link="C-10.15">Canada Shipping Act, 2001</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551712" lims:id="1551712" generate-in-text="no"><Text><DefinedTermEn>berth</DefinedTermEn> includes a wharf, pier, lock, anchorage or mooring buoy. (<DefinedTermFr>poste d’amarrage</DefinedTermFr>)</Text></Definition><Definition in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551713" lims:id="1551713" maritime</DefinedTermFr>)</Text></Definition></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551715" lims:id="1551715"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551716" lims:id="1551716">Incorporated documents — meaning of “ship”</MarginalNote><Label>2</Label><Text>For the purpose of interpreting any document that is incorporated by reference into these Regulations, “ship” is to be read as “vessel”.</Text></Section><Heading lims:inforce-start-date="2025-12-12" lims:enacted-date="2025-12-12" lims:fid="1551717" lims:id="1551717" level="1"><Label>PART 1</Label><TitleText>General Provisions</TitleText></Heading><Heading lims:inforce-start-date="2025-12-12" lims:enacted-date="2025-12-12" lims:fid="1551718" lims:id="1551718" level="2"><TitleText>Application</TitleText></Heading><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551719" lims:id="1551719"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551720" lims:id="1551720">Application</MarginalNote><Label>3</Label><Subsection in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551721" lims:id="1551721"><Label>(1)</Label><Text>These Regulations apply to the following vessels that are about to enter, leave or proceed within a VTS Zone:</Text><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551722" lims:id="1551722"><Label>(a)</Label><Text>vessels of 300 gross tonnage or more;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551723" lims:id="1551723"><Label>(b)</Label><Text>vessels that are engaged in towing or pushing another vessel, if the combined gross tonnage is 500 gross tonnage or more; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551724" lims:id="1551724"><Label>(c)</Label><Text>vessels that are carrying as cargo a pollutant or dangerous goods, or vessels that are engaged in towing or pushing such a vessel.</Text></Paragraph></Subsection><Subsection in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551725" lims:id="1551725"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551726" lims:id="1551726">Definition of <DefinitionRef>dangerous goods</DefinitionRef></MarginalNote><Label>(2)</Label><Text>For the purposes of paragraph (1)(c), <DefinitionRef>dangerous goods</DefinitionRef> means the substances, materials and articles referred to in the <IBR><XRefExternal reference-type="other">International Maritime Dangerous Goods Code</XRefExternal></IBR>, published by the International Maritime Organization, as amended from time to time.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551727" lims:id="1551727"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551728" lims:id="1551728">Prescribed classes</MarginalNote><Label>4</Label><Text>The vessels referred to in subsection <XRefInternal>3</XRefInternal>(1) are prescribed as classes of vessels for the purposes of subsections 126(1) and (3) of the Act.</Text></Section><Heading lims:inforce-start-date="2025-12-12" lims:enacted-date="2025-12-12" lims:fid="1551729" lims:id="1551729" level="2"><TitleText>Radio Aids to Marine Navigation</TitleText></Heading><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551730" lims:id="1551730"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551731" lims:id="1551731">Communication</MarginalNote><Label>5</Label><Text>The communication that is required under paragraph 126(1)(b) of the Act must be maintained in accordance with Part 3 of <XRefExternal reference-type="other"><IBR><XRefExternal reference-type="standard">Radio Aids to Marine Navigation</XRefExternal></IBR></XRefExternal>.</Text></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551732" lims:id="1551732"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551733" lims:id="1551733">Content and provision of reports</MarginalNote><Label>6</Label><Text>The master of a vessel must ensure that the reports and sailing plans required under these Regulations contain the information set out in Part 3 of <XRefExternal reference-type="other"><IBR><XRefExternal reference-type="standard">Radio Aids to Marine Navigation</XRefExternal></IBR></XRefExternal> and are provided to a marine communications and traffic services officer in accordance with that Part.