lims:fid="1299588" lims:id="1299588"><Text><DefinedTermEn>ballast water performance standard</DefinedTermEn> means the standard set out in regulation D-2 of the Annex. (<DefinedTermFr>norme de qualité des eaux de ballast</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299589" lims:id="1299589"><Text><DefinedTermEn>BWMS Code</DefinedTermEn> means the <XRefExternal reference-type="other">Code for Approval of Ballast Water Management Systems</XRefExternal>, published by the International Maritime Organization. (<DefinedTermFr>Code BWMS</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299590" lims:id="1299590"><Text><DefinedTermEn>Canadian pleasure craft</DefinedTermEn> means a pleasure craft that</Text><Paragraph lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299591" lims:id="1299591"><Label>(a)</Label><Text>is licensed under Part 10 of the Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299592" lims:id="1299592"><Label>(b)</Label><Text>is principally maintained or operated in Canada, is not a Canadian vessel and is not registered or licensed under the laws of another state. (<DefinedTermFr>embarcation de plaisance canadienne</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299593" lims:id="1299593"><Text><DefinedTermEn>Convention</DefinedTermEn> means the International Convention for the Control and Management of Ships’ Ballast Water and Sediments, 2004, signed at London on February 13, 2004. (<DefinedTermFr>Convention</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299594" lims:id="1299594"><Text><DefinedTermEn>Great Lakes Basin</DefinedTermEn> means the waters of the Great Lakes, their connecting and tributary waters and the waters of the St. Lawrence River as far as the lower exit of the St. Lambert Lock at Montréal in Quebec. (<DefinedTermFr>bassin des Grands Lacs</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299595" lims:id="1299595"><Text><DefinedTermEn>IBWM Certificate</DefinedTermEn> means the International Ballast Water Management Certificate issued under regulation E-2 or E-3 of the Annex. (<DefinedTermFr>certificat IGEB</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299596" lims:id="1299596"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299597" lims:id="1299597"><Text><DefinedTermEn>release</DefinedTermEn>, in respect of ballast water, includes leakage, pumping, pouring, emptying, dumping, spraying or placing. (<DefinedTermFr>déversement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299598" lims:id="1299598"><Text><DefinedTermEn>residual amounts</DefinedTermEn> means the quantity of ballast water that cannot be removed from a ballast tank using the equipment installed on the vessel for that purpose. (<DefinedTermFr>quantité résiduelle</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299599" lims:id="1299599"><Text><DefinedTermEn>sediments</DefinedTermEn> means matter settled out of ballast water within a vessel. (<DefinedTermFr>sédiments</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299600" lims:id="1299600"><Text><DefinedTermEn>TP 13617</DefinedTermEn> means the document entitled <XRefExternal reference-type="other">List of Canada’s Designated Alternate Ballast Water Exchange Areas and Fresh Waters</XRefExternal>, published by the Department of Transport. (<DefinedTermFr>TP 13617</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299601" lims:id="1299601"><Text><DefinedTermEn>waters under Canadian jurisdiction</DefinedTermEn> means Canadian waters and waters in the exclusive economic zone of Canada. (<DefinedTermFr>eaux de compétence canadienne</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:id="1299625"><Label>(b)</Label><Text>vessels that are not Canadian vessels and are in waters under Canadian jurisdiction.</Text></Paragraph></Subsection><Subsection lims:fid="1299627" lims:id="1299627">Activities related to oil or gas</MarginalNote><Label>(2)</Label><Text>These Regulations apply in respect of vessels referred to in subsection (1) that are capable of engaging in the drilling for, or the production, conservation or processing of, oil or gas, except vessels that are on location and engaged in one of those activities in an area referred to or</Text></Paragraph><Paragraph lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299630" lims:id="1299630"><Label>(c)</Label><Text>subsection 8(1) of the <XRefExternal reference-type="act" link="C-7.8">Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299631" lims:id="1299631"><MarginalNote lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299632" lims:id="1299632">Non-application</MarginalNote><Label>(3)</Label><Text>These Regulations do not apply in respect of</Text><Paragraph lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299633" lims:id="1299633"><Label>(a)</Label><Text>vessels operated under the authority of a state that is not a party to the Convention if they are operated exclusively in the Great Lakes Basin and if they do not take on board or release ballast water in waters under Canadian jurisdiction unless it is necessary to ensure the safety of the vessel during a voyage between ports located outside Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299634" lims:id="1299634"><Label>(b)</Label><Text>vessels that are owned or operated by a state and used only in government non-commercial service; or</Text></Paragraph><Paragraph lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299635" lims:id="1299635"><Label>(c)</Label><Text>vessels that carry only permanent ballast water in sealed tanks such that it is not subject to release.