these Regulations apply activities whose primary purpose is to enable the person to acquire knowledge or experience, and to the employer, as if that person were an employee of the employer, and every committees.</Text></Section><Heading lims:inforce-start-date="2015-09-14" lims:fid="817911" lims:id="817911" level="2"><TitleText>Selection of Members</TitleText></Heading><Section lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2015-06-19" lims:fid="817912" lims:id="817912"><Label>3</Label><Text>Employees who are not represented by a trade union must select members of a committee by a majority of votes.</Text></Section><Heading lims:inforce-start-date="2015-09-14" lims:fid="817913" lims:id="817913" level="2"><TitleText>Qualifications of Members Selected by the Employer</TitleText></Heading><Section lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:lastAmendedDate="2019-06-25" lims:fid="817914" lims:id="1188423"><Label>4</Label><Text>The members of a committee selected by the employer must be employees who exercise managerial functions.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2019-06-25" lims:fid="817916" lims:id="817916"><Label>5</Label><Subsection lims:inforce-start-date="2015-06-19" lims:fid="817917" lims:id="817917"><Label>(1)</Label><Text>The chairpersons of a committee who are selected in accordance with subsection 135.1(7) of the Act must act alternately.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-19" lims:fid="817918" lims:id="817918"><Label>(2)</Label><Text lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="1185733" lims:id="1188438">The Chairpersons have the following responsibilities:</Text><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817919" lims:id="817919"><Label>(a)</Label><Text>scheduling the committee meetings and notifying the members of those meetings;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817920" lims:id="817920"><Label>(b)</Label><Text>preparing the agenda of each committee meeting;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817921" lims:id="817921"><Label>(c)</Label><Text>ensuring that each item under discussion at a committee meeting concludes with a decision; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817922" lims:id="817922"><Label>(d)</Label><Text>ensuring that the committee carries out its functions.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:id="817924"><Label>6</Label><Text>If a committee member ceases to be a member and by reason of the vacancy the composition of the committee fails to meet the requirements of section 135.1 of the Act, a new member must be selected and appointed</Text><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817925" lims:id="817925"><Label>(a)</Label><Text>in the case of a policy committee, within 60 days after the day on which the vacancy occurs; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817926" lims:id="817926"><Label>(b)</Label><Text>in the case of a work place committee, within 30 days after the day on which the vacancy occurs.</Text></Paragraph></Section><Heading lims:inforce-start-date="2015-09-14" lims:fid="817927" lims:id="817927" level="2"><TitleText>Quorum</TitleText></Heading><Section lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:lastAmendedDate="2019-06-25" lims:fid="817928" lims:id="1188442"><Label>7</Label><Text>A quorum of a committee consists of the majority of members, at least half of which are employee members and at least one of which is an employer 419</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2015-09-14" lims:fid="817929" lims:id="817929" level="2"><TitleText>Minutes</TitleText></Heading><Section lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2019-06-25" lims:fid="817930" lims:id="817930"><Label>8</Label><Subsection lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="817931" lims:id="1188452"><Label>(1)</Label><Text>As soon as feasible after each committee meeting, the minutes must be provided to both chairpersons for their approval and the approval document, if any, must be attached to the minutes.</Text></Subsection><Subsection lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="817932" lims:id="1188453"><Label>(2)</Label><Text>As soon as feasible after receiving the minutes and the approval document, the chairperson selected by the employer members of the committee must provide a copy of those documents to the employer and each member of the committee.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-19" lims:fid="817933" lims:id="817933"><Label>(3)</Label><Text lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="1185734" lims:id="1188454">As soon as feasible after receiving a copy of the minutes and the approval document, the employer must provide a copy of them</Text><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817934" lims:id="817934"><Label>(a)</Label><Text>to the work place committee, in the case of minutes of a policy committee meeting; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817935" lims:id="817935"><Label>(b)</Label><Text>to the policy committee, at its request, in the case of minutes of a work place committee meeting.