SOR/2003-302, s. 5</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="870090" lims:id="870090" level="1"><TitleText>Non-structural Fires</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="870091" lims:id="870091" level="2"><TitleText>Prevention of Fires</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="870092" lims:id="870092"><Label>3</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870093" lims:id="870093"><Label>(1)</Label><Text>If, for the prevention of fire or fire management in a park, the superintendent considers it necessary to close any area or highway in the park to public use or travel, or to prohibit smoking or the starting or maintaining of fires in any area of the park, the superintendent shall post a prominently displayed notice in the area, on the highway or in any other conspicuous location in the park, which notice states, as applicable, that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870094" lims:id="870094"><Label>(a)</Label><Text>the area or highway is closed to public use or travel;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870095" lims:id="870095"><Label>(b)</Label><Text>smoking in the area is prohibited; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870096" lims:id="870096"><Label>(c)</Label><Text>starting or maintaining fires in the area is prohibited.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870097" lims:id="870097"><Label>(2)</Label><Text>When a notice has been posted under subsection (1), no person shall, in contravention of the notice,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870098" lims:id="870098"><Label>(a)</Label><Text>enter the area or highway referred to in the notice;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870099" lims:id="870099"><Label>(b)</Label><Text>smoke in the area referred to in the notice; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870100" lims:id="870100"><Label>(c)</Label><Text>start or maintain a fire in the area referred to in the notice.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870101" lims:id="870101"><Label>(3)</Label><Text>Every person in an area or on a highway that is subsequently closed pursuant to subsection (1) shall leave that area or highway.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="870103" lims:id="870103">SOR/94-266, s. 3; SOR/2003-302, s. 6</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="870104" lims:id="870104"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870105" lims:id="870105"><Label>(1)</Label><Text>No person shall start or maintain any fire in a park except</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870106" lims:id="870106"><Label>(a)</Label><Text>in a fireplace on private property;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870107" lims:id="870107"><Label>(b)</Label><Text>in a fireplace provided by the superintendent;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870108" lims:id="870108"><Label>(c)</Label><Text>in a portable stove, hibachi or barbecue; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870109" lims:id="870109"><Label>(d)</Label><Text>when in possession of a permit issued under subsection (3).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870110" lims:id="870110"><Label>(2)</Label><Text>No person shall start or attempt to start or maintain any fire referred to in subsection (1) unless such person uses only the type of fuel that the fireplace, portable stove, hibachi or barbecue is designed for.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870111" lims:id="870111"><Label>(3)</Label><Text>The superintendent may issue a permit to a person to start and maintain a fire in a park and such permit shall be subject to any terms and conditions stated thereon by the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870112" lims:id="870112"><Label>(4)</Label><Text>Every person who starts and maintains a fire shall, when it is no longer required, extinguish it.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="870114" lims:id="870114">SOR/94-266, s. 3; SOR/2003-302, s. 9(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="870115" lims:id="870115"><Label>5</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870116" lims:id="870116"><Label>(1)</Label><Text>Subject to subsection (2), no person shall be in possession of more than 250 litres of fuel or other flammable liquid in a park unless</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870117" lims:id="870117"><Label>(a)</Label><Text>the fuel or liquid is stored in the tank of a vehicle and that tank is a component of the fuel system of the vehicle;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870118" lims:id="870118"><Label>(b)</Label><Text>the fuel or liquid is stored in a tank that is a component of the heating system of the building; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870119" lims:id="870119"><Label>(c)</Label><Text>the fuel or liquid is being carried in a vehicle designed for the transportation of fuel or flammable liquid.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870120" lims:id="870120"><Label>(2)</Label><Text>The superintendent may issue a permit to a person for the possession of more than 250 litres of gasoline or other flammable liquid in a park and such permit shall be subject to any terms and conditions stated thereon by the superintendent.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="870121" lims:id="870121"><Label>(3)</Label><Text>No person shall, in a park,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870122" lims:id="870122"><Label>(a)</Label><Text>having started a fire referred to in subsection 4(1) or (3), allow that fire to spread beyond the confines of the fireplace, portable stove, hibachi or barbecue, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870123" lims:id="870123"><Label>(b)</Label><Text>discard a lighted cigar, cigarette, match or any other burning substance;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870124" lims:id="870124"><Label>(c)</Label><Text>discard any unused match or any article or substance that has a capability of starting a fire;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870125" lims:id="870125"><Label>(d)</Label><Text>operate any machine or equipment unless the machine or equipment is provided with adequate and efficient appliances to prevent the escape of fire and sparks;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870126" lims:id="870126"><Label>(e)</Label><Text>when removing or disposing of brush or any flammable material, allow such material to be accumulated, stored, handled, transported or disposed of in any manner other than in a manner as approved by the superintendent; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870127" lims:id="870127"><Label>(f)</Label><Text>leave any fire unattended except when reporting an uncontrollable fire.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="870129" lims:id="870129">SOR/94-266, s. 3; SOR/2003-302, s. 9(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="870130" lims:id="870130"><Label>6</Label><Text>Every person who observes an unattended fire in a park shall report it immediately to an employee.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="870132" lims:id="870132">SOR/2003-302, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="870133" lims:id="870133"><Label>7. and 8</Label><Text><Repealed>[Repealed, SOR/2003-302, s. 7]</Repealed></Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="870134" lims:id="870134" level="1"><TitleText>Structural Fires</TitleText></Heading><Heading lims:inforce-start-date="2006-03-22" lims:fid="870135" lims:id="870135" level="2"><TitleText>Prevention of Fires in Buildings or Other Structures in a Park</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="870136" lims:id="870136"><Label>9</Label><Text>The owner or occupant of a building, structure or place in a park shall permit a fire prevention inspector to enter the building, structure or place, as the case may be, at any reasonable time for the purpose of carrying out a fire prevention inspection.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="870138" lims:id="870138">SOR/94-266, s. 2; SOR/2003-302, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="870139" lims:id="870139"><Label>10</Label><Text>A fire prevention inspector may order that any alterations, renovations or repairs that are necessary to prevent fire be made to any building, structure or place in a park that has been inspected pursuant to section 9.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="870141" lims:id="870141">SOR/94-266, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="870142" lims:id="870142"><Label>11</Label><Text>A fire prevention inspector who makes an order pursuant to section 10 may</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870143" lims:id="870143"><Label>(a)</Label><Text>in the case of a building, structure or place to which the public has access, order that the building, structure or place be closed forthwith to public use and remain closed until the order has been complied with; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870144" lims:id="870144"><Label>(b)</Label><Text>in the case of any other building, structure or place, order that the building, structure or place be closed to habitation and use thirty days after service of the order, in accordance with section 12, and remain closed until the order has been complied with.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="870146" lims:id="870146">SOR/94-266, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="870147" lims:id="870147"><Label>12</Label><Text>A fire prevention inspector shall notify, in writing, the owner or occupant of a building, structure or place in a park of an order made pursuant to section 10 or 11 by</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="870148" lims:id="870148"><Label>(a)</Label><Text>registered mail;