</Text></Section><Heading lims:inforce-start-date="2025-12-12" lims:enacted-date="2025-12-12" lims:fid="1551734" lims:id="1551734" level="2"><TitleText>Establishment of VTS Zones</TitleText></Heading><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551735" lims:id="1551735"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551736" lims:id="1551736">Establishment of VTS Zones</MarginalNote><Label>7</Label><Text>The following VTS Zones are established:</Text><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551737" lims:id="1551737"><Label>(a)</Label><Text>the Western VTS Zones described in Schedule 1;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551738" lims:id="1551738"><Label>(b)</Label><Text>the Eastern VTS Zone described in Schedule 2;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551739" lims:id="1551739"><Label>(c)</Label><Text>the Local Eastern VTS Zones described in Schedule 3; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551740" lims:id="1551740"><Label>(d)</Label><Text>the Northern VTS Zone described in Schedule 4.</Text></Paragraph></Section><Heading lims:inforce-start-date="2025-12-12" lims:enacted-date="2025-12-12" lims:fid="1551741" lims:id="1551741" level="1"><Label>PART 2</Label><TitleText>Western VTS Zones</TitleText></Heading><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551742" lims:id="1551742"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551743" lims:id="1551743">Western VTS Zones</MarginalNote><Label>8</Label><Text>This Part applies in respect of the Western VTS Zones described in Schedule 1.</Text></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551744" lims:id="1551744"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551745" lims:id="1551745">Application</MarginalNote><Label>9</Label><Subsection in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551746" lims:id="1551746"><Label>(1)</Label><Text>In addition to the vessels referred to in subsection <XRefInternal>3</XRefInternal>(1), sections <XRefInternal>11</XRefInternal> to <XRefInternal>15</XRefInternal> apply to the following vessels that are about to enter, leave or proceed within a VTS Zone:</Text><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551747" lims:id="1551747"><Label>(a)</Label><Text>a vessel that is 20 m or more in length other than</Text><Subparagraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551748" lims:id="1551748"><Label>(i)</Label><Text>a pleasure craft that is less than 30 m in length, and</Text></Subparagraph><Subparagraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551749" lims:id="1551749"><Label>(ii)</Label><Text>a fishing vessel that is less than 24 m in length and not more than 150 gross tonnage; and</Text></Subparagraph></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551750" lims:id="1551750"><Label>(b)</Label><Text>a vessel that is engaged in towing or pushing another vessel or an object, other than fishing gear, unless the vessel and the other vessel or object being towed or pushed are within a log booming ground, if</Text><Subparagraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551751" lims:id="1551751"><Label>(i)</Label><Text>the combined length of the vessel and the other vessel or object is 45 m or more, or</Text></Subparagraph><Subparagraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551752" lims:id="1551752"><Label>(ii)</Label><Text>the length of the other vessel or object is 20 m or more.</Text></Subparagraph></Paragraph></Subsection><Subsection in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551753" lims:id="1551753"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551754" lims:id="1551754">Prescribed classes</MarginalNote><Label>(2)</Label><Text>In addition to the vessels referred to in section <XRefInternal>4</XRefInternal>, the vessels referred to in subsection (1) are prescribed classes of vessels for the purposes of subsections 126(1) and (3) of the Act.</Text></Subsection></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551755" lims:id="1551755"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551756" lims:id="1551756">Sailing plan — 24 hours</MarginalNote><Label>10</Label><Text>If a vessel enters a VTS Zone from outside Canadian waters, the master of the vessel must ensure that a sailing plan is provided at least 24 hours before the vessel enters the VTS Zone, or as soon as feasible before the vessel enters the VTS Zone if the estimated time of arrival of the vessel is less than 24 hours after the time the vessel departed from the last port of call.