matters</MarginalNote><Label>(2)</Label><Text>Any procedural matter or question that is not provided for in the Act, in these Rules or in any regulations made pursuant to the Act that arises in the course of any proceeding may be dealt with in any manner that the Board directs in order to ensure the fair and expeditious conduct of any proceeding.</Text></Subsection><Subsection lims:inforce-start-date="2012-11-23" lims:fid="785211" lims:id="785211"><MarginalNote lims:inforce-start-date="2012-11-23" lims:fid="785212" lims:id="785212">Board discretion</MarginalNote><Label>(3)</Label><Text>For the purpose of ensuring the fair and expeditious conduct of any proceeding, the Board may vary, supplement or dispense with any requirement set out in these Rules.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-11-23" lims:fid="785213" lims:id="785213" level="1"><TitleText>Procedure and Evidence</TitleText></Heading><Section lims:inforce-start-date="2012-11-23" lims:lastAmendedDate="2021-06-30" lims:fid="785214" lims:id="785214"><MarginalNote lims:inforce-start-date="2012-11-23" lims:fid="785215" lims:id="785215">Board powers</MarginalNote><Label>6</Label><Subsection lims:inforce-start-date="2012-11-23" lims:fid="785216" lims:id="785216"><Label>(1)</Label><Text>In relation to any proceeding, the Board may</Text><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785217" lims:id="785217"><Label>(a)</Label><Text>receive any evidence that it considers appropriate;</Text></Paragraph><Paragraph lims:inforce-start-date="2021-06-30" lims:enacted-date="2021-06-01" lims:fid="785218" lims:id="1311813"><Label>(b)</Label><Text>take notice of facts that may be judicially noticed and of any generally recognized scientific or technical facts, information or opinions concerning patented or protected medicines;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785219" lims:id="785219"><Label>(c)</Label><Text>add parties at any stage of the proceeding;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785220" may, at any time, direct</Text><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785224" lims:id="785224"><Label>(a)</Label><Text>that a party provide any information or documents, in paper or electronic format, that the Board considers concerned to any proceeding; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785225" proceeding before the Board in respect of any issue unless the issue has been raised in the pleadings or in a pre-hearing conference order or the expert witness evidence is called for the purpose of rebutting the evidence of an expert witness introduced by another party.</Text></Subsection><Subsection lims:inforce-start-date="2012-11-23" lims:fid="785234" lims:id="785234"><MarginalNote lims:inforce-start-date="2012-11-23" lims:fid="785235" lims:id="785235">Maximum number</MarginalNote><Label>(2)</Label><Text>More than two expert witnesses may not be called by a party, per issue, without leave of the Board.</Text></Subsection><Subsection lims:inforce-start-date="2012-11-23" lims:fid="785236" lims:id="785236"><MarginalNote lims:inforce-start-date="2012-11-23" lims:fid="785237" lims:id="785237">Report, declaration and availability</MarginalNote><Label>(3)</Label><Text>Every party who, in a proceeding before the Board, intends to introduce evidence given by an expert witness must</Text><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785238" lims:id="785238"><Label>(a)</Label><Text>file with the Secretary and serve on each of the parties in accordance with the Board’s schedule of events, an expert witness report that is supported by an affidavit and that must include</Text><Subparagraph lims:inforce-start-date="2012-11-23" lims:fid="785239" lims:id="785239"><Label>(i)</Label><Text>a statement of the issues addressed in the report,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-11-23" lims:fid="785240" lims:id="785240"><Label>(ii)</Label><Text>a description of the qualifications of the expert with respect to those issues,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-11-23" lims:fid="785241" lims:id="785241"><Label>(iii)</Label><Text>the expert’s curriculum vitae attached to the report as a schedule,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-11-23" lims:fid="785242" lims:id="785242"><Label>(iv)</Label><Text>the facts and assumptions on which the opinions in the report are based,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-11-23" lims:fid="785243" lims:id="785243"><Label>(v)</Label><Text>a summary of the opinions expressed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-11-23" lims:fid="785244" lims:id="785244"><Label>(vi)</Label><Text>in the case of a report provided in response to another expert’s report, an indication of the points of agreement and of disagreement with the other expert’s opinions,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-11-23" lims:fid="785245" lims:id="785245"><Label>(vii)</Label><Text>the reasons supporting each opinion expressed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-11-23" lims:fid="785246" lims:id="785246"><Label>(viii)</Label><Text>any literature or other documents specifically relied on in support of the opinions expressed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2012-11-23" lims:fid="785247" lims:id="785247"><Label>(ix)</Label><Text>a summary of the methodology on which the expert has relied;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785248" lims:id="785248"><Label>(b)</Label><Text>file with the Secretary and serve on each of the parties a signed Expert Witness Declaration in Form 1 set out in the schedule; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785249" lims:id="785249"><Label>(c)</Label><Text>ensure that the expert witness is available for examination and cross-examination at the hearing.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2012-11-23" lims:fid="785250" lims:id="785250"><MarginalNote lims:inforce-start-date="2012-11-23" lims:fid="785251" lims:id="785251">Duration of examination in chief</MarginalNote><Label>(4)</Label><Text>Examination in chief of any expert witness may not, without the Board’s consent, exceed 90 minutes.</Text></Subsection></Section><Heading lims:inforce-start-date="2012-11-23" lims:fid="785252" lims:id="785252" level="1"><TitleText>Time Limits</TitleText></Heading><Section lims:id="785254">Computation of time</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2012-11-23" lims:fid="785255" lims:id="785255"><Label>(1)</Label><Text>If a time limit set out in these Rules expires on a Saturday, Sunday or a holiday, the period is extended to the next business day.</Text></Subsection><Subsection lims:inforce-start-date="2012-11-23" lims:fid="785256" lims:id="785256"><MarginalNote lims:inforce-start-date="2012-11-23" lims:fid="785257" lims:id="785257">Deemed service</MarginalNote><Label>(2)</Label><Text>Any document that is served after 5:00 p.m. lims:fid="785261" lims:id="785261"><Label>(1)</Label><Text>Unless otherwise provided in these Rules, the giving of notice or the service of any document under these Rules must be effected</Text><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785262" lims:id="785262"><Label>(a)</Label><Text>by personal service in accordance with Rule 11;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785263" lims:id="785263"><Label>(b)</Label><Text>by courier, in which case service is deemed to have been made on the day of delivery of the document;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785264" lims:id="785264"><Label>(c)</Label><Text>by electronic transmission of a copy of the document to the address for service, in which case service is deemed to have been made on the day of transmission; or</Text></Paragraph><Paragraph lims:inforce-start-date="2012-11-23" lims:fid="785265" filed with the Board pursuant to these Rules or a direction of the Board, except in connection with <Language xml:lang="la">ex parte</Language> motions, the person who files the document must, concurrently with the filing, serve a copy of the document on every person who is, at the time of service, a party to the proceeding.</Text></Subsection><Subsection
