lims:inforce-start-date="2017-06-22" lims:fid="446392" lims:id="446392" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2012-06-29" lims:id="446394">Definitions</MarginalNote><Label>2</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2012-06-29" lims:fid="446395" lims:id="446395"><Text><DefinedTermEn>Crown corporation</DefinedTermEn> has the same meaning as in subsection 83(1) of the <XRefExternal reference-type="act" link="F-11">Financial Administration level="1"><TitleText>Designation of Minister</TitleText></Heading><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="446399" lims:id="446399"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446400" lims:id="446400">Power of Governor in Council</MarginalNote><Label>3</Label><Text>The Governor in Council may designate a member of the Queen’s Privy Council for Canada to be the Minister for the purposes of this Act.</Text></Section><Heading lims:inforce-start-date="2017-06-22" lims:fid="446401" lims:id="446401" level="1"><TitleText>Establishment</TitleText></Heading><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="446402" lims:id="446402"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446403" lims:id="446403">Establishment</MarginalNote><Label>4</Label><Text>A department is established, called Shared Services Canada, for the purpose of assisting the Minister in providing the services specified under section <XRefInternal>6</XRefInternal>.</Text></Section><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="446404" lims:id="446404"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446405" lims:id="446405">Minister</MarginalNote><Label>5</Label><Text>The Minister presides over Shared Services Canada and has the management and direction of it.</Text></Section><Heading lims:inforce-start-date="2017-06-22" lims:fid="446406" lims:id="446406" level="1"><TitleText>Powers, Duties and Functions</TitleText></Heading><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="446407" lims:id="446407"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446408" lims:id="446408">Governor in Council</MarginalNote><Label>6</Label><Text>The Governor in Council may specify</Text><Paragraph lims:inforce-start-date="2012-06-29" lims:fid="446409" lims:id="446409"><Label>(a)</Label><Text>the services that the Minister must provide through Shared Services Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-29" lims:fid="446410" lims:id="446410"><Label>(b)</Label><Text>the services that the Minister may provide through Shared Services Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-29" lims:fid="446411" lims:id="446411"><Label>(c)</Label><Text>the departments that must obtain a service that is specified under paragraph (a) exclusively from the Minister through Shared Services Canada and that are not permitted to meet their requirement for that service internally;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-29" lims:fid="446412" lims:id="446412"><Label>(d)</Label><Text>the departments and Crown corporations to which the Minister is permitted to provide services through Shared Services Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-29" lims:fid="446413" lims:id="446413"><Label>(e)</Label><Text>the departments and Crown corporations to which the Minister is not permitted to provide services through Shared Services Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2012-06-29" lims:fid="446414" lims:id="446414"><Label>(f)</Label><Text>terms and conditions respecting the provision of the specified services.</Text></Paragraph></Section><Section lims:inforce-start-date="2017-06-22" lims:lastAmendedDate="2017-06-22" lims:fid="446415" lims:id="446415"><MarginalNote lims:inforce-start-date="2017-06-22" lims:fid="446416" lims:id="446416">Minister</MarginalNote><Label>7</Label><Text>The Minister may, for the purpose of providing services under this Act, exercise any of the powers, or perform any of the duties or functions, that are set out in paragraph 6(a), (b), (c) or (g) of the <XRefExternal reference-type="act" link="P-38.2">Department of Public Works and Government Services Act</XRefExternal> in respect of departments, Crown corporations, persons, organizations and governments to which those services are lims:inforce-start-date="2017-06-22" lims:fid="446420" lims:id="446420">Delegation — appropriate Minister</MarginalNote><Label>7.1</Label><Subsection lims:inforce-start-date="2017-06-22" lims:fid="446421" lims:id="446421"><Label>(1)</Label><Text>For the purpose of providing services under this Act to a department through Shared Services Canada, the Minister may delegate any of his or her powers under section 7 in respect of that department, for any period and under any terms and conditions that he or she considers suitable, to that department’s appropriate Minister.</Text></Subsection><Subsection lims:inforce-start-date="2017-06-22" lims:fid="446422" lims:id="446422"><MarginalNote lims:inforce-start-date="2017-06-22" lims:fid="446423" lims:id="446423">Delegation — chief executive</MarginalNote><Label>(2)</Label><Text>For the purpose of providing services under this Act, through Shared Services Canada, to a department over which the Minister does not preside but for which he or she is the appropriate Minister, the Minister may delegate any of his or her powers under section 7 in respect of that department, for any period and under any terms and conditions that he or she considers suitable, to that department’s chief executive.