(<DefinedTermFr>eaux de classe 3 ou plus</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2008-04-17" lims:fid="743569" lims:id="743569" generate-in-text="no"><Text><DefinedTermEn>guide</DefinedTermEn>, in respect of a vessel, means its master. (<DefinedTermFr>guide</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2008-04-17" lims:fid="743570" lims:id="743570" generate-in-text="no"><Text><DefinedTermEn>helmet</DefinedTermEn> means a helmet that has a fastening system and is designed to protect from injury the head of a person who wears it from the mid-line of the forehead to the back of the crown of the head. (<DefinedTermFr>casque protecteur</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2008-04-17" lims:fid="743571" lims:id="743571" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743572" lims:id="743572"><Label>2</Label><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743573" lims:id="743573"><Label>(1)</Label><Text>These Regulations apply in respect of Canadian vessels that are inflatable and carry persons on an excursion in Canadian waters for remuneration.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743574" lims:id="743574"><Label>(2)</Label><Text>These Regulations do not apply in respect of motorized rigid-hull inflatable vessels.</Text></Subsection></Section><Heading lims:inforce-start-date="2008-04-17" lims:fid="743575" lims:id="743575" level="1"><TitleText>Responsibilities</TitleText></Heading><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743576" lims:id="743576"><Label>3</Label><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743577" lims:id="743577"><Label>(1)</Label><Text>Every person in charge of an enterprise that engages in an excursion shall ensure that the requirements set out in sections 4 to 17 are met in respect of the excursion.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743578" lims:id="743578"><Label>(2)</Label><Text>A vessel’s guide shall ensure that the requirements set out in sections 12 to 17 are met in respect of the vessel.</Text></Subsection></Section><Heading lims:inforce-start-date="2008-04-17" lims:fid="743579" lims:id="743579" level="1"><TitleText>Vessels and Equipment</TitleText></Heading><Heading lims:inforce-start-date="2008-04-17" lims:fid="743580" lims:id="743580" level="2"><TitleText>Vessels</TitleText></Heading><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743581" lims:id="743581"><Label>4</Label><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743582" lims:id="743582"><Label>(1)</Label><Text>Every vessel on an excursion shall be of sound construction and in good condition so as to be able to withstand the weather and water conditions that may reasonably be expected on the excursion.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743583" lims:id="743583"><Label>(2)</Label><Text>Every vessel shall have a line that is becketed to the gunwale around the outside of the vessel or safety straps that are suitable to use as handgrips.</Text></Subsection></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743584" lims:id="743584"><Label>5</Label><Text>Every vessel shall be able to maintain buoyancy if any one of its buoyancy chambers deflates.</Text></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743585" lims:id="743585"><Label>6</Label><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743586" lims:id="743586"><Label>(1)</Label><Text>Every vessel shall have sufficient seating so that every person on board can be seated.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743587" lims:id="743587"><Label>(2)</Label><Text>No vessel shall be loaded to exceed the manufacturer’s capacity recommendations, if any.</Text></Subsection></Section><Heading lims:inforce-start-date="2008-04-17" lims:fid="743588" lims:id="743588" level="2"><TitleText>Equipment</TitleText></Heading><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2023-06-07" lims:fid="743589" lims:id="743589"><Label>7</Label><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743590" lims:id="743590"><Label>(1)</Label><Text>Every person on an excursion, other than a guide, shall be provided with a properly sized small-vessel lifejacket or white-water vest.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743591" lims:id="743591"><Label>(2)</Label><Text>Before January 1, 2012, a person on an excursion in waters that are not class 3 or above waters may be provided with a properly sized personal flotation device instead of the equipment required by subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743592" lims:id="743592"><Label>(3)</Label><Text>Every guide on an excursion shall be provided with a properly sized small-vessel lifejacket or white-water vest or an inherently buoyant and properly sized personal flotation device that has a quick release harness.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743593" lims:id="743593"><Label>(4)</Label><Text>Every person on an excursion in class 3 or above waters, other than a person on an excursion on a motorized vessel that is over 6 m in length, shall be provided with a properly sized helmet.