Act</XRefExternal><FootnoteRef idref="fn_81000-2-1355-E-2012-05-15-v2_hq_12436">a</FootnoteRef>, the Minister has received that resolution;</Text><Footnote id="fn_81000-2-1355-E-2012-05-15-v2_hq_12436" placement="page" status="official"><Label>a</Label><Text>S.C. 2005, c. 53</Text></Footnote></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="788733" lims:id="788733" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas the Haisla Nation is a First Nation within the meaning of the <XRefExternal reference-type="act" link="F-11.64">First Nations Commercial and Industrial Development Act</XRefExternal><FootnoteRef idref="fn_81000-2-1355-E-2012-05-15-v2_hq_12436">a</FootnoteRef>;</Text></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="788734" lims:id="788734" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas jurisprudence in relation to the <XRefExternal reference-type="act" link="const">Constitution Act, 1867</XRefExternal><FootnoteRef idref="fn_81000-2-1355-E-2012-05-14_hq_12427">b</FootnoteRef> leaves some uncertainty with respect to the application of some provincial laws to reserve lands, and the intention of the annexed Regulations is to ensure that certain laws set out in Schedule 2 to those Regulations apply as federal law to the project lands, within the limits of federal constitutional authority;</Text><Footnote id="fn_81000-2-1355-E-2012-05-14_hq_12427" placement="page" status="official"><Label>b</Label><Text>30 &amp; 31 Vict., c. 3 (U.K.)</Text></Footnote></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="788735" lims:id="788735" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas the annexed Regulations specify provincial officials by whom, and provincial bodies by which, powers may be exercised or duties must be performed;</Text></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="788736" lims:id="788736" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And whereas in accordance with paragraph 5(1)(b) of the <XRefExternal reference-type="act" link="F-11.64">First Nations Commercial and Industrial Development Act</XRefExternal><FootnoteRef idref="fn_81000-2-1355-E-2012-05-15-v2_hq_12436">a</FootnoteRef> an agreement has been concluded between the Minister of Indian Affairs and Northern Development, the Province of British Columbia and the council of the Haisla Nation for the administration and enforcement of the Regulations by those provincial officials and bodies;</Text></Provision><Provision lims:inforce-start-date="2012-12-14" lims:fid="788737" lims:id="788737" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to section 3<FootnoteRef idref="fn_81000-2-1355-E-2012-05-22-clean_hq_12487">c</FootnoteRef> of the <XRefExternal reference-type="act" link="F-11.64">First Nations Commercial and Industrial Development lims:inforce-start-date="2012-12-14" lims:fid="788748" lims:id="788748" level="1"><TitleText>Application of Laws</TitleText></Heading><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788749" lims:id="788749"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788750" lims:id="788750">Incorporation by reference</MarginalNote><Label>4</Label><Text>Subject to section 5, the incorporated laws apply to the project lands.</Text></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788751" lims:id="788751"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788752" lims:id="788752">Restriction</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788753" lims:id="788753"><Label>(1)</Label><Text>A provision of an incorporated law applies only if the provision of the law of British Columbia that it incorporates is in force.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788754" lims:id="788754"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788755" lims:id="788755">Restriction</MarginalNote><Label>(2)</Label><Text>For greater certainty, an incorporated law applies only to the extent that it is within the limits of federal constitutional authority.</Text></Subsection></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788756" lims:id="788756"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788757" lims:id="788757">Incorporation of procedural matters</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788758" lims:id="788758"><Label>(1)</Label><Text>Unless otherwise provided and subject to any adaptations set out in sections <XRefInternal>13</XRefInternal> to <XRefInternal>43</XRefInternal>, the following are to be carried out in accordance with the laws of British Columbia, whether or not those laws have been set out in Schedule 2:</Text><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788759" lims:id="788759"><Label>(a)</Label><Text>the enforcement of incorporated laws;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788760" lims:id="788760"><Label>(b)</Label><Text>the prosecution of an offence, or any other proceedings, in relation to the contravention of an incorporated law;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788761" lims:id="788761"><Label>(c)</Label><Text>the review or appeal of an action or decision taken, or of a failure to take an action that could have been taken, under an incorporated law;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788762" lims:id="788762"><Label>(d)</Label><Text>any requirements for notice or service in relation to an action to be taken under an incorporated law.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788763" lims:id="788763"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788764" lims:id="788764">Related powers</MarginalNote><Label>(2)</Label><Text>For the purposes of subsection (1), a person or body that has a power, duty or function under a law of British Columbia has the same power, duty or function in respect of any actions taken under that subsection.</Text></Subsection></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788765" lims:id="788765"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788766" lims:id="788766">Offences and penalties</MarginalNote><Label>7</Label><Text>If contravention of a law of British Columbia that is incorporated in these Regulations is an offence under the laws of British Columbia, contravention of the incorporated law is also an offence and is subject to the same penalties as under the laws of British Columbia.