anything on which information that is capable of being understood by a person, or read by a computer or other device, is recorded or the atmosphere,</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446529" lims:id="446529"><Label>(c)</Label><Text>all organic and inorganic matter and living organisms, and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446530" lims:id="446530"><Label>(d)</Label><Text>the interacting natural systems that include components referred to in paragraphs (a) to (c); (<DefinedTermFr>environnement</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="446531" lims:id="446542"><Text><DefinedTermEn>place</DefinedTermEn> includes any vehicle, vessel, railway car or aircraft; (<DefinedTermFr>lieu</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="446543" lims:id="446543"><Text><DefinedTermEn>prescribed</DefinedTermEn> means prescribed by regulation;</Text></Definition><Definition lims:inforce-start-date="2015-02-27" lims:fid="446544" lims:id="446544"><Text><DefinedTermEn>seed</DefinedTermEn> means any plant part of any species belonging to the plant kingdom, represented, sold lims:fid="446575" lims:id="446575"><Label>(1)</Label><Text>The Governor in Council may make regulations</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446576" lims:id="446576"><Label>(a)</Label><Text>establishing grades with appropriate grade names for seeds;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446577" lims:id="446577"><Label>(a.1)</Label><Text>providing, with respect to grades requiring varietal purity, for the determination of varietal purity of seed crops and, in particular, for any such determination to be made by the Canadian Seed Growers’ Association and any standards established by that Association to be used;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446578" lims:id="446578"><Label>(a.2)</Label><Text>respecting the sale, importation or exportation of any seed that presents a risk of harm to human, animal or plant health or the environment;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446579" lims:id="446579"><Label>(a.3)</Label><Text>respecting the sending or conveying from one province to another or the importation or exportation of any seed;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446580" lims:id="446580"><Label>(a.4)</Label><Text>respecting the sale of any seed that has been imported or is to be exported or to be sent or conveyed from one province to another;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446581" lims:id="446581"><Label>(b)</Label><Text>prescribing the terms and conditions under which and the manner in which seed crops may be inspected or seeds may be graded or tested;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446582" lims:id="446582"><Label>(b.1)</Label><Text>respecting licences referred to in section 4.2, including their issuance, the conditions to which they may be subject and their amendment, suspension or revocation;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446583" lims:id="446583"><Label>(c)</Label><Text>prescribing the minimum standards of purity, germination, quality and disease for seeds;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446584" lims:id="446584"><Label>(d)</Label><Text>respecting the packing and marking of seeds and the marking and labelling of packages of seeds;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446585" lims:id="446585"><Label>(e)</Label><Text>prescribing the terms and conditions under which variety names of seeds may be used;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446586" lims:id="446586"><Label>(f)</Label><Text>exempting, with or without conditions, any item to which this Act applies, or a person or activity in respect of seed, from the application of this Act or the regulations or a provision of this Act or the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446587" lims:id="446587"><Label>(g)</Label><Text>respecting the taking of samples and the testing of seeds for the purposes of this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446588" lims:id="446588"><Label>(g.1)</Label><Text>requiring persons to take or keep samples of any seed, or its package or label, and to provide the Minister or an inspector with, or with access to, those samples, and respecting the manner in which those samples are to be taken or kept and the manner in which they are to be provided or access to them is to be provided;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446589" lims:id="446589"><Label>(h)</Label><Text>respecting the fees that may be charged for any services provided under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446590" lims:id="446590"><Label>(h.1)</Label><Text>prescribing information that shall be given, and prohibiting or restricting the use of variety names, in labelling or advertising seeds for sale or making, in prescribed circumstances, offers of seeds for sale;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446591" lims:id="446591"><Label>(h.2)</Label><Text>respecting the registration of varieties of seeds and the amendment of the register of such varieties;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446592" lims:id="446592"><Label>(h.3)</Label><Text>specifying terms and conditions to which registration referred to in paragraph (h.2) shall be subject, including any limitation respecting the duration of any such registration or restricting any effect thereof to a region specified in the regulations;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446593" lims:id="446593"><Label>(h.4)</Label><Text>prescribing the procedure for review of cases involving the refusal, suspension or cancellation of any registration referred to in paragraph (h.2);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446594" lims:id="446594"><Label>(h.5)</Label><Text>determining the cases in which and the conditions, including provision of a bond or suretyship, under which seeds shall, for the purposes of this Act, be transported and stored on importation;</Text></Paragraph><Paragraph lims:inforce-start-date="2019-01-15" lims:enacted-date="2012-11-22" lims:fid="1110053" lims:id="1110053"><Label>(h.6)</Label><Text>respecting the registration of establishments that prepare seeds and the licensing of operators of those establishments, including the renewal, cancellation and suspension of those registrations and licences and the conditions to which they are subject;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446595" lims:id="446595"><Label>(i)</Label><Text>respecting the detention, preservation and safeguarding of anything seized under section 8;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446596" lims:id="446596"><Label>(i.1)</Label><Text>providing for any reasonable costs incidental to any seizure under this section, and to the detention of the thing seized, to be payable by and recoverable from the person entitled to possession thereof at the time of the seizure;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446597" lims:id="446597"><Label>(j)</Label><Text>respecting the disposition