and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="445946" lims:id="445946"><Label>(c)</Label><Text>the privacy interests of sex offenders and the public interest in their rehabilitation and reintegration into the community as law-abiding citizens require that</Text><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="445947" lims:id="445947"><Label>(i)</Label><Text>the information be collected only to enable police services to prevent or investigate crimes of a sexual nature, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="445948" lims:id="445948"><Label>(ii)</Label><Text>access to the information, and use and disclosure of it, be restricted.</Text></Subparagraph></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-04-15" lims:fid="445950" lims:id="445950">2004, c. 10, s. 2; 2010, c. 17, s. 28</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-12-01" lims:fid="445951" lims:id="445951" level="1"><TitleText>Interpretation</TitleText></Heading><Section lims:inforce-start-date="2016-12-01" lims:lastAmendedDate="2016-12-01" lims:fid="445952" lims:id="445952"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="445953" lims:id="445953">Definitions</MarginalNote><Label>3</Label><Subsection lims:inforce-start-date="2016-12-01" lims:fid="445954" lims:id="445954"><Label>(1)</Label><Text>The following definitions apply in this Act.</Text><Definition lims:inforce-start-date="2016-12-01" lims:fid="445955" lims:id="445955"><Text><DefinedTermEn>database</DefinedTermEn> means the database that contains the information that is registered under this Act. (<DefinedTermFr>banque de données</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445956" lims:id="445956"><Text><DefinedTermEn>finding of not criminally responsible on account of mental disorder</DefinedTermEn> means a verdict of not criminally responsible on account of mental disorder within the meaning of subsection 672.1(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or a finding of not responsible on account of mental disorder within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, as the case may be. (<DefinedTermFr>verdict de non-responsabilité</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445957" lims:id="445957"><Text><DefinedTermEn>information</DefinedTermEn> includes characteristics recorded and photographs taken under subsection 5(3) and fingerprints taken under subsection 9(2). (<DefinedTermFr>renseignements</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445958" lims:id="445958"><Text><DefinedTermEn>main residence</DefinedTermEn> means the place in Canada where a person lives most often or, if there is no such place, the place in Canada where they may be found most often. (<DefinedTermFr>résidence principale</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445959" lims:id="445959"><Text><DefinedTermEn>member of a police service</DefinedTermEn> includes</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="445960" lims:id="445960"><Label>(a)</Label><Text>an officer or non-commissioned member of the Canadian Forces who is appointed for the purposes of section 156 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="445961" lims:id="445961"><Label>(b)</Label><Text>in an area in which an aboriginal police service is responsible for policing, a member of that police service. (<DefinedTermFr>membre d’un service de police</DefinedTermFr>)</Text></Paragraph></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445962" lims:id="445962"><Text><DefinedTermEn>Ontario Act</DefinedTermEn> has the same meaning as in subsection 490.011(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>. (<DefinedTermFr>loi ontarienne</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445963" lims:id="445963"><Text><DefinedTermEn>order</DefinedTermEn> means an order under section 490.012 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or section 227.01 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>. (<DefinedTermFr>ordonnance</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445964" lims:id="445964"><Text><DefinedTermEn>person who collects information</DefinedTermEn> means a person who is authorized to collect information under paragraph 18(1)(b) or subsection 19(1) of this Act or paragraph 227.2(c) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>. (<DefinedTermFr>préposé à la collecte</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445965" lims:id="445965"><Text><DefinedTermEn>person who registers information</DefinedTermEn> means a person who is authorized to register information under paragraph 18(1)(c) or subsection 19(1) of this Act or paragraph 227.2(d) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>. (<DefinedTermFr>préposé à l’enregistrement</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445966" lims:id="445966"><Text><DefinedTermEn>registration centre</DefinedTermEn> means a place that is designated as a registration centre under paragraph 18(1)(d) or subsection 19(1) of this Act or paragraph 227.2(e) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>. (<DefinedTermFr>bureau d’inscription</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445967" lims:id="445967"><Text><DefinedTermEn>retained</DefinedTermEn> means retained under a contract for services, whether the contract is entered into with an individual, or with their employer or another person to whom the individual provides services. (<DefinedTermFr>agent contractuel</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445968" lims:id="445968"><Text><DefinedTermEn>secondary residence</DefinedTermEn> means a place in Canada, other than a main residence, where a person regularly lives. (<DefinedTermFr>résidence secondaire</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445969" lims:id="445969"><Text><DefinedTermEn>sex offender</DefinedTermEn> means a person who is subject to an order or to an obligation under section 490.019 or 490.02901 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, section 227.06 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or section 36.1 of the <XRefExternal reference-type="act" link="I-20.6">International Transfer of Offenders Act</XRefExternal>. (<DefinedTermFr>délinquant sexuel</DefinedTermFr>)</Text></Definition><Definition lims:inforce-start-date="2016-12-01" lims:fid="445970" lims:id="445970"><Text><DefinedTermEn>sexual offence against a child</DefinedTermEn> means</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="445971" lims:id="445971"><Label>(a)</Label><Text>a designated offence as defined in subsection 490.011(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> that is committed against a person who is under 18 years of age and as a result of which the offender is required to comply with this Act; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="445972" lims:id="445972"><Label>(b)</Label><Text>an offence that is committed outside Canada against a person who is under 18 years of age and as a result of which the offender is required to comply with this Act. (<DefinedTermFr>infraction sexuelle visant un enfant</DefinedTermFr>)</Text></Paragraph></Definition></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="445973" lims:id="445973"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="445974" lims:id="445974">Interpretation</MarginalNote><Label>(2)</Label><Text>For the purposes of this Act, a crime is of a sexual nature if it consists of one or more acts that</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="445975" lims:id="445975"><Label>(a)</Label><Text>are either sexual in nature or committed with the intent to commit an act or acts that are sexual in nature; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="445976" lims:id="445976"><Label>(b)</Label><Text>constitute an offence.</Text></Paragraph></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2016-12-01" lims:fid="445978" lims:id="445978">2004, c. 10, s. 3; 2007, c. 5, s. 32; 2010, c. 17, s. 29; 2015, c. 23, s. 21</HistoricalNoteSubItem></HistoricalNote></Section><Heading lims:inforce-start-date="2016-12-01" lims:fid="445979" lims:id="445979" level="1"><TitleText>Obligations of Sex Offenders</TitleText></Heading><Section lims:inforce-start-date="2011-04-15" lims:lastAmendedDate="2011-04-15" lims:fid="445980" lims:id="445980"><MarginalNote lims:inforce-start-date="2011-04-15" lims:fid="445981" lims:id="445981">First obligation to report</MarginalNote><Label>4</Label><Subsection lims:inforce-start-date="2011-04-15" lims:fid="445982" lims:id="445982"><Label>(1)</Label><Text>A person who is subject to an order shall report to a registration centre referred to in section 7.1 within seven days — or, if they are required to report to a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, within 15 days — after</Text><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="445983" lims:id="445983"><Label>(a)</Label><Text>the order is made, if they are convicted of the offence in connection with which the order is made and</Text><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="445984" lims:id="445984"><Label>(i)</Label><Text>they are not given a custodial sentence,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="445985" lims:id="445985"><Label>(ii)</Label><Text>they are ordered to serve a sentence of imprisonment intermittently under subsection 732(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="445986" lims:id="445986"><Label>(iii)</Label><Text>they are the subject of a conditional sentence