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299636" lims:id="1299636"><MarginalNote lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299637" lims:id="1299637">Quantity</MarginalNote><Label>(4)</Label><Text>For greater certainty, these Regulations apply provided by these Regulations, the authorized representative and the master of a vessel must ensure that the requirements of the Annex are met in respect of the vessel.</Text></Subsection><Subsection ensure that the requirements of section <XRefInternal>8</XRefInternal>, subsections <XRefInternal>14</XRefInternal>(1), <XRefInternal>15</XRefInternal>(1) and <XRefInternal>16</XRefInternal>(1) and sections <XRefInternal>17</XRefInternal> to <XRefInternal>20</XRefInternal>, <XRefInternal>22</XRefInternal> and <XRefInternal>23</XRefInternal> are met.</Text></Subsection><Subsection lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299644" lims:id="1299644"><MarginalNote lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299645" lims:id="1299645">Master — ballast water record book</MarginalNote><Label>(3)</Label><Text>The master must ensure, in respect of the ballast water record book, that</Text><Paragraph authorized representative of a Canadian vessel or a Canadian pleasure craft must maintain the entries made in the ballast water record book, in accordance with regulation B-2 of the Annex, after the period during which the entries are to be maintained on board the vessel in accordance with that regulation.</Text></Subsection><Subsection lims:inforce-start-date="2021-06-04" representative and master — regulation E-1</MarginalNote><Label>(5)</Label><Text>The authorized representative and the master of a Canadian vessel or a Canadian pleasure craft must ensure that the lims:enacted-date="2021-06-04" lims:fid="1299656" lims:id="1299656"><Label>(c)</Label><Text>the requirement to obtain approval of a change that is made after an inspection.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299657" lims:id="1299657" level="1"><TitleText>Regulation A-4 of the Annex — Exemptions</TitleText></Heading><Section lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:lastAmendedDate="2021-06-04" lims:fid="1299658" Act is authorized, in respect of Canadian vessels, to exercise the powers of a Party to the Convention conferred by regulation A-4 of the Annex in respect of the requirements of sections <XRefInternal>15</XRefInternal> and <XRefInternal>16</XRefInternal> and of regulation B-3 of the Annex.</Text></Subsection><Subsection lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299661" lims:id="1299661"><MarginalNote lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299662" lims:id="1299662">Other vessels</MarginalNote><Label>(2)</Label><Text>On application by the authorized representative of a vessel other than a Canadian vessel, the Minister is authorized to exempt the vessel from the requirements of sections <XRefInternal>15</XRefInternal> and <XRefInternal>16</XRefInternal> and of regulation B-3 of the Annex if the application establishes that the applicable conditions described that the exchange would threaten the safety or stability of the vessel, its crew or its passengers because of adverse weather, vessel design or stress, equipment failure or any other extraordinary lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299741" lims:id="1299741"><Label>(1)</Label><Text>In addition to meeting the requirements of the Convention, a vessel that conducts ballast water management to meet the ballast water exchange standard must conduct a saltwater flushing of tanks that contain only residual amounts unless those residual amounts were taken on board in accordance with the ballast water exchange standard and subsection <XRefInternal>14</XRefInternal>(1).</Text></Subsection><Subsection lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299742" lims:id="1299742"><MarginalNote lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299743" lims:id="1299743">Saltwater flushing</MarginalNote><Label>(2)</Label><Text>For the purposes of subsection (1), saltwater flushing consists of the following measures undertaken in the following order:</Text><Paragraph lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299744" lims:id="1299744"><Label>(a)</Label><Text>the addition of water to the ballast tanks in accordance with the requirements for ballast water exchange set out in subsection <XRefInternal>14</XRefInternal>(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299745" lims:id="1299745"><Label>(b)</Label><Text>the mixing, through the motion of the vessel, of the water added under paragraph (a) with the residual amounts and any sediments that have settled in the tanks; and</Text></Paragraph><Paragraph lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299746" lims:id="1299746"><Label>(c)</Label><Text>the release, in accordance with the requirements for ballast water exchange set out in subsection <XRefInternal>14</XRefInternal>(1), of the waters mixed under paragraph (b) so that the salinity of the resulting residual amounts in the tanks exceeds 30 parts per thousand or is as close as possible to 30 parts per thousand.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299747" lims:id="1299747" level="1"><TitleText>Regulation D-3 of the Annex — Ballast Water Management Systems</TitleText></Heading><Section lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:lastAmendedDate="2021-06-04" lims:fid="1299748" lims:id="1299748"><MarginalNote lims:inforce-start-date="2021-06-04" lims:enacted-date="2021-06-04" lims:fid="1299749" lims:id="1299749">Minister’s approval</MarginalNote><Label>17</Label><Text>Any ballast water management system used on a Canadian vessel or a Canadian