</Text></Subsection><Subsection lims:inforce-start-date="2017-06-22" lims:fid="446424" lims:id="446424"><MarginalNote lims:inforce-start-date="2017-06-22" lims:fid="446425" lims:id="446425">Subdelegation — chief executive</MarginalNote><Label>(3)</Label><Text>The appropriate Minister for a department may, subject to and in accordance with the delegation under subsection (1), subdelegate to the chief executive of that department, for any period and under any terms and conditions that the appropriate Minister considers suitable, the power that was delegated to him or her under that subsection.</Text></Subsection><Subsection lims:inforce-start-date="2017-06-22" lims:fid="446426" lims:id="446426"><MarginalNote lims:inforce-start-date="2017-06-22" lims:fid="446427" lims:id="446427">Subdelegation — subordinate</MarginalNote><Label>(4)</Label><Text>The chief executive of a department may, subject to and in accordance with the delegation under subsection (2) or the subdelegation under subsection (3), subdelegate to any person under his or her jurisdiction, for any period and under any terms and conditions that the chief executive considers suitable, the power that was delegated or subdelegated, as the case may be, to him or her under that subsection.</Text></Subsection><Subsection lims:inforce-start-date="2017-06-22" lims:fid="446428" lims:id="446428"><MarginalNote lims:inforce-start-date="2017-06-22" lims:fid="446429" lims:id="446429">Definitions</MarginalNote><Label>(5)</Label><Text>The following definitions apply in this section.</Text><Definition lims:inforce-start-date="2017-06-22" lims:fid="446430" lims:id="446430"><Text><DefinedTermEn>appropriate Minister</DefinedTermEn> has the same meaning as in section 2 of the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>. (<DefinedTermFr>ministre compétent</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2017-06-22" lims:fid="446431" lims:id="446431"><Text><DefinedTermEn>chief executive</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2017-06-22" lims:fid="446432" lims:id="446432"><Label>(a)</Label><Text>with respect to a department named in Part I of Schedule VI to the <XRefExternal reference-type="act" link="F-11">Financial Administration Act</XRefExternal>, its deputy minister;</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-22" lims:fid="446433" lims:id="446433"><Label>(b)</Label><Text>with respect to a department named in Part II or III of that Schedule, the person occupying the position set out opposite that name; and</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-22" lims:fid="446434" lims:id="446434"><Label>(c)</Label><Text>with respect to a department that is not named in that Schedule, the chief executive officer, the deputy head or the person who occupies any other similar position, however called, in that department. (<DefinedTermFr>administrateur principal</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2017-06-22" lims:fid="446436" lims:id="446436">2017, c. 20, s. 113</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="446437" lims:id="446437"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446438" lims:id="446438">Governor in Council’s approval</MarginalNote><Label>8</Label><Text>The Minister may — with the Governor in Council’s approval, given on a general or a specific basis — provide the services that are specified under paragraph <XRefInternal>6</XRefInternal>(a) or (b) through Shared Services Canada to any person, organization or government, including a foreign government.</Text></Section><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="446439" lims:id="446439"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446440" lims:id="446440">Charging for services</MarginalNote><Label>9</Label><Text>The Minister may, subject to any regulations that the Treasury Board makes for the purposes of this section, charge for the services that are provided under this Act.</Text></Section><Section lims:inforce-start-date="2017-06-22" lims:lastAmendedDate="2017-06-22" lims:fid="446441" lims:id="446441"><MarginalNote lims:inforce-start-date="2017-06-22" lims:fid="446442" lims:id="446442">Authorization</MarginalNote><Label>9.1</Label><Subsection lims:inforce-start-date="2017-06-22" lims:fid="446443" lims:id="446443"><Label>(1)</Label><Text>Despite the Governor in Council having specified, under paragraph 6(c), that a department must obtain a service that is specified under paragraph 6(a) exclusively from the Minister through Shared Services Canada and is not permitted to meet its requirement for that service internally, the Minister may, if the Minister considers that exceptional circumstances justify it, and under any terms and conditions that the Minister specifies,</Text><Paragraph lims:inforce-start-date="2017-06-22" lims:fid="446444" lims:id="446444"><Label>(a)</Label><Text>authorize that department to obtain part of that service other than from the Minister through Shared Services Canada, including by meeting its requirement for that part of the service internally; or</Text></Paragraph><Paragraph lims:inforce-start-date="2017-06-22" lims:fid="446445" lims:id="446445"><Label>(b)</Label><Text>authorize that department to obtain all of that service in respect of one or more portions of the department — but not all of the department — other than from the Minister through Shared Services Canada, including by meeting its requirement for that service internally.