order made under section 742.1 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="445987" lims:id="445987"><Label>(b)</Label><Text>they receive an absolute or conditional discharge under Part XX.1 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, if they are found not criminally responsible on account of mental disorder for the offence in connection with which the order is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="445988" lims:id="445988"><Label>(b.1)</Label><Text>they receive an absolute or conditional discharge or are released from custody under Division 7 of Part III of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, if they are found not criminally responsible on account of mental disorder for the offence in connection with which the order is made;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="445989" lims:id="445989"><Label>(b.2)</Label><Text>the imprisonment or detention to which they are sentenced for the offence in connection with which the order is made is suspended under section 215 or 216 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="445990" lims:id="445990"><Label>(c)</Label><Text>they are released from custody pending the determination of an appeal relating to the offence in connection with which the order is made; or</Text></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="445991" lims:id="445991"><Label>(d)</Label><Text>they are released from custody after serving the custodial portion of a sentence for the offence in connection with which the order is made.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-04-15" lims:fid="445992" lims:id="445992"><MarginalNote lims:inforce-start-date="2011-04-15" lims:fid="445993" lims:id="445993">First obligation to report</MarginalNote><Label>(2)</Label><Text>A person who is subject to an obligation under section 490.019 or 490.02901 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, section 227.06 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or section 36.1 of the <XRefExternal reference-type="act" link="I-20.6">International Transfer of Offenders Act</XRefExternal> shall report to a registration centre referred to in section 7.1</Text><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="445994" lims:id="445994"><Label>(a)</Label><Text>if they are not in custody on the day on which they become subject to the obligation, within seven days — or, if they are required to report to a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, within 15 days — after that day; and</Text></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="445995" lims:id="445995"><Label>(b)</Label><Text>in any other case, within seven days — or, if they are required to report to a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, within 15 days — after</Text><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="445996" lims:id="445996"><Label>(i)</Label><Text>they receive an absolute or conditional discharge under Part XX.1 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="445997" lims:id="445997"><Label>(i.1)</Label><Text>they receive an absolute or conditional discharge or are released from custody under Division 7 of Part III of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="445998" lims:id="445998"><Label>(i.2)</Label><Text>an imprisonment or a detention to which they are sentenced is suspended under section 215 or 216 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="445999" lims:id="445999"><Label>(ii)</Label><Text>they are released from custody pending the determination of an appeal, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446000" lims:id="446000"><Label>(iii)</Label><Text>they are released from custody after serving the custodial portion of a sentence.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-04-15" lims:fid="446001" lims:id="446001"><MarginalNote lims:inforce-start-date="2011-04-15" lims:fid="446002" lims:id="446002">Means of reporting</MarginalNote><Label>(3)</Label><Text>If a sex offender is required to report to a registration centre designated under this Act, they shall report in person. If they are required to report to a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, they shall report in person unless regulations are made under paragraph 227.2(a) of that Act, in which case they shall report in accordance with those regulations.</Text></Subsection><Subsection lims:inforce-start-date="2011-04-15" lims:fid="446003" lims:id="446003"><MarginalNote lims:inforce-start-date="2011-04-15" lims:fid="446004" lims:id="446004">Compliance before leaving Canada</MarginalNote><Label>(4)</Label><Text>A sex offender shall not leave Canada before they report under this section.</Text></Subsection><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2011-04-15" lims:fid="446006" lims:id="446006">2004, c. 10, s. 4; 2007, c. 5, s. 33; 2010, c. 17, s. 30</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2016-12-01" lims:lastAmendedDate="2016-12-01" lims:fid="446007" lims:id="446007"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446008" lims:id="446008">Subsequent obligation to report</MarginalNote><Label>4.1</Label><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446009" lims:id="446009"><Label>(1)</Label><Text>A sex offender shall subsequently report to the registration centre referred to in section 7.1,</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446010" lims:id="446010"><Label>(a)</Label><Text>within seven days after they change their main residence or any secondary residence or, if they are required to report to a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, within 15 days after the change;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446011" lims:id="446011"><Label>(b)</Label><Text>within seven days after they change their given name or surname or, if they are required to report to a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, within 15 days after the change;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446012" lims:id="446012"><Label>(b.1)</Label><Text>within seven days after they receive a driver’s licence or, if they are required to report to a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, within 15 days after they receive it;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446013" lims:id="446013"><Label>(b.2)</Label><Text>within seven days after they receive a passport or, if they are required to report to a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, within 15 days after they receive it; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446014" lims:id="446014"><Label>(c)</Label><Text>at any time between 11 months and one year after they last reported to a registration centre under this Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446015" lims:id="446015"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446016" lims:id="446016">Means of reporting</MarginalNote><Label>(2)</Label><Text>If a sex offender is required to report to a registration centre designated under this Act, they shall report in person or in accordance with regulations made under paragraph 18(1)(a) or subsection 19(1). 2007, c. 5, s. 36; 2010, c. 17, s. 33</HistoricalNoteSubItem></HistoricalNote></Section><Section lims:inforce-start-date="2016-12-01" lims:lastAmendedDate="2016-12-01" lims:fid="446030" lims:id="446030"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446031" lims:id="446031">Obligation to provide information</MarginalNote><Label>5</Label><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446032" lims:id="446032"><Label>(1)</Label><Text>When a sex offender reports to a registration centre, they shall provide the following information to a person who collects information at the registration centre:</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446033" lims:id="446033"><Label>(a)</Label><Text>their given name and surname, and every alias that they use;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446034" lims:id="446034"><Label>(b)</Label><Text>their date of birth and gender;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446035" lims:id="446035"><Label>(c)</Label><Text>the address of their main residence and every secondary residence or, if there is no such address, the location of that place;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446036" lims:id="446036"><Label>(d)</Label><Text>the address of every place at which they are employed or retained or are engaged on a volunteer basis — or, if there is no address, the location of that place — the name of their employer or the person who engages them on a volunteer basis or retains them and the type of work that they do there;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446037" lims:id="446037"><Label>(d.1)</Label><Text>if applicable, their status as an officer or a non-commissioned member of the Canadian Forces within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> and the address and telephone number of their unit within the meaning of that subsection;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446038" lims:id="446038"><Label>(e)</Label><Text>the address of every educational institution at which they are enrolled or, if there is no such address, the location of that place;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446039" lims:id="446039"><Label>(f)</Label><Text>a telephone number at which they may be reached, if any, for every place referred to in paragraphs (c) and (d), and the number of every mobile telephone or pager in their possession;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446040" lims:id="446040"><Label>(g)</Label><Text>their height and weight and a description of every physical distinguishing mark that they have;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446041" lims:id="446041"><Label>(h)</Label><Text>the licence plate number, make, model, body type, year of manufacture and colour of the motor vehicles that are registered in their name or that they use regularly;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446042" lims:id="446042"><Label>(i)</Label><Text>the licence number and the name of the issuing jurisdiction of every driver’s licence that they hold; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446066" lims:id="446066"><Label>(e)</Label><Text>of a change in address, location or date, before their departure or</Text><Subparagraph lims:inforce-start-date="2016-12-01" lims:fid="446067" lims:id="446067"><Label>(i)</Label><Text>if the change is made after their departure and they are staying in Canada, within seven days after the date on which the change is made, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-12-01" lims:fid="446068" lims:id="446068"><Label>(ii)</Label><Text>if the change is made after their departure and they are staying outside Canada, without delay after the date on which the change is made.