lims:inforce-start-date="2013-12-06" lims:fid="742236" lims:id="742236"><Label>(1)</Label><Text>The following definitions apply in these Regulations.</Text><Definition lims:inforce-start-date="2013-12-06" lims:fid="742237" lims:id="742237" generate-in-text="no"><Text><DefinedTermEn>1966 Convention</DefinedTermEn> means the International Convention on Load Lines, 1966. (<DefinedTermFr>Convention de 1966</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742238" lims:id="742238" generate-in-text="no"><Text><DefinedTermEn>Act</DefinedTermEn> means the <XRefExternal reference-type="act" link="C-10.15">Canada Shipping Act, 2001</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742239" lims:id="742239" generate-in-text="no"><Text><DefinedTermEn>Board</DefinedTermEn> means the Marine Technical Review Board established under section 26 of the Act. (<DefinedTermFr>Bureau</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742240" lims:id="742240" generate-in-text="no"><Text><DefinedTermEn>classification society</DefinedTermEn> means the American Bureau of Shipping, Bureau Veritas, Det Norske Veritas, Lloyd’s Register of Shipping, Germanischer Lloyd, Registro Italiano Navale and Nippon Kaiji Kyokai. (<DefinedTermFr>société de classification</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742241" lims:id="742241" generate-in-text="no"><Text><DefinedTermEn>Convention</DefinedTermEn> means the International Convention on Load Lines, 1966, as modified by the Protocol. (<DefinedTermFr>Convention</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742242" lims:id="742242" generate-in-text="no"><Text><DefinedTermEn>domestic voyage</DefinedTermEn> means a voyage that is from a place in Canada to another place in Canada. (<DefinedTermFr>voyage intérieur</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742243" lims:id="742243" generate-in-text="no"><Text><DefinedTermEn>freeboard deck</DefinedTermEn> in respect of a vessel, means</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742244" lims:id="742244"><Label>(a)</Label><Text>the vessel’s uppermost complete deck that is exposed to weather and sea and has permanent means of closing all openings in its exposed parts, and below which all openings in the shell of the vessel are fitted with permanent means of watertight closing; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742245" lims:id="742245"><Label>(b)</Label><Text>a permanent deck that is lower than the deck referred to in paragraph (a), is continuous in a fore and aft direction at least between the machinery space and peak bulkheads and continuous athwartships if the vessel’s owner requests that lower deck. (<DefinedTermFr>pont de franc-bord</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742246" lims:id="742246" generate-in-text="no"><Text><DefinedTermEn>HSC Code</DefinedTermEn> means the <XRefExternal reference-type="other">International Code of Safety for High Speed Craft, 2000, (2000 HSC CODE)</XRefExternal>, published by the IMO, as amended from time to time. (<DefinedTermFr>recueil HSC</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742247" lims:id="742247" generate-in-text="no"><Text><DefinedTermEn>IMO</DefinedTermEn> means the International Maritime Organization. (<DefinedTermFr>OMI</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-23" lims:enacted-date="2021-06-10" lims:fid="742248" lims:id="1300711"><Text><DefinedTermEn>inland voyage</DefinedTermEn> has the same meaning as in section <XRefInternal>1</XRefInternal> of the <XRefExternal reference-type="regulation" link="SOR-2021-135">Vessel Safety Certificates Regulations</XRefExternal>. (<DefinedTermFr>voyage en eaux internes</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-23" lims:enacted-date="2021-06-10" lims:fid="742249" lims:id="1300710"><Text><DefinedTermEn>inland waters of Canada</DefinedTermEn> has the same meaning as in section <XRefInternal>1</XRefInternal> of the <XRefExternal reference-type="regulation" link="SOR-2021-135">Vessel Safety Certificates Regulations</XRefExternal>. (<DefinedTermFr>eaux internes du Canada</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742252" lims:id="742252" generate-in-text="no"><Text><DefinedTermEn>Minister</DefinedTermEn> means the Minister of Transport. (<DefinedTermFr>ministre</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742253" lims:id="742253" generate-in-text="no"><Text><DefinedTermEn>open-hopper dredge</DefinedTermEn> means a self-propelled dredge with an open hold or hopper in the hull that receives dredged material and is fitted with bottom doors that can quickly jettison the dredged material. (<DefinedTermFr>marie-salope</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742254" lims:id="742254" generate-in-text="no"><Text><DefinedTermEn>place</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742255" lims:id="742255"><Label>(a)</Label><Text>a port; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742256" lims:id="742256"><Label>(b)</Label><Text>any vessel or place that is used for loading or unloading vessels. (<DefinedTermFr>lieu</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742257" lims:id="742257" generate-in-text="no"><Text><DefinedTermEn>Protocol</DefinedTermEn> means the 1988 Protocol relating to the International Convention on Load lines, 1966, as amended on January 1, 2005. (<DefinedTermFr>Protocole</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2021-06-23" lims:enacted-date="2021-06-10" lims:fid="742258" lims:id="1300712"><Text><DefinedTermEn>sheltered waters voyage</DefinedTermEn> has the same meaning as in section <XRefInternal>1</XRefInternal> of the <XRefExternal reference-type="regulation" link="SOR-2021-135">Vessel Safety Certificates Regulations</XRefExternal>. (<DefinedTermFr>voyage en eaux abritées</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742259" lims:id="742259" generate-in-text="no"><Text><DefinedTermEn>superstructure</DefinedTermEn> means a decked structure on the freeboard deck of a vessel extending from side to side of the vessel or with the side plating not being more than four per cent of the breadth inboard of the shell plating, and includes that part of the hull extending above the freeboard deck if the freeboard deck is a lower deck. (<DefinedTermFr>superstructure</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742260" lims:id="742260" generate-in-text="no"><Text><DefinedTermEn>watertight</DefinedTermEn> means designed to withstand a static head of water without any leakage. (<DefinedTermFr>étanche à l’eau</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742261" lims:id="742261"><Label>(2)</Label><Text>For the purpose of these Regulations, a vessel is constructed on the earliest of</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742262" lims:id="742262"><Label>(a)</Label><Text>the day on which its keel is laid,</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742263" lims:id="742263"><Label>(b)</Label><Text>the day on which construction identifiable with a specific vessel begins, and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742264" lims:id="742264"><Label>(c)</Label><Text>the day on which assembly of the vessel reaches the lesser of 50 tonnes and one per cent of the estimated mass of all structural material.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742265" lims:id="742265"><Label>(3)</Label><Text>Subject to subsection (4), for the purpose of these Regulations, every reference to “Administration” in a document incorporated by reference in these Regulations means</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742266" lims:id="742266"><Label>(a)</Label><Text>in the case of a Canadian vessel, the Minister; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742267" lims:id="742267"><Label>(b)</Label><Text>in the case of a foreign vessel, the government of the state whose flag the vessel is entitled to fly.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742268" lims:id="742268"><Label>(4)</Label><Text>For the purpose of these Regulations, every reference to “Administration” in articles 6 and 8 of the 1966 Convention or the Convention means, in the case of a Canadian vessel, the Board.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742269" lims:id="742269"><Label>(5)</Label><Text>For the purpose of interpreting a document incorporated by reference in these Regulations, “should” Lines</TitleText></Heading><Heading lims:inforce-start-date="2007-07-01" lims:fid="742273" lims:id="742273" level="2"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2013-12-06" lims:fid="742274" lims:id="742274"><Label>2</Label><Text>The following definitions apply in this Part.</Text><Definition lims:inforce-start-date="2013-12-06" lims:fid="742275" lims:id="742275" generate-in-text="no"><Text><DefinedTermEn>amidships</DefinedTermEn> means the middle of the length of a vessel. (<DefinedTermFr>milieu du bâtiment</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742276" lims:id="742276" generate-in-text="no"><Text><DefinedTermEn>deck line</DefinedTermEn> means a horizontal line that is 300 mm long and 25 mm wide marked amidships on the outer surface of the shell on each side of the vessel. (<DefinedTermFr>ligne de pont</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742277" lims:id="742277" generate-in-text="no"><Text><DefinedTermEn>existing vessel</DefinedTermEn> means a vessel that is not a new vessel. (<DefinedTermFr>bâtiment existant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742278" lims:id="742278" generate-in-text="no"><Text><DefinedTermEn>international voyage</DefinedTermEn> means a voyage, other than an inland voyage, between a place in Canada and a place not in Canada or between places not in Canada. (<DefinedTermFr>voyage international</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742279" lims:id="742279" generate-in-text="no"><Text><DefinedTermEn>length</DefinedTermEn></Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742280" lims:id="742280"><Label>(a)</Label><Text>in respect of a new vessel, has the same meaning as in article 2(8) of Annex A to the Convention; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742281" lims:id="742281"><Label>(b)</Label><Text>in respect of an existing vessel, has the same meaning as in subsection 1(2) of Schedule I to the Rules. (<DefinedTermFr>longueur</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742282" lims:id="742282" generate-in-text="no"><Text><DefinedTermEn>new vessel</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742283" lims:id="742283"><Label>(a)</Label><Text>a Canadian vessel</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742284" lims:id="742284"><Label>(i)</Label><Text>that was constructed on or after April 14, 1970 and is engaged on an international voyage,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742285" lims:id="742285"><Label>(ii)</Label><Text>that was constructed on or after April 14, 1973 and is not engaged on an international voyage, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742286" lims:id="742286"><Label>(iii)</Label><Text>that was constructed before April 14, 1970 and is engaged on an international voyage, or that was constructed before April 14, 1973 and is not engaged on an international voyage, if the authorized representative makes a request in writing to the Minister for the vessel to be assigned freeboards as a new vessel; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742287" lims:id="742287"><Label>(b)</Label><Text>a foreign vessel that was constructed on or after the date on which the 1966 Convention came into force in the state whose flag the vessel is waters connecting those lakes, the St. Lawrence Seaway and the St. Lawrence River west of the Victoria Bridge in Montréal. (<DefinedTermFr>zone des Grands Lacs de l’Amérique du Nord</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742289" lims:id="742289" generate-in-text="no"><Text><DefinedTermEn>Rules</DefinedTermEn> means the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1425">General Load Line Rules</XRefExternal>, C.R.C., c. 1425, as they read on January 1, 