Act</XRefExternal>. (<DefinedTermFr>Loi</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="727505" lims:id="727505" generate-in-text="no"><Text><DefinedTermEn>Class A Reserve Service</DefinedTermEn> has the same meaning as in subarticle 9.06(1) of the <XRefExternal reference-type="regulation">Queen’s Regulations and Orders for the Canadian Forces</XRefExternal> and includes proceeding to and returning from the place where the training or duty is performed. (<DefinedTermFr>service de réserve de classe A</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2018-04-01" lims:fid="727506" lims:id="727506" generate-in-text="no"><Text><DefinedTermEn>Class B Reserve presence of a disability or a temporary or permanent physical or mental health problem that limits or prevents an individual’s reasonable performance in civilian life of their roles in the workplace, lims:enactId="1044721">SOR/2018-177, s. 1</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-01" lims:fid="727513" lims:id="727513" level="1"><Label>PART 1</Label><TitleText>Career Transition Services</TitleText><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727515" lims:id="727515">SOR/2011-219, s. 1</HistoricalNoteSubItem></HistoricalNote></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727516" lims:id="727516"><Label>2</Label><Text>The following career transition services may be provided under Part 1 of the Act:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727517" lims:id="727517"><Label>(a)</Label><Text>the provision of labour market information;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727518" lims:id="727518"><Label>(b)</Label><Text>career counselling; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727519" lims:id="727519"><Label>(c)</Label><Text>job-finding assistance.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727521" lims:id="727521">SOR/2011-219, s. 2; SOR/2012-289, s. 13; SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727522" lims:id="727522"><Label>3</Label><Text>An application under subsection 3(1) of the Act shall be made in writing and shall include, at the Minister’s request, any information or documents that are necessary to enable the Minister to assess the applicant’s eligibility for the services.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727524" lims:id="727524">SOR/2011-219, s. 3; SOR/2012-289, s. 13; SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727525" lims:id="727525"><Label>4</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727526" lims:id="727526"><Label>(1)</Label><Text>For the purposes of subsection 3(2) of the Act, a member’s absences from Canada shall be deemed not to have interrupted residence in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727527" lims:id="727527"><Label>(2)</Label><Text>For the purposes of subsections 3(3) and (4) of the Act, any intervals of absence from Canada totalling 183 days or less during a calendar year shall be deemed not to have interrupted residence in Canada.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727529" lims:id="727529">SOR/2011-219, s. 4; lims:fid="727530" lims:id="727530"><Label>4.1</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727531" lims:id="727531"><Label>(1)</Label><Text>For the purposes of section 5 of the Act, the Minister may suspend the provision of career transition services so long as the person does not participate to the extent required to meet the objectives of the career transition plan.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727532" lims:id="727532"><Label>(2)</Label><Text>Before suspending the provision of the services, the Minister shall provide the person with written notification of the reasons for the suspension and the effective date of the suspension.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727534" lims:id="727534">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727535" lims:id="727535"><Label>4.2</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727536" lims:id="727536"><Label>(1)</Label><Text>For the purposes of section 5 of the Act, the Minister may cancel the provision of career transition services if</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727537" lims:id="727537"><Label>(a)</Label><Text>the person’s eligibility was based on a misrepresentation or the concealment of a material fact; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727538" lims:id="727538"><Label>(b)</Label><Text>a suspension under section 4.1 continues for at least six months.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727539" lims:id="727539"><Label>(2)</Label><Text>On cancelling the provision of the services, the Minister shall provide the person with written notification of the reasons for the cancellation, the effective date of the cancellation and their rights of review.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727541" lims:id="727541">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2018-04-01" lims:fid="727542" lims:id="727542" level="1"><Label>PART 1.1</Label><TitleText>Education and Training Benefit</TitleText></Heading><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727543" lims:id="727543"><Label>5</Label><Text>An application under section 5.2 of the Act shall be made in writing and shall include</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727544" lims:id="727544"><Label>(a)</Label><Text>the length and type of service; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727545" lims:id="727545"><Label>(b)</Label><Text>at the Minister’s request, any other information or documents that are necessary to enable the Minister to assess the applicant’s eligibility for the benefit.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727547" lims:id="727547">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727548" lims:id="727548"><Label>5.01</Label><Text>For the purposes of paragraph 5.‍2(1)‍(a) of the Act, the length of service in the reserve force is to be determined in accordance with section 3 of the <XRefExternal reference-type="regulation" link="C.R.C.,_c._396">Canadian Forces Superannuation Regulations</XRefExternal>.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727550" lims:id="727550">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727551" lims:id="727551"><Label>5.02</Label><Text>For the purposes of subsection 5.3(2) of the Act, a veteran shall provide</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727552" lims:id="727552"><Label>(a)</Label><Text>for the initial period of study, an education and training plan that includes</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="727553" lims:id="727553"><Label>(i)</Label><Text>the name and description of the course of study,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="727554" lims:id="727554"><Label>(ii)</Label><Text>the tuition fees and any other related fees for which the veteran is requesting payment, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="727555" lims:id="727555"><Label>(iii)</Label><Text>the anticipated duration of the course of study for the veteran; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727556" lims:id="727556"><Label>(b)</Label><Text>for any subsequent period of study,</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="727557" lims:id="727557"><Label>(i)</Label><Text>the tuition fees and any other related fees for which the veteran is requesting payment, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="727558" lims:id="727558"><Label>(ii)</Label><Text>the results obtained for the previous period of study.</Text></Subparagraph></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727560" lims:id="727560">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727561" lims:id="727561"><Label>5.03</Label><Text>For the purposes of section 5.4 of the Act, the prescribed amount of the education and training completion bonus is $1,000.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727563" lims:id="727563">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727564" lims:id="727564"><Label>5.04</Label><Text>An application for an education and training completion bonus under section 5.4 of the Act shall be in writing and shall include proof of the degree, diploma, certification or designation received.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727566" lims:id="727566">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727567" lims:id="727567"><Label>5.05</Label><Text>For the purposes of subsection 5.5(2) of the Act, the prescribed maximum cumulative amount is $5000.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727569" lims:id="727569">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727570" lims:id="727570"><Label>5.06</Label><Text>The following information is prescribed for the purposes of subsection 5.5(3) of the Act:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727571" lims:id="727571"><Label>(a)</Label><Text>the duration of the education or training; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727572" lims:id="727572"><Label>(b)</Label><Text>proof of enrolment.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727574" lims:id="727574">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727575" lims:id="727575"><Label>5.07</Label><Text>For the purposes of subsection 5.9(3) of the Act, the Minister may pay an education and training benefit after it would otherwise cease to be payable if</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727576" lims:id="727576"><Label>(a)</Label><Text>due to circumstances beyond the veteran’s control, the veteran is unable to complete their course of study before the benefit ceases to be payable under subsection 5.9(1) of the Act; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727577" lims:id="727577"><Label>(b)</Label><Text>the veteran notifies the Minister as soon as practicable after the circumstances arise.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727579" lims:id="727579">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727580" lims:id="727580"><Label>5.08</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727581" lims:id="727581"><Label>(1)</Label><Text>The amounts referred to in subsection 5.2(2) of the Act and the amount set out in section 5.05 of these Regulations shall be adjusted annually on January 1 in accordance with the percentage increase to the Consumer Price Index, rounded to the next 0.10%, for the year ending on October 31 of the previous year.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727582" lims:id="727582"><Label>(2)</Label><Text>The Consumer Price Index is the annual average all-items Consumer Price Index for Canada (not seasonally adjusted) published by Statistics Canada.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727584" lims:id="727584">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727585" lims:id="727585"><Label>5.09</Label><Text>For the purposes of paragraph 5.2(1)(b) of the Act, an honourable release is a release for any of the following reasons:</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727586" lims:id="727586"><Label>(a)</Label><Text>medical;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727587" lims:id="727587"><Label>(b)</Label><Text>voluntary; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727588" lims:id="727588"><Label>(c)</Label><Text>service completed.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727590" lims:id="727590">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727591" lims:id="727591"><Label>5.1</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727592" lims:id="727592"><Label>(1)</Label><Text>For the purposes of section 5.92 of the Act, the Minister may suspend the payment of an education and training benefit if the results obtained by the veteran for previous periods of study demonstrate that the veteran is not</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727593" lims:id="727593"><Label>(a)</Label><Text>progressing in the course of study to the extent required to meet the objectives of their education and training plan; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727594" lims:id="727594"><Label>(b)</Label><Text>maintaining satisfactory academic standing within the educational institution.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727595" lims:id="727595"><Label>(2)</Label><Text>Before suspending the payment of the benefit, the Minister shall provide the veteran with written notification of the reasons for the suspension and the effective date of the suspension.