Environmental Protection Act, 1999</XRefExternal><FootnoteRef idref="fn_81000-2-2362-E_hq_22755">b</FootnoteRef>, the Minister of the Environment published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal>, Part I, on February 17, 2018, a copy of the proposed <XRefExternal reference-type="regulation">Regulations Limiting Carbon Dioxide Emissions from Natural Gas-fired Generation of Electricity</XRefExternal>, substantially in the annexed form, and persons were given an opportunity to file comments with respect to the proposed Regulations or to file a notice of objection requesting that a board of review be established and stating the reasons for the objection;</Text></Provision><Provision lims:inforce-start-date="2018-11-30" lims:fid="857457" lims:id="857457" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas, pursuant to subsection 93(3) of that Act, the National Advisory Committee has been given an opportunity to provide its advice under section 6<FootnoteRef idref="fn_81000-2-2362-E_hq_22756">c</FootnoteRef> of that Act;</Text></Provision><Provision lims:inforce-start-date="2018-11-30" lims:fid="857458" lims:id="857458" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And whereas, in accordance with subsection 93(4) of that Act, the Governor in Council is of the opinion that the proposed Regulations do not regulate an aspect of a substance that is regulated by or under any other Act of Parliament in a manner that provides, in the opinion of the Governor in Council, sufficient lims:inforce-start-date="2019-01-01" lims:fid="857463" lims:id="857463">Purpose</MarginalNote><Label>1</Label><Text>These Regulations establish a regime for limiting carbon dioxide (CO<Sub>2</Sub>) emissions that result from the generation of electricity by means of thermal energy from the combustion of natural gas, whether in conjunction with other fuels, except coal, or not.</Text></Section><Heading lims:inforce-start-date="2018-11-30" lims:fid="857464" lims:id="857464" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857465" lims:id="857465"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857466" lims:id="857466">Definitions</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857467" lims:id="857467"><Label>(1)</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2019-01-01" lims:fid="857468" lims:id="857468" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="C-15.31">Canadian Environmental Protection Act, 1999</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857469" lims:id="857469" generate-in-text="no"><Text><DefinedTermEn>API</DefinedTermEn> means the American Petroleum Institute. (<DefinedTermFr>API</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857470" lims:id="857470" generate-in-text="no"><Text><DefinedTermEn>ASTM</DefinedTermEn> means ASTM International, formerly known as the American Society for Testing and Materials. (<DefinedTermFr>ASTM</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857471" lims:id="857471" generate-in-text="no"><Text><DefinedTermEn>auditor</DefinedTermEn> means a person who</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857472" lims:id="857472"><Label>(a)</Label><Text>is independent of the responsible person that is to be audited; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857473" lims:id="857473"><Label>(b)</Label><Text>has knowledge of and has experience with respect to</Text><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857474" lims:id="857474"><Label>(i)</Label><Text>the certification, operation and relative accuracy test audit of continuous emission monitoring systems, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857475" lims:id="857475"><Label>(ii)</Label><Text>quality assurance and quality control procedures in relation to those systems. (<DefinedTermFr>vérificateur</DefinedTermFr>)</Text></Subparagraph></Paragraph></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857476" lims:id="857476" generate-in-text="no"><Text><DefinedTermEn>authorized official</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857477" lims:id="857477"><Label>(a)</Label><Text>in respect of a responsible person that is a corporation, an officer of the corporation who is authorized to act on its behalf;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857478" lims:id="857478"><Label>(b)</Label><Text>in respect of a responsible person that is an individual, that individual or an individual who is authorized to act on that individual’s behalf; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857479" lims:id="857479"><Label>(c)</Label><Text>in respect of a responsible person that is another entity, a person authorized to act on that other entity’s behalf. (<DefinedTermFr>agent autorisé</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857480" lims:id="857480" generate-in-text="no"><Text><DefinedTermEn>biomass</DefinedTermEn> means a fuel that consists only of non-fossilized, biodegradable organic material that originates from plants or animals but does not originate from a geological formation, and includes gases and liquids that are recovered from the decomposition of organic waste. (<DefinedTermFr>biomasse</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857481" lims:id="857481" generate-in-text="no"><Text><DefinedTermEn>boiler unit</DefinedTermEn> means a unit that consists of at least one boiler but does not have a combustion engine. (<DefinedTermFr>groupe chaudière</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857482" lims:id="857482" generate-in-text="no"><Text><DefinedTermEn>capacity</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857483" lims:id="857483"><Label>(a)</Label><Text>in the case of a unit, the maximum continuous rating (the maximum net power that can be continuously sustained by the unit without the use of duct burners, at standard conditions), expressed in MW, as most recently reported to a provincial authority of competent jurisdiction or to the electric system operator in the province where the unit is located; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857484" lims:id="857484"><Label>(b)</Label><Text>in the case of a combustion engine, the manufacturer provided capacity, expressed in MW. (<DefinedTermFr>capacité</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857485" lims:id="857485" generate-in-text="no"><Text><DefinedTermEn>combustion engine</DefinedTermEn> means an engine, other than an engine that is self-propelled or designed to be propelled while performing its function, that</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857486" lims:id="857486"><Label>(a)</Label><Text>operates according to the Brayton thermodynamic cycle and combusts natural gas to produce a net amount of motive power; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857487" lims:id="857487"><Label>(b)</Label><Text>combusts natural gas and uses reciprocating motion to convert thermal energy into mechanical work. (<DefinedTermFr>moteur à combustion</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857488" lims:id="857488" generate-in-text="no"><Text><DefinedTermEn>combustion engine unit</DefinedTermEn> means a unit that consists of at least one combustion engine and, if applicable, a heat recovery system, but does not have a boiler. (<DefinedTermFr>groupe moteur à combustion</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857489" lims:id="857489" generate-in-text="no"><Text><DefinedTermEn>continuous emission monitoring system</DefinedTermEn> or <DefinedTermEn>CEMS</DefinedTermEn> means equipment for the sampling, conditioning and analyzing of emissions from a given source and the recording of data related to those emissions. (<DefinedTermFr>système de mesure et d’enregistrement en continu des émissions</DefinedTermFr> ou <DefinedTermFr>SMECE</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857490" lims:id="857490" generate-in-text="no"><Text><DefinedTermEn>facility</DefinedTermEn> means all buildings, other structures and equipment, whether the equipment is stationary or not, that are located on a single site or adjacent sites and that are operated as a single integrated site. (<DefinedTermFr>installation</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857491" lims:id="857491" generate-in-text="no"><Text><DefinedTermEn>fossil fuel</DefinedTermEn> means a fuel other than biomass. (<DefinedTermFr>combustible fossile</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857492" lims:id="857492" generate-in-text="no"><Text><DefinedTermEn>heat recovery system</DefinedTermEn> means equipment, other than a boiler, that extracts heat from a combustion engine’s exhaust gases in order to generate steam or hot water. (<DefinedTermFr>système de récupération de la chaleur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857493" lims:id="857493" generate-in-text="no"><Text><DefinedTermEn>heat to electricity ratio</DefinedTermEn> means, in respect