Whereas the Public Service Commission has decided it is not practicable nor in the best interests of the Public Service(a)in relation to qualifications other than language skills, to apply section 10 of the Public Service Employment Act to training positions in the Department of Transport to which are appointed employees of that Department who participate in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program,(b)in relation to qualifications other than language skills, to apply section 10 of the Public Service Employment Act to operational positions in the Department of Transport to which will be appointed trainees who have successfully completed their training in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program,(c)to apply subsection 21(1) of the Public Service Employment Act to all persons who, but for this Order, would have a right of appeal under that subsection against the appointment to training positions in the Department of Transport of certain employees of that Department who participate in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program,(d)to apply subsection 21(1) of the Public Service Employment Act to all persons who, but for this Order, would have a right of appeal under that subsection against the appointment of operational positions in the Department of Transport of trainees who have successfully completed their training in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program,(e)to apply subsection 21(1) of the Public Service Employment Act to all persons who, but for this Order, would have a right of appeal under that subsection against the appointment to positions in the Department of Transport of trainees who have not successfully completed or have terminated without completing their training in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Traffic Down Program,during the period beginning on May 1, 1989 and ending on April 30, 1991.And Whereas the Public Service Commission recommends that, pursuant to subsection 41(1) of the Public Service Employment Act, the Governor in Council approve the exclusion by the Public Service Commission from the operation of section 10 and subsection 21(1) of the Public Service Employment Act of certain persons and positions.Therefore, Her Excellency the Governor General in Council, on the recommendation of the Secretary of State, pursuant to subsection 41(1) of the Public Service Employment Act, is pleased hereby to make the annexed Order approving the exclusion by the Public Service Commission from the operation of section 10 and subsection 21(1) of the Public Service Employment Act of certain persons and positions.Short Title

1This Order may be cited as the Exclusion Approval Order for Certain Employees and Certain Positions (Air Traffic Control Group), 1989.

Approval

2The exclusion by the Public Service Commission, from the operation of section 10 of the Public Service Employment Act, in relation to qualifications other than language skills, of training positions in the Department of Transport to which will be appointed employees of that Department who participate in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program, during the period beginning on May 1, 1989 and ending on April 30, 1991, is hereby approved.

3The exclusion by the Public Service Commission, from the operation of section 10 of the Public Service Employment Act, in relation to qualifications other than language skills, of operational positions in the Department of Transport to which will be appointed trainees who have successfully completed their training in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program, during the period beginning on May 1, 1989 and ending on April 30, 1991, is hereby approved.

4The exclusion by the Public Service Commission, from the operation of subsection 21(1) of the Public Service Employment Act, of all persons who, but for this Order, would have a right of appeal under that subsection against the appointment to training positions in the Department of Transport of certain employees of that Department who participate in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program, during the period beginning on May 1, 1989 and ending on April 30, 1991, is hereby approved.

5The exclusion by the Public Service Commission, from the operation of subsection 21(1) of the Public Service Employment Act, of all persons who, but for this Order, would have a right of appeal under that subsection against the appointment to operational positions in the Department of Transport of trainees who have successfully completed their training in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program, during the period beginning on May 1, 1989 and ending on April 30, 1991, is hereby approved.

6The exclusion by the Public Service Commission, from the operation of subsection 21(1) of the Public Service Employment Act, of all persons who, but for this Order, would have a right of appeal under that subsection against the appointment to positions in the Department of Transport of trainees who have not successfully completed or have terminated without completing their training in the Selection by Seniority Program for air traffic control training or in the Air Traffic Controllers Transfer Down Program during the period beginning on May 1, 1989 and ending on April 30, 1991, is hereby approved.