2006. (<DefinedTermFr>Règles</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742290" lims:id="742290" generate-in-text="no"><Text><DefinedTermEn>sailing vessel</DefinedTermEn> means a vessel that has sufficient sail area for navigation under sails alone, whether or not fitted with mechanical means of propulsion. (<DefinedTermFr>voilier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742291" lims:id="742291" generate-in-text="no"><Text><DefinedTermEn>St. Lawrence River Seasonal Area</DefinedTermEn> means that part of the St. Lawrence River bounded by the Victoria Bridge in Montréal, a straight line drawn from Cap-des-Rosiers to West Point, Anticosti Island, and a line drawn along the meridian of longitude 63°W from Anticosti Island to the north shore of the St. Lawrence River. (<DefinedTermFr>région saisonnière du fleuve Saint-Laurent</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742292" lims:id="742292" generate-in-text="no"><Text><DefinedTermEn>tanker</DefinedTermEn> means a vessel specially constructed for the carriage of liquid cargoes in bulk. (<DefinedTermFr>bâtiment-citerne</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742293" lims:id="742293" generate-in-text="no"><Text><DefinedTermEn>timber deck cargo</DefinedTermEn> means a cargo of timber carried on an uncovered part of a freeboard deck or superstructure deck. (<DefinedTermFr>chargement Zone</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742295" lims:id="742295"><Label>(a)</Label><Text>the waters of Puget Sound in the State of Washington;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742296" lims:id="742296"><Label>(b)</Label><Text>the waters lying between Vancouver Island and the mainland and east of a line from a point one nautical mile west of the city limits of Port Angeles in the State of Washington to Race Rocks on Vancouver Island and of a line from Hope Island, British Columbia, to Cape Calvert, Calvert Island, British Columbia;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742297" lims:id="742297"><Label>(c)</Label><Text>the waters lying east of a line from Cape Calvert to Duke Point on Duke Island in the State of Alaska;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742298" lims:id="742298"><Label>(d)</Label><Text>the waters lying north of Duke Island and east of Prince of Wales Island, Baranof Island and Chichagof Island in the State of Alaska;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742299" lims:id="742299"><Label>(e)</Label><Text>the waters of Peril, Neva and Olga Straits as far south as Sitka in the State of Alaska; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742300" lims:id="742300"><Label>(f)</Label><Text>the waters lying east of a line from Port Althorp on Chichagof Island to Cape Spencer in the State of Alaska. (<DefinedTermFr>zone d’application du Traité — côte lims:id="742305"><Label>(1)</Label><Text>Subject to subsection (2), this Part applies in respect of Canadian vessels everywhere and foreign vessels in Canadian waters.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742306" lims:id="742306"><Label>(2)</Label><Text>This Part does not apply in respect of</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742307" lims:id="742307"><Label>(a)</Label><Text>pleasure craft;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742308" lims:id="742308"><Label>(b)</Label><Text>vessels ordinarily engaged in catching, attempting to catch or harvesting fish, whales, seals, walrus or other living resources of the sea;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742309" lims:id="742309"><Label>(c)</Label><Text>high-speed craft that have been certified in accordance with the HSC Code and meet the requirements of that Code;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742310" lims:id="742310"><Label>(d)</Label><Text>new vessels of less than 24 m in length;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742311" lims:id="742311"><Label>(e)</Label><Text>existing vessels of less than 150 gross tonnage;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742312" lims:id="742312"><Label>(f)</Label><Text>vessels that are engaged on</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742313" lims:id="742313"><Label>(i)</Label><Text>a voyage solely within the limits of the inland waters of Canada or an inland voyage and holding a certificate issued under Part 2 or similar load line regulations made under the laws of the United States,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742314" lims:id="742315"><Label>(iii)</Label><Text>a domestic voyage, if the vessels are not carrying passengers or cargo;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742316" lims:id="742316"><Label>(g)</Label><Text>Canadian vessels or vessels registered in the United States that are engaged on an international voyage wholly within the West Coast Treaty Zone;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742317" lims:id="742317"><Label>(h)</Label><Text>new vessels that do not have means of self-propulsion that</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742318" lims:id="742318"><Label>(i)</Label><Text>are engaged on a domestic voyage wholly within the West Coast Treaty Zone and are not carrying oil as cargo or passengers, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742319" lims:id="742319"><Label>(ii)</Label><Text>are engaged on a domestic voyage outside the West Coast Treaty Zone and are not carrying oil as cargo, passengers or crew; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742320" lims:id="742320"><Label>(i)</Label><Text>existing vessels that do not have means of self-propulsion, are engaged on a domestic voyage and are not carrying passengers or 3(2)(f) and (g), a vessel that is constructed or converted for the purpose of towing on or after the day on which the <XRefExternal reference-type="regulation" link="SOR-2023-257">Vessel Construction and Equipment Regulations</XRefExternal> come into force and that is engaged on a voyage beyond the limits of an inland voyage shall meet the conditions of assignment set out in Chapter II of Annex I of Annex B of Part 3 of the Convention.</Text></Subsection><Subsection lims:inforce-start-date="2023-12-20" lims:enacted-date="2023-12-04" lims:fid="1436051" lims:id="1436051"><Label>(2)</Label><Text>Despite paragraphs 3(2)(f) to (i), a vessel that is constructed on or after the day on which the <XRefExternal reference-type="regulation" link="SOR-2023-257">Vessel Construction and Equipment Regulations</XRefExternal> come into force, that carries at least one person and that is engaged on a voyage beyond the limits of an inland voyage shall comply with regulations 24 and 25 of Chapter II of Annex I of Annex B of Part 3 of the Convention.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2023-12-20" lims:fid="742327" lims:id="742327"><Label>(b)</Label><Text>is marked in accordance with the certificate.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742328" lims:id="742328"><Label>(2)</Label><Text>No Canadian vessel shall depart on an international voyage unless it</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742329" lims:id="742329"><Label>(a)</Label><Text>holds an International Load Line Certificate or an International Load Line Exemption Certificate issued under section 5; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742330" lims:id="742330"><Label>(b)</Label><Text>is marked in accordance with the certificate.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742331" lims:id="742331"><Label>(3)</Label><Text>No foreign vessel shall depart from a place in Canada unless it</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742332" lims:id="742332"><Label>(a)</Label><Text>holds an International Load Line Certificate or an International Load Line Exemption Certificate issued by the government of the state whose flag the vessel is entitled to fly or, at the request of that government, by another government; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742333" lims:id="742333"><Label>(b)</Label><Text>is marked in accordance with the certificate.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742334" lims:id="742334" level="2"><TitleText>Certificates</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742335" lims:id="742335"><Label>5</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742336" lims:id="742336"><Label>(1)</Label><Text>On application by the authorized representative of a Canadian vessel that is a new vessel and was constructed before the day on which this section comes into force, the Minister shall issue an International Load Line Certificate to the vessel if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742337" lims:id="742337"><Label>(a)</Label><Text>the conditions of assignment set out in Chapter II of Annex I to the 1966 Convention are met;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742338" lims:id="742338"><Label>(b)</Label><Text>the vessel is maintained in accordance with the requirements of a classification society;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742339" lims:id="742339"><Label>(c)</Label><Text>the vessel has been assigned freeboards that</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742340" lims:id="742340"><Label>(i)</Label><Text>are determined in accordance with Chapter III of Annex I to the 1966 Convention, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742341" lims:id="742341"><Label>(ii)</Label><Text>if the freeboards determined under subparagraph (i) are not adequate because of the general structural strength of the vessel, are adequate for the general structural strength of the vessel; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742342" lims:id="742342"><Label>(d)</Label><Text>the vessel is marked in accordance with Chapter I of Annex I to the 1966 Convention.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742343" lims:id="742343"><Label>(2)</Label><Text>On application by the authorized representative of a Canadian vessel that is a new vessel and was constructed on or after the day on which this section comes into force, the Minister shall issue an International Load Line Certificate to the vessel if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742344" lims:id="742344"><Label>(a)</Label><Text>the conditions of assignment set out in Chapter II of Annex I to the Convention are met;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742345" lims:id="742345"><Label>(b)</Label><Text>the vessel is maintained in accordance with the requirements of a classification society;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742346" lims:id="742346"><Label>(c)</Label><Text>the vessel has been assigned freeboards that</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742347" lims:id="742347"><Label>(i)</Label><Text>are determined in accordance with Chapter III of Annex I to the Convention, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742348" lims:id="742348"><Label>(ii)</Label><Text>if the freeboards determined under subparagraph (i) are not adequate because of the general structural strength of the vessel, are adequate for the general structural strength of the vessel; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742349" lims:id="742349"><Label>(d)</Label><Text>the vessel is marked in accordance with Chapter I of Annex I to the Convention.