of a unit, the total useful thermal energy production in a calendar year, expressed in GWh, divided by the total gross electricity generation in that calendar year, expressed in GWh. (<DefinedTermFr>rapport chaleur-électricité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857494" lims:id="857494" generate-in-text="no"><Text><DefinedTermEn>natural gas</DefinedTermEn> means a mixture of hydrocarbons — such as methane, ethane or propane — that is in a gaseous state at standard conditions and that is composed of at least 70% methane by volume or that has a higher heating value that is not less than 35 MJ/standard m<Sup>3</Sup> and not more than 41 MJ/standard m<Sup>3</Sup>. It excludes landfill gas, digester gas, gas from wastewater treatment systems, refinery gas, sour gas, blast furnace gas, producer gas, coke oven gas, gas derived from petroleum coke or coal — including synthetic gas — or any gaseous fuel produced in a process that might result in highly variable sulphur content or heating value. (<DefinedTermFr>gaz naturel</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857495" lims:id="857495" generate-in-text="no"><Text><DefinedTermEn>operator</DefinedTermEn> means a person who has the charge, management or control of a unit. (<DefinedTermFr>exploitant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857496" lims:id="857496" generate-in-text="no"><Text><DefinedTermEn>performance test verifier</DefinedTermEn> means a person who</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857497" lims:id="857497"><Label>(a)</Label><Text>is independent of the responsible person for which the performance test is being conducted; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857498" lims:id="857498"><Label>(b)</Label><Text>has knowledge of and has experience with respect to performance testing of boiler units. (<DefinedTermFr>vérificateur de l’essai de rendement</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857499" lims:id="857499" generate-in-text="no"><Text><DefinedTermEn>potential electrical output</DefinedTermEn> means the quantity of electricity that would be generated by a unit in a calendar year if the unit were to operate at capacity at all times during that calendar year. (<DefinedTermFr>production potentielle d’électricité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857500" lims:id="857500" generate-in-text="no"><Text><DefinedTermEn>Reference Method</DefinedTermEn> means the document entitled <XRefExternal reference-type="standard">Reference Method for Source Testing: Quantification of Carbon Dioxide Releases by Continuous Emission Monitoring Systems from Thermal Power Generation</XRefExternal>, June 2012, published by the Department of the Environment. (<DefinedTermFr>Méthode de référence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857501" lims:id="857501" generate-in-text="no"><Text><DefinedTermEn>responsible person</DefinedTermEn> means an owner or operator of a unit. (<DefinedTermFr>personne responsable</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857502" lims:id="857502" generate-in-text="no"><Text><DefinedTermEn>standard conditions</DefinedTermEn> means a temperature of 15˚C and a pressure of 101.325 kPa. (<DefinedTermFr>conditions normales</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857503" lims:id="857503" generate-in-text="no"><Text><DefinedTermEn>standard m<Sup>3</Sup></DefinedTermEn> means a volume expressed in cubic metres — at standard conditions. (<DefinedTermFr>m<Sup>3</Sup> normalisé</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857504" lims:id="857504" generate-in-text="no"><Text><DefinedTermEn>unit</DefinedTermEn> means an assembly comprised of a boiler or combustion engine and any other equipment that is physically connected to either, including duct burners and other combustion devices, heat recovery systems, steam turbines, generators and emission control devices and that operate together to generate electricity and, if applicable, produce useful thermal energy, from the combustion of natural gas. (<DefinedTermFr>groupe</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857505" lims:id="857505" generate-in-text="no"><Text><DefinedTermEn>useful life</DefinedTermEn>, in respect of a boiler unit referred to in subsection <XRefInternal>3</XRefInternal>(4), has the same meaning as in subsection 2(1) of the <XRefExternal reference-type="regulation">Reduction of Carbon Dioxide Emissions from Coal-fired Generation of Electricity Regulations</XRefExternal>. (<DefinedTermFr>vie utile</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2019-01-01" lims:fid="857506" lims:id="857506" generate-in-text="no"><Text><DefinedTermEn>useful thermal energy</DefinedTermEn> means energy in the form of steam or hot water that is destined for a use — other than the generation of electricity — that would have required the consumption of energy in the form of fuel or electricity had that steam or hot water not been used. (<DefinedTermFr>énergie thermique utile</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857507" lims:id="857507"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857508" lims:id="857508">Interpretation of documents incorporated by reference</MarginalNote><Label>(2)</Label><Text>For the purposes of interpreting documents that are incorporated by reference into these Regulations, “should” must be read to mean “must” and any recommendation or suggestion must be read as an obligation.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857509" lims:id="857509"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857510" lims:id="857510">Standards incorporated by reference</MarginalNote><Label>(3)</Label><Text>Any standard of the ASTM, Gas Processors Association or the API that is incorporated by reference into these Regulations is incorporated as amended from time to time.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-11-30" lims:fid="857511" lims:id="857511" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857512" lims:id="857512"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857513" lims:id="857513">New generation of electricity — boiler units</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857514" lims:id="857514"><Label>(1)</Label><Text>These Regulations apply to any boiler unit that has a capacity of 25 MW or more, that begins generating electricity on or after January 1, 2019, beginning on January 1 of the calendar year during which it meets the following conditions:</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857515" lims:id="857515"><Label>(a)</Label><Text>more than 30% of its heat input, on average, during the calendar year, comes from the combustion of natural gas;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857516" lims:id="857516"><Label>(b)</Label><Text>its heat to electricity ratio is not more than 0.9; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857517" lims:id="857517"><Label>(c)</Label><Text>a quantity of the electricity that it generates is sold or distributed to the electric grid.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857518" lims:id="857518"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857519" lims:id="857519">New generation of electricity — combustion engine units</MarginalNote><Label>(2)</Label><Text>These Regulations apply to any combustion engine unit that has a capacity of 25 MW or more, that begins generating electricity on or after January 1, 2021, beginning on January 1 of the calendar year during which it meets the following conditions:</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857520" lims:id="857520"><Label>(a)</Label><Text>more than 30% of its heat input, on average, during the calendar year, comes from the combustion of natural gas; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857521" lims:id="857521"><Label>(b)</Label><Text>33% or more of its potential electrical output is sold or distributed to the electric grid, without regard to the quantity of electricity sold or distributed to the electric grid coming from the unit if the unit is equipped with replacement combustion engines that are temporarily installed, for a period of not more than 90 days, as part of repairs or maintenance, during the replacement period.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857522" lims:id="857522"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857523" lims:id="857523">Existing generation of electricity</MarginalNote><Label>(3)</Label><Text>These Regulations also apply to any unit referred to in subsection (1) or (2) that generated electricity at a facility before January 1, 2019 in the case of a boiler unit and before January 1, 2021 in the case of a combustion engine unit and</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857524" lims:id="857524"><Label>(a)</Label><Text>was moved to another facility on or after whichever of those dates is applicable; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857525" lims:id="857525"><Label>(b)</Label><Text>is a combustion engine unit for which more than 50% of the total capacity of the combustion engines comes from combustion engines installed on or after January 1, 2021, unless they are engines that have a capacity of 150 MW or less and are installed to replace engines that have a capacity of 150 MW or less and that are installed before January 1, 2021.