-08-23" lims:fid="884968" lims:id="884968"><Label>11</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="884969" lims:id="884969"><Label>(1)</Label><Text>For the purposes of paragraph 19(b) and subparagraph 20(1)(c)(ii) of the Act,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884970" lims:id="884970"><Label>(a)</Label><Text lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197569" lims:id="1197662">subject to sections 11.2 and 12, the expression <DefinedTermEn>cost of production</DefinedTermEn>, in relation to any goods, means the aggregate of all costs that are</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884971" lims:id="884971"><Label>(i)</Label><Text>attributable to, or in any manner related to, the production of the goods, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884972" lims:id="884972"><Label>(ii)</Label><Text>directly attributable to the design or engineering of the goods;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884973" lims:id="884973"><Label>(b)</Label><Text>the expression <DefinedTermEn>a reasonable amount for profits</DefinedTermEn>, in relation to any goods, means an amount equal to</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884974" lims:id="884974"><Label>(i)</Label><Text>where the exporter has made in the country of export a number of sales of like goods for use in the country of export, and where those sales when taken together produce a profit and are such as to permit a proper comparison, the weighted average profit made on the sales,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884975" lims:id="884975"><Label>(ii)</Label><Text>where subparagraph (i) is not applicable but the exporter has made in the country of export a number of sales of goods that are of the same general category as the goods sold to the importer in Canada and are for use in the country of export, and where those sales when taken together produce a profit and are such as to permit a proper comparison, the weighted average profit made on the sales,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884976" lims:id="884976"><Label>(iii)</Label><Text>where subparagraphs (i) and (ii) are not applicable but producers, other than the exporter, have made in the country of export a number of sales of like goods for use in the country of export, and where those sales when taken together produce a profit and are such as to permit a proper comparison, the weighted average profit made on the sales,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884977" lims:id="884977"><Label>(iv)</Label><Text>where subparagraphs (i) to (iii) are not applicable but producers, other than the exporter, have made in the country of export a number of sales of goods that are of the same general category as the goods sold to the importer in Canada and are for use in the country of export, and where those sales when taken together produce a profit and are such as to permit a proper comparison, the weighted average profit made on the sales,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884978" lims:id="884978"><Label>(v)</Label><Text>where subparagraphs (i) to (iv) are not applicable but the exporter has made in the country of export a number of sales of goods that are of the group or range of goods that is next largest to the category referred to in subparagraph (iv) and are for use in the country of export, and where those sales when taken together produce a profit and are such as to permit a proper comparison, the weighted average profit made on the sales, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884979" lims:id="884979"><Label>(vi)</Label><Text>where subparagraphs (i) to (v) are not applicable but producers, other than the exporter, have made in the country of export a number of sales of goods that are of the group or range of goods that is next largest to the category referred to in subparagraph (iv) and are for use in the country of export, and where those sales when taken together produce a profit and are such as to permit a proper comparison, the weighted average profit made on the sales; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884980" lims:id="884980"><Label>(c)</Label><Text>the expression <DefinedTermEn>a reasonable amount for administrative, selling and all other costs</DefinedTermEn>, in relation to any goods, means</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884981" lims:id="884981"><Label>(i)</Label><Text>an amount equal to all administrative, selling and other costs, including the costs of any warranty against defect or guarantee of performance and any design or engineering costs, that are not included in the cost of production but are reasonably attributable to the production and domestic sales of like goods made by the exporter, that satisfy the greatest number of the conditions set out in paragraphs 15(a) to (e) of the Act, taking into account subsection 16(1) of the Act, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884982" lims:id="884982"><Label>(ii)</Label><Text>where an amount cannot be determined under subparagraph (i), an amount equal to all administrative, selling and other costs, including the costs of any warranty against defect or guarantee of performance and any design or engineering costs, that are not included in the cost of production but are reasonably attributable to the production and sale of the goods.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="884983" lims:id="884983"><Label>(2)</Label><Text>For the purposes of subparagraphs (1)(b)(i), (ii) and (v), where the exporter is not the producer of the goods referred to in those subparagraphs, a reasonable amount for profits shall also include the amount of profits earned by the producer and any subsequent vendors in respect of sales of those goods to the exporter.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="884984" lims:id="884984"><Label>(3)</Label><Text>For the purpose of subparagraph (1)(c)(i), where the exporter is not the producer of the goods referred to in that subparagraph, a reasonable amount for administrative, selling and all other costs shall also include the amounts incurred by the producer and any subsequent vendors in respect of sales of those goods to the 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2019-08-23" lims:fid="884987" lims:id="884987"><Label>11.1</Label><Text>For the purpose of subsection 16(3) of the Act,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884988" lims:id="884988"><Label>(a)</Label><Text lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197570" lims:id="1197664">the cost of production, in relation to any goods, shall, subject to subsection 11.2(1) and section 12, be calculated by aggregating all costs that are</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884989" lims:id="884989"><Label>(i)</Label><Text>attributable to, or in any manner related to, the production of the goods, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="884990" lims:id="884990"><Label>(ii)</Label><Text>directly attributable to the design or engineering of the goods; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="884991" lims:id="884991"><Label>(b)</Label><Text>the administrative, selling and all other costs, in relation to any goods, shall be calculated by aggregating all administrative, selling and other costs, including the cost of any warranty against defect or guarantee of performance and any design or engineering costs that are not included in the cost of production but are attributable to the production and sale of the goods.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197666" lims:id="1197666"><Label>(1)</Label><Text>For the purposes of subparagraphs 11(1)(a)(i) and 11.1(a)(i), if an input used in the production of the goods is acquired by the exporter or producer from an associated person and is a significant factor in the production of the goods, the cost of that input in the country of export is considered to be the greater of the following amounts:</Text><Paragraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197667" lims:id="1197667"><Label>(a)</Label><Text>the price paid in respect of that input by the exporter or producer to the associated person;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197668" lims:id="1197668"><Label>(b)</Label><Text>the cost incurred by the associated person in the production of that input, including the administrative, selling and all other costs with respect to that input; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197669" lims:id="1197669"><Label>(c)</Label><Text>the price in the country of export of the same or substantially the same inputs, if sufficient information is available to enable the price to be determined on the basis of</Text><Subparagraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197670" lims:id="1197670"><Label>(i)</Label><Text>the selling prices of those inputs in the country of export, in the same or substantially the same quantities, between parties who are not associated persons, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197671" lims:id="1197671"><Label>(ii)</Label><Text>the published prices of those inputs in the country of export.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197672" lims:id="1197672"><Label>(2)</Label><Text>For the purposes of subparagraph 11(1)(a)(i), if the President is of the opinion that, under paragraph 16(2)(c) of the Act, a particular market situation exists which does not permit a proper comparison of the sale of like goods with the sale of the goods to the importer in Canada, such that the acquisition cost of an input used in the production of the goods does not reasonably reflect the actual cost of that input, the cost of that input in the country of export shall be considered to be the first of the following amounts that reasonably reflects the actual cost of the input so as to permit a proper comparison:</Text><Paragraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197673" lims:id="1197673"><Label>(a)</Label><Text>the price of the same or substantially the same inputs that are produced in the country of export and sold to the exporter or to other producers in the country of export;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197674" lims:id="1197674"><Label>(b)</Label><Text>the price of the same or substantially the same inputs that are produced in the country of export and sold from the country of export to a third country;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197675" lims:id="1197675"><Label>(c)</Label><Text>the price of the same or substantially the same inputs determined on the basis of the published prices of those inputs in the country of export;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197676" lims:id="1197676"><Label>(d)</Label><Text>the price of the same or substantially the same inputs that are produced in a third country and sold to the exporter or to other producers in the country of export, adjusted to reflect the differences relating to price comparability between the third country and the country of export; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-08-23" lims:enacted-date="2019-08-23" lims:fid="1197677" lims:id="1197677"><Label>(e)</Label><Text>the price of the same or substantially the same inputs determined on the basis of the published prices outside the country of export, adjusted to reflect the lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="884994" lims:id="884994"><Label>12</Label><Text>For the purposes of subparagraphs 11(1)(a)(ii) and 11.1(a)(ii), where the costs that are directly attributable to the design or engineering of the goods (in this section referred to as “first-mentioned goods”) cannot be determined, but the costs that are directly attributable to the design or engineering of goods of the same general category as the first-mentioned goods, produced and sold by any exporter or producer, can be determined, the costs that are directly attributable to the design or engineering of the first-mentioned goods shall be considered to be the amount that reflects the cost of the design or engineering of the goods of the same general category, such amount being adjusted to reflect the value of any differences in the design or engineering between the first-mentioned goods and the goods of the same general purposes of paragraph 11(1)(b),</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="884998" lims:id="884998"><Label>(a)</Label><Text>sales that are such as to permit a proper comparison are sales, other than any sale referred to in subsection 16(2) of the Act, that satisfy the greatest number of the conditions set out in paragraphs 15(a) to (e) of the Act, taking into account subsection 16(1) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="884999" lims:id="884999"><Label>(b)</Label><Text>the price of like goods shall be adjusted in the manner provided for in sections 3 to 10; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885000" lims:id="885000"><Label>(c)</Label><Text>the price of goods of the same general category or of goods of the group or range of goods that is next largest to the category referred to in subparagraph 11(1)(b)(iv) shall be adjusted in the manner provided for in sections 3 to 10, and for that purpose the expression “like goods” shall be read as “goods of the same general category” or “goods of the group or range of goods that is next largest to the category referred to in subparagraph 11(1)(b)(iv)”, as the case may be, wherever that expression occurs in those sections.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:id="885004"><Label>(1)</Label><Text>Subject to subsection (2), for the purpose of section 23.1 of the Act, the cost of production of goods, and the administrative, selling and all other costs with respect to the goods, for a start-up period of production shall be determined in accordance with sections 11 and 11.1.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885005" lims:id="885005"><Label>(2)</Label><Text>Where any of the costs determined under subsection (1) are affected by start-up operations that limit the level of production associated with the initial phases of commercial production owing to technical difficulties during the start-up period of production that are related to the use of new production facilities or the production of a new or substantially different product, the affected costs shall be adjusted on the basis of the costs that exist at the end of the start-up period of production or, if the period extends beyond the investigation period, on the basis of the costs that exist at the end of that period.