(<DefinedTermFr>aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="872025" lims:id="872025" generate-in-text="no"><Text><DefinedTermEn>airport reference point</DefinedTermEn> means the point described in Part I of the schedule; (<DefinedTermFr>point de repère de l’aéroport</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="872026" lims:id="872026" generate-in-text="no"><Text><DefinedTermEn>approach surface</DefinedTermEn> means an imaginary inclined plane that extends upward and outward from each end of a strip, which approach surface is more particularly described in Part III of the schedule; (<DefinedTermFr>surface d’approche</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="872027" lims:id="872027" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport; (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="872028" lims:id="872028" generate-in-text="no"><Text><DefinedTermEn>outer surface</DefinedTermEn> means an imaginary surface located above and in the immediate vicinity of the airport, which outer surface is more particularly described in Part IV of the schedule; (<DefinedTermFr>surface extérieure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="872029" lims:id="872029" generate-in-text="no"><Text><DefinedTermEn>strip</DefinedTermEn> means the rectangular portion of the landing area of the airport, including the runway prepared for the take-off and landing of aircraft in a particular direction, which strip is more particularly described in Part V of the schedule; (<DefinedTermFr>bande</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="872030" lims:id="872030" generate-in-text="no"><Text><DefinedTermEn>transitional surface</DefinedTermEn> means an imaginary inclined plane that extends upward and outward from the lateral limits of a strip and its approach surfaces, which transitional surface is more particularly described in Part VI of the schedule. (<DefinedTermFr>surface de transition</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="872031" lims:id="872031"><Label>(2)</Label><Text>For the purposes of these Regulations, the assigned elevation of the airport reference point is deemed to be 774 feet above sea level.</Text></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="872032" lims:id="872032" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="872033" lims:id="872033"><Label>3</Label><Text>These Regulations apply to all the lands, including public road allowances, adjacent to or in the vicinity of the airport, that consist of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="872034" lims:id="872034"><Label>(a)</Label><Text>the lands within, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="872035" lims:id="872035"><Label>(b)</Label><Text>the lands directly under that portion of an approach surface that extends beyond</Text></Paragraph><ContinuedSectionSubsection lims:inforce-start-date="2006-03-22" lims:fid="872036" lims:id="872036"><Text>the outer limits described in Part II of the schedule.</Text></ContinuedSectionSubsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="872037" lims:id="872037" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="872038" lims:id="872038"><Label>4</Label><Text>No person shall erect or construct, on any land to which these Regulations apply, any building, structure or object or any addition to any existing building, structure or object, the highest point of which will exceed in elevation at the location of that point any</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="872039" lims:id="872039"><Label>(a)</Label><Text>approach surface;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="872040" lims:id="872040"><Label>(b)</Label><Text>outer surface; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="872041" lims:id="872041"><Label>(c)</Label><Text>transitional surface.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="872042" lims:id="872042" level="1"><TitleText>Natural Growth</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="872043" lims:id="872043"><Label>5</Label><Text>Where an object of natural growth on any land to which these Regulations apply exceeds in elevation any of the surfaces referred to in paragraphs 4(a) to (c), the Minister may make a direction that the owner or the occupier of the land on which that object is growing remove the excessive growth.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="872044" lims:id="872044" level="1"><TitleText>Disposal of Waste</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="872045" lims:id="872045"><Label>6</Label><Text>No owner or occupier of any land to which these Regulations apply shall permit such land or any part of it to be used for the disposal of any waste edible by or attractive to birds.</Text></Section></Body><Schedule lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="872046" lims:id="872046" bilingual="no" spanlanguages="no"><ScheduleFormHeading lims:inforce-start-date="2006-03-22" lims:fid="872047" lims:id="872047"><Label>SCHEDULE</Label><OriginatingRef>(ss. 2 and 3)</OriginatingRef></ScheduleFormHeading><Heading lims:inforce-start-date="2006-03-22" lims:fid="872048" lims:id="872048" level="1"><Label>PART I</Label><TitleText>Description of the Airport Reference Point</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="872049" lims:id="872049" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The airport reference point is a point determined by commencing at the Northeasterly corner of Lot 19 in the Outer Two Miles, in the Parish of Saint James; THENCE, Southerly along the Eastern boundary of said Lot 19, a distance of 2,000 feet; THENCE, Westerly at right angles to the said Eastern boundary of Lot 19, a distance of 1,000 feet.