</Text></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551757" lims:id="1551757"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551758" lims:id="1551758">Sailing plan — other</MarginalNote><Label>11</Label><Text>The master of a vessel must ensure that a sailing plan is provided</Text><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551759" lims:id="1551759"><Label>(a)</Label><Text>at least 15 minutes before the vessel enters a VTS Zone, except if the vessel was granted a clearance to enter under paragraph 126(3)(a) of the Act;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551760" lims:id="1551760"><Label>(b)</Label><Text>at least 15 minutes before the vessel begins a manoeuvre in a VTS Zone that may be detrimental to safe navigation;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551761" lims:id="1551761"><Label>(c)</Label><Text>at least 15 minutes before the vessel departs from a berth within a VTS Zone; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551762" lims:id="1551762"><Label>(d)</Label><Text>immediately before the vessel gets underway within a VTS Zone if the vessel has been stranded, has stopped as a result of a breakdown in the main propulsion or steering system or has been involved in a collision.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551763" lims:id="1551763"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551764" lims:id="1551764">Position report</MarginalNote><Label>12</Label><Text>The master of a vessel must ensure that a position report is provided</Text><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551765" lims:id="1551765"><Label>(a)</Label><Text>when the vessel arrives at a calling-in-point described in Part 3 of <XRefExternal reference-type="other"><IBR><XRefExternal reference-type="standard">Radio Aids to Marine Navigation</XRefExternal></IBR></XRefExternal>;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551766" lims:id="1551766"><Label>(b)</Label><Text>as soon as feasible after the manoeuvre referred to in paragraph <XRefInternal>11</XRefInternal>(b) is completed; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551767" lims:id="1551767"><Label>(c)</Label><Text>immediately before the vessel departs from a berth within a VTS Zone.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551768" lims:id="1551768"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551769" lims:id="1551769">Final report</MarginalNote><Label>13</Label><Text>The master of a vessel must ensure that a final report is provided</Text><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551770" lims:id="1551770"><Label>(a)</Label><Text>on the arrival of the vessel at a berth within a VTS Zone; and</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551771" lims:id="1551771"><Label>(b)</Label><Text>immediately before the vessel leaves a VTS Zone, except if the vessel enters any other VTS Zone.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551772" lims:id="1551772"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551773" lims:id="1551773">Other reports</MarginalNote><Label>14</Label><Text>The master of a vessel must ensure that a report is provided as soon as feasible after the master becomes aware of any of the following circumstances:</Text><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551774" lims:id="1551774"><Label>(a)</Label><Text>there is a fire or explosion on board the vessel;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551775" lims:id="1551775"><Label>(b)</Label><Text>the vessel is involved in a collision, grounding or striking;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551776" lims:id="1551776"><Label>(c)</Label><Text>the vessel makes unforeseen contact with the bottom without going aground;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551777" lims:id="1551777"><Label>(d)</Label><Text>there is a defect in the vessel’s hull, main propulsion system, steering system, anchor or any equipment that is required under the <IBR><XRefExternal reference-type="regulation" link="SOR-2020-216">Navigation Safety Regulations, 2020</XRefExternal></IBR>;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551778" lims:id="1551778"><Label>(e)</Label><Text>the vessel’s seaworthiness is affected;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551779" lims:id="1551779"><Label>(f)</Label><Text>all or part of the vessel’s cargo shifts or falls overboard;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551780" lims:id="1551780"><Label>(g)</Label><Text>another vessel is in apparent difficulty;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551781" lims:id="1551781"><Label>(h)</Label><Text>there is an obstruction to navigation;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551782" lims:id="1551782"><Label>(i)</Label><Text>in addition to a missing, out of position or malfunctioning aid to navigation that must be reported under subsection 129(2) of the Act, an aid to navigation is damaged;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551783" lims:id="1551783"><Label>(j)</Label><Text>there are ice or weather conditions that are hazardous to safe navigation;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551784" lims:id="1551784"><Label>(k)</Label><Text>there is a pollutant in the water;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551785" lims:id="1551785"><Label>(l)</Label><Text>another