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742350" lims:id="742350"><Label>(3)</Label><Text>On application by the authorized representative of a Canadian vessel that is an existing vessel, the Minister shall issue an International Load Line Certificate to the vessel if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742351" lims:id="742351"><Label>(a)</Label><Text>the conditions of assignment set out in Part I of Schedule I to the Rules are met;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742352" lims:id="742352"><Label>(b)</Label><Text>the vessel is maintained in accordance with the requirements of a classification society;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742353" lims:id="742353"><Label>(c)</Label><Text>the vessel has been assigned freeboards determined in accordance with</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742354" lims:id="742354"><Label>(i)</Label><Text>in the case of a vessel other than a sailing vessel or tanker, Part II of Schedule I to the Rules and, if the vessel is carrying timber deck cargo, Part IV of that Schedule,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742355" lims:id="742355"><Label>(ii)</Label><Text>in the case of a sailing vessel, Part III of Schedule I to the Rules, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742356" lims:id="742356"><Label>(iii)</Label><Text>in the case of a tanker, Part V of Schedule I to the Rules; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742357" lims:id="742357"><Label>(d)</Label><Text>the vessel is marked in accordance with Part VI of Schedule I to the Rules.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742358" lims:id="742358"><Label>(4)</Label><Text>On application by the authorized representative of a Canadian vessel that is a new vessel, the Minister shall issue a Local Load Line Certificate to the vessel if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742359" lims:id="742359"><Label>(a)</Label><Text>the intended operation of the vessel provides an equivalent or greater level of safety than one or more of the requirements set out in subsection (1) or (2), as the case may be; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742360" lims:id="742360"><Label>(b)</Label><Text>the other requirements set out in subsection (1) or (2), as the case may be, are met.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742361" lims:id="742361"><Label>(4.1)</Label><Text>On application by the authorized representative of a Canadian vessel that is an existing vessel, the Minister shall issue a Local Load Line Certificate to the vessel if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742362" lims:id="742362"><Label>(a)</Label><Text>the intended operation of the vessel provides an equivalent or greater level of safety than one or more of the requirements set out in subsection (3); and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742363" lims:id="742363"><Label>(b)</Label><Text>the other requirements set out in subsection (3) are met.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742364" lims:id="742364"><Label>(5)</Label><Text>On application by the authorized representative of a Canadian vessel, the Minister shall issue an International Load Line Exemption Certificate to the vessel if it has been granted an exemption by the Board under section 13 and</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742365" lims:id="742365"><Label>(a)</Label><Text>subject to the terms of that exemption, the requirements of subsection (1), (2) or (3), as the case may be, are met; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742366" lims:id="742366"><Label>(b)</Label><Text>any design-, contruction- or equipment-related safety requirements set by the Board under that section are met.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742367" lims:id="742367"><Label>(6)</Label><Text>A Local Load Line Certificate that is issued to an open-hopper dredge shall include a dredging load line if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742368" lims:id="742368"><Label>(a)</Label><Text>it has been assigned a dredging freeboard that is 62.5 per cent of the assigned summer freeboard or 150 mm, whichever is greater; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742369" lims:id="742369"><Label>(b)</Label><Text>it is marked with the dredging load line placed directly below the deck line so that its upper edge marks the assigned dredging freeboard and the letters “WD” are marked forward of this line.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742370" lims:id="742370"><Label>(7)</Label><Text>Despite paragraphs (1)(d), (2)(d) and (3)(d), the Minister may issue a certificate if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742371" lims:id="742371"><Label>(a)</Label><Text>the marking is placed so that the freeboards are greater than those required by paragraph (1)(d), (2)(d) or (3)(d), as the case may be; or</Text></Paragraph><Paragraph lims:inforce-start-date="2023-12-20" lims:enacted-date="2023-12-04" lims:fid="742372" lims:id="1436054"><Label>(b)</Label><Text>in the case of a passenger vessel, it is marked in accordance with the <XRefExternal reference-type="regulation" link="SOR-2023-257">Vessel Construction and Equipment Regulations</XRefExternal> or paragraph 22(2)(c) of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1431">Hull Construction Regulations</XRefExternal>, as the case may be.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742373" lims:id="742373"><Label>(8)</Label><Text>Despite paragraph (6)(b), the Minister may issue a certificate that includes a dredging load line if the dredging load line is placed so that the dredging freeboard is greater than that required by that Duties</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742377" lims:id="742377"><Label>6</Label><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742378" lims:id="742378"><Label>(1)</Label><Text>The authorized representative of a vessel that holds an International Load Line Certificate or a Local Load Line Certificate shall ensure that</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742379" lims:id="742379"><Label>(a)</Label><Text>the conditions of assignment that were required to be met for the issuance of the certificate are met and the vessel is maintained in accordance with the requirements of a classification society;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742380" lims:id="742380"><Label>(b)</Label><Text>the vessel is marked as it was required to be marked for the issuance of the certificate or as it may be marked under subsection 5(7) or (8);</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742381" lims:id="742381"><Label>(c)</Label><Text>the certificate is endorsed as required by the Convention;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742382" lims:id="742382"><Label>(d)</Label><Text>no material alterations take place in the hull or superstructure of the vessel that would necessitate the assignment of an increased freeboard; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742383" lims:id="742383"><Label>(e)</Label><Text>the vessel is operated only as intended, in the case of a Local Load Line Certificate.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742384" lims:id="742384"><Label>(2)</Label><Text>The authorized representative of a vessel that holds an International Load Line Exemption Certificate shall ensure that</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742385" lims:id="742385"><Label>(a)</Label><Text>the conditions of assignment that were required to be met for the issuance of the certificate are met and the vessel is maintained in accordance with the requirements of a classification society;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742386" lims:id="742386"><Label>(b)</Label><Text>the vessel is marked as it was required to be marked for the issuance of the certificate or as it may be marked under subsection 5(7) or (8);</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742387" lims:id="742387"><Label>(c)</Label><Text>the vessel complies with any safety requirements set under article 6(2) or (4) of the 1966 Convention or the Convention or under section 13, as the case may be;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742388" lims:id="742388"><Label>(d)</Label><Text>the certificate is endorsed as required by the Convention; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742389" lims:id="742389"><Label>(e)</Label><Text>no material alterations take place in the hull or superstructure of the vessel that would necessitate the assignment of an increased freeboard.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742390" lims:id="742390" level="2"><TitleText>Seasonal Zones, Areas and Periods</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742391" lims:id="742391"><Label>7</Label><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742392" lims:id="742392"><Label>(1)</Label><Text>The seasonal zones, areas and periods set out in Annex II to the Convention apply for the purpose of determining the applicable load line when a new vessel is in one of those zones or areas.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742393" lims:id="742393"><Label>(2)</Label><Text>When a new vessel is engaged on a voyage set out in column 1 of the table to this subsection during a period set out in column 2, the seasonal period set out in column 3 applies for the purpose of determining the applicable load line.</Text><TableGroup lims:inforce-start-date="2007-07-01" lims:fid="742394" lims:id="742394" pointsize="7" lims:id="742403"><Label>8</Label><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742404" lims:id="742404"><Label>(1)</Label><Text>When a vessel is in fresh water of a specific gravity of 1.0, the applicable load line is adjusted by the fresh water allowance that is specified in the vessel’s load line certificate and determined in accordance with the 1966 Convention, the Convention or the Rules, as the case may be. However, if the vessel is in water of a specific gravity that is greater than 1.0 but less than 1.025, the applicable load line is adjusted by the following formula:</Text><FormulaGroup lims:inforce-start-date="2007-07-01" lims:fid="742405" lims:id="742405"><Formula lims:inforce-start-date="2007-07-01" lims:fid="742406" lims:id="742406"><FormulaText>[(1.025 – A)/0.025] × B</FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2007-07-01" lims:fid="742407" lims:id="742407"><FormulaTerm>A</FormulaTerm><Text>equals the actual specific gravity; and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2007-07-01" lims:fid="742408" lims:id="742408"><FormulaTerm>B</FormulaTerm><Text>equals the fresh water allowance.</Text></FormulaDefinition></FormulaGroup></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742409" lims:id="742409"><Label>(2)</Label><Text>Subsection (1) does not apply in respect of</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742410" lims:id="742410"><Label>(a)</Label><Text>a new vessel that is in the North American Great Lakes Zone; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742411" lims:id="742411"><Label>(b)</Label><Text>an existing vessel that is in the North American Great Lakes Zone during the period starting on September 16 in any year and ending on April 30 in the next year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742412" lims:id="742412"><Label>(3)</Label><Text>When a vessel departs from a place situated on a river or on inland waters to the sea, the applicable load line is raised to a level that accounts for the weight of fuel and all other materials required for consumption between the point of departure and the sea.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742413" lims:id="742413"><Label>(4)</Label><Text>Subsection (3) does not apply in respect of a vessel that</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742414" lims:id="742414"><Label>(a)</Label><Text>is in the North American Great Lakes Zone; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742415" lims:id="742415"><Label>(b)</Label><Text>is in the St. Lawrence River Seasonal Area, if the vessel is engaged on a voyage wholly within the limits of the North American Great Lakes Zone and the St. Lawrence River Seasonal Area.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742416" lims:id="742416" level="2"><TitleText>Dredging Load Lines</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742417" lims:id="742417"><Label>9</Label><Text>The dredging load line on an open-hopper dredge is the applicable load line when</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742418" lims:id="742418"><Label>(a)</Label><Text>the dredge is operating not more than 20 nautical miles from the mouth of a harbour of safe refuge;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742419" lims:id="742419"><Label>(b)</Label><Text>the height of waves in the area of operation is not more than 3 m or the wind velocity in the area is not more than 65 km/h; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742420" lims:id="742420"><Label>(c)</Label><Text>the dredge is carrying dredged material with a specific gravity that is not greater than the highest specific gravity of dredged material that the dredge is designed to dredge.