lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250748" lims:id="1250748"><Text><DefinedTermEn>Act</DefinedTermEn> means Part II of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250749" lims:id="1250749"><Text><DefinedTermEn>designated recipient</DefinedTermEn> means a work unit in a work place or person that is designated by an employer under section <XRefInternal>14</XRefInternal>. (<DefinedTermFr>destinataire désigné</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250750" lims:id="1250750"><Text><DefinedTermEn>occurrence</DefinedTermEn> means an occurrence of harassment and violence in the work place. (<DefinedTermFr>incident</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250751" lims:id="1250751"><Text><DefinedTermEn>principal party</DefinedTermEn> means an employee or employer who is the object of an occurrence. (<DefinedTermFr>partie principale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250752" lims:id="1250752"><Text><DefinedTermEn>responding party</DefinedTermEn> means the person who is alleged to have been responsible for the occurrence in notice of an occurrence provided under subsection <XRefInternal>15</XRefInternal>(1). (<DefinedTermFr>partie intimée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250753" lims:id="1250753"><Text><DefinedTermEn>witness</DefinedTermEn> means a person who witnessed an occurrence or is informed of an occurrence by the principal party or responding party. (<DefinedTermFr>témoin</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250754" lims:id="1250754"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250755" lims:id="1250755">Applicable Partner</MarginalNote><Label>(2)</Label><Text>In these Regulations, a reference to the “applicable partner” is to be read as a reference to the policy committee or, if there is no policy committee, as a reference to the work place committee or the health and safety representative.</Text></Subsection></Section><Heading lims:inforce-start-date="2020-06-17" lims:enacted-date="2020-06-17" lims:fid="1250756" lims:id="1250756" level="2"><TitleText>Joint Matters</TitleText></Heading><Section lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:lastAmendedDate="2021-01-01" lims:fid="1250757" lims:id="1250757"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250758" lims:id="1250758">When unable to agree</MarginalNote><Label>2</Label><Text>If an employer and the policy committee, the work place committee or the health and safety representative are unable to agree on any matter that is required by these Regulations to be done jointly by them, the employer’s decision prevails.</Text></Section><Heading lims:inforce-start-date="2020-06-17" lims:enacted-date="2020-06-17" lims:fid="1250759" lims:id="1250759" level="2"><TitleText>Former Employees</TitleText></Heading><Section lims:inforce-start-date="2021-07-01" lims:enacted-date="2021-06-01" lims:lastAmendedDate="2021-07-01" lims:fid="1250760" lims:id="1312104"><MarginalNote lims:inforce-start-date="2021-07-01" lims:enacted-date="2021-06-01" lims:fid="1312105" lims:id="1312105">Prescribed circumstances — extension</MarginalNote><Label>3</Label><Text>The Head of Compliance and Enforcement may extend the time period referred to in subsection 125(4) of the Act if a former employee demonstrates in an application to the Head of Compliance and Enforcement that they were unable to make the occurrence known to the employer within the time period because they incurred trauma as a result of the occurrence or because of a health lims:id="1250762"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250763" lims:id="1250763">Time period to make complaint</MarginalNote><Label>4</Label><Text>For the purpose of subsection 127.1(12) of the Act, a former employee may make a complaint under subsection 127.1(1) of the Act until the day that is the later of</Text><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250764" lims:id="1250764"><Label>(a)</Label><Text>three months after the day on which the former employee ceases to be employed by the employer, and</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250765" lims:id="1250765"><Label>(b)</Label><Text>if notice of the occurrence was provided under subsection <XRefInternal>15</XRefInternal>(1), three months after the day on which the resolution process is completed in respect of the occurrence.</Text></Paragraph></Section><Heading lims:inforce-start-date="2020-06-17" lims:enacted-date="2020-06-17" lims:fid="1250766" lims:id="1250766" level="1"><TitleText>Prevention and Protection Measures</TitleText></Heading><Heading lims:inforce-start-date="2020-06-17" lims:enacted-date="2020-06-17" lims:fid="1250767" lims:id="1250767" level="2"><TitleText>Work Place Assessment</TitleText></Heading><Section lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:lastAmendedDate="2021-01-01" lims:fid="1250768" lims:id="1250768"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250769" lims:id="1250769">Joint assessment</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250770" lims:id="1250770"><Label>(1)</Label><Text>An employer and the applicable partner must jointly carry out a work place assessment that consists of the identification of risk factors under section <XRefInternal>8</XRefInternal> and the development and implementation of preventive measures under section <XRefInternal>9</XRefInternal>.</Text></Subsection><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250771" lims:id="1250771"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250772" lims:id="1250772">Joint monitoring and updates</MarginalNote><Label>(2)</Label><Text>An employer and the applicable partner must jointly monitor the accuracy of the work place assessment and, if necessary, update it in order to reflect a change to the information set out in the assessment, including</Text><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250773" lims:id="1250773"><Label>(a)</Label><Text>a change to the risk factors identified under section <XRefInternal>8</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250774" lims:id="1250774"><Label>(b)</Label><Text>a change that compromises the effectiveness of a preventive measure developed and implemented under section <XRefInternal>9</XRefInternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250775" lims:id="1250775"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250776" lims:id="1250776">Review after three years</MarginalNote><Label>(3)</Label><Text>An employer and the applicable partner must jointly review the work place assessment every three years and, if necessary, update it.