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="727597" lims:id="727597">SOR/2017-161, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="727598" lims:id="727598"><Label>5.11</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="727599" lims:id="727599"><Label>(1)</Label><Text>For the purposes of section 5.92 of the Act, the Minister may cancel an education and training benefit if</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727600" lims:id="727600"><Label>(a)</Label><Text>the veteran’s eligibility for the benefit was based on a misrepresentation or the concealment of a material fact;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="727601" lims:id="727601"><Label>(b)</Label><Text>the results obtained by the veteran whose payment is suspended under subsection 5.1(1) for a previous period of study continue to demonstrate that the veteran is not</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="727602" lims:id="727602"><Label>(i)</Label><Text>progressing in the course of study to the extent required to meet the objectives of their education and training plan, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="727603" lims:inforce-start-date="2018-04-01" lims:fid="727604" lims:id="727604"><Label>(c)</Label><Text>the veteran fails to comply with a request made under subsection 5.3(2) and (3) or 5.5(3) and (4) of the lims:fid="1119531" lims:id="1121918">For the purposes of subsection 10(4) and paragraph 13(4)(a) of the Act, the Minister shall have regard to the following principles:</Text><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727626" lims:id="727626"><Label>(a)</Label><Text>that the provision of services be focused on addressing the needs of the applicant;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727627" lims:id="727627"><Label>(b)</Label><Text>that the provision of services will involve family members to the extent required to facilitate the rehabilitation;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727628" lims:id="727628"><Label>(c)</Label><Text>that the services be provided as soon as practicable;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727629" lims:id="727629"><Label>(d)</Label><Text>that the services provided be focused on building the applicant’s education, skills, training and experience; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727630" lims:id="727630"><Label>(e)</Label><Text>that the services provided not be focused solely on the applicant’s military occupation.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem employability and quality of life;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727635" lims:id="727635"><Label>(b)</Label><Text>the need for family members to be involved in the provision of services;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727636" lims:id="727636"><Label>(c)</Label><Text>the availability of local resources;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727637" lims:id="727637"><Label>(d)</Label><Text>the motivation, interest and aptitudes of the applicant;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727638" lims:id="727638"><Label>(e)</Label><Text>the cost effectiveness of the plan; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-04-01" lims:fid="727639" lims:id="727639"><Label>(f)</Label><Text>the duration of the lims:id="1121927"><Label>10</Label><Text>An application for rehabilitation services or vocational assistance shall be in writing and shall be accompanied by</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121929" lims:id="1121929"><Label>(i)</Label><Text>medical reports or other records that document the veteran’s physical or mental health problem,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121930" lims:id="1121930"><Label>(ii)</Label><Text>any information or document that indicates the nature of the veteran’s service in the Canadian Forces, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121931" lims:id="1121931"><Label>(iii)</Label><Text>any other information or document that indicates the circumstances of the veteran’s physical or mental health problem that the veteran considers to be relevant in support of the application;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121932" lims:id="1121932"><Label>(b)</Label><Text>in the case of a survivor’s application,</Text><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121933" lims:id="1121933"><Label>(i)</Label><Text>a copy of the member’s or veteran’s death certificate, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121934" lims:id="1121934"><Label>(ii)</Label><Text>medical reports or other records that document the member’s or veteran’s injury or disease, diagnosis and cause of death;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121935" lims:id="1121935"><Label>(c)</Label><Text>a declaration attesting to the truth of the information provided; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121936" lims:id="1121936"><Label>(d)</Label><Text>at the Minister’s request, any other information or documents that are necessary to enable the Minister to assess the applicant’s rehabilitation services or vocational assistance shall provide, at the request of the Minister, the following information and documents relating to the provision of the services or assistance:</Text><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727656" lims:id="727656"><Label>(a)</Label><Text>attendance reports;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727657" lims:id="727657"><Label>(b)</Label><Text>evaluations, assessments and progress reports; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727658" lims:id="727658"><Label>(c)</Label><Text>any other information or documents that are necessary to enable the Minister to assess the person’s continued eligibility for the services or assistance.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-12-08" lims:fid="727659" lims:id="727659"><Label>(2)</Label><Text>If a person fails to comply with a request under subsection (1), the Minister may suspend the delivery of rehabilitation services or vocational assistance until the information and documents are provided.</Text></Subsection><Subsection lims:inforce-start-date="2011-12-08" lims:fid="727660" lims:id="727660"><Label>(3)</Label><Text>Before suspending the delivery of services or assistance, the Minister shall provide the person with written notification of the reasons for the suspension and the effective date of the suspension.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-12-08" lims:fid="727662" lims:id="727662">SOR/2009-225, s. 4(F); SOR/2011-302, s. 3(E)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2006-03-23" lims:fid="727663" lims:id="727663"><Label>13</Label><Text>The Service Income Security Insurance Plan Long Term Disability (LTD) is prescribed for the purpose of subsection 16(1) of the Act.</Text></Section><Section lims:inforce-start-date="2009-07-30" lims:lastAmendedDate="2009-07-30" lims:fid="727664" lims:id="727664"><Label>14</Label><Subsection lims:inforce-start-date="2009-07-30" lims:fid="727665" lims:id="727665"><Label>(1)</Label><Text>For the purposes of section 17 of the Act, the Minister may cancel a person’s rehabilitation plan or vocational assistance plan if</Text><Paragraph lims:inforce-start-date="2009-07-30" lims:fid="727666" lims:id="727666"><Label>(a)</Label><Text>the person does not participate to the extent required to meet the goals of the plan;</Text></Paragraph><Paragraph lims:inforce-start-date="2009-07-30" lims:fid="727667" lims:id="727667"><Label>(b)</Label><Text>the person’s eligibility for the plan or the development of the plan was based on a misrepresentation or the concealment of a material fact; or</Text></Paragraph><Paragraph lims:inforce-start-date="2009-07-30" lims:fid="727668" lims:id="727668"><Label>(c)</Label><Text>the person, at least 6 months after the effective date of a suspension, continues to fail to comply with a request made under subsection 12(1).</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2009-07-30" lims:fid="727669" lims:id="727669"><Label>(2)</Label><Text>On cancelling a rehabilitation plan or vocational assistance plan, the Minister shall provide the person with written notification of the reasons for the cancellation, the effective date of the cancellation and their rights of review.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2009-07-30" lims:fid="727671" lims:id="727671">SOR/2009-225, s. 5(F)</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2013-10-01" lims:lastAmendedDate="2013-10-01" lims:fid="727672" lims:id="727672"><Label>15</Label><Subsection lims:inforce-start-date="2013-10-01" lims:fid="727673" lims:id="727673"><Label>(1)</Label><Text>The Minister may pay the following expenses arising out of a person’s participation in a rehabilitation plan or a vocational assistance plan:</Text><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="727674" lims:id="727674"><Label>(a)</Label><Text>in the case of training,</Text><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727675" lims:id="727675"><Label>(i)</Label><Text>those required by the training institution including tuition fees, books, computers and peripheral equipment, software, safety equipment, special clothing and tools,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727676" lims:id="727676"><Label>(ii)</Label><Text>examination and licensing fees,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727677" lims:id="727677"><Label>(iii)</Label><Text>Internet access,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727678" lims:id="727678"><Label>(iv)</Label><Text>school supplies,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727679" lims:id="727679"><Label>(v)</Label><Text>tutoring,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727680" lims:id="727680"><Label>(vi)</Label><Text>transportation to and from the training facility</Text><Clause lims:inforce-start-date="2013-10-01" lims:fid="727681" lims:id="727681"><Label>(A)</Label><Text>when a private vehicle is used, at a rate equal to the greater of 15 cents/km and the applicable lower kilometric rate set out in Appendix A of the <XRefExternal reference-type="citation">Commuting Assistance Directive</XRefExternal> published by the National Joint Council of the Public Service of Canada as amended from time to time, and</Text></Clause><Clause lims:inforce-start-date="2013-10-01" lims:fid="727682" lims:id="727682"><Label>(B)</Label><Text>when public transport is used, the cost of that transport,</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727683" lims:id="727683"><Label>(vii)</Label><Text>the cost of a pass or permit for parking at or near the training facility for the duration of the training,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727684" lims:id="727684"><Label>(viii)</Label><Text>if the approved training is not available at a training facility located within a distance that would allow for daily commuting from the person’s residence, the costs of temporary accommodations and the cost of one return trip per year from the person’s residence to the location of the training facility for the purpose of establishing the temporary accommodations,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727685" lims:id="727685"><Label>(ix)</Label><Text>any other expenses that are required to enable the person to meet an occupational goal in the approved rehabilitation or vocational assistance plan, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727686" lims:id="727686"><Label>(x)</Label><Text>50% of the cost of additional dependant care, to a maximum amount of $750 per month; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="727687" lims:id="727687"><Label>(b)</Label><Text>in the case of services, other than training,</Text><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727688" lims:id="727688"><Label>(i)</Label><Text>the costs of meals, transportation and accommodations incurred by the person in accordance with the rates set out in the Treasury Board Travel Directive, as amended from time to time, subject to the following conditions:</Text><Clause lims:inforce-start-date="2013-10-01" lims:fid="727689" lims:id="727689"><Label>(A)</Label><Text>if the means of transportation is a taxi, $5.00 shall be deducted from the cost of each trip unless the person’s mobility or cognition is severely impaired or the deduction would severely impede the person’s ability to access the services, or</Text></Clause><Clause lims:inforce-start-date="2013-10-01" lims:fid="727690" lims:id="727690"><Label>(B)</Label><Text>if the means of transportation is an automobile other than a taxi, the costs of transportation shall be paid at the rate applicable to employees of the public service of Canada who have requested the use of their own automobile plus 2 cents per kilometre and shall include the costs of parking,</Text></Clause></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727691" lims:id="727691"><Label>(ii)</Label><Text>if the person’s health needs in respect of the rehabilitation plan require the person to be accompanied by an escort while travelling, the costs of the escort’s meals, transportation and accommodations in accordance with subparagraph (i),</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727692" lims:id="727692"><Label>(iii)</Label><Text>the remuneration of an escort referred to in subparagraph (ii) if the escort is not the spouse, the common-law partner or a dependant of the person or any other member of that person’s household, at a daily rate computed by dividing by 30 the sum of basic and additional pension payable for a spouse or common-law partner at the rate set out in class 1 of Schedule I to the <XRefExternal reference-type="act" link="P-6">Pension Act</XRefExternal>, as adjusted in accordance with Part V of that Act, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="727693" lims:id="727693"><Label>(iv)</Label><Text>the costs of additional dependant care, to a maximum of $75 per day.