vessel may impede the movement of the vessel or of other vessels;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551786" lims:id="1551786"><Label>(m)</Label><Text>there is a risk, identified in Part 3 of <IBR><XRefExternal reference-type="standard">Radio Aids to Marine Navigation</XRefExternal></IBR>, to the health and well-being of individuals on board the vessel including the crew;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551787" lims:id="1551787"><Label>(n)</Label><Text>there is a risk, identified in Part 3 of <XRefExternal reference-type="other"><IBR><XRefExternal reference-type="standard">Radio Aids to Marine Navigation</XRefExternal></IBR></XRefExternal>, to marine safety or the marine environment.</Text></Paragraph></Section><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551788" lims:id="1551788"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551789" lims:id="1551789">Deviation report</MarginalNote><Label>15</Label><Text>In the case of a significant change in the information contained in a report, the master must ensure that a deviation report containing the updated information is provided as soon as feasible after the master becomes aware of the change.</Text></Section><Heading lims:inforce-start-date="2025-12-12" lims:enacted-date="2025-12-12" lims:fid="1551790" lims:id="1551790" level="1"><Label>PART 3</Label><TitleText>Eastern VTS Zone</TitleText></Heading><Section in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551791" lims:id="1551791"><MarginalNote in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551792" difficulty;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551817" lims:id="1551817"><Label>(h)</Label><Text>there is an obstruction to navigation;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551818" lims:id="1551818"><Label>(i)</Label><Text>in addition to a missing, out of position or malfunctioning aid to navigation that must be reported under subsection 129(2) of the Act, an aid to navigation is damaged;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:enacted-date="2025-12-12" lims:fid="1551833" lims:id="1551833"><Label>(i)</Label><Text>a pleasure craft that is less than 30 m in length, and</Text></Subparagraph><Subparagraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551834" lims:id="1551834"><Label>(ii)</Label><Text>a fishing vessel that is less than 24 m in length and not more than 150 gross tonnage; and</Text></Subparagraph></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551835" lims:id="1551835"><Label>(b)</Label><Text>a vessel that is engaged in towing or pushing another vessel or an object, other than fishing gear, unless the vessel and the other vessel or object being towed or pushed is within a log booming ground, if</Text><Subparagraph in-force="no" that a report is provided as soon as feasible after the master becomes aware of any of the following circumstances:</Text><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551896" lims:id="1551896"><Label>(a)</Label><Text>there is a fire or explosion on board the vessel;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551897" lims:id="1551897"><Label>(b)</Label><Text>the vessel is involved in a collision, grounding or striking;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551898" lims:id="1551898"><Label>(c)</Label><Text>the vessel makes unforeseen contact with the bottom without going aground;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551899" lims:id="1551899"><Label>(d)</Label><Text>there is a defect in the vessel’s hull, main propulsion system, steering system, anchor or any equipment that is required under the <IBR><XRefExternal reference-type="regulation" link="SOR-2020-216">Navigation Safety Regulations, 2020</XRefExternal></IBR>;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551900" lims:id="1551900"><Label>(e)</Label><Text>the vessel’s seaworthiness is affected;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551901" lims:id="1551901"><Label>(f)</Label><Text>all or part of the vessel’s cargo shifts or falls overboard;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551902" lims:id="1551902"><Label>(g)</Label><Text>another vessel is in apparent difficulty;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551903" lims:id="1551903"><Label>(h)</Label><Text>there is an obstruction to navigation;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551904" lims:id="1551904"><Label>(i)</Label><Text>in addition to a missing, out of position or malfunctioning aid to navigation that must be reported under subsection 129(2) of the Act, an aid to navigation is damaged;</Text></Paragraph><Paragraph in-force="no" lims:enacted-date="2025-12-12" lims:fid="1551905" lims:id="1551905"><Label>(j)</Label><Text>there are ice or weather conditions that are