</Text></Subparagraph></Paragraph></Subsection><Subsection lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="1425056" lims:id="1425056"><MarginalNote lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="1425057" lims:id="1425057">Exception</MarginalNote><Label>(1.02)</Label><Text>Despite paragraph (1)(a) or (1.01)(a) or (b), as the case may be, a sex offender who has a reasonable excuse for not complying with the requirement to give at least 14 days’ notice shall notify a person who collects information at the registration centre referred to in section 7.1 as soon as feasible before their departure of the dates of their departure and return and of every address or, if the address is unknown, every location at which they expect to stay in Canada or outside Canada.</Text></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446069" lims:id="446069"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446070" lims:id="446070">Canadian Forces</MarginalNote><Label>(1.1)</Label><Text>A sex offender who is required to notify a person who collects information at a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> and who requests the Chief of the Defence Staff to make a determination under section 227.16 of that Act shall provide the information relating to the operation within seven days after the date of their departure unless the determination is made during that period.</Text></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446071" lims:id="446071"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446072" lims:id="446072">Means of notification</MarginalNote><Label>(2)</Label><Text>If a sex offender is required to provide notification to a registration centre designated under this Act, they shall provide the notification by registered mail or in accordance with regulations made under paragraph 18(1)(a) or subsection 19(1). If they are required to provide notification to a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, they shall provide the notification by registered mail unless regulations are made under paragraph 227.2(a) of that Act, in which case they shall provide the notification in accordance with those centre</MarginalNote><Label>7.1</Label><Text>For the purposes of sections 4, 4.1, 4.3, 5.1 and 6, the registration centre is one that is designated under paragraph 18(1)(d) or subsection 19(1) that serves the area of the province in which the sex offender’s main residence is located, unless a registration centre designated under paragraph 227.2(e) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> serves a class of persons of which the sex offender is a member or the area in which the unit of the Canadian Forces in which the sex offender is serving lims:inforce-start-date="2011-04-15" lims:fid="446083" lims:id="446083">Registration of information</MarginalNote><Label>8</Label><Text>When a police service or the Commissioner of the Royal Canadian Mounted Police receives a copy of an order sent in accordance with paragraph 490.018(1)(d) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, either a person who registers information for the police service or one who registers it for the Commissioner shall</Text><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="446084" lims:id="446084"><Label>(a)</Label><Text>register without delay in the database only the name of the police service and the following information relating to the person who is subject to the order:</Text><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446085" lims:id="446085"><Label>(i)</Label><Text>their given name and surname,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446086" lims:id="446086"><Label>(ii)</Label><Text>the number that identifies a record of fingerprints collected from them under the <XRefExternal reference-type="act" link="I-1">Identification of Criminals Act</XRefExternal>, if such a record exists,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446087" lims:id="446087"><Label>(iii)</Label><Text>every offence to which the order relates,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446088" lims:id="446088"><Label>(iv)</Label><Text>when and where the offence or offences were committed,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446089" lims:id="446089"><Label>(v)</Label><Text>when and where the person was convicted of, or found not criminally responsible on account of mental disorder for, the offence or offences,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446090" lims:id="446090"><Label>(vi)</Label><Text>the age and gender of every victim of the offence or offences, and the victim’s relationship to the person,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446091" lims:id="446091"><Label>(vi.1)</Label><Text>the person’s method of operation in relation to the offence or offences, if that information is available to the person who registers information,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446092" lims:id="446092"><Label>(vii)</Label><Text>the date and duration of the order, and</Text></Subparagraph><Subparagraph lims:inforce-start-date="2011-04-15" lims:fid="446093" lims:id="446093"><Label>(viii)</Label><Text>the court that made the order; and</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="446094" lims:id="446094"><Label>(b)</Label><Text>ensure that the registration of the information is done in a manner and in circumstances that ensure its accordance with subsection 490.021(6) or 490.02903(3) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> — or receives a copy of the Form 1 delivered under subparagraph 8(4)(a)(ii) of the <XRefExternal reference-type="act" link="I-20.6">International Transfer of Offenders Act</XRefExternal> — a person who registers information for the Attorney General, or the minister of justice, shall register without delay in the database only the following information, as applicable, relating to the person named in the notice or Form 1, as the case may be:</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446100" lims:id="446100"><Label>(a)</Label><Text>their given name and surname;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446101" lims:id="446101"><Label>(b)</Label><Text>the number that identifies a record of fingerprints collected from them under the <XRefExternal reference-type="act" link="I-1">Identification of Criminals Act</XRefExternal>, if such a record exists;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446102" lims:id="446102"><Label>(c)</Label><Text>the date on which the notice was served;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446103" lims:id="446103"><Label>(d)</Label><Text>every offence listed in the notice or form;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446104" lims:id="446104"><Label>(e)</Label><Text>when and where the offence or offences were committed;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446105" lims:id="446105"><Label>(f)</Label><Text>when and where the person was convicted of, or found not criminally responsible on account of mental disorder for, the offence or offences;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446106" lims:id="446106"><Label>(g)</Label><Text>the age and gender of every victim of the offence or offences, and the victim’s relationship to the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446107" lims:id="446107"><Label>(g.1)</Label><Text>the person’s method of operation in relation to the offence or offences, if that information is available to the person who registers information;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446108" lims:id="446108"><Label>(h)</Label><Text>the expected duration of the obligation; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446109" lims:id="446109"><Label>(i)</Label><Text>in the case of a person referred to in paragraph 490.02(1)(b) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, the date, if any, on which the person last reported under the Ontario Act and the duration of their obligation to comply with section 3 of that Act.