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="885007" purpose of determining the normal value of any goods pursuant to paragraph 20(1)(d) of the Act, the price of like goods sold in Canada shall be adjusted by deducting therefrom an amount equal to the sum of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885020" lims:id="885020"><Label>(a)</Label><Text>all costs, including any duties and taxes, that result from the importation of the like goods or their sale by the importer to the purchaser in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885021" lims:id="885021"><Label>(b)</Label><Text>the amount of profit, determined in accordance with section 17, made by the importer of the like goods on their sale;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885022" lims:id="885022"><Label>(c)</Label><Text>all costs, charges and expenses incurred by the importer or exporter of the like goods, or any other person, in preparing the like goods for shipment to Canada that are additional to the costs, charges and expenses generally incurred on sales of the like goods for domestic consumption in the country of export; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885023" lims:id="885023"><Label>(d)</Label><Text>all other costs, charges and expenses incurred by the exporter or importer of the like goods, or any other person, that result from the exportation of the like goods or arise from their shipment to lims:id="885027"><Label>(a)</Label><Text>the amount of profit that generally results from sales of like goods by vendors in Canada who are at the same or substantially the same trade level as the lims:id="885028"><Label>(b)</Label><Text>if the amount described in paragraph (a) cannot be determined, the amount of profit that generally results from sales of goods of the same general category as the like goods by vendors in Canada, who are at the same or substantially the same trade level as the importer of the like goods to purchasers in Canada who are not associated with those vendors; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885029" lims:id="885029"><Label>(c)</Label><Text>where the amounts described in paragraphs (a) and (b) cannot be determined, the amount of profit that generally results from sales of goods that are of the group or range of goods that is next largest to the category referred to in paragraph (b), by vendors in Canada who are at the same or substantially the same trade level as the importer, to purchasers in Canada who are not associated with those lims:id="885041"><Label>(a)</Label><Text>the interest rate prevailing, in the country in which the like goods were sold, at the date of the sale of the like goods, for commercial loans available in that country in the same currency in which the payments for the like goods are expressed and on credit terms, other than the interest rate, that most closely approximate the credit terms on which the sale was made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885042" lims:id="885042"><Label>(b)</Label><Text>where the interest rate described in paragraph (a) cannot be ascertained or where there is no such interest rate, the lowest interest rate prevailing, in any country other than the country in which the like goods were sold, at the date of the sale of the like goods, for commercial loans available in that other country in the same currency in which the payments for the like goods are expressed and on credit terms, other than the interest rate, comparable to the credit terms on which the sale was made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885043" lims:id="885043"><Label>(c)</Label><Text>where the interest rates described in paragraphs (a) and (b) cannot be ascertained or where there are no such interest rates, the lowest interest rate prevailing, in any country other than the country in which the like goods were sold, at the date of the sale of the like goods, for commercial loans available in that other country in the same currency in which the payments for the like goods are expressed and on credit terms, other than the interest rate, that most closely approximate the credit terms on which the sale was made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885044" lims:id="885044"><Label>(d)</Label><Text>where the interest rates described in paragraphs (a) to (c) cannot be ascertained or where there are no such interest rates, the interest rate equal to the average yield in the year preceding the sale of the like goods on securities, for terms not exceeding one year, issued by the government that issues the currency in which the payments for the like goods are expressed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885045" lims:id="885045"><Label>(e)</Label><Text>where the interest rates described in paragraphs (a) to (d) cannot be ascertained or where there are no such interest rates, the average interest rate paid on Special Drawing Rights held by the International Monetary Fund in the year preceding the sale of the like goods.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885046" lims:id="885046"><Label>19</Label><Text>Where the normal value of any goods is to be determined under paragraph 20(1)(d) of the Act, section 18 of these Regulations shall be read with the substitution of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885047" lims:id="885047"><Label>(a)</Label><Text>the word “Canada” for the expressions “the country in which the like goods were generally results from sales of goods that are of the group or range of goods that is next largest to the category referred to in paragraph (b), by vendors in Canada who are at the same or of the Act or there is no such interest rate, the interest rate to be selected is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885067" lims:id="885067"><Label>(a)</Label><Text>the interest rate prevailing, at the date of the sale of the goods to the importer in Canada, in the country in which the vendor is located, for commercial loans available in that country in the same currency in which the payments for the goods are expressed and on credit terms, other than the interest rate, that most closely approximate the credit terms on which the sale was made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885068" lims:id="885068"><Label>(b)</Label><Text>where the interest rate described in paragraph (a) cannot be ascertained or where there is no such interest rate, the lowest interest rate prevailing, at the date of the sale of the goods to the importer in Canada, in any country other than the country in which the vendor is located, for commercial loans available in that other country in the same currency in which the payments for the goods are expressed and on credit terms, other than the interest rate, comparable to the credit terms on which the sale was made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885069" lims:id="885069"><Label>(c)</Label><Text>where the interest rates described in paragraphs (a) and (b) cannot be ascertained or where there are no such interest rates, the lowest interest rate prevailing, at the date of the sale of the goods to the importer in Canada, in any country other than the country in which the vendor is located, for commercial loans available in that other country in the same currency in which the payments for the goods are expressed and on credit terms, other than the interest rate, that most closely approximate the credit terms on which the sale was made;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885070" lims:id="885070"><Label>(d)</Label><Text>where the interest rates described in paragraphs (a) to (c) cannot be ascertained or where there are no such interest rates, the interest rate equal to the average yield in the year preceding the sale of the goods to the importer in Canada on securities, for terms not exceeding one year, issued by the government that issues the currency in which the payments for the goods are expressed; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885071" lims:id="885071"><Label>(e)</Label><Text>where the interest rates described in paragraphs (a) to (d) cannot be ascertained or there are no such interest rates, the average interest rate paid on Special Drawing Rights held by the International Monetary Fund in the year preceding the sale of the goods to the importer in Canada.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885072" lims:id="885072"><Label>24</Label><Text>Where an export price is determined under section 25 of the Act, section 23 of these Regulations shall be read with the substitution of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885073" lims:id="885073"><Label>(a)</Label><Text>the word “Canada” for the expressions “the country in which the vendor is located” and “that country”, wherever those expressions occur therein; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885074" lims:id="885074"><Label>(b)</Label><Text>the expression “sale of the goods by the importer in Canada” for the expression “sale of the goods to the importer in Canada”, wherever that expression occurs therein.</Text></Paragraph></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="885075" lims:id="885075" level="3"><TitleText>Goods in Transit</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885076" lims:id="885076"><Label>25</Label><Text>For the purpose of subsection 30(1) of the Act, the normal value and export price of goods exported to Canada from one country but passing in transit through another country shall be determined as if the goods were shipped directly to Canada from the first-mentioned country if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885077" lims:id="885077"><Label>(a)</Label><Text>the goods are conveyed to Canada from the first-mentioned country on a through bill of lading to a consignee in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885078" lims:id="885078"><Label>(b)</Label><Text>the goods have not been entered for trade or consumption in an intermediate country or have not remained in an intermediate country for any purpose other than transhipment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885079" lims:id="885079"><Label>(c)</Label><Text>where requested by an officer, the importer of the goods submits</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885080" lims:id="885080"><Label>(i)</Label><Text>the original bill of lading for the goods, or a certified copy of it, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885081" lims:id="885081"><Label>(ii)</Label><Text>if the original bill of lading for the goods, or a certified copy of it, is not available, any other information or documents that are available to the importer for the purpose of determining the country of export of the goods.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="885083" lims:id="885083">SOR/92-590, s. 1(E); SOR/96-255, ss. 9, 25</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="885084" lims:id="885084" level="3"><TitleText>Sustained Movement in the Rate of Exchange</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885085" lims:id="885085"><Label>25.1</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885086" lims:id="885086"><Label>(1)</Label><Text>For the purpose of section 30.2 of the Act, where a sale of goods to an importer in Canada takes place during a period in which there is a sustained movement in the rate of exchange that results in an appreciation of the value of the foreign currency in which the normal value of the goods is denominated in terms of the currency in which the exporter’s selling price of those goods is denominated, and the exporter’s selling price of those goods is adjusted from the price prevailing 60 days before the date of the sale to reflect the sustained movement in the rate of exchange, the export price of the goods shall be adjusted by multiplying that price by the result obtained by dividing the prevailing rate of exchange in respect of the foreign currency for the date of sale, by the average of the rates of exchange in respect of that foreign currency prevailing for each of the 30 days before the 60th day before the date of sale.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885087" lims:id="885087"><Label>(2)</Label><Text>Where the exporter’s selling price of the goods is denominated in Canadian dollars, the prevailing rate of exchange for the purpose of subsection (1) shall be the rate of exchange referred to in section 5 of the <XRefExternal reference-type="regulation" link="SOR-85-900">Currency Exchange for Customs Valuation Regulations</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885088" lims:id="885088"><Label>(3)</Label><Text>Where the exporter’s selling price of the goods is denominated in foreign currency, the prevailing rate of exchange for the purpose of subsection (1) shall be determined on the basis of rates of exchange referred to in section 5 of the <XRefExternal reference-type="regulation" link="SOR-85-900">Currency Exchange for Customs Valuation Regulations</XRefExternal>.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="885090" lims:id="885090">SOR/95-26, s. 4; SOR/96-255, ss. 10, 25</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="885091" lims:id="885091" level="1"><Label>PART I.1</Label><TitleText>Margin of Dumping Based on Percentage or Sample</TitleText></Heading><Section lims:inforce-start-date="2015-02-06" lims:lastAmendedDate="2015-02-06" lims:fid="885092" lims:id="885092"><Label>25.2</Label><Subsection lims:inforce-start-date="2015-02-06" lims:fid="885093" lims:id="885093"><Label>(1)</Label><Text>For the purpose of subsection 30.3(3) of the Act, the margin of dumping in relation to the goods of an exporter that were not included in the percentage or sample and the goods of the exporter for which a margin of dumping was not determined in accordance with subsection 30.3(2) of the Act shall be equal to the weighted average margin of dumping established as a result of the application of sections 15 to 30 of the Act in respect of goods from that exporter that are included in the percentage or sample.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-06" lims:fid="885094" lims:id="885094"><Label>(2)</Label><Text>Where a margin of dumping cannot be determined under subsection (1) because no goods from the exporter were included in the percentage or sample, the margin of dumping shall</Text><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885095" lims:id="885095"><Label>(a)</Label><Text>be equal to the weighted average of the margins of dumping established as a result of the application of sections 15 to 28 and 30 of the Act, excluding paragraph 25(1)(e), in respect of goods that are from the same country and are included in the percentage or sample;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885096" lims:id="885096"><Label>(b)</Label><Text>where a margin of dumping cannot be determined under paragraph (a), be equal to the weighted average of the margins of dumping established as a result of the application of sections 15 to 28 and 30 of the Act, excluding paragraph 25(1)(e), in respect of goods that are from all other countries whose goods are under consideration and are included in a percentage or sample; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885097" lims:id="885097"><Label>(c)</Label><Text>where a margin of dumping cannot be determined under paragraph (a) or (b), be determined in a reasonable manner based on the information available to the President.