(<DefinedTermFr>remplaçant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-04-10" lims:fid="792106" lims:id="792106" generate-in-text="no"><Text><DefinedTermEn>opting employee</DefinedTermEn> means an indeterminate employee whose work unit is relocated and who does not wish to relocate or whose services are no longer required by reason of lack of work, the discontinuance of a function or the transfer of work or a function outside the public service and who has not received a guarantee of a reasonable job offer. (<DefinedTermFr>fonctionnaire optant</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2012-04-10" lims:fid="792107" lims:id="792107" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2017-11-24" lims:lastAmendedDate="2017-11-24" lims:fid="792108" lims:id="792108"><Label>2</Label><Text>These Regulations apply to an alternate who is excluded from the application of section 16, paragraph 22(2)(a), subsection 29(3), sections 30, 31 and 39.1 to 48, subsection 51(4) and section 77 of the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal>.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-11-24" lims:fid="792110" lims:id="792110">SOR/2017-252, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2012-04-10" lims:fid="792111" lims:id="792111" level="1"><TitleText>Alternates</TitleText></Heading><Section lims:inforce-start-date="2012-04-10" lims:lastAmendedDate="2012-04-10" lims:fid="792112" lims:id="792112"><Label>3</Label><Text>An alternate must submit an irrevocable resignation from employment in the public service that is accepted by the deputy head and that is to take effect no later than five days after the day on which they are appointed or deployed to the position of the opting employee.</Text></Section><Section lims:inforce-start-date="2012-04-10" lims:lastAmendedDate="2012-04-10" lims:fid="792113" lims:id="792113"><Label>4</Label><Text>An alternate must not perform the duties of the position of the opting employee.</Text></Section><Section lims:inforce-start-date="2012-04-10" lims:lastAmendedDate="2012-04-10" lims:fid="792114" lims:id="792114"><Label>5</Label><Text>An alternate ceases to be an employee in the public service on the day on which the irrevocable resignation takes effect.</Text></Section><Heading lims:inforce-start-date="2012-04-10" lims:fid="792115" lims:id="792115" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2012-04-10" lims:lastAmendedDate="2012-04-10" lims:fid="792116" lims:id="792116"><Label>6</Label><Text>These Regulations come into force on the day on which they are registered.</Text></Section></Body></Regulation>