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446110" lims:id="446110"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446111" lims:id="446111">Registration of information — termination orders</MarginalNote><Label>(2)</Label><Text>When the Attorney General of a province, or the minister of justice of a territory, receives a notice referred to in subsection 490.016(3), 490.017(2), 490.027(3), 490.029(2), 490.02909(3), 490.0291(2), 490.02913(3) or 490.02914(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, a person who registers information for the Attorney General, or the minister of justice, shall register without delay in the database the fact that a termination order was made.</Text></Subsection><Subsection the minister of justice of a territory, may register in the database the fact that a person has applied in that jurisdiction for an exemption order under section 490.023, 490.02905, 490.029111 or 490.04 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="446114" lims:id="1425061"><MarginalNote lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="1425062" lims:id="1425062">Registration of information — exemption orders</MarginalNote><Label>(4)</Label><Text>When the Attorney General of a province, or the minister of justice of a territory, receives a notice referred to in section 490.025 or subsection 490.02907(1), 490.029114(1) or 490.07(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, a person who registers information for the Attorney General, or the minister of justice, shall register without delay in the database the fact that the court refused to make an exemption order under subsection 490.023(2), 490.02905(2), 490.029111(2) or 490.04(5) of that Act or that the appeal court dismissed an appeal from such a decision or quashed an exemption order.</Text></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446116" lims:id="446116"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446117" lims:id="446117">Registration of information</MarginalNote><Label>(5)</Label><Text>A person who registers information for the Attorney General of a province, or the minister of justice of a territory, may register in the database the day on which the custodial portion of a sex offender’s sentence or detention in custody begins, the days on which they are or are expected to be outside penitentiary as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="C-44.6">Corrections and Conditional Release Act</XRefExternal> or outside the provincial correctional facility, the address or location at which they stay or are expected to stay during that period and the date of their release or discharge if</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446118" lims:id="446118"><Label>(a)</Label><Text>the sex offender was prosecuted in that jurisdiction for the offence to which the sentence or detention relates; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446119" lims:id="446119"><Label>(b)</Label><Text>the offence was not prosecuted under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446120" lims:id="446120"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446121" lims:id="446121">Registration of information — Canada Border Services Agency</MarginalNote><Label>(5.1)</Label><Text>A person who registers information for the Commissioner of the Royal Canadian Mounted Police may register in the database the information disclosed to the Commissioner under subsection 15.2(2).</Text></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446122" lims:id="446122"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446123" lims:id="446123">Confidentiality and copy of information</MarginalNote><Label>(6)</Label><Text>A person who registers information under this section shall</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446124" lims:id="446124"><Label>(a)</Label><Text>ensure that the registration of the information is done in a manner and in circumstances that ensure its confidentiality; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446125" lims:id="446125"><Label>(b)</Label><Text>once the information is registered, on request, send the sex offender or the person served with a notice under section 490.021 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> a copy of all of the information relating lims:fid="446130" lims:id="446130"><Label>(1)</Label><Text>When the Canadian Forces Provost Marshal receives a copy of an order sent in accordance with subparagraph 227.05(1)(d)(iii) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, a person who registers information for the Provost Marshal shall register without delay in the database only the following information relating to the person who is subject to the order:</Text><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446131" lims:id="446131"><Label>(a)</Label><Text>their given name and surname;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446132" lims:id="446132"><Label>(b)</Label><Text>the number that identifies a record of fingerprints collected from them under the <XRefExternal reference-type="act" link="I-1">Identification of Criminals Act</XRefExternal>, if such a record exists;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446133" lims:id="446133"><Label>(c)</Label><Text>every offence to which the order relates;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446134" lims:id="446134"><Label>(d)</Label><Text>when and where the offence or offences were committed;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446135" lims:id="446135"><Label>(e)</Label><Text>when and where the person was convicted of, or found not criminally responsible on account of mental disorder for, the offence or offences;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446136" lims:id="446136"><Label>(f)</Label><Text>the age and gender of every victim of the offence or offences, and the victim’s relationship to the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446137" lims:id="446137"><Label>(f.1)</Label><Text>their method of operating in relation to the offence or offences, if that information is available to the person who registers information; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446138" lims:id="446138"><Label>(g)</Label><Text>the date and duration of the order.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446139" lims:id="446139"><MarginalNote lims:inforce-start-date="2014-06-01" lims:fid="446140" lims:id="446140">Registration of information — Canadian Forces</MarginalNote><Label>(2)</Label><Text>When the Canadian Forces Provost Marshal receives a copy of an affidavit of service and a notice sent in accordance with subsection 227.08(4) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, a person who registers information for the Provost Marshal shall register without delay in the database only the following information relating to the person who was served with the notice:</Text><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446141" lims:id="446141"><Label>(a)</Label><Text>their given name and surname;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446142" lims:id="446142"><Label>(b)</Label><Text>the number that identifies a record of fingerprints collected from them under the <XRefExternal reference-type="act" link="I-1">Identification of Criminals Act</XRefExternal>, if such a record exists;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446143" lims:id="446143"><Label>(c)</Label><Text>the date on which the notice was served;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446144" lims:id="446144"><Label>(d)</Label><Text>every offence listed in the notice;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446145" lims:id="446145"><Label>(e)</Label><Text>when and where the offence or offences were committed;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446146" lims:id="446146"><Label>(f)</Label><Text>when and where the person was convicted of, or found not criminally responsible on account of mental disorder for, the offence or offences;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446147" lims:id="446147"><Label>(g)</Label><Text>the age and gender of every victim of the offence or offences, and the victim’s relationship to the person;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446148" lims:id="446148"><Label>(g.1)</Label><Text>their method of operating in relation to the offence or offences, if that information is available to the person who registers information; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446149" lims:id="446149"><Label>(h)</Label><Text>the expected duration of the person’s obligation under section 227.06 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446150" lims:id="446150"><MarginalNote lims:inforce-start-date="2014-06-01" lims:fid="446151" lims:id="446151">Registration of information — Canadian Forces</MarginalNote><Label>(3)</Label><Text>When the Canadian Forces Provost Marshal receives a notice referred to in subsection 227.04(3), 227.13(3) or 240.5(3) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, a person who registers information for the Provost Marshal shall register without delay in the database the fact that a termination order was made.