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="817936" lims:id="1188455"><Label>(4)</Label><Text>As soon as feasible after receiving a copy of the minutes and the approval document, the employer must make a copy of the minutes readily available to the employees for a period of one month.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-19" lims:fid="817937" lims:id="817937"><Label>(5)</Label><Text>The employer must keep a copy of the minutes and the approval document at the following locations for a period of two years after the day on which the meeting was held:</Text><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817938" lims:id="817938"><Label>(a)</Label><Text>in the case of a policy committee, at the employer’s head office; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817939" lims:id="817939"><Label>(b)</Label><Text>in the case of a work place committee, at the employer’s head office or at the work level="2"><TitleText>Annual Report on Work Place Committee Activities</TitleText></Heading><Section lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2025-03-26" lims:fid="817941" lims:id="817941"><Label>9</Label><Subsection lims:inforce-start-date="2021-07-01" lims:enacted-date="2021-06-01" lims:fid="817942" lims:id="1312241"><Label>(1)</Label><Text>On or before March 1 each year, the chairperson selected by the employer members of the work place committee must submit to the Head of Compliance and Enforcement an annual report of the committee’s activities during the 12-month period ending on December 31 of the preceding year.</Text></Subsection><Subsection lims:inforce-start-date="2015-06-19" lims:fid="817943" lims:id="817943"><Label>(2)</Label><Text>The report must be in the form set out in the schedule, contain the information set out in the form, and be signed by both chairpersons.</Text></Subsection><Subsection lims:inforce-start-date="2025-03-26" lims:enacted-date="2025-03-06" lims:fid="817944" lims:id="1524984"><Label>(3)</Label><Text>As soon as feasible after the report has been submitted, the chairperson selected by the employer members of the work place committee must provide a copy of the report to the employer.</Text></Subsection><Subsection lims:inforce-start-date="2025-03-26" lims:enacted-date="2025-03-06" lims:fid="1524985" lims:id="1524985"><Label>(4)</Label><Text>As soon as feasible after receiving a copy of the report, the employer must post a copy of it in the conspicuous place or places in which the employer posts the information referred to in paragraph 125(1)(z.17) of the Act and keep the copy posted for a period of two months.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem safety representative is two years.</Text></Section><Heading lims:inforce-start-date="2015-09-14" lims:fid="817952" lims:id="817952" level="2"><TitleText>Vacancy</TitleText></Heading><Section lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2015-06-19" lims:fid="817953" lims:id="817953"><Label>13</Label><Text>If a health and safety representative ceases to be a representative, the vacancy must be filled within 30 days after the day on which the vacancy occurred.</Text></Section><Heading lims:inforce-start-date="2015-09-14" lims:fid="817954" lims:id="817954" level="1"><Label>PART 3</Label><TitleText>Health and Safety Training Program</TitleText></Heading><Heading lims:inforce-start-date="2015-09-14" lims:fid="817955" lims:id="817955" level="2"><TitleText>Training</TitleText></Heading><Section lims:inforce-start-date="2015-06-19" lims:lastAmendedDate="2019-06-25" lims:fid="817956" lims:id="817956"><Label>14</Label><Subsection lims:inforce-start-date="2015-06-19" lims:fid="817957" lims:id="817957"><Label>(1)</Label><Text>For the purposes of paragraph 125(1)(z.01) of the Act, training for members of policy and work place committees and health and safety representatives must be developed by the employer after consultation with the committees or representatives concerned and must include the following aspects:</Text><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817958" lims:id="817958"><Label>(a)</Label><Text>the Act and any regulations made under it;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817959" lims:id="817959"><Label>(b)</Label><Text>the means that allow the committee members and the health and safety representatives to fulfill their responsibilities under the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-06-25" lims:enacted-date="2019-06-25" lims:fid="817960" lims:id="1188471"><Label>(c)</Label><Text>the rules of each of the committees; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-06-19" lims:fid="817961" lims:id="817961"><Label>(d)</Label><Text>the principles of consensus building regarding health and safety issues.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-06-19" lims:fid="817962" lims:id="817962"><Label>(2)</Label><Text>The health and safety training program must be reviewed and updated at least once every three years, and whenever there is a change of circumstances that may affect the content of the