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2017-06-22" lims:fid="446446" lims:id="446446"><MarginalNote lims:inforce-start-date="2017-06-22" lims:fid="446447" lims:id="446447">Power exercised personally</MarginalNote><Label>(2)</Label><Text>The Minister must personally exercise the power that is set out in subsection (1).</Text></Subsection><Subsection lims:inforce-start-date="2017-06-22" lims:fid="446448" lims:id="446448"><MarginalNote lims:inforce-start-date="2017-06-22" lims:fid="446449" lims:id="446449">Instructions</MarginalNote><Label>(3)</Label><Text>A department that is authorized, under subsection (1), to obtain all or part of a service other than from the Minister through Shared Services Canada, including by meeting its requirement for that service or that part of the service internally, must do so in accordance with any instructions that the Minister lims:id="446462">Executive Vice-president</MarginalNote><Label>(2)</Label><Text>The Executive Vice-president is to act as President if that office is vacant or if the President is absent or Region that is described in the schedule to the <XRefExternal reference-type="act" link="N-4">National Capital Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2017-06-22" lims:fid="446467" lims:id="446467" level="1"><TitleText>Human Resources</TitleText></Heading><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="446468" lims:id="446468"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446469" lims:id="446469">Appointment of employees</MarginalNote><Label>14</Label><Text>The employees that are necessary for the conduct of Shared Services Canada’s work are to be appointed in accordance with the <XRefExternal reference-type="act" link="P-33.01">Public Service Employment Act</XRefExternal>.</Text></Section><Heading lims:inforce-start-date="2017-06-22" lims:fid="446470" lims:id="446470" level="1"><TitleText>General</TitleText></Heading><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="446471" lims:id="446471"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446472" lims:id="446472"><XRefExternal reference-type="act" link="A-1">Access to Information Act</XRefExternal></MarginalNote><Label>15</Label><Text>For greater certainty, for the purposes of the <XRefExternal reference-type="act" link="A-1">Access to Information Act</XRefExternal>, the records of other government institutions as defined in that Act or of other organizations that are, on behalf of those institutions or organizations, contained in or carried on Shared Services Canada’s information technology systems are not under the control of Shared Services Canada.</Text></Section><Section lims:inforce-start-date="2012-06-29" lims:lastAmendedDate="2012-06-29" lims:fid="446473" lims:id="446473"><MarginalNote lims:inforce-start-date="2012-06-29" occupying the position of President of the former department on the day on which this section comes into force becomes President of the new department on that day and is deemed to have been appointed under subsection <XRefInternal>10</XRefInternal>(1).</Text></Subsection><Subsection lims:inforce-start-date="2012-06-29" lims:fid="446485" lims:id="446485"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446486" lims:id="446486">Employees</MarginalNote><Label>(2)</Label><Text>Nothing in this Act is to be construed as affecting the status of an employee who, immediately before the coming into force of this section, occupied a position in the former department, except that the employee is, on the coming into force of this section, to occupy that fiscal year in which this section comes into force, by an appropriation Act based on the Estimates for that year for defraying the federal public administration’s charges and expenses for the former department that is unexpended on the day on which this section comes into force is deemed, on that day, to be an amount appropriated for defraying the federal public administration’s charges and expenses for the new department.</Text></Subsection><Subsection lims:inforce-start-date="2012-06-29" lims:fid="446492" lims:id="446492"><MarginalNote lims:inforce-start-date="2012-06-29" lims:fid="446493" lims:id="446493">Transfer of powers, duties and functions</MarginalNote><Label>(2)</Label><Text>If a power, duty or function is vested in or exercisable by the former department’s President or an employee of the former department under any Act, order, rule or regulation, or any contract, lease, licence or other document, that power, duty or function is vested in or is
