and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785841" lims:id="785841"><Label>(b)</Label><Text>in the case of counsel for a claimant or protected person, if the counsel is a person referred to in any of paragraphs 91(2)(a) to (c) of the Act, in addition to the information referred to in paragraph (a), the name of the body of which the counsel is a member and the membership identification number issued to the counsel. (<DefinedTermFr>coordonnées</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2012-12-15" lims:fid="785842" lims:id="785842" generate-in-text="no"><Text><DefinedTermEn>Division</DefinedTermEn> means the Refugee Protection Division. (<DefinedTermFr>Section</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-12-15" lims:fid="785843" lims:id="785843" generate-in-text="no"><Text><DefinedTermEn>officer</DefinedTermEn> means a person designated as an officer by the Minister under subsection 6(1) of the Act. (<DefinedTermFr>agent</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-12-15" lims:fid="785844" lims:id="785844" generate-in-text="no"><Text><DefinedTermEn>party</DefinedTermEn> means,</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785845" lims:id="785845"><Label>(a)</Label><Text>in the case of a claim for refugee protection, the claimant and, if the Minister intervenes in the claim, the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785846" lims:id="785846"><Label>(b)</Label><Text>in the case of an application to vacate or to cease refugee protection, the protected person and the Minister. (<DefinedTermFr>partie</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2012-12-15" lims:fid="785847" lims:id="785847" generate-in-text="no"><Text><DefinedTermEn>proceeding</DefinedTermEn> includes a conference, an application or a hearing. (<DefinedTermFr>procédure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-12-15" lims:fid="785848" lims:id="785848" generate-in-text="no"><Text><DefinedTermEn>registry office</DefinedTermEn> means a business office of the Division. (<DefinedTermFr>greffe</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-12-15" lims:fid="785849" lims:id="785849" generate-in-text="no"><Text><DefinedTermEn>Regulations</DefinedTermEn> means the <XRefExternal reference-type="regulation" link="SOR-2002-227">Immigration and Refugee Protection Regulations</XRefExternal>. (<DefinedTermFr>Règlement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-12-15" lims:fid="785850" lims:id="785850" generate-in-text="no"><Text><DefinedTermEn>vulnerable person</DefinedTermEn> means a person who has been identified as vulnerable under the <XRefExternal reference-type="other">Guideline on Procedures with Respect to Vulnerable Persons Appearing Before the IRB</XRefExternal> issued under paragraph 159(1)(h) of the Act. (<DefinedTermFr>personne vulnérable</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2012-12-15" lims:fid="785851" lims:id="785851" generate-in-text="no"><Text><DefinedTermEn>working day</DefinedTermEn> does not include Saturdays, Sundays or other days on which the Board offices are closed. (<DefinedTermFr>jour ouvrable</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2012-11-30" lims:fid="785852" lims:id="785852" level="1"><TitleText>Communicating with the Division</TitleText></Heading><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="785853" lims:id="785853"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785854" lims:id="785854">Communicating with Division</MarginalNote><Label>2</Label><Text>All communication with the Division must be directed to the registry office specified by the Division.</Text></Section><Heading lims:inforce-start-date="2012-11-30" lims:fid="785855" lims:id="785855" level="1"><TitleText>Information and Documents to Be Provided</TitleText></Heading><Heading lims:inforce-start-date="2012-11-30" lims:fid="785856" lims:id="785856" level="2"><TitleText>Claims for Refugee Protection</TitleText></Heading><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="785857" lims:id="785857"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785858" lims:id="785858">Fixing date, time and location of hearing</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785859" lims:id="785859"><Label>(1)</Label><Text>As soon as a claim for refugee protection is referred to the Division, or as soon as possible before it is deemed to be referred under subsection 100(3) of the Act, an officer must fix a date, time and location for the claimant to attend a hearing on the claim, within the time limits set out in the Regulations, from the dates, times and locations provided by the Division.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785860" lims:id="785860"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785861" lims:id="785861">Date fixed by officer</MarginalNote><Label>(2)</Label><Text>Subject to paragraph 3(b), the officer must select the date closest to the last day of the applicable time limit set out in the Regulations, unless the claimant agrees to an earlier date.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785862" lims:id="785862"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785863" lims:id="785863">Factors</MarginalNote><Label>(3)</Label><Text>In fixing the date, time and location for the hearing, the officer must consider</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785864" lims:id="785864"><Label>(a)</Label><Text>the claimant’s preference of location; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785865" lims:id="785865"><Label>(b)</Label><Text>counsel’s availability, if the claimant has retained counsel at the time of referral and the officer has been informed that counsel will be available to attend a hearing on one of the dates provided by the Division.