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743594" lims:id="743594"><Label>(5)</Label><Text>Subsection (4) does not apply in respect of an excursion in waters where there are no rocks or other hard objects that could cause impact injuries to a person who falls overboard.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743595" lims:id="743595"><Label>(6)</Label><Text>Every person on an excursion in class 3 or above waters where the water temperature is less than 15° C shall, unless the excursion is on a motorized vessel that is over 6 m in length, be provided with properly sized gear designed to provide thermal protection to the body core when a person is immersed in water.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743596" lims:id="743596"><Label>(7)</Label><Text>Every small-vessel lifejacket, white-water vest or personal flotation device provided under any of subsections (1) to (3)</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743597" lims:id="743597"><Label>(a)</Label><Text>shall, in the case of a small-vessel lifejacket, bear in English and French its manufacturer’s marking or labelling indicating that it meets the standards set out in CAN/CGSB-65.7-M88, <XRefExternal reference-type="standard">Lifejackets, Inherently Buoyant Type</XRefExternal> or the standards for a class 2 lifejacket set out in the CAN/CGSB-65.7-2007, <XRefExternal reference-type="standard">Lifejackets</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743598" lims:id="743598"><Label>(b)</Label><Text>shall, in the case of a personal flotation device, bear in English and French its manufacturer’s marking or labelling indicating that it meets the standards for type I personal flotation devices set out in CAN/CGSB-65.11-M88, <XRefExternal reference-type="standard">Personal Flotation Devices</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743599" lims:id="743599"><Label>(c)</Label><Text>shall, in the case of a white-water vest, have been approved by the United States Coast Guard for use in commercial white-water activities;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743600" lims:id="743600"><Label>(d)</Label><Text>shall not be altered in a manner that</Text><Subparagraph lims:inforce-start-date="2008-04-17" lims:fid="743601" lims:id="743601"><Label>(i)</Label><Text>compromises its original structural integrity, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2008-04-17" lims:fid="743602" lims:id="743602"><Label>(ii)</Label><Text>diminishes the integrity or readability of any marking or labelling required by paragraph (a) or (b);</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743603" lims:id="743603"><Label>(e)</Label><Text>shall be in good condition; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743604" lims:id="743604"><Label>(f)</Label><Text>shall be maintained and replaced in accordance with the manufacturer’s instructions or recommendations, if any, that come with the equipment.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743605" lims:id="743605"><Label>(8)</Label><Text>A person who provides their own equipment or gear that meets the applicable requirements of subsections (1) to (7) shall be considered to have been provided with that equipment or gear.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2023-06-07" lims:enacted-date="2023-05-19" lims:fid="1400113" lims:id="1400113" lims:enactId="1398705">SOR/2023-105, s. 11(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2023-06-07" lims:fid="743606" lims:id="743606"><Label>8</Label><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743607" lims:id="743607"><Label>(1)</Label><Text>A first aid kit that contains the following shall be carried in a watertight container by one vessel out of every five or fewer vessels travelling together:</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743608" lims:id="743608"><Label>(a)</Label><Text>20 adhesive bandages;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743609" lims:id="743609"><Label>(b)</Label><Text>two sterile pads;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743610" lims:id="743610"><Label>(c)</Label><Text>one 10-cm × 4.5-m gauze bandage;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743611" lims:id="743611"><Label>(d)</Label><Text>one 7.5-cm × 4.5-m roller bandage;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743612" lims:id="743612"><Label>(e)</Label><Text>one triangular bandage, with a minimum base length of 100 cm, and two pins;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743613" lims:id="743613"><Label>(f)</Label><Text>one 1.25-cm × 4.5-m roll of adhesive first-aid tape;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743614" lims:id="743614"><Label>(g)</Label><Text>one pair of safety scissors;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743615" lims:id="743615"><Label>(h)</Label><Text>60 mL of antiseptic wound solution and 10 disposable applicators, or 10 antiseptic swabs;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743616" lims:id="743616"><Label>(i)</Label><Text>a first aid manual;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743617" lims:id="743617"><Label>(j)</Label><Text>two pairs of latex examination gloves; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743618" lims:id="743618"><Label>(k)</Label><Text>one resuscitation face shield.