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="727694" lims:id="727694"><Label>(2)</Label><Text>If a person receives rehabilitation services or vocational assistance in a country other than Canada, the costs referred to in paragraph (1)(b) are payable at the same rates and subject to the same conditions that are established for former members of the armed forces of that country for similar costs, or, if no such rates or conditions are established, at the rates and conditions that would be payable if the person were resident in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="727695" lims:id="727695"><Label>(3)</Label><Text>The maximum amount that may be paid under subparagraphs (1)(a)(i) to (ix) is $75,800 unless a higher amount is necessary to enable the person to meet an occupational goal in an approved rehabilitation or vocational assistance plan.</Text></Subsection><Subsection lims:inforce-start-date="2013-10-01" lims:fid="727696" lims:id="727696"><Label>(4)</Label><Text>The Minister may pay more than the percentage and maximum amount set out in subparagraph (1)(a)(x)</Text><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="727697" lims:id="727697"><Label>(a)</Label><Text>if there are more than three dependants requiring care;</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="727698" lims:id="727698"><Label>(b)</Label><Text>if necessary as a result of the availability or location of care; or</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="727699" lims:id="727699"><Label>(c)</Label><Text>if necessary to enable the person to meet an occupational goal in an approved rehabilitation or vocational assistance plan.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-10-01" lims:fid="727701" lims:id="727701">SOR/2009-225, s. 6(E); lims:id="727702"><Label>16</Label><Text>A claim for reimbursement must be made in writing within one year after the day on which the expenditure is incurred and must include proof of the lims:id="1121943"><Label>17</Label><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121944" lims:id="1121944"><Label>(1)</Label><Text>An application for an income replacement benefit shall be in writing and shall include</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121945" lims:id="1121945"><Label>(a)</Label><Text>in the case of an application made under subsection 18(1) of the Act,</Text><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" 19(1) of the Act,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121947" lims:id="1121947"><Label>(ii)</Label><Text>medical reports or other records that document the veteran’s physical or mental health problem,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121948" lims:id="1121948"><Label>(iii)</Label><Text>any information or document that indicates the nature of the veteran’s service in the Canadian Forces, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121949" lims:id="1121949"><Label>(iv)</Label><Text>any other information or document that indicates the circumstances of the veteran’s physical or mental health problem that the veteran considers to be relevant in support of the application;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121950" lims:id="1121950"><Label>(b)</Label><Text>in the case of an application made under subsection 22(1) of the Act,</Text><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121951" lims:id="1121951"><Label>(i)</Label><Text>information that is necessary to determine the imputed income in respect of the member or veteran referred to in subsection 23(3) of the Act and all amounts payable from prescribed sources in respect of the member or veteran,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121952" lims:id="1121952"><Label>(ii)</Label><Text>a copy of the member’s or veteran’s death certificate, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121953" lims:id="1121953"><Label>(iii)</Label><Text>medical reports or other records that document the member’s or veteran’s injury or disease, diagnosis and cause of death;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121954" lims:id="1121954"><Label>(c)</Label><Text>in the case of an application made under subsection 24(1) or 26(1) of the Act, a copy of the member’s or veteran’s death certificate; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121955" lims:id="1121955"><Label>(d)</Label><Text>in all cases,</Text><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121956" lims:id="1121956"><Label>(i)</Label><Text>a declaration attesting to the truth of the information provided, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121957" lims:id="1121957"><Label>(ii)</Label><Text>at the Minister’s request, any other information or documents that are necessary to enable the Minister to assess the applicant’s eligibility for the benefit or to determine the amount payable.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121958" lims:id="1121958"><Label>(2)</Label><Text>For the purposes of paragraph 18(3)(a) of the Act, the information and documents referred to in subparagraphs (1)(a)(ii) to (iv) are the prescribed information.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-12-08" lims:id="1121961"><Label>(1)</Label><Text>For the purposes of subsection 18(5) of the Act, the Minister shall, in determining whether the veteran has a diminished earning capacity that is due to a physical or mental health problem, require that the veteran undergo a vocational assessment and shall use the results of that assessment in making the determination.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121962" lims:id="1121962"><Label>(2)</Label><Text>Despite subsection (1), the Minister may, in lieu of requiring that the veteran undergo the vocational assessment, make the determination based on medical reports or other records, information or documents available to the Minister, if he or she is of the opinion that those reports or records, information or documents are sufficient to make the determination.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" of the value of the veteran’s monthly military salary at the time of release from that service and the value of the minimum amount,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121971" lims:id="1121971"><Label>(ii)</Label><Text>at any time during Class C Reserve Service, the greater of the value of the veteran’s monthly military salary on the date of completion of the Class C Reserve Service and the value of the minimum amount, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121972" lims:id="1121972"><Label>(iii)</Label><Text>at any time during Class A Reserve Service or Class B Reserve Service, the greater of the value of the veteran’s monthly military salary on the date of completion of the Class A Reserve Service or Class B Reserve Service and the value of the minimum amount.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121973" lims:id="1121973"><Label>(2)</Label><Text>The value of the monthly military salary and of the minimum amount referred to in subsection (1) are determined on the date on which the benefit is payable and in each subsequent year, taking into account the adjustments referred to in subsections 21(1) and 21.1(1).</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121974" lims:id="1121974"><Label>(3)</Label><Text>For the purposes of subsection 115(2) of the Act, the imputed income that is taken into account in the determination of the benefit referred to in that subsection is equal to</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121975" lims:id="1121975"><Label>(a)</Label><Text>in the case of a veteran whose final release was from the regular force, the greater of the value of the veteran’s monthly military salary at the time of release and the value of the minimum amount; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121976" lims:id="1121976"><Label>(b)</Label><Text>in the case of a veteran whose final release was from the reserve lims:id="1121977"><Label>(i)</Label><Text>during regular force service, the greater of the value of the veteran’s monthly military salary at the time of release from that service and the value of the minimum amount,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121978" lims:id="1121978"><Label>(ii)</Label><Text>at any time during Class C Reserve Service, the greater of the value of the veteran’s monthly military salary on the date of completion of the Class C Reserve Service and the value of the minimum amount, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121979" lims:id="1121979"><Label>(iii)</Label><Text>at any time during Class A Reserve Service or Class B Reserve Service, the greater of the value of the veteran’s monthly military salary on the date of completion of the Class A Reserve Service or Class B Reserve Service and the value of the minimum amount.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1121980" lims:id="1121980"><Label>(4)</Label><Text>The value of the monthly military salary and of the minimum amount referred to in subsection (3) are determined on March 31, 2019, taking into account the lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122002" lims:id="1122002"><Label>(i)</Label><Text>during regular force service, the greater of the value of the member’s monthly military salary at the time of release from that service and the value of the minimum amount,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122003" lims:id="1122003"><Label>(ii)</Label><Text>at any time during Class C Reserve Service, the greater of the value of the member’s monthly military salary — on the earlier of the date of completion of the Class C Reserve Service and the date of the member’s death — and the value of the minimum amount, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122004" lims:id="1122004"><Label>(iii)</Label><Text>at any time during Class A Reserve Service or Class B Reserve Service, the greater of the value of the member’s monthly military salary — on the earlier of the date of completion of the Class A Reserve Service or Class B Reserve Service and the date of the member’s death — and the value of the minimum amount.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122005" lims:id="1122005"><Label>(2)</Label><Text>The value of the monthly military salary and of the minimum amount referred to in subsection (1) are determined on the date on which the benefit is payable and in each subsequent year, taking into account the adjustments referred to in subsections 21(1) and 21.1(1).