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446152" lims:id="446152"><MarginalNote lims:inforce-start-date="2014-06-01" lims:fid="446153" lims:id="446153">Registration of information — Canadian Forces</MarginalNote><Label>(4)</Label><Text>A person who registers information for the Canadian Forces Provost Marshal may register in the database the fact that a person has applied for an exemption order under section 227.1 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446154" lims:id="446154"><MarginalNote lims:inforce-start-date="2014-06-01" lims:fid="446155" lims:id="446155">Registration of information — Canadian Forces</MarginalNote><Label>(5)</Label><Text>When the Canadian Forces Provost Marshal receives a notice referred to in section 227.11 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, a person who registers information for the Provost Marshal shall register without delay in the database the fact that a court martial refused to make an exemption order under subsection 227.1(4) of that Act or that the Court Martial Appeal Court dismissed an appeal from such a decision or quashed an exemption order.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446156" lims:id="446156"><MarginalNote lims:inforce-start-date="2014-06-01" lims:fid="446157" lims:id="446157">Registration of information — Canadian Forces</MarginalNote><Label>(6)</Label><Text>If a sex offender was prosecuted under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> for the offence to which the sentence or detention relates, a person who registers information for the Canadian Forces Provost Marshal may register in the database</Text><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446158" lims:id="446158"><Label>(a)</Label><Text>the day on which the custodial portion of the sex offender’s sentence or detention in custody begins;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446159" lims:id="446159"><Label>(b)</Label><Text>the days on which they are or are expected to be outside the service prison or detention barrack as defined in subsection 2(1) of that Act and the address or location at which they stay or are expected to stay during that period; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446160" lims:id="446160"><Label>(c)</Label><Text>the date of their release or discharge.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446161" lims:id="446161"><MarginalNote lims:inforce-start-date="2014-06-01" lims:fid="446162" lims:id="446162">Registration of information — Canadian Forces</MarginalNote><Label>(7)</Label><Text>A person who registers information for the Canadian Forces Provost Marshal shall register without delay in the database</Text><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446163" lims:id="446163"><Label>(a)</Label><Text>the fact that a person is the subject of a determination under subsection 227.15(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, the effect of the determination on the person, the date on which the suspension of the time limit, proceeding or obligation first applies and the date on which it ceases to apply;</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446164" lims:id="446164"><Label>(b)</Label><Text>the fact that a person is the subject of a determination under subsection 227.16(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> and the date on which the determination was made; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446165" lims:id="446165"><Label>(c)</Label><Text>the fact that a person has become, or has ceased to be, subject to a regulation made under paragraph 227.2(a) or (e) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446166" lims:id="446166"><MarginalNote lims:inforce-start-date="2014-06-01" lims:fid="446167" lims:id="446167">Confidentiality and copy of information</MarginalNote><Label>(8)</Label><Text>A person who registers information under this section shall</Text><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446168" lims:id="446168"><Label>(a)</Label><Text>ensure that the registration of the information is done in a manner and in circumstances that ensure its confidentiality; and</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446169" lims:id="446169"><Label>(b)</Label><Text>once the information is registered under any of subsections (2) to (7), on request, send the sex offender or the person served with a notice under section 227.08 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> a copy of all of the information relating to them that is registered in the database, by registered lims:id="446172"><MarginalNote lims:inforce-start-date="2004-12-15" lims:fid="446173" lims:id="446173">Information to be given to sex offender</MarginalNote><Label>9</Label><Subsection lims:inforce-start-date="2004-12-15" lims:fid="446174" lims:id="446174"><Label>(1)</Label><Text>When a sex offender reports to a registration centre and provides satisfactory proof of their identity to a person who collects information, that person shall immediately inform them of</Text><Paragraph lims:inforce-start-date="2004-12-15" lims:fid="446175" lims:id="446175"><Label>(a)</Label><Text>the nature of their obligations under sections 4 to 6 and of the information that may be collected under sections 5 and 6; and</Text></Paragraph><Paragraph lims:inforce-start-date="2004-12-15" lims:fid="446176" lims:id="446176"><Label>(b)</Label><Text>the purpose for which the information is being collected.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2004-12-15" lims:fid="446177" lims:id="446177"><MarginalNote lims:inforce-start-date="2004-12-15" lims:fid="446178" lims:id="446178">Fingerprints</MarginalNote><Label>(2)</Label><Text>If a person who collects information has reasonable grounds to suspect that a person who is reporting to the registration centre as a sex offender under this Act is not the sex offender and no other proof of identity is satisfactory in the circumstances, they may take fingerprints from the person in order to confirm their identity.</Text></Subsection><Subsection lims:inforce-start-date="2004-12-15" lims:fid="446179" lims:id="446179"><MarginalNote lims:inforce-start-date="2004-12-15" lims:fid="446180" lims:id="446180">Destruction of fingerprints</MarginalNote><Label>(3)</Label><Text>Despite any other Act of Parliament, if the fingerprints provided under subsection (2) confirm that the person who is reporting is the sex offender, they shall not be disclosed, or used for any other purpose, and shall be destroyed without delay.</Text></Subsection><Subsection lims:inforce-start-date="2004-12-15" lims:fid="446181" lims:id="446181"><MarginalNote lims:inforce-start-date="2004-12-15" lims:fid="446182" lims:id="446182">Privacy and confidentiality</MarginalNote><Label>(4)</Label><Text>The person who collects information shall ensure that</Text><Paragraph lims:inforce-start-date="2004-12-15" lims:fid="446183" lims:id="446183"><Label>(a)</Label><Text>the sex offender’s privacy is respected in a manner that is reasonable in the circumstances; and</Text></Paragraph><Paragraph lims:inforce-start-date="2004-12-15" lims:fid="446184" lims:id="446184"><Label>(b)</Label><Text>the information is provided and collected in a manner and in circumstances that ensure its confidentiality.</Text></Paragraph></Subsection></Section><Section lims:inforce-start-date="2008-09-12" lims:lastAmendedDate="2008-09-12" lims:fid="446185" lims:id="446185"><MarginalNote lims:inforce-start-date="2008-09-12" lims:fid="446186" lims:id="446186">Registration of information</MarginalNote><Label>10</Label><Text>A person who registers information collected at a registration centre</Text><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446187" lims:id="446187"><Label>(a)</Label><Text>shall, subject to paragraph (b) and any regulations made under paragraph 19(3)(c), register without delay in the database only the information collected under sections 5 and 6, the date on which the sex offender reported or provided notification to the registration centre and the province of registration;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446188" lims:id="446188"><Label>(b)</Label><Text>may register at any time in the database the number that identifies a record of fingerprints collected from a sex offender under the <XRefExternal reference-type="act" link="I-1">Identification of Criminals Act</XRefExternal>, if such a record exists; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446189" lims:id="446189"><Label>(c)</Label><Text>shall ensure that the registration of the information is done in a manner and in circumstances that ensure its confidentiality.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem lims:inforce-start-date="2008-09-12" lims:fid="446191" information at a registration centre shall, free of charge,</Text><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446194" lims:id="446194"><Label>(a)</Label><Text>either give a copy of the information collected under section 5, dated and signed by the person who collected it, to the sex offender when they report to the registration centre in person and provide information under this Act, or send it to the sex offender by mail or another means agreed to by the sex offender, without delay after it is collected, if they report other than in person;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446195" lims:id="446195"><Label>(b)</Label><Text>send the sex offender a copy of the information collected under section 6, dated and signed by the person who collected it, by mail or another means agreed to by the sex offender, without delay after it is collected;</Text></Paragraph><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446196" lims:id="446196"><Label>(c)</Label><Text>send the sex offender a copy of all of the information relating to them that is registered in the database, by mail or another means agreed to by the sex offender, without delay once the information referred to in paragraph (a) is registered; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446197" lims:id="446197"><Label>(d)</Label><Text>at the request of the sex offender, send them a copy of all of the information relating to them that is registered in the database, by mail or another means agreed to by the sex offender, without delay once the information referred to in paragraph (b) is registered.