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743619" lims:id="743619"><Label>(2)</Label><Text>Every vessel shall carry a throw bag that has at least 15 m of buoyant line.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2023-06-07" lims:enacted-date="2023-05-19" lims:fid="1400115" lims:id="1400115" lims:enactId="1398710">SOR/2023-105, s. 12(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743620" lims:id="743620"><Label>9</Label><Text>Every vessel shall carry, travel with another vessel that carries or be at all times within 5 km of a cache that contains</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743621" lims:id="743621"><Label>(a)</Label><Text>a repair kit for inflatable vessels;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743622" lims:id="743622"><Label>(b)</Label><Text>an air pump;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743623" lims:id="743623"><Label>(c)</Label><Text>an engine repair kit and a spare motor if the vessel is propelled by a motor; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743624" lims:id="743624"><Label>(d)</Label><Text>a spare oar with an oarlock or clip if the vessel is propelled by oars.</Text></Paragraph></Section><Heading lims:inforce-start-date="2008-04-17" lims:fid="743625" lims:id="743625" level="1"><TitleText>Operational Requirements</TitleText></Heading><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743626" lims:id="743626"><Label>10</Label><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743627" lims:id="743627"><Label>(1)</Label><Text>Every vessel’s guide shall</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743628" lims:id="743628"><Label>(a)</Label><Text>be at least 18 years of age;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743629" lims:id="743629"><Label>(b)</Label><Text>hold a standard first aid certificate as defined in section 16.1 of the <XRefExternal reference-type="regulation" link="SOR-86-304">Canada Occupational Health and Safety Regulations</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743630" lims:id="743630"><Label>(c)</Label><Text>if the excursion is in class 3 or above waters, have completed five excursions in class 3 or above waters on an inflatable vessel, other than a motorized rigid-hull inflatable vessel.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743631" lims:id="743631"><Label>(2)</Label><Text>If the excursion is in class 3 or above waters, every vessel’s guide shall have completed one excursion on any type of vessel in those waters. However, if the excursion includes more than five nights, any guide who is not the excursion leader may instead have completed one excursion in other waters that are of equal or greater difficulty to navigate than the waters in which the excursion takes place.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743632" lims:id="743632"><Label>(3)</Label><Text>Before an excursion is started, every vessel’s guide shall ensure that he or she is aware of</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743633" lims:id="743633"><Label>(a)</Label><Text>the current and expected conditions and the hazards of the waters in which the excursion will take place; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743634" lims:id="743634"><Label>(b)</Label><Text>the contents of the rescue plan required by section 17.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743635" lims:id="743635"><Label>11</Label><Text>Every overnight excursion in class 3 or above waters shall include the participation of a person who holds a swift-water rescue certificate that is evidence of their successful completion of theoretical and practical training in the skills and knowledge necessary for swift-water rescues, including training in</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743636" lims:id="743636"><Label>(a)</Label><Text>selecting and using swift-water rescue equipment;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743637" lims:id="743637"><Label>(b)</Label><Text>executing swift-water rescues;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743638" lims:id="743638"><Label>(c)</Label><Text>ensuring the safety of rescue personnel; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743639" lims:id="743639"><Label>(d)</Label><Text>identifying and managing medical emergencies and carrying out evacuations.</Text></Paragraph></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743640" lims:id="743640"><Label>12</Label><Text>Before an excursion is started, every person on the excursion, other than the guides, shall receive a safety briefing that includes</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743641" lims:id="743641"><Label>(a)</Label><Text>information about the excursion and a warning about the nature of the hazards of the waters in which it will take place;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743642" lims:id="743642"><Label>(b)</Label><Text>a description of the general safety precautions to take and the routine procedures to follow in the waters;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743643" lims:id="743643"><Label>(c)</Label><Text>details of the requirement under section 13 to wear equipment, as well as directions regarding its use; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743644" lims:id="743644"><Label>(d)</Label><Text>a description of the procedures to follow in the event of emergencies during the excursion, including casualties, persons overboard and the swamping and capsizing of vessels.