</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122006" lims:id="1122006"><Label>(3)</Label><Text>For the purposes of subsection 23(1) of the Act, the imputed income of a veteran referred to in subsection 22(1) of the Act is equal to</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122007" lims:id="1122007"><Label>(a)</Label><Text>in the case of a deceased veteran whose final release was from the regular force, the greater of the value of the veteran’s monthly military salary at the time of release and the value of the minimum amount; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122008" lims:id="1122008"><Label>(b)</Label><Text>in the case of a deceased veteran whose final release was from the reserve force, if the injury or disease that resulted in the death was incurred, contracted or aggravated, as the case may be,</Text><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122009" lims:id="1122009"><Label>(i)</Label><Text>during regular force service, the greater of the value of the veteran’s monthly military salary at the time of release from that service and the value of the minimum amount,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122010" lims:id="1122010"><Label>(ii)</Label><Text>at any time during Class C Reserve Service, the greater of the value of the veteran’s monthly military salary on the date of completion of the Class C Reserve Service and the value of the minimum amount, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122011" lims:id="1122011"><Label>(iii)</Label><Text>at any time during Class A Reserve Service or Class B Reserve Service, the greater of the value of the veteran’s monthly military salary on the date of completion of the Class A Reserve Service or Class B Reserve Service and the value of the minimum amount.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122012" lims:id="1122012"><Label>(4)</Label><Text>The value of the monthly military salary and of the minimum amount referred to in subsection (3) are determined on the date on which the benefit is payable and in each subsequent year, taking into account the adjustments referred to in subsections 21(1) and 21.1(1).</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122013" lims:id="1122013"><Label>(5)</Label><Text>For the purposes of subsection 118(2) of the Act, the imputed income that is taken into account in the determination of the benefit referred to in that subsection is equal to</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122014" lims:id="1122014"><Label>(a)</Label><Text>in the case of a deceased veteran whose final release was from the regular force, the greater of the value of the veteran’s monthly military salary at the time of release and the value of the minimum amount; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122015" lims:id="1122015"><Label>(b)</Label><Text>in the case of a deceased veteran whose final release was from the reserve force, if the event that resulted in the physical or mental health problem occurred</Text><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122016" lims:id="1122016"><Label>(i)</Label><Text>during regular force service, the greater of the value of the veteran’s monthly military salary at the time of release from that service and the value of the minimum amount,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122017" lims:id="1122017"><Label>(ii)</Label><Text>at any time during Class C Reserve Service, the greater of the value of the veteran’s monthly military salary on the date of completion of the Class C Reserve Service and the value of the minimum amount, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122018" lims:id="1122018"><Label>(iii)</Label><Text>at any time during Class A Reserve Service or Class B Reserve Service, the greater of the value of the veteran’s monthly military salary on the date of completion of the Class A Reserve Service or Class B Reserve Service and the value of the minimum amount.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122019" lims:id="1122019"><Label>(6)</Label><Text>The value of the monthly military salary and of the minimum amount referred to in subsection (5) are determined on March 31, 2019, taking into account the adjustment referred to in subsection 21(1).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-10-01" sections 18 and 20 shall be adjusted annually on January 1 in accordance with the percentage increase to the Consumer Price Index, rounded to the next 0.10%, for the year ending on October 31 of the previous year.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122025" lims:id="1122025"><Label>(2)</Label><Text>The adjustments referred to in subsection (1) shall be made</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122026" lims:id="1122026"><Label>(a)</Label><Text>in the case of the monthly military salary, beginning at the time of release or on the date of completion of service or death of the member or veteran, as the case may be; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122027" lims:id="1122027"><Label>(b)</Label><Text>in the case of the minimum amount, beginning on April 1, 2019.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122028" lims:id="1122028"><Label>(3)</Label><Text>The amount determined for A in subsection 19.1(1) of the Act shall be adjusted annually on January 1 in accordance with the percentage increase to the Consumer Price Index, rounded to the next 0.10%, for the year ending on October 31 of the previous year, unless that amount has been replaced under subsection 99(4) or 115(3) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122029" lims:id="1122029"><Label>(4)</Label><Text>The income replacement benefit determined in accordance with subsection 26.1(1) of the Act shall be adjusted annually on January 1 in accordance with the percentage increase to the Consumer Price Index, rounded to the next 0.10%, for the year ending on October 31 of the previous year, unless that amount has been replaced under subsection 118(3) of the Act.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122030" lims:id="1122030"><Label>(5)</Label><Text>The Consumer Price Index is the annual average all-items Consumer Price Index for Canada (not seasonally adjusted) published by Statistics Canada.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122031" lims:id="1122031"><Label>(6)</Label><Text>For greater certainty, if the adjustments referred to in this section apply in respect of a period during a calendar year, that period is considered to be the calendar year for the purpose of that lims:id="1122040"><Label>(2)</Label><Text>The adjustments made to the monthly military salary under subsections 21(1) and 21.1(1) shall be made independently of one another.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122041" lims:id="1122041"><Label>(3)</Label><Text>For greater certainty, if the adjustment referred to in subsection (1) applies in respect of a period during a calendar year, that period is considered to be the calendar year for the purpose of that adjustment.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122042" lims:id="1122042"><Label>(4)</Label><Text>The adjustment referred to in subsection (1) shall not take effect, in respect of the amount of the income replacement benefit to be paid to a veteran, until the first day of the month in which the Minister determines under R-9;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122105" lims:id="1122105"><Label>(d)</Label><Text>benefits payable under the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122106" lims:id="1122106"><Label>(e)</Label><Text>benefits payable under any employer-sponsored long-term disability insurance plan;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122107" lims:id="1122107"><Label>(f)</Label><Text>compensation payable in respect of economic loss under the <XRefExternal reference-type="act" link="G-5">Government Employees Compensation Act</XRefExternal> or any provincial workers’ compensation legislation;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122108" lims:id="1122108"><Label>(g)</Label><Text>benefits payable under an employer-sponsored pension plan; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122109" lims:id="1122109"><Label>(h)</Label><Text>employment income in excess of $20,000 earned in a calendar year.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122110" lims:id="1122110"><Label>(2)</Label><Text>Any amounts payable to a veteran for a dependent child or in respect of the veteran’s deceased spouse or common-law partner are not to be included under subsection (1).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122112" lims:id="1122112" lims:enactId="1044733">SOR/2018-177, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="1122113" lims:id="1122113"><Label>24.2</Label><Text>For the purposes of paragraph 24.1(1)(h), the following are taken into account in determining the annual employment income of a veteran referred to in subsection 19.1(1) of the Act:</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122114" lims:id="1122114"><Label>(a)</Label><Text>in the first year during which the income replacement benefit begins to be payable, employment income earned during the period beginning on the first day of the month in which the benefit begins to be payable to the veteran and ending on December 31 of that year; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122115" lims:id="1122115"><Label>(b)</Label><Text>in subsequent years, employment income earned in each calendar year.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122117" lims:id="1122117" lims:enactId="1044733">SOR/2018-177, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="1122118" lims:id="1122118"><Label>24.3</Label><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122119" lims:id="1122119"><Label>(1)</Label><Text>The following sources are prescribed for the purposes of subsection 26.1(3) of the Act:</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122120" lims:id="1122120"><Label>(a)</Label><Text>benefits payable under the <XRefExternal reference-type="act" link="C-17">Canadian Forces Superannuation Act</XRefExternal> or the <XRefExternal reference-type="act" link="P-36">Public Service Superannuation Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122121" lims:id="1122121"><Label>(b)</Label><Text>benefits payable under Part I of the <XRefExternal reference-type="act" link="R-11">Royal Canadian Mounted Police Superannuation Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122122" lims:id="1122122"><Label>(c)</Label><Text>benefits payable under the <XRefExternal reference-type="act" link="C-8">Canada Pension Plan</XRefExternal> or the <XRefExternal reference-type="act">Act respecting the Québec Pension Plan</XRefExternal>, CQLR, c. and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122126" lims:id="1122126"><Label>(g)</Label><Text>benefits payable under an employer-sponsored pension plan.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122127" lims:id="1122127"><Label>(2)</Label><Text>Any amounts payable to a survivor for a dependent child are not to be included under subsection (1).</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122129" lims:id="1122129" lims:enactId="1044733">SOR/2018-177, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="1122130" lims:id="1122130"><Label>24.4</Label><Text>If, during a calendar year, an amount from a prescribed source referred to in subsection 24.1(1) or 24.3(1) is paid other than on a monthly basis, it shall be converted into an amount payable for a month by dividing the total amount paid from that source by 12 and</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122131" lims:id="1122131"><Label>(a)</Label><Text>if it relates to the calendar year in which it is paid, shall be considered for the purpose of that calendar year;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122132" lims:id="1122132"><Label>(b)</Label><Text>if it relates to a previous calendar year, shall be considered for the purpose of that previous calendar year; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122133" lims:id="1122133"><Label>(c)</Label><Text>if it relates to a subsequent calendar year, shall be considered for the purpose of the calendar year in which it is paid.