﻿<?xml version="1.0" encoding="utf-8"?><Regulation lims:pit-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:current-date="2019-06-21" lims:inforce-start-date="2006-03-22" lims:fid="663835" lims:id="663835" regulation-type="SOR" xml:lang="en" xmlns:lims="http://justice.gc.ca/lims"><Identification lims:inforce-start-date="2006-03-22" lims:fid="663836" lims:id="663836"><InstrumentNumber>SOR/2000-43</InstrumentNumber><RegistrationDate><Date><YYYY>2000</YYYY><MM>2</MM><DD>1</DD></Date></RegistrationDate><ConsolidationDate lims:inforce-start-date="2006-03-22"><Date><YYYY>2019</YYYY><MM>6</MM><DD>22</DD></Date></ConsolidationDate><EnablingAuthority lims:inforce-start-date="2006-03-22" lims:fid="663838" lims:id="663838"><XRefExternal reference-type="act" link="C-15.31">CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999</XRefExternal></EnablingAuthority><LongTitle lims:inforce-start-date="2006-03-22" lims:fid="663839" lims:id="663839">Gasoline and Gasoline Blend Dispensing Flow Rate Regulations</LongTitle><RegulationMakerOrder><RegulationMaker>P.C.</RegulationMaker><OrderNumber>2000-79</OrderNumber><Date><YYYY>2000</YYYY><MM>2</MM><DD>1</DD></Date></RegulationMakerOrder></Identification><Order lims:inforce-start-date="2006-03-22" lims:fid="663840" lims:id="663840"><Provision lims:inforce-start-date="2006-03-22" lims:fid="663841" lims:id="663841" language-align="yes" format-ref="indent-0-0" list-item="no"><Text>Whereas, pursuant to subsection 48(1) of the <XRefExternal reference-type="act">Canadian Environmental Protection Act</XRefExternal><FootnoteRef idref="footnotea_e">a</FootnoteRef>, the Minister of the Environment published in the <XRefExternal reference-type="other" link="gazette">Canada Gazette</XRefExternal>, Part I, on June 5, 1999, a copy of the proposed <XRefExternal reference-type="regulation" link="SOR-2000-43">Gasoline and Gasoline Blend Dispensing Flow Rate Regulations</XRefExternal>, substantially in the annexed form, and persons were given an opportunity to file comments with respect to the Regulations or to file a notice of objection requesting that a board of review be established and stating the reasons for the objection;</Text><Footnote id="footnotea_e" placement="page" status="official"><Label>a</Label><Text>R.S., c. 16 (4th Supp.) </Text></Footnote></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="663842" lims:id="663842" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Whereas, pursuant to subsection 34(1)<FootnoteRef idref="footnoteb_e">b</FootnoteRef> of the <XRefExternal reference-type="act">Canadian Environmental Protection Act</XRefExternal><FootnoteRef>a</FootnoteRef>, the federal-provincial advisory committee has been given an opportunity to provide its advice under section 6 of that Act;</Text><Footnote id="footnoteb_e" placement="page" status="official"><Label>b</Label><Text>S.C. 1989, c. 9, s. 2</Text></Footnote></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="663843" lims:id="663843" format-ref="indent-0-0" language-align="no" list-item="no"><Text>And whereas, in the opinion of the Governor in Council, pursuant to subsection 34(3) of the <XRefExternal reference-type="act">Canadian Environmental Protection Act</XRefExternal><FootnoteRef>a</FootnoteRef>, the proposed Regulations do not regulate an aspect of a substance that is regulated by or under any other Act of Parliament;</Text></Provision><Provision lims:inforce-start-date="2006-03-22" lims:fid="663844" lims:id="663844" format-ref="indent-0-0" language-align="no" list-item="no"><Text>Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of the Environment and the Minister of Health, pursuant to subsection 34(1) of the <XRefExternal reference-type="act">Canadian Environmental Protection Act</XRefExternal><FootnoteRef>a</FootnoteRef>, hereby makes the annexed <XRefExternal reference-type="regulation" link="SOR-2000-43">Gasoline and Gasoline Blend Dispensing Flow Rate Regulations</XRefExternal>.</Text></Provision></Order><Body lims:inforce-start-date="2006-03-22" lims:fid="663845" lims:id="663845"><Heading lims:inforce-start-date="2006-03-22" lims:fid="663846" lims:id="663846" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="663847" lims:id="663847"><Label>1</Label><Text>The definitions in this section apply in these Regulations.