﻿<?xml version="1.0" encoding="utf-8"?><Regulation lims:pit-date="2006-05-11" lims:lastAmendedDate="2006-05-11" lims:current-date="2019-06-21" lims:inforce-start-date="2006-05-11" lims:fid="728787" lims:id="728787" regulation-type="SOR" xml:lang="en" in-force="yes" xmlns:lims="http://justice.gc.ca/lims"><Identification lims:inforce-start-date="2006-05-11" lims:fid="728788" lims:id="728788"><InstrumentNumber>SOR/2006-92</InstrumentNumber><RegistrationDate><Date><YYYY>2006</YYYY><MM>5</MM><DD>11</DD></Date></RegistrationDate><ConsolidationDate lims:inforce-start-date="2006-05-11"><Date><YYYY>2019</YYYY><MM>6</MM><DD>22</DD></Date></ConsolidationDate><EnablingAuthority lims:inforce-start-date="2006-05-11" lims:fid="728790" lims:id="728790"><XRefExternal reference-type="act" link="L-2">CANADA LABOUR CODE</XRefExternal></EnablingAuthority><LongTitle lims:inforce-start-date="2006-05-11" lims:fid="728791" lims:id="728791">Banking Industry Commission-paid Salespeople Hours of Work Regulations</LongTitle><RegulationMakerOrder><RegulationMaker>P.C.</RegulationMaker><OrderNumber>2006-371</OrderNumber><Date><YYYY>2006</YYYY><MM>5</MM><DD>11</DD></Date></RegulationMakerOrder></Identification><Order lims:inforce-start-date="2006-05-11" lims:fid="728792" lims:id="728792"><Provision lims:inforce-start-date="2006-05-11" lims:fid="728793" lims:id="728793" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas, pursuant to subsection 248(1) of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>, the Minister of Labour on February 10, 2004 appointed a Commissioner to make an inquiry into and concerning the employment of the class of employees known as commission-paid salespeople who are employed in the banking industry in Canada and to report to the Minister as to whether the general hours of work provisions of that Act can reasonably be applied to that class of employees without adversely affecting the banks and the employees;</Text></Provision><Provision lims:inforce-start-date="2006-05-11" lims:fid="728794" lims:id="728794" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Whereas the Commissioner reported to the Minister of Labour that the hours of work provided for in the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> are not suitable for that class of employees and that the class should be exempted from the application of sections 169<FootnoteRef idref="footnotea_e">a</FootnoteRef>, 171 and 174 of that Act;</Text><Footnote id="footnotea_e" placement="page" status="official"><Label>a</Label><Text>S.C. 1993, c. 42, s. 14</Text></Footnote></Provision><Provision lims:inforce-start-date="2006-05-11" lims:fid="728795" lims:id="728795" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>And whereas the Governor in Council is satisfied that sections 169<FootnoteRef>a</FootnoteRef>, 171 and 174 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal> cannot reasonably be applied to that class of employees;</Text></Provision><Provision lims:inforce-start-date="2006-05-11" lims:fid="728796" lims:id="728796" format-ref="indent-0-0" language-align="yes" list-item="no"><Text>Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Labour, pursuant to paragraph 175(1)(b) of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>, hereby makes the annexed <XRefExternal reference-type="regulation">Banking Industry Commission-paid Salespeople Hours of Work Regulations</XRefExternal>.</Text></Provision></Order><Body lims:inforce-start-date="2006-05-11" lims:fid="728797" lims:id="728797"><Heading lims:inforce-start-date="2006-05-11" lims:fid="728798" lims:id="728798" level="1"><TitleText>Exemption</TitleText></Heading><Section lims:inforce-start-date="2006-05-11" lims:lastAmendedDate="2006-05-11" lims:fid="728799" lims:id="728799"><Label>1</Label><Text>The class of employees known as commission-paid salespeople who are employed in the banking industry in Canada are exempt from the application of sections 169, 171 and 174 of the <XRefExternal reference-type="act" link="L-2">Canada Labour Code</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2006-05-11" lims:fid="728800" lims:id="728800" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2006-05-11" lims:lastAmendedDate="2006-05-11" lims:fid="728801" lims:id="728801" type="transitional"><Label>2</Label><Text>These Regulations come into force on the day on which they are registered.</Text></Section></Body></Regulation>