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122135" lims:id="1122135" lims:enactId="1044733">SOR/2018-177, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="727777" lims:id="1122136"><Label>25</Label><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122137" lims:id="1122137"><Label>(1)</Label><Text>A person referred to in subsection 19(1) or paragraph 23(1)(a) of the Act who is entitled to an income replacement benefit shall</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122138" lims:id="1122138"><Label>(a)</Label><Text>in the case of a veteran, notify the Minister of their employment income and provide the Minister with an annual statement of their employment income;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122139" lims:id="1122139"><Label>(b)</Label><Text>notify the Minister of any change to amounts payable from sources referred to in subsection <XRefInternal>22</XRefInternal>(1) or <XRefInternal>23</XRefInternal>(1);</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122140" lims:id="1122140"><Label>(c)</Label><Text>provide the Minister with annual statements of amounts payable from sources referred to in subsection <XRefInternal>22</XRefInternal>(1) or <XRefInternal>23</XRefInternal>(1); and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122141" lims:id="1122141"><Label>(d)</Label><Text>at the Minister’s request, provide any other information or documents that are necessary to enable the Minister to assess the person’s continued eligibility for the benefit or to determine the amount of the benefit payable.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122142" lims:id="1122142"><Label>(2)</Label><Text>A person referred to in subsection 19.1(1), paragraph 23(1)(b) or subsection 26.1(1) of the Act who is entitled to an income replacement benefit shall</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122143" lims:id="1122143"><Label>(a)</Label><Text>in the case of a veteran, notify the Minister of their employment income;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122144" lims:id="1122144"><Label>(b)</Label><Text>notify the Minister of any change to amounts payable from sources referred to in subsection <XRefInternal>23</XRefInternal>(2), <XRefInternal>24.1</XRefInternal>(1) or <XRefInternal>24.3</XRefInternal>(1); and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122145" lims:id="1122145"><Label>(c)</Label><Text>at the Minister’s request, provide any other information or documents that are necessary to enable the Minister to assess the person’s continued eligibility for the benefit or to determine the amount of the benefit payable.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2013-01-01" lims:fid="727788" lims:id="727788">SOR/2009-225, s. 8; SOR/2011-302, s. 5; SOR/2012-289, s. 14(E)</HistoricalNoteSubItem><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122146" lims:id="1122146" lims:enactId="1044733">SOR/2018-177, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="1122147" lims:id="1122147"><Label>25.1</Label><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122148" lims:id="1122148"><Label>(1)</Label><Text>For the purposes of section 21 of the Act, the Minister may suspend the payment of an income replacement benefit to a veteran who fails to do either of the following until the situation that gave rise to the suspension is resolved:</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122149" lims:id="1122149"><Label>(a)</Label><Text>provide the information or documents required under section <XRefInternal>25</XRefInternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122150" lims:id="1122150"><Label>(b)</Label><Text>comply with paragraph 18(2)(b) of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122151" lims:id="1122151"><Label>(2)</Label><Text>For the purposes of section 26.2 of the Act, the Minister may suspend the payment of an income replacement benefit to a person who is entitled to that benefit if they fail to provide the information or documents required under section <XRefInternal>25</XRefInternal> until the information and documents are provided.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122152" lims:id="1122152"><Label>(3)</Label><Text>Before suspending the payment of the income replacement benefit, the Minister shall provide the person with written notification of the reasons for the suspension and the effective date of the suspension.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122154" lims:id="1122154" lims:enactId="1044733">SOR/2018-177, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="727789" lims:id="1122155"><Label>26</Label><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122156" lims:id="1122156"><Label>(1)</Label><Text>For the purposes of sections 21 and 26.2 of the Act, the Minister may cancel the payment of an income replacement benefit if</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122157" lims:id="1122157"><Label>(a)</Label><Text>the situation that gave rise to the suspension of the payment of the benefit is not resolved within six months from the effective date of the suspension; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122158" lims:id="1122158"><Label>(b)</Label><Text>the assessment of the person’s eligibility for the benefit or the determination of the amount payable was based on a misrepresentation or the concealment of a material fact.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122159" lims:id="1122159"><Label>(2)</Label><Text>On cancelling the payment of the income replacement benefit, the Minister shall provide the person with written notification of the reasons for the cancellation, the effective date of the cancellation and their rights of review.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122161" lims:id="1122161" lims:enactId="1044733">SOR/2018-177, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="727794" lims:id="1122162"><Label>27</Label><Text><Repealed>[Repealed, SOR/2018-177, s. 8]</Repealed></Text></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="727802" lims:id="1122163"><Label>28</Label><Text><Repealed>[Repealed, SOR/2018-177, s. 8]</Repealed></Text></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="727810" lims:id="1122164"><Label>29</Label><Text><Repealed>[Repealed, SOR/2018-177, s. 8]</Repealed></Text></Section><Heading lims:inforce-start-date="2018-04-01" lims:fid="727813" lims:id="727813" level="2"><TitleText>Canadian Forces Income Support Benefit</TitleText></Heading><Section lims:inforce-start-date="2011-12-08" lims:lastAmendedDate="2011-12-08" lims:fid="727814" lims:id="727814"><Label>30</Label><Text>An application for a Canadian Forces income support benefit shall be in writing and shall be accompanied by</Text><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727815" lims:id="727815"><Label>(a)</Label><Text>a statement of income of the applicant and, if applicable, of their spouse or common-law partner;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727816" lims:id="727816"><Label>(b)</Label><Text>in the case of an application of a survivor or orphan,</Text><Subparagraph lims:inforce-start-date="2011-12-08" lims:fid="727817" lims:id="727817"><Label>(i)</Label><Text>a copy of the death certificate of the member or veteran, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-12-08" lims:fid="727818" lims:id="727818"><Label>(ii)</Label><Text>medical reports or other records that document the member’s or veteran’s injury or disease, diagnosis and cause of death;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727819" lims:id="727819"><Label>(c)</Label><Text>a declaration attesting to the truth of the information provided; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727820" lims:id="727820"><Label>(d)</Label><Text>at the request of the Minister, any other information or documents that are necessary to enable the Minister to assess whether the applicant is eligible for the benefit or the amount of benefit payable.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-12-08" lims:fid="727822" lims:id="727822">SOR/2011-302, s. 8</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2019-04-01" lims:fid="727823" lims:id="727823"><Label>31</Label><Text>The application shall be made</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="727824" lims:id="1122165"><Label>(a)</Label><Text>in the case of an initial application under section 27 of the Act, no later than six months after the last day of the last month in which the veteran was entitled to the income replacement benefit;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727825" lims:id="727825"><Label>(b)</Label><Text>in the case of an initial application under section 28 of the Act, no later than 6 months after the last day of the month in which the veteran dies; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727826" lims:id="727826"><Label>(c)</Label><Text>in the case of a subsequent application under section 27 or 28 of the Act, no later than 6 months after the last day of the month in which the benefit ceases to be payable under subsection 35(6) of the Act.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122167" lims:id="1122167" lims:enactId="1044735">SOR/2018-177, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2006-03-23" lims:fid="727827" lims:id="727827"><Label>32</Label><Text>For the purposes of paragraphs 27(b), 28(b) and 35(6)(b) of the Act, the veteran or survivor, as the case may be, must demonstrate that they are looking for and will accept employment that is available in the local labour market for which they are reasonably qualified by reason of their education, training or experience.</Text></Section><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2006-03-23" lims:fid="727828" lims:id="727828"><Label>33</Label><Text>For the purposes of section 33 and 34 of the Act, a person’s residence in Canada is presumed not to be interrupted if the person has been absent from Canada for 183 days or less in a calendar year.</Text></Section><Section lims:inforce-start-date="2011-12-08" lims:lastAmendedDate="2011-12-08" lims:fid="727829" lims:id="727829"><Label>34</Label><Subsection lims:inforce-start-date="2011-12-08" lims:fid="727830" lims:id="727830"><Label>(1)</Label><Text>A person who is in receipt of a Canadian Forces income support benefit shall</Text><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727831" lims:id="727831"><Label>(a)</Label><Text>notify the Minister of changes in income, or changes to monthly benefits payable from the sources referred to in section 37;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727832" lims:id="727832"><Label>(b)</Label><Text>in the case of a veteran, notify the Minister of changes in income, or changes in monthly benefits payable to their spouse or common-law partner from the sources referred to in section 37;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727833" lims:id="727833"><Label>(c)</Label><Text>in the case of a veteran, notify the Minister of changes to their spousal or common-law partner status and number of dependent children;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727834" lims:id="727834"><Label>(d)</Label><Text>in the case of an orphan, notify the Minister when they cease to follow a course of instruction;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727835" lims:id="727835"><Label>(e)</Label><Text>notify the Minister when they intend to be absent from Canada for more than 183 days in a calendar year; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-12-08" lims:fid="727836" lims:id="727836"><Label>(f)</Label><Text>at the request of the Minister, provide the information or documents referred to in any of paragraphs (a) to (e) or any other information or documents that are necessary to enable the Minister to assess the person’s continued eligibility for the benefit or to determine the amount of benefit payable.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-12-08" lims:fid="727837" lims:id="727837"><Label>(2)</Label><Text>For the purposes of section 36 of the Act, the Minister may suspend the payment of a Canadian Forces income support benefit to a person who fails to comply with subsection (1) until the information and documents are provided.</Text></Subsection><Subsection lims:inforce-start-date="2011-12-08" lims:fid="727838" lims:id="727838"><Label>(3)</Label><Text>Before suspending the payment, the Minister shall provide the person with written notification of the reasons for the suspension and the effective date of the suspension.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-12-08" lims:fid="727840" lims:id="727840">SOR/2011-302, s. 9</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2006-03-23" lims:fid="727841" lims:id="727841"><Label>35</Label><Subsection lims:inforce-start-date="2006-03-23" lims:fid="727842" lims:id="727842"><Label>(1)</Label><Text>For the purposes of section 36 of the Act, the Minister may cancel the payment of a Canadian Forces income support benefit to a person if</Text><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727843" lims:id="727843"><Label>(a)</Label><Text>the person, at least 6 months after the effective date of the suspension, continues to fail to comply with paragraph 34(1)(f); or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727844" lims:id="727844"><Label>(b)</Label><Text>the person’s eligibility for the benefit or the determination of the amount payable was based on a misrepresentation or the concealment of a material fact.