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785866" lims:id="785866"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785867" lims:id="785867">Providing information to claimant in writing</MarginalNote><Label>(4)</Label><Text>The officer must</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785868" lims:id="785868"><Label>(a)</Label><Text>notify the claimant in writing by way of a notice to appear</Text><Subparagraph lims:inforce-start-date="2012-12-15" lims:fid="785869" lims:id="785869"><Label>(i)</Label><Text>of the date, time and location of the hearing of the claim; and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-12-15" lims:fid="785870" lims:id="785870"><Label>(ii)</Label><Text>of the date, time and location of any special hearing on the abandonment of the claim under subrules 65(2) and (3);</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785871" lims:id="785871"><Label>(b)</Label><Text>unless the claimant has provided a completed Basis of Claim Form to the officer in accordance with subsection 99(3.1) of the Act, provide to the claimant the Basis of Claim Form; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785872" lims:id="785872"><Label>(c)</Label><Text>provide to the claimant information in writing</Text><Subparagraph lims:inforce-start-date="2012-12-15" lims:fid="785873" lims:id="785873"><Label>(i)</Label><Text>explaining how and when to provide a Basis of Claim Form and other documents to the Division and to the Minister,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-12-15" lims:fid="785874" lims:id="785874"><Label>(ii)</Label><Text>informing the claimant of the importance of obtaining relevant documentary evidence without delay,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-12-15" lims:fid="785875" lims:id="785875"><Label>(iii)</Label><Text>explaining how the hearing will proceed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-12-15" lims:fid="785876" lims:id="785876"><Label>(iv)</Label><Text>informing the claimant of the obligation to notify the Division and the Minister of the claimant’s contact information and any changes to that information,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-12-15" lims:fid="785877" lims:id="785877"><Label>(v)</Label><Text>informing the claimant that they may, at their own expense, be represented by legal or other counsel, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-12-15" lims:fid="785878" lims:id="785878"><Label>(vi)</Label><Text>informing the claimant that the claim may be declared abandoned without further notice if the claimant fails to provide the completed Basis of Claim Form or fails to appear at the hearing.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785879" lims:id="785879"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785880" lims:id="785880">Providing information in writing and documents to Division</MarginalNote><Label>(5)</Label><Text>After providing to the claimant the information set out in subrule (4), the officer must without delay provide to the Division</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785881" lims:id="785881"><Label>(a)</Label><Text>a written statement indicating how and when the information set out in subrule (4) was provided to the claimant;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785882" lims:id="785882"><Label>(b)</Label><Text>the completed Basis of Claim Form for a claimant referred to in subsection 99(3.1) of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785883" lims:id="785883"><Label>(c)</Label><Text>a copy of each notice to appear provided to the claimant in accordance with paragraph (4)(a);</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785884" lims:id="785884"><Label>(d)</Label><Text>the information set out in Schedule 2;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785885" lims:id="785885"><Label>(e)</Label><Text>a copy of any identity and travel documents of the claimant that have been seized by the officer;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785886" lims:id="785886"><Label>(f)</Label><Text>a copy of the notice of seizure of any seized documents referred to in paragraph (e); and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785887" lims:id="785887"><Label>(g)</Label><Text>a copy of any other relevant documents that are in the possession of the officer.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785888" lims:id="785888"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785889" lims:id="785889">Providing copies to claimant</MarginalNote><Label>(6)</Label><Text>The officer must provide to the claimant a copy of any documents or information that the officer has provided to the Division under paragraphs (5)(d) to (g).</Text></Subsection></Section><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="785890" lims:id="785890"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785891" lims:id="785891">Claimant’s contact information</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785892" lims:id="785892"><Label>(1)</Label><Text>The claimant must provide their contact information in writing to the Division and to the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785893" lims:id="785893"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785894" lims:id="785894">Time limit</MarginalNote><Label>(2)</Label><Text>The claimant’s contact information must be received by the Division and the Minister no later than 10 days after the day on which the claimant receives the information provided by the officer under subrule 3(4).</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785895" lims:id="785895"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785896" lims:id="785896">Change to contact information</MarginalNote><Label>(3)</Label><Text>If the claimant’s contact information changes, the claimant must without delay provide the changes in writing to the Division and to the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785897" lims:id="785897"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785898" lims:id="785898">Information concerning claimant’s counsel</MarginalNote><Label>(4)</Label><Text>A claimant who is represented by counsel must without delay, on retaining counsel, provide the counsel’s contact information in writing to the Division and to the Minister and notify them of any limitations on the counsel’s retainer. If that information changes, the claimant must without delay provide the changes in writing to the Division and to the Minister.