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-06" lims:fid="885098" lims:id="885098"><Label>(3)</Label><Text>Any margin of dumping that is insignificant shall not be taken into account in a determination of the margin of dumping under duty or other charge levied by a government against the recipient of the benefit of the subsidy for the purpose of offsetting the subsidy; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885109" lims:id="885109"><Label>(c)</Label><Text>the amount of any loss in the value of the subsidy that results from the deferred receipt of the subsidy in the production, purchase, distribution, transportation, sale, export or import of subsidized goods, the estimated total quantity of subsidized goods to which the grant is attributable;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885115" lims:id="885115"><Label>(b)</Label><Text>where the grant was, or is, to be used for the purchase or construction of a fixed asset, the estimated total quantity of subsidized goods for the production, purchase, distribution, transportation, sale, export or import of which the fixed asset was, or will be, used for the anticipated useful life of the fixed asset;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885116" lims:id="885116"><Label>(c)</Label><Text>where the use of the grant was, or is, not for the purposes described in paragraph (a) or (b) or is unknown, the estimated total quantity of subsidized goods the production, purchase, distribution, transportation, sale, export or import of which was, or will be, carried out by the person who received the grant during the weighted average useful life, not exceeding 10 years, of fixed assets used by the industry of that person.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="885118" lims:id="885118">SOR/92-236, s. 2(E); SOR/95-26, s. lims:inforce-start-date="2006-03-22" lims:fid="885120" lims:id="885120"><Label>(1)</Label><Text>Any amount that relates to the direct transfer of funds or liabilities by the practices of a government interest, that would have been incurred by the recipient of the preferential loan with respect to a non-guaranteed commercial loan that the recipient could have lims:id="885135"><Label>(2)</Label><Text>For the purposes of paragraph (1)(a), the interest rate is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885136" lims:id="885136"><Label>(a)</Label><Text>the prevailing interest rate in the territory of the government that made the preferential loan, at the date the preferential loan was made, in respect of non-guaranteed commercial loans that the recipient of the preferential loan could have obtained, in the same currency in which the payments for the preferential loan are expressed and on credit terms, other than the interest rate, that are the same or substantially the same as the credit terms of the preferential loan;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885137" lims:id="885137"><Label>(b)</Label><Text>where the interest rate described in paragraph (a) cannot be ascertained or where there is no such interest rate, the prevailing interest rate in the territory of the government that provided the preferential loan, at the date the preferential loan was provided, in respect of non-guaranteed commercial loans that the recipient of the preferential loan could have obtained, in the same currency in which the payments for the preferential loan are expressed and on credit terms, other than the interest rate, that most closely approximate the credit terms of the preferential loan; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885138" lims:id="885138"><Label>(c)</Label><Text>where the interest rates described in paragraphs (a) and (b) cannot be ascertained or where there are no such interest rates, the prevailing interest rate in the territory of the government that provided the preferential loan, at the date the preferential loan was made, in respect of non-guaranteed commercial loans that</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885139" lims:id="885139"><Label>(i)</Label><Text>producers of like goods, whose financial creditworthiness is the same or substantially the same as or, in the absence of that condition, approximates that of the recipient of the preferential loan, could have obtained,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885140" lims:id="885140"><Label>(ii)</Label><Text>where subparagraph (i) is not applicable, producers of goods of the same general category, whose financial creditworthiness is the same or substantially the same as or, in the absence of that condition, approximates that of the recipient of the preferential loan, could have obtained, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885141" lims:id="885141"><Label>(iii)</Label><Text>where subparagraphs (i) and (ii) are not applicable, producers of goods of the group or range of goods that is next largest to the category referred to in subparagraph (ii), whose financial creditworthiness is the same or substantially the same as or, in the absence of that condition, approximates that of the recipient of the preferential loan, could have obtained,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2006-03-22" lims:fid="885142" lims:id="885142"><Text>in the same currency in which the payments for the preferential loan are expressed and on credit terms, other than the interest rate, that most closely approximate the credit terms of the preferential was, or is, to be used for the purchase or construction of a fixed asset, the estimated total quantity of subsidized goods for the production, purchase, distribution, transportation, sale, export or import of which the fixed asset was, or will be, used for the anticipated useful life of the fixed asset;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885151" lims:id="885151"><Label>(c)</Label><Text>where the use of the preferential loan was not or is not for the purposes described in paragraph (a) or (b) or is unknown, the estimated total quantity of subsidized goods the production, purchase, distribution, transportation, sale, export or import of which was or will be carried out by the person who received the preferential loan during the weighted average useful life of fixed assets, not exceeding 10 years, used by the industry in which that person is engaged.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885154" lims:id="885154" level="2"><TitleText>Loan Guarantees</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885155" lims:id="885155"><Label>31.1</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885156" lims:id="885156"><Label>(1)</Label><Text>Where the subsidy in relation to any subsidized goods is in the form of a loan guarantee, the amount of subsidy shall be determined by distributing, in accordance with generally accepted accounting principles, over the quantity of goods determined in accordance with subsection (2), the present value of the difference between</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885157" lims:id="885157"><Label>(a)</Label><Text>the amount of interest and any administrative fees the person on whose behalf the guarantee is provided would have had to pay in respect of the loan had it not been for the guarantee, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885158" lims:id="885158"><Label>(b)</Label><Text>the amount of interest and any administrative fees the person on whose behalf the guarantee is provided will actually pay in respect of the loan secured by the guarantee,</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="885159" lims:id="885159"><Text>such present value being determined as of the date the loan funds were advanced and by reference to the discount rate determined in accordance with subsection (3).</Text></ContinuedSectionSubsection></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885160" lims:id="885160"><Label>(2)</Label><Text>For the purposes of subsection (1), the quantity of goods is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885161" lims:id="885161"><Label>(a)</Label><Text>where the loan secured by the guarantee was, or is, to be used for operating expenses in the production, purchase, distribution, transportation, sale, export or import of subsidized goods, the estimated total quantity of subsidized goods to which the loan is attributable;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885162" lims:id="885162"><Label>(b)</Label><Text>where the loan secured by the guarantee was, or is, to be used for the purchase or construction of a fixed asset, the estimated total quantity of subsidized goods for the production, purchase, distribution, transportation, sale, export or import of which the fixed asset was, or will be, used during the anticipated useful life of the fixed asset;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885163" lims:id="885163"><Label>(c)</Label><Text>where the use of the loan secured by the guarantee was not or is not a use set out in paragraph (a) or (b) or is unknown, the estimated total quantity of subsidized goods the production, purchase, distribution, transportation, sale, export or import of which was or will be carried out by the person who received the loan during the weighted average useful life of fixed assets, not exceeding 10 years, used by the industry in which that person is engaged.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885164" lims:id="885164"><Label>(3)</Label><Text>For the purposes of subsection (1), the discount rate is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885165" lims:id="885165"><Label>(a)</Label><Text>the prevailing interest rate in the territory of the government that provided the loan guarantee, at the date the loan was made, in respect of commercial loans that the recipient of the loan could have obtained, in the same currency in which the payments for the loan are expressed and on credit terms, other than the interest rate, that are the same or substantially the same as the credit terms of the loan;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885166" lims:id="885166"><Label>(b)</Label><Text>where the interest rate described in paragraph (a) cannot be ascertained or where there is no such interest rate, the prevailing interest rate in the territory of the government that provided the loan guarantee, at the date the loan was made, in respect of commercial loans that the recipient of the loan could have obtained, in the same currency in which the payments for the loan are expressed and on credit terms, other than the interest rate, that most closely approximate the credit terms of the loan; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885167" lims:id="885167"><Label>(c)</Label><Text>where the interest rates described in paragraphs (a) and (b) cannot be ascertained or where there are no such interest rates, the prevailing interest rate in the territory of the government that provided the loan guarantee, at the date the loan was made, in respect of commercial loans that</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885168" lims:id="885168"><Label>(i)</Label><Text>producers of like goods, whose financial creditworthiness is the same or substantially the same as or, in the absence of that condition, approximates that of the recipient of the loan, could have obtained,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885169" lims:id="885169"><Label>(ii)</Label><Text>where subparagraph (i) is not applicable, producers of goods of the same general category, whose financial creditworthiness is the same or substantially the same as or, in the absence of that condition, approximates that of the recipient of the loan, could have obtained, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885170" lims:id="885170"><Label>(iii)</Label><Text>where subparagraphs (i) and (ii) are not applicable, producers of goods of the group or range of goods that is next largest to the category referred to in subparagraph (ii), whose financial creditworthiness is the same or substantially the same as or, in the absence of that condition, approximates that of the recipient of the loan, could have obtained,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2006-03-22" lims:fid="885171" lims:id="885171"><Text>in the same currency in which the payments for the loan are expressed and on credit terms, other than the interest rate, that most closely approximate the credit terms of the subsidy in relation to any subsidized goods is contingent on the export of those goods and in the form of a credit against, a refund of or an exemption from income taxes levied during any period, the Taxes</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885182" lims:id="885182"><Label>33</Label><Text>Where the subsidy in relation to any subsidized goods is contingent on the export of those goods and in the form of a deferral of income taxes, the amount of subsidy shall be determined by distributing, in accordance with generally accepted accounting principles, the amount determined in accordance with section 34 over the quantity of goods exported during the period for which taxes would have been paid had the taxes not been lims:inforce-start-date="2006-03-22" lims:fid="885186" lims:id="885186"><Label>(1)</Label><Text>The amount for the purpose of section 33 is the present value of the interest that would have been payable, by the recipient of the deferral of income taxes, on a commercial loan in an amount equal to the amount of the deferred taxes, for a period equal to the period of the deferral, and with repayment terms similar to those in the payment schedule that applies to the deferred taxes, such present value being determined as of the date the deferral of income taxes came into effect in respect of the recipient of the deferral and by reference to the discount rate determined in accordance with subsection (2), and the interest rate in respect of such a loan being equal to the rate that is</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885187" lims:id="885187"><Label>(a)</Label><Text>the prevailing interest rate in the territory of the government that permitted the deferral of income taxes, at the date the taxes would have been payable had they not been deferred, in respect of commercial loans that the recipient of the deferral could have obtained and that have a period the same or substantially the same as the period of the deferral and repayment terms comparable to those in the payment schedule applicable to the deferred taxes;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885188" lims:id="885188"><Label>(b)</Label><Text>where the interest rate described in paragraph (a) cannot be ascertained or where there is no such interest rate, the prevailing interest rate in the territory of the government that permitted the deferral, at the date the taxes would have been payable had they not been deferred, in respect of commercial loans that the recipient of the deferral could have obtained and that have a period that most closely approximates that of the period of the deferral and repayment terms that most closely approximate those in the payment schedule applicable to the deferred taxes; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885189" lims:id="885189"><Label>(c)</Label><Text>where the interest rates described in paragraphs (a) and (b) cannot be ascertained or where there are no such interest rates, the prevailing interest rate in the territory of the government that permitted the deferral, at the date the taxes would have been payable had they not been deferred, in respect of commercial loans that</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885190" lims:id="885190"><Label>(i)</Label><Text>producers of like goods, whose financial creditworthiness is the same or substantially the same as or, in the absence of that condition, approximates that of the recipient of the deferral, could have obtained,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885191" lims:id="885191"><Label>(ii)</Label><Text>where subparagraph (i) is not applicable, producers of goods of the same general category, whose financial creditworthiness is the same or substantially the same as or, in the absence of that condition, approximates that of the recipient of the deferral, could have