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-23" lims:fid="727845" lims:id="727845"><Label>(2)</Label><Text>On cancelling the payment, the Minister shall provide the person with written notification of the reasons for the cancellation, the effective date of the cancellation and their rights of review.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2019-04-01" lims:fid="727846" lims:id="727846"><Label>36</Label><Text>For the purposes of section 37 of the Act, the following definitions apply.</Text><Definition lims:inforce-start-date="2006-03-23" lims:fid="727847" lims:id="727847" generate-in-text="no"><Text><DefinedTermEn>base calendar year</DefinedTermEn> means the 12-month period starting with any month in which the Canadian Forces income support benefit is payable. (<DefinedTermFr>année civile de base</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-23" lims:fid="727848" lims:id="727848" generate-in-text="no"><Text><DefinedTermEn>income</DefinedTermEn>, in respect of a person for a base calendar year, has the same meaning as in section 2 of the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal> except that</Text><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727849" lims:id="727849"><Label>(a)</Label><Text>it does not include the aggregate of net income from employment, self-employment or rental of property that is equal to or less than</Text><Subparagraph lims:inforce-start-date="2006-03-23" lims:fid="727850" lims:id="727850"><Label>(i)</Label><Text>in the case of a veteran with no spouse or common-law partner, $2,900,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-23" lims:fid="727851" lims:id="727851"><Label>(ii)</Label><Text>in the case of a veteran with a spouse or common-law partner, $4,200,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-23" lims:fid="727852" lims:id="727852"><Label>(iii)</Label><Text>in the case of a survivor, $2,900, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-23" lims:fid="727853" lims:id="727853"><Label>(iv)</Label><Text>in the case of an orphan, $2,900;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727854" lims:id="727854"><Label>(b)</Label><Text>it does not include interest income that, in the case of a veteran, survivor or orphan, is equal to or less than $140;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="727855" lims:id="1122168"><Label>(c)</Label><Text>it does not include income replacement benefits payable under section 18, 22 or 26 of the Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727856" lims:id="727856"><Label>(d)</Label><Text>it does not include long-term disability benefits payable under the Service Income Security Insurance Plan Long Term Disability (LTD);</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727857" lims:id="727857"><Label>(e)</Label><Text>paragraph (d) of the definition “income” in section 2 of the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal> does not apply;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727858" lims:id="727858"><Label>(f)</Label><Text>business and capital losses shall be taken into account in the year in which they occur; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727859" lims:id="727859"><Label>(g)</Label><Text>dividend income shall be taken into account on the basis of the actual amount of the dividend. and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-10-01" lims:fid="727865" lims:id="727865"><Label>(e)</Label><Text>compassionate awards payable under section 34 of the <XRefExternal reference-type="act" link="V-1.6">Veterans Review and Appeal Board Act</XRefExternal> to those persons who have been refused a disability pension under the <XRefExternal reference-type="act" Act</XRefExternal>, is increased as a result of an amendment to that Act, the amounts set out in column 2 of items 1, 2 and 4 of Schedule 1 to the Act shall be increased in the following manner:</Text><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727872" lims:id="727872"><Label>(a)</Label><Text>the amounts set out in items 1 and 4 shall be increased by the amount of the increase for a single pensioner under the <XRefExternal reference-type="act" link="O-9">Old Age Security Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727873" lims:id="727873"><Label>(b)</Label><Text>the amount set out in item 2 shall be increased by an amount equal to the difference between the increase to the amount for a couple under (<DefinedTermFr>évident</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-23" lims:fid="727984" lims:id="727984" generate-in-text="no"><Text><DefinedTermEn>recorded on medical examination prior to enrolment</DefinedTermEn>, in respect of a disability or disabling condition of a member or veteran, means a written record, X-ray film or photograph of the disability or disabling condition that was placed in</Text><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727985" lims:id="727985"><Label>(a)</Label><Text>a medical report made on the enrolment of the member or veteran;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727986" lims:id="727986"><Label>(b)</Label><Text>official documentation covering a former period of service of the member or veteran;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727987" lims:id="727987"><Label>(c)</Label><Text>the files of the Department of Veterans Affairs relating to the member or veteran;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727988" lims:id="727988"><Label>(d)</Label><Text>the records of a compensation board or insurance company relating to the member or veteran; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="727989" lims:id="727989"><Label>(e)</Label><Text>the records of a medical practitioner or a clinic, hospital or other medical institution relating to the member or veteran. lims:id="727991"><Label>48</Label><Text>An application for compensation under Part 3 of the Act shall be made in writing and shall include</Text><Paragraph lims:inforce-start-date="2011-12-08" veteran</Text><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728004" lims:id="728004"><Label>(a)</Label><Text>sustained an amputation at or above the wrist or ankle;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728005" lims:id="728005"><Label>(b)</Label><Text>sustained legal blindness in both eyes — meaning that their best corrected visual acuity is less than or equal to 6/60 or they have less than 20 degrees of visual field remaining — for a minimum of 84 consecutive days;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728006" lims:id="728006"><Label>(c)</Label><Text>sustained quadriplegia, paraplegia, hemiplegia or complete paralysis of a limb for a minimum of 84 consecutive days;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728007" lims:id="728007"><Label>(d)</Label><Text>sustained total loss of urinary or bowel function for a minimum of 84 consecutive days;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728008" lims:id="728008"><Label>(e)</Label><Text>required the assistance of at least one person to perform at least three activities of daily living for a minimum of 112 consecutive days;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728009" lims:id="728009"><Label>(f)</Label><Text>was admitted to an intensive care unit for a minimum of five consecutive days;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728010" lims:id="728010"><Label>(g)</Label><Text>was admitted to a hospital for acute or rehabilitative inpatient care for a minimum of 84 consecutive days; or</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728011" lims:id="728011"><Label>(h)</Label><Text>was admitted to a hospital for acute or rehabilitative inpatient care for less than 84 consecutive days during which the member or the veteran received complex treatments.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-07-16" lims:fid="728013" lims:id="728014"><Label>48.4</Label><Text>For the purpose of subsection 44.1(1) of the Act, a sudden and single incident is a one-time event — including motor vehicle accidents, falls, explosions, application for pain and suffering compensation shall include</Text><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="728019" lims:id="728019"><Label>(a)</Label><Text>medical reports or other records that document the member’s or veteran’s injury or disease, diagnosis, disability and increase in the extent of the disability; and</Text></Paragraph><Paragraph lims:inforce-start-date="2013-10-01" lims:fid="728020" lims:id="728020"><Label>(b)</Label><Text>in the case of an application by a survivor or a dependent child,</Text><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="728021" lims:id="728021"><Label>(i)</Label><Text>a copy of the death certificate of the member or veteran, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2013-10-01" lims:fid="728022" lims:id="728022"><Label>(ii)</Label><Text>medical reports or other records that document the cause of death of the member or purposes of subsection 45(1) of the Act, a member or veteran is presumed, in the absence of evidence to the contrary, to have established that an injury or disease is a service-related injury or disease, or a non-service-related injury or disease that was aggravated by service, if it is demonstrated that the injury or disease or its aggravation was incurred in the course of</Text><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728026" lims:id="728026"><Label>(a)</Label><Text>any physical training or sports activity in which the member or veteran was participating that was authorized or organized by a military authority, or performed in the interests of the service although not authorized or organized by a military authority;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728027" lims:id="728027"><Label>(b)</Label><Text>any activity incidental to or directly connected with an activity described in paragraph (a), including the transportation of the member or veteran by any means between the place at which the member or veteran normally performed duties and the place of the activity;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728028" lims:id="728028"><Label>(c)</Label><Text>the transportation of the member or veteran, in the course of duties, in a military vessel, vehicle or aircraft or by any means of transportation authorized by a military authority, or any act done or action taken by any person that was incidental to or directly connected with that transportation;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728029" lims:id="728029"><Label>(d)</Label><Text>the transportation of the member or veteran while on authorized leave by any means authorized by a military authority, other than public transportation, between the place at which the member or veteran normally performed duties and the place at which the member or veteran was to take leave or a place at which public transportation was available;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728030" lims:id="728030"><Label>(e)</Label><Text>service in an area in which the prevalence of the disease that was contracted by the member or veteran, or that aggravated an existing injury or disease of the member or veteran, constituted a health hazard to persons in that area;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728031" lims:id="728031"><Label>(f)</Label><Text>any military operation, training or administration, as a result of either a specific order or an established military custom or practice, whether or not a failure to perform the act that resulted in the injury or disease or its aggravation would have resulted in disciplinary action against the member or veteran; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728032" lims:id="728032"><Label>(g)</Label><Text>the performance by the member or veteran of any duties that exposed the member or veteran to an environmental hazard that might reasonably have caused the injury or disease or its aggravation.