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857526" lims:id="857526"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857527" lims:id="857527">Significantly modified — conversion to natural gas</MarginalNote><Label>(4)</Label><Text>These Regulations also apply to any boiler unit referred to in subsection (1) that was registered under subsection 4(1) of the <XRefExternal reference-type="regulation">Reduction of Carbon Dioxide Emissions from Coal-fired Generation of Electricity Regulations</XRefExternal>, and that generated electricity before January 1, 2019, beginning on January 1 of the calendar year following that in which the unit ceases to combust coal.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857528" lims:id="857528"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857529" lims:id="857529">Hybrid configuration</MarginalNote><Label>(5)</Label><Text>If a combustion engine unit and a boiler unit share the same steam turbine, the provisions of these Regulations apply as follows:</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857530" lims:id="857530"><Label>(a)</Label><Text>with respect to a combustion engine unit, they apply to the assembly comprised of combustion engines and any other equipment connected to them including the steam turbine that it shares with the boiler unit; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857531" lims:id="857531"><Label>(b)</Label><Text>with respect to a boiler unit, they apply to the assembly comprised of boilers and any other equipment connected to them including the steam turbine that it shares with the combustion engine unit.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857532" lims:id="857532"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857533" lims:id="857533">Non-application</MarginalNote><Label>(6)</Label><Text>These Regulations do not apply to units with respect to a calendar year in which they generate electricity and, if applicable, produce useful thermal energy from the combustion of <DefinitionRef>coal</DefinitionRef> as defined in subsection 2(1) of the <XRefExternal reference-type="regulation">Reduction of Carbon Dioxide Emissions from Coal-fired Generation of Electricity Regulations</XRefExternal>.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-11-30" lims:fid="857534" lims:id="857534" level="1"><TitleText>Requirements</TitleText></Heading><Heading lims:inforce-start-date="2018-11-30" lims:fid="857535" lims:id="857535" level="2"><TitleText>Emission Intensity Limits</TitleText></Heading><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857536" lims:id="857536"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857537" lims:id="857537">General</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857538" lims:id="857538"><Label>(1)</Label><Text>A responsible person for a unit must not emit from the unit an amount of CO<Sub>2</Sub> from the combustion of fossil fuels in the unit, that is, during a calendar year, on average, greater than any of the following intensity limits, as applicable:</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857539" lims:id="857539"><Label>(a)</Label><Text>420 tonnes of CO<Sub>2</Sub> emissions/GWh of energy produced</Text><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857540" lims:id="857540"><Label>(i)</Label><Text>in the case of boiler units, other than those referred to in subsection <XRefInternal>3</XRefInternal>(4), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857541" lims:id="857541"><Label>(ii)</Label><Text>in the case of combustion engine units that are equipped with at least one combustion engine that has a capacity of more than 150 MW; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857542" lims:id="857542"><Label>(b)</Label><Text>550 tonnes of CO<Sub>2</Sub> emissions/GWh of energy produced in the case of combustion engine units that are equipped with combustion engines that have a capacity of 150 MW or less.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857543" lims:id="857543"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857544" lims:id="857544">Significantly modified boiler units</MarginalNote><Label>(2)</Label><Text>It is prohibited for a responsible person for a boiler unit referred to in subsection <XRefInternal>3</XRefInternal>(4) to emit from the boiler unit an amount of CO<Sub>2</Sub>, from the combustion of fossil fuels in the unit, that is, during a calendar year, on average, greater than 420 tonnes of CO<Sub>2</Sub> emissions/GWh of energy produced, as applicable, beginning in</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857545" lims:id="857545"><Label>(a)</Label><Text>the year after the unit’s end of useful life, if the initial performance test conducted under subsection <XRefInternal>5</XRefInternal>(1) indicates a CO<Sub>2</Sub> emissions intensity greater than 600 t/GWh;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857546" lims:id="857546"><Label>(b)</Label><Text>the sixth year after the unit’s end of useful life, if the initial performance test conducted under subsection <XRefInternal>5</XRefInternal>(1) indicates a CO<Sub>2</Sub> emissions intensity greater than 550 t/GWh and less than or equal to 600 t/GWh;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857547" lims:id="857547"><Label>(c)</Label><Text>the ninth year after the unit’s end of useful life, if the initial performance test conducted under subsection <XRefInternal>5</XRefInternal>(1) indicates a CO<Sub>2</Sub> emissions intensity greater than 480 t/GWh and less than or equal to 550 t/GWh; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857548" lims:id="857548"><Label>(d)</Label><Text>the eleventh year after the unit’s end of useful life, if the initial performance test conducted under subsection <XRefInternal>5</XRefInternal>(1) results in a CO<Sub>2</Sub> emissions intensity less than or equal to 480 t/GWh.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857549" lims:id="857549"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857550" lims:id="857550">Quantification of energy and emissions</MarginalNote><Label>(3)</Label><Text>For the purposes of subsections (1) and (2),</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857551" lims:id="857551"><Label>(a)</Label><Text>the quantity of energy produced in the calendar year must be determined in accordance with section <XRefInternal>11</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857552" lims:id="857552"><Label>(b)</Label><Text>the quantity of CO<Sub>2</Sub> emissions produced in the calendar year must be determined in accordance with sections <XRefInternal>12</XRefInternal> to <XRefInternal>18</XRefInternal>, as applicable.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857553" lims:id="857553"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857554" lims:id="857554">Special Rules</MarginalNote><Label>(4)</Label><Text>For the purposes of subsection (3), if, in the calendar year, one of the combustion engines of the unit is repaired or maintained and one or more replacement combustion engines are temporarily installed, the quantity of energy and CO<Sub>2</Sub> emissions produced during the replacement period, to a maximum of 90 days per calendar year, are excluded from the calculation referred to in that paragraph.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857555" lims:id="857555"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857556" lims:id="857556">Exception — boiler unit</MarginalNote><Label>(5)</Label><Text>Despite subsection (1), a boiler unit that, in a calendar year, does not meet one of the conditions set out in subsection <XRefInternal>3</XRefInternal>(1), is not subject to the emission intensity limit for that calendar year.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857557" lims:id="857557"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857558" lims:id="857558">Exception — combustion engine</MarginalNote><Label>(6)</Label><Text>Despite subsection (1), a combustion engine unit that, in a calendar year, does not meet one of the conditions set out in subsection <XRefInternal>3</XRefInternal>(2), is not subject to the emission intensity limit for that calendar year.