obtained, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="885192" lims:id="885192"><Label>(iii)</Label><Text>where subparagraphs (i) and (ii) are not applicable, producers of goods of the group or range of goods that is next largest to the category referred to in subparagraph (ii), whose financial creditworthiness is the same or substantially the same as or, in the absence of that condition, approximates that of the recipient of the deferral, could have obtained,</Text></Subparagraph><ContinuedParagraph lims:inforce-start-date="2006-03-22" lims:fid="885193" lims:id="885193"><Text>and that have a period that most closely approximates that of the period of the deferral and repayment terms that most closely approximate those in the payment schedule applicable to the deferred the export of the goods and is in the form of an exemption from or remission, refund or drawback equal to an amount greater than the duties or taxes levied on the production, purchase, distribution, transportation, sale, export or import of the goods, the amount of subsidy shall be determined by deducting the amount of duties or taxes levied on or in respect of the exported goods, or the amount of duties or taxes that would have been levied on or in respect of the goods if they had not been exported, from the amount of the exemption, remission, refund or drawback that was granted in connection with the goods, and dividing the result by the quantity of goods, in relation to which the exemption, remission, refund or drawback was granted, that were exported during the period for lims:fid="885202" lims:id="885202"><Label>35.01</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885203" lims:id="885203"><Label>(1)</Label><Text>Where the subsidy in relation to any subsidized goods is contingent on the export of the goods and is in the form of an exemption from or remission, refund or drawback equal to an amount greater than the duties or taxes levied on goods consumed in the production of the exported goods, the amount of subsidy shall be determined by deducting the amount of duties or taxes levied on or in respect of the consumed goods from the amount of the exemption, remission, refund or drawback that was granted in connection with the consumed goods, and dividing the result by the quantity of goods, in relation to which the exemption, remission, refund or drawback was granted, that were exported during the period for which the duties or taxes were exempted, remitted, refunded or drawn back.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885204" lims:id="885204"><Label>(2)</Label><Text>For the purpose of subsection (1), the only goods considered to be consumed in the production of the exported goods are</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885205" lims:id="885205"><Label>(a)</Label><Text>energy, fuel, oil and catalysts that are used or consumed in the production of the exported goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885206" lims:id="885206"><Label>(b)</Label><Text>goods incorporated into the exported lims:fid="885212" lims:id="885212"><Label>(b)</Label><Text>the fair market value of those shares immediately before the government’s decision to acquire the shares became to be given to every person who, but for section 77.012 of the Act, would be entitled to make such an application or to appeal shall be given by publication in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal> of a notice to that effect and, if service of such a notice is required pursuant to the rules of procedure adopted or maintained pursuant to paragraph 14 Complaints</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885313" lims:id="885313"><Label>37</Label><Text>For the purposes of subparagraph (b)(ii) of the definition <DefinitionRef>properly documented</DefinitionRef> in subsection 2(1) of the Act, the following information is prescribed:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885314" lims:id="885314"><Label>(a)</Label><Text>the volume and value of the complainant’s domestic production of like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885315" lims:id="885315"><Label>(b)</Label><Text>a list of all producers of like goods in Canada, and of associations of such producers in Canada, whom the complainant knows of;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885316" lims:id="885316"><Label>(b.1)</Label><Text>a list of the trade unions that represent persons employed in the production of like goods in Canada and the associations that include such trade unions, whom the complainant knows of;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885317" lims:id="885317"><Label>(c)</Label><Text>such details as are reasonably available to the complainant regarding the estimated volume and value of the production of like goods by the producers referred to in paragraph (b);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885318" lims:id="885318"><Label>(d)</Label><Text>the name of each foreign producer or exporter of the allegedly dumped or subsidized goods whom the complainant knows of;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885319" lims:id="885319"><Label>(e)</Label><Text>the name of each importer in Canada of the allegedly dumped or subsidized goods whom the complainant knows of;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885320" lims:id="885320"><Label>(f)</Label><Text>such details as are reasonably available to the complainant regarding the evolution of the volume of imports of the allegedly dumped or subsidized goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885321" lims:id="885321"><Label>(g)</Label><Text>such details as are reasonably available to the complainant regarding the effect of imports of the allegedly dumped or subsidized goods on the price of like Injury</TitleText></Heading><Section lims:inforce-start-date="2015-02-06" lims:lastAmendedDate="2022-06-24" lims:fid="885325" lims:id="885325"><Label>37.1</Label><Subsection lims:inforce-start-date="2015-02-06" lims:fid="885326" lims:id="885326"><Label>(1)</Label><Text>The following factors may be considered in determining whether the dumping or subsidizing of goods has caused injury or retardation:</Text><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885327" lims:id="885327"><Label>(a)</Label><Text>the volume of the dumped or subsidized goods and, in particular, whether there has been a significant increase in the volume of imports of the dumped or subsidized goods, either in absolute terms or relative to the production or consumption of like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885328" lims:id="885328"><Label>(b)</Label><Text>the effect of the dumped or subsidized goods on the price of like goods and, in particular, whether the dumped or subsidized goods have significantly</Text><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885329" lims:id="885329"><Label>(i)</Label><Text>undercut the price of like goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885330" lims:id="885330"><Label>(ii)</Label><Text>depressed the price of like goods, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885331" lims:id="885331"><Label>(iii)</Label><Text>suppressed the price of like goods by preventing the price increases for those like goods that would otherwise likely have occurred;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885332" lims:id="885332"><Label>(c)</Label><Text>the resulting impact of the dumped or subsidized goods on the state of the domestic industry and, in particular, all relevant economic factors and indices that have a bearing on the state of the domestic industry, including</Text><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885333" lims:id="885333"><Label>(i)</Label><Text>any actual or potential decline in output, sales, market share, profits, productivity, return on investments or the utilization of industrial capacity,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="1368670" lims:id="1368670"><Label>(i.1)</Label><Text>any actual or potential negative effects on employment levels or the terms and conditions of employment of the persons employed in the domestic industry, including their wages, hours worked, pension plans, benefits or worker training and safety,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="885334" lims:id="1368671"><Label>(ii)</Label><Text>any actual or potential negative effects on cash flow, inventories, growth or the ability to raise capital,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885335" lims:id="885335"><Label>(ii.1)</Label><Text>the magnitude of the margin of dumping or amount of subsidy in respect of the dumped or subsidized goods, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885336" lims:id="885336"><Label>(iii)</Label><Text>in the case of agricultural goods, including any goods that are agricultural goods or commodities by virtue of an Act of Parliament or of the legislature of a province, that are subsidized, any increased burden on a government support programme; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885337" lims:id="885337"><Label>(d)</Label><Text>any other factor that is relevant in the circumstances.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-06" lims:fid="885338" lims:id="885338"><Label>(2)</Label><Text>The following factors may be considered in determining whether the dumping or subsidizing of goods is threatening to cause injury:</Text><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885339" lims:id="885339"><Label>(a)</Label><Text>the nature of the subsidy in question and the effects it is likely to have on trade;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885340" lims:id="885340"><Label>(b)</Label><Text>whether there has been a significant rate of increase of dumped or subsidized goods imported into Canada, which rate of increase indicates a likelihood of substantially increased imports into Canada of the dumped or subsidized goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885341" lims:id="885341"><Label>(c)</Label><Text>whether there is sufficient freely disposable capacity, or an imminent, substantial increase in the capacity of an exporter, that indicates a likelihood of a substantial increase of dumped or subsidized goods, taking into account the availability of other export markets to absorb any increase;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885342" lims:id="885342"><Label>(d)</Label><Text>the potential for product shifting where production facilities that can be used to produce the goods are currently being used to produce other goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885343" lims:id="885343"><Label>(e)</Label><Text>whether the goods are entering the domestic market at prices that are likely to have a significant depressing or suppressing effect on the price of like goods and are likely to increase demand for further imports of the goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885344" lims:id="885344"><Label>(f)</Label><Text>inventories of the goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="885345" lims:id="1368672"><Label>(g)</Label><Text>the actual and potential negative effects on existing development and production efforts, including effects on hiring and on efforts to produce a derivative or more advanced version of like goods;<LineBreak /></Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885346" lims:id="885346"><Label>(g.1)</Label><Text>the magnitude of the margin of dumping or amount of subsidy in respect of the dumped or subsidized goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885347" lims:id="885347"><Label>(g.2)</Label><Text>evidence of the imposition of anti-dumping or countervailing measures by the authorities of a country other than Canada in respect of goods of the same description or in respect of similar goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885348" lims:id="885348"><Label>(h)</Label><Text>any other factor that is relevant in the circumstances.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-06" lims:fid="885349" lims:id="885349"><Label>(3)</Label><Text>The following additional factors may be considered in determining whether the dumping or subsidizing of goods has caused injury or retardation or is threatening to cause injury:</Text><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885350" lims:id="885350"><Label>(a)</Label><Text>whether a causal relationship exists between the dumping or subsidizing of the goods and the injury, retardation or threat of injury, on the basis of the factors listed in subsections (1) and (2); and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885351" lims:id="885351"><Label>(b)</Label><Text>whether any factors other than the dumping or subsidizing of the goods have caused injury or retardation or are threatening to cause injury, on the basis of</Text><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885352" lims:id="885352"><Label>(i)</Label><Text>the volumes and prices of imports of like goods that are not dumped or subsidized,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-06" producers,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885356" lims:id="885356"><Label>(v)</Label><Text>developments in technology,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885357" lims:id="885357"><Label>(vi)</Label><Text>the export performance and productivity of the domestic industry in respect of like goods, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-06" lims:fid="885358" lims:id="885358"><Label>(vii)</Label><Text>any other factor that is lims:fid="885361" lims:id="885361"><Label>37.11</Label><Text>The following factors may be considered in determining whether injury has been caused by a massive importation of dumped or subsidized goods or, if the importations have occurred within a relatively short period of time and in the aggregate are massive, by a series of importations of dumped or subsidized goods:</Text><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885362" lims:id="885362"><Label>(a)</Label><Text>whether there has been an increase of at least 15% in the volume of imports of those goods from an individual country of export and in respect of which an investigation under the Act has not been terminated, during a representative period within the period beginning 90 days before the date of initiation of the investigation and ending on the date of the President’s preliminary determination under subsection 38(1) of the Act, relative to a preceding representative period of comparable duration within the period of investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885363" lims:id="885363"><Label>(b)</Label><Text>whether the importer, producer or exporter of the dumped goods has a history of importing into Canada, or exporting into Canada, dumped goods in respect of which the Tribunal has made an order or finding that the dumping of the goods has caused injury or retardation or a threat of injury;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885364" lims:id="885364"><Label>(c)</Label><Text>whether the authorities of a country other than Canada have determined that injury to the domestic industry of that country was caused by the dumping of goods of the same description, or of similar goods, by an exporter of the goods that are under investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885365" lims:id="885365"><Label>(d)</Label><Text>whether there has been a significant increase in the