(<DefinedTermFr>Convention</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="661373" lims:id="661373" generate-in-text="no"><Text><DefinedTermEn>Union</DefinedTermEn> means the International Telecommunication Union. (<DefinedTermFr>(Union)</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="661374" lims:id="661374" generate-in-text="no"><Text><DefinedTermEn>Vienna Convention</DefinedTermEn> means the Vienna Convention on Diplomatic Relations set out in Schedule I to the <XRefExternal reference-type="act" link="F-29.4">Foreign Missions and International Organizations Act</XRefExternal>. (<DefinedTermFr>Convention de Vienne</DefinedTermFr>)</Text></Definition></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="661375" lims:id="661375" level="1"><TitleText>Privileges and Immunities</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="661376" lims:id="661376"><Label>2</Label><Text>The Union shall have the legal capacities of a body corporate and the privileges and immunities set out in Articles II and III of the Convention.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="661377" lims:id="661377"><Label>3</Label><Text>Representatives of foreign states that are members of the Union shall have, during their journey to and from the place of a meeting of the Union in Canada, as well as in Canada,</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661378" lims:id="661378"><Label>(a)</Label><Text>the following privileges and immunities set out in Section 11 of Article IV of the Convention, namely,</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="661379" lims:id="661379"><Label>(i)</Label><Text>immunity from personal arrest or detention and from seizure of their personal baggage and, in respect of words spoken or written and all acts done by them in their capacity as representatives, immunity from legal process of every kind,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="661380" lims:id="661380"><Label>(ii)</Label><Text>inviolability for all papers and documents,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="661381" lims:id="661381"><Label>(iii)</Label><Text>the right to use codes and to receive papers or correspondence by courier or in sealed bags,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="661382" lims:id="661382"><Label>(iv)</Label><Text>exemption from immigration restrictions, alien registration and national service obligations in Canada when visiting or passing through Canada in the exercise of their functions,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="661383" lims:id="661383"><Label>(v)</Label><Text>the same immunities and facilities in respect of their personal baggage as are accorded to diplomatic envoys, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="661384" lims:id="661384"><Label>(vi)</Label><Text>such other privileges, immunities and facilities not inconsistent with the foregoing as diplomatic envoys enjoy, except that they shall have no right to claim exemption from customs duties on goods imported (otherwise than as part of their personal baggage) or from excise duties or sales taxes; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661385" lims:id="661385"><Label>(b)</Label><Text>the privileges and immunities set out in Sections 12, 13 and 14 of Article IV of the Convention, subject to Sections 15 and 16 of that Article.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="661386" lims:id="661386"><Label>4</Label><Text>Senior officials of the Union who are not Canadian citizens or permanent residents shall have the privileges and immunities comparable to the privileges and immunities accorded under the Vienna Convention to diplomatic agents.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="661387" lims:id="661387"><Label>5</Label><Text>Officials of the Union who are not Canadian citizens or permanent residents shall have the following privileges and immunities set out in Section 18 of Article V of the Convention:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661388" lims:id="661388"><Label>(a)</Label><Text>immunity from legal process in respect of words spoken or written and all acts performed by them in their official capacity;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661389" lims:id="661389"><Label>(b)</Label><Text>exemption from taxation on the salaries and emoluments paid to them by the Union;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661390" lims:id="661390"><Label>(c)</Label><Text>immunity from national service obligations;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661391" lims:id="661391"><Label>(d)</Label><Text>immunity from immigration restrictions and alien registration;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661392" lims:id="661392"><Label>(e)</Label><Text>the same privileges in respect of exchange facilities as are accorded to the officials of comparable ranks forming part of diplomatic missions to the Government of Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661393" lims:id="661393"><Label>(f)</Label><Text>the same repatriation facilities in time of international crisis as diplomatic envoys; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661394" lims:id="661394"><Label>(g)</Label><Text>the right to import free of duty their furniture and effects at the time of first taking up their post in Canada.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="661395" lims:id="661395"><Label>6</Label><Text>Senior officials and officials of the Union who are Canadian citizens or permanent residents shall have the following privileges and immunities set out in Section 18 of Article V of the Convention:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661396" lims:id="661396"><Label>(a)</Label><Text>immunity from legal process in respect of words spoken or written and all acts performed by them in their official capacity; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661397" lims:id="661397"><Label>(b)</Label><Text>the same privileges in respect of exchange facilities as are accorded to the officials of comparable ranks forming part of diplomatic missions to the Government of Canada.</Text></Paragraph></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="661398" lims:id="661398"><Label>7</Label><Text>Experts performing missions for the Union who are not Canadian citizens or permanent residents shall have the privileges and immunities set out in Article VI of the Convention.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="661399" lims:id="661399"><Label>8</Label><Text>Experts performing missions for the Union who are Canadian citizens or permanent residents shall have, during their journey to and from the place of mission in Canada, as well as in Canada, the following privileges and immunities set out in Section 22 of Article VI of the Convention, subject to the restrictions set out in Section 23 of that Article:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661400" lims:id="661400"><Label>(a)</Label><Text>in respect of words spoken or written and acts done by them in the course of the performance of their mission, immunity from legal process of every kind, which immunity shall continue to be accorded notwithstanding that the persons concerned are no longer employed on missions for the Union; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="661401" lims:id="661401"><Label>(b)</Label><Text>inviolability for all papers and documents.</Text></Paragraph></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="661402" lims:id="661402" level="1"><TitleText>Coming into Force</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="661403" lims:id="661403"><Label>9</Label><Text>This Order comes into force on the day on which it is registered.</Text></Section></Body></Regulation>