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-11-30" lims:fid="857559" lims:id="857559" level="2"><TitleText>Performance Tests — Significantly Modified Boiler Units</TitleText></Heading><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857560" lims:id="857560"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857561" lims:id="857561">Initial performance test</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857562" lims:id="857562"><Label>(1)</Label><Text>An initial performance test must be conducted in the presence of the performance test verifier and in accordance with subsection (3) to determine the CO<Sub>2</Sub> emission intensity for a boiler unit referred to in subsection <XRefInternal>3</XRefInternal>(4) within 12 months following</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857563" lims:id="857563"><Label>(a)</Label><Text>in the case of a unit that has ceased to combust coal before January 1, 2019, January 1, 2019; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857564" lims:id="857564"><Label>(b)</Label><Text>in the case of a unit that ceases to combust coal on or after January 1, 2019, the day on which electricity generated from the boiler unit was first sold or distributed to the electric grid, in the calendar year in which the unit becomes subject to these Regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857565" lims:id="857565"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857566" lims:id="857566">Annual performance test</MarginalNote><Label>(2)</Label><Text>Performance tests are to be subsequently conducted annually to determine the CO<Sub>2</Sub> emission intensity for the boiler unit in question, in accordance with subsection (3), for as long as the responsible person for that boiler unit does not have to meet the emission limit referred to in subsection <XRefInternal>4</XRefInternal>(2).</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857567" lims:id="857567"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857568" lims:id="857568">Conditions — test</MarginalNote><Label>(3)</Label><Text>The initial and annual performance test must consist of a continuous test that lasts at least two hours and does not exceed 100% of the unit’s capacity.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857569" lims:id="857569"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857570" lims:id="857570">Quantification</MarginalNote><Label>(4)</Label><Text>For the purposes of subsections (1) and (2),</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857571" lims:id="857571"><Label>(a)</Label><Text>the quantity of energy produced by the unit must be determined in accordance with section <XRefInternal>11</XRefInternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857572" lims:id="857572"><Label>(b)</Label><Text>the quantity of CO<Sub>2</Sub> emitted by the unit must be determined in accordance with sections <XRefInternal>12</XRefInternal>, <XRefInternal>13</XRefInternal> and <XRefInternal>15</XRefInternal> to <XRefInternal>18</XRefInternal>, as applicable: however, all emissions must be quantified including those from the combustion of biomass.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857573" lims:id="857573"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857574" lims:id="857574">Adaptation</MarginalNote><Label>(5)</Label><Text>For the performance test, the reference to “calendar year” in sections <XRefInternal>11</XRefInternal>, <XRefInternal>12</XRefInternal>, <XRefInternal>15</XRefInternal>, <XRefInternal>17</XRefInternal> and <XRefInternal>18</XRefInternal> and in the Reference Method is replaced with a reference to “performance test period”.</Text></Subsection></Section><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857575" lims:id="857575"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857576" lims:id="857576">Requirement</MarginalNote><Label>6</Label><Text>A responsible person for a unit referred to in subsection <XRefInternal>3</XRefInternal>(4) must obtain an annual performance test result that shows less than a 2% increase in emission intensity from the previous performance test.</Text></Section><Heading lims:inforce-start-date="2018-11-30" lims:fid="857577" lims:id="857577" level="2"><TitleText>Emergency Circumstances</TitleText></Heading><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857578" lims:id="857578"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857579" lims:id="857579">Application for exemption</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857580" lims:id="857580"><Label>(1)</Label><Text>A responsible person for a unit may, under an emergency circumstance described in subsection (2), apply to the Minister for an exemption from the application of subsection <XRefInternal>4</XRefInternal>(1) or (2) in respect of the unit if, as a result of the emergency, the operator of the electricity grid in the province in which the unit is located or an official of that province responsible for ensuring and supervising the electricity supply orders the responsible person to produce electricity to avoid a threat to the supply or to restore that supply.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857581" lims:id="857581"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857582" lims:id="857582">Definition of <DefinitionRef>emergency circumstance</DefinitionRef></MarginalNote><Label>(2)</Label><Text>An emergency circumstance is a circumstance</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857583" lims:id="857583"><Label>(a)</Label><Text>that arises due to an extraordinary, unforeseen and irresistible event; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857584" lims:id="857584"><Label>(b)</Label><Text>under which one or more of the measures referred to in paragraph 1(a) of the <XRefExternal reference-type="regulation" link="SOR-2010-138">Regulations Prescribing Circumstances for Granting Waivers Pursuant to Section 147 of the Act</XRefExternal> has been made or issued in the province where the unit is located.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857585" lims:id="857585"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857586" lims:id="857586">Deadline for application</MarginalNote><Label>(3)</Label><Text>The application for the exemption must be provided to the Minister within 15 days after the day on which the emergency circumstance arises. The application must include the information referred to in section 1 and paragraphs 2(a), (b) and (d) of Schedule 1 or the unit’s registration number, if any, the date on which the emergency circumstance arose and information, along with supporting documents, to demonstrate that the conditions set out in subsection (1) are met.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857587" lims:id="857587"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857588" lims:id="857588">Minister’s decision</MarginalNote><Label>(4)</Label><Text>If the Minister is satisfied that the conditions set out in subsection (1) are met, the Minister must, within 30 days after the day on which the application is received,</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857589" lims:id="857589"><Label>(a)</Label><Text>grant the exemption; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857590" lims:id="857590"><Label>(b)</Label><Text>if the unit has not been assigned a registration number, assign a registration number and inform the responsible person of that number.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857591" lims:id="857591"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857592" lims:id="857592">Duration of exemption</MarginalNote><Label>(5)</Label><Text>The exemption becomes effective on the day on which the emergency circumstance arises and ceases to have effect on the earliest of</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857593" lims:id="857593"><Label>(a)</Label><Text>the ninetieth day after that day,</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857594" lims:id="857594"><Label>(b)</Label><Text>the day specified by the Minister,</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857595" lims:id="857595"><Label>(c)</Label><Text>the day on which the circumstance referred to in paragraph (2)(a) ceases to cause a disruption, or a significant risk of disruption, to the electricity supply in the province where the unit is located, and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857596" lims:id="857596"><Label>(d)</Label><Text>the day on which the measure, if any, referred to in paragraph (2)(b) ceases to have effect.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857597" lims:id="857597"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857598" lims:id="857598">Application for extension of exemption</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857599" lims:id="857599"><Label>(1)</Label><Text>If the conditions set out in subsection <XRefInternal>7</XRefInternal>(1) will continue to exist after the day on which the exemption granted under paragraph <XRefInternal>7</XRefInternal>(4)(a) is to cease to have effect, the responsible person may, before that day, apply to the Minister for an extension of the exemption.