</Text></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788767" lims:id="788767"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788768" lims:id="788768">Financial requirements under lease</MarginalNote><Label>8</Label><Text>If the incorporated laws require a cash deposit or other financial security to be given, those requirements do not displace, but instead apply in addition to, the requirements of any lease of the project lands in relation to cash deposits or other financial security.</Text></Section><Heading lims:inforce-start-date="2012-12-14" lims:fid="788769" lims:id="788769" level="1"><TitleText>Inapplicable Federal Regulations</TitleText></Heading><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788770" lims:id="788770"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788771" lims:id="788771">Exclusion</MarginalNote><Label>9</Label><Text>The <XRefExternal reference-type="regulation" link="C.R.C.,_c._960">Indian Reserve Waste Disposal Regulations</XRefExternal> do not apply to the project lands.</Text></Section><Heading lims:inforce-start-date="2012-12-14" lims:fid="788772" lims:id="788772" level="1"><TitleText>Construction Standards</TitleText></Heading><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788773" lims:id="788773"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788774" lims:id="788774">Conformity with British Columbia standards</MarginalNote><Label>10</Label><Text>Construction of and alterations to buildings on the project lands must be done in accordance with the <XRefExternal reference-type="other">British Columbia Building Code</XRefExternal> and <XRefExternal reference-type="other">British Columbia Fire Code</XRefExternal>, as amended from time to time.</Text></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788775" lims:id="788775"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788776" lims:id="788776">Occupancy permit</MarginalNote><Label>11</Label><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788777" lims:id="788777"><Label>(1)</Label><Text>No building on the project lands is to be occupied unless the Haisla Nation, or a person authorized by the Haisla Nation, has issued an occupancy permit for that building.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788778" lims:id="788778"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788779" lims:id="788779">Occupancy permit</MarginalNote><Label>(2)</Label><Text>The Haisla Nation, or a person authorized by the Haisla Nation, must issue an occupancy permit for a building within 15 days after it receives written confirmation by a person registered or licensed as a professional engineer under the <XRefExternal reference-type="act">Engineers and Geoscientists Act</XRefExternal> (R.S.B.C. 1996, c. 116) that the building was constructed in accordance with section 10.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-12-14" lims:fid="788780" lims:id="788780" level="1"><TitleText>Transitional Provision</TitleText></Heading><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788781" lims:id="788781"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788782" lims:id="788782">Survival of rights</MarginalNote><Label>12</Label><Text>Any permits, authorizations, orders or exemptions — including any amendments to them — issued by the British Columbia Oil and Gas Commission in relation to the project lands prior to the coming into force of these Regulations are considered to have been issued under these Regulations and to be valid for the purposes of these Regulations.</Text></Section><Heading lims:inforce-start-date="2012-12-14" lims:fid="788783" lims:id="788783" level="1"><TitleText>Adaptations Applicable to All Incorporated Laws</TitleText></Heading><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788784" lims:id="788784"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788785" lims:id="788785">British Columbia statutes and regulations</MarginalNote><Label>13</Label><Text>Unless otherwise indicated, the statutes and regulations referred to in sections <XRefInternal>18</XRefInternal> to <XRefInternal>43</XRefInternal> are statutes and regulations of British Columbia.</Text></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788786" lims:id="788786"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788787" lims:id="788787">Interpretation of incorporated laws</MarginalNote><Label>14</Label><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788788" lims:id="788788"><Label>(1)</Label><Text>The incorporated laws are to be read without reference to any of the following:</Text><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788789" lims:id="788789"><Label>(a)</Label><Text>spent provisions and provisions making consequential amendments to other enactments that are not incorporated laws;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788790" lims:id="788790"><Label>(b)</Label><Text>provisions appointing a person, providing for the remuneration of a person, or establishing or continuing a provincial body, program or fund;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788791" lims:id="788791"><Label>(c)</Label><Text>provisions relating to the internal management of a provincial body;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788792" lims:id="788792"><Label>(d)</Label><Text>provisions requiring or authorizing monies to be paid from the Consolidated Revenue Fund of British Columbia;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788793" lims:id="788793"><Label>(e)</Label><Text>provisions authorizing the Lieutenant-Governor in Council, a Minister or a provincial body to make regulations of general application, except to the extent required to make the regulations set out in Schedule 2.