(<Emphasis style="italic">organisme accrédité</Emphasis>)</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="641274" lims:id="641274" level="1"><TitleText>Remission</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="641275" lims:id="641275"><Label>3</Label><Text>Subject to section 4, remission is hereby granted of the taxes imposed under Division III of Part IX and under any other Part of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> and customs duties imposed under section 21 of the <XRefExternal reference-type="act" link="C-54.011">Customs Tariff</XRefExternal>, paid or payable on goods that are imported and used solely for testing or examination for certification by an accredited organization.</Text><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="641277" lims:id="641277">SI/88-18, s. 2; SI/91-8, s. 2; SI/98-15, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="641278" lims:id="641278" level="1"><TitleText>Conditions</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="641279" lims:id="641279"><Label>4</Label><Text>Remission under section 3 is granted on condition that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="641280" lims:id="641280"><Label>(a)</Label><Text>an application for remission is made to the Minister of National Revenue within two years after the date of importation of the goods for which remission is claimed;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="641281" lims:id="641281"><Label>(b)</Label><Text>the goods are imported on or after July 1, 1986 by or on behalf of an accredited organization, for testing or examination by that organization;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="641282" lims:id="641282"><Label>(c)</Label><Text>the goods are neither sold nor given to any person other than an accredited organization in Canada by or on behalf of the importer, and on completion of the testing or examination the goods are either exported or destroyed by or on behalf of the importer; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="641283" lims:id="641283"><Label>(d)</Label><Text>the applicant provides such other evidence as is necessary to demonstrate to the Minister of National Revenue that the applicant is entitled to the remission.</Text></Paragraph></Section></Body></Regulation>