</Text><Definition lims:inforce-start-date="2006-03-22" lims:fid="663848" lims:id="663848" generate-in-text="no"><Text><DefinedTermEn>gasoline</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="663849" lims:id="663849"><Label>(a)</Label><Text>a fuel that is sold or represented as gasoline; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="663850" lims:id="663850"><Label>(b)</Label><Text>a petroleum distillate, or a mixture of petroleum distillates, oxygenates or additives, that is suitable for use in a spark ignition engine and that has the following characteristics, as determined by the applicable test method listed in the National Standard of Canada standard CAN/CGSB-3.5-94, <XRefExternal reference-type="standard">Unleaded Automotive Gasoline,</XRefExternal> as amended from time to time:</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="663851" lims:id="663851"><Label>(i)</Label><Text>a vapour pressure of at least 38 kPa,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="663852" lims:id="663852"><Label>(ii)</Label><Text>an antiknock index of at least 80,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="663853" lims:id="663853"><Label>(iii)</Label><Text>a distillation temperature, at which 10% of the fuel has evaporated, of not less than 35°C and not greater than 70°C, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="663854" lims:id="663854"><Label>(iv)</Label><Text>a distillation temperature, at which 50% of the fuel has evaporated, of not less than 65°C and not greater than 120°C. (<DefinedTermFr>essence</DefinedTermFr>)</Text></Subparagraph></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="663855" lims:id="663855" generate-in-text="no"><Text><DefinedTermEn>gasoline blend</DefinedTermEn> means any mixture of gasoline and oxygenate that is suitable for use in a spark ignition engine. (<DefinedTermFr>mélange d’essence</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="663856" lims:id="663856" generate-in-text="no"><Text><DefinedTermEn>heavy-duty vehicle</DefinedTermEn> means an on-road vehicle that has</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="663857" lims:id="663857"><Label>(a)</Label><Text>a maximum design loaded weight rating specified by a manufacturer of more than 3856 kg;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="663858" lims:id="663858"><Label>(b)</Label><Text>a curb weight of more than 2722 kg; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="663859" lims:id="663859"><Label>(c)</Label><Text>an area enclosed by the geometric projection of the basic vehicle, which includes tires but does not include mirrors or air deflectors, along the longitudinal axis of the vehicle onto a plane perpendicular to that axis, of more than 4.2 m<Sup>2</Sup>. (<DefinedTermFr>véhicule lourd</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="663860" lims:id="663860" generate-in-text="no"><Text><DefinedTermEn>on-road vehicle</DefinedTermEn> means any self-propelled vehicle that is designed to be driven on roads. (<DefinedTermFr>véhicule routier</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="663861" lims:id="663861" generate-in-text="no"><Text><DefinedTermEn>oxygenate</DefinedTermEn> means an oxygen-containing, ashless, organic compound that, when added to gasoline, increases the oxygen content in the gasoline. (<DefinedTermFr>produit oxygéné</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="663862" lims:id="663862" generate-in-text="no"><Text><DefinedTermEn>retailer</DefinedTermEn> means any person who owns or operates any establishment at which gasoline or a gasoline blend is sold or offered for sale for use in an on-road vehicle. (<DefinedTermFr>détaillant</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="663863" lims:id="663863" generate-in-text="no"><Text><DefinedTermEn>wholesale purchaser-consumer</DefinedTermEn> means any person that is not a retailer and that stores gasoline or a gasoline blend in a storage tank of at least 2100 L for use in an on-road vehicle. (<DefinedTermFr>grossiste acheteur-consommateur</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="663864" lims:id="663864" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="663865" lims:id="663865"><Label>2</Label><Text>These Regulations apply to the flow rate from any nozzle that is used to dispense gasoline, or a gasoline blend, that contains benzene, but do not apply to the flow rate from any nozzle that is used exclusively to dispense gasoline or a gasoline blend into heavy-duty vehicles.