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788794" lims:id="788794"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788795" lims:id="788795">Interpretation of incorporated laws</MarginalNote><Label>(2)</Label><Text>Despite paragraph (1)(b),</Text><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788796" lims:id="788796"><Label>(a)</Label><Text>a person appointed to a position under a law of British Columbia that has been incorporated by reference in these Regulations is considered to have been appointed to the same position for the purposes of these Regulations, for so long as that person remains in that position under the law of British Columbia; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-14" lims:fid="788797" lims:id="788797"><Label>(b)</Label><Text>a provincial body, program or fund established or continued under a law of British Columbia that has been incorporated by reference in these Regulations is considered to have been established or continued for the purposes of these Regulations.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788798" lims:id="788798"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788799" lims:id="788799">Specified officials and bodies</MarginalNote><Label>(3)</Label><Text>For greater certainty, a person or body that has a power, duty or function under a law of British Columbia incorporated by reference in these Regulations has the same power, duty or function under these Regulations, subject to the adaptations set out in sections <XRefInternal>18</XRefInternal> to <XRefInternal>43</XRefInternal>.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788800" lims:id="788800"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788801" lims:id="788801">Interpretation of adapted laws</MarginalNote><Label>(4)</Label><Text>For greater certainty, if a law of British Columbia is adapted by these Regulations, a reference to that law in an incorporated law or in any notice, form, instrument or other document issued under an incorporated law is to be read as a reference to that law as adapted by these Regulations.</Text></Subsection></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788802" lims:id="788802"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788803" lims:id="788803">Exclusion</MarginalNote><Label>15</Label><Text>Unless otherwise provided by these Regulations, a provision of an incorporated law that imposes an obligation, liability or penalty on an owner, occupier, public authority, public body or unspecified person or entity does not apply to Her Majesty in right of Canada or federal ministers or officials.</Text></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788804" lims:id="788804"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788805" lims:id="788805">Limitation on searches and inspections</MarginalNote><Label>16</Label><Text>A power to search or make inspections under an incorporated law, including the power to enter a place, does not include a power to enter or search, or to inspect anything in, a federal government office, without the consent of the person who is or appears to be in charge of that office.</Text></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788806" lims:id="788806"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788807" lims:id="788807">Limitation on production of documents</MarginalNote><Label>17</Label><Text>A power to seize, remove or compel the production of documents under an incorporated law does not include a power to seize, remove or compel the production of a document in the possession of the federal government, without the consent of the person in possession of the document.</Text></Section><Heading lims:inforce-start-date="2012-12-14" lims:fid="788808" lims:id="788808" level="1"><TitleText>Adaptations to the Environmental Management Act and Regulations</TitleText></Heading><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788809" lims:id="788809"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788810" lims:id="788810">Municipalities</MarginalNote><Label>18</Label><Text>The <XRefExternal reference-type="act">Environmental Management Act</XRefExternal> and the regulations made under it set out in Schedule 2 are to be read without reference to any powers conferred on a municipality or an employee of a municipality.</Text></Section><Heading lims:inforce-start-date="2012-12-14" lims:fid="788811" lims:id="788811" level="2"><TitleText><XRefExternal reference-type="act">Environmental Management Act</XRefExternal></TitleText></Heading><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788812" lims:id="788812"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788813" lims:id="788813">Adaptation to Part 4</MarginalNote><Label>19</Label><Text>For the purposes of Part 4 of the <XRefExternal reference-type="act">Environmental Management Act</XRefExternal>, the standard to be applied for remediation is a standard consistent with industrial land use.</Text></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788814" lims:id="788814"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788815" lims:id="788815">Adaptation to section 40(1)(b)</MarginalNote><Label>20</Label><Text>In section 40(1)(b) of the Act, a reference to “the applicable municipality” is to be read as a reference to “the director”.</Text></Section><Section lims:inforce-start-date="2012-12-14" lims:lastAmendedDate="2012-12-14" lims:fid="788816" lims:id="788816"><MarginalNote lims:inforce-start-date="2012-12-14" lims:fid="788817" lims:id="788817">Adaptation to section 55(6)</MarginalNote><Label>21</Label><Text>Section 55(6) of the Act is to be read as follows:</Text><ReadAsText lims:inforce-start-date="2012-12-14" lims:fid="788818" lims:id="788818"><Subsection lims:inforce-start-date="2012-12-14" lims:fid="788819" lims:id="788819"><Label>(6)</Label><Text>Her Majesty in right of Canada and Her Ministers and officials, and the Haisla Nation and its council and employees, do not incur any liability and are not to be considered a responsible person under this Act as a result of any bylaw, law, permit, license, approval or other document adopted or issued