</Text></Subsection></Section><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="785899" lims:id="785899"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785900" lims:id="785900">Declaration — counsel not representing or advising for consideration</MarginalNote><Label>5</Label><Text>If a claimant retains counsel who is not a person referred to in any of paragraphs 91(2)(a) to (c) of the Act, both the claimant and their counsel must without delay provide the information and declarations set out in Schedule 3 to the Division in writing.</Text></Section><Heading lims:inforce-start-date="2012-11-30" lims:fid="785901" lims:id="785901" level="2"><TitleText>Basis of Claim Form</TitleText></Heading><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="785902" lims:id="785902"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785903" lims:id="785903">Claimant’s declarations</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785904" lims:id="785904"><Label>(1)</Label><Text>The claimant must complete a Basis of Claim Form and sign and date the declaration set out in the form stating that</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785905" lims:id="785905"><Label>(a)</Label><Text>the information given by the claimant is complete, true and correct; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785906" lims:id="785906"><Label>(b)</Label><Text>the claimant understands that the declaration is of the same force and effect as if made under oath.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785907" lims:id="785907"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785908" lims:id="785908">Form completed without interpreter</MarginalNote><Label>(2)</Label><Text>If the claimant completes the Basis of Claim Form without an interpreter’s assistance, the claimant must sign and date the declaration set out in the form stating that they can read the language of the form and understand what information is requested.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785909" lims:id="785909"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785910" lims:id="785910">Interpreter’s declaration</MarginalNote><Label>(3)</Label><Text>If the claimant completes the Basis of Claim Form with an interpreter’s assistance, the interpreter must sign and date the declaration in the form stating that</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785911" lims:id="785911"><Label>(a)</Label><Text>they are proficient in the language and dialect, if any, used, and were able to communicate effectively with the claimant;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785912" lims:id="785912"><Label>(b)</Label><Text>the completed Basis of Claim Form and all attached documents were interpreted to the claimant; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="785913" lims:id="785913"><Label>(c)</Label><Text>the claimant indicated that the claimant understood what was interpreted.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="785914" lims:id="785914"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785915" lims:id="785915">Providing Basis of Claim Form — inland claim</MarginalNote><Label>7</Label><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785916" lims:id="785916"><Label>(1)</Label><Text>A claimant referred to in subsection 99(3.1) of the Act must provide the original and a copy of the completed Basis of Claim Form to the officer referred to in rule 3.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785917" lims:id="785917"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785918" lims:id="785918">Providing Basis of Claim Form — port of entry claim</MarginalNote><Label>(2)</Label><Text>A claimant other than a claimant referred to in subsection 99(3.1) of the Act must provide the original and a copy of the completed Basis of Claim Form to the Division.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="785919" lims:id="785919"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="785920" lims:id="785920">Documents to be attached</MarginalNote><Label>(3)</Label><Text>The claimant must attach to the original and to the copy of the completed Basis of Claim Form a copy of their identity and travel documents, genuine or not, and a copy of any other relevant documents in their possession. and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786038" lims:id="786038"><Label>(c)</Label><Text>the reasons why counsel or the officer believes that a representative should be designated.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786039" lims:id="786039"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786040" lims:id="786040">Requirements for being designated</MarginalNote><Label>(4)</Label><Text>To be designated as a representative, a person must</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786041" lims:id="786041"><Label>(a)</Label><Text>be 18 years of age or older;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786042" lims:id="786042"><Label>(b)</Label><Text>understand the nature of the proceedings;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786043" lims:id="786043"><Label>(c)</Label><Text>be willing and able to act in the best interests of the claimant or protected person; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786044" lims:id="786044"><Label>(d)</Label><Text>not have interests that conflict with those of the claimant or protected person.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786045" lims:id="786045"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786046" lims:id="786046">Factors</MarginalNote><Label>(5)</Label><Text>When determining whether a claimant or protected person is unable to appreciate the nature of the proceedings, the Division must consider any relevant factors, including</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786047" lims:id="786047"><Label>(a)</Label><Text>whether the person can understand the reason for the proceeding and can instruct counsel;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786048" lims:id="786048"><Label>(b)</Label><Text>the person’s statements and behaviour at the proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786049" lims:id="786049"><Label>(c)</Label><Text>expert evidence, if any, on the person’s intellectual or physical faculties, age or mental condition; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786050" lims:id="786050"><Label>(d)</Label><Text>whether the person has had a representative designated for a proceeding in another division of the Board.