</Text></Paragraph></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742421" lims:id="742421" level="2"><TitleText>Timber Load Lines</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742422" lims:id="742422"><Label>10</Label><Text>The provisions of the 1966 Convention and the Convention relating to timber load lines do not apply in respect of any vessel that is in the North American Great Lakes Zone or that is engaged on a voyage wholly within the limits of the North American Great Lakes Zone and the St. Lawrence River Seasonal Area.</Text></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742423" lims:id="742423" level="2"><TitleText>Posting of Certificates</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742424" lims:id="742424"><Label>11</Label><Text>The authorized representative of a Canadian vessel that holds an International Load Line Certificate, a Local Load Line Certificate or an International Load Line Exemption Certificate shall ensure that it is framed and posted in a conspicuous place on board the vessel.</Text></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742425" lims:id="742425" level="2"><TitleText>Draught and Freeboard Notices</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742426" lims:id="742426"><Label>12</Label><Text>The master of a Canadian vessel that holds an International Load Line Certificate, a Local Load Line Certificate or an International Load Line Exemption Certificate shall, before leaving a place to proceed on an international voyage, post the particulars of the draughts and freeboards in a conspicuous place on board the vessel and keep them legible until the vessel arrives at another place.</Text></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742427" lims:id="742427" level="2"><TitleText>Exemptions and Equivalents</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742428" lims:id="742428"><Label>13</Label><Text>The Board may exercise the powers conferred on the Administration by articles 6 and 8 of the 1966 Convention or the Convention, as the case may be.</Text></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742429" lims:id="742429" level="1"><Label>PART 2</Label><TitleText>Diamond Load Lines</TitleText></Heading><Heading lims:inforce-start-date="2007-07-01" lims:fid="742430" lims:id="742430" level="2"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742431" lims:id="742431"><Label>14</Label><Text>(1) The following definitions apply in this Part.</Text><Definition lims:inforce-start-date="2007-07-01" lims:fid="742432" lims:id="742432" generate-in-text="no"><Text><DefinedTermEn>amidships</DefinedTermEn> means the middle of the length of a vessel. (<DefinedTermFr>milieu du bâtiment</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="742433" lims:id="742433" generate-in-text="no"><Text><DefinedTermEn>deck line</DefinedTermEn> means a horizontal line that is 300 mm long and 25 mm wide marked amidships on the outer surface of the shell on each side of the vessel. (<DefinedTermFr>ligne de pont</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="742434" lims:id="742434" generate-in-text="no"><Text><DefinedTermEn>existing vessel</DefinedTermEn> means a vessel that is not a new vessel. (<DefinedTermFr>bâtiment existant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="742435" lims:id="742435" generate-in-text="no"><Text><DefinedTermEn>length</DefinedTermEn> or <DefinedTermEn>L</DefinedTermEn></Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742436" lims:id="742436"><Label>(a)</Label><Text>in respect of a new vessel, means 96 per cent of the total length on a waterline at 85 per cent of the least moulded depth measured from the top of the keel, or the length from the fore side of the stem to the axis of the rudder stock on that waterline, if that is greater, except that, in vessels designed with a rake of keel, the waterline on which the length is measured shall be parallel to the designed waterline; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742437" lims:id="742437"><Label>(b)</Label><Text>in respect of an existing vessel, has the same meaning as in subsection 1(2) of Schedule I to the Rules. (<DefinedTermFr>longueur</DefinedTermFr> ou <DefinedTermFr>L</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="742438" lims:id="742438" generate-in-text="no"><Text><DefinedTermEn>moulded depth</DefinedTermEn> means the vertical distance measured</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742439" lims:id="742439"><Label>(a)</Label><Text>from the top of the freeboard deck beam at side</Text><Subparagraph lims:inforce-start-date="2007-07-01" lims:fid="742440" lims:id="742440"><Label>(i)</Label><Text>to the top of the keel,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-07-01" lims:fid="742441" lims:id="742441"><Label>(ii)</Label><Text>in the case of a vessel that is not of metal construction, to the lower edge of the keel rabbet, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2007-07-01" lims:fid="742442" lims:id="742442"><Label>(iii)</Label><Text>in the case of a vessel that is fitted with thick garboards or a structure other than a flat plate keel, to the point where a line extending the flat of the bottom continued inwards would cut the side of the keel;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742443" lims:id="742443"><Label>(b)</Label><Text>in the case of a vessel that has rounded gunwales, from the point where the moulded lines of the deck and shell would intersect if the gunwale were right-angled to the point described in subparagraph (a)(i), (ii) or (iii), as the case may be; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742444" lims:id="742444"><Label>(c)</Label><Text>in the case of a vessel that has a stepped freeboard deck, from a line extending from the lower part of the freeboard deck along a line parallel to the higher part of the freeboard deck to the point described in subparagraph (a)(i), (ii) or (iii), as the case may be. (<DefinedTermFr>creux sur quille</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="742445" lims:id="742445" generate-in-text="no"><Text><DefinedTermEn>new vessel</DefinedTermEn> means a vessel that is 24 m or more in length</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742446" lims:id="742446"><Label>(a)</Label><Text>that was constructed on or after April 14, 1973; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742447" lims:id="742447"><Label>(b)</Label><Text>that was constructed as a Canadian vessel before the date referred to in paragraph (a), if the vessel’s authorized representative makes a request in writing to the Minister for the vessel to be assigned freeboards as a new vessel. (<DefinedTermFr>bâtiment neuf</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2007-07-01" lims:fid="742448" lims:id="742448" generate-in-text="no"><Text><DefinedTermEn>Rules</DefinedTermEn> means the <XRefExternal reference-type="regulation" link="C.R.C.,_c._1442">Load Line Rules for Lakes and Rivers</XRefExternal>, C.R.C., c. 1442, as they read on January 1, 2006. (<DefinedTermFr>Règles</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742449" lims:id="742449" level="2"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2013-12-06" lims:fid="742450" lims:id="742450"><Label>15</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742451" lims:id="742451"><Label>(1)</Label><Text>Subject to subsections (2) and (3), this Part applies in respect of Canadian vessels and foreign vessels that are engaged on a voyage solely within the limits of the inland waters of Canada and Canadian vessels that are engaged on an inland voyage.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742452" lims:id="742452"><Label>(2)</Label><Text>This Part does not apply in respect of</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742453" lims:id="742453"><Label>(a)</Label><Text>pleasure craft;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742454" lims:id="742454"><Label>(b)</Label><Text>vessels ordinarily engaged in catching, attempting to catch or harvesting fish, whales, seals, walrus or other living resources of the sea;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742455" lims:id="742455"><Label>(c)</Label><Text>high-speed craft that have been certified in accordance with the HSC Code and meet the requirements of that Code;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742456" lims:id="742456"><Label>(d)</Label><Text><Repealed>[Repealed, SOR/2013-235, s. 17]</Repealed></Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742457" lims:id="742457"><Label>(e)</Label><Text>existing vessels of less than 150 gross tonnage;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742458" lims:id="742458"><Label>(f)</Label><Text>vessels that hold an International Load Line Certificate, a Local Load Line Certificate or an International Load Line Exemption Certificate;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742459" lims:id="742459"><Label>(g)</Label><Text>vessels that are engaged on</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742460" lims:id="742460"><Label>(i)</Label><Text>a sheltered waters voyage, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742461" lims:id="742461"><Label>(ii)</Label><Text>a domestic voyage, if the vessels are not carrying passengers or cargo;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742462" lims:id="742462"><Label>(h)</Label><Text>new vessels that do not have means of self-propulsion, are engaged on a domestic voyage and are not carrying passengers, crew or oil as cargo; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742463" lims:id="742463"><Label>(i)</Label><Text>existing vessels that do not have means of self-propulsion, are engaged on a domestic voyage and are not carrying passengers or crew.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742464" lims:id="742464"><Label>(3)</Label><Text>Section 17 does not apply in respect of vessels that hold a load line certificate issued under Title 46, chapter I, part 45 of the <XRefExternal reference-type="regulation">Code of Federal Regulations</XRefExternal> of the United States, as amended from time to time.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-12-06" lims:fid="742466" lims:id="742466">SOR/2013-235, s. 17</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2023-12-20" lims:enacted-date="2023-12-04" lims:fid="1436056" lims:id="1436056" level="2"><TitleText>Exceptions</TitleText></Heading><Section lims:inforce-start-date="2023-12-20" lims:enacted-date="2023-12-04" lims:lastAmendedDate="2023-12-20" lims:fid="1436057" lims:id="1436057"><Label>15.1</Label><Subsection lims:inforce-start-date="2023-12-20" lims:enacted-date="2023-12-04" lims:fid="1436058" lims:id="1436058"><Label>(1)</Label><Text>Despite paragraph 15(2)(g), a vessel that is constructed or converted for the purpose of towing on or after the day on which the <XRefExternal reference-type="regulation" link="SOR-2023-257">Vessel Construction and Equipment Regulations</XRefExternal> come into force and that is engaged on an inland voyage shall meet the conditions of assignment set out in Schedule 1.</Text></Subsection><Subsection lims:inforce-start-date="2023-12-20" lims:enacted-date="2023-12-04" lims:fid="1436059" lims:id="1436059"><Label>(2)</Label><Text>Despite paragraphs 15(2)(g) to (i), a vessel that is constructed on or after the day on which the <XRefExternal reference-type="regulation" link="SOR-2023-257">Vessel Construction and Equipment Regulations</XRefExternal> come into force, that carries at least one person and that is engaged on an inland voyage shall comply with sections 11 and 13 of Schedule 1.