Her Excellency the Governor General in Council, considering that it is in the public interest to do so, on the recommendation of the Minister of Human Resources and Skills Development and the Treasury Board, pursuant to subsection 23(2.1)a of the Financial Administration Act, hereby makes the annexed Overpayments of Canada Education Savings Grants Remission Order.aS.C. 1991, c. 24, s. 7(2)Remission

1Remission is hereby granted to any beneficiary of an overpayment in respect of a Canada Education Savings grant paid under the Canada Education Savings Act and the Canada Education Savings Regulations during the period beginning on January 1, 1998 and ending on June 30, 2005.

Conditions

2The remission is granted on the condition that(a)the beneficiary is a person so designated in respect of a registered education savings plan within the meaning of section 146.1 of the Income Tax Act;(b)the grant was paid to or for the benefit of the beneficiary during the period specified in section 1;(c)the grant has not been repaid; and(d)the minimum contributions under subparagraph 4(1)(c)(i) or (ii) of the Canada Education Savings Regulations were not made to the registered education savings plan in respect of the beneficiary.