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786051" lims:id="786051"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786052" lims:id="786052">Designation applies to all proceedings</MarginalNote><Label>(6)</Label><Text>The designation of a representative for a person who is under 18 years of age or who is unable to appreciate the nature of the proceedings applies to all subsequent proceedings in the Division with respect to that person unless the Division orders otherwise.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786053" lims:id="786053"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786054" lims:id="786054">End of designation — person reaches 18 years of age</MarginalNote><Label>(7)</Label><Text>The designation of a representative for a person who is under 18 years of age ends when the person reaches 18 years of age unless that representative has also been designated because the person is unable to appreciate the nature of the proceedings.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786055" lims:id="786055"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786056" lims:id="786056">Termination of designation</MarginalNote><Label>(8)</Label><Text>The Division may terminate a designation if the Division is of the opinion that the representative is no longer required or suitable and may designate a new representative if required.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786057" lims:id="786057"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786058" lims:id="786058">Designation criteria</MarginalNote><Label>(9)</Label><Text>Before designating a person as a representative, the Division must</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786059" lims:id="786059"><Label>(a)</Label><Text>assess the person’s ability to fulfil the responsibilities of a designated representative; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786060" lims:id="786060"><Label>(b)</Label><Text>ensure that the person has been informed of the responsibilities of a designated representative.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786061" lims:id="786061"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786062" lims:id="786062">Responsibilities of representative</MarginalNote><Label>(10)</Label><Text>The responsibilities of a designated representative include</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786063" lims:id="786063"><Label>(a)</Label><Text>deciding whether to retain counsel and, if counsel is retained, instructing counsel or assisting the represented person in instructing counsel;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786064" lims:id="786064"><Label>(b)</Label><Text>making decisions regarding the claim or application or assisting the represented person in making those decisions;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786065" lims:id="786065"><Label>(c)</Label><Text>informing the represented person about the various stages and procedures in the processing of their case;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786066" lims:id="786066"><Label>(d)</Label><Text>assisting in gathering evidence to support the represented person’s case and in providing evidence and, if necessary, being a witness at the hearing;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786067" lims:id="786067"><Label>(e)</Label><Text>protecting the interests of the represented person and putting forward the best possible case to the Division;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786068" lims:id="786068"><Label>(f)</Label><Text>informing and consulting the represented person to the extent possible when making decisions about the case; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786069" lims:id="786069"><Label>(g)</Label><Text>filing and perfecting an appeal to the Refugee Appeal Division, if required.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2012-11-30" lims:fid="786070" lims:id="786070" level="1"><TitleText>Disclosure of Personal Information</TitleText></Heading><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="786071" lims:id="786071"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786072" lims:id="786072">Disclosure of information from another claim</MarginalNote><Label>21</Label><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786073" lims:id="786073"><Label>(1)</Label><Text>Subject to subrule (5), the Division may disclose to a claimant personal and other information that it wants to use from any other claim if the claims involve similar questions of fact or if the information is otherwise relevant to the determination of their claim.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786074" lims:id="786074"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786075" lims:id="786075">Notice to another claimant</MarginalNote><Label>(2)</Label><Text>If the personal or other information of another claimant has not been made public, the Division must make reasonable efforts to notify the other claimant in writing that</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786076" lims:id="786076"><Label>(a)</Label><Text>it intends to disclose the information to a claimant; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786077" lims:id="786077"><Label>(b)</Label><Text>the other claimant may object to that disclosure.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786078" lims:id="786078"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786079" lims:id="786079">Request for disclosure</MarginalNote><Label>(3)</Label><Text>In order to decide whether to object to the disclosure, the other claimant may make a written request to the Division for personal and other information relating to the claimant. If claims were once joined but were later separated, only personal or other information that was provided before the separation is not subject to this rule.