</Text></Subsection></Section><Section lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:lastAmendedDate="2021-01-01" lims:fid="1250777" lims:id="1250777"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250778" lims:id="1250778">Joint review and update</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250779" lims:id="1250779"><Label>(1)</Label><Text>An employer and the work place committee or the health and safety representative must jointly review and, if necessary, update the work place assessment if notice of an occurrence is provided under subsection <XRefInternal>15</XRefInternal>(1) and</Text><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250780" lims:id="1250780"><Label>(a)</Label><Text>the occurrence is not resolved under section <XRefInternal>23</XRefInternal> and the principal party ends the resolution process under section <XRefInternal>18</XRefInternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250781" lims:id="1250781"><Label>(b)</Label><Text>the responding party is not an employee or the employer.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250782" lims:id="1250782"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250783" lims:id="1250783">Review to consider circumstances</MarginalNote><Label>(2)</Label><Text>A review conducted under subsection (1) must take into account the circumstances of the occurrence.</Text></Subsection><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250784" lims:id="1250784"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250785" lims:id="1250785">Multiple occurrences</MarginalNote><Label>(3)</Label><Text>If a review and update are being conducted under subsection (1) and notice is provided under subsection <XRefInternal>15</XRefInternal>(1) of another occurrence that involves substantially the same matters and for which a review and update are also required under subsection (1), those occurrences may be addressed together in the same review and update.</Text></Subsection></Section><Section lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:lastAmendedDate="2021-01-01" lims:fid="1250786" lims:id="1250786"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250787" lims:id="1250787">Qualifications</MarginalNote><Label>7</Label><Text>An employer must ensure that each individual who is directed by the employer to identify the risk factors referred to in section <XRefInternal>8</XRefInternal>, or to develop and implement the preventive measures referred to in section <XRefInternal>9</XRefInternal>, is qualified to do so by virtue of their training, education or experience.</Text></Section><Section lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:lastAmendedDate="2021-01-01" lims:fid="1250788" lims:id="1250788"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250789" lims:id="1250789">Identification of risk factors</MarginalNote><Label>8</Label><Text>An employer and the applicable partner must jointly identify the risk factors, internal and external to the work place, that contribute to harassment and violence in the work place, taking into account</Text><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250790" lims:id="1250790"><Label>(a)</Label><Text>the culture, conditions, activities and organizational structure of the work place;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250791" lims:id="1250791"><Label>(b)</Label><Text>circumstances external to the work place, such as family violence, that could give rise to harassment and violence in the work place;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250792" lims:id="1250792"><Label>(c)</Label><Text>any reports, records and data that are related to harassment and violence in the work place;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250793" lims:id="1250793"><Label>(d)</Label><Text>the physical design of the work place; and</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250794" lims:id="1250794"><Label>(e)</Label><Text>the measures that are in place to protect psychological health and safety in the work place.</Text></Paragraph></Section><Section lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:lastAmendedDate="2021-01-01" lims:fid="1250795" lims:id="1250795"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250796" lims:id="1250796">Preventive measures — development and implementation</MarginalNote><Label>9</Label><Text>Within six months after the risk factors are identified under section <XRefInternal>8</XRefInternal>, an employer and the applicable partner must jointly</Text><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250797" lims:id="1250797"><Label>(a)</Label><Text>develop preventive measures that, to the extent feasible,</Text><Subparagraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250798" lims:id="1250798"><Label>(i)</Label><Text>mitigate the risk of harassment and violence in the work place, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250799" lims:id="1250799"><Label>(ii)</Label><Text>neither create nor increase the risk of harassment and violence in the work place;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250800" lims:id="1250800"><Label>(b)</Label><Text>develop an implementation plan for the preventive measures; and</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250801" lims:id="1250801"><Label>(c)</Label><Text>implement the preventive measures in accordance with the implementation plan.