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857600" lims:id="857600"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857601" lims:id="857601">Contents of application</MarginalNote><Label>(2)</Label><Text>The application must include the unit’s registration number and information, along with supporting documents, to demonstrate that</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857602" lims:id="857602"><Label>(a)</Label><Text>the conditions set out in subsection <XRefInternal>7</XRefInternal>(1) will continue to exist after the day on which the exemption is to cease to have effect; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857603" lims:id="857603"><Label>(b)</Label><Text>measures — other than the operation of the unit while the exemption has effect — have been or are being taken to end, decrease the risk of or mitigate the consequences of the disruption.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857604" lims:id="857604"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857605" lims:id="857605">Minister’s decision</MarginalNote><Label>(3)</Label><Text>If the Minister is satisfied that the elements referred to in paragraphs (2)(a) and (b) have been demonstrated, the Minister must grant the extension within 15 days after the day on which the application is received.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857606" lims:id="857606"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857607" lims:id="857607">Duration of extension</MarginalNote><Label>(4)</Label><Text>The extension ceases to have effect on the earliest of</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:inforce-start-date="2018-11-30" lims:fid="857611" lims:id="857611" level="2"><TitleText>Accuracy of Data</TitleText></Heading><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857612" lims:id="857612"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857613" lims:id="857613">Measuring devices — installation, maintenance and calibration</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857614" lims:id="857614"><Label>(1)</Label><Text>A responsible person for a unit must install, maintain and calibrate a measuring device — other than a continuous emission monitoring system and a measuring device that is subject to the <XRefExternal reference-type="act" link="E-4">Electricity and Gas Inspection Act</XRefExternal> — that is used for the purposes of these Regulations in accordance with the manufacturer’s instructions or any applicable generally recognized national or international industry standard.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857615" lims:id="857615"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857616" lims:id="857616">Frequency of calibration</MarginalNote><Label>(2)</Label><Text>The responsible person must calibrate each of the measuring devices at the greater of the following frequencies:</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857617" lims:id="857617"><Label>(a)</Label><Text>at least once in every calendar year but at least five months after a previous calibration, and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857618" lims:id="857618"><Label>(b)</Label><Text>the minimum frequency recommended by the manufacturer.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857619" lims:id="857619"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857620" lims:id="857620">Accuracy of measurements</MarginalNote><Label>(3)</Label><Text>The responsible person must use measuring devices that enable measurements to be made with a degree of accuracy of ± 5%.</Text></Subsection></Section><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857621" lims:id="857621"><MarginalNote lims:inforce-start-date="2019-01-01" quantity of electricity generated by the given unit in the calendar year expressed in GWh, determined by the formula in subsection (2); lims:fid="857635" lims:id="857635">Quantity of electricity — hybrid configuration</MarginalNote><Label>(2)</Label><Text>The quantity of electricity generated by a given unit is determined by the lims:id="857743">Quantification</MarginalNote><Label>17</Label><Text>The quantity of CO<Sub>2</Sub> emissions resulting from the combustion of fossil fuels in a unit in a calendar year, that is not lims:inforce-start-date="2019-01-01" lims:fid="857793" lims:id="857793"><Label>(c)</Label><Text>for a solid fuel, on the same wet or dry basis as that used in the determination of CC<Sub>A</Sub>, in accordance with,</Text><FormulaParagraph lims:inforce-start-date="2019-01-01" lims:fid="857794" lims:id="857794"><Label>(i)</Label><Text>for a solid fuel derived from waste, ASTM E777-08, entitled <XRefExternal reference-type="standard">Standard Test Method for Carbon and Hydrogen in the Analysis Sample of Refuse-Derived Fuel</XRefExternal>, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2019-01-01" lims:fid="857795" lims:id="857795"><Label>(ii)</Label><Text>for any other solid fuel, the following standard or method for the measurement of the carbon content of the fuel:</Text><FormulaParagraph lims:inforce-start-date="2019-01-01" lims:fid="857796" lims:id="857796"><Label>(A)</Label><Text>the ASTM standard that applies to the type of fuel, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2019-01-01" lims:fid="857797" lims:id="857797"><Label>(B)</Label><Text>if no ASTM standard applies, an applicable internationally recognized method;</Text></FormulaParagraph></FormulaParagraph></FormulaParagraph></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2019-01-01" lims:fid="857798" lims:id="857798"><FormulaTerm>i</FormulaTerm><Text>is the i<Sup>th</Sup> sampling period that is referred to in section <XRefInternal>19</XRefInternal>, where “i” goes from the number 1 to n and where fuel,</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2019-01-01" lims:fid="857801" lims:id="857801"><Label>(b)</Label><Text>in kL, for a liquid fuel, and</Text></FormulaParagraph><FormulaParagraph lims:inforce-start-date="2019-01-01" lims:fid="857802" lims:id="857802"><Label>(c)</Label><Text>in tonnes, for a solid fuel, on the same wet or dry basis as that used in the determination of CC<Sub>A</Sub>.</Text></FormulaParagraph></FormulaDefinition></FormulaGroup></Subsection></Section><Heading lims:inforce-start-date="2018-11-30" lims:fid="857803" lims:id="857803" level="2"><TitleText>Sampling and Missing Data</TitleText></Heading><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857804" lims:id="857804"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857805" lims:id="857805">Sampling</MarginalNote><Label>19</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857806" lims:id="857806"><Label>(1)</Label><Text>Subject to subsection (2), the determination of the value of the elements related to carbon content referred to in section <XRefInternal>18</XRefInternal> must be based on fuel samples taken in accordance with this section.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857807" lims:id="857807"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857808" lims:id="857808">Carbon content provided by the supplier</MarginalNote><Label>(2)</Label><Text>If the supplier of the fuel has provided the carbon content of the fuel, the responsible person can obtain from that supplier the carbon content of the fuel for the specified sampling period and at the specified minimum sampling frequency rather than taking samples in accordance with subsection (3).</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857809" lims:id="857809"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857810" lims:id="857810">Frequency</MarginalNote><Label>(3)</Label><Text>Each fuel sample must be taken at a time and location in the fuel handling system of the facility that provides the following representative samples of the fuel combusted at the applicable minimum frequency:</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857811" lims:id="857811"><Label>(a)</Label><Text>for natural gas, during each sampling period consisting of each year that the unit generates electricity or produces useful thermal energy, two samples taken that year, with each of those samples being taken at least four months after any previous sample has been taken, in accordance with whichever of the following standard that applies:</Text><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857812" lims:id="857812"><Label>(i)</Label><Text>ASTM D4057-12, entitled <XRefExternal reference-type="standard">Standard Practice for Manual Sampling of Petroleum and Petroleum Products</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857813" lims:id="857813"><Label>(ii)</Label><Text>ASTM D4177-16e1, entitled <XRefExternal reference-type="standard">Standard Practice for Automatic Sampling of Petroleum and Petroleum Products</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857814" lims:id="857814"><Label>(iii)</Label><Text>ASTM