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-11-30" lims:fid="786090" lims:id="786090" level="1"><TitleText>Specialized Knowledge</TitleText></Heading><Section lims:inforce-start-date="2012-12-15" lims:lastAmendedDate="2012-12-15" lims:fid="786091" lims:id="786091"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786092" lims:id="786092">Notice to parties</MarginalNote><Label>22</Label><Text>Before using any information or opinion that is within its specialized knowledge, the Division must notify the claimant or protected person and, if the paragraph 170(f) of the Act, the period during which the Minister must notify the Division of the Minister’s intention to intervene is no later than 10 days after the day on which the Minister lims:id="786125">Resumption of hearing</MarginalNote><Label>(4)</Label><Text>The Division must fix a date for the resumption of the hearing that is as soon as practicable,</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786126" lims:id="786126"><Label>(a)</Label><Text>if the Minister responds to the notice referred to in subrule (2), after receipt of the response from issues relating to the integrity of the Canadian refugee protection system may arise from the claim and the Division is of the opinion that the Minister’s participation may help in the full and proper hearing of the claim, the Division must adjourn the hearing and without delay notify the Minister in writing and provide any relevant information to the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786133" lims:id="786133"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786134" lims:id="786134">Integrity issues</MarginalNote><Label>(3)</Label><Text>For the purpose of this rule, claims in which the possibility that issues relating to the integrity of the Canadian refugee protection system may arise include those in which there is</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786135" lims:id="786135"><Label>(a)</Label><Text>information that the claim may have been made under a false identity in whole or in part;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786136" lims:id="786136"><Label>(b)</Label><Text>a substantial change to the basis of the claim from that indicated in the Basis of Claim Form first provided to the Division;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786137" lims:id="786137"><Label>(c)</Label><Text>information that, in support of the claim, the claimant submitted documents that may be fraudulent; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786138" lims:id="786138"><Label>(d)</Label><Text>other information that the claimant may be directly or indirectly misrepresenting or withholding material facts relating to a relevant matter.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786139" lims:id="786139"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786140" lims:id="786140">Disclosure to claimant</MarginalNote><Label>(4)</Label><Text>The Division must provide to the claimant a copy of any notice or information that the Division provides to the Minister.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786141" lims:id="786141"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786142" lims:id="786142">Resumption of hearing</MarginalNote><Label>(5)</Label><Text>The Division must fix a date for the resumption of the hearing that is as soon as practicable,</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786143" lims:id="786143"><Label>(a)</Label><Text>if the Minister responds to the notice referred to in subrule (2), after receipt of the response from the Minister; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786144" lims:id="786144"><Label>(b)</Label><Text>if the Subject to operational limitations, the Division must allow the application if</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786404" lims:id="786404"><Label>(a)</Label><Text>the claimant retains counsel no later than five working days after the day on which the hearing date was fixed by the officer;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786405" lims:id="786405"><Label>(b)</Label><Text>the counsel retained is not available on the date fixed for the hearing;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786406" lims:id="786406"><Label>(c)</Label><Text>the application is made in writing;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786407" lims:id="786407"><Label>(d)</Label><Text>the application is made without delay and no later than five working days after the day on which the hearing date was fixed by the officer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786408" lims:id="786408"><Label>(e)</Label><Text>the claimant provides at least three dates and times when counsel is available, which are within the time limits set out in the Regulations for the hearing of the claim.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786409" lims:id="786409"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786410" lims:id="786410">Application for medical reasons</MarginalNote><Label>(6)</Label><Text>If a claimant or protected person makes the application for medical reasons, other than those related to their counsel, they must provide, together with the application, a legible, recently dated medical certificate signed by a qualified medical practitioner whose name and address are printed or stamped on the certificate. A claimant or protected person who has provided a copy of the certificate to the Division must provide the original document to the Division without delay.</Text></Subsection><Subsection lims:inforce-start-date="2012-12-15" lims:fid="786411" lims:id="786411"><MarginalNote lims:inforce-start-date="2012-12-15" lims:fid="786412" lims:id="786412">Content of certificate</MarginalNote><Label>(7)</Label><Text>The medical certificate must set out</Text><Paragraph lims:inforce-start-date="2012-12-15" lims:fid="786413" lims:id="786413"><Label>(a)</Label><Text>the particulars of the medical condition, without specifying the diagnosis, that prevent the claimant or protected person from participating in the proceeding on the date fixed for the proceeding;