of anything forfeited under section 8;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446598" lims:id="446598"><Label>(j.1)</Label><Text>requiring persons to prepare, keep or maintain documents and to provide the Minister or an inspector with, or with access to, those documents, and respecting</Text><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="446599" lims:id="446599"><Label>(i)</Label><Text>the information in those documents,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="446600" lims:id="446600"><Label>(ii)</Label><Text>the manner in which they are to be prepared, kept or maintained,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="446601" lims:id="446601"><Label>(iii)</Label><Text>the place where they are to be kept or maintained, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2015-02-27" lims:fid="446602" lims:id="446602"><Label>(iv)</Label><Text>the manner in which they are to be provided or access to them is to be provided;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446603" lims:id="446603"><Label>(j.2)</Label><Text>respecting the issuance of certificates or other documents for the purpose of section 4.11;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446604" lims:id="446604"><Label>(j.3)</Label><Text>respecting quality management programs, quality control programs, safety programs, preventive control plans or any other similar programs or plans to be implemented by persons who conduct any activity regulated under this Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446605" lims:id="446605"><Label>(k)</Label><Text>prescribing anything else that by this Act is required to be prescribed; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446606" lims:id="446606"><Label>(l)</Label><Text>generally, for carrying out the purposes and provisions of this Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="446607" lims:id="446607"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="446608" lims:id="446608">Weed seeds</MarginalNote><Label>(2)</Label><Text id="statutory">The Minister may, by order, specify the kinds of plants whose seeds are, for the purposes of this Act, weed seeds.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="446609" lims:id="446609"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="446610" lims:id="446610">Paragraphs (1)(a.2) and (a.3)</MarginalNote><Label>(3)</Label><Text>Regulations made under paragraph (1)(a.2) or (a.3) may, among other things, establish preclearance or in-transit S-8, s. 8; 1995, c. 40, s. 87; 2015, c. 2, s. 80</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2015-02-27" lims:lastAmendedDate="2015-02-27" lims:fid="446702" lims:id="446702"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="446703" lims:id="446703">Removal or destruction of unlawful imports</MarginalNote><Label>8.1</Label><Subsection lims:inforce-start-date="2015-02-27" lims:fid="446704" lims:id="446704"><Label>(1)</Label><Text>An inspector who has reasonable grounds to believe that imported seed does not meet the requirements of the regulations or was imported in contravention of a provision of this Act or the regulations may, by notice, whether the seed is seized or not, order its owner or importer or the person having possession, care or control of it to remove it from Canada or, if removal is not possible, to destroy it.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="446705" lims:id="446705"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="446706" lims:id="446706">Notice</MarginalNote><Label>(2)</Label><Text>The notice must either be delivered personally to the owner or importer of the seed or to the person having possession, care or control of it or be sent by registered mail to the owner’s, importer’s or person’s address in Canada.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="446707" lims:id="446707"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="446708" lims:id="446708">Forfeiture</MarginalNote><Label>(3)</Label><Text>If the seed is not removed from Canada or destroyed within the period specified in the notice — or, if no period was specified, within 90 days after the day on which the notice was delivered or sent — it is, despite subsection 8(2), forfeited to Her Majesty in right of Canada and may be disposed of as the Minister may direct.</Text></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="446709" lims:id="446709"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="446710" lims:id="446710">Suspension of application of subsection (3)</MarginalNote><Label>(4)</Label><Text>An inspector may, for a period that he or she specifies, suspend the application of subsection (3) if he or she is satisfied that</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446711" lims:id="446711"><Label>(a)</Label><Text>harm to human, animal or plant health or the environment is unlikely to result;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446712" lims:id="446712"><Label>(b)</Label><Text>the seed will not be sold within that period;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446713" lims:id="446713"><Label>(c)</Label><Text>the measures that should have been taken for the seed not to have been imported in contravention of a provision of this Act or the regulations will be taken within that period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446714" lims:id="446714"><Label>(d)</Label><Text>if the seed does not meet the requirements of the regulations, it will be brought into compliance with the regulations within that period.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="446715" lims:id="446715"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="446716" lims:id="446716">Cancellation</MarginalNote><Label>(5)</Label><Text>An inspector may cancel the notice if he or she is satisfied that</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446717" lims:id="446717"><Label>(a)</Label><Text>harm to human, animal or plant health or the environment is unlikely to result;</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446718" lims:id="446718"><Label>(b)</Label><Text>the seed has not been sold within the period referred to in subsection (6);</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446719" lims:id="446719"><Label>(c)</Label><Text>the measures referred to in paragraph (4)(c) were taken within that period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446720" lims:id="446720"><Label>(d)</Label><Text>if the seed did not meet the requirements of the regulations when it was imported, it was brought into compliance with the regulations within that period.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2015-02-27" lims:fid="446721" lims:id="446721"><MarginalNote lims:inforce-start-date="2015-02-27" lims:fid="446722" lims:id="446722">Period</MarginalNote><Label>(6)</Label><Text>The period for the purposes of subsection (5) is</Text><Paragraph lims:inforce-start-date="2015-02-27" lims:fid="446723" lims:id="446723"><Label>(a)</Label><Text>if the application of subsection (3) was suspended under subsection (4), the period of the suspension;