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2023-12-20" lims:enacted-date="2023-12-04" lims:fid="1436061" lims:id="1436061" lims:enactId="1431492">SOR/2023-257, s. 518</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742467" lims:id="742467" level="2"><TitleText>Prohibitions</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2013-12-06" lims:fid="742468" lims:id="742468"><Label>16</Label><Text>No vessel shall depart from a place in Canada and no Canadian vessel shall depart from a place outside Canada unless it</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742469" lims:id="742469"><Label>(a)</Label><Text>holds</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742470" lims:id="742470"><Label>(i)</Label><Text>a Great Lakes and Inland Waters of Canada Load Line Certificate issued under section 17, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742471" lims:id="742471"><Label>(ii)</Label><Text>a load line certificate issued under Title 46, chapter I, part 45 of the <XRefExternal reference-type="regulation">Code of Federal Regulations</XRefExternal> of the United States, as amended from time to time; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742472" lims:id="742472"><Label>(b)</Label><Text>is marked in accordance with the certificate.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-12-06" lims:fid="742474" lims:id="742474">SOR/2013-235, s. 18(F)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742475" lims:id="742475" level="2"><TitleText>Certificates</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742476" lims:id="742476"><Label>17</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742477" lims:id="742477"><Label>(1)</Label><Text>On application by the authorized representative of a new vessel, the Minister shall issue a Great Lakes and Inland Waters of Canada Load Line Certificate to the vessel if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742478" lims:id="742478"><Label>(a)</Label><Text>the conditions of assignment set out in Schedule 1 are met;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742479" lims:id="742479"><Label>(b)</Label><Text>the vessel is maintained in accordance with the requirements of a classification society;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742480" lims:id="742480"><Label>(c)</Label><Text>the vessel has been assigned freeboards that</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742481" lims:id="742481"><Label>(i)</Label><Text>are determined in accordance with Schedule 2, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742482" lims:id="742482"><Label>(ii)</Label><Text>if the freeboards determined under subparagraph (i) are not adequate because of the general structural strength of the vessel, are adequate for the general structural strength of the vessel; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742483" lims:id="742483"><Label>(d)</Label><Text>the vessel is marked in accordance with Schedule 3.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742484" lims:id="742484"><Label>(2)</Label><Text>On application by the authorized representative of an existing vessel, the Minister shall issue a Great Lakes and Inland Waters of Canada Load Line Certificate to the vessel if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742485" lims:id="742485"><Label>(a)</Label><Text>the conditions of assignment set out in Part I of Schedule I to the Rules are met;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742486" lims:id="742486"><Label>(b)</Label><Text>the vessel is maintained in accordance with the requirements of a classification society;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742487" lims:id="742487"><Label>(c)</Label><Text>the vessel has been assigned freeboards determined in accordance with Part II, III or IV of Schedule I to the Rules; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742488" lims:id="742488"><Label>(d)</Label><Text>the vessel is marked in accordance with Part V of Schedule I to the Rules.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742489" lims:id="742489"><Label>(3)</Label><Text>Despite paragraphs (1)(d) and (2)(d), the Minister may issue a certificate if</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742490" lims:id="742490"><Label>(a)</Label><Text>the marking on the vessel is placed so that the freeboard is greater than that required by paragraph (1)(d) or (2)(d), as the case may be; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742546" lims:id="742546"><Label>(d)</Label><Text>there are no more than two main deck cargo openings to a single cargo space. (<DefinedTermFr>bâtiment du type A</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742547" lims:id="742547" generate-in-text="no"><Text><DefinedTermEn>Type B vessel</DefinedTermEn> means a vessel that is not a Type A vessel. (<DefinedTermFr>bâtiment du type B</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742548" lims:id="742548" generate-in-text="no"><Text><DefinedTermEn>weathertight</DefinedTermEn> means designed to prevent water from penetrating a vessel in any sea condition. (<DefinedTermFr>étanche aux intempéries</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742549" lims:id="742549" level="1"><TitleText>Stability and other Information</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742550" lims:id="742550"><Label>2</Label><Text>A vessel that carries bulk or liquid cargo shall carry the information required by regulation 7.2 of Chapter VI of the International Convention for the Safety of Life at Sea, 1974 and the Protocol of 1988 relating to that Convention, as amended from time to time.</Text></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742551" lims:id="742551" level="1"><TitleText>Access Openings</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742552" lims:id="742552"><Label>3</Label><Text>Access openings in bulkheads at the ends of enclosed superstructures shall</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742553" lims:id="742553"><Label>(a)</Label><Text>be fitted with efficiently constructed weathertight doors that are permanently attached to the bulkhead so that the whole structure is at least equivalent in strength to a bulkhead with no openings;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742554" lims:id="742554"><Label>(b)</Label><Text>have means for securing the doors weathertight that are permanently attached to the bulkhead or the doors and are operable from both sides of the bulkhead; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742555" lims:id="742555"><Label>(c)</Label><Text>have sills at least 300 mm above the deck.</Text></Paragraph></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742556" lims:id="742556" level="1"><TitleText>Hatchways</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742557" lims:id="742557"><Label>4</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742558" lims:id="742558"><Label>(1)</Label><Text>Hatchways shall have efficiently constructed coamings</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742559" lims:id="742559"><Label>(a)</Label><Text>at least 460 mm above the deck, in the case of coamings in Position 1; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742560" lims:id="742560"><Label>(b)</Label><Text>at least 300 mm above the deck, in the case of coamings in Position 2.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742561" lims:id="742561"><Label>(2)</Label><Text>Subsection (1) does not apply if the hatchway is fitted with a watertight cover.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742562" lims:id="742562"><Label>(3)</Label><Text>Except for open-hopper dredges, hatchways in Position 1 or Position 2 shall be fitted with efficiently constructed weathertight hatchway covers.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742563" lims:id="742563"><Label>(4)</Label><Text>If weathertight covers on hatchways are made of mild steel, the maximum allowable stress shall be calculated using the following loads:</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742564" lims:id="742564"><Label>(a)</Label><Text>in the case of vessels that are 110 m in length or over, a load not less than 12 kPa on hatchways in Position 1 and not less than 9.6 kPa on hatchways in Position 2;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742565" lims:id="742565"><Label>(b)</Label><Text>in the case of vessels that are 24 m in length, a load not less than 9.6 kPa on hatchways in Position 1 and not less than 7.2 kPa on hatchways in Position 2; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742566" lims:id="742566"><Label>(c)</Label><Text>in the case of vessels of intermediate length, a load obtained by interpolation from the loads referred to in paragraphs (a) and (b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742567" lims:id="742567"><Label>(5)</Label><Text>The maximum allowable stress calculated for the loads in subsection (4) shall not exceed the minimum ultimate strength of the material using a safety factor of 4.25.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742568" lims:id="742568"><Label>(6)</Label><Text>Hatchway covers in Position 1 or Position 2 shall be so designed as to limit deflection to not more than 0.0028 times the span under the loads referred to in subsection (4). Mild steel plating that forms the tops of the covers shall not be thinner than one per cent of the spacing between stiffeners or 6 mm, whichever is greater.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742569" lims:id="742569"><Label>(7)</Label><Text>Coamings and hatchway covers of exposed hatchways on decks above the superstructure deck shall be efficiently constructed.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742570" lims:id="742570"><Label>(8)</Label><Text>The strength and stiffness of hatchway covers made of materials other than mild steel shall be at least equivalent to those of mild steel.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742571" lims:id="742571"><Label>(9)</Label><Text>The means for securing and maintaining the weathertightness of hatchway covers shall be such that the weathertightness can be maintained in any sea conditions.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742572" lims:id="742572" level="1"><TitleText>Cargo Ports and other Similar Openings</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742573" lims:id="742573"><Label>5</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742574" lims:id="742574"><Label>(1)</Label><Text>Cargo ports and other similar openings in the shell of a vessel below the freeboard deck shall be fitted with watertight doors that are as strong as the structure to which they are attached.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742575" lims:id="742575"><Label>(2)</Label><Text>Cargo ports and other similar openings above the freeboard deck shall be fitted with weathertight doors that are as strong as the structure to which they are attached.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742576" lims:id="742576"><Label>(3)</Label><Text>The lower edges of cargo ports and other similar openings shall not be below a line drawn parallel to the freeboard deck at side that has the upper edge of the uppermost load line at its lowest point.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742577" lims:id="742577" level="1"><TitleText>Machinery Space Openings</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742578" lims:id="742578"><Label>6</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742579" lims:id="742579"><Label>(1)</Label><Text>Machinery space openings in Position 1 or Position 2 shall be enclosed by efficiently constructed steel casings.