</Text></Paragraph><HistoricalNote><HistoricalNoteSubItem for correction of information</MarginalNote><Label>12</Label><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446202" lims:id="446202"><Label>(1)</Label><Text>Subject to subsection (2), a sex offender or a person served with a notice under section 490.021 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or section 227.08 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> may, at any time, ask a person who collects information at the registration centre referred to in section 7.1 to correct any information relating to them that is registered in the database and that they believe contains an error or omission.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446203" lims:id="446203"><MarginalNote lims:inforce-start-date="2014-06-01" lims:fid="446204" lims:id="446204">Request for correction of information</MarginalNote><Label>(2)</Label><Text>The request shall be made to the Canadian Forces Provost Marshal if the information is registered in the database under section 8.2.</Text></Subsection><Subsection lims:inforce-start-date="2014-06-01" lims:fid="446205" lims:id="446205"><MarginalNote lims:inforce-start-date="2014-06-01" lims:fid="446206" lims:id="446206">Correction or notation</MarginalNote><Label>(3)</Label><Text>The person to whom the request is made shall, without delay, ensure that</Text><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446207" lims:id="446207"><Label>(a)</Label><Text>information in the database is corrected if they are satisfied that the information contains an error or omission; or</Text></Paragraph><Paragraph lims:inforce-start-date="2014-06-01" lims:fid="446208" lims:id="446214"><Label>(1)</Label><Text>The Commissioner of the Royal Canadian Mounted Police may authorize a person to consult information that is registered in the database, compare the information with other information or, by electronic means, combine the information with, or link it to, any other information contained in a computer system within the meaning of subsection 342.1(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, for research or statistical purposes.</Text></Subsection><Subsection lims:inforce-start-date="2008-09-12" lims:fid="446215" lims:id="446215"><MarginalNote lims:inforce-start-date="2008-09-12" lims:fid="446216" lims:id="446216">Conditions</MarginalNote><Label>(2)</Label><Text>The Commissioner shall not provide the authorization unless the Commissioner</Text><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446217" lims:id="446217"><Label>(a)</Label><Text>is satisfied that those purposes cannot reasonably be accomplished without consulting the information or without comparing or combining the information with, or linking it to, the other information, as the case may be; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446218" lims:id="446218"><Label>(b)</Label><Text>obtains from the person a written undertaking that no subsequent disclosure of the information or of any information resulting from the comparison or combination of the information with, or the linking of the information to, other information will be made, or be lims:id="1425064"><Label>(1)</Label><Text>Subject to subsections (2) and (3) and regulations made under paragraphs 19(3)(b) and (d), information that is registered in the database in accordance with this Act shall be kept in the database until 50 years have elapsed after the death of the sex offender to whom it relates.</Text></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="446228" lims:id="446228"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="446229" lims:id="446229">Permanent removal and destruction of information</MarginalNote><Label>(2)</Label><Text>Despite any other Act of Parliament, all information that is collected under this Act, or registered in the database, in connection with an order shall be destroyed and permanently removed from the database if</Text><Paragraph lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="446230" lims:id="1425066"><Label>(a)</Label><Text>the person who is subject to the order is finally acquitted of every offence in connection with which the order was made or receives a free pardon granted under Her Majesty’s royal prerogative of mercy or under section 748 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> for every such offence or is the subject of an expungement order under the <XRefExternal reference-type="act" link="E-21.5">Expungement of Historically Unjust Convictions Act</XRefExternal> for every such offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="446231" lims:id="1425067"><Label>(b)</Label><Text>the sentence for every offence in connection with which the order was made ceases to have force and effect under subsection 249.11(2) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="1425065" lims:id="1425065"><Label>(c)</Label><Text>the person who is subject to the order is granted an exemption order under subsection 490.04(5) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or on an appeal from a decision made under that subsection.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2018-06-21" lims:fid="446232" lims:id="446232"><MarginalNote lims:inforce-start-date="2018-06-21" lims:fid="446233" the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> shall be destroyed and permanently removed from the database if</Text><Paragraph lims:inforce-start-date="2018-06-21" lims:fid="446234" lims:id="446234"><Label>(a)</Label><Text>the person who is subject to the obligation is finally acquitted of every offence to which it relates or lims:fid="446245" lims:id="446245"><Label>(c)</Label><Text>the date of a sex offender’s release or discharge.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-04-15" lims:fid="446246" lims:id="446246"><MarginalNote lims:inforce-start-date="2011-04-15" lims:fid="446247" lims:id="446247">Provincial correctional authority</MarginalNote><Label>(2)</Label><Text>The person in charge of a provincial correctional facility may disclose to a person who registers information</Text><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="446248" lims:id="446248"><Label>(a)</Label><Text>the day on which a sex offender is received into the facility;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="446249" lims:id="446249"><Label>(b)</Label><Text>if a sex offender is expected to be temporarily outside the facility for seven or more days, the days on which they are expected to be outside, the days on lims:fid="446250" lims:id="446250"><Label>(c)</Label><Text>the date of a sex offender’s release or discharge.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2011-04-15" lims:fid="446251" lims:id="446251"><MarginalNote lims:inforce-start-date="2011-04-15" lims:fid="446252" lims:id="446252">Canadian Forces</MarginalNote><Label>(3)</Label><Text>The person in charge of a service prison or detention barrack as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> may disclose to a person who registers information</Text><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="446253" lims:id="446253"><Label>(a)</Label><Text>the day on which a sex offender is received into the prison or barrack;</Text></Paragraph><Paragraph lims:inforce-start-date="2011-04-15" lims:fid="446254" lims:id="446254"><Label>(b)</Label><Text>if a sex offender is expected to be temporarily outside the prison or barrack for seven or more days, the days on which they are expected to be outside, the days on which they are outside, the address or location at which they are expected to stay and the address or Code</XRefExternal> or in the laying of a charge for such an offence by collecting the information disclosed to it under paragraph 16(4)(j.2) or (j.3) as well as the following information with respect date of their departure from Canada;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446262" lims:id="446262"><Label>(b)</Label><Text>the date of their return to Canada; and</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446263" lims:id="446263"><Label>(c)</Label><Text>every address or location at which they have stayed outside Canada.