volume of domestic inventories of the dumped or subsidized goods within a relatively short period of time; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-06" lims:fid="885366" lims:id="885366"><Label>(e)</Label><Text>any other factor that is relevant in the Factors</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2022-06-24" lims:fid="885370" lims:id="885370"><Label>37.2</Label><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885371" lims:id="885371"><Label>(1)</Label><Text>In making a determination under paragraph 76.03(7)(a) of the Act, the President may consider</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885372" lims:id="885372"><Label>(a)</Label><Text>whether there has been dumping of goods while a finding or order in respect of the goods is in effect and, if applicable,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885373" lims:id="885373"><Label>(i)</Label><Text>the period during which the dumping occurred,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885374" lims:id="885374"><Label>(ii)</Label><Text>the volume and prices of the dumped and non-dumped goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885375" lims:id="885375"><Label>(iii)</Label><Text>the margin of dumping, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885376" lims:id="885376"><Label>(iv)</Label><Text>for non-dumped goods, the amount by which the export prices exceed the normal values of the goods;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885377" lims:id="885377"><Label>(b)</Label><Text>whether there has been subsidizing of goods while a finding or order in respect of the goods is in effect and, if applicable,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885378" lims:id="885378"><Label>(i)</Label><Text>the nature and duration of the foreign subsidy program in respect of the goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885379" lims:id="885379"><Label>(ii)</Label><Text>the period during which the subsidizing occurred,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885380" lims:id="885380"><Label>(iii)</Label><Text>the volume of the subsidized goods, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885381" lims:id="885381"><Label>(iv)</Label><Text>the amount of subsidy;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885382" lims:id="885382"><Label>(b.1)</Label><Text>whether there has been a decision setting out a finding of circumvention in respect of the order or finding that is subject to the expiry review or in respect of similar goods to the goods to which that order or finding applies;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885383" lims:id="885383"><Label>(c)</Label><Text>the performance of the exporters, foreign producers, brokers and traders including, where applicable, in respect of production, capacity utilization, costs, sales volumes, prices, inventories, market share, exports and profits;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885384" lims:id="885384"><Label>(d)</Label><Text>the likely future performance of the exporters, foreign producers, brokers and traders on the basis of factors, where applicable, such as production, capacity utilization, sales volumes, prices, inventories, market share, exports and profits;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885385" lims:id="885385"><Label>(e)</Label><Text>the potential for the foreign producers to produce the goods in facilities that are currently used to produce other goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885386" lims:id="885386"><Label>(f)</Label><Text>evidence of the imposition of anti-dumping or countervailing measures by the authorities of a country other than Canada in respect of goods of the same description or in respect of similar goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885387" lims:id="885387"><Label>(g)</Label><Text>whether measures taken by the authorities of a country other than Canada are likely to cause a diversion of dumped or subsidized goods into Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="885388" lims:id="1368674"><Label>(h)</Label><Text>any changes in market conditions domestically or internationally, including changes in the supply of and demand for the goods, in sources of imports into Canada, in prices, in employment levels, in the terms or conditions of employment, in market share and in inventories;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885389" lims:id="885389"><Label>(i)</Label><Text>the imposition of anti-dumping or countervailing measures by authorities of Canada in respect of similar goods while an order or finding in respect of the goods was in effect; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="885390" lims:id="1368675"><Label>(j)</Label><Text>any other factor pertaining to the current or likely behaviour or state of a foreign government or of the domestic or international economy, market for goods or industry as a whole or in relation to workers or individual producers, exporters, brokers or traders.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885391" lims:id="885391"><Label>(2)</Label><Text>In making a determination under subsection 76.03(10) of the Act, the Tribunal may consider</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885392" lims:id="885392"><Label>(a)</Label><Text>the likely volume of the dumped or subsidized goods if the order or finding is allowed to expire, and, in particular, whether there is likely to be a significant increase in the volume of imports of the dumped or subsidized goods, either in absolute terms or relative to the production or consumption of like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885393" lims:id="885393"><Label>(b)</Label><Text>the likely prices of the dumped or subsidized goods if the order or finding is allowed to expire and their effect on the prices of like goods, and, in particular, whether the dumping or subsidizing of goods is likely to significantly undercut the prices of like goods, depress those prices, or suppress them by preventing increases in those prices that would likely have otherwise occurred;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885394" lims:id="885394"><Label>(c)</Label><Text>the likely performance of the domestic industry, taking into account that industry’s recent performance, including trends in production, capacity utilization, employment levels, prices, sales, inventories, market share, exports and profits;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885395" lims:id="885395"><Label>(d)</Label><Text>the likely performance of the foreign industry, taking into account that industry’s recent performance, including trends in production, capacity utilization, employment levels, prices, sales, inventories, market share, exports and profits;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="885396" lims:id="1368676"><Label>(e)</Label><Text>the likely impact of the dumped or subsidized goods on domestic industry if the order or finding is allowed to expire, having regard to all relevant economic factors and indices, including</Text><Subparagraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="1368677" lims:id="1368677"><Label>(i)</Label><Text>any potential decline in output, sales, market share, profits, productivity, return on investments or utilization of production capacity,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="1368678" lims:id="1368678"><Label>(ii)</Label><Text>any potential negative effects on cash flow, inventories, growth or the ability to raise capital, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="1368679" lims:id="1368679"><Label>(iii)</Label><Text>any potential negative effects on employment levels or the terms and conditions of employment of the persons employed in the domestic industry, including their wages, hours worked, pension plans, benefits or worker training and safety;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885397" lims:id="885397"><Label>(f)</Label><Text>the potential for the foreign producers to produce the goods in facilities that are currently used to produce other goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="885398" lims:id="1368680"><Label>(g)</Label><Text>the potential negative effects of the dumped or subsidized goods on existing development and production efforts, including effects on hiring and on efforts to produce a derivative or more advanced version of like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885399" lims:id="885399"><Label>(h)</Label><Text>evidence of the imposition of anti-dumping or countervailing measures by the authorities in a country other than Canada in respect of goods of the same description or in respect of similar goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885400" lims:id="885400"><Label>(i)</Label><Text>whether measures taken by the authorities in a country other than Canada are likely to cause a diversion of the dumped or subsidized goods into Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885401" lims:id="885401"><Label>(j)</Label><Text>any changes in market conditions domestically or internationally, including changes in the supply of and demand for the goods, as well as any changes in trends and in sources of imports into Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="885402" lims:id="1368681"><Label>(k)</Label><Text>any other factor pertaining to the current or likely behaviour or state of the domestic or international economy, market for goods or industry as a whole or in relation to workers or individual producers, exporters, brokers or traders.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885406" lims:id="885406"><Label>38</Label><Text>Subject to section 39, if the same goods, like goods or similar goods are</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885407" lims:id="885407"><Label>(a)</Label><Text>subject to more than one properly documented complaint in relation to the dumping or subsidizing of goods, the President may join the complaints for the purpose of initiating a single investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885408" lims:id="885408"><Label>(b)</Label><Text>subject to more than one preliminary inquiry, the Tribunal may join the preliminary inquiries and carry them out as a single preliminary inquiry;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885409" lims:id="885409"><Label>(c)</Label><Text>subject to more than one dumping investigation or subsidy investigation, or one or more dumping investigations and one or more subsidy investigations, the President may join the investigations and carry them out as a single investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885410" lims:id="885410"><Label>(d)</Label><Text>subject to more than one application for a scope ruling, the President may join the applications for the purpose of initiating a single scope proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885411" lims:id="885411"><Label>(e)</Label><Text>subject to more than one scope proceeding, the President may join the proceedings and carry them out as a single scope proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885412" lims:id="885412"><Label>(f)</Label><Text>subject to more than one complaint respecting circumvention, the President may join the complaints for the purpose of initiating a single anti-circumvention investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885413" lims:id="885413"><Label>(g)</Label><Text>subject to more than one anti-circumvention investigation, the President may join the investigations and carry them out as a single anti-circumvention investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885414" lims:id="885414"><Label>(h)</Label><Text>subject to one or more applications for a scope ruling and one or more complaints respecting circumvention, the President may join the applications and complaints for the purpose of initiating a single anti-circumvention investigation, which includes consideration of the issue of scope; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885415" lims:id="885415"><Label>(i)</Label><Text>subject to one or more scope proceedings and one or more anti-circumvention investigations, the President may join the scope proceedings and the investigations and carry them out as a single anti-circumvention investigation, paragraph <XRefInternal>38</XRefInternal>(c) is not to be joined with another investigation under that paragraph if a preliminary determination of dumping or subsidizing has been made in respect of at least one of those investigations.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885420" lims:id="885420"><Label>(2)</Label><Text>An investigation referred to in paragraph <XRefInternal>38</XRefInternal>(g) or (i) is not to be joined with another investigation or proceeding under that paragraph if a statement of essential facts has been published in respect of lims:inforce-start-date="2018-04-26" lims:fid="885424" lims:id="885424"><Label>(1)</Label><Text>If complaints are joined under paragraph <XRefInternal>38</XRefInternal>(a), the President shall cause written notice of the joinder to be provided to the complainants and government of each country of export involved in the complaints.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885425" lims:id="885425"><Label>(2)</Label><Text>If preliminary inquiries are joined under paragraph <XRefInternal>38</XRefInternal>(b), the Tribunal shall cause written notice of the joinder to be provided to the President and the complainants, importers, exporters and government of each country of export involved in the inquiries.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885426" lims:id="885426"><Label>(3)</Label><Text>If investigations are joined under paragraph <XRefInternal>38</XRefInternal>(c), the President shall cause written notice of the joinder to be provided to the Tribunal and the complainants, importers, exporters and government of each country of export involved in the investigations.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885427" lims:id="885427"><Label>(4)</Label><Text>If applications or complaints are joined under paragraph <XRefInternal>38</XRefInternal>(d), (f) or (h), the President shall cause written notice of the joinder to be provided to the complainants and applicants involved in them.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885428" lims:id="885428"><Label>(5)</Label><Text>If proceedings or investigations are joined under paragraph <XRefInternal>38</XRefInternal>(e), (g) or (i), the President shall cause written notice of the joinder to be provided to the complainants, applicants, importers, exporters, government of each country of export and domestic producers involved in them.