D5287-08(2015), entitled <XRefExternal reference-type="standard">Standard Practice for Automatic Sampling of Gaseous Fuels</XRefExternal>, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857815" lims:id="857815"><Label>(iv)</Label><Text>ASTM F307-13, entitled <XRefExternal reference-type="standard">Standard Practice for Sampling Pressurized Gas for Gas Analysis</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857816" lims:id="857816"><Label>(b)</Label><Text>for refinery gas, during each sampling period consisting of each day that the unit generates electricity or produces useful thermal energy, one sample per day that is taken at least six hours after any previous sample has been taken, in accordance with any applicable standard referred to in paragraph (a);</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857817" lims:id="857817"><Label>(c)</Label><Text>for a type of liquid fuel or of a gaseous fuel other than refinery gas and natural gas, during each sampling period consisting of each month that the unit generates electricity or produces useful thermal energy, one sample per month that is taken at least two weeks after any previous sample has been taken, in accordance with any of the standards referred to in paragraph (a); and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857818" lims:id="857818"><Label>(d)</Label><Text>for a solid fuel, one composite sample per month that consists of sub-samples, each having the same mass, that are taken from the fuel that is fed for combustion during each week that begins in that month and during which the unit generates electricity or produces useful thermal energy, and after all fuel treatment operations have been carried out but before any mixing of the fuel from which the sub-sample is taken with other fuels, and at least 72 hours after any previous sub-sample has been taken.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857819" lims:id="857819"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857820" lims:id="857820">Additional samples</MarginalNote><Label>(4)</Label><Text>For greater certainty, the responsible person who, for the purposes of these Regulations, takes more samples than the minimum required under subsection (3) must make the determination referred to in subsection (1) based on each sample taken — and in the case of composite samples, each sub-sample taken — including those additional samples.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857821" lims:id="857821"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857822" lims:id="857822">Significantly modified boiler units</MarginalNote><Label>(5)</Label><Text>In the case of a boiler unit referred to in subsection <XRefInternal>3</XRefInternal>(4), one fuel sample is required for the initial performance test and each subsequent performance test and it must be taken in accordance with one of the applicable standards set out in subparagraphs (3)(a)(i) to (iv).</Text></Subsection></Section><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857823" lims:id="857823"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857824" lims:id="857824">Missing data</MarginalNote><Label>20</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857825" lims:id="857825"><Label>(1)</Label><Text>Except in the case of an initial performance test or any subsequent performance test referred to in section 5, if, for any reason beyond the responsible person’s control, the emission intensity referred to in subsection <XRefInternal>4</XRefInternal>(1) or <XRefInternal>4</XRefInternal>(2) cannot be determined in accordance with a formula set out in any of sections <XRefInternal>11</XRefInternal>, <XRefInternal>17</XRefInternal> and <XRefInternal>18</XRefInternal> because data required to determine the value of an element of that formula is missing for a given period in a calendar year, replacement data for that given period must be used to determine that value.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857826" lims:id="857826"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857827" lims:id="857827">Replacement data — CEMS</MarginalNote><Label>(2)</Label><Text>If a CEMS is used to determine the value of an element of a formula set out in section <XRefInternal>17</XRefInternal> but data is missing for a given period, the replacement data must be obtained in accordance with Section 3.5.2 of the Reference Method.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857828" lims:id="857828"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857829" lims:id="857829">Replacement data — fuel-based methods</MarginalNote><Label>(3)</Label><Text>If a fuel-based method is used to determine the value of any element — related to the carbon content or molecular mass of a fuel — of a formula set out in section <XRefInternal>17</XRefInternal> or <XRefInternal>18</XRefInternal> but data is missing for a given period, the replacement data is to be the average of the available data for that element, using the fuel-based method in question, during the equivalent period prior to and, if the data is available, subsequent to that given period. However, if no data is available for that element for the equivalent period prior to that given period, the replacement data to be used is the value determined for that element, using the fuel-based method in question, during the equivalent period subsequent to the given period.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857830" lims:id="857830"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857831" lims:id="857831">Replacement data — multiple periods</MarginalNote><Label>(4)</Label><Text>Replacement data may be used in relation to a maximum of 28 days in a calendar year.</Text></Subsection></Section><Heading lims:inforce-start-date="2018-11-30" lims:fid="857832" lims:id="857832" level="1"><TitleText>Reporting, Sending, Recording and Retaining Information</TitleText></Heading><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857833" lims:id="857833"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857834" lims:id="857834">Annual reports</MarginalNote><Label>21</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857835" lims:id="857835"><Label>(1)</Label><Text>Subject to subsection (2), a responsible person for a unit must send one of the following reports, to the Minister on or before the June 1 that follows the calendar year that is the subject of the report:</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857836" lims:id="857836"><Label>(a)</Label><Text>a report containing the information set out in Schedule 1 in respect of each calendar year in which the unit meets the conditions set out in subsection <XRefInternal>3</XRefInternal>(1) or (2), as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857837" lims:id="857837"><Label>(b)</Label><Text>a short report containing the information referred to in sections 1 and 2, except paragraph 2(h), of Schedule 1 in respect of each calendar year in which the unit no longer meets one of the conditions referred to in subsection <XRefInternal>3</XRefInternal>(1) or (2), as the case may be.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857838" lims:id="857838"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857839" lims:id="857839">Significantly modified boiler units</MarginalNote><Label>(2)</Label><Text>A responsible person for a boiler unit referred to in subsection <XRefInternal>3</XRefInternal>(4) must send the reports referred to in subsection (1), beginning in the year in which it must meet the emission limit referred to in subsection 4(2).</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857840" lims:id="857840"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857841" lims:id="857841">Permanent cessation of electricity generation</MarginalNote><Label>(3)</Label><Text>If a unit permanently ceases to generate electricity in a calendar year, a responsible person for the unit must so notify the Minister in writing not later than 60 days after the day on which the unit ceases generating electricity. A report is not necessary in respect of the calendar years following the calendar year in which the unit ceases generating electricity.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857842" lims:id="857842"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857843" lims:id="857843">Registration number</MarginalNote><Label>(4)</Label><Text>On receipt of a first report in respect of a unit referred to in paragraph (1)(a), the Minister must assign a registration number to the unit and inform the responsible person of that number.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857844" lims:id="857844"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857845" lims:id="857845">Change of information</MarginalNote><Label>(5)</Label><Text>If there is a change to the information referred to in section 1 of Schedule 1 that was provided in the most recent report, the responsible person must notify the Minister of the change in writing not later than 30 days after the day on which the change is made.