or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808889" lims:id="808889"><Label>(b)</Label><Text>in the case of a grievance that has been consolidated with another grievance, the person designated under paragraph <XRefInternal>10</XRefInternal>(c) or (d). (<DefinedTermFr>intimé</DefinedTermFr>)</Text></Paragraph></Definition></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808890" lims:id="808890"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808891" lims:id="808891">Initial level</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808892" lims:id="808892"><Label>(1)</Label><Text>The persons who constitute the initial level are the persons who perform the functions of a level 1 in the Force.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808893" lims:id="808893"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808894" lims:id="808894">Initial level — three persons</MarginalNote><Label>(2)</Label><Text>For the purpose of subsection <XRefInternal>6</XRefInternal>(1), all combinations of any three persons who perform the functions of a level 1 in the Force constitute the initial level.</Text></Subsection></Section><Section lims:inforce-start-date="2022-12-05" lims:enacted-date="2022-12-05" lims:lastAmendedDate="2022-12-05" lims:fid="808895" lims:id="1382386"><Label>4</Label><Text><Repealed>[Repealed, SOR/2022-259, s. 2]</Repealed></Text></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="808897" lims:id="808897" level="2"><TitleText>Access to Information</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808898" lims:id="808898"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808899" lims:id="808899">Limitations under subsection 31(4) of Act</MarginalNote><Label>5</Label><Text>For the purpose of the limitations referred to in subsection 31(4) of the Act, a member is not entitled to be granted access to written or documentary information</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808900" lims:id="808900"><Label>(a)</Label><Text>the disclosure of which could reasonably be expected to be injurious to the defence of Canada or any state allied or associated with Canada, as defined in subsection 15(2) of the <XRefExternal reference-type="act" link="A-1">Access to Information Act</XRefExternal>, or to the detection, prevention or suppression of subversive or hostile activities, as defined in that subsection;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808901" lims:id="808901"><Label>(b)</Label><Text>the disclosure of which could reasonably be expected to be injurious to law enforcement;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808902" lims:id="808902"><Label>(c)</Label><Text>the disclosure of which is contrary to a provision of any contract entered into by the Crown;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808903" lims:id="808903"><Label>(d)</Label><Text>about a person’s financial or personal affairs if the person’s interest or security outweighs the member’s interest in the information; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808904" lims:id="808904"><Label>(e)</Label><Text>the disclosure of which is prohibited by law.</Text></Paragraph></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="808905" lims:id="808905" level="2"><TitleText>Panel for Grievances</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808906" lims:id="808906"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808907" lims:id="808907">Initial level panel</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808908" lims:id="808908"><Label>(1)</Label><Text>The Commissioner may designate a person to select any three-person combination described in subsection <XRefInternal>3</XRefInternal>(2) as a panel.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808909" lims:id="808909"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808910" lims:id="808910">Panel selection</MarginalNote><Label>(2)</Label><Text>The designated person may select the panel for the purpose of hearing a grievance in the following circumstances:</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808911" lims:id="808911"><Label>(a)</Label><Text>the decision, act or omission giving rise to the grievance is likely to be the subject of numerous grievances;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808912" lims:id="808912"><Label>(b)</Label><Text>the relevant law or the relevant Treasury Board or Force policy is vague or ambiguous; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808913" lims:id="808913"><Label>(c)</Label><Text>the relevant law is contradictory, or the relevant Treasury Board or Force policy is contradictory or internally inconsistent.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808914" lims:id="808914"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808915" lims:id="808915">Chairperson</MarginalNote><Label>(3)</Label><Text>The designated person must designate one of the three persons to be the chairperson of the panel. The chairperson is responsible for its day-to-day management, including the management of communications between the panel and the OCGA and the panel and the parties.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808916" lims:id="808916"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808917" lims:id="808917">Panel decision</MarginalNote><Label>(4)</Label><Text>Matters before a panel are decided by a majority of the members of the panel. The chairperson has a second vote in the case of a tie.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="808918" lims:id="808918" level="2"><TitleText>Presentation of Grievance</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808919" lims:id="808919"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808920" lims:id="808920">Initial level grievance</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808921" lims:id="808921"><Label>(1)</Label><Text>A grievor presents a grievance at the initial level by filing a grievance form with the OCGA or the grievor’s supervisor that includes the following information:</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808922" lims:id="808922"><Label>(a)</Label><Text>the grievor’s name and employee number;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808923" lims:id="808923"><Label>(b)</Label><Text>particulars concerning the decision, act or omission that is the subject of the grievance and the name of the person the grievor believes made the decision, did the act or made the omission;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808924" lims:id="808924"><Label>(c)</Label><Text>the date on which the grievor knew of the decision, act or omission;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808925" lims:id="808925"><Label>(d)</Label><Text>a concise statement of the grounds on which the grievance is based;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808926" lims:id="808926"><Label>(e)</Label><Text>particulars concerning the prejudice the grievor claims to have suffered as a result of the decision, act or omission; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808927" lims:id="808927"><Label>(f)</Label><Text>particulars concerning the redress requested.