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="872050" lims:id="872050" level="1"><Label>PART II</Label><TitleText>Description of the Outer Limits of Land</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="872051" lims:id="872051" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>In the City of Winnipeg in the Province of Manitoba being in accordance with the Special Survey of said City and being all those lands contained within the following limits, namely;</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="872052" lims:id="872052" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>COMMENCING at the point of intersection of the straight production northerly of the west boundary of Lot Two (2) in the Outer Two Miles of the Parish of Saint James with the south boundary of Section Twenty (20) Township Eleven (11) Range Two (2) East of the Principal Meridian;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872053" lims:id="872053" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>THENCE along the following described boundaries of sections and parts of sections all in said township and range and their straight productions across intervening road allowances, in the order and direction III</Label><TitleText>Description of the Approach Surfaces</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="872083" lims:id="872083" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The approach surfaces, shown on Department of Transport Winnipeg International Airport Zoning Plan No. E.1540, are surfaces abutting each end of the strips associated with the runways designated 18L-36R, 13R-31L, 13L-31R, the 18R end of the strip associated with runway 18R-36L and the 25 end of the strip associated with runway 07-25 and are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="872084" lims:id="872084" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(a)</Label><Text>a surface abutting the end of the strip associated with runway approach 18L,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872085" lims:id="872085" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(b)</Label><Text>a surface abutting the end of the strip associated with runway approach 36R,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872086" lims:id="872086" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(c)</Label><Text>a surface abutting the end of the strip associated with runway approach 13R,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872087" lims:id="872087" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(d)</Label><Text>a surface abutting the end of the strip associated with runway approach 31L,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872088" lims:id="872088" format-ref="indent-0-0" language-align="no" list-item="no"><Text>consisting of an inclined plane having a ratio of one foot measured vertically to 50 feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip, 1,000 feet measured vertically above the elevation at the end of the strip, and 50,000 feet measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 8,100 feet from the projected centre line; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872089" lims:id="872089" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(e)</Label><Text>a surface abutting the end of the strip associated with runway approach 13L, and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872090" lims:id="872090" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(f)</Label><Text>a surface abutting language-align="no" list-item="no"><Text>consisting of an inclined plane having a ratio of one foot measured vertically to 50 feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip, 1,000 feet measured vertically above the elevation at the end of the strip, and 50,000 feet measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 8,000 feet from the projected centre line; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872092" lims:id="872092" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(g)</Label><Text>a surface abutting the end of the strip associated with runway approach 25,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872093" lims:id="872093" format-ref="indent-0-0" language-align="no" list-item="no"><Text>consisting of an inclined plane having a ratio of one foot measured vertically to 50 feet measured horizontally rising to an imaginary horizontal line drawn at right angles to the projected centre line of the strip, 200 feet measured vertically above the elevation at the end of the strip, and 10,000 feet measured horizontally from the end of the strip, the outer ends of the imaginary horizontal line being 1,600 feet from the projected centre line; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872094" lims:id="872094" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(h)</Label><Text>a surface abutting the end of the strip associated with runway approach 18R,</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:inforce-start-date="2006-03-22" lims:fid="872097" lims:id="872097" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The outer surface, shown on Department of Transport Winnipeg International Airport Zoning Plan No. E.1540, is an imaginary surface located at a common plane established at a constant elevation of 150 feet above the assigned elevation of the airport reference point except where that common plane is less than 30 feet above the surface of the ground, the imaginary surface is located 30 feet above the surface of the ground.</Text></Provision><Heading lims:inforce-start-date="2006-03-22" lims:fid="872098" lims:id="872098" level="1"><Label>PART V</Label><TitleText>Description of the Strips</TitleText></Heading><Provision lims:inforce-start-date="2006-03-22" lims:fid="872099" lims:id="872099" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>The strips, shown on Department of Transport Winnipeg International Airport Zoning Plan No. E.1540, are described as follows:</Text><Provision lims:inforce-start-date="2006-03-22" lims:fid="872100" lims:id="872100" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(a)</Label><Text>the strip associated with runway 18L-36R is 1,200 feet in width, 600 feet being on each side of the centre line of the runway and 13,600 feet in length; and</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="872101" lims:id="872101" first-line-indent="1" language-align="no" list-item="yes" subsequent-line-indent="3"><Label>(b)</Label><Text>the strip associated with runway 13R-31L is 1,200 feet in width, 600 feet being on each side of the centre line of the runway and subsequent-line-indent="3"><Label>(c)</Label><Text>the strip associated with runway 13L-31R is 1,000 feet in width, 500 feet being on each side of the centre line of the runway and 13,700 feet in surface, shown on Department of Transport Winnipeg International Airport Zoning Plan No. E.1540, is a surface consisting of an inclined plane having a ratio of one foot measured vertically to seven feet measured horizontally at right angles to the centre line, and centre line produced of each strip and extending upward and outward from the lateral limits of each strip and its approach surfaces