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742580" lims:id="742580"><Label>(2)</Label><Text>Access openings in the casings required by subsection (1) shall</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742581" lims:id="742581"><Label>(a)</Label><Text>be fitted with efficiently constructed weathertight covers that are permanently attached and operable from both sides of the opening and have their lower edge at least 300 mm above the deck;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742582" lims:id="742582"><Label>(b)</Label><Text>if the opening is a doorway, meet the requirements set out in section 3; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742583" lims:id="742583"><Label>(c)</Label><Text>if the opening is a funnel or machinery space ventilator that needs to be kept open for the essential operation of the vessel, be fitted with a coaming at a height above the deck of at least</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742584" lims:id="742584"><Label>(i)</Label><Text>3.8 m in Position 1, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742585" lims:id="742585"><Label>(ii)</Label><Text>1.8 m in Position 2.</Text></Subparagraph></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742586" lims:id="742586" level="1"><TitleText>Air Pipes</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742587" lims:id="742587"><Label>7</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742588" lims:id="742588"><Label>(1)</Label><Text>If air pipes to tanks extend above the freeboard deck or superstructure decks, the exposed parts of the pipes shall be efficiently constructed and the height from the deck to the point on the pipe where water may downflood shall be at least 760 mm on the freeboard deck, 600 mm on raised quarter-decks and 300 mm on other superstructure decks.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742589" lims:id="742589"><Label>(2)</Label><Text>Air pipes shall be fitted with permanently attached means of closing.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742590" lims:id="742590" level="1"><TitleText>Ventilators</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742591" lims:id="742591"><Label>8</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742592" lims:id="742592"><Label>(1)</Label><Text>Ventilators and their coamings in Position 1 or Position 2 serving spaces below freeboard decks, decks of enclosed superstructures or trunk decks shall be efficiently constructed.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742593" lims:id="742593"><Label>(2)</Label><Text>The height of ventilator coamings shall be at least 760 mm above the deck in Position 1 and at least 600 mm above the deck in Position 2.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742594" lims:id="742594"><Label>(3)</Label><Text>Ventilator openings shall have permanently attached weathertight means of closing.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742595" lims:id="742595"><Label>(4)</Label><Text>Subsection (3) does not apply in respect of ventilators in Position 1 with coamings that extend 3.8 m or more above the deck or to ventilators in Position 2 with coamings that extend 1.8 m or more above the deck.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742596" lims:id="742596" level="1"><TitleText>Side Scuttles</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742597" lims:id="742597"><Label>9</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742598" lims:id="742598"><Label>(1)</Label><Text>Side scuttles to spaces below the freeboard deck or to spaces within enclosed superstructures shall be fitted with hinged inside deadlights so that they can be closed watertight.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742599" lims:id="742599"><Label>(2)</Label><Text>The sill of each side scuttle shall be above a line that is drawn parallel to the freeboard deck at side and has its lowest point 2.5% of the breadth above the summer fresh water load line or 500 mm above that line, whichever is the greater distance.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742600" lims:id="742600"><Label>(3)</Label><Text>The side scuttles and deadlights shall be efficiently constructed.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742601" lims:id="742601" level="1"><TitleText>Miscellaneous Openings in Freeboard, Superstructure and Trunk Decks</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742602" lims:id="742602"><Label>10</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742603" lims:id="742603"><Label>(1)</Label><Text>Manholes and flush scuttles in Position 1 or Position 2 or within a superstructure other than an enclosed superstructure shall have watertight covers.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742604" lims:id="742604"><Label>(2)</Label><Text>Openings in freeboard decks other than hatchways, machinery space openings, manholes and flush scuttles shall be protected by</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742605" lims:id="742605"><Label>(a)</Label><Text>an enclosed superstructure; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742606" lims:id="742606"><Label>(b)</Label><Text>an efficiently constructed and weathertight deckhouse or companionway.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742607" lims:id="742607"><Label>(3)</Label><Text>Openings in an exposed part of a superstructure deck or in the top of a deckhouse on the freeboard deck that give access to a space below the freeboard deck or within an enclosed superstructure shall be protected in accordance with subsection (2).</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742608" lims:id="742608" level="1"><TitleText>Freeing Ports</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742609" lims:id="742609"><Label>11</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742610" lims:id="742610"><Label>(1)</Label><Text>This section applies in respect of wells that could collect water and are formed by bulwarks on the exposed parts of the freeboard deck or superstructure decks.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742611" lims:id="742611"><Label>(2)</Label><Text>If the sheer in way of the well is standard sheer or greater than standard sheer, drainage shall be provided by way of freeing ports with an area on each side of the vessel of at least</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742612" lims:id="742612"><Label>(a)</Label><Text>“A” for each well on the freeboard deck or on the raised quarter-deck; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742613" lims:id="742613"><Label>(b)</Label><Text>one-half of “A” for each well on superstructure decks other than raised quarter-decks.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742614" lims:id="742614"><Label>(3)</Label><Text>The value of “A” is calculated in square metres as follows:</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742615" lims:id="742615"><Label>(a)</Label><Text>if the length of the bulwark in way of the well is 20 m or less, 0.7 plus 0.035 times the length of that bulwark; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742616" lims:id="742616"><Label>(b)</Label><Text>in any other case, 0.07 times the lesser of</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742617" lims:id="742617"><Label>(i)</Label><Text>the length of the bulwark in way of the well, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742618" lims:id="742618"><Label>(ii)</Label><Text>70 per cent of the length of the vessel.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742619" lims:id="742619"><Label>(4)</Label><Text>The freeing port area required by subsection (2) shall be increased by 0.04 m<Sup>2</Sup> per metre of length of the well for each metre that the height of the bulwark exceeds</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742620" lims:id="742620"><Label>(a)</Label><Text>600 mm, in the case of vessels that are 73 m in length or less;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742621" lims:id="742621"><Label>(b)</Label><Text>1 200 mm, in the case of vessels that are 146 m in length or more; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742622" lims:id="742622"><Label>(c)</Label><Text>in the case of vessels that are of intermediate length, the height obtained by linear interpolation between the heights set out in paragraphs (a) and (b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742623" lims:id="742623"><Label>(5)</Label><Text>In the case of vessels greater than 146 m in length with an average height of bulwark of less than 900 mm, the freeing port area required by subsections (2) and (4) shall be decreased by 0.04 m<Sup>2</Sup> per metre of length of well for each metre by which the average height of the bulwark is less than 900 mm.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742624" lims:id="742624"><Label>(6)</Label><Text>The freeing port area required by subsections (2), (4) and (5) shall be increased by</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742625" lims:id="742625"><Label>(a)</Label><Text>in the case of vessels with no sheer, 50 per cent;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742626" lims:id="742626"><Label>(b)</Label><Text>in the case of vessels with standard sheer, zero per cent; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742627" lims:id="742627"><Label>(c)</Label><Text>in the case of vessels with less than standard sheer, the percentage obtained by linear interpolation between the percentages set out in paragraphs (a) and (b).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742628" lims:id="742628"><Label>(7)</Label><Text>If a vessel does not have guardrails in way of a trunk on an exposed part of the freeboard deck or has continuous hatchway side coamings between detached superstructures, the freeing port area shall be at least</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742629" lims:id="742629"><Label>(a)</Label><Text>20 per cent of the total area of the bulwarks if the breadth of the trunk or hatchways is 40 per cent or less of the breadth of the vessel;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742630" lims:id="742630"><Label>(b)</Label><Text>10 per cent of the total area of the bulwarks if the breadth of the trunk or hatchways is 75 per cent or more of the breadth of the vessel; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742631" lims:id="742631"><Label>(c)</Label><Text>the percentage of the total area of the bulwarks obtained by linear interpolation between the percentages set out in paragraphs (a) and (b) if the breadth of the trunk or hatchways is more than 40 per cent but less than 75 per cent of the breadth of the vessel.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742632" lims:id="742632"><Label>(8)</Label><Text>In superstructures that are open at either or both ends, the minimum freeing port area in way of wells shall be determined in accordance with the recommendation set out in interpretation LL.60 of the Unified interpretations of the provisions of the International Convention on Load Lines, 1966.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742633" lims:id="742633"><Label>(9)</Label><Text>The lower edges of the freeing ports shall be as near the deck as practicable.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742634" lims:id="742634"><Label>(10)</Label><Text>Two thirds of the required freeing port area for each well shall be located in the half of the well nearest the lowest point of the sheer curve.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742635" lims:id="742635"><Label>(11)</Label><Text>Shutters that are fitted to freeing ports shall have</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742636" lims:id="742636"><Label>(a)</Label><Text>ample clearance to prevent jamming; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742637" lims:id="742637"><Label>(b)</Label><Text>hinges that have pins or bearings of material that is resistant to corrosion.