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885430" lims:id="885430">SOR/2000-138, s. 7; Interest Inquiry</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885432" lims:id="885432"><Label>40.1</Label><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885433" lims:id="885433"><Label>(1)</Label><Text>A request referred to in subsection 45(1) of the Act shall be made in writing to the Tribunal within 45 days after the issuance of an order or finding by the Tribunal under section 43 of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885434" lims:id="885434"><Label>(2)</Label><Text>A request referred to in subsection 45(1) of the Act shall</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885435" lims:id="885435"><Label>(a)</Label><Text>include the name, address for service, telephone number and, if any, the facsimile number and electronic mail address of the requester and of the requester’s counsel, if any, and be signed by the requester or by the requester’s counsel, if any;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885436" lims:id="885436"><Label>(b)</Label><Text>include a statement of the public interest affected by the imposition of an anti-dumping or countervailing duty indicating the degree to which it is affected;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885437" lims:id="885437"><Label>(c)</Label><Text>include sufficient information as to whether the imposition of an anti-dumping or countervailing duty would not or might not be in the public interest;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885438" lims:id="885438"><Label>(d)</Label><Text>address all relevant factors, including, where applicable,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885439" lims:id="885439"><Label>(i)</Label><Text>the availability of goods of the same description from countries or exporters to which the order or finding does not apply,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885440" lims:id="885440"><Label>(ii)</Label><Text>the effect that the imposition of an anti-dumping or countervailing duty has had or is likely to have on competition in the domestic market,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885441" lims:id="885441"><Label>(iii)</Label><Text>the effect that the imposition of an anti-dumping or countervailing duty has had or is likely to have on producers in Canada that use the goods as inputs in the production of other goods and in the provision of services,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885442" lims:id="885442"><Label>(iv)</Label><Text>the effect that the imposition of an anti-dumping or countervailing duty has had or is likely to have on competition by limiting access to goods that are used as inputs in the production of other goods and in the provision of services, or by limiting access to technology,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885443" lims:id="885443"><Label>(v)</Label><Text>the effect that the imposition of an anti-dumping or countervailing duty has had or is likely to have on the choice or availability of goods at competitive prices for consumers, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885444" lims:id="885444"><Label>(vi)</Label><Text>the effect that the non-imposition of an anti-dumping or countervailing duty, or the non-imposition of such a duty in the full amount provided for in sections 3 to 6 of the Act is likely to have on domestic producers of inputs, including primary commodities, used in the production of like goods; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885445" lims:id="885445"><Label>(e)</Label><Text>include any other information that is relevant in the circumstances.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885446" lims:id="885446"><Label>(3)</Label><Text>For the purposes of subsection 45(3) of the Act, the following factors are prescribed:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885447" lims:id="885447"><Label>(a)</Label><Text>whether goods of the same description are readily available from countries or exporters to which the order or finding does not apply;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885448" lims:id="885448"><Label>(b)</Label><Text>whether imposition of an anti-dumping or countervailing duty in the full amount</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885449" lims:id="885449"><Label>(i)</Label><Text>has eliminated or substantially lessened or is likely to eliminate or substantially lessen competition in the domestic market in respect of goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885450" lims:id="885450"><Label>(ii)</Label><Text>has caused or is likely to cause significant damage to producers in Canada that use the goods as inputs in the production of other goods and in the provision of services,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885451" lims:id="885451"><Label>(iii)</Label><Text>has significantly impaired or is likely to significantly impair competitiveness by</Text><Clause lims:inforce-start-date="2018-04-26" lims:fid="885452" lims:id="885452"><Label>(A)</Label><Text>limiting access to goods that are used as inputs in the production of other goods and in the provision of services, or</Text></Clause><Clause lims:inforce-start-date="2018-04-26" lims:fid="885453" lims:id="885453"><Label>(B)</Label><Text>limiting access to technology, or</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885454" lims:id="885454"><Label>(iv)</Label><Text>has significantly restricted or is likely to significantly restrict the choice or availability of goods at competitive prices for consumers or has otherwise caused or is otherwise likely to cause them significant harm; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885455" lims:id="885455"><Label>(c)</Label><Text>whether non-imposition of an anti-dumping or countervailing duty or the non-imposition of such a duty in the full amount provided for in sections 3 to 6 of the Act is likely to cause significant damage to domestic producers of inputs, including primary commodities, used in the domestic manufacture or production of like goods.</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885456" lims:id="885456"><Label>(d)</Label><Text><Repealed>[Repealed, SOR/2015-27, s. 5]</Repealed></Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885457" lims:id="885457"><Label>(4)</Label><Text>A request by a person referred to in subsection 45(6) of the Act to make representations to the Tribunal on the question referred to in that subsection shall be made in writing and filed with the Tribunal within 21 days after the date of publication of the notice referred to in subsection 45(2) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885458" lims:id="885458"><Label>(5)</Label><Text>A request made by a person under subsection (4) shall outline the person’s interest in the inquiry and shall give the name, address for service, telephone number, and, if any, the facsimile number and electronic-mail address of the person and of the person’s counsel, if any.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885460" lims:id="885460">SOR/2000-138, s. 7; SOR/2015-27, s. 5; SOR/2018-88, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="885461" lims:id="885461" level="2"><TitleText>Person Interested</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885462" lims:id="885462"><Label>41</Label><Text>For the purpose of subsection 45(6) of the Act, <DefinedTermEn>person interested</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885463" lims:id="885463"><Label>(a)</Label><Text>a person who is engaged in the production, sale or export of any goods that are the subject of an investigation;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885464" lims:id="885464"><Label>(b)</Label><Text>a person who is engaged in the purchase or import of any goods that are the subject of an investigation, or a trade union that represents persons employed in such purchase or import or an association that includes such trade unions;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885465" lims:id="885465"><Label>(c)</Label><Text>a person who is engaged in the production, purchase or sale of any goods produced in Canada that are like goods in relation to any goods that are the subject of an investigation, or a trade union that represents persons employed in such production, purchase or sale or an association that includes such trade unions;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885466" lims:id="885466"><Label>(d)</Label><Text>a person who is engaged in the production or sale of any goods produced in Canada that are used in the production of like goods in relation to any goods that are the subject of an investigation, or a trade union that represents persons employed in such production or sale or an association that includes such trade unions;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885467" lims:id="885467"><Label>(e)</Label><Text>a person who is acting on behalf of a person referred to in any of paragraphs (a) to (d) or a trade union or association referred to in any of paragraphs (b) to (d);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885468" lims:id="885468"><Label>(f)</Label><Text>a person who is required or authorized by any Act of Parliament or of the legislature of a province to make representations to the Tribunal on the question referred to in subsection 45(6) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885469" lims:id="885469"><Label>(g)</Label><Text>a person who is a user of any goods that are like goods in relation to any goods that are the subject of an investigation, or a trade union that represents persons employed by such a user or an association that includes such trade unions; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885470" lims:id="885470"><Label>(h)</Label><Text>an association whose purpose includes to advocate for consumer interests in Canada.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885472" lims:id="885472">SOR/2000-138, s. 8; SOR/2018-88, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885473" lims:id="885473"><Label>42</Label><Text>For the purposes of subsection 89(1) and section 95 of the Act, a person referred to in paragraphs 41(a) to (c) of these Regulations is a person interested in the question as to which of two or more persons is the importer in Canada where that question arises under the Act.</Text></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="885474" lims:id="885474" level="2"><TitleText>Fee Payable</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885475" lims:id="885475"><Label>43</Label><Text>The fees that are payable under section 83 of the Act for the copying of information, and the fees that are payable for the copying of information that is disclosed under subsection 84(3) of the Act, shall be as follows:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885476" lims:id="885476"><Label>(a)</Label><Text>for photocopying a page with the dimensions of not more than 21.5 cm by 35.5 cm, $0.20 per page;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885477" lims:id="885477"><Label>(b)</Label><Text>for microfiche duplication, non-silver, $0.40 per fiche;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885478" lims:id="885478"><Label>(c)</Label><Text>for 16 mm microfilm duplication, non-silver, $12 per 30.5 mm roll;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885479" lims:id="885479"><Label>(d)</Label><Text>for 35 mm microfilm duplication, non-silver, $14 per 30.5 mm roll;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885480" lims:id="885480"><Label>(e)</Label><Text>for microform-to-paper duplication, $0.25 per page;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885481" lims:id="885481"><Label>(f)</Label><Text>for magnetic tape-to-tape duplication, $25 per 731.5 mm reel;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885482" lims:id="885482"><Label>(g)</Label><Text>for personal computer magnetic diskette duplication, $2 per diskette (all sizes); and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="885483" lims:id="885483"><Label>(h)</Label><Text>for compact disk duplication, $20 per disk.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="885485" lims:id="885485">SOR/89-578, s. 1; SOR/2000-138, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="885486" lims:id="885486" level="2"><TitleText>Currency Conversion</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885487" lims:id="885487"><Label>44</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885488" lims:id="885488"><Label>(1)</Label><Text>Subject to subsection (2) and section 45, where an amount that is used or taken into account for any purpose in the administration or enforcement of the Act is expressed in the currency of a country other than Canada, the equivalent dollar value of that amount shall be calculated by multiplying that other currency amount by the prevailing rate of exchange referred to in section 5 of the <XRefExternal reference-type="regulation" link="SOR-85-900">Currency Exchange for Customs Valuation Regulations</XRefExternal> in respect of that currency for the date of sale.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="885489" lims:id="885489"><Label>(2)</Label><Text>Where a sale of foreign currency on forward markets is directly linked to the export sale to an importer in Canada, the rate of exchange that was used in the forward sale of currency shall be used in place of the rate of exchange referred to in subsection (1).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="885491" lims:id="885491">SOR/95-26, s. 13</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885492" lims:id="885492"><Label>45</Label><Text>Where sufficient information has not been furnished or is not available at the time goods have been released from customs possession or entered for warehouse, whichever is the earlier, to enable the calculation under section 44 to be made on the basis of the date of sale, the date of shipment to Canada shall be used in place of the date of sale for the purpose of that section.</Text></Section><Heading lims:inforce-start-date="2018-04-26" lims:fid="885493" lims:id="885493" level="2"><TitleText>Re-determinations</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="885494" lims:id="885494"><Label>46</Label><Text>Where a manufacturer, producer or exporter of goods of the United States files a request for re-determination, the manufacturer, producer or exporter is hereby prescribed for the purposes of subsection 59(4) of the Act.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="885496" lims:id="885496">SOR/89-63, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885497" lims:id="885497"><Label>47</Label><Text>For the purposes of subsections 56(1.01) and (1.1), 58(1.1) and (2) and 70(1) to (3) of the Act, a request for a re-determination shall be delivered to the Canada Border Services Agency at the address specified on its website.</Text><HistoricalNote><HistoricalNoteSubItem with a statement of facts in support of those arguments;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885528" lims:id="885528"><Label>(c)</Label><Text>evidence in support of those arguments and facts; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885529" lims:id="885529"><Label>(d)</Label><Text>if the requester is the importer of the goods, a copy of</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885530" lims:id="885530"><Label>(i)</Label><Text>the documentation used in accounting for the goods under subsection 32(1), (3) or (5) of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal>, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885531" lims:id="885531"><Label>(ii)</Label><Text>for goods that were released prior to accounting, any documentation that was used in making an interim accounting for the goods under subsection 32(2) of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal> that is different from the documentation referred to in subparagraph (i).