(<Language xml:lang="fr">Admission Temporaire</Language> — Temporary Admission) Carnet as set out in the <XRefExternal reference-type="other">Annex to the Customs Convention on the A.T.A. Carnet for the Temporary Admission of Goods</XRefExternal>; (<DefinedTermFr>carnet</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="639480" lims:id="639480" generate-in-text="no"><Text><DefinedTermEn>chief officer of customs</DefinedTermEn>, with respect to an area or place, means the manager of the customs office or customs offices that serve that area or place; (<DefinedTermFr>agent en chef des douanes</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="639481" lims:id="639481" generate-in-text="no"><Text><DefinedTermEn>convention materials</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639482" lims:id="639482"><Label>(a)</Label><Text>banners, flags, papers, shields, stand decorations, backdrops and other decorations,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639483" lims:id="639483"><Label>(b)</Label><Text>stationery, paper clips, pens, pencils and similar items but does not include office machines,</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639484" lims:id="639484"><Label>(c)</Label><Text>identification badges, and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639485" lims:id="639485"><Label>(d)</Label><Text>printing plates, including rolls and cylinders, matrices, moulds, exposed positive or negative films and other similar goods necessary to produce advertising matter relating to a meeting or convention; (<DefinedTermFr>articles de congrès</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="639486" lims:id="639486" generate-in-text="no"><Text><DefinedTermEn>foreign organization</DefinedTermEn> means a corporation whose head office is outside Canada or an association that is not incorporated and none of whose members are residents of Canada but does not include a Canadian branch of any such association; (<DefinedTermFr>organisation étrangère</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="639487" lims:id="639487" generate-in-text="no"><Text><DefinedTermEn>official paraphernalia</DefinedTermEn> means mugs, jewellery, pens, scarves, t-shirts, badges and similar items, each bearing the official registered symbol of a foreign organization; (<DefinedTermFr>accessoires officiels</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2006-03-22" lims:fid="639488" lims:id="639488" generate-in-text="no"><Text><DefinedTermEn>souvenirs</DefinedTermEn> means lapel buttons, billfolds, keycases, pens, pencils, corsages, t-shirts, scarves and similar items. (<DefinedTermFr>souvenirs</DefinedTermFr>) </Text></Definition><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="639490" lims:id="639490">SI/88-18, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="639491" lims:id="639491" level="1"><TitleText>Application</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="639492" lims:id="639492"><Label>3</Label><Text>This Order applies only to meetings or conventions held in Canada by foreign organizations.</Text></Section><Heading lims:inforce-start-date="2006-03-22" lims:fid="639493" lims:id="639493" level="1"><TitleText>Remission</TitleText></Heading><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="639494" lims:id="639494"><Label>4</Label><Text>Subject to section 7, remission is hereby granted of all taxes paid or payable under Division III of Part IX and under any other Part of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> on or in respect of the following goods:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639495" lims:id="639495"><Label>(a)</Label><Text>any convention materials imported for use in the conduct of a meeting or convention; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639496" lims:id="639496"><Label>(b)</Label><Text>any advertising matter or souvenirs, the individual value of which does not exceed $25, imported for free distribution to persons attending a meeting or convention.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="639498" lims:id="639498">SI/88-18, s. 2(E); SI/91-8, s. 2; SI/98-13, s. 2</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="639499" lims:id="639499"><Label>5</Label><Text>Subject to sections 7 and 8, remission is hereby granted of all taxes paid or payable under Division III of Part IX and under any other Part of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> on or in respect of the following goods:</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639500" lims:id="639500"><Label>(a)</Label><Text>any projector, camera, sound and lighting equipment, audio-visual equipment, typewriter or other office machine that is the property of a foreign organization and is imported for use in the conduct of a meeting or convention, on condition that such goods are exported forthwith on conclusion of the meeting or convention; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639501" lims:id="639501"><Label>(b)</Label><Text>any souvenirs, the individual value of which exceeds $25, that are imported for free distribution to persons attending a meeting or convention, on condition that all such souvenirs are exported forthwith on conclusion of the meeting or convention.