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2019-04-01" lims:fid="728033" lims:id="728033"><Label>51</Label><Text lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1119536" lims:id="1122631">Subject to section 52, if an application for pain and suffering compensation is in respect of a disability or disabling condition of a member or veteran that was not obvious at the time they became a member of the forces and was not recorded on their medical examination prior to enrolment, the member or veteran is presumed to have been in the medical condition found on their enrolment medical examination unless there is</Text><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728034" lims:id="728034"><Label>(a)</Label><Text>recorded evidence that the disability or disabling condition was diagnosed within three months after enrolment; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728035" lims:id="728035"><Label>(b)</Label><Text>medical evidence that establishes beyond a reasonable doubt that the disability or disabling condition existed prior to enrolment.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122279" lims:id="1122279" lims:enactId="1044756">SOR/2018-177, s. 18</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2006-03-23" lims:fid="728036" lims:id="728036"><Label>52</Label><Text>Information given by a member or veteran at the time of enrolment with respect to a disability or disabling condition is not evidence that the disability or disabling condition existed prior to their enrolment unless there is corroborating evidence that establishes beyond a reasonable doubt that the disability or disabling condition existed prior to the time they became a member of the forces.</Text></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="728037" lims:id="1122190"><Label>53</Label><Text>A member or veteran who is in receipt of pain and suffering compensation shall, at the Minister’s request, provide medical reports or other records or any other information or documents that are necessary to enable the Minister to assess the member’s or veteran’s continued eligibility for the compensation or the extent of the member’s or veteran’s disability or to determine the amount of the compensation payable.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122192" lims:id="1122192" lims:enactId="1044742">SOR/2018-177, s. 13</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="1122193" lims:id="1122193"><Label>53.1</Label><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122194" lims:id="1122194"><Label>(1)</Label><Text>For the purposes of section 52.1 of the Act, the Minister may suspend the payment of pain and suffering compensation to a member or veteran who fails to provide the information or documents required under section 53 until the information and documents are provided.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122195" lims:id="1122195"><Label>(2)</Label><Text>Before suspending the payment of pain and suffering compensation to a member or veteran, the Minister shall provide the member or the veteran with written notification of the reasons for the suspension and the effective date of the suspension.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122197" lims:id="1122197" lims:enactId="1044742">SOR/2018-177, s. 13</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="1122198" lims:id="1122198"><Label>53.2</Label><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122199" lims:id="1122199"><Label>(1)</Label><Text>For the purposes of section 52.1 of the Act, the Minister may cancel the payment of pain and suffering compensation if</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122200" lims:id="1122200"><Label>(a)</Label><Text>the situation that gave rise to the suspension of the payment of pain and suffering compensation is not resolved within six months from the effective date of the suspension; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122201" lims:id="1122201"><Label>(b)</Label><Text>the assessment of the member’s or veteran’s eligibility for pain and suffering compensation or of the extent of their disability or the determination of the amount payable was based on a misrepresentation or the concealment of a material fact.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122202" lims:id="1122202"><Label>(2)</Label><Text>On cancelling the payment of pain and suffering compensation, the Minister shall provide the member or the veteran with written notification of the reasons for the cancellation, the effective date of the cancellation and the member’s or veteran’s rights of review.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122204" lims:id="1122204" lims:enactId="1044742">SOR/2018-177, s. 13</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="1122205" lims:id="1122205"><Label>53.3</Label><Text>For the purposes of subsection 53(1) of the Act, a member or veteran may elect to receive the pain and suffering compensation as a lump sum by notifying the Minister in writing of their election.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="1122208" lims:id="1122208"><Label>53.4</Label><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122209" lims:id="1122209"><Label>(1)</Label><Text>The following sources are prescribed for the purposes of section 56.3 of the Act:</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122210" lims:id="1122210"><Label>(a)</Label><Text>amounts arising from a legal liability to pay damages for non-economic loss; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122211" lims:id="1122211"><Label>(b)</Label><Text>compensation payable in respect of non-economic loss under</Text><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122212" lims:id="1122212"><Label>(i)</Label><Text>the <XRefExternal reference-type="act" link="G-5">Government Employees Compensation Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122213" lims:id="1122213"><Label>(ii)</Label><Text>any provincial workers’ compensation legislation,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122214" lims:id="1122214"><Label>(iii)</Label><Text>a compensation plan established by any other legislation of a similar nature, whether federal, provincial or of another jurisdiction other than a plan to which the member or veteran has contributed, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122215" lims:id="1122215"><Label>(iv)</Label><Text>a compensation plan of a similar nature established by the United Nations or by or under an international agreement to which Canada is a party, other than a plan to which the member or veteran has contributed.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122216" lims:id="1122216"><Label>(2)</Label><Text>For the purposes of section 56.3 of the Act, the amount by which the Minister may reduce the pain and suffering compensation that is payable monthly to a member or veteran is the lesser of</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122217" lims:id="1122217"><Label>(a)</Label><Text>the amount that is payable from the prescribed source, converted into a monthly amount in accordance with generally accepted actuarial principles if it has been paid or is payable in a lump sum or on a periodic basis other than monthly, and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122218" lims:id="1122218"><Label>(b)</Label><Text>the full amount of pain and suffering compensation that is payable monthly.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122219" lims:id="1122219"><Label>(3)</Label><Text>For the purposes of section 56.3 of the Act, the amount by which the Minister may reduce the pain and suffering compensation that is payable as a lump sum to a member or veteran is the lesser of</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122220" lims:id="1122220"><Label>(a)</Label><Text>the amount that is payable from the prescribed source, converted into a lump-sum amount in accordance with generally accepted actuarial principles if it has been paid or is payable on a periodic basis, and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122221" lims:id="1122221"><Label>(b)</Label><Text>the full amount of pain and suffering compensation that is payable as a lump sum.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122222" lims:id="1122222"><Label>(4)</Label><Text>If the pain and suffering compensation paid to a member or veteran was reduced in accordance with subsection (2) or (3) and, at the time of the member’s or veteran’s death, the total amount of the reduction exceeds the total amounts received from the prescribed source, the reduction in the pain and suffering compensation shall be redetermined in accordance with subsection (2) or (3) with the references in paragraphs (2)(a) and (3)(a) to the amount that is payable from the prescribed source being replaced with references to the total amount received by the member or veteran from the prescribed source before death.</Text></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122223" lims:id="1122223"><Label>(5)</Label><Text>If the redetermination under subsection (4) results in a smaller reduction of pain and suffering compensation than was previously determined under subsection (2) or (3), the difference between the two amounts is to be paid to the member’s or veteran’s survivor or dependent children in the manner set out in section 56.1 of the Act.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122225" lims:id="1122225" lims:id="1122226" level="2"><TitleText>Additional Pain and Suffering Compensation</TitleText></Heading><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="728049" lims:id="1122227"><Label>54</Label><Text>For the purposes of section 56.6 of the Act, a permanent and severe impairment is</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122228" lims:id="1122228"><Label>(a)</Label><Text>an amputation at or above the elbow or the knee;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122229" lims:id="1122229"><Label>(b)</Label><Text>the amputation of more than one upper or lower limb at any level;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122230" lims:id="1122230"><Label>(c)</Label><Text>a total and permanent loss of the use of a limb;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122231" lims:id="1122231"><Label>(d)</Label><Text>a total and permanent loss of vision, hearing or speech;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122232" lims:id="1122232"><Label>(e)</Label><Text>a severe and permanent psychiatric condition;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122233" lims:id="1122233"><Label>(f)</Label><Text>a severe and permanent limitation in mobility or self-care; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122234" lims:id="1122234"><Label>(g)</Label><Text>a permanent requirement for supervision.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:enacted-date="2018-08-23" lims:fid="1122238" lims:id="1122238"><Label>(b)</Label><Text>the need for supervision and assistance;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122239" lims:id="1122239"><Label>(c)</Label><Text>the degree of the loss of use of a limb;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122240" lims:id="1122240"><Label>(d)</Label><Text>the frequency of the symptoms; and</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122241" lims:id="1122241"><Label>(e)</Label><Text>the degree of psychiatric impairment.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem request, provide medical reports or other records or any other information or documents that are necessary to enable the Minister to assess the veteran’s continued eligibility for the compensation or section 56.8 of the Act, the Minister may suspend the payment of additional pain and suffering compensation to a veteran who fails to do either of the following until the situation that gave rise to the suspension is resolved:</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122249" lims:id="1122249"><Label>(a)</Label><Text>provide the information or documents required under section 54.3; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122250" lims:id="1122250"><Label>(b)</Label><Text>undergo a medical examination or an assessment required by the Minister under section 56.7 of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122251" lims:id="1122251"><Label>(2)</Label><Text>Before suspending the payment of additional pain and suffering compensation to a veteran, the Minister shall provide the veteran with written notification of the reasons for the suspension and the effective date of the suspension.