</Text></Paragraph></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743645" lims:id="743645"><Label>13</Label><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743646" lims:id="743646"><Label>(1)</Label><Text>Every person who is provided with a small-vessel lifejacket, white-water vest or personal flotation device under section 7 shall wear it when on board a vessel.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743647" lims:id="743647"><Label>(2)</Label><Text>Every person who is provided with a helmet under subsection 7(4) shall wear it when on board a vessel in class 3 or above waters.</Text></Subsection><Subsection lims:inforce-start-date="2008-04-17" lims:fid="743648" lims:id="743648"><Label>(3)</Label><Text>Every person who is provided with gear under subsection 7(6) shall wear it when on board a vessel in class 3 or above waters where the water temperature is less than 15°C.</Text></Subsection></Section><Section lims:inforce-start-date="2023-06-07" lims:enacted-date="2023-05-19" lims:lastAmendedDate="2023-06-07" lims:fid="743649" lims:id="1400116"><Label>14</Label><Text>Any equipment or material that is on board a vessel and that is not being used shall be stowed and secured in place when the vessel is moving.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2023-06-07" lims:enacted-date="2023-05-19" lims:fid="1400118" lims:id="1400118" lims:enactId="1398712">SOR/2023-105, s. 13</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743650" lims:id="743650"><Label>15</Label><Text>No person may be allowed on board a vessel if there are reasonable grounds to believe that their faculties are impaired by alcohol or a drug to an extent that they might present a hazard to the vessel or to persons on board it.</Text></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743651" lims:id="743651"><Label>16</Label><Text>Except in an emergency, no vessel shall be operated</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743652" lims:id="743652"><Label>(a)</Label><Text>in class 3 or above waters unless it is accompanied by another vessel, whether inflatable or not; or</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743653" lims:id="743653"><Label>(b)</Label><Text>in class 3 or above waters during the period beginning one-half hour after sunset and ending one-half hour before sunrise.</Text></Paragraph></Section><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2008-04-17" lims:fid="743654" lims:id="743654"><Label>17</Label><Text>On every excursion, a rescue plan in respect of the excursion that contains the procedures to be followed in the event of an emergency, including the following procedures, shall be carried on a vessel:</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743655" lims:id="743655"><Label>(a)</Label><Text>a description of the means of communication to be used in an emergency;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743656" lims:id="743656"><Label>(b)</Label><Text>emergency telephone numbers, such as the telephone numbers of local law enforcement and search and rescue groups;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743657" lims:id="743657"><Label>(c)</Label><Text>a description of pull-out or extraction sites from which, in an emergency, persons can be transported by air or land; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743658" lims:id="743658"><Label>(d)</Label><Text>the procedures to be followed in a medical emergency.</Text></Paragraph></Section><Heading lims:inforce-start-date="2008-04-17" lims:fid="743659" lims:id="743659" level="1"><TitleText>Records</TitleText></Heading><Section lims:inforce-start-date="2008-04-17" lims:lastAmendedDate="2023-06-07" lims:fid="743660" lims:id="743660"><Label>18</Label><Text>Every person in charge of an enterprise that engages in an excursion shall keep, for three years after the excursion, records that include</Text><Paragraph lims:inforce-start-date="2008-04-17" lims:fid="743661" lims:id="743661"><Label>(a)</Label><Text>in respect of each guide on the excursion, the name of the guide, the date of the excursion, the number of passengers on the excursion and the class of waters and a geographical description of the waters in which the excursion took place;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-07" lims:enacted-date="2023-05-19" lims:fid="743662" lims:id="1400119"><Label>(b)</Label><Text>information in respect of the certificates required by paragraph 10(1)(b) and section 11, including the name of the holder of the certificate, its date of issuance and, if applicable, the name of the institution that issued it and the endorsed propulsion method as chosen by the enterprise or specified on the swift-water rescue certificate;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-06-07" lims:enacted-date="2023-05-19" lims:fid="743663" lims:id="1400120"><Label>(c)</Label><Text>a description of the safety briefing required by section 12;
