lims:fid="1252368" lims:id="1252368">Definition of <DefinitionRef>Act</DefinitionRef></MarginalNote><Label>1</Label><Text>In these Regulations, <DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2020-06-26" lims:enacted-date="2020-06-26" lims:fid="1252369" lims:id="1252369" level="1"><TitleText>General Provisions</TitleText></Heading><Section lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:lastAmendedDate="2020-09-01" lims:fid="1252370" lims:id="1252370"><MarginalNote lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252371" lims:id="1252371">Educational institutions</MarginalNote><Label>2</Label><Text>For the purpose of subsection 167(1.2) of the Act, the educational institutions are</Text><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252372" lims:id="1252372"><Label>(a)</Label><Text>any post-secondary educational institution or vocational school that is listed in the Directory of Educational Institutions in Canada as amended from time to time, which is maintained by the Council of Ministers of Education through its subunit, the Canadian Information Centre for International Credentials;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252373" lims:id="1252373"><Label>(b)</Label><Text>any secondary educational institution that meets provincial requirements in respect of the delivery of education in the province in which it is located;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252374" lims:id="1252374"><Label>(c)</Label><Text>any post-secondary educational institution or vocational school that is administered by a federal department or agency; and</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252375" lims:id="1252375"><Label>(d)</Label><Text>any secondary or post-secondary educational institution or vocational school that is located outside Canada and that meets the requirements in respect of the delivery of education under the laws of the jurisdiction in which it is located.</Text></Paragraph></Section><Section lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:lastAmendedDate="2020-09-01" lims:fid="1252376" lims:id="1252376"><MarginalNote lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252377" lims:id="1252377">Provision of documents to employer</MarginalNote><Label>3</Label><Text>Before performing activities referred to in subsection 167(1.2) of the Act, a person must provide the employer with all documents, issued by an educational institution or vocational school referred to in section <XRefInternal>2</XRefInternal> of these Regulations, that contain the following information:</Text><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252378" lims:id="1252378"><Label>(a)</Label><Text>the person’s full name;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252379" lims:id="1252379"><Label>(b)</Label><Text>the name and address of the educational institution or vocational school and the name of the program in which the person is enrolled;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252380" lims:id="1252380"><Label>(c)</Label><Text>the name and address of the employer for whom the activities are to be performed;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252381" lims:id="1252381"><Label>(d)</Label><Text>a description of the activities whose performance fulfils the requirements of the program;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252382" lims:id="1252382"><Label>(e)</Label><Text>the date on which the performance of the activities is to begin and</Text><Subparagraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252383" lims:id="1252383"><Label>(i)</Label><Text>the date on which the performance of the activities is to cease, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252384" lims:id="1252384"><Label>(ii)</Label><Text>the number of hours during which the activities are to be performed; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252385" lims:id="1252385"><Label>(f)</Label><Text>the name, job title, phone number and email address of a person employed by the educational institution or vocational school who is involved in the administration of the program.</Text></Paragraph></Section><Section lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:lastAmendedDate="2025-12-12" lims:fid="1252386" lims:id="1252386"><MarginalNote lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252387" lims:id="1252387">Record-keeping</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252388" lims:id="1252388"><Label>(1)</Label><Text>An employer of a person referred to in subsection 167(1.2) of the Act must keep a record containing the following:</Text><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252389" lims:id="1252389"><Label>(a)</Label><Text>the full name and address of the person and, if the person has not attained the age referred to in subsection 10(1) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._986">Canada Labour Standards Regulations</XRefExternal>, their age;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252390" lims:id="1252390"><Label>(b)</Label><Text>the documents referred to in section <XRefInternal>3</XRefInternal> of these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252391" lims:id="1252391"><Label>(c)</Label><Text>any agreement in writing between the employer and the person concerning the performance of the activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252392" lims:id="1252392"><Label>(d)</Label><Text>any correspondence between the employer and the educational institution or vocational school concerning the person’s enrolment in the program or their performance of the activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252393" lims:id="1252393"><Label>(e)</Label><Text>the dates on which the person began and ceased performing the activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252394" lims:id="1252394"><Label>(f)</Label><Text>the dates on which the activities were performed and the number of hours they were performed on each of those dates;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252395" lims:id="1252395"><Label>(g)</Label><Text>any general holiday granted to the person under these Regulations and, if a day was substituted for a general holiday, the written approval of the person in accordance with paragraph 195(2)(a) of the Act as adapted by subsection <XRefInternal>7</XRefInternal>(2) of these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2025-12-12" lims:enacted-date="2025-11-28" lims:fid="1252396" lims:id="1552274"><Label>(h)</Label><Text>the start and end dates of each leave granted to the person under these Regulations, as well as any change in the length of the leave;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252397" lims:id="1252397"><Label>(i)</Label><Text>any written approval that is provided by the person in accordance with subparagraph 170(2)(b)(i) or 172(2)(b)(i) of the Act as adapted by subsection <XRefInternal>7</XRefInternal>(2) of these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252398" lims:id="1252398"><Label>(j)</Label><Text>any notice of leave that is provided by the person to the employer under these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252399" lims:id="1252399"><Label>(k)</Label><Text>any certificate from a health care practitioner that is submitted by the person to the employer under these Regulations in respect of leave, maternity-related matters set out in subsection 204(2) of the Act or a break for medical reasons;</Text></Paragraph><Paragraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252400" lims:id="1252400"><Label>(l)</Label><Text>if the person was absent due to an illness or injury related to the performance of the activities,</Text><Subparagraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252401" lims:id="1252401"><Label>(i)</Label><Text>detailed reasons for the absence,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252402" lims:id="1252402"><Label>(ii)</Label><Text>a copy of any certificate from a health care practitioner certifying that the person is fit to resume the activities, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2022-06-02" lims:enacted-date="2022-03-04" lims:fid="1252403" lims:id="1354927"><Label>(iii)</Label><Text>the date on which the person returned to work or a copy of a notification from the employer to the person that a return to work was not reasonably practicable and the reasons why;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2022-06-02" lims:enacted-date="2022-03-04" lims:fid="1252404" lims:id="1354928"><Label>(m)</Label><Text>the dates of commencement and termination of any modification of the activities under subsection 205(1) of the Act, as adapted by subsection <XRefInternal>7</XRefInternal>(2) of these Regulations, and any notice provided by the employer concerning the modification;</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-02" lims:enacted-date="2022-03-04" lims:fid="1354929" lims:id="1354929"><Label>(n)</Label><Text>any work schedule and modification of a work schedule that is provided in writing to the person by the employer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2022-06-02" lims:enacted-date="2022-03-04" lims:fid="1354930" lims:id="1354930"><Label>(o)</Label><Text>any refusal by the person made under subsection 173.01(2) of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252405" lims:id="1252405"><MarginalNote lims:inforce-start-date="2020-09-01" lims:enacted-date="2020-06-26" lims:fid="1252406" lims:id="1252406">Period for keeping records</MarginalNote><Label>(2)</Label><Text>An employer must keep the record referred to in subsection (1) for a period of 36 months after the day on which the activities cease.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem be granted a leave of absence from employment of up to five days in every calendar year in order to enable the employee to engage in traditional Aboriginal practices, leave of absence from employment under any of sections 206.6 to 206.8 must, as soon as possible, provide the employer with a notice in writing of any change in the length of the leave that they intend link="C.R.C.,_c._986">Canada Labour Standards Regulations</XRefExternal> is adapted as follows for the purpose of its application to the persons referred to in subsection 167(1.2) of the Act and, in