</Text></Paragraph></Section><Heading lims:inforce-start-date="2020-06-17" lims:enacted-date="2020-06-17" lims:fid="1250802" lims:id="1250802" level="2"><TitleText>Work Place Harassment and Violence Prevention Policy</TitleText></Heading><Section lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:lastAmendedDate="2021-01-01" lims:fid="1250803" lims:id="1250803"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250804" lims:id="1250804">Joint development</MarginalNote><Label>10</Label><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250805" lims:id="1250805"><Label>(1)</Label><Text>An employer and the applicable partner must jointly develop a work place harassment and violence prevention policy.</Text></Subsection><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250806" lims:id="1250806"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250807" lims:id="1250807">Policy content</MarginalNote><Label>(2)</Label><Text>The policy must contain the following elements:</Text><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250808" lims:id="1250808"><Label>(a)</Label><Text>the employer’s mission statement regarding the prevention of and protection against harassment and violence in the work place;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250809" lims:id="1250809"><Label>(b)</Label><Text>a description of the respective roles of the employer, designated recipient, employees, policy committee, work place committee and health and safety representative in relation to harassment and violence in the work place;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250810" lims:id="1250810"><Label>(c)</Label><Text>a description of the risk factors, internal and external to the work place, that contribute to work place harassment and violence;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250811" lims:id="1250811"><Label>(d)</Label><Text>a summary of the training that will be provided regarding work place harassment and violence;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250812" lims:id="1250812"><Label>(e)</Label><Text>a summary of the resolution process, including</Text><Subparagraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250813" lims:id="1250813"><Label>(i)</Label><Text>the name or identity of the designated recipient, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250814" lims:id="1250814"><Label>(ii)</Label><Text>the manner in which a principal party or witness may provide the employer or the designated recipient with notice of an occurrence;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" summary of the emergency procedures that must be implemented when an occurrence poses an immediate danger to the health and safety of an employee or when there is a threat of such an which the employer will protect the privacy of persons who are involved in an occurrence or in the resolution process for an occurrence under these Regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250818" lims:id="1250818"><Label>(i)</Label><Text>a description of any recourse, in addition to any under the Act or However, if the occurrence is also investigated, it cannot be resolved by conciliation after the investigator has provided their report under subsection lims:id="1250925"><Label>(a)</Label><Text>in the case where the employer and the applicable partner have jointly developed or identified a list of persons who may act as an investigator, a person from lims:enacted-date="2020-06-17" lims:fid="1250935" lims:id="1250935"><Label>(1)</Label><Text>For the purposes of these Regulations, an investigator must</Text><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250936" lims:id="1250936"><Label>(a)</Label><Text>be trained in investigative techniques;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250937" lims:id="1250937"><Label>(b)</Label><Text>have knowledge, training and experience that are relevant to harassment and violence in the work place; and</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250938" lims:id="1250938"><Label>(c)</Label><Text>have knowledge of the Act, the <XRefExternal reference-type="act" link="H-6">Canadian Human Rights Act</XRefExternal> and any other legislation that is relevant to harassment and violence in the work lims:id="1250944"><Label>(d)</Label><Text>a description of any experience that they have which is relevant to the nature of the occurrence that is to be those related to the circumstances in the work place that contributed to the occurrence; and</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250952" lims:id="1250952"><Label>(c)</Label><Text>their recommendations to eliminate or minimize the risk of a similar occurrence.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250953" lims:id="1250953"><MarginalNote lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" is resolved under subsection <XRefInternal>19</XRefInternal>(2) or under section 23 or 24;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250968" lims:id="1250968"><Label>(c)</Label><Text>if an investigator has provided a report in accordance with subsection <XRefInternal>30</XRefInternal>(1), the employer implements the (2), an employer must ensure that the resolution process is completed within one year after the day on which notice of the occurrence is provided under subsection that form part of the work place assessment;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250987" lims:id="1250987"><Label>(c)</Label><Text>a copy of the documents that form part of each review and update of the work place assessment;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250988" lims:id="1250988"><Label>(d)</Label><Text>for each instance where the employer and the policy committee, the work place committee or the health and safety representative are unable to agree on a matter that is required by these Regulations to be jointly done by them, a record of the employer’s decision in that matter and the reasons for that decision;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-01-01" lims:enacted-date="2020-06-17" lims:fid="1250989" lims:id="1250989"><Label>(e)</Label><Text>a record of each notice provided under subsection <XRefInternal>15</XRefInternal>(1) and of each action taken in response to the
