Gazette</XRefExternal>, Part I, on May 26, 2007 and a reasonable opportunity was thereby afforded to interested persons to make representations to the Registrar with respect to the proposed level="2"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2008-05-01" lims:lastAmendedDate="2008-05-01" lims:fid="743821" lims:id="743821"><MarginalNote lims:inforce-start-date="2008-05-01" lims:fid="743822" lims:id="743822">Definitions</MarginalNote><Label>1</Label><Text>The following definitions apply in these Rules.</Text><Definition lims:inforce-start-date="2008-05-01" lims:fid="743823" lims:id="743823" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="C-34">Competition Act</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743824" lims:id="743824" generate-in-text="no"><Text><DefinedTermEn>applicant</DefinedTermEn> means a person who files an application under Part VII.1 or Part VIII of the Act or a person who files a reference under section 124.2 of the Act. (<DefinedTermFr>demandeur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743825" lims:id="743825" generate-in-text="no"><Text><DefinedTermEn>certified copy</DefinedTermEn> of a document means a copy of the document certified by the Registrar or a person designated by the Registrar. (<DefinedTermFr>copie certifiée</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743826" lims:id="743826" generate-in-text="no"><Text><DefinedTermEn>Chairperson</DefinedTermEn> means the judicial member designated to be Chairman of the Tribunal under subsection 4(1) of the <XRefExternal reference-type="act" link="C-36.4">Competition Tribunal Act</XRefExternal>. (<DefinedTermFr>président</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743827" lims:id="743827" generate-in-text="no"><Text><DefinedTermEn>Commissioner</DefinedTermEn> means the Commissioner of Competition appointed under subsection 7(1) of the Act. (<DefinedTermFr>commissaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743828" lims:id="743828" generate-in-text="no"><Text><DefinedTermEn>consent agreement</DefinedTermEn> means an agreement made under section 74.12, 105 or 106.1 of the Act, the terms of which have been agreed on by the parties. (<DefinedTermFr>consentement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743829" lims:id="743829" generate-in-text="no"><Text><DefinedTermEn>counsel</DefinedTermEn> means a member of the bar of a province. (<DefinedTermFr>avocat</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743830" lims:id="743830" generate-in-text="no"><Text><DefinedTermEn>document</DefinedTermEn> includes pleadings, affidavits and any correspondence, memorandum, book, plan, map, drawing, diagram, pictorial or graphic work, photograph, film, microform, sound recording, videotape, machine readable record, and any other documentary material, regardless of physical form or characteristics, and any copy or portion of that material. (<DefinedTermFr>document</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743831" lims:id="743831" generate-in-text="no"><Text><DefinedTermEn>electronic hearing</DefinedTermEn> means a hearing in which documents are provided in an electronic form to the registry and are presented electronically in the course of the hearing. (<DefinedTermFr>audience électronique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743832" lims:id="743832" generate-in-text="no"><Text><DefinedTermEn>electronic transmission</DefinedTermEn> includes transmission by electronic mail (e-mail) or via the Tribunal website. (<DefinedTermFr>transmission électronique</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743833" lims:id="743833" generate-in-text="no"><Text><DefinedTermEn>file</DefinedTermEn> means to file with the Registrar. (<DefinedTermFr>déposer</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743834" lims:id="743834" generate-in-text="no"><Text><DefinedTermEn>intervenor</DefinedTermEn> means </Text><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743835" lims:id="743835"><Label>(a)</Label><Text>a person granted leave to intervene by the Tribunal in accordance with rule 46;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743836" lims:id="743836"><Label>(b)</Label><Text>an attorney general who intervenes under section 88 or 101 of the Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743837" lims:id="743837"><Label>(c)</Label><Text>the Commissioner who intervenes under section 103.2 or subsection 124.2(3) of the Act. (<DefinedTermFr>intervenant</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743838" lims:id="743838" generate-in-text="no"><Text><DefinedTermEn>originating document</DefinedTermEn> means either a notice of application, a notice of reference, or an application for leave under section 103.1 of the generate-in-text="no"><Text><DefinedTermEn>paper hearing</DefinedTermEn> means a hearing in which documents are provided in paper form to the registry and are presented in paper form in the course of generate-in-text="no"><Text><DefinedTermEn>reference</DefinedTermEn> means the reference of a question to