</Text></Subsection></Section><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857846" lims:id="857846"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857847" lims:id="857847">Performance test reporting</MarginalNote><Label>22</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857848" lims:id="857848"><Label>(1)</Label><Text>A responsible person for a boiler unit referred to in subsection <XRefInternal>3</XRefInternal>(4) must send, to the Minister, a report containing the information referred to in Schedule 4 in relation to the performance test identified in section <XRefInternal>5</XRefInternal> no later than 60 days after the performance test was conducted.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857849" lims:id="857849"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857850" lims:id="857850">Performance test verifier’s report — initial test</MarginalNote><Label>(2)</Label><Text>In the case of a boiler unit referred to in subsection <XRefInternal>3</XRefInternal>(4), the responsible person must obtain a report, signed by the performance test verifier, on the initial performance test, that contains the information referred to in Schedule 5 and send it to the Minister with their report referred to in subsection (1).</Text></Subsection></Section><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857851" lims:id="857851"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857852" lims:id="857852">Electronic report, notice and application</MarginalNote><Label>23</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857853" lims:id="857853"><Label>(1)</Label><Text>A report or notice that is required, or an application that is made, under these Regulations must be sent electronically in the form specified by the Minister and must bear the electronic signature of an authorized official of the responsible person.</Text></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857854" lims:id="857854"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857855" lims:id="857855">Paper report or notice</MarginalNote><Label>(2)</Label><Text>If the Minister has not specified an electronic form or if the person is unable to send the report, notice or application electronically in accordance with subsection (1) because of circumstances beyond the person’s control, the report, notice or application must be sent on paper, in the form specified by the Minister, if applicable, and be signed by an authorized official of the responsible person.</Text></Subsection></Section><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857856" lims:id="857856"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857857" lims:id="857857">Maintain copy</MarginalNote><Label>24</Label><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857858" lims:id="857858"><Label>(1)</Label><Text>A responsible person for a unit must make a record containing the following documents and information:</Text><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857859" lims:id="857859"><Label>(a)</Label><Text>any notice referred to in subsection <XRefInternal>21</XRefInternal>(5) that was sent to the Minister along with supporting documents;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857860" lims:id="857860"><Label>(b)</Label><Text>any application referred to in subsection <XRefInternal>7</XRefInternal>(3) or <XRefInternal>8</XRefInternal>(2), whichever applies, along with supporting documents;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857861" lims:id="857861"><Label>(c)</Label><Text>every measurement and calculation used to determine the value of an element of a formula used for the purposes of section <XRefInternal>4</XRefInternal> and, if applicable, section <XRefInternal>5</XRefInternal>, along with an indication of the standards that were used to determine the value of the elements used in those formula and any necessary supporting documents;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857862" lims:id="857862"><Label>(d)</Label><Text>an indication of the standards or methods referred to in the description of CC<Sub>i</Sub> in subsection <XRefInternal>18</XRefInternal>(2) that were used to determine the value of CC<Sub>A</Sub> in paragraph <XRefInternal>18</XRefInternal>(1)(a), (b) or (c), as the case may be, or, for a sample of gaseous fuel, a statement that indicates that a direct measuring device was used to determine that value;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857863" lims:id="857863"><Label>(e)</Label><Text>information demonstrating that any meter referred to in section <XRefInternal>11</XRefInternal> complies with the requirements of the <XRefExternal reference-type="act" link="E-4">Electricity and Gas Inspection Act</XRefExternal> and the <XRefExternal reference-type="regulation" link="SOR-86-131">Electricity and Gas Inspection Regulations</XRefExternal>, including a certificate referred to in section 14 of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857864" lims:id="857864"><Label>(f)</Label><Text>information demonstrating that the installation, maintenance and calibration of the measuring devices referred to in subsection <XRefInternal>9</XRefInternal>(1) were done in accordance with that subsection and subsection <XRefInternal>9</XRefInternal>(2) and that the measuring devices used comply with subsection <XRefInternal>9</XRefInternal>(3);</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857865" lims:id="857865"><Label>(g)</Label><Text>supporting documents that confirm the CEMS certification under section <XRefInternal>10</XRefInternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857866" lims:id="857866"><Label>(h)</Label><Text>any document, record or information referred to in section 8 of the Reference Method, for each calendar year during which a responsible person used a CEMS;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857867" lims:id="857867"><Label>(i)</Label><Text>the results of the analysis of every sample taken in accordance with section <XRefInternal>19</XRefInternal>, as well as the date that each sample was taken and an indication of the standards that were used to take representative samples of the fuel;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857868" lims:id="857868"><Label>(j)</Label><Text>information demonstrating the unit capacity set out in the annual report;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857869" lims:id="857869"><Label>(k)</Label><Text>in the case of a unit that has a combustion engine that is temporarily installed for a period of 90 days or less as part of repair or maintenance,</Text><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857870" lims:id="857870"><Label>(i)</Label><Text>evidence that the combustion engine underwent repairs or maintenance and that a replacement combustion engine was temporarily connected to the unit for the duration of the repairs or maintenance,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857871" lims:id="857871"><Label>(ii)</Label><Text>the number of days that a replacement combustion engine was connected to the unit, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-01-01" lims:fid="857872" lims:id="857872"><Label>(iii)</Label><Text>the number of days that the repairs or maintenance lasted;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857873" lims:id="857873"><Label>(l)</Label><Text>information demonstrating each combustion engine capacity set out in the annual report, the date on which each combustion engine was installed and, in the case of a combustion engine with a capacity of 150 MW or less, a statement that, if applicable, the combustion engine was installed to replace an engine, with a capacity of 150 MW or less, as part of repair or maintenance; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-01" lims:fid="857874" lims:id="857874"><Label>(m)</Label><Text>any report referred to in section <XRefInternal>22</XRefInternal>, along with supporting documents.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-01-01" lims:fid="857875" lims:id="857875"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857876" lims:id="857876">30 days</MarginalNote><Label>(2)</Label><Text>The record referred to in subsection (1) must be made as soon as feasible but not later than 30 days after the day on which the information and documents to be included in it become available.</Text></Subsection></Section><Section lims:inforce-start-date="2019-01-01" lims:lastAmendedDate="2019-01-01" lims:fid="857877" lims:id="857877"><MarginalNote lims:inforce-start-date="2019-01-01" lims:fid="857878" lims:id="857878">Retention of records and reports</MarginalNote><Label>25</Label><Text>A responsible person who is required under these Regulations to make a record or send a report or notice must keep the record or a copy of the report or notice, along with the supporting documents, at their principal place of business in Canada for at least seven years after they make the record or send the report or notice.