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446264" lims:id="446264"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446265" lims:id="446265">Canada Border Services Agency — disclosure of information</MarginalNote><Label>(2)</Label><Text>The Canada Border Services Agency may, in assisting the member or employee of, or person retained by, a police service referred to in subsection (1), disclose to the Commissioner of the Royal Canadian Mounted Police any information collected under paragraphs (1)(a) to consult any information that is collected under this Act or registered in the database, unless they are</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446274" lims:id="446274"><Label>(a)</Label><Text>a member or employee of, or a person retained by, a police service who consults the information for the purpose of preventing or investigating a crime of a sexual nature or an offence under section 490.031, 490.0311 or 490.0312 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="446275" lims:id="1425070"><Label>(b)</Label><Text>a member or employee of, or a person retained by, a police service in the province in which a sex offender’s main residence is located who consults the information to verify compliance by the sex offender with an order or with an obligation under section 490.019 or 490.02901 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, section 227.06 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or section 36.1 of the <XRefExternal reference-type="act" link="I-20.6">International Transfer of Offenders Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446276" lims:id="446276"><Label>(b.1)</Label><Text>a person who collects information at a registration centre designated under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> who consults the information to verify compliance by a sex offender who is subject to the Code of Service Discipline — or who is an officer, or non-commissioned member, of the primary reserve as defined in section 227 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> — with an order or with an obligation under section 490.019 or 490.02901 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, section 227.06 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or section 36.1 of the <XRefExternal reference-type="act" link="I-20.6">International Transfer of Offenders Act</XRefExternal>;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446277" lims:id="446277"><Label>(c)</Label><Text>a person who collects or registers information who consults the information in order to exercise the functions or perform the duties assigned to them under an Act of Parliament;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446278" lims:id="446278"><Label>(d)</Label><Text>a person who is authorized under section 13 to consult information that is registered in the database for research or statistical purposes and who does so for those purposes;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446279" lims:id="446279"><Label>(e)</Label><Text>the Commissioner of the Royal Canadian Mounted Police or a person authorized by the Commissioner who consults information that is collected under this Act or registered in the database in order to perform the duties of the Commissioner under this Act, under subsection 490.03(1) or (2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or under subsection 227.18(1) or 227.19(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446280" lims:id="446280"><Label>(f)</Label><Text>a member or employee of, or a person retained by, the Royal Canadian Mounted Police who is authorized to consult the information for the purpose of administering the database and who does so for that purpose.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446281" lims:id="446281"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446282" lims:id="446282">Unauthorized comparison of information</MarginalNote><Label>(3)</Label><Text>No person shall compare any information that is collected under this Act or registered in the database with any other information unless</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446283" lims:id="446283"><Label>(a)</Label><Text>the information was consulted in accordance with paragraph (2)(a) and they compare it with other information for the purpose of preventing or investigating a crime of a sexual nature;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446284" lims:id="446284"><Label>(b)</Label><Text>the information was consulted in accordance with paragraph (2)(b) or (b.1) and they compare it with other information for the purpose of verifying compliance by the sex offender with an order or with an obligation under section 490.019 or 490.02901 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, section 227.06 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or section 36.1 of the <XRefExternal reference-type="act" link="I-20.6">International Transfer of Offenders Act</XRefExternal> or for the purpose of preventing or investigating an offence under section 490.031, 490.0311 or 490.0312 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> — or an offence under any of those provisions that is punishable under section 130 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> — or an offence under section 119.1 of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446285" lims:id="446285"><Label>(b.1)</Label><Text>the information was collected under subsection 15.2(1) and they compare it with other information for the purpose of assisting a member or an employee of, or a person retained by, a police service in the prevention or investigation of a crime of a sexual nature or an offence under section 490.031 or 490.0311 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or in the laying of a charge for such an offence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446286" lims:id="446286"><Label>(c)</Label><Text>they compare the information in accordance with an authorization under section 13.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446287" lims:id="446287"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446288" lims:id="446288">Unauthorized combination or linking of information</MarginalNote><Label>(3.1)</Label><Text>No person shall, by electronic means, combine any information that is collected under this Act or registered in the database with, or link it to, any other information contained in a computer system within the meaning of subsection 342.1(2) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> unless</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446289" lims:id="446289"><Label>(a)</Label><Text>they combine the information that is registered in the database with, or link it to, information contained in the sex offender registry established under the Ontario Act, for the purpose of registering information under section 8, 8.1 or 10;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446290" lims:id="446290"><Label>(a.1)</Label><Text>the information was consulted in accordance with paragraph (2)(a) and they combine it with, or link it to, law enforcement information for the purpose of preventing or investigating a crime of a sexual nature;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446291" lims:id="446291"><Label>(a.2)</Label><Text>the information was consulted in accordance with paragraph (2)(b) or (b.1) and they combine it with, or link it to, law enforcement information for the purpose of verifying the sex offender’s compliance with an order or with an obligation under section 490.019 or 490.02901 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, section 227.06 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or section 36.1 of the <XRefExternal reference-type="act" link="I-20.6">International Transfer of Offenders Act</XRefExternal> or for the purpose of preventing or investigating an offence under section 490.031 or 490.0311 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, an offence under either of those provisions that is punishable under section 130 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or an offence under section 119.1 of that Act;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446292" lims:id="446292"><Label>(a.3)</Label><Text>the information was collected under subsection 15.2(1) and they combine it with information contained in a computer system of the Canada Border Services Agency for the purpose of assisting a member or an employee of, or a person retained by, a police service in the prevention or investigation of a crime of a sexual nature or an offence under section 490.031 or 490.0311 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or in the laying of a charge for such an offence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446293" lims:id="446293"><Label>(b)</Label><Text>they combine or link information in accordance with an authorization under section 13.