C-46</Text></Footnote></Provision></Order><Body lims:inforce-start-date="2008-07-02" lims:fid="745309" lims:id="745309"><Heading lims:inforce-start-date="2008-07-02" lims:fid="745310" lims:id="745310" level="1"><TitleText>Qualification Required of Evaluating Officer</TitleText></Heading><Section lims:inforce-start-date="2008-07-02" lims:lastAmendedDate="2008-07-02" lims:fid="745311" lims:id="745311"><Label>1</Label><Text>An evaluating officer must be a certified drug recognition expert accredited by the International Association of Chiefs of Police.</Text></Section><Heading lims:inforce-start-date="2008-07-02" lims:fid="745312" lims:id="745312" level="1"><TitleText>Physical Coordination Tests</TitleText></Heading><Section lims:inforce-start-date="2008-07-02" lims:lastAmendedDate="2008-07-02" lims:fid="745313" lims:id="745313"><Label>2</Label><Text>The physical coordination tests to be conducted under paragraph 254(2)(a) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> are the following standard field sobriety tests:</Text><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745314" lims:id="745314"><Label>(a)</Label><Text>the horizontal gaze nystagmus test;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745315" lims:id="745315"><Label>(b)</Label><Text>the walk-and-turn test; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745316" lims:id="745316"><Label>(c)</Label><Text>the one-leg stand test.</Text></Paragraph></Section><Heading lims:inforce-start-date="2008-07-02" lims:fid="745317" lims:id="745317" level="1"><TitleText>Evaluation Tests and Procedures</TitleText></Heading><Section lims:inforce-start-date="2008-07-02" lims:lastAmendedDate="2008-07-02" lims:fid="745318" lims:id="745318"><Label>3</Label><Text>The tests to be conducted and the procedures to be followed during an evaluation under subsection 254(3.1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> are</Text><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745319" lims:id="745319"><Label>(a)</Label><Text>a preliminary examination, which consists of measuring the pulse and determining that the pupils are the same size and that the eyes track an object equally;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745320" lims:id="745320"><Label>(b)</Label><Text>eye examinations, which consist of</Text><Subparagraph lims:inforce-start-date="2008-07-02" lims:fid="745321" lims:id="745321"><Label>(i)</Label><Text>the horizontal gaze nystagmus test,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-07-02" lims:fid="745322" lims:id="745322"><Label>(ii)</Label><Text>the vertical gaze nystagmus test, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-07-02" lims:fid="745323" lims:id="745323"><Label>(iii)</Label><Text>the lack-of-convergence test;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745324" lims:id="745324"><Label>(c)</Label><Text>divided-attention tests, which consist of</Text><Subparagraph lims:inforce-start-date="2008-07-02" lims:fid="745325" lims:id="745325"><Label>(i)</Label><Text>the Romberg balance test,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-07-02" lims:fid="745326" lims:id="745326"><Label>(ii)</Label><Text>the walk-and-turn test referred to in paragraph 2(b),</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-07-02" lims:fid="745327" lims:id="745327"><Label>(iii)</Label><Text>the one-leg stand test referred to in paragraph 2(c), and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-07-02" lims:fid="745328" lims:id="745328"><Label>(iv)</Label><Text>the finger-to-nose test, which includes the test subject tilting the head back and touching the tip of their index finger to the tip of their nose in a specified manner while keeping their eyes closed;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745329" lims:id="745329"><Label>(d)</Label><Text>an examination, which consists of measuring the blood pressure, temperature and pulse;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745330" lims:id="745330"><Label>(e)</Label><Text>an examination of pupil sizes under light levels of ambient light, near total darkness and direct light and an examination of the nasal and oral cavities;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745331" lims:id="745331"><Label>(f)</Label><Text>an examination, which consists of checking the muscle tone and pulse; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-07-02" lims:fid="745332" lims:id="745332"><Label>(g)</Label><Text>a visual examination of the arms, neck and, if exposed, the legs for evidence of injection sites.</Text></Paragraph></Section><Heading lims:inforce-start-date="2008-07-02" lims:fid="745333" lims:id="745333" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2008-07-02" lims:lastAmendedDate="2008-07-02" lims:fid="745334" lims:id="745334"><Label>4</Label><Text>These Regulations come into force on July 2, 2008.</Text></Section></Body></Regulation>