</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885533" lims:id="885533">SOR/2018-88, s. purpose of subsection 60.1(2) of the Act, the notice of a re-determination is to be published on the website of the Canada Border Services Agency no later than 15 days after the day on which the lims:inforce-start-date="2018-04-26" lims:fid="885538" lims:id="885538"><Label>(1)</Label><Text>For the purpose of subsection 61(1.1) of the Act, <DefinedTermEn>interested person</DefinedTermEn> means any person who, in the opinion of the Tribunal, has a substantial interest in the matter and any person who</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885539" lims:id="885539"><Label>(a)</Label><Text>in respect of an appeal of a re-determination, is a domestic producer of like goods in relation to goods that are subject to the applicable order of the Governor in Council or order or finding of the Tribunal; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885540" lims:id="885540"><Label>(b)</Label><Text>in respect of an appeal of a scope ruling or an amendment to a scope ruling, provided information to the President for the purpose of either the proceeding that resulted in the scope ruling or the review that resulted in the amendment, or both.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885541" lims:id="885541"><Label>(2)</Label><Text>For the purpose of subsection 63(1) of the Act, <DefinedTermEn>interested person</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885542" lims:id="885542"><Label>(a)</Label><Text>any person who is, or may become,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885543" lims:id="885543"><Label>(i)</Label><Text>an importer of goods that are or could be subject to the applicable order of the Governor in Council, order or finding of the Tribunal or undertaking, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885544" lims:id="885544"><Label>(ii)</Label><Text>an exporter of such goods;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885545" lims:id="885545"><Label>(b)</Label><Text>a foreign producer of such goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885546" lims:id="885546"><Label>(c)</Label><Text>a domestic producer of like goods in relation to goods that are subject to the applicable order, finding or undertaking; or</Text></Paragraph><Paragraph <DefinedTermEn>interested person</DefinedTermEn> means any person who provided information to the President for the purpose of the review of the scope lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885565" lims:id="885565"><Label>54.1</Label><Text>An application for a scope ruling referred to in subsection 63(1) of the Act is complete if it contains the following information:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885566" lims:id="885566"><Label>(a)</Label><Text>in all cases,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885567" lims:id="885567"><Label>(i)</Label><Text>the name and civic address and, if different, postal address of the interested person,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885568" lims:id="885568"><Label>(ii)</Label><Text>an indication as to which of subparagraph <XRefInternal>52.3</XRefInternal>(2)(a)(i) or (ii) or of paragraph <XRefInternal>52.3</XRefInternal>(2)(b), (c) or (d) describes the interested person,</Text></Subparagraph><Subparagraph Commodity Description and Coding System attributed to the goods for which the ruling is applied for,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885573" lims:id="885573"><Label>(vii)</Label><Text>an indication as to whether those goods have been sold or consigned to an importer in Canada and whether those goods have been imported,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885574" lims:id="885574"><Label>(viii)</Label><Text>the name and civic address and, if different, postal address of each importer in Canada of those goods, if known,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885575" lims:id="885575"><Label>(ix)</Label><Text>the name and civic address and, if different, postal address of each producer and exporter of those goods, if known,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885576" lims:id="885576"><Label>(x)</Label><Text>the name and civic address and, if different, postal address of each domestic producer of like goods, and of any association of those domestic producers, if known, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885577" lims:id="885577"><Label>(xi)</Label><Text>any other relevant information; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885578" lims:id="885578"><Label>(b)</Label><Text>if the basis for the ruling that is applied for is a claim as to whether the goods for which the ruling is applied for originate in a country that is subject to the applicable order, finding or undertaking referred to in subparagraph (a)(iii) or originate in a third country,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885579" lims:id="885579"><Label>(i)</Label><Text>the name of the subject country and the third country,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885580" lims:id="885580"><Label>(ii)</Label><Text>a description, at the time of their export from the subject country, of goods from which the goods for which the ruling is applied for are produced,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885581" lims:id="885581"><Label>(iii)</Label><Text>the name and civic address and, if different, postal address, of each producer and exporter of the goods for which their description is required by subparagraph (ii), if known,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885582" lims:id="885582"><Label>(iv)</Label><Text>a description of the movement of the goods for which their description is required by subparagraph (a)(v) from the third country to Canada and by subparagraph (ii) from the subject country to the third country, including a specification of any intermediate country that they entered and left or through which they were transhipped en route,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885583" lims:id="885583"><Label>(v)</Label><Text>a description of production activities, undertaken in the subject country, the third country and any intermediate country, in relation to goods for which their description is required by subparagraph (a)(v) and subparagraph (ii), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885584" lims:id="885584"><Label>(vi)</Label><Text>any other relevant information.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885586" lims:id="885586">SOR/2018-88, s. 12</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885587" lims:id="885587"><Label>54.2</Label><Text>For the purpose of subsection 63(4) of the Act, the President shall reject an application for a scope ruling if the application is incomplete or there is a scope ruling that applies to the goods for which the ruling is applied for.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885589" lims:id="885589">SOR/2018-88, s. 12</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885590" lims:id="885590"><Label>54.3</Label><Text>For the purpose of subsection 63(5) of the Act, the President may reject an application for a scope ruling if any of the following circumstances apply:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885591" lims:id="885591"><Label>(a)</Label><Text>the goods for which the ruling is applied for have not been produced as of the day on which the application is received;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885592" lims:id="885592"><Label>(b)</Label><Text>the basis for which the ruling is applied for is the subject of a proceeding before the President, the Tribunal, the Federal Court of Appeal, the Supreme Court of Canada or a panel under Part I.1 or II of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885593" lims:id="885593"><Label>(c)</Label><Text>following a decision setting out a finding of circumvention, the Tribunal makes an amending order referred to in section 75.3 of the Act that applies to the goods for which the ruling is applied for;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885594" lims:id="885594"><Label>(d)</Label><Text>a decision by the Tribunal, the Federal Court of Appeal, the Supreme Court of Canada, or a panel under Part I.1 or II of the Act, applies to the ruling that is applied for; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885595" lims:id="885595"><Label>(e)</Label><Text>in the opinion of the President, the application is frivolous, vexatious or made in bad faith.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885597" lims:id="885597">SOR/2018-88, s. 12</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885598" lims:id="885598"><Label>54.4</Label><Text>For the purpose of subsection 66(2) of the Act, the President may extend the period for making a scope ruling to 210 days if any of the following circumstances apply:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885599" lims:id="885599"><Label>(a)</Label><Text>the issues presented by the scope proceeding are complex or novel;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885600" lims:id="885600"><Label>(b)</Label><Text>it is difficult to obtain satisfactory evidence or to assess the accuracy of evidence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885601" lims:id="885601"><Label>(c)</Label><Text>it is difficult to consider the information and evidence in light of the variety of goods in respect of which the scope proceeding has been initiated, the number of persons involved in the proceeding or any unusual difficulties.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885603" lims:id="885603">SOR/2018-88, s. 12</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885604" lims:id="885604"><Label>54.5</Label><Text>For the purpose of subsection 66(3) of the Act, the President may terminate a scope proceeding if any of the following circumstances apply:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885605" lims:id="885605"><Label>(a)</Label><Text>the President is unable to obtain necessary evidence or assess the accuracy of evidence;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885606" lims:id="885606"><Label>(b)</Label><Text>in the opinion of the President, there are no grounds for making the scope ruling;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885607" lims:id="885607"><Label>(c)</Label><Text>there is a scope ruling that applies to the goods in respect of which the scope proceeding has been initiated; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885608" lims:id="885608"><Label>(d)</Label><Text>a circumstance referred to in any of paragraphs <XRefInternal>54.3</XRefInternal>(b) to (d) arises after the initiation of the proceeding.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885610" lims:id="885610">SOR/2018-88, s. 12</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885611" lims:id="885611"><Label>54.6</Label><Text>For the purpose of subsection 66(6) of the Act, the President may take the following factors into account in making a scope ruling:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885612" lims:id="885612"><Label>(a)</Label><Text>in all cases,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885613" lims:id="885613"><Label>(i)</Label><Text>the physical characteristics of the goods in respect of which the scope proceeding has been initiated, including their composition,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885614" lims:id="885614"><Label>(ii)</Label><Text>their technical specifications,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885615" lims:id="885615"><Label>(iii)</Label><Text>their uses,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885616" lims:id="885616"><Label>(iv)</Label><Text>their packaging, including any other goods contained in the packaging, along with the promotional material and documentation concerning the goods in respect of which the scope proceeding has been initiated, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885617" lims:id="885617"><Label>(v)</Label><Text>their channels of distribution;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885618" lims:id="885618"><Label>(b)</Label><Text>for a ruling as to whether goods in respect of which the scope proceeding has been initiated are of the same description as goods to which an order of the Governor in Council or an order or finding of the Tribunal applies,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885619" lims:id="885619"><Label>(i)</Label><Text>the description of the goods referred to in that order or that order or finding,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885620" lims:id="885620"><Label>(ii)</Label><Text>in the case of an order or finding of the Tribunal, the reasons for the order or finding, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885621" lims:id="885621"><Label>(iii)</Label><Text>any relevant decision by the Tribunal, the Federal Court of Appeal, the Supreme Court of Canada, or a panel under Part I.1 or II of the Act;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885622" lims:id="885622"><Label>(c)</Label><Text>for a ruling as to whether goods in respect of which the scope proceeding has been initiated are of the same description as goods to which an undertaking applies,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885623" lims:id="885623"><Label>(i)</Label><Text>the description of the goods referred to in the preliminary determination of dumping or subsidizing and in the undertaking, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885624" lims:id="885624"><Label>(ii)</Label><Text>the reasons for the preliminary determination; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885625" lims:id="885625"><Label>(d)</Label><Text>if the basis for a ruling referred to in paragraph (b) or (c) is whether goods in respect of which the scope proceeding has been initiated originate in a country that is subject to the applicable order, finding or undertaking or originate in a third country,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885626" lims:id="885626"><Label>(i)</Label><Text>the production activities undertaken in the third country in respect of the goods and undertaken in the subject country in respect of goods from which the goods are produced,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885627" lims:id="885627"><Label>(ii)</Label><Text>the nature of the goods when they were exported from the third country and of goods from which the goods are produced when they were exported from the subject country, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885628" lims:id="885628"><Label>(iii)</Label><Text>the costs of production of the goods incurred in the third country.