</Text></Section><Heading lims:inforce-start-date="2018-11-30" lims:fid="857879" lims:id="857879" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2018-11-30" lims:lastAmendedDate="2018-11-30" lims:fid="857880" lims:id="857880"><MarginalNote lims:inforce-start-date="2018-11-30" lims:fid="857881" lims:id="857881">Registration</MarginalNote><Label>26</Label><Subsection lims:inforce-start-date="2018-11-30" lims:fid="857882" lims:id="857882"><Label>(1)</Label><Text>Subject to subsection (2), these Regulations come into force on January 1, 2019.</Text></Subsection><Subsection lims:inforce-start-date="2018-11-30" lims:fid="857883" lims:id="857883"><MarginalNote list-item="no"><Label>(ii)</Label><Text>in the case of a boiler unit, the quantity of electricity that is sold or distributed to the electric grid for the calendar year;</Text></Provision></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857912" lims:id="857912" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(m)</Label><Text>the percentage of the unit’s heat input that comes from natural gas, on average for the calendar year; and</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857913" lims:id="857913" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(n)</Label><Text>in the case of a boiler unit, the value of the unit’s heat to electricity ratio.</Text></Provision></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857914" lims:id="857914" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>3</Label><Text>The following information respecting the emission intensity referred to in subsection <XRefInternal>4</XRefInternal>(1) or (2) of these Regulations resulting from the combustion of fossil fuel in the unit during the calendar year:</Text><Provision lims:inforce-start-date="2019-01-01" lims:fid="857915" lims:id="857915" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>the emission intensity for the unit — that is, the ratio of the quantity of CO<Sub>2</Sub> emissions referred to in paragraph (c) to the quantity of energy referred to in subparagraph (b)(i) — expressed in tonnes per GWh;</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857916" lims:id="857916" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>in respect of the quantity of energy produced by the unit,</Text><Provision lims:inforce-start-date="2019-01-01" lims:fid="857917" lims:id="857917" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>that quantity determined in accordance with section <XRefInternal>11</XRefInternal> of these Regulations, expressed in GWh,</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857918" lims:id="857918" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>the value determined for G and H<Sub>pnet</Sub> in the formula set out in subsection <XRefInternal>11</XRefInternal>(1) of these Regulations, expressed in GWh, and</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857919" lims:id="857919" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(iii)</Label><Text>the value determined for G<Sub>ce</Sub>, G<Sub>s</Sub> and G<Sub>ext</Sub> in the formula set out in subsection <XRefInternal>11</XRefInternal>(2) of these Regulations, expressed in GWh;</Text></Provision></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857920" lims:id="857920" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>in respect of the quantity of CO<Sub>2</Sub> emissions from the combustion of fuels in the unit,</Text><Provision lims:inforce-start-date="2019-01-01" lims:fid="857921" lims:id="857921" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>if paragraph <XRefInternal>12</XRefInternal>(a) of these Regulations applies, the result of the calculation made in accordance with section <XRefInternal>13</XRefInternal> or <XRefInternal>14</XRefInternal> and, if applicable, section <XRefInternal>15</XRefInternal> of these Regulations, expressed in tonnes, and</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857922" lims:id="857922" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>if paragraph <XRefInternal>12</XRefInternal>(b) of these Regulations applies, the result of the calculation made in accordance with sections <XRefInternal>17</XRefInternal> and <XRefInternal>18</XRefInternal> of these Regulations, expressed in tonnes; and</Text></Provision></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857923" lims:id="857923" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(d)</Label><Text>for each type of fuel combusted,</Text><Provision lims:inforce-start-date="2019-01-01" lims:fid="857924" lims:id="857924" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>the type and, if that type is biomass, an explanation of why that type is <DefinitionRef>biomass</DefinitionRef> as defined in subsection <XRefInternal>2</XRefInternal>(1) of these Regulations, and</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857925" lims:id="857925" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>the quantity of fuel combusted.</Text></Provision></Provision></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857926" lims:id="857926" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>4</Label><Text>The following information:</Text><Provision lims:inforce-start-date="2019-01-01" lims:fid="857927" lims:id="857927" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>in the case of a unit that is granted an exemption under paragraph <XRefInternal>7</XRefInternal>(4)(a) of these Regulations, the duration of the emergency circumstance, such as the date on which the circumstance arose and the date on which it ceased; and</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857928" lims:id="857928" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>in the case of a unit referred to in subsection <XRefInternal>4</XRefInternal>(4) of these Regulations that is temporarily connected to one or more replacement combustion engines,</Text><Provision lims:inforce-start-date="2019-01-01" lims:fid="857929" lims:id="857929" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>the duration of the repairs or maintenance, such as the day in the calendar year on which the repairs or maintenance began and the day in the calendar year on which they ended, and</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857930" lims:id="857930" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(ii)</Label><Text>the reason why the replacement combustion engine was used.</Text></Provision></Provision></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857931" lims:id="857931" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>5</Label><Text>A copy of the auditor’s report referred to in subsection <XRefInternal>16</XRefInternal>(2) of these Regulations.</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857932" lims:id="857932" format-ref="indent-0-0" language-align="yes" list-item="no"><Label>6</Label><Text>The following information respecting the replacement data referred to in section <XRefInternal>20</XRefInternal> of these Regulations that were used for a given period during the calendar year, if applicable:</Text><Provision lims:inforce-start-date="2019-01-01" lims:fid="857933" lims:id="857933" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(a)</Label><Text>the reason why data required to determine the value of an element of a formula referred to in section <XRefInternal>11</XRefInternal>, <XRefInternal>17</XRefInternal> or <XRefInternal>18</XRefInternal> of these Regulations was not obtained and an explanation why that reason was beyond the responsible person’s control;</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857934" lims:id="857934" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(b)</Label><Text>the element of the formula for which data was not obtained and the date of the day on which the data were not obtained and, if that data were not obtained for a period of several days, the dates of the days on which the period begins and ends; and</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857935" lims:id="857935" format-ref="indent-1-1" language-align="no" list-item="no"><Label>(c)</Label><Text>the value determined for the element referred to in paragraph (b) using replacement data, along with details of that determination, including</Text><Provision lims:inforce-start-date="2019-01-01" lims:fid="857936" lims:id="857936" format-ref="indent-2-2" language-align="no" list-item="no"><Label>(i)</Label><Text>the data used to make that determination for each period of one or more days,</Text></Provision><Provision lims:inforce-start-date="2019-01-01" lims:fid="857937" lims:id="857937" format-ref="indent-2-2" language-align="no"