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122253" lims:id="1122253" lims:enactId="1044742">SOR/2018-177, s. 13</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:lastAmendedDate="2019-04-01" lims:fid="1122254" lims:id="1122254"><Label>54.5</Label><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122255" lims:id="1122255"><Label>(1)</Label><Text>For the purposes of section 56.8 of the Act, the Minister may cancel the payment of additional pain and suffering compensation if</Text><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122256" lims:id="1122256"><Label>(a)</Label><Text>the situation that gave rise to the suspension of the payment of additional pain and suffering compensation is not resolved within six months from the effective date of the suspension; or</Text></Paragraph><Paragraph lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122257" lims:id="1122257"><Label>(b)</Label><Text>the assessment of the veteran’s eligibility for additional pain and suffering compensation or of the extent of their permanent and severe impairment was based on a misrepresentation or the concealment of a material fact.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122258" lims:id="1122258"><Label>(2)</Label><Text>On cancelling the payment of additional pain and suffering compensation, the Minister shall provide the veteran with written notification of the reasons for the cancellation, the effective date of the cancellation and the veteran’s rights of review.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2019-04-01" lims:enacted-date="2018-08-23" lims:fid="1122260" lims:id="1122260" Benefit</TitleText></Heading><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2006-03-23" lims:fid="728100" lims:id="728100"><Label>55</Label><Text>An application for a death benefit shall include medical reports or other records that document the member’s injury or disease, diagnosis and cause of death.</Text></Section><Section lims:inforce-start-date="2009-07-30" lims:lastAmendedDate="2009-07-30" lims:fid="728101" lims:id="728101"><Label>56</Label><Text>The presumptions set out in section 50 apply with any necessary modifications to applications for a death compensation of 5% set out in column 1 of that Schedule, is eligible, on application, for the payment or reimbursement of fees for financial advice, to a maximum of $500, relating to the amount, award or benefit if</Text><Paragraph lims:inforce-start-date="2017-04-01" lims:fid="728137" lims:id="728137"><Label>(a)</Label><Text>the financial advice is provided by an arms-length financial adviser who is primarily engaged in the business of providing financial advice;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-04-01" lims:fid="728138" lims:id="728138"><Label>(b)</Label><Text>the person makes the application within 12 months after</Text><Subparagraph lims:inforce-start-date="2017-04-01" lims:fid="728139" lims:id="728139"><Label>(i)</Label><Text>in the case of an amount paid or lims:fid="728172" lims:id="728172"><Label>(c)</Label><Text>a declaration by the designated person attesting that they</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="728173" lims:id="728173"><Label>(i)</Label><Text>meet the requirements set out in paragraph 65.1(1)(c) of the Act, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="728174" lims:id="728174"><Label>(ii)</Label><Text>consent to</Text><Clause lims:inforce-start-date="2018-04-01" lims:fid="728175" lims:id="728175"><Label>(A)</Label><Text>their designation for the purposes of subsection 65.1(1) of the Act,</Text></Clause><Clause lims:inforce-start-date="2018-04-01" lims:fid="728176" lims:id="728176"><Label>(B)</Label><Text>the disclosure by the veteran of their personal information to the Minister for the purposes of Part 3.1 of the Act, and</Text></Clause><Clause lims:inforce-start-date="2018-04-01" lims:fid="728177" lims:id="728177"><Label>(C)</Label><Text>the disclosure by the Minister of their personal information to the veteran for the purposes of Part 3.1 of the Act; and</Text></Clause></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="728178" lims:id="728178"><Label>(d)</Label><Text>at the Minister’s request, any other information or documents that are necessary to enable the Minister to assess the applicant’s eligibility for the benefit.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="728180" lims:id="728180">SOR/2015-197, s. lims:id="728181"><Label>65.2</Label><Text>For the purposes of paragraph 65.1(1)(d) of the Act, the veteran shall</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="728182" lims:id="728182"><Label>(a)</Label><Text>either</Text><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="728183" lims:id="728183"><Label>(i)</Label><Text>require a level of care and supervision that is consistent with admission to an institution,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="728184" lims:id="728184"><Label>(ii)</Label><Text>require daily physical assistance of another person for most activities of daily living,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="728185" lims:id="728185"><Label>(iii)</Label><Text>require ongoing direction and supervision during the performance of most activities of daily living, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2018-04-01" lims:fid="728186" lims:id="728186"><Label>(iv)</Label><Text>require daily supervision and is not considered to be safe when left alone.</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="728187" lims:id="728187"><Label>(b)</Label><Text><Repealed>[Repealed, SOR/2017-161, s. 6]</Repealed></Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="728189" lims:id="728189">SOR/2015-197, s. 7; SOR/2017-161, s. purposes of subsection 65.1(2) of the Act, the Minister shall consider only whether the veteran’s state of physical, mental or cognitive health is not likely to substantially improve for at least 12 purposes of subsection 65.1(3) of the Act, the Minister shall consider only whether, when the person referred to in paragraph 65.1(1)(c) of the Act is unavailable,</Text><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728194" lims:id="728194"><Label>(a)</Label><Text>the provision or coordination of the ongoing care would be compromised; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-07-16" lims:fid="728195" lims:id="728195"><Label>(b)</Label><Text>the health and well-being of the veteran would be placed at risk.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2015-07-16" lims:fid="728197" lims:id="728197">SOR/2015-197, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="728198" lims:id="728198"><Label>65.5</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="728199" lims:id="728199"><Label>(1)</Label><Text>A designated person and the veteran in respect of whom the person is being paid the caregiver recognition benefit shall provide, at the Minister’s request, any information or documents that are necessary to enable the Minister to assess the veteran’s continued eligibility for the benefit.</Text></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="728200" lims:id="728200"><Label>(2)</Label><Text>The Minister may, for the purposes of section 65.31 of the Act, suspend the payment of the benefit so long as</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="728201" lims:id="728201"><Label>(a)</Label><Text>the designated person or the veteran, as the case may be, fails to comply with a request made under subsection (1); or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="728202" lims:id="728202"><Label>(b)</Label><Text>the veteran fails to undergo an assessment required under section 65.3 of the Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="728203" lims:id="728203"><Label>(3)</Label><Text>Before suspending the payment of the benefit, the Minister shall provide the veteran and the designated person with written notification of the reasons for the suspension and the effective date of the suspension.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="728205" lims:id="728205">SOR/2015-197, s. 7; SOR/2017-161, s. 7</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2018-04-01" lims:lastAmendedDate="2018-04-01" lims:fid="728206" lims:id="728206"><Label>65.6</Label><Subsection lims:inforce-start-date="2018-04-01" lims:fid="728207" lims:id="728207"><Label>(1)</Label><Text>For the purposes of section 65.31 of the Act, the Minister may cancel the caregiver recognition benefit if</Text><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="728208" lims:id="728208"><Label>(a)</Label><Text>a suspension under subsection 65.5(2) continues for at least six months; or</Text></Paragraph><Paragraph lims:inforce-start-date="2018-04-01" lims:fid="728209" lims:id="728209"><Label>(b)</Label><Text>the veteran’s eligibility for the benefit was based on a misrepresentation or the concealment of a material fact.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-04-01" lims:fid="728210" lims:id="728210"><Label>(2)</Label><Text>On cancelling the benefit, the Minister shall provide the veteran and the designated person with written notification of the reasons for the cancellation, the effective date of the cancellation and the veteran’s rights of review.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-04-01" lims:fid="728212" lims:id="728212">SOR/2015-197, s. 7; SOR/2017-161, s. lims:inforce-start-date="2015-07-16" lims:fid="728214" lims:id="728214"><Label>(1)</Label><Text>For the purposes of paragraphs 65.1(1)(b) and (c) and subsections 65.1(2) and (3) of the Act, <DefinedTermEn>care</DefinedTermEn> means any activity that is necessary for the health, welfare, maintenance and protection of a person.</Text></Subsection><Subsection lims:inforce-start-date="2015-07-16" lims:fid="728215" lims:id="728215"><Label>(2)</Label><Text>For the purposes of paragraph 65.1(1)(c) and subsection 65.1(3) of the Act, <DefinedTermEn>home</DefinedTermEn> in relation to a veteran, means the dwelling, other than a health care facility, in which the veteran normally lims:inforce-start-date="2018-04-01" lims:fid="728219" lims:id="728219"><Label>(1)</Label><Text>The amount set out in item 5, column 2, of Schedule 2 to the Act shall be adjusted annually on January 1 in accordance with the percentage increase to the Consumer Price Index, rounded to the next 0.10%, for the year ending on October 31 of the previous year.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-23" lims:fid="728226" lims:id="728226"><Label>(1)</Label><Text>For the purpose of subsection 74(1) of the Act, the Minister shall pay the costs of meals, transportation and accommodations in accordance with the rates set out in the Treasury Board Travel Directive, as amended from time to time, subject to the following conditions:</Text><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728227" lims:id="728227"><Label>(a)</Label><Text>if the means of transportation is a taxi, $5.00 shall be deducted from the cost of each trip unless the person’s mobility or cognition is severely impaired or the deduction would severely impede the person’s ability to access the medical examination or assessment; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-23" lims:fid="728228" lims:id="728228"><Label>(b)</Label><Text>if the means of transportation is an automobile other than a taxi, the costs of transportation are payable at the rate applicable to employees of the public service of Canada who have requested the use of their own automobile plus 2 cents per kilometre and shall include the costs of parking.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-23" lims:fid="728229" lims:id="728229"><Label>(2)</Label><Text>If a person undergoes a medical examination or an assessment in a country other than Canada, the payment of the expenses shall be made at the same rate and subject to the same conditions as the rates and conditions that are established for former members of the armed forces of that country for similar costs, or, if no such rates are established, at the rates that would be payable if the person were resident in Canada.</Text></Subsection></Section><Section lims:inforce-start-date="2006-03-23" lims:lastAmendedDate="2006-03-23" lims:fid="728230" lims:id="728230"><Label>67</Label><Text>A claim for reimbursement shall be made in writing no later than one year after the day on which the expenditure is incurred and must include proof of the expenditures.</Text></Section><Heading