the Tribunal for determination under section 124.2 of the generate-in-text="no"><Text><DefinedTermEn>Registrar</DefinedTermEn> means the Registrar of the Tribunal. (<DefinedTermFr>registraire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-05-01" lims:fid="743844" lims:id="743844" generate-in-text="no"><Text><DefinedTermEn>registry</DefinedTermEn> means the Registry of the generate-in-text="no"><Text><DefinedTermEn>respondent</DefinedTermEn> means a person who is named as a respondent in a notice of Applicable to All Proceedings</TitleText></Heading><Heading lims:inforce-start-date="2008-05-01" lims:fid="743847" lims:id="743847" level="3"><TitleText>Dispensing with Compliance</TitleText></Heading><Section lims:inforce-start-date="2008-05-01" lims:lastAmendedDate="2008-05-01" lims:fid="743848" lims:id="743848"><MarginalNote lims:inforce-start-date="2008-05-01" lims:fid="743849" lims:id="743849">Variation</MarginalNote><Label>2</Label><Subsection lims:inforce-start-date="2008-05-01" lims:fid="743850" lims:id="743850"><Label>(1)</Label><Text>The Tribunal may dispense with, vary or supplement the application of any of these Rules in a particular case in order to deal with all matters as informally and expeditiously as the circumstances and considerations of fairness permit.</Text></Subsection><Subsection lims:inforce-start-date="2008-05-01" lims:fid="743851" lims:id="743851"><MarginalNote lims:inforce-start-date="2008-05-01" lims:fid="743852" lims:id="743852">Urgent matters</MarginalNote><Label>(2)</Label><Text>If a party considers that the circumstances require that an application be heard urgently or within a specified period, the party may request that the Tribunal give directions about how to proceed.</Text></Subsection></Section><Heading lims:inforce-start-date="2008-05-01" lims:fid="743853" lims:id="743853" level="3"><TitleText>Time Limits</TitleText></Heading><Section lims:inforce-start-date="2008-05-01" lims:lastAmendedDate="2008-05-01" lims:fid="743854" lims:id="743854"><MarginalNote lims:inforce-start-date="2008-05-01" lims:fid="743855" lims:id="743855"><XRefExternal reference-type="act" link="I-21">Interpretation Act</XRefExternal></MarginalNote><Label>3</Label><Text>Unless otherwise provided in these Rules, time limits under these Rules or under an order of the Tribunal shall be calculated under sections 26 to 30 of the <XRefExternal reference-type="act" link="I-21">Interpretation Act</XRefExternal>.</Text></Section><Section lims:inforce-start-date="2008-05-01" lims:lastAmendedDate="2008-05-01" lims:fid="743856" lims:id="743856"><MarginalNote lims:inforce-start-date="2008-05-01" lims:fid="743857" lims:id="743857">Calculating time limits</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2008-05-01" lims:fid="743858" lims:id="743858"><Label>(1)</Label><Text>If the time for doing an act expires on a holiday or a Saturday, the act may be done on the next day that is not a holiday or a Saturday.</Text></Subsection><Subsection lims:inforce-start-date="2008-05-01" lims:fid="743859" lims:id="743859"><MarginalNote lims:inforce-start-date="2008-05-01" lims:fid="743860" lims:id="743860">Time limit less than six days</MarginalNote><Label>(2)</Label><Text>If a time limit is less than six days, holidays and Saturdays shall not be included in the calculation of the time limit.</Text></Subsection></Section><Section lims:inforce-start-date="2008-05-01" lims:lastAmendedDate="2008-05-01" lims:fid="743861" lims:id="743861"><MarginalNote lims:inforce-start-date="2008-05-01" lims:fid="743862" lims:id="743862">Varying time limits</MarginalNote><Label>5</Label><Text>The time limits prescribed by these Rules may only be shortened or extended by an order or a direction of a judicial member.</Text></Section><Heading lims:inforce-start-date="2008-05-01" lims:fid="743863" lims:id="743863" level="3"><TitleText>Documents</TitleText></Heading><Section lims:inforce-start-date="2008-05-01" lims:lastAmendedDate="2008-05-01" lims:fid="743864" lims:id="743864"><MarginalNote lims:inforce-start-date="2008-05-01" lims:fid="743865" lims:id="743865">Memorandum of fact and law</MarginalNote><Label>6</Label><Text>Where in these Rules a reference is made to a memorandum of fact and law, the memorandum of fact and law shall contain a table of contents and, in consecutively numbered paragraphs,</Text><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743866" lims:id="743866"><Label>(a)</Label><Text>a concise statement of fact;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743867" lims:id="743867"><Label>(b)</Label><Text>a statement of the points in issue;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743868" lims:id="743868"><Label>(c)</Label><Text>a concise statement of the submissions;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743869" lims:id="743869"><Label>(d)</Label><Text>a concise statement of the order sought, including any order lims:id="743876">In blank</MarginalNote><Label>(2)</Label><Text>The Registrar may issue a writ of subpoena in blank and the person to whom it is issued