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="663866" lims:id="663866" level="1"><TitleText>Maximum Dispensing Flow Rate</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="663867" lims:id="663867"><Label>3</Label><Text>No retailer or wholesale purchaser-consumer shall use or offer for use a nozzle to dispense gasoline or a gasoline blend into an on-road vehicle if the flow rate from the nozzle exceeds 38 L/min.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="663868" lims:id="663868" level="1"><TitleText>Method of Determining Dispensing Flow Rate</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="663869" lims:id="663869"><Label>4</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="663870" lims:id="663870"><Label>(1)</Label><Text>A person shall determine the flow rate referred to in section 3 by measuring the amount of time it takes to dispense 10.0 L of gasoline or a gasoline blend from the nozzle with the nozzle operated at the maximum flow rate.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="663871" lims:id="663871"><Label>(2)</Label><Text>In making the determination referred to in subsection (1), the person shall</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="663872" lims:id="663872"><Label>(a)</Label><Text>use a digital stopwatch that reads to at least 0.01 seconds to measure the dispensing time;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="663873" lims:id="663873"><Label>(b)</Label><Text>use the dispenser’s volume meter to measure the dispensed volume of gasoline or gasoline blend; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="663874" lims:id="663874"><Label>(c)</Label><Text>start the stopwatch when the dispenser’s volume meter indicates that 2.0 L of gasoline or gasoline blend have been dispensed.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="663875" lims:id="663875"><Label>(3)</Label><Text>The person shall use the following formula to calculate the dispensing flow rate of gasoline or a gasoline blend from the nozzle, in litres per minute:</Text><FormulaGroup lims:inforce-start-date="2006-03-22" lims:fid="663876" lims:id="663876"><Formula lims:inforce-start-date="2006-03-22" lims:fid="663877" lims:id="663877"><FormulaText>Flow Rate = 60 × [V<Sub>f</Sub> - V<Sub>i</Sub>]/[T<Sub>f</Sub> - T<Sub>i</Sub>]</FormulaText></Formula><FormulaConnector>where</FormulaConnector><FormulaDefinition lims:inforce-start-date="2006-03-22" lims:fid="663878" lims:id="663878"><FormulaTerm>T<Sub>i</Sub></FormulaTerm><Text>is the reading of the stopwatch, in seconds, when the person starts the stopwatch;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2006-03-22" lims:fid="663879" lims:id="663879"><FormulaTerm>T<Sub>f</Sub></FormulaTerm><Text>is the reading of the stopwatch, in seconds, when the person stops the stopwatch;</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2006-03-22" lims:fid="663880" lims:id="663880"><FormulaTerm>V<Sub>i</Sub></FormulaTerm><Text>is the reading of the dispenser’s volume meter, in litres, when the person starts the stopwatch; and</Text></FormulaDefinition><FormulaDefinition lims:inforce-start-date="2006-03-22" lims:fid="663881" lims:id="663881"><FormulaTerm>V<Sub>f</Sub></FormulaTerm><Text>is the reading of the dispenser’s volume meter, in litres, when the person stops the stopwatch.</Text></FormulaDefinition></FormulaGroup></Subsection></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="663882" lims:id="663882" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="663883" lims:id="663883" type="transitional"><Label>5</Label><Text>These Regulations come into force 12 months after the day on which they are registered.</Text></Section></Body></Regulation>