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742638" lims:id="742638" level="1"><TitleText>Scuppers, Drains, Inlets and Discharges</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742639" lims:id="742639"><Label>12</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742640" lims:id="742640"><Label>(1)</Label><Text>Every discharge pipe passing through the shell from spaces below the freeboard deck shall have</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742641" lims:id="742641"><Label>(a)</Label><Text>an automatic non-return valve fitted at the shell with a positive means of closing that is operable</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742642" lims:id="742642"><Label>(i)</Label><Text>from above the freeboard deck, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742643" lims:id="742643"><Label>(ii)</Label><Text>from a readily accessible location if the discharge originates in a space that is crewed or equipped with a means of continuously monitoring the level of bilge water; or</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742644" lims:id="742644"><Label>(b)</Label><Text>two automatic non-return valves, one of which is fitted at the shell and one inboard that is accessible for examination when the vessel is in service.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742645" lims:id="742645"><Label>(2)</Label><Text>Every discharge pipe that passes through the shell from within an enclosed superstructure, or from within a deckhouse or companionway required by subsection 10(2), shall</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742646" lims:id="742646"><Label>(a)</Label><Text>meet the requirements set out in paragraph (1)(a) or (b); or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742647" lims:id="742647"><Label>(b)</Label><Text>have an automatic non-return valve fitted at the shell, if the discharge originates in a space that is regularly visited by the crew.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742648" lims:id="742648"><Label>(3)</Label><Text>Every scupper, drain or discharge pipe that passes through the shell above the summer fresh water load line at a distance that is less than the greater of 5 per cent of the breadth and 600 mm shall have an automatic non-return valve fitted at the shell.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742649" lims:id="742649"><Label>(4)</Label><Text>Subsection (3) does not apply in respect of a scupper, drain or discharge pipe that originates above the freeboard deck if the part of the pipe that is between the shell and the freeboard deck is efficiently constructed.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742650" lims:id="742650"><Label>(5)</Label><Text>Every scupper pipe that leads from a superstructure other than an enclosed superstructure, a deckhouse or a companionway required by subsection 10(2) shall drain overboard.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742651" lims:id="742651"><Label>(6)</Label><Text>In crewed machinery spaces, every main and auxiliary sea inlet and discharge necessary for the operation of machinery shall have a valve with a positive means of closing that can be controlled locally.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742652" lims:id="742652"><Label>(7)</Label><Text>The valves required by this section to have positive means of closing shall have indicators at the operating position to show whether the valve is open or closed.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742653" lims:id="742653"><Label>(8)</Label><Text>The pipes to which this section refers shall be efficiently constructed.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742654" lims:id="742654"><Label>(9)</Label><Text>The shell fittings and the valves required by this section shall be efficiently constructed.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742655" lims:id="742655" level="1"><TitleText>Protection of the Crew</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742656" lims:id="742656"><Label>13</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742657" lims:id="742657"><Label>(1)</Label><Text>The deckhouses used for the accommodation of the crew shall be efficiently constructed.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742658" lims:id="742658"><Label>(2)</Label><Text>All exposed parts of the freeboard and superstructure decks shall be fitted with guardrails or bulwarks that are at least 900 mm in height.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742659" lims:id="742659"><Label>(3)</Label><Text>Guardrails shall be fitted</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742660" lims:id="742660"><Label>(a)</Label><Text>in at least three courses in which the space between the lowest course and the deck does not exceed 230 mm and the other courses are not spaced more than 380 mm apart; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742661" lims:id="742661"><Label>(b)</Label><Text>if the sheer strake projects at least 200 mm above the deck, in at least two courses in which the space between the lower course and the sheer strake or the upper course does not exceed 380 mm.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742662" lims:id="742662"><Label>(4)</Label><Text>Guardrail supports shall be placed on the flat of the deck on vessels with rounded gunwales.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742663" lims:id="742663"><Label>(5)</Label><Text>Vessels shall have lifelines, gangways or underdeck passages for the protection of the crew while passing to and from their accommodation spaces, the machinery space and all other spaces used in the normal operation of the vessel.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742664" lims:id="742664"><Label>(6)</Label><Text>Whenever bulkhead openings are closed, other access shall be provided for the crew to reach accommodation spaces or machinery or other working spaces in enclosed superstructures that are bridges or poops.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742665" lims:id="742665"><Label>(7)</Label><Text>If an exposed part of a freeboard deck is in way of a trunk, guardrails that meet the requirements of subsection (3) shall be fitted for at least half the length of the exposed part.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742666" lims:id="742666" level="1"><TitleText>Special Conditions of Assignment for Type A Vessels</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-12-20" lims:fid="742667" lims:id="742667"><Label>14</Label><Text>Type A vessels shall meet the following requirements:</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742668" lims:id="742668"><Label>(a)</Label><Text>machinery casings shall have bulkheads with no openings on all sides on the freeboard deck unless</Text><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742669" lims:id="742669"><Label>(i)</Label><Text>the casings are protected by an enclosed poop or bridge or efficiently constructed deckhouse of at least standard height, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-12-06" lims:fid="742670" lims:id="742670"><Label>(ii)</Label><Text>the openings meet the requirements set out in section 3 and lead to a space or passageway that is as strong as the casing and from which a second interior access opening that meets the requirements set out in section 3 is provided for access to the engine room;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742671" lims:id="742671"><Label>(b)</Label><Text>unless there is fore and aft access below the freeboard deck, a permanent fore and aft gangway shall be fitted at the superstructure deck level between the poop and all other deckhouses used in the normal operation of the vessel;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742672" lims:id="742672"><Label>(c)</Label><Text>hatchways on the exposed freeboard or forecastle deck shall have efficiently constructed watertight covers;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742673" lims:id="742673"><Label>(d)</Label><Text>vessels shall have guardrails fitted for at least half the length of the exposed parts of the weather deck; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742674" lims:id="742674"><Label>(e)</Label><Text>if superstructures are connected by trunks, guardrails shall be <DefinedTermFr>S</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742696" lims:id="742696" generate-in-text="no"><Text><DefinedTermEn>summer draught</DefinedTermEn> means the distance measured from the top of the keel of a vessel to the upper edge of the load line that would mark the vessel’s summer freeboard referred to in subsection 8(1). (<DefinedTermFr>tirant d’eau d’été</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742697" lims:id="742697" generate-in-text="no"><Text><DefinedTermEn>trunk</DefinedTermEn> means an efficiently constructed structure that is on a freeboard deck of a vessel and has a breadth of less than 92 per cent of the breadth of the vessel. (<DefinedTermFr>trunk</DefinedTermFr>)</Text></Definition></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742698" lims:id="742698"><Label>(2)</Label><Text>For the purposes of this Schedule, all length and height measurements shall be in metres and taken to three decimal places.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742699" lims:id="742699"><Label>(3)</Label><Text>Words and expressions used in this Schedule and defined in section 1 of Schedule 1 have the same meaning as in that section.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742700" lims:id="742700" level="1"><TitleText>Basic Freeboard lims:inforce-start-date="2013-12-06" lims:fid="742702" lims:id="742702"><Label>(1)</Label><Text>The basic freeboard in millimetres shall be</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:id="742732"><Label>3</Label><Text>The basic freeboard for a Type B vessel that is less than 153 m in length and has enclosed superstructures with an effective length of not more than a quarter of the length of the vessel shall be increased by b millimetres where</Text><FormulaGroup lims:inforce-start-date="2013-12-06" lims:fid="742733" lims:id="742733"><Formula lims:inforce-start-date="2013-12-06" lims:fid="742734" lims:id="742734"><FormulaText>b = 2.5 × (153 – L) × (0.25 – E/L)</FormulaText></Formula></FormulaGroup></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742735" lims:id="742735" level="1"><TitleText>Correction for Superstructures and Trunks</TitleText></Heading><Section requirements referred to in subsection (2) are the following:</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742744" lims:id="742744"><Label>(a)</Label><Text>the trunk shall be at least as strong as an enclosed superstructure;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742745" lims:id="742745"><Label>(b)</Label><Text>no hatchways shall be in the freeboard deck in way of the trunk other than small access openings with watertight covers;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742746" lims:id="742746"><Label>(c)</Label><Text>the trunk deck shall be a permanent working platform fitted with guardrails;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742747" lims:id="742747"><Label>(d)</Label><Text>if the trunk is detached, it shall be connected to the adjacent superstructures by permanent gangways;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742748" lims:id="742748"><Label>(e)</Label><Text>guardrails shall be fitted in way of the trunk on the exposed parts of the freeboard deck for at least half the length of exposed parts of the trunk;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742749" lims:id="742749"><Label>(f)</Label><Text>the trunk shall have a breadth at least 60 per cent of the breadth of the vessel; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742750" lims:id="742750"><Label>(g)</Label><Text>if there is no superstructure on the vessel, the length of the trunk shall be at least 60 per cent of its length.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742751" lims:id="742751" level="1"><TitleText>Correction for Sheer</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-06-07" lims:fid="742752" lims:id="742752"><Label>5</Label><Text>Correction in the basic freeboard for sheer shall be determined in accordance with regulation 38 of the 1966 Convention. However, for the purpose of the determination, L shall be the lesser of the length of the vessel and 153 m.</Text></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742753" lims:id="742753" level="1"><TitleText>Correction for Bow Height</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-06-07" lims:fid="742754" lims:id="742754"><Label>6</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742755" lims:id="742755"><Label>(1)</Label><Text>The following definitions apply in this section.