VII, s. 15)</Text></Footnote></Provision></Order><Body lims:inforce-start-date="2006-03-22" lims:fid="664464" lims:id="664464"><Heading lims:inforce-start-date="2006-03-22" lims:fid="664465" lims:id="664465" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="664466" lims:id="664466"><Label>1</Label><Text>In these Regulations, “substance” means tributyltetradecylphosphonium chloride that has the molecular formula C<Sub>26</Sub>H<Sub>56</Sub>P·Cl.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="664467" lims:id="664467" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="664468" lims:id="664468"><Label>2</Label><Text>These Regulations do not apply in respect of the manufacture, use, processing, sale, offering for sale or importation of the substance as a laboratory analytical standard, or any aspect of the substance that is regulated by or under the <XRefExternal reference-type="act" link="P-9">Pest Control Products Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="664469" lims:id="664469" level="1"><TitleText>Prohibition</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="664470" lims:id="664470"><Label>3</Label><Text>No person shall use, process, sell, offer for sale or import the substance.</Text></Section><Section lims:inforce-start-date="2018-02-02" lims:lastAmendedDate="2018-02-02" lims:fid="664471" lims:id="664471"><Label>4</Label><Text>No person shall manufacture the substance unless the person</Text><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="664472" lims:id="664472"><Label>(a)</Label><Text>manufactures it for export only;</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="664473" lims:id="664473"><Label>(b)</Label><Text>has notified the Minister, in writing, of their intent to manufacture it, 60 days before the start date of the manufacturing process; and</Text></Paragraph><Paragraph lims:inforce-start-date="2018-02-02" lims:fid="664474" lims:id="664474"><Label>(c)</Label><Text>manufactures it using a fully contained process by which the containment of the substance is ensured by various pollution control or recovery technologies, including emergency containment, in order to prevent any release into the environment.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2018-02-02" lims:fid="664476" lims:id="664476">SOR/2018-11, s. 15(E)</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="664477" lims:id="664477" level="1"><TitleText>Manufacturer’s Records</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="664478" lims:id="664478"><Label>5</Label><Text>A person who manufactures the substance for export shall maintain books and records certifying the quantities of the substance manufactured during a given year. The books and records shall be kept at the person’s facility in Canada for five years.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="664479" lims:id="664479" level="1"><TitleText>Export</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="664480" lims:id="664480"><Label>6</Label><Text>A manufacturer who exports the substance shall maintain a copy of the Canada Customs declaration of export, if applicable, at their facility in Canada for five years.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="664481" lims:id="664481" level="1"><TitleText>Incineration</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="664482" lims:id="664482"><Label>7</Label><Text>A manufacturer who sends the substance or a material that contains the substance for incineration shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="664483" lims:id="664483"><Label>(a)</Label><Text>proceed in accordance with the <Emphasis style="italic">National Guidelines for Hazardous Waste Incineration Facilities — Design and Operating Criteria</Emphasis>, Volume 1, Canadian Council of Ministers of the Environment (CCME), March 1992, as amended from time to time; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="664484" lims:id="664484"><Label>(b)</Label><Text>maintain for five years at their facility in Canada a copy of the documents certifying the incineration.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="664485" lims:id="664485" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="664486" lims:id="664486" type="transitional"><Label>8</Label><Text>These Regulations come into force on the day on which they are registered.</Text></Section></Body></Regulation>