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808928" lims:id="808928"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808929" lims:id="808929">Final level grievance</MarginalNote><Label>(2)</Label><Text>A grievor presents a grievance at the final level by filing with the OCGA or the grievor’s supervisor</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808930" lims:id="808930"><Label>(a)</Label><Text>a grievance form that includes the following information:</Text><Subparagraph lims:inforce-start-date="2014-11-28" lims:fid="808931" lims:id="808931"><Label>(i)</Label><Text>the reasons why the grievor is presenting the grievance at the final level and, in particular, the reasons why the decision rendered by the adjudicator at the initial level contravenes the principles of procedural fairness, is based on an error of law or is clearly unreasonable, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2014-11-28" lims:fid="808932" lims:id="808932"><Label>(ii)</Label><Text>particulars concerning the redress requested; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808933" lims:id="808933"><Label>(b)</Label><Text>a copy of the decision rendered by the adjudicator at the initial level as to the disposition of the grievance.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808934" lims:id="808934"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808935" lims:id="808935">Transmission of grievance</MarginalNote><Label>(3)</Label><Text>A supervisor presented with a grievance form must forward it, together with any request submitted under subsection <XRefInternal>8</XRefInternal>(1), to the OCGA as soon as feasible.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808936" lims:id="808936"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808937" lims:id="808937">Transmission of copy of grievance</MarginalNote><Label>(4)</Label><Text>The OCGA must forward a copy of any grievance form that it receives to the respondent and to the person who holds the first position of officer or its equivalent in the respondent’s chain of command, or to the person named in the decision rendered under subsection <XRefInternal>8</XRefInternal>(3).</Text></Subsection></Section><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808938" lims:id="808938"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808939" lims:id="808939">Request to not forward</MarginalNote><Label>8</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808940" lims:id="808940"><Label>(1)</Label><Text>A grievor who wishes to object to a copy of the grievance form referred to in subsection <XRefInternal>7</XRefInternal>(1) being forwarded to the person who holds the first position of officer or its equivalent in the respondent’s chain of command must, when they present their grievance, submit to the OCGA a written request not to forward it that includes supporting reasons.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808941" lims:id="808941"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808942" lims:id="808942">Transmission of request</MarginalNote><Label>(2)</Label><Text>The OCGA must forward the request and a copy of the grievance form to the adjudicator who is considering the grievance.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808943" lims:id="808943"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808944" lims:id="808944">Decision on request</MarginalNote><Label>(3)</Label><Text>The adjudicator must render a decision on the request, including reasons for the decision, as soon as feasible, and send the decision to the OCGA. If the adjudicator allows the request, they must name in the decision an appropriate person for the purpose of receiving a copy of the grievance form.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808945" lims:id="808945"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808946" lims:id="808946">Service of decision</MarginalNote><Label>(4)</Label><Text>The OCGA must cause a copy of the adjudicator’s decision to be served on the parties.</Text></Subsection></Section><Heading lims:inforce-start-date="2014-11-28" lims:fid="808947" lims:id="808947" level="2"><TitleText>Informal Resolution</TitleText></Heading><Section lims:inforce-start-date="2014-11-28" lims:lastAmendedDate="2014-11-28" lims:fid="808948" lims:id="808948"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808949" lims:id="808949">Informal resolution</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808950" lims:id="808950"><Label>(1)</Label><Text>As soon as feasible after receiving a copy of a grievance form, the respondent must contact the grievor to discuss an informal resolution of the grievance.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808951" lims:id="808951"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808952" lims:id="808952">Refusal to discuss grievance</MarginalNote><Label>(2)</Label><Text>If the grievor refuses to discuss the grievance, or any aspect of it, with a view to resolving it informally, the respondent must provide written notice of that fact to the OCGA and cause a copy of it to be served on the grievor.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808953" lims:id="808953"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808954" lims:id="808954">Continuing resolution</MarginalNote><Label>(3)</Label><Text>The parties may, until the adjudicator disposes of the grievance in writing, continue to attempt to resolve the matters in dispute by way of an informal resolution process.</Text></Subsection><Subsection lims:inforce-start-date="2014-11-28" lims:fid="808955" lims:id="808955"><MarginalNote lims:inforce-start-date="2014-11-28" lims:fid="808956" lims:id="808956">Agreements for informal resolution</MarginalNote><Label>(4)</Label><Text>On request by a party, the adjudicator who is considering a grievance may</Text><Paragraph lims:inforce-start-date="2014-11-28" lims:fid="808957" lims:id="808957"><Label>(a)</Label><Text>review a proposed agreement for the informal resolution of rise to the appeal is served on the member who is the subject of that decision.