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="639503" lims:id="639503">SI/88-18, s. 2(E); SI/91-8, s. 2; SI/98-13, s. 3</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="639504" lims:id="639504"><Label>6</Label><Text>Subject to sections 7 and 8, remission of all taxes paid or payable under Division III of Part IX and under any other Part of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> on official paraphernalia imported by a foreign organization for sale at a meeting or convention and sold at the meeting or convention is hereby granted in an amount equivalent to the percentage of non-residents officially in attendance at the meeting or convention on condition that</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639505" lims:id="639505"><Label>(a)</Label><Text>the foreign organization maintains records of attendance at and registration for the meeting or convention and produces the records for inspection at any reasonable time on request of an officer employed in the administration of the <XRefExternal reference-type="act" link="C-52.6">Customs Act</XRefExternal> or the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639506" lims:id="639506"><Label>(b)</Label><Text>any official paraphernalia imported by the foreign organization for sale at the meeting or convention that is not sold is exported forthwith on conclusion of the meeting or convention; and</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639507" lims:id="639507"><Label>(c)</Label><Text>the meeting or convention is not open to the Canadian public at large.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="639509" lims:id="639509">SI/88-18, s. 2; SI/91-8, s. 2; SI/98-13, s. 4</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="639510" lims:id="639510"><Label>7</Label><Text>Remission is granted under sections 4 to 6 on condition that an application therefor is submitted to the Minister of National Revenue within two years of the date of importation of the goods for which remission is claimed.</Text></Section><Section lims:inforce-start-date="2006-03-22" lims:lastAmendedDate="2006-03-22" lims:fid="639511" lims:id="639511"><Label>8</Label><Subsection lims:inforce-start-date="2006-03-22" lims:fid="639512" lims:id="639512"><Label>(1)</Label><Text>Where goods referred to in section 5 or 6 are imported into Canada for a temporary period and are not accompanied by a valid carnet, remission is hereby granted in respect of the goods on the condition that the importer of those goods, on request of the chief officer of customs, posts security in an amount not exceeding the aggregate of the taxes imposed under Division III of Part IX and under any other Part of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> that would be payable if this Order did not apply.</Text></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="639513" lims:id="639513"><Label>(2)</Label><Text>Security given under subsection (1) shall be deposited with the chief officer of customs and shall be in the form of</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639514" lims:id="639514"><Label>(a)</Label><Text>cash;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639515" lims:id="639515"><Label>(b)</Label><Text>a certified cheque;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639516" lims:id="639516"><Label>(c)</Label><Text>a transferable bond issued by the Government of Canada; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639517" lims:id="639517"><Label>(d)</Label><Text>a bond issued by</Text><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="639518" lims:id="639518"><Label>(i)</Label><Text>an entity that is licensed or otherwise authorized under the laws of Canada or of a province to carry on the fidelity or surety class of insurance business and that is recommended to the Treasury Board by the Office of the Superintendent of Financial Institutions as an entity whose bonds may be accepted by the Government of Canada,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="639519" lims:id="639519"><Label>(ii)</Label><Text>a member of the Canadian Payments Association referred to in section 4 of the <XRefExternal reference-type="act">Canadian Payments Association Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="639520" lims:id="639520"><Label>(iii)</Label><Text>a corporation that accepts deposits insured by the Canada Deposit Insurance Corporation or by the <Language xml:lang="fr">Régie de l’assurance-dépôts du Québec</Language> to the maximums permitted by the statutes under which those institutions are established,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="639521" lims:id="639521"><Label>(iv)</Label><Text>a credit union, as defined in subsection 137(6) of the <XRefExternal reference-type="act" link="I-3.3">Income Tax Act</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2006-03-22" lims:fid="639522" lims:id="639522"><Label>(v)</Label><Text>a corporation that accepts deposits from the public, if repayment of the deposits is guaranteed by Her Majesty in right of a province.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2006-03-22" lims:fid="639523" lims:id="639523"><Label>(3)</Label><Text>Security given pursuant to subsection (1) in respect of goods referred to in section 5 or 6 shall be refunded or cancelled if</Text><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639524" lims:id="639524"><Label>(a)</Label><Text>the goods are destroyed, where the destruction is certified by a customs officer, police officer or fire marshall;</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639525" lims:id="639525"><Label>(b)</Label><Text>the goods are exported on conclusion of the meeting or convention in respect of which they were imported, where the exportation is certified by a customs officer; or</Text></Paragraph><Paragraph lims:inforce-start-date="2006-03-22" lims:fid="639526" lims:id="639526"><Label>(c)</Label><Text>all taxes payable under Division III of Part IX and under any other Part of the <XRefExternal reference-type="act" link="E-15">Excise Tax Act</XRefExternal> are paid.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2006-03-22" lims:fid="639528" lims:id="639528">SI/88-18, s. 2;