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446294" lims:id="446294"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446295" lims:id="446295">Unauthorized disclosure</MarginalNote><Label>(4)</Label><Text>No person shall disclose any information that is collected under this Act or registered in the database or the fact that information relating to a person is collected under this Act or registered in the database, or allow it to be disclosed,</Text><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446296" lims:id="446296"><Label>(a)</Label><Text>unless the disclosure is to the sex offender, or the person served with a notice under section 490.021 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or section 227.08 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, to whom the information relates;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446297" lims:id="446297"><Label>(b)</Label><Text>unless the disclosure is expressly authorized under this Act, the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or the <XRefExternal reference-type="act" link="N-5">National Defence investigate an offence under section 17 or to lay a charge for such an offence,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="1425071" lims:id="1425071"><Label>(i.1)</Label><Text>to enable them to verify the sex offender’s compliance with section 5,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="446300" lims:id="1425073"><Label>(ii)</Label><Text>to enable them to prevent or investigate a crime of a sexual nature, an offence under section 119.1 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>, an offence under section 490.031 or 490.0311 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or an offence under either of those provisions that is punishable under section 130 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or to enable them to lay a charge for such an offence,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="446301" lims:id="1425074"><Label>(iii)</Label><Text>to enable them to investigate a criminal offence or a service offence within the meaning of subsection 2(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> or to lay a charge for such an offence, as long as the investigation or charge results from an investigation referred to in subparagraph (ii), or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="1425072" lims:id="1425072"><Label>(iv)</Label><Text>to enable them to obtain a warrant under subsection 490.03121(1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> and execute the warrant;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446302" lims:id="446302"><Label>(d)</Label><Text>unless the disclosure is to a prosecutor and is necessary to enable the prosecutor to determine whether a charge for an offence resulting from an investigation referred to in paragraph (c) should be laid;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446303" lims:id="446303"><Label>(e)</Label><Text>unless the disclosure is to a person who is responsible under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> for laying, referring or preferring a charge for a service offence and to a person who provides legal advice with respect to the charge, and the disclosure is necessary to enable them to determine whether a charge for a service offence resulting from an investigation referred to in paragraph (c) should be laid, referred or preferred;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446304" lims:id="446304"><Label>(f)</Label><Text>unless the disclosure is to a prosecutor, judge or justice in a proceeding relating to an application for a search warrant in connection with an investigation referred to in paragraph (c), and the information is relevant to the application;</Text></Paragraph><Paragraph lims:inforce-start-date="2023-10-26" lims:enacted-date="2023-10-26" lims:fid="1425075" lims:id="1425075"><Label>(f.1)</Label><Text>unless the disclosure is to a prosecutor, judge or justice in a proceeding relating to an application for a warrant referred to in subparagraph (c)(iv), and the information is relevant to the application;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446305" lims:id="446305"><Label>(g)</Label><Text>unless the disclosure is to a person who is authorized under the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> to issue a search warrant in connection with the investigation of a service offence and to a person who provides legal advice with respect to the issuance of the search warrant, and the information is relevant to an application for a search warrant in connection with an investigation referred to in paragraph (c);</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446306" lims:id="446306"><Label>(h)</Label><Text>unless the information disclosed is relevant to the proceeding, appeal or review and the disclosure is</Text><Subparagraph lims:inforce-start-date="2022-06-20" lims:enacted-date="2019-06-21" lims:fid="446307" lims:id="1352998"><Label>(i)</Label><Text>to a prosecutor in connection with a proceeding that results from an investigation referred to in paragraph (c) and that is before a <DefinitionRef>court of criminal jurisdiction</DefinitionRef> or a <DefinitionRef>superior court of criminal jurisdiction</DefinitionRef>, as defined in section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, or a <DefinitionRef>court martial</DefinitionRef>, as defined in subsection 2(1) of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal>,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2016-12-01" lims:fid="446308" lims:id="446308"><Label>(ii)</Label><Text>to the Attorney General within the meaning of section 2 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal>, or the Minister of National Defence or counsel instructed by the Minister, in connection with an appeal of a decision made in such a proceeding,</Text></Subparagraph><Subparagraph lims:inforce-start-date="2022-06-20" lims:enacted-date="2019-06-21" lims:fid="446309" lims:id="1352999"><Label>(iii)</Label><Text>to the court or military judge presiding over the proceeding or appeal, or</Text></Subparagraph><Subparagraph lims:inforce-start-date="2022-06-20" lims:enacted-date="2019-06-21" lims:fid="446310" lims:id="1353000"><Label>(iv)</Label><Text>to a review authority referred to in section 163.6 of the <XRefExternal reference-type="act" link="N-5">National Defence Act</XRefExternal> for its review under that section and to a person who provides legal advice to the review authority in connection with that review;</Text></Subparagraph></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446311" lims:id="446311"><Label>(i)</Label><Text>unless the disclosure to the person is necessary to assist an investigation of any act or omission referred to in subsection 7(4.1) of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> by a police service in the state where the act or omission was committed;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446312" lims:id="446312"><Label>(j)</Label><Text>unless the disclosure is to an employee of, or a person retained by, a person referred to in any of paragraphs (d) to (i) who is authorized by that person to receive information disclosed under that paragraph on their behalf;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446313" lims:id="446313"><Label>(j.1)</Label><Text>unless the disclosure is to a member or an employee of, or a person retained by, a police service outside Canada and is necessary to assist them in the prevention or investigation of a crime of a sexual nature;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446314" lims:id="446314"><Label>(j.2)</Label><Text>unless the disclosure is to the Canada Border Services Agency, is limited to the information referred to in paragraphs 5(1)(a), (b), (i) and (j) and is necessary to assist a member or an employee of, or a person retained by, a police service in the prevention or investigation of a crime of a sexual nature or an offence under section 490.031 or 490.0311 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or in the laying of a charge for such an offence;</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446315" lims:id="446315"><Label>(j.3)</Label><Text>unless the disclosure is to the Canada Border Services Agency, relates to a sex offender who is convicted of a sexual offence against a child and who poses a high risk of committing a crime of a sexual nature, is limited to the information referred to in paragraphs 5(1)(a), (b), (i) and (j) and is made for the purpose of assisting a member or an employee of, or a person retained by, a police service in the prevention or investigation of a crime of a sexual nature or an offence under section 490.031 or 490.0311 of the <XRefExternal reference-type="act" link="C-46">Criminal Code</XRefExternal> or in the laying of a charge for such an offence; or</Text></Paragraph><Paragraph lims:inforce-start-date="2016-12-01" lims:fid="446316" lims:id="446316"><Label>(k)</Label><Text>unless the disclosure is by a person who is authorized under section 13 to consult information that is registered in the database or to compare or combine that information with, or link it to, other information, the disclosure is for research or statistical purposes and it is not made, or allowed to be made, in a form that could reasonably be expected to identify any individual to whom it relates.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2016-12-01" lims:fid="446317" lims:id="446317"><MarginalNote lims:inforce-start-date="2016-12-01" lims:fid="446318" lims:id="446318">Unauthorized use</MarginalNote><Label>(5)</Label><Text>No person shall use any information that is collected under this Act or registered in the database, or allow it to be used, for a purpose other than that for which it is consulted, compared, combined, linked or disclosed, as the case may be, the means by which designated classes of persons may report under section 4.1 or 4.3, or provide notification under section 6, to registration centres designated under paragraph register information; and</Text></Paragraph><Paragraph lims:inforce-start-date="2008-09-12" lims:fid="446333" lims:id="446333"><Label>(d)</Label><Text>designating places or classes of places in the province as registration centres, and the area of the province served by each registration centre.</Text></Paragraph></Subsection><Subsection lims:inforce-start-date="2008-09-12" lims:fid="446334" lims:id="446334"><MarginalNote lims:inforce-start-date="2008-09-12" lims:fid="446335" lims:id="446335">Regulations</MarginalNote><Label>(2)</Label><Text>Subject to subsection (3), the lieutenant governor in council of a province may, by regulation, exercise the power of the Governor in Council with respect to any matter referred to in paragraph 19(3)(a) if the Governor in Council does not