</Text><Definition lims:inforce-start-date="2013-12-06" lims:fid="742756" lims:id="742756" generate-in-text="no"><Text><DefinedTermEn>assumed bow height</DefinedTermEn>, in respect of a vessel, means the vertical distance at the forward perpendicular between</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742757" lims:id="742757"><Label>(a)</Label><Text>the top of the exposed deck at side; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742758" lims:id="742758"><Label>(b)</Label><Text>the water line that corresponds to the basic freeboard, as corrected in accordance with sections 3 to 6, where applicable, including any designed trim. (<DefinedTermFr>hauteur d’étrave présumée</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2013-12-06" lims:fid="742759" lims:id="742759" generate-in-text="no"><Text><DefinedTermEn>standard bow in length; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742761" lims:id="742761"><Label>(b)</Label><Text>8677 – 18.917 L mm for a vessel of 168 m or more in length. (<DefinedTermFr>hauteur d’étrave normale</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2023-06-07" lims:enacted-date="2023-05-19" lims:fid="742762" lims:id="1400110"><Label>(2)</Label><Text>Subject to subsection (3), if the assumed bow height is less than the standard bow height, the basic freeboard shall be increased by the difference.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742763" lims:id="742763"><Label>(3)</Label><Text>For the purpose of the definition <DefinedTermEn>assumed bow height</DefinedTermEn>, the top of the exposed deck at side is deemed not to include sheer or the height of a superstructure unless</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742764" lims:id="742764"><Label>(a)</Label><Text>in the case of sheer, it extends for at least 15 per cent of the length of the vessel measured from the forward perpendicular; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742765" lims:id="742765"><Label>(b)</Label><Text>in the case of the height of a superstructure, the superstructure is enclosed and extends from the stem to a point at least 0.06 L abaft the forward perpendicular.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742766" lims:id="742766" level="1"><TitleText>Correction for Deck Line</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-06-07" lims:fid="742767" lims:id="742767"><Label>7</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742768" lims:id="742768"><Label>(1)</Label><Text>If the position of the upper edge of the deck line is placed in accordance with paragraph 2(b) of Schedule 3 above the position established by paragraph 2(a) of that Schedule, the basic freeboard shall be increased by the difference between those positions.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742769" lims:id="742769"><Label>(2)</Label><Text>If the position of the upper edge of the deck line is placed in accordance with paragraph 2(b) of Schedule 3 below the position established by paragraph 2(a) of that Schedule, the basic freeboard shall be decreased by the difference between those positions.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742770" lims:id="742770" level="1"><TitleText>Fresh Water Freeboards</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-06-07" lims:fid="742771" lims:id="742771"><Label>8</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742772" lims:id="742772"><Label>(1)</Label><Text>The summer freeboard that is applicable during the summer season in fresh water shall be the freeboard determined in accordance with sections 2 to 7.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742773" lims:id="742773"><Label>(2)</Label><Text>The midsummer freeboard that is applicable during the midsummer season in fresh water shall be determined by deducting y millimetres from the summer freeboard where y is equal to the summer draught in metres multiplied by 25.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742774" lims:id="742774"><Label>(3)</Label><Text>The intermediate freeboard that is applicable during the intermediate season in fresh water shall be determined by adding y millimetres to the summer freeboard where y is equal to the summer draught in metres multiplied by the quotient of 2540 divided by the greater of 122 m and L.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742775" lims:id="742775"><Label>(4)</Label><Text>The winter freeboard that is applicable during the winter season in fresh water shall be determined by adding y millimetres to the summer freeboard where y is equal to the summer draught in metres multiplied by the quotient of 5080 divided by the greater of 122 m and L.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742776" lims:id="742776" level="1"><TitleText>Salt Water Freeboards</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-06-07" lims:fid="742777" lims:id="742777"><Label>9</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742778" lims:id="742778"><Label>(1)</Label><Text>Salt water freeboards that are applicable to vessels that operate in salt water shall be determined by adding y millimetres to the corresponding fresh water freeboards where y is equal to the displacement in fresh water in tonnes at the summer load waterline divided by the product of 4.1 times the tonnes per centimetre immersion in fresh water at the summer load waterline.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742779" lims:id="742779"><Label>(2)</Label><Text>If the displacement in fresh water in tonnes at the summer load waterline cannot be determined, one forty-eighth of the summer draught shall be added to the corresponding fresh water freeboards.</Text></Subsection></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742780" lims:id="742780" level="1"><TitleText>Minimum Freeboard</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-06-07" lims:fid="742781" lims:id="742781"><Label>10</Label><Text>Despite sections 8 and 9, the freeboard other than the open-hopper dredge freeboard shall not be less than 50 mm.</Text></Section><Heading lims:inforce-start-date="2013-12-06" lims:fid="742782" lims:id="742782" level="1"><TitleText>Open-hopper Dredges</TitleText></Heading><Section lims:inforce-start-date="2013-12-06" lims:lastAmendedDate="2023-06-07" lims:fid="742783" lims:id="742783"><Label>11</Label><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742784" lims:id="742784"><Label>(1)</Label><Text>The dredging freeboard for open-hopper dredges shall be 62.5 per cent of the summer freeboard for a type B vessel or 150 mm, whichever is greater.</Text></Subsection><Subsection lims:inforce-start-date="2013-12-06" lims:fid="742785" lims:id="742785"><Label>(2)</Label><Text>The dredging freeboard for an open-hopper dredge is applicable only when</Text><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742786" lims:id="742786"><Label>(a)</Label><Text>the dredge is operating not more than 20 nautical miles from the mouth of a harbour of safe refuge;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742787" lims:id="742787"><Label>(b)</Label><Text>the height of waves in the area of operation is not more than 3 m or the wind velocity in the area is not more than 65 km per hour; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-12-06" lims:fid="742788" lims:id="742788"><Label>(c)</Label><Text>the dredge is carrying dredged material with a specific gravity that is not greater than the highest specific gravity of dredged material that the dredge is Line</TitleText></Heading></Section><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742797" lims:id="742797"><Label>2</Label><Text>The upper edge of the deck line shall</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742798" lims:id="742798"><Label>(a)</Label><Text>pass through the point where the continuation outwards of the upper surface of the freeboard deck intersects the outer surface of the shell, as illustrated in Figure 1; or</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742799" lims:id="742799"><Label>(b)</Label><Text>be placed above or below the position established in paragraph (a).</Text></Paragraph></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742800" lims:id="742800" level="1"><TitleText>Load Line Diamond</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742801" lims:id="742801"><Label>3</Label><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742802" lims:id="742802"><Label>(1)</Label><Text>A right-angled diamond as illustrated in Figure 2 shall be marked amidships below the deck line on each side of the vessel.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742803" lims:id="742803"><Label>(2)</Label><Text>The diamond shall be</Text><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742804" lims:id="742804"><Label>(a)</Label><Text>marked with lines 25 mm wide with an outside diagonal measurement of 380 mm;</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742805" lims:id="742805"><Label>(b)</Label><Text>intersected by a horizontal line that is 540 mm long and 25 mm wide and that has the midpoint of its upper edge coinciding with the midpoint of the diamond; and</Text></Paragraph><Paragraph lims:inforce-start-date="2007-07-01" lims:fid="742806" lims:id="742806"><Label>(c)</Label><Text>placed so that its centre is at a distance below the upper edge of the deck line equal to the summer freeboard referred to in subsection 8(1) of Schedule 2.</Text></Paragraph></Subsection></Section><Heading lims:inforce-start-date="2007-07-01" lims:fid="742807" lims:id="742807" level="1"><TitleText>Load Lines</TitleText></Heading><Section lims:inforce-start-date="2007-07-01" lims:lastAmendedDate="2007-07-01" lims:fid="742808" lims:id="742808"><Label>4</Label><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742809" lims:id="742809"><Label>(1)</Label><Text>Horizontal lines, to be known as fresh water load lines, indicating the assigned fresh water freeboards, shall be marked as illustrated in Figure 2. Each line shall be 230 mm long and 25 mm wide and extend forward of and at right angles to a vertical line that is 25 mm wide.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742810" lims:id="742810"><Label>(2)</Label><Text>The vertical line referred to in subsection (1) shall be placed 660 mm forward of the vertical diagonal of the load line diamond.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742811" lims:id="742811"><Label>(3)</Label><Text>The midsummer fresh water load line shall be placed so that its upper edge marks the assigned midsummer fresh water freeboard and the letters “MS” shall be marked forward of this line.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742812" lims:id="742812"><Label>(4)</Label><Text>The summer fresh water load line shall be placed so that its upper edge marks the assigned summer fresh water freeboard and the letter “S” shall be marked forward of this line.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742813" lims:id="742813"><Label>(5)</Label><Text>The intermediate fresh water load line shall be placed so that its upper edge marks the assigned intermediate fresh water freeboard and the letter “I” shall be marked forward of this line.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742814" lims:id="742814"><Label>(6)</Label><Text>The winter fresh water load line shall be placed so that its upper edge marks the assigned winter fresh water freeboard and the letter “W” shall be marked forward of this line.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742815" lims:id="742815"><Label>(7)</Label><Text>If an open-hopper dredge has been assigned a dredging freeboard, the dredging fresh water load line shall be placed directly below the deck line so that its upper edge marks the assigned dredging fresh water freeboard and the letters “WD” shall be marked forward of this line.</Text></Subsection><Subsection lims:inforce-start-date="2007-07-01" lims:fid="742816" lims:id="742816"><Label>(8)</Label><Text>If a vessel has been assigned salt water freeboards, salt water load lines shall be marked as illustrated in Figure 2.
