Her Excellency the Governor General in Council, on the recommendation of the Minister of Labour and after consultation with the Canadian Nuclear Safety Commission, pursuant to section 159a of the Canada Labour Code and section 8.2b of the Non-smokers’ Health Actc, hereby makes the annexed Saskatchewan Uranium Mines and Mills Exclusion Regulations.S.C. 1997, c. 9, par. 125(1)(d)S.C. 1997, c. 9, par. 125(1)(h)R.S., c. 15 (4th Supp.)InterpretationThe definitions in this section apply in these Regulations.employment means employment withthe holder of a surface lease to mine or process any uranium-bearing material granted pursuant to The Provincial Lands Act, R.S.S. 1978, c. P-31, The Forest Act, R.S.S. 1978, c. F-19, or The Forest Resources Management Act, S.S. 1996, c. F-19.1; ora person who operates a uranium mine or mill that mines or processes uranium-bearing material for or on behalf of a person mentioned in paragraph (a). (emploi)uranium mine or mill means a uranium mine or uranium mill in the Province of Saskatchewan that is subject to the Nuclear Safety and Control Act. (mine d’uranium ou usine de concentration d’uranium)ExclusionEmployment on or in connection with a uranium mine or mill is hereby excluded from the application ofsections 122 to 158 of the Canada Labour Code; andthe Non-Smokers’ Health Act, except section 8.2.Application of Saskatchewan LegislationSubject to section 4, the following acts and regulations, as amended from time to time, apply in relation to employment on or in connection with a uranium mine or mill:The Boiler and Pressure Vessel Act, R.S.S. 1978, c. B-5, except section 39, and the following regulations made under that Act, namely,Regulations Respecting The Design, Construction, Installation and Use of Boilers and Pressure Vessels, SR 262/57,Regulations Respecting Compressed Gas Pressure Vessels, SR 99/70,Regulations Respecting Examinations and Certificates of Engineers and Firemen, SR 311/77, andRegulations Respecting the Welding of Boilers, Pressure Vessels and Pressure Piping, SR 61/78;The Electrical Inspection Act, 1993, S.S. 1993, c. E-6.3, and the following regulations made under that Act, namely,The Electrical Inspection Regulations, Chapter E-6.3, Reg 1, except sections 19 to 21,The Use of Electricity in Mines Regulations, 1996, Chapter E-6.3, Reg 4,The Canadian Electrical Code (Adoption) Regulations, 1999, Chapter E-6.3, Reg 5, andThe Canadian Electrical Code (Saskatchewan Amendments) Regulations, 1999, Chapter E-6.3, Reg 6;The Electrical Licensing Act, S.S. 1988-89, c. E-7.2;The Gas Inspection Act, 1993, S.S. 1993, c. G-3.2, and The Gas Inspection Regulations, Chapter G-3.2, Reg 1;The Gas Licensing Act, S.S. 1988-89, c. G-4.1, and The Gas Licensing Regulations, Chapter G-4.1, Reg 1, except sections 10, 12 and 13;The Occupational Health and Safety Act, 1993, S.S. 1993, c. O-1.1, and the following regulations made or continued under that Act, namely,The Occupational Health and Safety Regulations, 1996, Chapter O-1.1, Reg 1, except section 84 and Parts XXVII, XXIX and XXXI, andThe Mines Regulations, SR 284/78, except Part XXVII;The Passenger and Freight Elevator Act, R.S.S. 1978, c. P-4, and The Passenger and Freight Elevator Regulations, 1982, Chapter P-4, Reg 1; andThe Radiation Health and Safety Act, 1985, S.S. 1984-85-86, c. R-1.1, except section 18 and subsection 19(1), and The Radiation Health and Safety Regulations, Chapter R-1.1, Reg 1, except subsections 21(6) and (7), sections 24 to 28, 32, and 40 to 46, clause 47(1)(c), sections 48 to 50, subclauses 51(1)(b)(i) and 2(b)(i) and Forms A and B of Part III of the Appendix.For the purposes of section 3,the reference to “notwithstanding section 29 of The Summary Offences Procedure Act, 1990” in clause 59(1)(a) of The Occupational Health and Safety Act, 1993 shall be read as a reference to “notwithstanding subsection 787(2) of the Criminal Code”;subsection 4(1) of The Boiler and Pressure Vessel Act shall be read as if the reference to “that are subject to the legislative authority of the province” did not appear;a reference to “C.R.C.” wherever it occurs in the Regulations Respecting Compressed Gas Pressure Vessels, SR 99/70, shall be read as a reference to the Canadian Transportation Agency; andsection 3 of the Passenger and Freight Elevator Act shall be read as if the reference to “, or subject to, the legislative authority of” did not appear.In case of an inconsistency between any of the provisions of the Nuclear Safety and Control Act and any regulations made under that Act and the provisions of these Regulations and the provisions of any act or regulation as incorporated into section 3 of these Regulations, the provisions of the Nuclear Safety and Control Act and its regulations prevail to the extent of the inconsistency.Repeal[Repeal]Coming into ForceThese Regulations come into force on the day on which they are registered.