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885630" lims:id="885630">SOR/2018-88, s. 12</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885631" lims:id="885631"><Label>54.7</Label><Text>For the purpose of subsection 67(2) of the Act, the President may review a scope ruling in any of the following circumstances:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885632" lims:id="885632"><Label>(a)</Label><Text>an order or finding is issued by the Tribunal with respect to goods of the same description as goods to which the ruling applies except that those goods originate in, or are exported from, a country that is different from a subject country in the ruling;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885633" lims:id="885633"><Label>(b)</Label><Text>an order made under subsection 76.01(5) or 76.03(12) of the Act affects the ruling;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885634" lims:id="885634"><Label>(c)</Label><Text>an order or finding made under subsection 61(3) or 62(2) of the Act relates to the scope ruling or a definitive decision that relates to the scope ruling is referred back under subsection 77.015(3) or (4), 77.019(5), 77.15(3) or (4) or 77.19(4) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885635" lims:id="885635"><Label>(d)</Label><Text>a decision referred to in subsection 75.1(1) of the Act sets out a finding of circumvention that relates to the scope ruling;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885636" lims:id="885636"><Label>(e)</Label><Text>the ruling is based on erroneous information; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885637" lims:id="885637"><Label>(f)</Label><Text>there has been a material change in circumstances since the ruling was made.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885639" lims:id="885639">SOR/2018-88, s. Review</TitleText></Heading><Section lims:inforce-start-date="2018-04-26" lims:lastAmendedDate="2018-04-26" lims:fid="885641" lims:id="885641"><Label>55</Label><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885642" lims:id="885642"><Label>(1)</Label><Text>For the purpose of subsection 13.2(2) of the Act, a request for a review shall contain the following information:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885643" lims:id="885643"><Label>(a)</Label><Text>confirmation that the goods have been sold or consigned to an importer in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885644" lims:id="885644"><Label>(b)</Label><Text>with respect to each sale or consignment of the goods to an importer in Canada,</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885645" lims:id="885645"><Label>(i)</Label><Text>the name and address of the importer,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885646" lims:id="885646"><Label>(ii)</Label><Text>a detailed description of the goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885647" lims:id="885647"><Label>(iii)</Label><Text>the date of sale or consignment of the goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885648" lims:id="885648"><Label>(iv)</Label><Text>the date of shipment of the goods,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885649" lims:id="885649"><Label>(v)</Label><Text>the purchase or consignment order number with respect to the goods and the date of the purchase or consignment order,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885650" lims:id="885650"><Label>(vi)</Label><Text>complete details of the</Text><Clause lims:inforce-start-date="2018-04-26" lims:fid="885651" lims:id="885651"><Label>(A)</Label><Text>contract of sale or of the purchase order acknowledgement or acceptance, or</Text></Clause><Clause lims:inforce-start-date="2018-04-26" lims:fid="885652" lims:id="885652"><Label>(B)</Label><Text>consignment contract or of the consignment order acknowledgment or acceptance, and</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885653" lims:id="885653"><Label>(vii)</Label><Text>the name and address of the manufacturer or producer of the goods; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885654" lims:id="885654"><Label>(c)</Label><Text>a description of the exporting enterprise and a list of all associated persons who are located in the country of export.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885655" lims:id="885655"><Label>(2)</Label><Text>A request for a review shall be delivered to the Canada Border Services Agency at the address specified on its paragraph 71(a) of the Act, the following factors may be considered in determining whether there has been a change in the pattern of trade:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885672" lims:id="885672"><Label>(a)</Label><Text>any change in the volume of imports into Canada of goods subject to the applicable order of the Governor in Council or the applicable order or finding of the Tribunal;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885673" lims:id="885673"><Label>(b)</Label><Text>any change in the volume of imports into Canada of goods in respect of which circumvention may be occurring;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885674" lims:id="885674"><Label>(c)</Label><Text>any change in the volume of imports — from the country named in that applicable order or order or finding into the country from which goods referred to in paragraph (b) originate or are exported — of</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885675" lims:id="885675"><Label>(i)</Label><Text>like goods in relation to goods referred to in paragraph (a), or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885676" lims:id="885676"><Label>(ii)</Label><Text>parts or components from which like goods referred to in subparagraph (i) are assembled or completed; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885677" lims:id="885677"><Label>(d)</Label><Text>any other the purpose of paragraph 71(b) of the Act, the following activities are prescribed:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885681" lims:id="885681"><Label>(a)</Label><Text>the assembly or completion of like goods in Canada, by means of insignificant processes, using parts or components — that represent a major portion of the total cost of producing the like goods — originating in or exported from a country that is subject to the applicable order of the Governor in Council or the applicable order or finding of the Tribunal, whether or not those parts or components are the only ones used to assemble or complete the like goods in Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885682" lims:id="885682"><Label>(b)</Label><Text>the assembly or completion of like goods in a third country, by means of insignificant processes, using parts or components — that represent a major portion of the total cost of producing the like goods — originating in or exported from a country that is subject to the applicable order of the Governor in Council or the applicable order or finding of the Tribunal, whether or not those parts or components are the only ones used to assemble or complete the like goods in the third country; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885683" lims:id="885683"><Label>(c)</Label><Text>the slight modification — in a country that is subject to the applicable order of the Governor in Council or the applicable order or finding of the Tribunal or in a third country — of like goods originating in or exported from that subject country such that the slightly modified goods are no following factors may be considered in determining whether the processes of assembly or completion of the like goods referred to in paragraph <XRefInternal>57.12</XRefInternal>(a) or (b) are insignificant:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885687" lims:id="885687"><Label>(a)</Label><Text>the nature of those processes;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885688" lims:id="885688"><Label>(b)</Label><Text>the nature of the facilities used to carry out those processes;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885689" lims:id="885689"><Label>(c)</Label><Text>the level of investment related to those processes and to those facilities;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885690" lims:id="885690"><Label>(d)</Label><Text>the level of research and development related to those processes;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885691" lims:id="885691"><Label>(e)</Label><Text>the costs of those processes;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885692" lims:id="885692"><Label>(f)</Label><Text>the proportion of those costs in relation to the cost of production of the like goods; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885693" lims:id="885693"><Label>(g)</Label><Text>any other relevant factor.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem in paragraph <XRefInternal>57.12</XRefInternal>(c) is slight:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885697" lims:id="885697"><Label>(a)</Label><Text>the physical characteristics of the modified goods and the like goods, including their composition;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885698" lims:id="885698"><Label>(b)</Label><Text>the technical specifications of the modified goods and the like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885699" lims:id="885699"><Label>(c)</Label><Text>each of the classification numbers under the Harmonized Commodity Description and Coding System attributed to the modified goods and the like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885700" lims:id="885700"><Label>(d)</Label><Text>the uses of the modified goods and the like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885701" lims:id="885701"><Label>(e)</Label><Text>the extent to which the modified goods could be substituted for the like goods and consumer preferences in relation to the modified goods and the like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885702" lims:id="885702"><Label>(f)</Label><Text>the packaging for the modified goods and the like goods, along with the promotional material and documentation concerning the modified goods and the like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885703" lims:id="885703"><Label>(g)</Label><Text>the channels of distribution for the modified goods and the like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885704" lims:id="885704"><Label>(h)</Label><Text>the difference in the processes to produce, the facilities used to produce and the costs of producing the modified goods and the like goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885705" lims:id="885705"><Label>(i)</Label><Text>the cost of the modification and, if it is possible to reverse the modification, the cost of reversing it; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885706" lims:id="885706"><Label>(j)</Label><Text>any other relevant factor.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem whether imports of goods to which an activity referred to in section <XRefInternal>57.12</XRefInternal> applies are undermining the remedial effects of the applicable order of the Governor in Council or the applicable order or finding of the Tribunal:</Text><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885710" lims:id="885710"><Label>(a)</Label><Text>the price and volume of like goods referred to in paragraph <XRefInternal>57.12</XRefInternal>(a) sold in Canada or the price and volume of imports of like goods referred to in paragraph <XRefInternal>57.12</XRefInternal>(b) or of slightly modified goods referred to in paragraph <XRefInternal>57.12</XRefInternal>(c);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885711" lims:id="885711"><Label>(b)</Label><Text>whether the goods referred to in paragraph (a) are sold to consumers that otherwise may have bought goods that are subject to the applicable order of the Governor in Council or the applicable order or finding of the Tribunal;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885712" lims:id="885712"><Label>(c)</Label><Text>whether the goods referred to in paragraph (a) have the same use as goods that are subject to the applicable order of the Governor in Council or the applicable order or finding of the Tribunal; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885713" lims:id="885713"><Label>(d)</Label><Text>any other relevant factor.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-26" lims:fid="885715" lims:id="885715">SOR/2018-88, s. lims:id="885717"><Label>(a)</Label><Text>a difference in costs in respect of</Text><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885718" lims:id="885718"><Label>(i)</Label><Text>goods that are subject to the applicable order of the Governor in Council or the applicable order or finding of the Tribunal, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-26" lims:fid="885719" lims:id="885719"><Label>(ii)</Label><Text>the like goods referred to in paragraph <XRefInternal>57.12</XRefInternal>(a) or (b) or the slightly modified goods referred to in paragraph <XRefInternal>57.12</XRefInternal>(c);</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885720" lims:id="885720"><Label>(b)</Label><Text>the timing of when an activity referred to in section <XRefInternal>57.12</XRefInternal> began or substantially increased in relation to the day on which an order imposing a countervailing duty was made under section 7 of the Act or an investigation was initiated under section 31 of the Act, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885721" lims:id="885721"><Label>(c)</Label><Text>the sale, in a country other than Canada, of like goods referred to in paragraph <XRefInternal>57.12</XRefInternal>(b), of parts or components referred to in paragraph <XRefInternal>57.12</XRefInternal>(a) or (b) or of slightly modified goods referred to in paragraph <XRefInternal>57.12</XRefInternal>(c);</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885722" lims:id="885722"><Label>(d)</Label><Text>a change in consumer preferences in relation to goods referred to in subparagraph (a)(i) or (ii) or to parts or components referred to in paragraph <XRefInternal>57.12</XRefInternal>(a);</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="885723" lims:id="1368684"><Label>(e)</Label><Text>a change in technology related to the production of goods referred to in subparagraph (a)(i) or (ii);</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-24" lims:enacted-date="2022-06-24" lims:fid="1368685" lims:id="1368685"><Label>(e.1)</Label><Text>any economic or commercial factors that are unrelated to the imposition of anti-dumping or countervailing duties; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885724" lims:id="885724"><Label>(f)</Label><Text>any other relevant lims:id="885755"><Label>(c)</Label><Text>a detailed description of those goods;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885756" lims:id="885756"><Label>(d)</Label><Text>if the decision setting out a finding of circumvention in respect of the applicable amending order referred to in section 75.3 of the Act is made in respect of a prescribed activity referred to in paragraph <XRefInternal>57.12</XRefInternal>(a), the name and civic address and, if different, the postal address of each producer of parts or components referred to in that paragraph and, if known, the name and civic address and, if different, the postal address of each person that uses those parts or components;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885757" lims:id="885757"><Label>(e)</Label><Text>if the decision setting out a finding of circumvention in respect of the applicable amending order were slightly modified such that they became goods for which the request for exemption is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885759" lims:id="885759"><Label>(g)</Label><Text>an indication of the applicable amending order referred to in section 75.3 of the Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-26" lims:fid="885760" lims:id="885760"><Label>(h)</Label><Text>arguments in support of the request, along with supporting evidence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-26" lims:fid="885761" lims:id="885761"><Label>(2)</Label><Text>A request for an exemption shall be delivered to the Canada Border Services Agency at the address