shall complete it and may include any number of originating document shall be effected</Text><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743881" lims:id="743881"><Label>(a)</Label><Text>in the case of an individual, by leaving a certified copy of the originating document with the individual;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743882" lims:id="743882"><Label>(b)</Label><Text>in the case of a partnership, by leaving a certified copy of the originating document with one of the partners during business hours;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743883" lims:id="743883"><Label>(c)</Label><Text>in the case of a corporation, by leaving a certified copy of the originating document with an officer of the corporation or with a person lims:id="743884"><Label>(d)</Label><Text>in the case of the Commissioner, by leaving a certified copy of the originating document at the Commissioner’s office during business hours; is represented by counsel, by leaving a certified copy of the originating document with the counsel who accepts service of the document.</Text></Paragraph></Subsection><Subsection manner</MarginalNote><Label>(2)</Label><Text>If a person is unable to serve an originating document in a manner described in subrule (1), the person may apply to a judicial member for an order setting an order of the Tribunal, the Tribunal may, on motion, order that a document be deemed validly served if it is satisfied that the document came to the notice of the person to be served or that it would have come to that person’s notice except for the person’s avoidance of service.</Text></Section><Section lims:inforce-start-date="2008-05-01" lims:lastAmendedDate="2008-05-01" lims:fid="743892" lims:fid="743894" lims:id="743894"><Label>(1)</Label><Text>Service of a document, other than an originating document, on a person who is not represented by counsel shall be effected</Text><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743895" lims:id="743895"><Label>(a)</Label><Text>in a manner set out in any of paragraphs 8(1)(a) to (d), except that the copy of the document need not be certified;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743896" lims:id="743896"><Label>(b)</Label><Text>by leaving a copy of the document at the usual or last known address of the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743897" lims:id="743897"><Label>(c)</Label><Text>by sending a copy of the document to the person by facsimile transmission in accordance with subrule (3);</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743898" lims:id="743898"><Label>(d)</Label><Text>by sending a copy of the document to the person by registered mail or by messenger or courier service, and by obtaining an acknowledgement of receipt signed and dated by the person or by someone on behalf of the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-05-01" lims:fid="743899" lims:id="743899"><Label>(e)</Label><Text>by electronic transmission of the document to the person, if the for admissions</MarginalNote><Label>56</Label><Text>A party may, after pleadings have been closed but not later than 25 days before the commencement of the hearing, request that another party admit a fact or the authenticity of a document by serving a request to admit, in form 255 of the <XRefExternal reference-type="regulation" link="SOR-98-106">Federal Courts Rules</XRefExternal>, on that party, lims:id="744216">Non-application</MarginalNote><Label>(4)</Label><Text>If satisfied that the interest of justice outweighs any prejudice that would result to a party who disclosed evidence, the Tribunal may, on motion, order that the deemed undertaking referred to in subrule (2) does not apply to the evidence or to information obtained from it, and may impose any terms and give any directions that are just.</Text></Subsection></Section><Section lims:inforce-start-date="2008-05-01" lims:lastAmendedDate="2008-05-01" lims:fid="744217" lims:id="744217"><MarginalNote to documents</MarginalNote><Label>65</Label><Text>Subject to any confidentiality order under rule 66, a party who has served an affidavit of documents on another party shall allow the other party to inspect and make copies of the documents listed in the affidavit, unless those documents are subject to a claim for privilege or are not within the party’s possession, power or are entitled to have access to the confidential document or information,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-05-01" lims:fid="744240" lims:id="744240"><Label>(iii)</Label><Text>any document or information or category of documents or information to be made available to the person or category of persons referred to in subparagraph (ii),</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-05-01" lims:fid="744241" lims:id="744241"><Label>(iv)</Label><Text>any written confidentiality agreement to be signed by the person or persons referred to in subparagraph (ii) and the provisions of that agreement,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-05-01" lims:fid="744242"
